209 Safe Transport Victoria to be given proposed notice creating activity exclusion zone S. 209(1) amended by No. 34/2023 s. 127(Sch. 1 item 7.90(a)). (1) Before publishing a notice under section 208(2), a port management body, local port manager or waterway manager must give a draft of the notice to Safe Transport Victoria. S. 209(2) amended by No. 34/2023 s. 127(Sch. 1 item 7.90(b)). (2) On receiving a draft of a notice under subsection (1), Safe Transport Victoria may, within the prescribed time, direct the port management body, local port manager or waterway manager not to publish the notice if Safe Transport Victoria intends to give a direction to the body or manager under section 204(2) that relates to the same part of State waters. (4) A port management body, local port manager or waterway manager that is given a direction under subsection (2) must comply with the direction.
