226 Review procedure (1) In hearing the application, the Local Court must review afresh the merits of the reconsidered decision. (2) In doing so, the Local Court is not bound by anything done by the CHO in making the reconsidered decision.
Medicines, Poisons and Therapeutic Goods Act 2012 122 (3) Without limiting subsection (2), the Local Court may: (a) consider evidence that was not considered by the CHO; and (b) disregard evidence that was considered by the CHO.
