30Delegation by Prime Minister

#### 30 Delegation by Prime Minister (1) The Prime Minister may, in writing, delegate all or any of the Prime Minister’s functions or powers under this Act to: (a) any Minister; or (b) an SES employee, or an acting SES employee, in either of the following: (i) the Department administered by the Prime Minister; (ii) the Department administered by the Minister; or (c) a member of the staff of the PWSS who is an SES employee or an acting SES employee. > Note: Sections 34AA to 34A of the Acts Interpretation Act 1901 contain provisions relating to delegations. (2) In performing a delegated function or exercising a delegated power, the delegate must comply with any written directions of the Prime Minister. (3) To avoid doubt, subsection (1) does not apply in relation to functions or powers conferred on the Prime Minister merely in the capacity of parliamentarian or office‑holder.
