Marriage (Recognised Denominations) Proclamation 2018

The central concept is “recognised denomination”. Section 26 of the Marriage Act provides that the Governor‑General may, by proclamation, declare a religious body or religious organisation to be a recognised denomination. Once declared, that body or organisation is a recognised denomination for all purposes of the Act. The term is not further defined in the Marriage Act or in this proclamation. The proclamation itself lists over 200 specific religious bodies and organisations in Schedule 1. The list includes major Christian denominations (Roman Catholic, Anglican, Uniting, Lutheran, Baptist, various Orthodox churches, Pentecostal and evangelical groups), non‑Christian faiths (Islam, Jewry, Baha’i, Buddhism, Hinduism, Sikh, Zoroastrian, Druze, and others), new religious movements (Church of Scientology, Eckankar, International Society for Krishna Consciousness), and many smaller independent churches and associations. The breadth of the list suggests that the Commonwealth has taken a broad approach to what constitutes a “religious body or religious organisation” for the purposes of marriage solemnisation. However, the proclamation does not contain any criteria for what qualifies as religious; the Attorney‑General’s Department presumably assesses applications for inclusion on the basis of evidence that the body or organisation is genuinely religious and operates as a denomination within the meaning of the Act. There is no statutory right to be included, and the proclamation can be amended to add or remove bodies without legislative amendment. Another key concept is the relationship between the proclamation and the marriage‑celebrant system. Under the Marriage Act, a minister of religion of a recognised denomination may apply to be a marriage celebrant if they are “authorised to solemnise marriages by or under the law of the State or Territory in which the marriage is solemnised”. The proclamation does not affect that state‑level requirement; it merely establishes the prerequisite that the minister’s denomination be recognised. The proclamation also interacts with the concept of “marriage” as defined in the Marriage Act, which was amended in 2017 to allow for same‑sex marriage. The proclamation is silent on that subject, so it applies equally to marriages of all couples. The list includes many organisations that have public positions for or against same‑sex marriage, but the proclamation does not discriminate based on doctrine. The concept of “religious body or religious organisation” is intentionally broad, as evidenced by the inclusion of bodies such as the “Australian Unitarian Druze” and “Spirit of the Earth Medicine Society”. The proclamation also includes entities that are incorporated (e.g., “A2A Ltd”, “Hillsong Church Australia”) and unincorporated associations (e.g., “Brethren”, “Jewry”). This suggests that incorporation status is not a factor in recognition. The proclamation effectively delegates to the executive the power to decide which religions can have their ministers solemnise marriages, which is a significant interference in the religious marketplace. The list is a form of regulatory licensing of religious marriage solemnisation.

The proclamation directly affects three groups: the religious bodies and organisations listed in Schedule 1, their ministers, and couples who wish to marry under the rites of those bodies. For listed denominations, the proclamation removes a regulatory barrier: their ministers can apply to become marriage celebrants without first having to establish the denomination’s status with the Attorney‑General’s Department. This is a compliance cost saving for those denominations. For ministers of listed denominations, it clarifies their eligibility, though they must still meet state‑law requirements and pass a fit‑and‑proper‑person check under the Marriage Act. For couples, the proclamation expands the pool of potential celebrants who can conduct a religious marriage ceremony, preserving the option to marry in accordance with their faith’s traditions rather than being forced to use a civil celebrant. Indirectly, the proclamation also affects religious bodies not on the list. Those bodies must either seek inclusion via a formal request to the government (a process that may involve lobbying, legal costs, and delay), or rely on civil celebrants or state‑appointed ministers of religion who may not belong to their denomination. This creates a competitive disadvantage for unlisted faiths, particularly newer or smaller religious groups. The cost of seeking inclusion is not disclosed, but it likely involves preparing an application demonstrating that the body is a religious organisation, along with evidence of its structure and marriage‑solemnisation practices. The proclamation also indirectly affects taxpayers, who bear the administrative cost of maintaining and updating the list. However, that cost is likely small. The proclamation does not directly affect marriage celebrants who are not ministers of religion (e.g., civil celebrants), but it does influence the market for marriage services: a large number of religious celebrants may reduce demand for civil celebrants in areas where those denominations are strong. From a public choice perspective, the proclamation is a case of concentrated benefits (listed denominations gain easier access to the marriage celebrant market) and diffuse costs (the public bears the risk of errors or of sectarian bias in listing decisions). The proclamation also affects the balance between state and religious authority over marriage. By listing denominations, the Commonwealth effectively endorses certain religious bodies as legitimate marriage‑solemnising authorities, while others are implicitly not endorsed. This may have social implications for religious freedom and equality. The 2024 amendment (F2024L01003) added or removed some bodies; without the amending instrument text, we cannot say which bodies were affected, but any addition or removal alters the competitive dynamics for those specific groups.

The proclamation itself imposes no duties on any person or body. It confers a right (in the sense of a legal capacity) on each listed religious body or organisation: the right to have its ministers apply for authorisation as marriage celebrants based on that denominational status. However, that right is not absolute; it is contingent on the minister satisfying other requirements under the Marriage Act, including state‑law authorisation and the Registrar’s approval. The proclamation does not grant ministers a right to solemnise marriages automatically. The corresponding duty falls on the Commonwealth: the Governor‑General (acting on advice) is empowered to maintain and amend the list. There is no statutory duty to add any particular group, nor to review the list periodically. The proclamation therefore creates an expectation but not a legal obligation that the list will be kept current. The Marriage Act imposes duties on ministers who become celebrants (e.g., to comply with notice requirements, to ensure marriages are lawfully solemnised), but those duties are not created by this proclamation. For religious bodies, the proclamation places no obligation to ensure their ministers comply with the Marriage Act; that is the individual responsibility of the minister and the Commonwealth regulatory system. The proclamation also confers no rights on couples to demand a particular denominational celebrant; couples may only marry via a minister of a recognised denomination if that minister is individually authorised and willing to solemnise the marriage. In terms of rights vis‑a‑vis the government, a religious body not on the list has no statutory right to be included. The decision to add a body is discretionary. That lack of a right creates uncertainty and may chill applications from minority faiths that fear rejection could be seen as government disapproval. The proclamation therefore has a soft chilling effect on religious expression for groups outside the list. On the other hand, listed denominations have a right to continued recognition unless the proclamation is amended to remove them. Removal would require a further proclamation, which is a public act; there is no right to a hearing or to reasons for removal. That lack of procedural protection is a gotcha. The proclamation is silent on whether a body can be removed if it ceases to operate or if its practices change. The duty of the Commonwealth is limited to maintaining the instrument; there is no active obligation to inform listed bodies of changes.

The proclamation does not contain any penalty provisions. Enforcement of the marriage‑solemnisation regime is governed by the Marriage Act 1961, which creates offences for solemnising a marriage without being authorised, for failing to comply with notice and registration requirements, and for other breaches. Those penalties apply to ministers of religion of recognised denominations in the same way as to other celebrants. The proclamation does not alter those penalties or create new ones. For example, section 100 of the Marriage Act makes it an offence to solemnise a marriage without being authorised, punishable by imprisonment for up to five years. Section 101 deals with unauthorised solemnisation of marriages known to be void. These penalties apply to any person, including a minister of a recognised denomination who solemnises a marriage without being individually authorised. The proclamation has no direct enforcement mechanism. The Commonwealth’s power to amend the proclamation is the only indirect enforcement lever: if a listed denomination’s ministers systematically breach marriage laws, the government could theoretically remove that denomination from the list, but that would be a political rather than a legal enforcement action. There is no indication in the instrument of any criteria for removal based on compliance failures. The proclamation thus relies on the broader regulatory framework of the Marriage Act and the Registrar’s oversight to enforce standards. There is no penalty for a listed body that ceases to be a genuine religious organisation; the proclamation would continue to recognise it unless amended. That creates a risk of outdated or fraudulent listings. From a regulatory perspective, the proclamation could be seen as a low‑enforcement instrument that simply designates eligible entities, leaving compliance to other parts of the legal system. The cost of any enforcement action falls on the Commonwealth, but the deterrent effect of potential criminal penalties for individual ministers is likely sufficient. For couples, there is no private right of action under this proclamation. If a marriage is solemnised by an unauthorised person, it may be void, but that outcome flows from the Marriage Act, not the proclamation. The proclamation itself is not enforceable by private litigants.

The proclamation is made under and operates solely within the framework of the Marriage Act 1961, specifically section 26. That section provides that a recognised denomination is a religious body or organisation declared by proclamation. The proclamation gives effect to that provision. The Marriage Act itself contains detailed rules about marriage celebrants, including how ministers of recognised denominations become authorised (section 29), the effect of authorisation (section 35), and the requirement that ministers be authorised by or under the law of the relevant state or territory (section 26(2)). The proclamation does not override or modify any of those provisions. It interacts with state and territory laws in a limited way: a minister of a recognised denomination must also be authorised to solemnise marriages under state law. For example, in New South Wales, the Marriage Act 1961 and the state’s Marriage of Persons other than Ministers of Religion Act 1867 (or equivalent) may apply. The proclamation does not address that interaction; it simply enables the Commonwealth pathway. The proclamation also interacts with the Australian Charities and Not‑for‑profits Commission Act 2012 and the Income Tax Assessment Act 1997 to the extent that being a recognised denomination may affect a body’s status as a religious institution for charity or tax purposes. However, the proclamation is not determinative of that status; it is solely for marriage‑celebrant purposes. The proclamation does not interact with antidiscrimination laws directly, but it could raise issues if the list were to exclude a faith on discriminatory grounds. Such a challenge would be under the Racial Discrimination Act 1975 or the Australian Human Rights Commission Act 1986, not under this proclamation. The proclamation itself is silent on discrimination. It interacts with the Legislative Instruments Act 2003 (now the Legislation Act 2003) for registration and tabling purposes. As a legislative instrument, it is subject to disallowance by either House of Parliament. That provides a parliamentary check on the content of Schedule 1. The proclamation does not interact with the Marriage Amendment (Definition and Religious Freedoms) Act 2017, which amended the definition of marriage and introduced protections for religious celebrants. The proclamation continues to apply equally to all ministers of recognised denominations regardless of their views on same‑sex marriage. The 2024 amending proclamation (F2024L01003) is a separate legislative instrument that must be read together with the principal proclamation. The interaction between the two is straightforward: the amendment adds or removes entries from Schedule 1. The absence of any transitional provisions in the amendment history suggests changes take effect immediately without grandfathering.

The proclamation was originally registered on 26 November 2018 as F2018L01607 and commenced on 27 November 2018. It replaced any earlier recognised denominations proclamations under the Marriage Act. The compilation notes indicate that section 2 (commencement) and section 5 (repeal of previous proclamations) were repealed by the Legislation Act 2003, section 48D and section 48C respectively, as standard drafting for legislative instruments. The first and only amendment is the Marriage (Recognised Denominations) Amendment Proclamation 2024 (F2024L01003), registered on 16 August 2024 and commencing on 17 August 2024. That amendment affected Schedule 1. Without access to the text of the 2024 amending instrument, we cannot identify which specific bodies were added or removed. The endnote for Schedule 1 states “am F2024L01003”, meaning the schedule was amended. The amendment likely added new religious bodies that had applied for recognition since 2018, and possibly removed any that had ceased to exist or requested removal. The amendment process is initiated by the Attorney‑General’s Department, which accepts applications from religious bodies. The criteria for inclusion are not published, but presumably the body must demonstrate that it is a genuine religious organisation and that its ministers perform marriage ceremonies. The 2024 amendment was made by the Governor‑General on the advice of the Executive Council. It is a legislative instrument subject to disallowance, but no notice of disallowance appears in the endnotes. The amendment history also shows that sections 2 and 5 were repealed by the Legislation Act (as noted above) and Schedule 2 was repealed. The legislation history includes no application, saving, or transitional provisions for either the original or amending instrument. This means that the amendment operated immediately upon commencement, without any grace period for affected bodies. If a body was removed from the list, its ministers would cease to be eligible to apply as ministers of a recognised denomination from 17 August 2024. That could cause problems for pending applications or marriages scheduled soon after. The lack of transitional provisions is a notable risk. The amendment history demonstrates that the list is dynamic and subject to periodic updating. There is no requirement for a regular review; amendments occur as need arises. The cost of seeking an amendment is borne by the applying religious body, which must prepare documentation and likely engage with the department. The compilation includes editorial changes made under the Legislation Act; none are noted as affecting substantive provisions.

The source text contains no reference to any litigation concerning the proclamation. The endnotes and the instrument itself do not mention any court cases or tribunal decisions. This is expected for a relatively uncontroversial administrative instrument that simply lists names. However, the absence of litigation does not mean the proclamation has never been challenged. In theory, a religious body denied inclusion could seek judicial review of the decision under the Administrative Decisions (Judicial Review) Act 1977 or the common law, arguing that the decision was made for an improper purpose, was irrational, or involved a failure to take into account relevant considerations. No such case is reported in the source. Similarly, a party to a marriage could challenge the validity of a marriage solemnised by a minister of a body that was not in fact a recognised denomination at the time. That would be a matter under the Marriage Act, not a direct challenge to the proclamation, but the validity of the proclamation could be collaterally challenged. No known cases are referenced. The proclamation could also be subject to a constitutional challenge if a religious organisation argued that the power to define recognised denominations infringes on the implied freedom of religious expression under the Constitution. However, such a challenge has not eventuated, and the High Court has historically given the Commonwealth broad power over marriage under section 51(xxi) of the Constitution. The proclamation’s list includes many diverse faiths, which may have insulated it from challenge by showing broad accommodation. The lack of litigation history suggests that the administrative process for inclusion is functioning without causing disputes that reach courts, or that aggrieved parties lack the resources to litigate. It may also indicate that the discretion to add bodies is exercised in a way that avoids obvious discrimination. However, the silence should not be taken as proof that the instrument is immune from future legal challenge. The 2024 amendment could yet be litigated if a removed body claims procedural unfairness or if a body denied inclusion alleges that the criteria are applied inconsistently. For now, the litigation history is a blank slate.

Several features of the proclamation pose traps for the unwary. First, the proclamation does not define “religious body or religious organisation”. The list is long and eclectic, but inclusion is entirely at the discretion of the executive. A religious group that considers itself a denomination but is not listed cannot rely on the proclamation and must either apply for amendment or have its ministers become civil celebrants. That application process is not automatic; the group may be rejected without reasons, and there is no right of review. This creates uncertainty for minority faiths. Second, being listed does not make a minister automatically authorised to solemnise marriages. The minister must still apply to the Registrar of Marriage Celebrants, meet fit‑and‑proper‑person requirements, and be authorised under state or territory law. Many ministers may mistakenly believe that the proclamation itself grants solemnisation authority; it does not. Third, the proclamation contains no grandfathering provisions for amendments. If a body is removed from the list, its existing ministers who are already authorised as marriage celebrants do not automatically lose their authorisation; they remain authorised as individual celebrants, but they can no longer solemnise marriages as ministers of that denomination. However, new ministers of that body cannot use the denominational pathway. This could lead to practical difficulties for faith communities that lose recognition. Fourth, the list includes many incorporated entities (e.g., “A2A Ltd”, “Hillsong Church Australia”). If a listed body changes its name, merges, or dissolves, the listing may become stale. The proclamation does not require bodies to notify the government of changes. A minister of a renamed body might be unable to prove they belong to the exact listed entity. Fifth, the proclamation does not distinguish between mainstream and fringe religious groups. The inclusion of bodies such as the “Church of Scientology Incorporated” and “ECKANKAR Australia” means the government has adopted a neutral approach to religious truth, but that neutrality could be tested if a group with controversial practices seeks listing. There is no mechanism for public objection to a listing. Sixth, the proclamation is silent on whether a body can be listed if it does not perform marriages. Some listed groups may not actually conduct marriage ceremonies in practice, but their ministers could still apply to be celebrants, potentially leading to marriages that lack genuine religious character. Seventh, the reliance on a static list means any omission can only be rectified by a new proclamation, which requires time and political will. A religious body that misses the cut for a particular amendment may wait years for the next one. Finally, the proclamation does not incorporate any sunset clause or review date, so it continues indefinitely until amended. That could result in outdated listings that no longer correspond to living religious communities.

For a religious body or organisation already listed in Schedule 1, compliance is straightforward: there are no ongoing obligations imposed by this proclamation. The body should ensure that its ministers understand that being a minister of a recognised denomination is only the first step toward being a marriage celebrant. The body may wish to assist ministers with the application process under the Marriage Act by providing evidence of ordination and state‑law authorisation. The proclamation does not require any reporting or fee payment. For a religious body not listed, compliance with the proclamation in the sense of gaining recognition requires a proactive approach. The body should apply to the Attorney‑General’s Department for an amendment to the proclamation to add its name. The application should include evidence that the body is a religious organisation, that it conducts marriage ceremonies, that it has a structure and governance (whether incorporated or not), and that its ministers are authorised under state or territory law. The department’s criteria are not publicly specified, but previous successful applications suggest that the body must be established and have a genuine religious character. The body should monitor the Federal Register of Legislation for future amending proclamations to see if its application has been accepted. If accepted, the body’s name will appear in a subsequent compilation. If rejected, the body has no formal avenue of appeal, but it can seek reasons and reapply. The cost of application includes staff time and possible legal advice. For ministers of listed denominations, compliance involves ensuring they are individually authorised under the Marriage Act. They must apply to the Registrar of Marriage Celebrants using the approved form, provide evidence of their ordination and state‑law authority, and consent to background checks. They must also comply with the Marriage Act’s obligations regarding notice of marriage, lodgement of documents, and prohibition on solemnising unless satisfied the marriage is lawful. The proclamation does not affect those obligations. For couples, compliance with the proclamation is passive: they should verify that the minister they intend to use is a minister of a listed denomination (consult the current version of Schedule 1 on the Register) and that the minister is individually authorised. A couple can check the public Register of Marriage Celebrants. If the minister is not authorised, the marriage may be void. For commercial entities advising religious bodies, the key compliance steps are to monitor amendments to the proclamation, advise clients of the need for individual authorisation, and assist with applications for amendment. There is no need to lodge anything with the government under this proclamation itself. In summary, the compliance burden is low for listed bodies and non‑existent in terms of ongoing duties, but the cost of seeking listing for excluded groups is a barrier that the proclamation imposes. The proclamation effectively privatises the compliance cost: it is up to each religious body to pursue inclusion. The government incurs only the administrative cost of processing applications and drafting amending instruments. The lack of transparency about criteria and the absence of a right to reasons for rejection are the main compliance risks for unlisted bodies.
