Marine Safety Legislation (Lakes Hume and Mulwala) Act 2001

The Act uses a small set of legal mechanisms to effect cross-jurisdictional governance for marine safety in specific waters. These main concepts, drawn from the Act’s definitions and operative parts, are as follows.

Definitions fix the geographic scope. “Lake Hume” and “Lake Mulwala” are defined with reference to physical infrastructure and longitudes: Lake Hume is the stretch from the Hume Weir upstream to the line at longitude 147°30' east, while Lake Mulwala covers the waters from the Yarrawonga Weir upstream to longitude 146°15' east and includes the Ovens River north of the Murray Valley Highway Bridge (s 3). The Act defines two operational labels: “transferred Victorian area” and “transferred New South Wales area,” each identified as the portion of the named waters that lie within the territorial limits of the State but which are to be treated, for marine safety purposes, as belonging to the other State (s 3).

Application by reference is the central technique. Rather than rewriting or harmonising substantive marine safety requirements, the Act makes each State’s marine safety legislation, and the associated laws of that State, apply in and in relation to the transferred area as if the transferred area were within that State’s borders (s 5(1), s 9). The defined term “marine safety legislation” points to the operative marine safety Act of each State and its subordinate instruments "as in force from time to time" (s 3). The Act therefore imports, by reference, the entirety of the applied jurisdiction’s regime, including powers, duties, procedures and sanctions.

Associated laws are given a broad compass. Section 4 defines “associated laws” as laws of a State concerning a matter arising under that State's marine safety legislation. Section 4(2) gives non-exhaustive examples: investigation and prosecution (including infringement notices), jurisdiction of courts and tribunals, procedure before courts, payment and recovery of fines, jurisdiction of the Ombudsman with respect to public officials, access to information held by public officials, and statutory interpretation. This means that the Act contemplates not only substantive safety rules, but the procedural and enforcement apparatus that sits around them.

Conferral of functions and jurisdiction is explicit. All persons who have functions conferred for the purposes of the applied State’s marine safety legislation may exercise those functions in the transferred area (s 6(1), s 10(1)). Similarly, the courts of the applied State are expressly invested with jurisdiction in respect of matters arising under the applied State’s marine safety legislation as applied to the transferred area (s 6(2), s 10(2)).

Limits and discretion are built in. The Act provides that an applied State’s provision does not operate in a transferred area where it is incapable of applying, where the provision expressly excludes or limits its own territorial reach, or where it applies only to a specified locality that does not include that place (s 7(1)). The Governor in Council may make regulations to exclude particular provisions of the applied State's marine safety legislation or to prevent exclusion of particular provisions of the other State's legislation (s 8). A broad regulation-making power is available under s 13 to make necessary or convenient provisions to give effect to the Act.

Interstate enforcement arrangements are formalised. Section 11 extends appointment powers so that a State’s marine safety legislation can authorise enforcement personnel who are members of the other State’s police force or Waterways Authority, and vice versa. The Act binds the Crown in Victoria and so far as legislative power permits other capacities of the Crown (s 12).

Finally, transitional and savings mechanisms acknowledge sequencing risks. Section 14 preserves other laws that allow application of a State's laws beyond its limits (s 14(1)), provides a transitional reference if the NSW Marine Safety Act 1998 had not commenced by the commencement of this Act (s 14(2)), and allows regulations to include savings or transitional provisions where necessary (s 14(3)). These arrangements are intended to manage timing gaps and legal continuity.

This Act affects a defined set of actors by changing which State’s marine safety regime governs them when they operate in specified waters. The principal categories are listed below with the source provisions that ground the effect.

Recreational and commercial vessel operators and owners using Lake Hume and Lake Mulwala will be subject to whichever State’s marine safety legislation and associated laws have been applied to the particular waters in question (s 5(1), s 9). Because the Act applies the applied State’s legislation "as in force from time to time" (s 3), boat users must comply with the substantive duties, equipment standards, licensing, and other obligations that the applied State imposes.

Enforcement officers and agencies of both States are affected. The Act expressly authorises persons who have functions under the applied State’s marine safety legislation to exercise those functions in transferred areas (s 6(1), s 10(1)). Section 11 extends appointment powers so that a State’s power to appoint or authorise officers for enforcing its marine safety legislation may include police officers of the other State, staff of the Waterways Authority of New South Wales, or employees appointed under relevant public administration statutes (s 11). That formalises cross-jurisdictional enforcement capability and potentially requires human resource and operational coordination between agencies.

State courts and tribunals are affected through invested jurisdiction. The Act invests the several courts of the applied State with jurisdiction over matters arising under the applied State’s marine safety legislation as it applies in transferred areas (s 6(2), s 10(2)). Litigation, prosecutions, appeals and reviews arising from incidents in transferred waters will proceed in the applied State’s courts under that State’s procedural and substantive law as it applies to the matter (see s 4(2)(b), (c)).

Local governments and other public agencies with responsibilities touching on waterways will be affected indirectly where their activities intersect with marine safety matters, because s 4(2)(e) and s 4(2)(f) include Ombudsman jurisdiction and access to information held by public officials, which can have implications for oversight and administrative interactions.

Persons subject to fines, penalty or infringement notices in relation to incidents in transferred areas are affected because s 4(2)(a) and s 4(2)(d) bring investigation, prosecution, and payment and recovery of fines within the concept of “associated laws,” and the Act applies those processes from the applied State into the transferred area (s 5(1)).

The Crown and public bodies are bound. Section 12 states that the Act binds the Crown in right of Victoria and, as far as legislative power permits, the Crown in other capacities. That has implications for public authorities operating vessels or exercising powers in the lakes.

Practitioners and compliance officers acting for private clients or public agencies are affected operationally. They must determine which State's marine safety regime applies in particular parts of the lakes by reference to the geographic tests in the Act, notably the location of Bethanga Bridge and the Murray Valley Highway Bridge and the specified longitudes for the extent of the lakes (s 3 definitions). They must also track any regulations made under the Act that exclude or preserve particular provisions (s 8), and ensure that cross-appointment instruments authorised under each State's marine safety legislation are in place and valid (s 11).

Finally, the courts and enforcement agencies will need to consider procedural and evidentiary rules that the applied State’s associated laws bring into play, because s 4(2) explicitly includes evidence, appeals, review and related procedural matters among the associated laws that may apply in the transferred areas.

The Act primarily confers duties and rights by reference to the applied State’s marine safety legislation and associated laws. It does so in three legal dimensions: which statutory duties and prohibitions govern conduct in each transferred area; who has the power to enforce and adjudicate; and which procedural and remedial mechanisms are available. The Act itself contains limited independent duties; its effect is to import those duties from the relevant State.

Substantive duties and prohibitions arise under the applied State’s marine safety legislation. Section 5(1) imports the marine safety legislation of New South Wales and its associated laws into the transferred Victorian area "as if that area were within the territorial limits of New South Wales." Section 9 gives legal effect for the corresponding New South Wales Act to apply the marine safety legislation of Victoria in the transferred New South Wales area "as if that area were within the territorial limits of Victoria." Practically, this means that obligations such as licensing, vessel safety standards, speed limits, navigational rules, mandatory equipment, and operator competency requirements will be those imposed by the applied State's statutes and subordinate instruments, because the Act directs users to comply with the applied regime rather than with the regime of the State in which the water is physically located.

Enforcement powers and duties are conferred on persons with functions under the applied State's legislation. Sections 6(1) and 10(1) state that persons who have functions conferred or imposed for the purposes of the applied State's marine safety legislation may exercise those functions in relation to the transferred area. That includes investigative powers, powers to issue infringement notices, powers to detain or require production of documents, and powers to direct or control vessels, where those are part of the applied regime. The Act’s definition of “associated laws” (s 4) explicitly includes investigation and prosecution of offences, the issue of infringement notices, arrest and bail procedures, and payment and recovery mechanisms (s 4(2)(a), (d)).

Jurisdictional rights and remedies attach to the applied State’s courts and tribunals. Sections 6(2) and 10(2) invest the several courts of the applied State with jurisdiction over matters arising under the applied State’s marine safety statute and associated laws as they apply in the transferred area. Rights to seek relief, contest notices, apply for judicial review, or raise appeals will therefore be governed by the procedural and substantive jurisdictional laws of the applied State.

Cross-appointment confers rights of exercise for interstate officers. Section 11 provides that appointment or authorisation powers under a State’s marine safety legislation extend to police officers and staff from the other State’s enforcement bodies. Conversely, persons who are police officers of Victoria or employed under the Public Administration Act 2004 may be appointed under NSW marine safety legislation for enforcement purposes (s 11(2) as amended). The practical legal effect is that an officer appointed under the applied State's instrument may lawfully perform enforcement functions in the transferred area.

Limitations on applicability are rights for subjects and administrators. Section 7 provides that a provision of the applied State's marine safety legislation will not be taken to apply in a transferred area where it is incapable of applying, where the legislation itself expressly prevents application in that place, or where it applies only in a specified locality not including that place (s 7(1)). This protects against importing provisions that are territorially or conceptually impossible to operate in the transferred area.

Regulatory discretion to exclude or preserve provisions is vested in the Governor in Council. Section 8 allows regulations under this Act to exclude particular provisions of the applied State’s marine safety legislation from applying in the transferred area, and to provide that particular provisions of the other State’s legislation are not excluded. This creates an administrative power that can change which specific duties and rights apply in practice.

Savings and transitional rights are preserved. Section 14(1) makes clear that nothing in this Act limits other laws that provide for application of a State’s laws beyond its limits, so where such arrangements already exist they continue to operate. Section 14(2) creates a transitional reading for references to the NSW marine safety legislation if the NSW Act had not yet commenced at the time this Act began operation.

The Act binds the Crown, which affects public duty-holders. Under s 12 the Act binds the Crown in right of Victoria, and to the extent legislative power permits other Crown capacities. That means public entities are subject to the applied State’s marine safety legislation and its associated laws when operating in transferred areas.

This Act does not itself create specific offences, penalties, or enforcement sanctions. Instead it imports the enforcement and penalty regimes of the applied State’s marine safety legislation and its associated laws into transferred areas, and provides mechanisms to enable enforcement across State lines.

Enforcement and penalty mechanisms will therefore be those that exist under the applied State’s marine safety statute and subordinate instruments. Section 4(2) identifies the criminal and administrative enforcement-related matters that are treated as “associated laws,” including the investigation and prosecution of offences, the issue of infringement or penalty notices, arrest, bail, trial or hearing and conviction of offenders, and the payment and recovery of fines and penalties (s 4(2)(a), (d)). By applying the applied State’s marine safety legislation and associated laws in a transferred area (s 5(1), s 9), the Act brings those enforcement mechanisms into scope for incidents in the transferred waters.

Jurisdiction for prosecutions and adjudication is conferred on the courts of the applied State. Sections 6(2) and 10(2) expressly invest the several courts of the applied State with jurisdiction in all matters arising under the applied State’s marine safety and associated laws as they apply in the transferred area. That means prosecutions, hearings, appeals and enforcement proceedings will normally be conducted in the applied State’s courts using that State’s procedural rules (s 4(2)(b), (c)).

Interstate appointment and authorisation of enforcement officers is enabled to facilitate practical enforcement. Section 11 extends appointment powers so that, for example, police officers of New South Wales or members of the staff of the Waterways Authority of New South Wales may be appointed or authorised under Victoria’s marine safety legislation for enforcement in New South Wales or in the transferred Victorian area, and the converse is authorised for Victoria police officers under New South Wales legislation (s 11). Thus the Act permits enforcement officers to be endowed with lawful powers to enforce the applied State’s rules in transferred waters.

Regulation-making powers allow the Governor in Council to limit or tailor what parts of the applied State’s enforcement machinery operate in a transferred area. Section 8 allows regulations to exclude particular provisions of the applied State’s marine safety legislation or its associated laws from operating in a transferred area. That may be deployed to avoid importing enforcement mechanisms that are inapplicable or inappropriate in practice. Section 7 also sets a statutory limit by excluding applied provisions that are incapable of applying or that the applied legislation itself expressly prevents from extending to the place.

Procedural matters such as evidence, appeals and review, and the recovery of fines will follow the applied State’s associated laws where those matters are imported under s 4(2). This means enforcement agencies, suspects and regulated entities must follow the applied State’s procedures for matters such as service, admissibility of evidence, and appeal rights.

Practical enforcement costs and liabilities will fall on the persons or authorities engaged in enforcing the applied State’s regime, and regulated persons in the transferred area will bear fines or penalties imposed under the applied State’s laws. The Act binds the Crown in right of Victoria (s 12), so public entities are also potentially liable under the applied State’s regime where they operate in the transferred areas.

The Act operates as an inter-jurisdictional application statute: it makes the marine safety legislation and associated laws of one State apply in defined parts of the other State. It therefore interacts with other laws in multiple structural ways: by importing substantive law, by importing procedural and enforcement machinery, by preserving pre-existing cross-border legal arrangements, and by giving the executive regulatory power to alter the imported scope.

Imports by reference link the Act to each State’s substantive and subordinate marine safety law. Section 3 defines "marine safety legislation" for each State as the State's marine safety Act and "the regulations and other instruments made under that Act, as in force from time to time." Consequently, changes in either State’s marine safety legislation or subordinate instruments will affect the legal regime that governs the transferred areas without the need to amend this Act. Practitioners must therefore consult the applied State’s current instrument, since the Act imports the law “as in force from time to time” (s 3).

Associated laws are explicitly part of what is imported. Section 4’s definition of “associated laws” includes jurisdictional and procedural matters, investigation and prosecution machinery, payment and recovery of fines, Ombudsman jurisdiction, access to official information and legal interpretation. The Act therefore brings administrative law mechanisms (for example review and Ombudsman oversight) and criminal procedure rules (arrest, bail, trial) into interaction with the applied State’s systems when those systems are applied to transferred areas.

The Act preserves existing cross-border arrangements and other laws that provide for extra-territorial application. Section 14(1) expressly states that nothing in this Act limits other laws that provide for application of the laws of a State, or any part of those laws, beyond the limits of the State. That means pre-existing agreements, reciprocal enforcement arrangements or provisions in other statutes that allow cross-border application continue to operate alongside this Act.

Regulatory interaction is significant. Section 8 enables regulations under this Act to exclude particular provisions of the applied State’s marine safety legislation from operating in the transferred area, or to supply that particular provisions of the other State's legislation are not excluded. Section 13 gives the Governor in Council a general regulation-making power. Regulations under this Act will thus interact with other statutes by modifying the imported application of a State’s law to fit local circumstances, and those regulations can themselves have legal effects that must be reconciled with the applied State’s law.

The Act interacts with the corresponding New South Wales Act. Part 3 is expressly framed to have effect “for the purposes of the provisions of the corresponding New South Wales Act that apply the marine safety legislation of Victoria ... in and in relation to the transferred New South Wales area as if that area were within the territorial limits of Victoria” (s 9). The Act therefore presumes a reciprocal or corresponding NSW instrument that effects mirror provisions for the other State’s waters.

Transitional interaction arises where the timing of commencement differs. Section 14(2) provides that if the Marine Safety Act 1998 of New South Wales had not commenced before the commencement of this Act, references to the marine safety legislation of New South Wales are taken, until that Act commences, to be references to the Acts and regulations to be repealed by Schedule 2 to that Act. This is a textual device to ensure continuity when a new State Act is staged in.

Crown immunity and public law intersections are limited but present. Section 12 binds the Crown in right of Victoria and, insofar as legislative power permits, the Crown in all its other capacities. That places public entities under the imported applied State’s regime where they operate in transferred areas, subject to the constitutional and legislative limits on binding Crown capacity.

Finally, the Act must be read with the applied State’s marine safety legislation and its associated laws, including criminal and civil procedure, evidence statutes, and administrative law frameworks. The Act’s express inclusions in s 4 mean that components of those statutes will interact directly with local administrative processes, appeals mechanisms, fines recovery paths and Ombudsman oversight.

This Act has been subject to a small number of amendments, which mainly adjust cross-references and appointment arrangements rather than alter the Act’s core cross-jurisdictional mechanism. The endnotes in the published version record the amending instruments and the relevant sections affected. The amendments recorded in this source are set out below with the textual changes they effected.

• Marine Safety Act 2010 (No. 65/2010): This amending Act altered the definition of “marine safety legislation of Victoria” in s 3 to refer to the Marine Safety Act 2010 of Victoria, and the regulations and other instruments made under that Act, "as in force from time to time." The endnotes note that s 3's definition was amended by s 420 (Schedule 3, item 12) of the Marine Safety Act 2010, with a commencement date stated as 1 July 2012 (endnotes: Table of Amendments).

• Public Administration Act 2004 (No. 108/2004): Section 11(2) of this Act was amended so that persons who are police officers of Victoria or who are employed under Part 3 of the Public Administration Act 2004 may be appointed or authorised under the marine safety legislation of New South Wales for enforcement purposes. The endnotes list s 117(1) (Schedule 3 item 124) of the Public Administration Act 2004 as the amending provision, commencing 5 April 2005.

• Criminal Procedure Amendment (Consequential and Transitional Provisions) Act 2009 (No. 68/2009): This amending Act altered s 4(2)(a) and is recorded in the endnotes as s 97 (Schedule item 85), commencing 1 January 2010. The amendment related to the text giving examples of matters arising under marine safety legislation, specifically the list that includes investigation and prosecution of offences under the legislation.

• Victoria Police Amendment (Consequential and Other Matters) Act 2014 (No. 37/2014): This amending Act inserted a definition of “police officer” into s 3 of this Act, by reference to the Victoria Police Act 2013. The endnotes record s 10 (Schedule item 108) as the amending provision, which commenced on 1 July 2014.

The endnotes also record formal commencement history for the Act itself: the Marine Safety Legislation (Lakes Hume and Mulwala) Act 2001 was assented to on 14 November 2001 and commenced on 1 December 2001 (Endnotes, Minister’s second reading speech and commencement note). The endnotes contain a Table of Amendments listing the instruments above and the precise commencement dates for each amending provision affecting this Act.

There are no amendments noted as "Not in Operation" in the published endnotes at the date of the version incorporated in this source. The Interpretation of Legislation Act 1984 provisions on form and style are relevant for how amendments and insertions are to be read, and the endnotes reference those interpretative rules.

Practitioners should be alert to the mechanism in the Act that imports each State’s marine safety legislation “as in force from time to time” (s 3), because subsequent amendments to the operative marine safety statutes or subordinate instruments of either State will change the law that governs transferred waters without amendment to this Act. The Act’s own amendment history has, to date, been limited to cross-referencing and appointment-related adjustments rather than major scheme changes.

The Act text and the published endnotes in this source do not record any cases or judicial decisions interpreting or applying the Marine Safety Legislation (Lakes Hume and Mulwala) Act 2001. The explanatory details section in the endnotes contains "No entries at date of publication," and there are no named cases in the Act itself. The Act’s operative clauses focus on conferring jurisdiction and applying other Acts by reference, which means litigation that touches on the Act is likely to arise under the applied State’s marine safety legislation and its associated laws rather than under this Act per se.

Because this Act invests the courts of the applied State with jurisdiction for matters arising under the applied State’s marine safety legislation as it applies in transferred areas (s 6(2), s 10(2)), relevant litigation would typically appear in the applied State’s courts under the applied State’s statutory framework. Any judicial interpretation specific to the cross-application mechanism in this Act, such as disputes over whether a provision is "incapable of applying" in a transferred area under s 7(1)(a), or whether regulation-making under s 8 validly excludes specific provisions, would likely be resolved by the courts of the applied State exercising the jurisdiction conferred.

The endnotes do list the Minister’s second reading speech dates and the formal assent and commencement dates for the Act, but provide no report of litigation. Practitioners seeking relevant case law or authorities that construe or apply the cross-jurisdictional notions in this Act should consult the reported decisions of Victorian and New South Wales courts, and check whether any proceedings under the applied State's marine safety legislation have raised points about the operation of this Act. The Act itself instructs application "as if that area were within the territorial limits" of the applied State, which suggests that disputes about applicable law, procedure and enforcement will involve analysing the text of the applied State’s legislation together with the operation of this Act.

Because the source contains no litigation record, this section records the absence of litigation history within the material supplied.

Several drafting and operational features of the Act create traps for practitioners and administrators who do not read the definitions and cross-references carefully.

1. Transferred areas are not intuitive geographically. The Act does not simply assign whole lakes to the nearest State; it defines “transferred Victorian area” and “transferred New South Wales area” by reference to the portion of the lake that lies within the territorial limits of a State (s 3). That means parts of the lakes that are physically in Victoria may be governed by New South Wales marine safety legislation (s 5(1)), and parts physically in New South Wales may be governed by Victorian legislation (s 9). Failure to check the Act’s definitions, and the position of the Bethanga Bridge and Murray Valley Highway Bridge referred to in s 3, can lead to applying the wrong State’s rules.

2. The Act imports laws “as in force from time to time.” Section 3’s definition of each State’s marine safety legislation incorporates that State’s Act and instruments "as in force from time to time." This is convenient for continuity, but it means the applicable rules can change when the applied State amends its marine safety legislation or subordinate instruments. Practitioners should not assume the regime is frozen; they must check the current text of the applied State’s instruments.

3. The Act imports procedural and enforcement machinery. Section 4’s list of “associated laws” includes prosecution, court procedure, fines recovery, Ombudsman jurisdiction and access to information (s 4(2)). That means a person prosecuted in a transferred area will be subject to the applied State’s criminal and civil procedural rules, which could differ materially from the procedural rules of the State where the water is physically located. Service, evidence admissibility, appeal rights and penalty recovery will follow the applied State’s system unless a regulation modifies the effect.

4. Some provisions may be incapable of applying. Section 7(1)(a) excludes applied provisions that are “incapable of applying” in the transferred place. Determining incapacity requires a textual and practical analysis of the applied provision, and could create litigation risk where a provision is technically imported but practically impossible to enforce in the transferred area. The Act does not itself specify how incapacity is to be resolved.

5. Regulation-making power can change the regime. Section 8 allows the Governor in Council to exclude particular provisions of an applied State’s marine safety legislation from operating in transferred areas, or to provide that particular provisions of the other State’s legislation are not excluded. That regulatory discretion can alter which specific duties or enforcement mechanisms apply, and regulations may be changed over time. Users should check not only the applied State’s law but also any regulations made under this Act.

6. Cross-appointment instruments require attention. Section 11 extends appointment and authorisation powers to interstate officers, but those appointments must be made under the applicable State’s marine safety legislation. Absent valid appointment or authorisation instruments, enforcement actions by interstate officers could be challenged. The Act also contains amendments to s 11(2) changing who may be appointed; those amendments should be checked for historical or present effect.

7. References to physical infrastructure and longitudes are specific. The Act fixes the extent of the lakes and the relevant boundaries by reference to Hume Weir, Yarrawonga Weir, the Bethanga Bridge, the Murray Valley Highway Bridge, and specified longitudes (s 3). Where a bridge is replaced, the Act’s definitions pick up the replacement bridge, but practitioners should verify the current physical facts to determine whether particular waters fall within a transferred area.

8. The Act does not itself harmonise substantive standards. It reallocates which State’s regime applies; it does not reconcile differences between the two States’ substantive marine safety rules. Operators that move between different parts of the lakes may face differing equipment, licensing, or conduct requirements depending on the transferred area they are in.

9. Transitional reading if NSW Act timing differs. Section 14(2) provides a transitional interpretation if the NSW Marine Safety Act 1998 had not commenced at the time this Act started, treating references to the NSW marine safety legislation as references to the Acts and regulations to be repealed by Schedule 2 to that Act until it commences. Practitioners must account for such transitional textual substitutions where they may apply.

10. The Act’s text does not capture reciprocal details. Part 3 refers to the “corresponding New South Wales Act,” and this Act has effect for the purposes of the corresponding Act (s 9). To understand the full operational arrangement, one must read the corresponding NSW instrument; failure to do so risks missing reciprocal details that will govern transferred New South Wales areas.

Overall, the principal practical gotchas are around determining which State’s rules apply in a given spot, ensuring enforcement officers have valid appointment and authorisation, and tracking the applied State’s evolving laws and any regulations made under this Act.

Compliance under this framework involves three layers: determining the applicable regime for particular waters, ensuring personnel and operational authorisations are in place, and maintaining administrative processes to manage enforcement, fines and procedures as dictated by the applied State.

1. Identify the transferred area before applying rules. Use the statutory definitions in s 3 to determine whether a given location lies in the transferred Victorian area or the transferred New South Wales area. The practical markers are the Bethanga Bridge, the Murray Valley Highway Bridge, Hume Weir, Yarrawonga Weir and the specified longitudes (s 3). Where a bridge has been replaced after commencement, the definitions adopt the replacement bridge; nonetheless confirm the contemporaneous physical facts.

2. Confirm which State’s marine safety legislation applies "as in force." After establishing the location, apply the marine safety legislation of the designated applied State and any associated laws noted in s 4. Because s 3 imports the applied State’s Act and subordinate instruments "as in force from time to time," compliance requires consulting the current statutory and regulatory texts of the applied State rather than relying on archived or out-of-date instruments.

3. Check regulations under this Act for exclusions or preservations. Section 8 authorises regulations to exclude particular provisions of the applied State’s marine safety legislation from operating in a transferred area, and to provide that particular provisions of the other State’s legislation are not excluded. Before acting on a point of law that appears to be imported, verify whether the Governor in Council has made regulations under s 8 or s 13 that alter the imported scope.

4. Ensure enforcement officers are validly appointed or authorised. If your organisation relies on enforcement cooperation or cross-appointed officers, check that appointments and authorisations comply with the applied State’s marine safety legislation and that any cross-appointments required by s 11 have been executed. Section 11 allows appointment of police officers and Waterways Authority staff of the other State, and conversely supports appointment of Victoria police or public administration employees under New South Wales legislation as amended.

5. Prepare to follow the applied State’s procedural rules. Investigations, prosecutions, infringement notices, appeals, review, and fines recovery will typically follow the applied State’s associated laws (s 4(2)(a), (b), (c), (d)). Compliance officers should set up processes that align with those procedural requirements, including evidence gathering, preservation, service of notices, and records management, as the applied State’s own procedural rules may differ from those of the State where the water is physically located.

6. Manage signage, guidance and education for water users. Because different parts of the lakes may be governed by different State regimes, operators should provide map-based guidance for boaters and other users showing which rules apply in which areas, with references to the applicable State's licensing, equipment and conduct requirements. This reduces the risk of inadvertent non-compliance when vessels move between transferred areas.

7. Address cross-border contractual and insurance issues. Commercial operators should check that their insurance and contractual arrangements account for the applicable State’s regulatory regime and enforcement mechanisms in the waters where they operate. Since penalties, seizure powers and operator obligations may differ between regimes, insurance policies and client contracts should be reviewed to ensure coverage and indemnities align with the applicable law.

8. Record and track fines, infringement and recovery processes. Section 4(2)(d) brings payment and recovery of fines into associated laws. Organisations that collect fees, pay fines or manage penalty processes must be prepared to interact with the applied State’s recovery mechanisms and any cross-border debt recovery processes.

9. Maintain liaison with both States’ maritime enforcement agencies. Operational coordination between Victorian and New South Wales enforcement bodies will reduce enforcement gaps and duplication. Establish formal points of contact to confirm authorisation and to coordinate cross-appointment logistics under s 11.

10. Monitor legislative change in both States and regulations under this Act. Because the Act imports the law of each State “as in force from time to time” and because the Governor in Council may make regulations that modify which provisions apply in transferred areas, compliance requires ongoing monitoring of amendments in both Victoria and New South Wales and of any regulations made under this Act.

Practical compliance will therefore require legal review, operational mapping of waterways, personnel appointment checks, procedures aligned to the applied State’s processes, and ongoing regulatory surveillance. The Act’s structure places the onus on operators and enforcement bodies to determine and follow the applicable State’s marine safety legislation and associated laws for the parts of Lake Hume and Lake Mulwala that are subject to the transfer mechanism set out by this Act.
