74Fit and proper person

#### 74 Fit and proper person (1) In determining whether a person is a fit and proper person for the purposes of deciding whether to issue or revoke a certificate, the National Regulator may have regard only to: (a) any conviction of the person for an offence against this Law; and (b) any conviction of the person for an offence against a law of the Commonwealth, a State or a Territory that is relevant for the purposes of deciding whether the person is suitable to hold the certificate; and (c) any other matter prescribed by the regulations. (2) This section does not affect the operation of Part VIIC of the Crimes Act 1914 of the Commonwealth (which includes provisions that, in certain circumstances, relieve persons of the requirement to disclose spent convictions and require persons aware of such convictions to disregard them).
