12 General overview of authorisation conditions for (1) The Act, section 44 requires a person who is authorised to deal with a medicine to comply with any condition to which the authorisation is subject. Section 31 sets out the authorisation conditions for a person or endorsed health practitioner who is authorised to prescribe a medicine.
(2) The conditions are additional to other restrictions on a person’s or endorsed health practitioner’s authority to deal with a medicine. Note Conditions may also be imposed under other provisions of the Act including, for example, s 89 which sets out conditions on licences.
Part 2.2 Relationship with registration laws Part 2.2 Relationship with registration laws 20 Medicines authorisations subject to Health Practitioner Regulation National Law (ACT) restrictions A health practitioner’s authorisation under the Act to deal with a medicine is subject to any condition or other restriction to which the health practitioner is subject under the Health Practitioner Regulation National Law (ACT). Section 31 places conditions on the prescribing of medicines by a health practitioner authorised to prescribe the medicines. If a particular health practitioner’s registration under the Health Practitioner Regulation National Law (ACT) is subject to the condition or restriction that the person may not prescribe certain medicines, the health practitioner’s authorisation under the Medicines, Poisons and Therapeutic Goods Act 2008 to prescribe medicines is also subject to that condition or restriction.
