195 Consultation by Safe Transport Victoria on proposed rules S. 195(1) amended by No. 34/2023 s. 127(Sch. 1 item 7.78(a)). (1) This section applies if Safe Transport Victoria— S. 195(1)(a) amended by Nos 37/2014 s. 10(Sch. item 107.10), 34/2023 s. 127(Sch. 1 item 7.78(a)). (a) receives a request from a police officer to make a rule that Safe Transport Victoria considers is of a material nature; or S. 195(1)(b) amended by No. 34/2023 s. 127(Sch. 1 item 7.78 (a)(b)). (b) proposes to make a rule on its own initiative that Safe Transport Victoria considers is of a material nature. S. 195(2) amended by No. 34/2023 s. 127(Sch. 1 item 7.78(a)). (2) Before making a rule, Safe Transport Victoria must invite submissions and comments from the public in accordance with this section. S. 195(3) amended by No. 34/2023 s. 127(Sch. 1 item 7.78(c)). (3) Safe Transport Victoria must— S. 195(3)(a) substituted by No. 55/2017 s. 17. (a) publish notice of the request or proposal to make a rule— S. 195(3)(a)(i) amended by No. 34/2023 s. 127(Sch. 1 item 7.78(d)). (i) on Safe Transport Victoria's Internet site; and S. 195(3)(a)(ii) amended by No. 34/2023 s. 127(Sch. 1 item 7.78(a)). (ii) in some other way that gives notice of the request or proposal to persons who Safe Transport Victoria reasonably believes will be affected by the requested or proposed rule, if made; and S. 195(3)(b) amended by No. 34/2023 s. 127(Sch. 1 item 7.78(d)). (b) make copies of the request or proposal available to the public on Safe Transport Victoria's Internet site and at a prescribed place during business hours free of charge. (4) A notice under subsection (3)(a) must— (a) include a summary of the request or proposal; and S. 195(4)(b) amended by No. 34/2023 s. 127(Sch. 1 item 7.78(a)). (b) specify the date by when a submission or comment must be made to Safe Transport Victoria; and S. 195(4)(d) amended by No. 34/2023 s. 127(Sch. 1 item 7.78(d)). (d) specify that copies of the request or proposal are available on Safe Transport Victoria's Internet site and at the prescribed place during business hours free of charge. (5) The period of time between publication of the notice and the date specified in the notice must not be less than 4 weeks.
