Married Persons Property Act 1986

This Act relies on a small number of repeating legal mechanisms: statutory equality of capacity, rebuttable presumptions about title and trust, conversion events, protection of third-party purchasers, and court‑based remedies. Each concept is expressed in short, textual provisions that interact.

Equality of capacity (s 3). The Act flatly states parity in legal capacity between married women and married men for "all purposes" except where another Territory law provides otherwise (s 3(1)). The phrase covers personal, official, representative and fiduciary capacities and is explicitly prospective and retrospective in application to marriages before or after commencement and outside the ACT (s 3(2)). This is a generalising device that replaces or overrules older common-law incapacity rules specific to married women in property contexts.

Presumptions of gift, advancement and ownership (s 9, s 11, s 12). The Act contains several statutory presumptions that operate unless "the contrary intention appears." Section 9(1) treats transfers by a woman to her husband (or to their child or someone standing in place of a parent) as giving rise to the same presumptions of gift or advancement that would apply to a man making similar transfers (s 9(1)(a)-(d)). Section 11 presumes that property bought with housekeeping allowances belongs to the payer and spouse (or partner) as joint tenants, absent agreement to the contrary. Section 12 treats a beneficiary plus spouse as two separate persons when construing gifts to two or more persons as joint tenants or tenants in common, affecting the calculation of shares under a testamentary or other instrument.

Statutory trust and conversion on contingency (s 10). Section 10 contains a forced trust rule where a transfer made "in contemplation of" marriage, civil union or civil partnership results in the transferee holding the property on trust for the transferor until the marriage/union occurs, and then holding absolutely (s 10(1)). Analogous rules apply to joint vestings (s 10(2)) and to the case where both parties contribute to purchase in contemplation of marriage (s 10(3)), with a pre-marriage tenancy in common in shares proportionate to contributions becoming a joint tenancy on the marriage. These rules create a temporal shift in beneficial interests triggered by the occurrence of marriage or union.

Authority to pledge spouse’s credit and agency of necessity (ss 4-5). Section 4 establishes a symmetrical presumption that a husband living with his wife has the same presumed authority to pledge his wife’s credit as a wife has to pledge her husband’s. The subsection expressly extends to two people in a domestic partnership. Section 5, however, eliminates any prior rule allowing a married woman to act as agent of necessity for her husband in pledging his credit or borrowing on his credit , the Act removes that equitable device for the ACT.

Restrictions on anticipation/alienation (s 6). Section 6 renders void any instrument executed after commencement that purports to attach to a woman’s enjoyment of property any restriction on anticipation or alienation that could not have been attached to a man’s enjoyment of that property. This provision functions as a non‑discrimination rule for instruments limiting the alienability of property held by women.

Non‑liability for pre-marriage debts (s 7). A married person is not liable for a spouse’s debts incurred before marriage. The provision is categorical and does not contain an express exception for guarantees or where the spouse later assumes the debt by contract; its plain wording is "A married person is not liable for any debt incurred by his or her spouse before their marriage."

Court jurisdiction and remedies (ss 13-15). The Act allows a person, or a third party facing competing claims, to apply to the court to determine questions about title, possession or disposition (s 13). The Act defines "court" as the Supreme Court or the Magistrates Court (s 2). The Magistrates Court’s jurisdiction is subject to the Magistrates Court Act 1930, including s 264 (proceedings affecting title to land) and s 257(1) monetary limits (s 14). The court may grant interim injunctions, make orders for sale, partition or division of proceeds, and set aside dispositions done to defeat an existing or apprehended order (s 15(1)-(3)). It must have regard to purchasers in good faith and may protect such persons (s 15(4)). The court may order restoration of invested money and profits to a spouse whose money was invested by the other spouse without consent (s 15(5)). A third party applying under s 13 is treated as a stakeholder (s 15(6)). The powers include wide fact‑finding and investigative directions (s 15(7)).

Interpretive and definitional scaffolding. The Act contains a dictionary (s 1A and the dictionary at the end), and it points readers to definitions and interpretive provisions in the Legislation Act 2001 (see notes to s 1A and the dictionary). The Act’s reach therefore depends in practice on those cross‑references for terms such as "civil union partner", "domestic partnership", "Magistrates Court" and "Supreme Court".

Rebuttable character of most rules. A recurring drafting device is the phrase "unless the contrary intention appears." That language appears in ss 9, 10 and 11 and allows parties to displace statutory presumptions by clear evidence of a differing purpose. Practically, that makes many of the Act’s effects default rules that can be contracted around or rebutted with contemporaneous documentation or evidence.

Protection of third parties and purchasers. The Act balances discretionary remedial powers with protection for bona fide purchasers (s 15(4)) and for third parties treated as stakeholders (s 15(6)). The court’s power to set aside dispositions made "with a view to defeating" an order (s 15(3)) is therefore qualified by a statutory requirement to consider and protect innocent third parties.

Overall, the Act operates as a package of default legal positions about ownership, agency and remedial powers in family property contexts, with the common theme of replacing gendered incapacity rules with gender‑neutral presumptions and creating temporal trust mechanics around marriage and union events.

Primary persons affected are married people and those in civil unions or civil partnerships, their children, persons standing in place of parents, domestic partners and third parties who transact with them. The Act’s dictionary and amendment history show that the Act’s scope was broadened to cover civil union partners and civil partners; the definitions for those terms are supplied by the Legislation Act, and the Act’s provisions repeatedly reference civil union and civil partnership status in place of marriage for many rules (see s 9 heading and s 10).

Married women and men: Section 3 expressly equalises capacity and legal rights for married women with married men. That provision affects lawyers, trustees, administrators and courts , it removes older common-law rules that treated married women as less than fully capacitated in property matters, and replaces them with statutory parity unless another Territory law says otherwise.

Spouses who hold title or contribute to purchase: Sections 9-12 and 10(3) specifically affect parties who transfer, vest or buy property either before or during marriage, civil union or civil partnership. For instance, if a woman pays for property that is vested in her husband, s 9 creates the same presumptions as would apply if a man had paid and vested in his wife. If two people contribute to purchase and vest title in one person in contemplation of marriage, s 10 creates a trust and then converts the holding into joint tenancy on marriage. These provisions therefore affect purchasers, title-holders, conveyancers, and lenders who rely on title.

Domestic partners: Section 4 explicitly extends the presumption about authority to pledge a spouse’s credit to two people in a domestic partnership, "in the same way" it applies to husband and wife living together. The Act points users to the Legislation Act for the meaning of domestic partnership (note to s 4). This affects non‑married cohabiting couples who meet the domestic partnership definition.

Third parties and purchasers in good faith: Section 15(4) requires courts to have regard to the interests of persons who purchased in good faith. Section 15(6) treats third-party applicants as "stakeholders." Third-party creditors, purchasers, and recipients of transfers are therefore affected by the protections and by the court’s power to set aside dispositions intended to defeat orders.

Estate planners and will drafters: Section 12 affects the construction of instruments that make gifts to two or more persons as joint tenants or tenants in common by treating a person and his or her spouse/partner as two separate persons unless a contrary intention is shown. That affects how shares are calculated under wills, deeds and testamentary instruments.

Courts and magistrates: The Act defines the court to include both the Supreme Court and the Magistrates Court (s 2). Section 14 expressly confines the Magistrates Court to matters within the monetary threshold and to title-to-land proceedings as governed by the Magistrates Court Act 1930. This affects litigants and advisers deciding jurisdiction and remedy strategies.

Creditors and lenders: The presumptions in s 4 about authority to pledge a spouse’s credit are material to lenders who receive security or guarantees from one spouse citing an implied authority in the other. Conversely, s 5 eliminates the concept of a married woman as agent of necessity to pledge her husband’s credit, which affects emergency borrowing and the enforceability of credit arrangements made by spouses on each other’s behalf.

People who make housekeeping allowances: Section 11 presumes that property bought with housekeeping allowances belongs to the payer and partner as joint tenants absent agreement to the contrary. That affects family budgeting, record-keeping and the legal ownership of household chattels and bank balances.

Parties entering transfers in contemplation of marriage, civil union or civil partnership: Section 10 imposes specific trust consequences for transfers made in contemplation of marriage or union, affecting both the transferor and transferee and creating potential timing risks if marriage or union does not occur.

Legal practitioners, accountants and conveyancers: The Act’s frequent "unless the contrary intention appears" language creates an evidential and drafting burden. Legal advisers will need to prepare express declarations of trust, written agreements, or clear contractual terms if parties wish to displace the statutory presumptions. Conveyancers must be aware that vesting a property in one spouse before marriage can trigger statutory trust rules.

Public authorities and administrative officers: The Act cross‑references definitions and interpretive provisions in the Legislation Act and the Magistrates Court Act. Government agencies implementing or applying property-related schemes involving families must be aware of these statutory presumptions and the Act’s remedial powers.

Finally, the Act affects estate beneficiaries and purchasers whose rights might be curtailed by the court’s power to set aside transfers made to defeat existing or apprehended orders (s 15(3)). Those purchasers benefit from the protection for bona fide purchasers (s 15(4)), but risk remains where transfers are challenged as made for the purpose of defeating anticipated court orders.

The Act creates rights (statutory presumptions and entitlements) and imposes duties principally in the form of obligations the court may enforce; it does not create large-scale new positive obligations on spouses beyond those already emerging from property law, but it does shift default property positions and creates duties for parties who wish to displace them.

Equality of legal capacity (s 3). Right: A married woman has the same legal capacities as a married man "for all purposes" unless another Territory law provides otherwise. Duty/constraint: Other Territory laws may still impose differing rules; s 3’s effect is limited where contrary Territory law exists.

Presumption of authority to pledge spouse’s credit (s 4). Right (to third parties): A spouse living together with their partner is presumed to have the implied authority to pledge their partner’s credit to the same extent as the reverse. That gives lenders and contractors a default position when relying on transactions involving cohabiting spouses. Limitation: The presumption is rebuttable by evidence; the text does not specify how to rebut but ordinary evidential rules apply.

Abolition of agency of necessity for married women (s 5). Duty removed: Any former rule that allowed married women to pledge their husband’s credit as agent of necessity "ceases to have any force or effect in the ACT." Practically, advisers cannot rely on emergency agency to validate borrowing arranged by a wife on the husband's behalf.

Restriction on anti‑alienation clauses (s 6). Duty to ensure non‑discriminatory drafting: Any instrument executed after commencement cannot validly attach to a woman’s enjoyment of property any restriction on anticipation or alienation that could not be attached to a man’s enjoyment. Drafters must avoid gendered or sex‑based restrictions in instruments.

Non‑liability for pre‑marriage debts (s 7). Right: A person cannot be held liable for a debt incurred by their spouse before marriage. This functionally limits creditor remedies against a spouse for pre‑marriage obligations of the other spouse.

Criminal liability parity (s 8). Right/duty: Acts that would make a married man criminally liable in relation to his wife's property make a married woman criminally liable in relation to her husband's property. The right here is symmetry , criminal liability applies equally.

Presumption of gift/advancement and statutory trusts (ss 9-12). Rights and duties for transfers and title: Sections 9-12 set presumptions about beneficial ownership that affect parties’ rights to property held in another’s name. For example, s 9 presumes gifts or advancement in specified transfers from a woman to her husband or child, unless contrary intention appears; s 10 imposes a trust on transfers made "in contemplation of" marriage and converts the trust into absolute ownership or joint tenancy upon marriage. These are default rights that create duties for transferees to hold property on trust until conversion events occur.

Housekeeping allowance presumption (s 11). Right: Property purchased with household allowance payments and unspent money is taken to belong to payer and spouse as joint tenants absent an agreement to the contrary. Duty: Parties who do not want that outcome must reach an express agreement to the contrary.

Court powers and duties (ss 13-15). The court has wide remedial rights and duties: on application it may grant injunctions (s 15(1)); make orders for sale, partition or set aside dispositions made to defeat an order (s 15(2)-(3)); consider and protect bona fide purchasers (s 15(4)); order repayment of invested money and profits to the spouse whose funds were invested without consent (s 15(5)); treat third-party applicants as stakeholders (s 15(6)); and direct inquiries (s 15(7)). Duty: the court must "have regard to the interests of, and shall make any order proper for the protection of, a person who purchased the property in good faith" (s 15(4)), which creates a legislated balancing obligation in exercising remedial powers.

Jurisdictional limits (s 14). Duty for litigants: Applications under s 13 to the Magistrates Court are subject to monetary limits and proceedings affecting title to land per the Magistrates Court Act 1930 (s 14). Parties must therefore observe jurisdictional thresholds and consider whether the Supreme Court is the correct forum for higher-value disputes or complex title issues.

Rebuttable nature of many presumptions. Key practical duty: where parties wish to avoid statutory default outcomes they should create clear contemporaneous documentation evidence of "contrary intention." The Act repeatedly permits contrary intentions to displace presumptions (see ss 9, 10, 11). The duty for practitioners is to draft express agreements, deeds of trust or recorded title arrangements.

Protection of third parties (s 15(4)-(6)). The court must consider purchasers in good faith, and third-party applicants are stakeholders. Practitioners advising third parties must be aware that while the court can set aside dispositions done to defeat an order, it must also protect bona fide purchasers, creating an evidential duty to show knowledge or lack thereof.

Penalty units and offences. The republication notes set the value of penalty units for offences against the law at $140 for an individual and $700 for a corporation as at the republication date. The Act itself contains no explicit offence provisions save for s 8 which equates criminal liability for certain acts by married women and men. Users should check the Legislation Act s 133 and any other Territory offences legislation for details on particular criminal offences that might be engaged by property conduct.

In short, the Act creates default property positions and judicial powers, while providing routes to contract around presumptions, and imposes duties on courts to protect bona fide third parties. The duties most immediate to practitioners are those of careful drafting and evidentiary planning to displace statutory defaults where parties wish to preserve a particular ownership arrangement.

The Act itself is primarily civil in nature. It provides remedial courts powers to prevent or unwind dispositions and to allocate property rights between spouses and partners. It contains one express criminal‑law parity clause (s 8) that ensures acts which would make a married man criminally liable in relation to his wife’s property will likewise make a married woman criminally liable in relation to her husband’s property. The statutes do not, however, specify distinct new offences or fixed monetary penalties for breaches of the Act’s civil presumptions. Enforcement is therefore largely through civil proceedings and equitable remedies.

Court enforcement powers (ss 13-15). The principal enforcement mechanisms are the powers the court may exercise on application under s 13. The court may:

• grant interim injunctions restraining threatened transfers, assignments, sales or other dispositions until the s 13 application is heard (s 15(1));
• make orders regarding title, possession or disposition, including sale and division of proceeds, partition or division (s 15(2));
• set aside any disposition that was made "with a view to defeating an existing or apprehended order in relation to the property" (s 15(3));
• have regard to, and make orders proper for the protection of, persons who purchased in good faith (s 15(4));
• order payment to a spouse of money and any interest or profit where money of a spouse was invested by the other spouse without consent (s 15(5));
• treat third-party applicants as stakeholders for the purposes of the proceedings (s 15(6));
• direct any inquiry it considers appropriate about the matters in question (s 15(7)).

These powers give the courts both prophylactic tools (injunctions) and substantive remedial tools (setting aside transfers, ordering repayments, directing sale/partition). The ability to set aside transfers is a strong remedial device; it is, however, expressly limited by s 15(4), which requires the court to consider protections for good-faith purchasers.

Jurisdictional enforcement limits (s 14). Enforcement through the Magistrates Court is limited by the Magistrates Court Act 1930 monetary thresholds and by the provisions governing proceedings affecting title to land (s 14). If a claim exceeds the Magistrates Court monetary jurisdiction or raises complex title-to-land questions beyond s 264, parties must seek relief in the Supreme Court, which has broader remedial powers.

Criminal enforcement (s 8). The Act creates parity for criminal liability in property-related offences between married men and women (s 8). This provision does not create new criminal offences but ensures that existing offences applicable to a married man’s conduct in relation to his wife’s property apply equally to a married woman’s conduct in relation to her husband’s property. Practitioners must therefore look to the general criminal law and to specific property‑related offences elsewhere in Territory law for the actual statutory penalties and offence elements.

Penalty unit application. The republication header states that "At the republication date, the value of a penalty unit for an offence against this law is $140 for an individual and $700 for a corporation (see Legislation Act 2001, s 133)." That is an indexation and value statement; the Act itself does not list monetary fines. Any criminal penalties engaged via s 8 will be calculated under the general penalty‑unit framework in Territory law.

Enforcement risks and practical points. Because many of the Act’s effects are presumptive, the common enforcement pathway will be disputed civil proceedings where one party seeks judicial determination of ownership or restitution. The court’s powers to set aside transfers made to defeat orders, and to order restitution of invested money, mean that parties who transfer assets to avoid forthcoming claims risk losing those assets and may face costs orders in litigation. The Act protects bona fide purchasers to reduce chill on third-party commerce, but practitioners advising purchasers should ensure due diligence on vendor capacity and relationship status to avoid becoming subject to a successful setting-aside application.

No administrative penalties or regulatory enforcement body is created by the Act. Enforcement is activated by private application to the court (s 13), by third parties who may apply to protect themselves (s 13(2)), or by criminal prosecution under existing criminal statutes where conduct meets offence elements and s 8 parity is engaged.

In sum, legal consequence under the Act is spearheaded by courts exercising injunctive, restitutive and declaratory powers rather than by a separate penalties regime in the Act itself. Parties and advisers should plan for civil litigation risk, and for the potential application of existing criminal property offences where appropriate.

The Married Persons Property Act 1986 operates in conjunction with, and by reference to, several other Territory and general statutes. The Act is deliberately narrow in text and relies on interaction with definitions and procedural law elsewhere.

Legislation Act 2001. The Act depends on the Legislation Act for interpretive and definitional scaffolding. Section 1A places the dictionary as part of the Act and the notes point readers to the Legislation Act for the legal status of definitions and notes. The notes explicitly reference the Legislation Act, s 155 and s 156(1) for how definitions apply across the Act, and the Legislation Act, s 169 for the meaning of "domestic partnership" (note to s 4 and to the dictionary). The republication also cites the Legislation Act s 133 for the penalty unit value. Practically, meaning of "civil partner", "civil union partner", "domestic partnership", and the courts referenced are controlled in part by the Legislation Act definitions (dictionary note).

Magistrates Court Act 1930. Section 14 constrains the Magistrates Court jurisdiction for s 13 applications, expressly subject to the Magistrates Court Act 1930, s 264 (Proceedings affecting title to land), and limits jurisdiction to cases where the question relates to property valued at or under the amount mentioned in s 257(1) of the Magistrates Court Act (s 14(a)-(b)). Therefore, procedural thresholds, appeal rights and monetary jurisdiction are governed by the Magistrates Court Act and its rules. Practitioners must check the Magistrates Court Act for the exact monetary limit and for procedural provisions when bringing or defending applications under s 13.

Court Procedures Act and related procedural law. The 2004 Court Procedures (Consequential Amendments) Act and the Court Procedures Act 2004 amended aspects of procedure affecting litigation. The amendment history records consequential amendments in 2004 (A2004-60) which affected s 13 and s 15. These amendments likely adjusted procedural mechanics to fit updated court procedure frameworks. Practitioners should consult current court rules and the Court Procedures Act when preparing interlocutory or substantive proceedings under the Act.

Civil Unions Act, Civil Partnerships Act, Marriage Equality (Same Sex) Act 2013 and related amendments. The Act’s amendment history shows multiple changes between 2006 and 2013 to extend the text from "marriage" to include "civil union" and "civil partnership" in various sections (see amendment history endnotes). Some amendments were inserted but never commenced because associated Acts were disallowed or held invalid (for example, the Civil Unions Act 2006 was repealed by disallowance; the 2013 Marriage Equality Act provisions were held to be of no effect in Commonwealth v Australian Capital Territory [2013] HCA 55). The practical effect is that references to civil unions and civil partnerships in the Act were intended to align with Territory recognition of those statuses; advisers must check current status of those partner categories in Territory law and the Legislation Act definitions.

Criminal law and general property law. Section 8 ties the Act to criminal law by establishing parity of criminal liability in relation to spouse’s property. The substantive criminal offences remain located in general criminal statutes. Similarly, the Act intersects with general principles of property, trusts and equity: statutory trusts and conversion events in s 10 are an overlay on general equitable doctrines such as resulting trusts, constructive trusts and the law of advancement. However, the Act creates specific statutory presumptions which may displace or supplement those equitable principles. Practitioners should consider common law trust and property principles in tandem with the Act’s statutory rules.

Conveyancing and land registration statutes. Because ss 9-12 and s 10 interact with title and vesting, the Act affects practical conveyancing and registration. The Act does not amend land titles or property registration legislation directly; nonetheless, the statutory presumptions can affect beneficial ownership despite registered title. Advisers must consider Land Titles Act and personal property securities regimes, and how court orders under s 15 may operate against registered interests.

Family law (federal) and state/territory family property regimes. The Act addresses property relationships between spouses and partners within the Territory. It does not displace federal Family Law Act 1975 (Cth) jurisdiction in relation to property disputes in separated married or de facto couples where federal jurisdiction applies. The Act is focused on ownership, title and remedial powers vis-à-vis transfers and investments during cohabitation and in contemplation of marriage. Where federal family law jurisdiction applies (for example, division of matrimonial property on divorce), counsel must coordinate strategies with federal family law remedies and orders that affect property division; the Act does not create an alternative federal division mechanism.

Registry, taxation and superannuation law. The Act does not directly address tax or superannuation. However, statutory changes to beneficial ownership (for example, conversion to joint tenancy on marriage under s 10) can have tax and superannuation consequences. Advisers must therefore consider cross‑regime impacts with tax legislation and superannuation law when property ownership changes in ways the Act prescribes.

Pre‑existing ordinances and conversion to ACT law. The legislation history explains that the Act originated as a Commonwealth ordinance and was converted to an ACT enactment on self‑government day (11 May 1989). Amendments across years have been enacted by Territory legislatures. Where older ordinances or other Territory laws interact, practitioners must consider the re‑numbering and modification history set out in the endnotes.

In summary, the Married Persons Property Act is a compact statute whose practical operation depends on careful interaction with the Legislation Act for definitions, the Magistrates Court Act and Court Procedures Act for procedure and jurisdictional limits, general property and trust principles, and other Territory statutes governing partner status. Advisers should always check the current status of civil union/civil partnership statute provisions and the high‑court decision noted in the amendment history when advising on partner-type recognition.

The Act has a documented legislative history beginning with its origin as a Commonwealth ordinance in 1986 and continuing through multiple Territory amendments and republications. The endnotes in the republication provide a precise chronology of legislative changes and their commencement status.

Origin and conversion to Territory law. The Married Persons’ Property Ordinance 1986 (Ord1986‑18) was notified 26 June 1986 and commenced 26 June 1986. On 11 May 1989, under the Australian Capital Territory (Self-Government) Act 1988 (Cwlth) the ordinance was converted into an ACT enactment, allowing the Legislative Assembly to amend and repeal the law. The change from "Ordinance" to "Act" occurred under the Self-Government (Citation of Laws) Act 1989 (A1989‑21, s 5) on 11 May 1989.

Statute Law Revision and 1990s amendments. The Statute Law Revision Act 1995 (A1995‑46) amended the Act and those amendments commenced 18 December 1995. An earlier Magistrates Court (Civil Jurisdiction) (Amendment) Ordinance 1988 influenced jurisdictional matters and had been applied in 1989-1991.

2004-2005 amendments. The Sexuality Discrimination Legislation Amendment Act 2004 (A2004‑2) made amendments (notably s 4) that appeared in the republication and commenced in 2004; the Court Procedures (Consequential Amendments) Act 2004 (A2004‑60) made consequential changes affecting ss 13 and 15 and related procedural adjustments. Technical commencement dates for particular schedules were noted in the endnotes (for example, some parts commenced in March 2004 and January 2005 as recorded).

2006 civil unions changes (never commenced). The Civil Unions Act 2006 (A2006‑22) made a suite of amendments to this Act (for example, changing headings and inserting civil union parties into ss 9-12 and s 15), but the Civil Unions Act itself was repealed by disallowance on 14 June 2006 (Commonwealth Gazette reference). The amendment history records the A2006‑22 amendments as "rep before commenced by disallowance," meaning those changes did not take legal effect.

2007-2008 consolidation and civil partnerships. The Statute Law Amendment Act 2007 (A2007‑3) made editorial and numbering amendments that took effect from 1 July 2006 (deemed commencement provisions). The Civil Partnerships Act 2008 (A2008‑14) inserted amendments broadening the Act’s terminology to include civil partners and civil partnerships and those amendments commenced in May 2008.

2012 civil unions re‑inserted. The Civil Unions Act 2012 (A2012‑40) contained amendments to this Act that commenced in September 2012. The republication notes record these amendments and the amendment numbering. Practitioners must note that the 2012 Act’s amendments took effect as per the commencement notice CN2012‑?? referenced in the endnotes.

2013 Marriage Equality (Same Sex) Act amendments (held of no effect). The Marriage Equality (Same Sex) Act 2013 (A2013‑39) was notified on 4 November 2013 and some schedule amendments to this Act were intended to commence on 7 November 2013. However, the endnotes record that the High Court held this Act to be of no effect in Commonwealth v Australian Capital Territory [2013] HCA 55. The amendment history therefore flags multiple A2013‑39 amendments to ss 4, 7, 10, 11, 12 and the dictionary as "never effective." The republication in November 2013 therefore includes those amending provisions as non-effective annotations.

Editorial and dictionary additions. Section 1A (dictionary) and s 1B (notes) were inserted by the Statute Law Amendment Act 2007 as editorial modernisation and to ensure the dictionary is part of the Act. The dictionary was updated by later amendments in 2008 and 2012 to reflect partner categories and court definitions.

Republications. The act has had multiple authorised republications (see endnote 5), with republication No 8 being the present document (7 November 2013), which includes A2013‑39 annotation though some A2013‑39 items were never effective.

Implications of amendment history. Two features emerge from the amendment record. First, repeated legislative attempts were made to broaden the Act’s terms from "married" to include civil unions and civil partnerships; those that took effect do so in the text, but several attempts were disallowed or held invalid and therefore never effective. Second, the amendment history documents careful editorial work to modernise and cross‑reference definitions (Legislation Act cross‑references) and procedural alignment with the Court Procedures Act and Magistrates Court Act.

Advisers must therefore pay close attention to commencement and effectiveness not only of the Married Persons Property Act provisions but of the partner-recognition Acts that amend it. The endnotes supply detailed commencement dates and annotations of non‑effective amendments; these are essential to check when advising on current law.

The republication’s endnotes identify a single High Court decision that directly affected the amendment history of this Act: Commonwealth v Australian Capital Territory [2013] HCA 55. The endnotes explain that provisions of the Marriage Equality (Same Sex) Act 2013 were held to be of no effect by that decision, and that several amendments to this Married Persons Property Act made by A2013‑39 never took legal effect as a consequence.

What the endnotes record. The republication notes under "Legislation history" and "Amendment history" state that the Marriage Equality (Same Sex) Act 2013 (A2013‑39) was notified and that certain schedule amendments to this Act were stamped as commencing 7 November 2013 but that the High Court held the ACT Act to be of no effect in Commonwealth v Australian Capital Territory [2013] HCA 55. The amendment history flags multiple A2013‑39 amendments as "never effective." The republication itself was reissued 24 February 2014 "because of High Court decision in relation to A2013‑39." This makes the High Court decision the key litigation event explicitly recorded as affecting the Act’s text and effective amendments.

No other case law is recorded in the Act’s republication. The Act’s provisions interact with common law and equitable doctrines (for example, resulting and constructive trusts, agency, and the law of advancement), but the republication does not cite precedents or decisions applying the Act’s sections. Practitioners must therefore consult case law separately for judicial interpretation of s 10’s trust conversion mechanics, s 9’s presumptions of advancement, s 15’s power to set aside dispositions made to defeat orders, and s 4-5’s operation regarding pledging spouse’s credit. The republication’s endnotes supply the statutory change context but not judicial gloss.

Practical consequence. The direct litigation history recorded in the republication focuses on constitutional invalidation of a separate ACT statute (the Marriage Equality Act) which affected the Married Persons Property Act only to the extent it sought to insert particular amendments that were never effective. There is no reported litigation in the republication that interprets the substantive operation of ss 9-12 or s 15 within the ACT courts or in higher courts, so practitioners need to rely on general property and trust authorities, any ACT decisions not recorded in the republication, and cross‑jurisdictional authority where applicable.

If litigation strategy or rights assessment is required under the Act, check:

• current ACT decisions applying the Married Persons Property Act provisions;
• federal family law decisions if family law jurisdiction overlaps;
• High Court and superior court rulings on related trust, advancement, and matrimonial property doctrines where relevant.

In summary, the republication records one litigation event with direct statutory effect (Commonwealth v ACT [2013] HCA 55), but does not catalogue adjudication of the Act’s substantive provisions. That absence is itself a risk factor: legislative text sets presumptions and remedies, but the court’s interpretive approach to those provisions will determine their practical operation. Practitioners should therefore research case law post‑2013 to see how courts have applied contractual contrary-intention evidence, statutory trust rules, setting-aside powers and protections for bona fide purchasers under s 15.

The Act contains a number of default rules and provisos that can produce unintended outcomes if advisers or parties do not take active steps. These "gotchas" are concrete mechanisms in the text that practitioners should watch for.

"Unless the contrary intention appears" is the escape valve and the trap. Many of the Act’s key rules are presumptions subject to displacement by showing a contrary intention (see ss 9(1), 10(1)-(3), 11). In practice, that means that where parties do not make contemporaneous, clear, written arrangements (declarations of trust, co‑ownership agreements, or registered interests), statutory presumptions will govern. The absence of an express contrary intention is itself evidence that the statute’s automatic rules should apply. Drafting must therefore be explicit and contemporaneous.

Automatic conversion to joint tenancy on marriage/union (s 10). Transfers made "in contemplation of" marriage result in the transferee holding on trust until marriage, and then on marriage the transferee is "taken to hold the property absolutely" or to hold as joint tenants where joint vesting applied (ss 10(1)-(2)). This timed conversion can be surprising: a person who takes title before marriage may believe they hold beneficial ownership, but s 10 can produce a trust in favour of the transferor until marriage, then absolute or joint tenancy after. Parties who purchase and vest title in anticipation of marriage should document their intentions if they do not want the statutory trust consequences.

Housekeeping allowances and joint testamentary outcomes (s 11). Money paid as a household allowance that is used to purchase property or remains unspent is presumed to be joint property. Couples who intend separate ownership of household purchases must make express agreements. This presumption can reach unspent cash balances as well as chattels and real property bought with housekeeping funds.

Presumption of advancement re: sex (s 9). Section 9 equalises presumptions of gift/advancement in transfers by women to husbands and other specified persons "as would arise if the property … had been paid for by a man." The historical presumption of advancement has been eroded in many jurisdictions by statute and case law; here it remains as a statutory presumption. Practitioners should know that absent contrary intention, transfers by a woman into her husband's name may be taken as advancement or gift. Inheritance planning and property subdivisions must account for that.

Abolition of agent of necessity for married women (s 5). Historically, equity allowed a wife to act as agent of necessity for husband in emergencies. Section 5 abolishes any rule giving a married woman that authority "to pledge his credit or to borrow money on his credit" in the ACT. The practical gotcha is that emergency lenders cannot rely on a wife's asserted agency to create binding obligations for the husband. Lenders must secure express authorisation; family members relying on emergency borrowing to pay urgent costs may find a statutory defence to liability is not available.

Pledging spouse’s credit presumption vs. lender diligence (s 4). Section 4 creates a presumption of authority to pledge spouse’s credit for cohabiting spouses, and extends to domestic partners. Lenders may rely on that presumption, but it is rebuttable. The gotcha is twofold: first, lenders who rely on the presumption without verification expose themselves to later dispute if the presumption is rebutted; second, the presumption might be invoked to validate transactions the other spouse did not authorise, raising post‑transaction litigation risk.

Setting aside transfers to defeat orders (s 15(3)) balanced by protection for purchasers (s 15(4)). The court can set aside dispositions made with a view to defeating an existing or apprehended order. This creates a significant risk for transfers done in anticipation of litigation, but the court must also "have regard to" and protect bona fide purchasers. The practical uncertainty , whether a purchaser was "in good faith" or not , is an evidential battleground. Parties attempting to "cleanse" assets by transferring them before proceedings invite reversal unless the third party can establish good faith and lack of knowledge.

Magistrates Court monetary limits (s 14). Section 14 limits the Magistrates Court’s jurisdiction for s 13 applications to property under the Magistrates Court Act monetary threshold. Parties who miscalculate value and proceed in the Magistrates Court risk jurisdictional error, wasted costs, and the need to recommence in the Supreme Court.

Non‑liability for pre‑marriage debts (s 7) may not be absolute in all contexts. The Act states clearly that a married person is not liable for any debt incurred by their spouse before marriage. However, the provision does not expressly address contractual novations, joint guarantees given after marriage, or where the spouse adopts the debt. Advisers must ensure that creditors seeking security take contemporaneous guarantees or security interests in the spouse’s name rather than relying on post‑marriage enforcement.

Interaction with external regimes and unsettled case law. The republication records few judicial interpretations of the Act. Where the Act intersects with federal family law property division, tax, superannuation or land registration outcomes, outcomes may be affected by other statutory regimes and judicial discretion. The lack of recorded litigation in the republication means interpretive uncertainties (for example, how courts will balance s 15(3) set‑aside power against s 15(4) purchaser protection) remain a practical risk.

Amendments that never took effect. The amendment history lists multiple changes intended by Acts that were disallowed or held of no effect (notably A2006‑22 and A2013‑39). Advisers must confirm current force of provisions and not rely on amendments that appear in some textual versions but which the republication records as never effective.

Record‑keeping and proof burdens. Because the Act allows rebuttal of presumptions by "contrary intention," parties lacking detailed records will often lose on the default statutory rule. The practical gotcha is the evidential burden on those who say a transfer was not intended as a gift or joint tenancy , contemporaneous written evidence is vital.

In short, the main "gotchas" are the Act’s multiple default rules, the conversion mechanics tied to marriage or union, the effect of housekeeping allowances, statutory abolition of certain equitable agency rules, the risk of setting‑aside transfers done to defeat orders, and the need to confirm current amendment status in light of the Act’s complex amendment history.

Compliance under this Act is both preventive and documentary. Because many of the Act’s effects are default presumptions avoidable only by clear contrary intention, the principal compliance strategy for practitioners and clients is to document intentions, structure title appropriately, and manage transactional timing. Below are practical steps, grounded in the Act’s text, for advising clients and for institutional compliance.

1. Use clear, contemporaneous written declarations to displace presumptions (ss 9, 10, 11). Where a transfer is made and the parties do not want the statutory presumption to apply, prepare a deed of trust, declaration of beneficial interest, or express written agreement at the time of transfer showing the contrary intention. The Act repeatedly permits contrary intentions to displace the presumption; documentation is the most reliable evidence of that contrary intention.

2. For purchases before marriage or union, register a declaration of trust or specify tenancy in common shares (s 10). If property is purchased and vested in one person "in contemplation of" marriage, s 10 will treat the transferee as holding on trust until marriage and then convert holdings to joint tenancy on marriage. To avoid automatic conversion and unintended loss of separate shares, create and register a declaration of trust or record the property as tenants in common with specified shares proportionate to contributions (s 10(3)(c)).

3. For housekeeping allowances, agree and record property ownership arrangements (s 11). To avoid the presumption that property bought with housekeeping payments is joint property, record an agreement that specifies ownership shares, and retain clear records of contributions and bank transactions.

4. Lenders and third parties should do due diligence on spousal authority and title (s 4 and s 15(4)). Lenders who rely on a spouse’s implied authority to pledge the other spouse’s credit under s 4 should verify authorisation in writing. To preserve good‑faith purchaser protection under s 15(4), thorough due diligence and contemporaneous searches and enquiries minimise the risk of later setting aside.

5. Avoid reliance on agency of necessity for married women (s 5). Do not rely on historical equitable agency doctrines for emergency borrowing by a wife on behalf of a husband. Obtain express authorisation or separate security to ensure enforceability.

6. If anticipating litigation, avoid transfers intended to defeat orders; seek interlocutory orders early (s 15(1)-(3)). Transfers made "with a view to defeating" an existing or apprehended order can be set aside (s 15(3)). If parties foresee a dispute, consider seeking court directions and injunctions under s 15(1) and avoid manipulating assets to shield them from potential orders.

7. For advisers handling wills and gifts to multiple persons, specify how spouses are to be treated for calculation of shares (s 12). Section 12 treats a person and his/her spouse as separate persons unless contrary intention appears. Draft testamentary instruments to make clear whether a gift to two or more persons intends separate or combined shares.

8. Check jurisdictional thresholds before litigating (s 14). Apply s 14’s direction that the Magistrates Court’s jurisdiction is constrained by the Magistrates Court Act 1930 s 257(1) and s 264. For disputes exceeding the monetary threshold or involving complex title issues, commence action in the Supreme Court.

9. Maintain clear records of contributions and payments to support claims under s 10(3) and to rebut presumption of advancement (s 9). Contributions evidence is essential where parties both contribute and title is vested in one party.

10. Consider tax and registration consequences. While the Act does not change taxation or land registration law, statutory transfers and conversions in beneficial ownership can have tax consequences. Coordinate with tax advisers, and ensure conveyancing steps and registrations reflect intentions (e.g. declarations of trust filed where appropriate).

11. For third parties applying as stakeholders (s 13(2) and s 15(6)), comply with court directions for stakes to be held pending resolution. If you are a third-party stakeholder facing conflicting claims, consider bringing a s 13 application to get judicial determination rather than unilaterally transferring property out of caution.

12. Keep abreast of partner‑recognition definitions in the Legislation Act and of effective amendments. Because the Act’s coverage of civil unions and civil partnerships stems from amendments and Legislation Act definitions, confirm the current legal status of "civil union partner," "civil partner" and "domestic partnership" in the Legislation Act and check whether particular amendments are in force (amendment history in endnotes is essential).

13. Where criminal liability is a risk, liaise with criminal law counsel. Section 8 equates criminal liability between married men and women in relation to a spouse’s property. If actions could lead to criminal prosecution in relation to property, seek specialist advice.

14. For institutional compliance (banks, registries, conveyancers): adopt internal procedures to request written authorisations for transactions affecting another spouse, retain transaction files with relationship status checks, and ensure staff understand the rebuttable presumption mechanics and the requirement to protect bona fide purchasers.

15. Draft partnership and cohabitation agreements for domestic partners. Given s 4 extends certain presumptions to domestic partners, domestic partners should consider written agreements clarifying credit authority, ownership of property and the effect of contributions.

In practice, the overarching compliance principle is documentation. The Act converts many traditional equitable rules into statutory presumptions that are readily displaced by a contrary intention shown in writing and contemporaneously. Counsel, accountants, conveyancers and lenders should therefore prioritise clear written evidence of intentions, title structures and authorisations to ensure that clients’ property rights reflect their actual agreement rather than statutory defaults.
