166 Disciplinary actions that may be taken by Safe Transport Victoria against a person holding a permission S. 166(1) amended by No. 34/2023 s. 127(Sch. 1 item 7.49(a)). (1) Safe Transport Victoria may take one or more of the following disciplinary actions against a person who holds a permission— (a) cancel the permission and disqualify the person from applying for a permission of that kind— (i) for a period not exceeding 5 years; or S. 166(1)(a)(ii) amended by No. 34/2023 s. 127(Sch. 1 item 7.49(b)). (ii) until a condition imposed by Safe Transport Victoria is met; (b) suspend the permission— (i) for any period; or S. 166(1)(b)(ii) amended by No. 34/2023 s. 127(Sch. 1 item 7.49(b)). (ii) until a condition imposed by Safe Transport Victoria is met; (c) if the permission is already suspended, do either of the following— (i) cancel the permission and disqualify the person from applying for a permission of that kind— (A) for a period not exceeding 5 years; or S. 166(1) (c)(i)(B) amended by No. 34/2023 s. 127(Sch. 1 item 7.49(b)). (B) until a condition imposed by Safe Transport Victoria is met; or (ii) suspend the permission— (A) for an additional period; or S. 166(1) (c)(ii)(B) amended by No. 34/2023 s. 127(Sch. 1 item 7.49(b)). (B) until a condition imposed by Safe Transport Victoria is met; (d) direct the person to take particular training; (e) impose a new condition, restriction or other limitation on, or vary a condition, restriction or other limitation on, the permission; S. 166(1)(f) amended by No. 78/2011 s. 25(a). (f) reprimand the person; S. 166(1)(g) inserted by No. 78/2011 s. 25(b), amended by No. 34/2023 s. 127(Sch. 1 item 7.49(b)). (g) if the permission is a certificate or authority recognised by Safe Transport Victoria as an equivalent to a certificate issued under this Act, withdraw recognition of that certificate or authority. (2) If a person holds more than one kind of permission, Safe Transport Victoria may take action in relation to any one or more of the permissions.
