268 Safe Transport Victoria may remove obstructions to navigation S. 268(1) amended by No. 34/2023 s. 127(Sch. 1 item 7.144). (1) Safe Transport Victoria may remove, or authorise the removal of, any obstruction to navigation. S. 268(2) amended by No. 34/2023 s. 127(Sch. 1 item 7.144). (2) Safe Transport Victoria may take action under this section regardless of— (a) whether or not a direction for the removal of the obstruction has been given under section 267; or (b) if a direction has been made under section 267, whether or not the time specified in the direction for compliance with the direction has expired. (3) Action taken under this section may include the removal of the obstruction by its destruction if it is reasonable to do so in the circumstances. (5) Safe Transport Victoria may recover any reasonable costs incurred in taking action under this section as a debt due and payable by the owner of, or the person responsible for, the obstruction.
