What it does
This Act authorises the Treasurer of Victoria to execute guarantees on behalf of the State for loans made to the Master Builders' Association of Victoria, subject to express statutory constraints and conditions. Mechanically, the Act does three things.
First, it creates the power. Section 2(1) confers on the Treasurer the power to execute a guarantee in favour of any person or body guaranteeing repayment of a loan to be made to the Association. The statutory power is permissive, not mandatory; it is an enabling provision for the Treasurer to provide a State guarantee.
Second, it prescribes the substantive limits and conditions on that power. Section 2(2) restricts guarantees to loans that satisfy three cumulative tests: the loan must be for implementing a scheme approved by the Treasurer to enable the employment of apprentices (s 2(2)(a)); the loan’s terms and conditions must be approved by the Treasurer (s 2(2)(b)); and the loan must not exceed an amount currently set by the Treasurer as the maximum for such loans (s 2(2)(c). Section 2(3) then sets further contractual and procedural features that the guarantee may or must contain, including that the guarantee may cover interest and enforcement expenses (s 2(3)(a)), that the creditor may be required to take and hold securities as the Treasurer requires (s 2(3)(b)), that the Treasurer’s liability is conditional on the creditor first exhausting its rights under securities to the Treasurer’s satisfaction (s 2(3)(c)), that assignment of the benefit of the guarantee is prohibited without the Treasurer’s written consent (s 2(3)(d)), and that the Treasurer may determine the form and other terms of the guarantee (s 2(3)(e)).
Third, it provides for payment. Section 3 appropriates any sums that become due under guarantees authorised by the Act from the Consolidated Fund. The appropriation is explicit: all sums that may from time to time become due and payable by the Treasurer under any guarantee authorised by the Act shall be paid out of the Consolidated Fund (s 3).
