Melbourne City Link Regulations 2019

The Regulations concentrate on a set of tightly defined operational concepts for toll collection and evidence: prescribed tolling devices, digital files and checksums, testing and certification, notice placement, exemption categories, and administrative parameters for enforcement.

Prescribed tolling devices. Regulation 9 prescribes two device types as the sole recognised tolling devices for recording a vehicle's use of a toll zone: a digital toll camera unit and a tag. The definition of digital toll camera unit in reg 4 lists discrete model identifiers (for example Kapsch Part Number 8633 001-415 and several Kapsch VRX and FX series units). The tag definition likewise lists specific transponder models (including Kapsch TRP4010, multiple Kapsch TS models and Q‑Free OBU615F). The Regulations therefore take a model-specific approach to device prescription, tying evidentiary rules to an enumerated set of device types and models.

Digital files, images and checksums. The Regulations define a digital file as a digital image plus metadata (toll zone, date/time data, checksum) (reg 4). A toll message file is the control unit-produced file containing the toll zone, date/time, and checksums for the related digital files and for the toll message file itself (reg 4). Regulation 12 prescribes the process by which an image or message is produced so it will satisfy sections 88(b) and 89(4)(e) of the Act: creation of a digital file, checksum verification by a computer (recalculation and exact-match confirmation), and production of a printed image containing the image plus a message showing toll zone and date/time. The checksum requirement is the central integrity test for evidentiary admissibility as prescribed by the Regulations.

Testing and testing officers. A "testing officer" is strictly defined (reg 4) and includes academic heads or authorised delegates in certain engineering faculties, persons or classes approved by the Secretary to the Department of Transport and Planning, a person from a NATA-accredited testing facility, or an engineer who meets degree and professional membership criteria and has approval by the President of the Victorian Division of Engineers Australia. Regulation 11 sets procedural obligations: the testing officer must be satisfied the unit is correctly positioned and maintained (11(1)(a)), make a full record of the test with serial number, date/time, statement of compliance and the testing officer's name/qualifications (11(1)(b)‑(c)), provide that record to the relevant corporation and enforcement agency within 21 days (11(2)), and the relevant corporation must retain the record for at least one year (11(3)).

Notices and driver information. Regulations 7-8 require the Link corporation, with consent of the responsible road authority, to place notices on specified connecting freeways and connecting roads listed in Schedule 1, before each entrance to the Link/Extension road, facing approaching drivers, and at a reasonable distance for safe avoidance (reg 7). Notices must state that a toll zone is being approached and that tolls will apply, and may provide registration instructions and other assistance information (reg 8).

Certificates. Regulations 13-16 prescribe the form and content of various certificates used under the Act: enforcement agency certificates (reg 13), certificates from the Head, Transport for Victoria or Secretary DTP (reg 14), certificates under s 89(3A) for assignment/possession of registration numbers (reg 15), and certificates by the relevant corporation (reg 16). Each certificate must include prescribed statements about appearance of matters in records, registration status according to certain records, or the issuer's knowledge and belief as to truth.

Exemptions and administrative amounts. Regulation 5 gives the relevant corporation power to exempt vehicles or classes from registration under Part 4 of the Act, including conditional and time-limited exemptions. Regulation 6 lists classes of vehicles exempt from toll payment (ambulances, fire units, police, Defence and certain emergency vehicles), and specifies the statutory source of the exemption power (sections 72A(b) and 73(6) of the Act). Regulation 17 prescribes a 28‑day nomination rejection period (section 72AA(1)(a) of the Act), and reg 18 prescribes a $40 administrative amount for orders under section 76(1) of the Act.

Interoperability and legal linkages. The Regulations tie evidentiary processes to the Act (sections 88 and 89), and reference other statutes for definitions and cross-references: Road Management Act 2004 (responsible road authority definition), Road Safety Act 1986 (vehicle registration), Education and Training Reform Act 2006 (testing officer institutions), Ambulance Services Act 1986, Emergency Management Act 2013 and others for exemption qualifications (reg 6).

Procedural timelines and records. Testing frequencies are set: after repair/modification and prior to first use post-repair, otherwise within 24 months before use (reg 10(c)). Testing officers must provide test records within 21 days (reg 11(2)). The relevant corporation keeps test records for at least one year (reg 11(3)). The nomination rejection period is fixed at 28 days from invoice (reg 17).

Scope limitations and sunset. The Regulations revoke prior subordinate rules and are made under s 118 of the Act (regs 2-3). The Endnotes state the Regulations were made 30 July 2019 and will sunset 10 years after making (30 July 2029) per the Subordinate Legislation Act 1994. The document also records two subsequent amendment instruments: S.R. No. 150/2019 and S.R. No. 99/2025, with changes reflected throughout the text.

The main concepts therefore form a connected operational framework: enumerated devices and models, integrity via checksum and controlled processes for image production, defined and qualified testers with record-keeping obligations, notice placement duties requiring consent from the responsible road authority, narrowly defined exempt vehicle classes, specified administrative monetary quantum for certain orders, and detailed certificate forms to be used as evidence in proceedings under the Act.

Primary decision-makers and operational actors. The Regulations place duties principally on the "relevant corporation" (the Link corporation), the enforcement agency, testing officers, the Head of Transport for Victoria and the Secretary to the Department of Transport and Planning. The Link corporation must place notices (reg 7), manage testing records (reg 11(2)-(3)), and issue certificates under s 89(4) in the prescribed form (reg 16). The enforcement agency receives test records and issues certificates under reg 13. The Secretary and Head have roles in issuing registration/assignment certificates (regs 14-15).

Vehicle operators and drivers. Any driver who approaches or uses the Link or Extension road is affected by notice placement rules (regs 7-8) and the device-based recording regime (regs 9-12). Vehicle operators whose vehicles are on the enumerated exempt lists (reg 6) are directly affected by toll liability: certain ambulances, specified fire service units, police, Australian Defence Force vehicles in specified uses, and emergency vehicles under specified agencies are exempt from tolls (reg 6). Fleet managers and commercial operators will be affected by registration exemptions the relevant corporation may grant under reg 5, and by evidentiary procedures for toll charges.

Device vendors and integrators. The Regulations prescribe specific models of digital toll camera units and tags (reg 4 definitions). Vendors whose hardware is not listed will not be recognised under the Regulations as a prescribed device, which affects procurement, interoperability and replacement strategies. The model-specific prescription means equipment suppliers to the Link system must match the enumerated Kapsch models or Q‑Free OBU615F tag if they want compatibility with the evidentiary pathway set out by the Regulations.

Testing personnel and accredited facilities. Testing officers, as defined in reg 4, are central. Categories include academic heads or authorised people in relevant university/TAFE faculties, NATA-accredited testing facility officers, individuals with specific engineering degrees and professional membership plus approval by Engineers Australia’s Victorian Division President, and persons approved by the Secretary to the Department of Transport and Planning. Such persons gain procedural authority to test toll camera units and produce records that enforcement agencies and the relevant corporation rely on. NATA-accredited testing facilities and approved individuals will therefore see demand for camera testing and certification.

Responsible road authorities. The placement of notices on connecting freeways and roads requires the consent of the responsible road authority (reg 7). That gives responsible road authorities a gatekeeping role over whether notices are sited and how the Link corporation can inform drivers approaching toll zones. It is therefore an inter-agency coordination point between the Link corporation and the road authority designated under the Road Management Act 2004.

Courts and litigants. The Regulations are closely tied to evidentiary provisions of the Act (for example the processes to produce admissible images under sections 88(b) and 89(4)(e) of the Act; regs 12, 13-16). Prosecutors, defence lawyers and courts will be affected by the strict requirements for checksum verification and the form of certificates. The $40 prescribed administrative amount under reg 18 affects parties subject to court orders under s 76 of the Act.

Administrative staff and record-keepers. The relevant corporation must retain test records for at least one year (reg 11(3)). Testing officers must provide records within 21 days (reg 11(2)). Administrative workflows inside the relevant corporation, enforcement agency and testing entities must be configured to meet these timeframes and maintain specified record content (serial numbers, dates, testing officer details).

Road users who rely on registration information. Regulation 15 ties evidentiary certificates to records of the Secretary to the Department of Transport and Planning with respect to registration assignments. Persons named in certificates (e.g., registrants) and those contesting assignment or nomination will be affected by the 28‑day nomination rejection window (reg 17) and the way certificates can certify assignment or entitlement to number plates (reg 15).

Indirectly affected parties. Insurance companies, lease companies, and corporate fleet managers will be affected operationally: they will rely on notice placement to warn drivers, on device and image evidence to adjudicate toll disputes, and on the nomination/rejection timeline to respond to invoices. Technology service providers (software for checksum verification, file storage and control unit processing) will be affected by the technical specification requirements in regs 4 and 12.

Geographical coverage. The Regulations apply to the Link road, the Extension road, the western and southern links described in the Act (reg 4 definitions), and to explicitly listed connecting freeways and roads in Schedule 1. The placement of notices is only required at the connecting freeways and roads set out in reg 7 and Schedule 1; other notice placement is allowed but not prescribed (reg 7(4)).

Who bears costs. Practical costs fall on different actors: the Link corporation bears costs of notice placement and retesting/maintenance coordination; vehicle operators bear tolls except where exemption applies; testing facilities and officers carry testing workload and record-provision obligations; the enforcement agency and relevant corporation handle certificate issuance and data verification costs; and equipment vendors must ensure their devices match the enumerated models or otherwise may not be used within the prescribed evidentiary framework.

In short, the Regulations affect a network of public bodies (Link corporation, enforcement agency, Transport for Victoria, Secretary DTP, responsible road authorities), technical actors (testing officers, device vendors), and road users (drivers, operators, fleet managers), with roles and responsibilities tightly defined in the text.

The Regulations allocate duties and confirm certain rights in narrow, procedural terms. Below are the principal obligations and the corresponding rights that arise from the text.

Duties of the relevant corporation / Link corporation

• Place notices. The Link corporation must, with the consent of the responsible road authority, cause notices to be placed on specified connecting freeways and roads before each entrance to the Link road and at reasonable distances for safe avoidance; notices must be adjacent to the carriageway and face approaching drivers (reg 7(1)-(3)). The consent requirement creates a duty to coordinate with the responsible road authority.
• Retain test records. The relevant corporation must retain records provided by testing officers for at least one year after testing (reg 11(3)).
• Issue certificates. The relevant corporation (or authorised person) may issue certificates under s 89(4) in the prescribed form (reg 16).

Duties of the testing officer

• Test to prescribed standards. A testing officer must ensure the digital toll camera unit is positioned to take registration images, comply with reg 10(a), be satisfied that maintenance or repairs are satisfactory, and make a full and accurate test record including serial number, date/time and a statement that the unit satisfied the requirements (reg 11(1)(a)-(b)).
• Sign and state qualifications. The testing officer must sign the record and set out name and qualifications (reg 11(1)(c)).
• Provide records promptly. The testing officer must give the test record to the relevant corporation and a copy to the enforcement agency within 21 days of testing (reg 11(2)).

Duties of the enforcement agency

• Receive records and issue certificates. The enforcement agency receives copies of test records (reg 11(2)(b)) and issues certificates under s 89(1) in the prescribed form (reg 13).
• Certify matters in records. A certificate issued by the enforcement agency must state that the matters set out in the certificate appear in or can be calculated from the enforcement agency's records and that the issuer believes the matters are true and correct (reg 13).

Duties associated with device use and data integrity

• Device positioning and testing frequency. A digital toll camera unit must be positioned to capture registration numbers and transmit images to a control unit, be tested according to reg 11, and be tested after repair/modification before first use or, otherwise, within 24 months before use (reg 10(a)-(c)).
• Digital file creation and checksum verification. For an image or message to be produced by a prescribed process, a digital file must be created by the unit (reg 12(2)) and a computer must recalculate and confirm the checksum is identical to that contained in the digital file or the toll message file (reg 12(1)(b)(i-ii)). The printed image must include the image plus a message indicating the toll zone and date/time (reg 12(1)(c)).

Duties of the Link corporation and responsible road authority in notice placement

• Consent and coordination. Notices may only be placed with consent of the responsible road authority (reg 7). The Link corporation must ensure notices are located at specified connecting freeways and roads (reg 7(1)-(3)).
• Content obligations. Notices must indicate a toll zone is being approached and that tolls apply; they may provide registration information and other assistance (reg 8).

Duties and limits on exemptions

• Exercise of exemption power. Under reg 5 the relevant corporation may exempt vehicles from registration under Part 4 of the Act; exemptions can be unconditional or conditioned, identical or varied between classes, and time-limited. The power is discretionary.
• Prescribed toll exemptions. Reg 6 prescribes explicit classes of vehicles that are exempt from toll payment (ambulances, specified fire services, police, Defence uses, emergency vehicles under named agencies). The text limits these exemptions to the classes enumerated; other exemptions would require action under reg 5.

Rights conferred or preserved

• Drivers’ right to notice. Drivers approaching the Link/Extension road are entitled to have warning notices placed in the specified locations before entry so they can safely avoid entering a toll zone (reg 7(1)(d); reg 8(1)).
• Right to records and challenge timeframe. A person nominated in a statement as the responsible person is granted 28 days from invoice issue to give a nomination rejection statement to an authorised person (reg 17).
• Evidentiary rights for authorities. The enforcement agency, Head Transport for Victoria and the Secretary to Department of Transport and Planning have express authority to issue certificates in the prescribed form (regs 13-15), enabling them to produce sworn or certified documentary proof admissible under the Act.

Administrative amounts and court orders

• The prescribed administrative amount is $40 per proven charge for court orders under s 76(1) of the Act (reg 18). This sets a fixed administrative quantum for courts to order in relevant proceedings.

Record-keeping and timing duties

• Testing officers must provide records within 21 days (reg 11(2)); the relevant corporation must retain for at least one year (reg 11(3)). Digital toll camera units must be tested after any repair/modification before first use, or otherwise within 24 months (reg 10(c)).

Operational consequences of duties

• Device conformity. Only listed device models are prescribed as tolling devices (reg 9 and reg 4 definitions), making conformant equipment necessary for evidentiary compliance.
• Evidence production obligations. The checksum recalculation and printed-image requirements (reg 12) impose technical duties on the control unit and the computer used for verification to produce admissible printed evidence.

Limits and delegations

• Consent requirements create a sharing of decision-making authority with the responsible road authority (reg 7). The relevant corporation may authorise persons to issue certificates (reg 16) and may make exemptions under reg 5 subject to conditions.

In all, the Regulations impose specific technical and procedural duties on the Link corporation, enforcement agency, testing officers and others, while securing rights for drivers to prior notice and for agencies to use defined evidentiary pathways and administrative amounts. All duties are tied to precise timeframes, record content and device specifications that must be observed to generate admissible evidence and comply with the Act.

The Regulations themselves are primarily procedural and technical; they do not create new criminal offences in their text. Instead, they provide the evidentiary, procedural and administrative scaffolding for enforcement under the Melbourne City Link Act 1995, and prescribe an administrative monetary amount for court orders.

Evidentiary pathway and enforcement mechanics

• Evidence under the Act. The Regulations prescribe how images and messages are to be produced to satisfy sections 88(b) and 89(4)(e) of the Act (reg 12). That prescribed process , digital file creation, checksum verification, printed image containing toll zone and timestamp , is the mechanism by which the enforcement agency can establish photographic or digital record evidence in proceedings under the Act. Regulations 13-16 prescribe the form of certificates admissible under sections 89(1), 89(2), 89(3A) and 89(4) of the Act. The effect is to standardise and streamline evidentiary proof in enforcement actions brought under the Act.

Administrative monetary amount and court orders

• Reg 18 prescribes an administrative amount of $40 in respect of each charge found proven for the purposes of section 76(1) of the Act. Section 76(1) of the Act (not reproduced in the Regulations) empowers the court to order payment of an administrative amount; the Regulations fix that amount at $40 per proven charge. This is the only direct monetary quantum the Regulations establish. The Regulations do not themselves set penalty points, fines or criminal sanctions; those remain within the Act.

Enforcement actors

• The enforcement agency is the body that receives test records (reg 11(2)(b)), issues certificates (reg 13) and likely initiates enforcement under the Act. The relevant corporation issues prescribed certificates under reg 16 and retains records per reg 11(3). The Secretary and Head Transport for Victoria produce registration-related certificates (regs 14-15). The practical enforcement ecosystem, therefore, is composed of these administrative actors plus the courts applying the Act with the Regulations providing prescribed forms and methods of technical proof.

Procedural safeguards and timings relevant to enforcement

• Nomination and rejection timetable. Reg 17 prescribes the period for someone nominated in a statement to give a nomination rejection statement to an authorised person: 28 days from the date on which an invoice is issued to the person nominated. This is an enforcement-related procedural limitation that fixes a defence window; failure to act within 28 days is likely to have consequences under the Act’s rules on nomination and liability (the Act provisions, not reproduced here, govern the consequence).
• Testing records and disclosure. Testing officers must provide records to both the relevant corporation and the enforcement agency within 21 days (reg 11(2)). The retention requirement (at least one year, reg 11(3)) affects evidentiary availability in prosecutions or civil proceedings.

Standards for admissibility and challenge points

• Checksum verification. Reg 12 requires a computer to recalculate checksums and confirm identity between recalculated checksums and the checksum contained in the digital file or toll message file (reg 12(1)(b)(i-ii)). This technical integrity check is the evidentiary frontier: failure to perform or document the recalculation as prescribed undermines the prescribed process and may be susceptible to challenge in court.
• Certificate contents. Certificates must state prescribed matters (regs 13-16). If a certificate lacks the statements required by those regulations, parties may contest its sufficiency as evidence under the Act’s certificate provisions.

Limitations on penalties within the Regulations

• No separate penalty schedule. The Regulations do not introduce new offences or penalties; instead they feed into enforcement under the Act. The only monetary figure provided is the administrative amount for court orders (reg 18). Penalties, notice offences, or fines remain as established in the Act; the Regulations standardise the means of proving contraventions rather than expanding penalty categories.

Inter-agency enforcement interplay

• Consent and the responsible road authority. Placement of notices requires the consent of the responsible road authority (reg 7). In practical terms, the responsible road authority participates in the notice process that underpins enforceability (drivers must reasonably be warned before entering toll zones). If notices are not placed or are deficient, that could feed into arguments in enforcement proceedings that notice was inadequate, affecting the enforcement agency’s ability to sustain charges.

Procedural enforcement risks and gaps

• Record retention window is limited. The relevant corporation must keep test records for at least one year (reg 11(3)). If enforcement actions or discovery demands extend beyond that period, the absence of retained records could impair evidence-ahead prosecutions.
• Device list specificity creates evidentiary choke points. Only devices and tags enumerated in reg 4 are prescribed; images or messages generated by non-prescribed devices may not meet the prescribed process and could be contested in enforcement proceedings on admissibility grounds.

In summary, the Regulations function as an evidentiary and procedural template for enforcement under the Melbourne City Link Act 1995. They prescribe how authorities must produce and verify digital evidence, how certificates are to be formed, the timelines for testing and nomination, and a fixed administrative amount for courts. They do not themselves create new offences or directly expand penalty regimes; enforcement action and sanctions remain matters for the parent Act and the courts, with these Regulations supplying the technical steps for admissible proof.

The Regulations are subordinate legislation made under section 118 of the Melbourne City Link Act 1995 (reg 2) and operate as a detailed procedural adjunct to that Act’s enforcement, registration and tolling framework. They intersect with several other statutory regimes by reference and operational dependency.

Melbourne City Link Act 1995

• Primary source. The Regulations are made under s 118 of the Act (reg 2) and repeatedly reference specific provisions of the Act as the legal context for their prescriptions: exemptions under sections 72A(b) and 73(6) and the registration exemption power under s 73(5) (regs 5-6), evidentiary provisions under ss 88 and 89 (reg 12; regs 13-16), nomination processes under s 72AA (reg 17) and administrative amounts under s 76 (reg 18). The Regulations therefore function to operationalise parts of the Act by setting prescribed forms, technical processes and timeframes.

Road Management Act 2004

• Responsible road authority. The term "responsible road authority" is defined by reference to s 3(1) of the Road Management Act 2004 (reg 4). Regulation 7 conditions the placement of notices on the consent of the responsible road authority. This creates an inter-legislative coordination point: the Link corporation cannot unilaterally place notices where the Road Management Act identifies a particular authority as responsible.

Road Safety Act 1986

• Registration source records. Regulation 14 and 15 expressly require certificates to certify registration matters "according to the records of" the Head, Transport for Victoria or the Secretary to the Department of Transport and Planning, specifically referencing registration under the Road Safety Act 1986 (reg 14(b)). Thus, registration status and assignment of registration numbers under the Road Safety Act are the authoritative base for certificates used in toll enforcement.

Ambulance Services Act 1986, Emergency Management Act 2013, Emergency Services statutes

• Exemption references. Regulation 6 grants toll exemptions to vehicles under the control of ambulance services defined by the Ambulance Services Act 1986, to emergency agencies recognised under the Emergency Management Act 2013, and to specified emergency service authorities (for example Fire Rescue Victoria, Country Fire Authority) (reg 6). These cross-references tether toll exemption status to definitions and institutional arrangements in other statutes.

Education and Training Reform Act 2006; Engineers Australia and NATA

• Testing officer qualifications. The definition of testing officer in reg 4 refers to heads of faculties or authorised persons in universities and TAFE institutes within the meaning of the Education and Training Reform Act 2006, to NATA accreditation, and to Engineers Australia membership and approval. This links the technical testing regime to accreditation and professional qualification regimes under separate statutory and professional bodies.

Subordinate legislation interpretation and sunset

• Interpretation Act and Subordinate Legislation Act. The Endnotes make interpretative references (ILA and statutory interpretation notes) and record that the Regulations were made 30 July 2019 and will sunset 10 years after making under the Subordinate Legislation Act 1994 (endnotes). Those external statutory rules determine the shelf-life and interpretative weight of headings, notes and other formal elements.

Certificates and court evidence rules

• The Regulations prescribe certificates that rely on the records of other statutory bodies (for example Secretary DTP records, Head Transport for Victoria records). Those certificates interact with the Act’s certificate admissibility provisions (ss 89(1)-(4)), and through those provisions they interact with the rules of evidence applied in court. The Regulations standardise contents to make certificates acceptable under the Act, which in turn affects how evidence from other statutes' records (vehicle registration, assignment of number plates) is incorporated into toll enforcement cases.

Procurement, competition and contract law (indirect)

• Device model listings. The Regulations prescribe particular device models and tags by manufacturer and model number (reg 4). Although not directly altering procurement law, the device prescription affects procurement choices, potentially favouring suppliers whose devices are listed. That interacts with public procurement obligations and tender processes that the Link corporation or relevant corporation will follow; procurement officers must ensure that contracted devices produce digital files and checksums as required.

Privacy and data protection (indirect)

• Personal data and images. The Regulations mandate creation, verification and retention of digital images and associated metadata (reg 4 definitions; reg 12). While the Regulations do not reference privacy statutes directly, the operational handling of images and personal data will fall within applicable privacy and data-protection frameworks (for example the Privacy and Data Protection Act 2014 in Victoria). Compliance with those data-protection obligations will therefore be an operational overlay on the processes the Regulations prescribe.

Other subordinate instruments

• The Regulations explicitly revoke earlier Melbourne City Link Regulations (reg 3) and note subsequent amending instruments S.R. No. 150/2019 and S.R. No. 99/2025 (Endnotes). Practitioners must therefore read the Regulations together with their amending instruments and check the consolidated version (this instrument states it incorporates amendments as at 30 September 2025).

In short, the Regulations are deeply integrated with the Act and reference a range of other statutes for definitional and operational purposes. They impose technical and evidentiary rules that depend on external record-keeping regimes (vehicle registration), accreditation and professional approval processes (testing officers), and the consent of road authorities defined by the Road Management Act. They do not displace those other regimes but require operational coordination with them.

This consolidated instrument incorporates subsequent amendments and revocations; the Endnotes and marginal notations identify the key amending instruments and dates. The Regulations were made 30 July 2019 and incorporate amendments to 30 September 2025.

Original instrument and commencement

• The Melbourne City Link Regulations 2019 (S.R. No. 68/2019) were made on 30 July 2019 by the Governor in Council under section 118 of the Melbourne City Link Act 1995 and came into operation on 30 July 2019 (Endnotes, General information).

Revocations

• Regulation 3 revokes the Melbourne City Link Regulations 2009 (S.R. No. 7/2009) and its 2012 and 2014 amendment instruments (S.R. Nos 114/2012 and 168/2014). Reg 3 explicitly listed those earlier subordinate instruments as revoked.

Publication and savoring

• The Endnotes' Table of Amendments records the two amending instruments (S.R. No. 150/2019 and S.R. No. 99/2025), with their dates of making and commencement. The consolidated version states it incorporates amendments as at 30 September 2025.

Sunset provision

• The Endnotes reference the Subordinate Legislation Act 1994: the Regulations will sunset 10 years after making, i.e., on 30 July 2029 (Endnotes, General information). Depending on the instrument's amendment history, this sunset remains relevant and indicates that, absent further action, the Regulations cease to operate on that date.

Interpretative and stylistic changes

• The Endnotes also include interpretative guidance referencing the Interpretation of Legislation Act 1984 and set out that headings, notes and provision numbers form part of the Statutory Rule, and provide other style rules. These are not amendments to operative content but affect how the instrument should be read and applied.

Practical implications for users

• Users must consult amending instruments and the consolidated version to ensure they rely on the current prescriptions. The consolidated text before you includes amendments up to 30 September 2025, and practitioners should watch for any further amending S.R.s and for the approaching sunset date (30 July 2029) which may require legislative renewal or replacement.

In short, the Regulations were initiated in 2019, have been amended at least twice (2019, 2025), have revoked earlier subordinate instruments, and include stylistic and definitional updates that have been folded into this consolidated text.

The text of the Regulations does not include judicial decisions or a litigation history. There are no cases, appeals or judicial interpretations recorded within the instrument or its Endnotes. The Regulations themselves reference evidentiary provisions in the Melbourne City Link Act 1995 (ss 88 and 89) for which litigation might exist outside this instrument, but no cases are named in the Regulations.

What the instrument shows about litigation-relevant mechanisms

• Evidentiary prescriptions. The Regulations prescribe the process by which an image or message is to be produced so it will satisfy sections 88(b) and 89(4)(e) of the Act (reg 12), and they prescribe the form of certificates under ss 89(1)-(4) (regs 13-16). These areas are common loci for litigation in tolling and automated enforcement regimes (challenges to device accuracy, chain of custody, certificate sufficiency, and data integrity), but the Regulations present procedural remedies rather than judicial decisions.
• Technical and admissibility points likely to be litigated. The checksum verification process (reg 12(1)(b)), the requirement that the computer recalculate the checksum and confirm identity, and the strict listing of device models in the digital toll camera unit and tag definitions (reg 4) are technical features that litigants could challenge in courts when contesting toll notices or enforcement actions. The testing officer’s record-keeping obligations (reg 11) and the retention period (at least one year, reg 11(3)) are other potential areas where litigation could explore whether the prescribed process was followed.

Practical guidance for litigators and researchers

• Search external sources. Because this instrument does not contain a litigation history, practitioners must search court databases, tribunal records and published decisions for cases that invoke the Melbourne City Link Act and these Regulations. The Regulations’ cross-references to the Act (sections 76, 72AA, 88, 89, etc.) will guide searches for litigation that addresses evidentiary questions or enforcement under the Act.
• Anticipate technical challenges. Based on the Regulations’ technical prescriptions, the plausible litigation vectors include: challenges to checksum verification and data integrity; questions about whether a device used was a prescribed model; sufficiency and form of certificates under regs 13-16; adequacy of notices under regs 7-8; and timeliness or completeness of testing records required by reg 11.

Absence of reported decisions in the instrument

• The Regulations do not cite any judicial decisions or administrative determinations. The Endnotes focus on interpretative matters and amendments, not litigation. Users should therefore treat the Regulations as a procedural framework and consult case law separately for how courts have treated these processes in practice.

In sum, the consolidated Regulations do not themselves record any litigation history. The text sets out multiple technical elements that are likely to be contested in enforcement proceedings under the Act, but any judicial treatment of those issues must be sourced from external case law research rather than the instrument itself.

The Regulations contain several precise, technical prescriptions that create points of operational risk, ambiguity and potential challenge. Below are concrete "gotchas" drawn from the text that practitioners and administrators should note.

Model-specific device prescription

• Only listed devices count. The definition of digital toll camera unit and tag in reg 4 list specific makes and part numbers. If a camera unit or tag is not one of the enumerated models, it is not a prescribed tolling device under reg 9. Practical consequence: images or data produced by non‑prescribed devices may not meet the prescribed evidentiary process in reg 12 and therefore could be contested in enforcement proceedings. Procurement or hardware replacement that fails to match the listed models may therefore produce non‑admissible evidence.

Checksum exact-match requirement

• Rigid checksum test. Reg 12 requires a computer to recalculate the checksum for each digital file and confirm that the recalculated checksum is identical to the checksum contained in the digital file, or the checksum for that digital file contained in the toll message file (reg 12(1)(b)). Any divergence , due to different algorithms, file conversions, metadata changes or storage-system modifications , risks rendering the printed image non-prescribed and potentially inadmissible under the Act’s evidentiary rules.

Control unit and toll message file responsibilities

• Chain of custody and control. The toll message file contains checksums for each related digital file and for itself (reg 4 definition). The prescribed process relies on a control unit producing a toll message file and a computer performing verification. If the control unit's storage, file-copying or transmission introduces any change to file contents (e.g., different file headers), checksum mismatches may arise. Administrators must ensure the end-to-end processing preserves exact file contents or document the process to show compliance with reg 12.

Testing frequency and repair rule

• Testing after repair and 24-month rule. Reg 10(c) requires testing "in the case of a unit that has been repaired or modified, after the repairs or modifications ... and before the unit's first use after the repairs or modifications" and otherwise within 24 months before use. The "first use after repairs or modifications" requirement means that any untested post-repair use could invalidate the prescribed process. Administrators must schedule immediate post-repair testing before returning units to service.

Testing officer qualifications and approvals

• Multiple approval pathways. Testing officers can be heads of faculty, NATA-accredited facility officers, persons approved by the Secretary or individual engineers meeting degree, membership and presidential approval requirements (reg 4). Confusion may arise over which personnel qualify in practice, and approvals by the Secretary or the President of Engineers Australia are discretionary administrative steps that must be documented. Failure to use an appropriately authorised testing officer may invalidate test records under reg 11.

Record-keeping window

• Retention only one year. The relevant corporation must retain a test record for at least one year after testing (reg 11(3)). Enforcement cases or discovery requests that reach back beyond one year may therefore lack supporting test records. If an audit, civil claim or court action requires older testing records, the limited retention period could be a problem.

Consent of responsible road authority for notices

• Consent gate. The Link corporation must obtain the consent of the responsible road authority to place notices on connecting freeways and specified connecting roads (reg 7). Practically, disagreement or delay from the responsible road authority could delay notice placement, with knock-on effects for driver notice and potential arguments over inadequate warning in enforcement proceedings. "Reasonable distance" for placement is not numerically specified, creating scope for dispute.

Notice content flexibility but mandatory basics

• Mandatory phrase and optional assistance. Notices must state that a vehicle is approaching a toll zone and that tolls will apply (reg 8(1)), but beyond that the content is discretionary and depends on Link corporation plus road authority consent (reg 8(2)). The mandatory/optional split means some required content can be omitted only at the discretion of the Link corporation and road authority, which could affect driver awareness.

Certificates require issuer belief wording

• Certificates must state that matters are true "to the knowledge and belief" of the issuer (regs 13-16). The common law recognises that certificate wording is significant; if an issuer lacks adequate knowledge or belief, the certificate may be vulnerable to challenge. Agencies must ensure that issuers have sufficient information and that certificates are signed by authorised persons.

Nomination rejection period ties to invoice date

• Fixed 28-day window. Reg 17 prescribes the timeframe for a nominated person to give a nomination rejection statement: 28 days from invoice issuance. Practical problem: if an invoice is delayed, the statutory rejection window may shrink; conversely, uncertainty about the invoice's issue date can cause disputes about whether the 28‑day deadline was met.

Administrative amount may be out of step with inflation

• Fixed $40 per proven charge. Reg 18 fixes an administrative amount of $40 per charge for court orders (reg 18). Over time this figure may become outdated relative to actual administrative costs and may not be indexed. Courts have to apply this fixed amount where s 76(1) applies.

Ambiguity over "reasonable distance" and "adjacent to the carriageway"

• Subjective locational criteria. Regulations require notices be "adjacent to the carriageway" and placed at a "reasonable distance before each entrance" so drivers can safely avoid entering (reg 7). These terms are not numerically defined and could be interpreted differently in disputes about whether notice placement met the Regulations' requirements.

Limited scope for other notices

• The Regulations permit the Link corporation, with consent, to place notices other than those referred to in reg 7(4). However, if the Link corporation relies solely on the prescribed locations, some approach routes may lack adequate warning, creating exposure to arguments that signage was insufficient.

Interoperability and vendor lock-in risk

• Model list may create operational dependency. The Regulations' specific model lists may effectively lock the Link system to particular vendors (Kapsch and Q‑Free) unless the Regulations are amended. That raises procurement and competition questions for operators and governments.

Data privacy and handling not addressed in the text

• No explicit data protection prescriptions. The Regulations require creation, transmission and retention of digital images and metadata but do not set out privacy safeguards, storage security standards beyond checksum verification, or retention limits for the image/toll message files themselves. Data protection obligations therefore arise from separate laws and must be layered on by the administering bodies.

In short, the principal gotchas are the model-specific device list, the exact-match checksum requirement, the narrow retention period for testing records, consent requirements for notice placement, subjective locational standards, and procedural timing points (21-day testing record provision; 28-day nomination rejection). Administrators and lawyers should treat these as concrete implementation risks that must be managed in operations, procurement and litigation strategy.

Compliance requires coordinated action across technical, administrative and legal functions. Below are concrete, actionable steps mapped to the Regulations' provisions to help operators, testing officers, enforcement agencies and relevant corporations comply.

1. Device procurement and mapping (regs 4, 9)

• Use only prescribed devices. Acquire and deploy only the digital toll camera units and tags listed in reg 4 if you intend to rely on the prescribed evidentiary pathway. That list includes specific Kapsch models and the Q‑Free OBU615F tag.
• Maintain a device inventory. Record serial numbers and model identifiers for every installed unit to meet the retesting and certification record requirements (reg 11(1)(b)(i)).

2. Camera positioning and technical configuration (reg 10)

• Position units to capture registration numbers, and transmit images to a control unit as required (reg 10(a)). Document positioning plans, including photos or engineering diagrams, to evidence compliance.
• Establish a maintenance log for each unit, including dates of repairs, modifications and routine maintenance, so that post-repair testing obligations are triggered and tracked (reg 10(c)(i)-(ii)).

3. Testing officer selection and testing procedures (regs 4, 11)

• Authorise qualified testing officers. Use testing officers who fall into an accepted category (university/TAFE head or authorised delegate; NATA-accredited facility officer; Secretary-approved person; or an engineer meeting degree, Engineers Australia membership, and presidential approval) (reg 4).
• Pre-approve testing officer list. Keep a register of approved testing officers and their qualifications to evidence that tests were performed by persons authorised under the Regulations.
• Implement a testing protocol. Have an internal testing protocol that mirrors reg 11: check compliance with reg 10(a), inspect maintenance and repairs, prepare full records listing the serial number, date/time and that testing requirements were satisfied, sign and include the testing officer’s name and qualifications (reg 11(1)(a)-(c)).
• Deliver records promptly. Ensure testing officers provide the record to the relevant corporation and the enforcement agency within 21 days of testing (reg 11(2)) and that the relevant corporation retains the record for at least one year (reg 11(3)).

4. Digital file handling and checksum verification (regs 4, 12)

• Maintain an end-to-end file integrity process. Ensure digital files created by camera units include the digital image, toll zone data, date/time data and checksum (reg 4). The control unit must create toll message files containing checksums for related files and for itself (reg 4).
• Use a documented checksum algorithm. The Verification computer must recalculate checksums using the same, documented algorithm and confirm an exact match between recalculated checksum and that contained in the digital file or toll message file (reg 12(1)(b)(i-ii)). Record the verification process and log the results for each piece of evidence produced.
• Produce printed images with required messaging. When producing admissible printed images, include the image plus a message indicating the toll zone and the date/time the vehicle was used in the toll zone (reg 12(1)(c)). Maintain copies of both the digital file and the printed image with verification logs.

5. Notice placement and coordination with road authorities (regs 7-8, Schedule 1)

• Obtain responsible road authority consent. Before placing notices on connecting freeways or Schedule 1 connecting roads, obtain written consent from the relevant responsible road authority (reg 7(1)). Keep records of consent and any conditions imposed by the authority.
• Install prescribed signage. Place notices at the specified locations set out in reg 7 and Schedule 1, adjacent to the carriageway, facing approaching drivers and at a reasonable distance to allow safe avoidance (reg 7(1)(c)-(d)). Record exact sign locations with GPS coordinates and photos to document compliance.
• Ensure content compliance. Make notices state that a vehicle is approaching a toll zone and that tolls will apply (reg 8(1)). Where helpful, include registration instructions and assistance information (reg 8(2)(a)-(b)).

6. Certificates and administrative documentation (regs 13-16)

• Use prescribed certificate templates. Prepare standard certificate templates matching regs 13-16, and ensure they include the required statements: identification of issuing authority, statements about records and the issuer’s knowledge and belief in the certificate matter (regs 13-16).
• Designate authorised signatories. Ensure only authorised persons sign certificates (enforcement agency, Head of Transport for Victoria, Secretary DTP, relevant corporation or authorised persons) and keep delegations and authorisation documents on file.

7. Nomination rejection and invoice processes (reg 17)

• Invoice management. Track invoice issue dates carefully. The 28‑day nomination rejection period runs from the invoice issue date (reg 17). Implement processes to deliver invoices with verifiable issue dates (email with timestamp, postal certificate of posting) and to log delivery.
• Provide clear nominee information. When issuing invoices or nomination statements, include instructions on how to submit a nomination rejection statement and contact details for authorised persons.

8. Administrative amount and court orders (reg 18)

• Apply $40 administrative amount. When seeking or responding to a court order under s 76(1) of the Act, account for the prescribed administrative amount of $40 in respect of each charge found proven (reg 18). Ensure court filings and settlement calculations reflect this figure.

9. Records retention and discovery readiness (reg 11(3))

• Keep test records for at least one year. The relevant corporation must retain test records for at least one year (reg 11(3)). Implement a records retention schedule so that test records, checksum logs, control unit files and printed images are retained in line with the Regulations and any applicable privacy/data retention laws.

10. Privacy and data security

• Layer privacy compliance. While the Regulations do not prescribe privacy standards, images and metadata involve personal information. Apply applicable privacy laws (for example, the Privacy and Data Protection Act 2014) to storage, access control, retention and deletion. Implement encryption, access logs and minimisation to reduce exposure.
• Data destruction policies. Coordinate data destruction policies with the statutory retention requirements. If other laws require longer retention for certain purposes, reconcile those timelines with the one‑year testing record minimum.

11. Procurement and vendor compliance

• Contractual warranties. When contracting with device vendors (Kapsch, Q‑Free or others), include warranties and technical obligations to ensure device software/hardware will generate digital files and checksums compatible with the verification process in reg 12.
• Change-control procedure. Establish a change-control regime: before modifying or upgrading devices, schedule re-testing and verification and document pre‑ and post‑modification test results (reg 10(c)(i)).

12. Audit, training and incident response

• Audit the compliance chain. Regularly audit the device fleet, testing records, checksum verification logs and certificate issuance to ensure ongoing compliance.
• Training for authorised staff. Train testing officers, data administrators and enforcement staff on the exact technical steps required for checksum recalculation, file handling and certificate preparation.
• Incident and dispute handling. For dispute-prone areas (checksum mismatch, missing records, signage consent disputes), create a documented incident-response process to preserve evidence and report to the enforcement agency.

13. Liaison with responsible road authorities and other agencies

• Memoranda of understanding. Use formal MOUs with responsible road authorities to codify consent terms on notice placement and maintenance obligations (reg 7).
• Co-ordinate with Transport for Victoria and Secretary DTP. For certificate and registration matters, keep regular lines of communication to facilitate prompt issuance and accuracy of registration-related certificates (regs 14-15).

14. Legal review and monitoring

• Monitor amendments. The Regulations have been amended (S.R. No. 150/2019 and S.R. No. 99/2025). Maintain a process for monitoring further S.R.s and the approaching sunset date (Endnotes).
• Legal sign-off for evidence. Before relying on digital images and certificates in enforcement proceedings, obtain legal sign-off to confirm that the prescribed process under reg 12 was strictly followed and documented.

By implementing these operational steps , procurement, precise positioning, authorised testing, checksum verification, careful record-keeping, coordinated notice placement, certificate standardisation, privacy layering and legal monitoring , the Link corporation, enforcement agencies, testing officers and vendors can align practice with the Regulations’ technical and procedural prescriptions.
