178Reporting by ship masters

#### 178 Reporting by ship masters (1) The master of a security regulated ship must report maritime transport or offshore facility security incidents (other than cyber security incidents) in accordance with this section. (2) An incident that relates to the master’s ship must be reported to: (a) the Secretary; and (b) the Australian Federal Police or the police force of a State or a Territory; and (c) if the ship is within a security regulated port—the port operator for the port; and (d) if the ship is using a port facility within a security regulated port—the port facility operator for the port facility; and (e) if the ship is located in the vicinity of a security regulated offshore facility and is engaged in any activity in relation to the facility—the offshore facility operator for the facility. (3) An incident that relates to a security regulated port (including a port facility within the port) must be reported to the port operator for the port. (4) An incident that relates to another security regulated ship must be reported to: (a) the ship operator for the ship; or (b) the master of the ship. (5) An incident that relates to a security regulated offshore facility must be reported to the offshore facility operator for the facility.
