sec.43 Offence to apply poisons
This section applies in relation to a poison other than an S5 or S6 poison. A person must not apply a poison unless the poison is lawfully supplied to the person and the person— applies the poison in the authorised way; or has a reasonable excuse. Maximum penalty—200 penalty units. s 43 amd 2021 No. 12 s 231 (sec.43-ssec.1) This section applies in relation to a poison other than an S5 or S6 poison. (sec.43-ssec.2) A person must not apply a poison unless the poison is lawfully supplied to the person and the person— applies the poison in the authorised way; or has a reasonable excuse. Maximum penalty—200 penalty units.
- (a) applies the poison in the authorised way; or
- (b) has a reasonable excuse.
