Marine Safety (Fees) Regulations 2021

The Regulations revolve around a small set of recurring concepts: fee units, classes of service (vessel categories, licence classes, certificates, pilotage services), who collects the fee, and temporal conversion mechanisms.

Fee units and their conversion. The Regulations primarily express monetary obligations as a quantity of fee units (see regs 5, 8, 11, 13, 15, 16-24). Fee units are a statutory accounting device defined and valued under the Monetary Units Act 2004. The endnotes state that a fee is calculated by multiplying the number of fee units by the value of a fee unit for the relevant financial year, as fixed by the Treasurer under s 5 of the Monetary Units Act (Endnotes: Fee Units). The endnotes give the fee unit value for the year commencing 1 July 2023 as $15.90 and require rounding of the calculated fee to the nearest 10 cents. The Regulations therefore separate the nominal amount (fee units) from the real dollar charge by delegating annual dollar updates to the Treasurer.

Classes of fees. Fees are grouped by the regulated activity:

• Vessel fees (Part 2 Div 1): boating facilities and safety education levies, transfer of registration, special identification plates (regs 5-7).
• Marine licences and endorsements (Part 2 Div 2): annual grant/renewal fees by licence class, replacement documents, record searches, knowledge-test fees and refund mechanics for cancelled licences (regs 8-12).
• Local knowledge certificates (Part 2 Div 3): issue/renewal, duplicate, and separate fees for written and oral examinations (regs 13-15).
• Pilotage (Part 2 Div 4): application and grant fees for pilot licences and exemptions, duplicate documents, examination fees that vary by port/channel combinations, and registration fee for pilotage services providers (regs 16-24).

Differential pricing by vessel or licence class. Several fees scale with the regulated entity. Examples: two bracketed annual fees for recreational vessels in reg 5 (up to 4.0 m and over 4.0 m); two licence classes in reg 8 (general and restricted) with different annual fee units; pilotage examination and exemption examinations charged according to combinations of ports and channels with separate fee‑unit values in table form (regs 19 and 23).

Administrative actors and discretion. The Safety Director is the named administrative collector and decisionmaker in many provisions: the Safety Director receives fees, may conduct examinations (reg 23: conducts exams and charges the fee), and has express discretion to refund a portion of a licence fee on cancellation (reg 12). The Treasurer has a procedural role tied to setting the fee unit dollar value.

Cross‑referenced definitions and legal architecture. The Regulations borrow defined terms, notably “declared port waters” and “length”, from the Marine Safety Regulations 2012 (reg 4 and Endnotes: explanatory details). They also use statutory references to the Marine Safety Act 2010 for authorisation and to identify which Act provisions trigger the fee obligations (for example regs 11, 16, 20, 24 cite relevant Act sections).

Timing and life cycle. The Regulations took effect on 7 July 2021 (reg 3), were amended by S.R. No. 66/2023 (noted in the Table of Amendments and endnotes) and have an automatic sunset 10 years from the date of making (Endnotes: general information). The annual nature of many fees and the Treasurer’s annual fee unit setting introduce a recurring administrative refresh for fee calculation.

Practical interplay of fixed-dollar and fee-unit provisions. Not all charges use fee units. Some are expressed in absolute dollar amounts (for example the $6.60 search fee in reg 10 and the endorsement fees listed as dollar amounts in reg 8(1) items 3-4). Practitioners must therefore treat conversion and payment methods differently depending on the regulation in question.

Together, these concepts define a modular fee schedule: the Regulations specify the bill for identified actions and the administrative mechanics for converting the schedule into current‑dollar obligations.

The Regulations affect a discrete set of regulated persons and entities engaged in marine activities in Victoria. Primary payers and affected parties are:

• Recreational vessel owners and operators who must pay boating facilities and safety education fees calibrated by vessel length and engine power (reg 5). The table distinguishes vessels up to and including 4.0 metres and those over 4.0 metres, producing different annual fee‑unit charges.
• Any person who acquires a registered vessel, because they must pay the transfer of registration fee when taking ownership (reg 6). The note to reg 6 directs readers to reg 18 of the Marine Safety Regulations 2012 for associated obligations on persons acquiring vessels.
• Owners applying for special identification plates for their vessels, who must pay the prescribed fee for issue (reg 7), with the process governed by reg 25 of the Marine Safety Regulations 2012 (note to reg 7).
• Applicants for marine licences and restricted marine licences, including those seeking endorsements on a general or restricted licence (reg 8). The Regulations specify annual fees for a general licence (2.5 fee units/year) and restricted licence (1.25 fee units/year), and small dollar amounts for endorsements (reg 8(1) Table).
• Holders who need replacement licence documents after loss, theft, damage or illegibility (reg 9), and persons requesting searches of marine licence records (reg 10).
• People required to undertake marine licence knowledge tests under sections 53(2), 54(2) or 55(5) of the Act, because reg 11 sets the test fee payable to the Safety Director.
• Holders and applicants for local knowledge certificates, and candidates for the written and oral examinations that accompany those certificates (regs 13-15).
• Aspiring pilots and pilotage services providers: applicants for pilot licences, those sitting examinations for pilot licences, applicants for pilot exemptions, and entities applying for registration as a pilotage services provider, are all subject to financial obligations under regs 16-24. The pilotage examination fees are sensitive to which ports and channels are involved (regs 19 and 23 tables).
• Eligible veterans, as a constrained subgroup of applicants for some general marine licences, because reg 8(2) renders the fee nil where the applicant qualifies as an “eligible veteran” in the sense used by the Road Safety (Vehicles) Regulations 2021 and notifies the Safety Director before commencement of the grant/renewal/endorsement.
• The Safety Director as collector and administrator: the Regulations place collection and some decisionmaking responsibilities with this office (see regs 11, 12, 13, 17, 21, 23).

Secondary affected parties include commercial operators whose personnel require licences, training providers that prepare candidates for knowledge tests and local knowledge examinations, and port authorities and private pilots who may be affected by the structure of pilotage examination fees.

Who decides. The Regulations make clear that the Treasurer fixes the dollar value of a fee unit annually under the Monetary Units Act 2004 (Endnotes: Fee Units), and the Safety Director collects fees, conducts or commissions examinations, and may give refunds in specified circumstances (regs 11, 12, 23). The Marine Safety Act 2010 supplied the legislative authorisation for these subordinate rules (reg 2 references ss 309, 310 and 312).

Who bears the cost. The immediate burden falls on regulated persons who seek licences, certificates, examinations and related administrative services. Vessel purchasers pay the transfer fee; licence applicants and holders pay annual licence fees (with a limited veteran exemption); those sitting examinations or requiring duplicate documents pay per‑event charges. Because many fees are recurring and expressed per annum, frequent renewals or multi‑staff certifications increase cost exposure for commercial operators.

Who benefits. The Regulations do not state hypothecation of revenue. They operationally allocate the administrative cost of the regulatory scheme to the regulated population by requiring direct fees for regulatory services and documents.

Geographical and subject limits. Several pilotage and examination fees are keyed to specific ports and declared port waters (regs 19, 23). The Regulations incorporate the defined term “declared port waters” as in the Marine Safety Regulations 2012 (reg 4), meaning that port‑specific obligations and fees only apply where that statutory designation exists.

In sum, the Regulations impose direct financial obligations on individual licence applicants and holders, vessel owners, examination candidates and pilotage applicants; administrative responsibility lies with the Safety Director and the Treasurer for collection and fee‑unit valuation respectively.

The Regulations create financial duties and limited administrative rights associated with marine regulation. They do not create new prohibitions or substantive safety duties; rather, they attach monetary obligations to the administrative lifecycle of licences, certificates and pilotage permissions.

Primary duties

• Pay prescribed fees: Persons must pay the fee specified for the relevant instrument or service before or as required by the administering process. Fees are specified for annual licence grants and renewals (reg 8), duplicates and replacements (regs 9, 18, 22), examinations (regs 11, 15, 19, 23), applications for pilot licences or exemptions (regs 16, 20), and registration as a pilotage services provider (reg 24).
• Pay per event where specified: Examination fees are payable per sitting (reg 15(1) and (2)). The marine licence knowledge test fee is explicitly required to be paid to the Safety Director before sitting the test (reg 11).
• Notify in time to claim concession: An applicant who is an “eligible veteran” must notify the Safety Director that they are an eligible veteran before the date of commencement of the grant, renewal or endorsement to obtain a nil fee for certain general marine licences (reg 8(2)(b)). The concession is therefore contingent on ineligibility being asserted before the administrative action commences.

Limited rights and administrative discretions

• Refund on cancellation: If the Safety Director cancels a marine licence under regulation 55(4) of the Marine Safety Regulations 2012, the Safety Director may refund part of the licence fee according to a specified pro rata formula (reg 12). The formula is itemised in reg 12 and depends on the unexpired months (A), total months granted (B) and amount paid (C).
• Replacement and duplicate documents: The Regulations provide a right to obtain a replacement licence document or duplicate certificate on payment of the prescribed fee (regs 9, 14, 18, 22).
• Application consideration: The Safety Director is entitled to consider applications for renewal of pilot exemptions and charge an additional fee for considering a renewal application (reg 20(2)). The Regulations do not prescribe criteria for consideration; those substantive standards sit in the Act and the Marine Safety Regulations 2012.
• Examination conduct: The Safety Director may conduct examinations directly (reg 23) or have them conducted by or on behalf of the Safety Director (reg 15 for local knowledge certificates). The conduct, scheduling and manner of the examination are administrative powers aligned with the Act and the Marine Safety Regulations 2012.

Procedural cross‑references that create duties. Many fees sit alongside duties in other instruments. For example, reg 6’s note directs attention to reg 18 of the Marine Safety Regulations 2012 for obligations on persons acquiring a vessel; reg 7 references reg 25 of the Marine Safety Regulations 2012 for requirements to apply for a special identification plate; reg 9’s note references reg 49 of the Marine Safety Regulations 2012 for requirements to obtain a replacement marine licence. The fee payments are therefore ancillary to duties or processes described elsewhere; compliance requires attention to both the fee schedule and the procedural/regulatory requirements in the principal regulations.

Limits on rights. The Regulations do not create an express right of appeal against the amount set for a fee; disputes about fee quantum would, in practice, be handled under the administrative mechanisms in the Act or other applicable administrative review or judicial review processes, none of which are created or altered by these Regulations.

Payment mechanics and delegation. The Regulations specify that fees are to be paid to the Safety Director in many provisions (for example regs 11, 13, 17, 21, 23). The Treasurer’s duty is to publish the fee‑unit value each year (Endnotes: Fee Units); thus payment mechanics combine administrative collection by the Safety Director with annual valuation by the Treasurer.

In essence, the Regulations assign clear monetary duties to those engaging with the State’s marine licensing and pilotage systems, while giving the Safety Director and the Treasurer narrowly defined administrative discretions to collect, refund and set annual currency conversions.

The Regulations themselves do not contain express penalty provisions for non‑payment of the prescribed fees. They are a schedule of charges that operate within the enforcement architecture of the Marine Safety Act 2010 and the Marine Safety Regulations 2012. The instrument nonetheless prescribes mechanisms and administrative touchpoints that have enforcement implications; these include collection, conditional refunds, and cross‑references to other provisions that carry substantive compliance obligations.

Enforcement actors and mechanisms referenced. The Safety Director is the primary administrative actor named for receiving fees, conducting or arranging examinations, and making refund decisions (see regs 11, 12, 13, 17, 21, 23). The Safety Director’s capacity to deny the benefit of a licence, certificate or pilot permission is implicit because payment of the prescribed fee is a necessary step in the grant/renewal/issue processes set out in the Act and the Marine Safety Regulations 2012, which are cited in the notes accompanying several regulations (for instance, regs 6, 7, 9, 10 notes). Any failure to meet statutory prerequisites under the Act and the principal regulations may therefore prevent the administrative grant.

No express penalty rates in this instrument. The Regulations do not set monetary penalties, infringement notices or criminal sanctions for failing to pay a specific fee. Penalties for offences, if any, are located in the Marine Safety Act 2010 and associated regulations; the present Regulations do not create or modify those penalty provisions. Practitioners must therefore consult the Act and the Marine Safety Regulations 2012 for the full enforcement regime applicable to, for example, operating without a licence or failing to comply with licensing conditions.

Refund and resolution process. The Regulations give the Safety Director discretion to refund part of a marine licence fee on cancellation under regulation 55(4) of the Marine Safety Regulations 2012, calculated using the formula in reg 12. That provision is an administrative remedy, not a penalty, and the calculus of the refund (A/B × C) is specified precisely in the text (reg 12). The existence of a statutory refund formula reduces uncertainty about the quantum of refunds in cancellation cases where reg 55(4) is engaged.

Fees and procedural consequences. Because some processes explicitly require payment of a fee to proceed (for example, reg 11 requires fee payment to the Safety Director to sit a compulsory knowledge test), non‑payment is a de facto bar to procedural progression even where no standalone penalty is stated in the Regulations. Administrative enforcement is therefore realised through denial or suspension of the underlying service, permit or process rather than through a separate penalty in these Regulations.

Interaction with other enforcement provisions. The Regulations are framed as subordinate instruments made under ss 309, 310 and 312 of the Marine Safety Act 2010 (reg 2). Those sections of the Act confer powers that include the charging of fees and may describe the consequences of non‑compliance elsewhere in the Act. For sanctions, suspension, revocation, or other enforcement responses to non‑payment or non‑compliance, recourse will be to the Act and the Marine Safety Regulations 2012 rather than to the fees Regulations themselves.

Administrative review and dispute resolution. The Regulations do not articulate an internal review mechanism, dispute resolution process or appeal route specific to fee quantum or fee collection disputes. Such remedies, where they exist, are to be found in the Act, in general administrative law, or under Victorian statutory administrative review mechanisms. Practitioners disputing a fee or seeking a refund will need to engage those avenues rather than rely on any special appeals process in the fees instrument.

In summary, the instrument creates binding billing obligations and administrative levers to collect fees and to withhold regulatory services where fees are unpaid. It does not itself create penalty rates or infringement mechanisms; enforcement relies on the broader statutory framework of the Marine Safety Act 2010 and subordinate regulations.

The Regulations operate as subordinate legislation in a statutory network. The text explicitly references, and depends upon, several principal Acts and subordinate instruments; interaction with those instruments establishes duties, definitions, valuation mechanics, and procedural steps.

Authorising Act. The Regulations were made under sections 309, 310 and 312 of the Marine Safety Act 2010 (reg 2). Those sections are the statutory basis for prescribing fees and making subordinate rules. The Regulations thus implement the Act’s fee‑charging powers by specifying amounts and the administrative mechanics for particular processes under the Act (for example, licence grants, pilotage permissions).

Marine Safety Regulations 2012. The fee schedule cross‑references the Marine Safety Regulations 2012 for key definitions, procedural steps and related obligations. The definition of “declared port waters” and “length” are adopted from the Marine Safety Regulations 2012 (reg 4 and Endnotes: explanatory details). Notes to regs 6, 7, 9 and 10 point practitioners to specific provisions of the Marine Safety Regulations 2012 that govern obligations when acquiring a vessel, applying for a special identification plate, issuing a replacement marine licence document, and records of marine licences respectively. Hence, compliance requires reading the fees instrument alongside the operative technical and procedural obligations in the principal regulations.

Monetary Units Act 2004. Fee quantum is largely expressed in fee units, the conversion of which into dollars is governed by the Monetary Units Act 2004. The endnotes recap the statutory conversion process: section 7 of the Monetary Units Act is used to calculate the dollar amount, the Treasurer fixes the fee unit’s value under section 5, and the value must be published before 1 June in the preceding financial year (Endnotes: Fee Units). For the financial year starting 1 July 2023 the fee unit value is recorded as $15.90. This interaction separates the policy decision about the nominal fee (how many fee units) from the fiscal and budgetary decision about the real dollar amount (set by the Treasurer).

Subordinate Legislation Act 1994. The endnotes record that the Regulations will sunset after 10 years under section 5 of the Subordinate Legislation Act 1994 (Endnotes: general information). That statutory interaction imposes a lifecycle constraint requiring either re‑making or replacement of the instrument (or legislative intervention) before the sunset date if the fee regime is to continue.

Road Safety (Vehicles) Regulations 2021. The definition of “eligible veteran” used for the concession in reg 8(2) is drawn from regulation 5 of the Road Safety (Vehicles) Regulations 2021 (reg 8(3) and Endnotes: explanatory details). This cross‑reference externalises the concept of eligible veterans to another statutory instrument; practitioners must check that instrument to determine entitlement.

Marine Safety Act operational sections. Several provisions in the fees instrument reference sections of the Act that create or trigger licensing, testing or pilotage obligations. Examples: reg 11 links the knowledge-test fee to tests required under ss 53(2), 54(2) or 55(5) of the Act; reg 16 ties its application fee to s 251(2)(b)(ii); reg 20(1) refers to s 253(2)(b)(ii); and reg 24 references s 240(2)(c) for registration as a pilotage services provider. These references show that the fees are accessory to substantive statutory powers and procedural steps found in the Act.

Other administrative law and fiscal rules. The Treasurer’s duty to publish the fee unit value ties the Regulations into the government’s fiscal calendar and publication obligations. Administrative law remedies (judicial review, merits review where available) in respect of decisions made under the Act and Marine Safety Regulations 2012 remain available in the absence of a bespoke dispute process in the fees instrument. The Regulations do not displace general obligations in administrative law (for example procedural fairness) nor the requirements for lawful delegation under the Act that authorised the Regulations.

Practical cross‑instrument consequences. Because fees are payable to secure permits, licences and certificates created under the Act and principal regulations, non‑payment will have procedural and operational consequences across instruments. For example, failing to pay the licence fee prevents the procedural completion of a licence grant under the Act and the principal regulations. Similarly, the veteran concession draws on an external definition, meaning changes to that external instrument could affect who pays under these Regulations without any amendment to the fees instrument itself.

In short, the Regulations are tightly integrated into the statutory architecture for marine safety: they implement the Act’s fee powers, adopt definitions and processes from the Marine Safety Regulations 2012, rely on the Monetary Units Act for valuation mechanics, and interact with cross‑sector instruments such as the Road Safety (Vehicles) Regulations 2021 for eligibility definitions.

The Regulations were made on 6 July 2021 and came into operation on 7 July 2021 (reg 3 and Endnotes: general information). The printed version in this source is a consolidated version incorporating amendments up to 1 July 2023 (Version No. 002).

Recorded amendments in the source:

• Marine Safety (Fees) Amendment Regulations 2023, S.R. No. 66/2023. Table of Amendments (Endnotes: Table of Amendments) records that the amendment instrument was made on 27 June 2023 and commenced on 1 July 2023. The explanatory heading to Regulation 8 notes that Reg. 8 was amended by S.R. No. 66/2023 (reg 8 amended by S.R. No. 66/2023 reg. 4(1)(2) with reference to ILA s. 39B(2)). The insertion of reg 8(2) and reg 8(3) is identified in the marginal notes: reg 8(2) and reg 8(3) were inserted by S.R. No. 66/2023 reg. 4(2). The new subregulation introduced the eligible veteran exemption mechanism for some general marine licence fees, and the qualifying definition cross‑reference was also inserted.

• Earlier instruments and references that affect definitions used by the Regulations are summarised in the endnotes to the consolidated version: reg 4’s definition of “declared port waters” is taken from the Marine Safety Regulations 2012 as amended by a number of Statutory Rules (S.R. Nos 102/2013, 153/2015, 158/2015, 143/2016, 74/2017, 138/2017, 101/2018, 61/2019, 146/2019 and 63/2020) (Endnotes: explanatory details 1). The endnotes also note that the definition of “eligible veteran” in reg 8(3) originates in S.R. No. 116/2021 and was subsequently amended by a sequence of Statutory Rules (S.R. Nos 47/2022, 51/2022, 129/2022, 130/2022, 53/2023, 54/2023 and 67/2023) (Endnotes: explanatory details 2). These cross‑references indicate the Regulations’ reliance on a living body of subordinate instruments for definitions and eligibility categories.

• Style changes and interpretive adjustments. The printed version includes a standard note on style changes under the Interpretation of Legislation Act 1984 (ILA) (Endnotes: Interpretation of Legislation Act 1984). That note explains that certain style changes authorised by ILA s 54A are applied and that references to ILA s 39B are present where undivided regulations were subsequently subdivided.

Lifecycle constraint. The endnotes record that the Regulations will sunset 10 years after making, on 6 July 2031, under s 5 of the Subordinate Legislation Act 1994 (Endnotes: general information). This is not an amendment but a statutory expiry provision that affects the instrument’s long‑term continuity.

Practical implications of amendment history. The 2023 amendment is the primary substantive change recorded in the consolidated version: it introduced an eligible veteran exemption for some general marine licence fees and the associated cross‑reference to the Road Safety (Vehicles) Regulations 2021 definition. Other changes reflected in the endnotes have been to upstream definitions in the Marine Safety Regulations 2012 that affect the meaning of terms used here, rather than to the fees schedule itself.

For researchers and practitioners, the key archival points are: consult the instrument as consolidated to 1 July 2023 for the current text; check S.R. No. 66/2023 for the precise wording and legislative history of the 2023 amendments; and monitor the Treasurer’s annual fee unit determinations under the Monetary Units Act 2004 as they affect the real dollar value of fee‑unit denominated items.

The text of the Marine Safety (Fees) Regulations 2021 and the accompanying endnotes do not record any litigation concerning the Regulations. The instrument’s endnotes and Table of Amendments focus on statutory amendments and interpretive notes; they do not summarise cases, judicial determinations, or administrative appeals pertaining to the fees schedule. Consequently, no reported decisions, appeals, or litigation outcomes are cited in this consolidated source.

What this means operationally:

• Absence of cited cases in the instrument does not imply that disputes have not arisen in practice; it indicates that this consolidated version does not incorporate or summarise litigation history. To identify any judicial or tribunal consideration of these Regulations, one must search Victorian and federal judicial databases, tribunal records, and administrative review decisions for cases mentioning the Marine Safety (Fees) Regulations 2021 or related provisions of the Marine Safety Act 2010.
• Where disputes are likely to occur, the Regulations provide a couple of explicit hooks that could give rise to procedural challenge or review: the Safety Director’s discretion to refund (reg 12) and the administration of concessions (reg 8(2) , eligible veteran exemption). Challenges to administrative exercise of discretion typically arise under administrative law principles (judicial review for legality, and administrative review where available). None of those processes are referenced in the Regulations themselves.
• Potential factual disputes that could lead to litigation or review include contested entitlement to the eligible veteran concession (because reg 8(2) requires timely notification to the Safety Director), the application of the refund formula following licence cancellation (reg 12’s arithmetic), or disagreement about whether a particular port/channel combination attracts a specified pilotage examination fee (regs 19 and 23 tables rely on the definition “declared port waters” from the Marine Safety Regulations 2012).

For practitioners preparing for possible disputes, the practical steps are: (1) keep contemporaneous records of fee payments and notifications (especially veteran notifications), (2) retain correspondence with the Safety Director in case of later contest about entitlement or refund calculations, and (3) prepare to engage the administrative review or judicial review processes under the Act or general administrative law if outcomes suggest unlawfulness or procedural unfairness. Because the Regulations do not cite or summarise any cases, specific litigation precedent cannot be asserted from this instrument alone.

If a client requires identification of any judicial consideration of these Regulations since commencement, a secondary search of case law databases and tribunal records will be necessary; the Regulations’ text does not provide litigation history.

Several features of the Regulations are particularised and can cause practical issues if overlooked. The following are concrete points to watch for, with references to the enabling text.

1. Fee‑unit conversion and timing. Most fees are specified in fee units and must be multiplied by the fee‑unit dollar value fixed by the Treasurer under the Monetary Units Act 2004. The endnotes record the fee unit value for the financial year commencing 1 July 2023 as $15.90 and require rounding to the nearest 10 cents (Endnotes: Fee Units). Practitioners must verify the fee‑unit value applicable to the specific financial year of payment, because the Treasurer’s annual determination changes the dollar amount without amendment to the Regulations themselves. Failure to use the correct fee‑unit value results in underpayment or overpayment.

2. Mixed units: dollars vs fee units. Some charges are expressed as fixed dollar amounts (for example reg 10’s $6.60 search fee and reg 8(1) items 3-4 for endorsements listed as $5.10 and $2.50 respectively), while others use fee units. This mixture means that automated billing or accounting systems must be configured to handle both types and the correct rounding rule applies to calculated fee‑unit conversions.

3. Veteran concession timing trap. The eligible veteran concession in reg 8(2) is conditional on timely notification: the applicant must notify the Safety Director that they are an eligible veteran before the date of commencement of the grant, renewal or endorsement (reg 8(2)(b)). The concession therefore requires advance administrative action; retroactive claims after the licence has commenced are not permitted by the text. Practitioners advising veteran clients must ensure the notification is lodged prior to the administrative commencement date.

4. Refund calculation specifics. The refund for cancelled marine licences is optional (the Safety Director “may” refund) and calculated by a specified formula (reg 12). The formula is proportionate: refund = (A/B) × C, where A is the unexpired number of months, B is the total number of months granted, and C is amount paid. Practitioners should preserve precise dates and payment records because the refund sum is formulaic and susceptible to disputes about how months are counted.

5. Identical fees for duplicates and substantive issues. For some items the fee for a duplicate document equals the issue fee (for example local knowledge certificate issue and duplicate are both 4.6 fee units, regs 13-14). Failure to note that duplicates carry the same cost as an original may surprise clients and suggests evaluative caution when electing to order duplicates.

6. Examination fees scaled by ports and channels. Pilotage examination fees (reg 19) and the Safety Director’s conduct of pilot exemption examinations (reg 23) are set by a matrix of port/channel combinations with material variance in fee‑unit amounts. Misidentifying which combination applies (for example “Port of Melbourne waters (both channels)” vs “one channel”) produces large fee differences (see regs 19, 23). Further, the term “declared port waters” is defined in the Marine Safety Regulations 2012 (reg 4 and Endnotes: explanatory details), so the applicability of a particular fee depends on that separate instrument’s definitions.

7. Application fees vs consideration fees. For pilot exemptions, the Regulations impose a prescribed application fee and, in addition, a fee for the Safety Director to consider a renewal (reg 20(1) and (2)). Practitioners must budget for both the lodgement fee and any consideration fee at renewal.

8. Sunset date. The Regulations will sunset on 6 July 2031 (Endnotes: general information). Legislative or administrative changes needed to keep the schedule operative beyond that date must be made before the sunset. This is a medium‑term planning factor for fee revenue forecasting and compliance processes.

9. Cross‑instrument definitions. Terms like “eligible veteran” and “declared port waters” are defined in other instruments (reg 8(3); reg 4). Changes in those instruments can alter who pays and how, without an amendment to the fees Regulations themselves,so stay alert for upstream amendments.

10. Rounding rule for calculated fees. The endnotes require rounding of calculated fee amounts to the nearest 10 cents (Endnotes: Fee Units). Good financial practice demands using that rounding convention consistently across billed items; failure to do so could create small reconciliation mismatches.

In practice, the combination of annual fee‑unit recalibration, mixed unit types (dollars and fee units), port‑sensitive pilotage fees, timing conditions on concessions and the absence of fee waivers beyond the specific eligible veteran concession are the principal operational “gotchas” to manage when advising clients or running compliance systems.

Compliance with the Regulations requires integrating fee computation, payment procedures, and administrative notifications into routine marine licensing and pilotage workflows. The following is a stepwise checklist drawn strictly from the Regulations and endnotes.

1. Determine the relevant fee item. Identify which regulation and table row applies to the activity: vessel boating facilities and safety education (reg 5), transfer of registration (reg 6), special identification plate (reg 7), licence class and endorsement (reg 8), replacements (regs 9, 18, 22), searches (reg 10), tests/exams (regs 11, 15, 19, 23), local knowledge certificates (regs 13-15), pilotage applications/exemptions (regs 16, 20-21), or registration as a pilotage services provider (reg 24).

2. Check whether the fee is in fee units or fixed dollars. Note the unit type in the relevant regulation. If the fee is in fee units, proceed to step 3. If it is in fixed dollars (for example reg 10’s $6.60, or endorsement amounts in reg 8(1) items 3-4), use that figure directly and apply any rounding rule only if conversion is required.

3. If fee units apply, obtain the fee‑unit value for the correct financial year. Under the Monetary Units Act 2004, the Treasurer fixes the fee unit value annually and publishes it in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year (Endnotes: Fee Units). For the financial year commencing 1 July 2023, the endnotes record a fee unit value of $15.90; confirm the value applicable to the year of payment.

4. Calculate and round the dollar amount. Multiply the number of fee units by the fee‑unit dollar value. Round the resulting amount to the nearest 10 cents as required in the endnotes (Endnotes: Fee Units). Record the calculation and rounding to support any audit or dispute.

5. Payment recipient and timing. Pay the fee to the Safety Director where the regulation specifies (see regs 11, 13, 17, 21, 23). Many fees are payable “must be paid to the Safety Director” before sitting tests or being issued a licence/certificate. Confirm any procedural payment requirements set out in the Marine Safety Act 2010 or the Marine Safety Regulations 2012 (cross‑references in the notes to regs 6, 7, 9, 10).

6. Eligible veteran concession notification. If an applicant claims the eligible veteran concession for relevant general marine licence fees, ensure the applicant provides the required notification to the Safety Director before the date of commencement of the grant, renewal or endorsement (reg 8(2)(b)). Verify eligibility reference in the Road Safety (Vehicles) Regulations 2021 (reg 8(3)).

7. Keep documentary proof. Preserve receipts, evidence of deposited payments, copies of the notification to the Safety Director (for veteran concessions), and application submissions. The refund formula in reg 12 is arithmetic; clear records of payment dates and licence commencement/cancellation dates are necessary to calculate any refund owed.

8. For cancellations and refunds. If a licence is cancelled under regulation 55(4) of the Marine Safety Regulations 2012 and a refund is sought, expect the Safety Director to apply the formula in reg 12: refund = (A/B) × C (A = unexpired months, B = total months granted, C = amount paid). Provide documentary proof of dates and amounts paid to support the calculation.

9. Examination logistics. For tests and examinations, ensure the relevant fee is paid before sitting as the Regulations require payment (reg 11 for marine licence knowledge tests; reg 15 for local knowledge certificate examinations; regs 19 and 23 for pilotage examinations). Understand whether the examination is conducted “by, or on behalf of, the Safety Director” (reg 15(1)) and follow the Safety Director’s directions on scheduling and payment.

10. Verify port/channel specification for pilotage fees. Pilotage and exemption examination fees are specific to port/channel combinations outlined in the tables in regs 19 and 23. Confirm which port/channel combination applies to the candidate before calculating the fee. Refer to the Marine Safety Regulations 2012 definition of “declared port waters” if necessary (reg 4 and Endnotes: explanatory details).

11. Duplicate/replacement documents. Where a replacement or duplicate is required (regs 9, 14, 18, 22), pay the specified fee and follow the process set out in the Marine Safety Regulations 2012 (e.g. reg 49 for replacement of a marine licence document). Maintain proof of identity and circumstances (loss, theft, damage) as the principal regulations require.

12. Record searches. For a search of marine licence records and obtaining a certificate as to any matter appearing in records, pay the fixed $6.60 fee (reg 10) and comply with the procedural requirements in reg 52 of the Marine Safety Regulations 2012 (note to reg 10).

13. Budget for application and consideration fees for pilot exemptions. For pilot exemption renewals, budget for both the prescribed application fee (reg 20(1)) and the additional fee for the Safety Director’s consideration of the renewal (reg 20(2)).

14. Monitor legislative changes and fee unit updates. Because the fee schedule is set in fee units and definitions are cross‑referenced to other subordinate instruments, compliance requires periodic checks for amendments to: (a) the fee unit value published by the Treasurer, (b) the Marine Safety Regulations 2012 (for definitions and procedural steps), and (c) the Road Safety (Vehicles) Regulations 2021 (for the eligible veteran definition). Also observe the sunset date of 6 July 2031 for future planning (Endnotes: general information).

15. Internal controls and accounting. Implement accounting workflows that (a) fetch the current fee‑unit value at the time of invoicing, (b) apply the correct port/channel logic for pilotage fees, (c) enforce advance notification deadlines for concessions, and (d) apply the rounding rule consistently. Retain calculation worksheets to support audits and administrative review.

These steps are derived from the Regulations and the endnotes. They align the administrative and financial processes of regulated entities with the mechanical requirements of the fees schedule and the cross‑referenced instruments that govern entitlement and process.
