sec.12B Tenure as public service officer on ending of particular employment contracts

This section applies if— a person is employed on contract under section 12 , other than as a pilot; and the contract— is terminated other than by disciplinary action; or expires and is not renewed or replaced by another contract of employment under section 12 ; and immediately before the person was first employed under the contract, the person was employed as a public service officer on tenure. The person becomes a public service officer employed on tenure. The person is to be employed— at the classification level at which the person would have been employed if the person had continued in employment as a public service officer on tenure; and on the remuneration to which the person would have been entitled if the person had continued in employment as a public service officer on tenure. s 12B ins 2010 No. 19 s 189 amd 2013 No. 40 s 8 (sec.12B-ssec.1) This section applies if— a person is employed on contract under section 12 , other than as a pilot; and the contract— is terminated other than by disciplinary action; or expires and is not renewed or replaced by another contract of employment under section 12 ; and immediately before the person was first employed under the contract, the person was employed as a public service officer on tenure. (sec.12B-ssec.2) The person becomes a public service officer employed on tenure. (sec.12B-ssec.3) The person is to be employed— at the classification level at which the person would have been employed if the person had continued in employment as a public service officer on tenure; and on the remuneration to which the person would have been entitled if the person had continued in employment as a public service officer on tenure.

• (a) a person is employed on contract under section 12 , other than as a pilot; and
• (b) the contract— (i) is terminated other than by disciplinary action; or (ii) expires and is not renewed or replaced by another contract of employment under section 12 ; and
• (i) is terminated other than by disciplinary action; or
• (ii) expires and is not renewed or replaced by another contract of employment under section 12 ; and
• (c) immediately before the person was first employed under the contract, the person was employed as a public service officer on tenure.
• (i) is terminated other than by disciplinary action; or
• (ii) expires and is not renewed or replaced by another contract of employment under section 12 ; and
• (a) at the classification level at which the person would have been employed if the person had continued in employment as a public service officer on tenure; and
• (b) on the remuneration to which the person would have been entitled if the person had continued in employment as a public service officer on tenure.
