What it does
This instrument prescribes the qualifications or skills that a person must hold in order to be eligible for registration as a marriage celebrant under the Marriage Act 1961. It does not itself register celebrants; rather it sets the curricular and documentary baseline that an applicant must meet to satisfy the statutory requirement that a person have either a Certificate IV in Celebrancy, a celebrancy qualification, or celebrancy skills (s 6). The instrument is made under paragraph 39C(1)(b) of the Marriage Act 1961 and in accordance with section 39 of the Marriage Regulations 2017 (s 3). It therefore functions as a delegated instrument specifying what counts as sufficient training or demonstrable skill for the purposes of registration applications made under section 39D of the Act (s 9(1)).
Mechanically, the Determination does three things. First, it establishes three alternative pathways to meet the statutory requirement: (a) completion of a Certificate IV in Celebrancy, (b) possession of a celebrancy qualification, or (c) possession of celebrancy skills (s 6). Second, it specifies in detail what units and teaching materials a Certificate IV in Celebrancy must include; the instrument provides two alternate unit sets that satisfy the Certificate IV requirement and mandates particular legislative and departmental materials be used in the course content (s 7). Third, it prescribes what a celebrancy qualification must include , namely four listed APG unit codes (formerly CVL codes), the use of the Act and Regulations in training, and that the celebrancy qualification must be awarded by Monash University (s 8).
The Determination also contains an application and transitional provision. It applies to registration applications made on or after 1 April 2018 (s 9(1)) and preserves application of the prior 2009 Determination for applications lodged before that date where a decision had not been made by 1 April 2018 (s 9(2)). In short, the instrument operationalises the Act’s requirement that a registrable celebrant have specified training or skills by defining acceptable qualifications, the minimum unit content for those qualifications, and the materials to be used in delivering the training (ss 6-8).
