Marine Parks (Zoning) Regulations 2012

The Regulations implement four zone types and a small set of cross‑cutting implementation rules.

Zone types and rule incorporation

• General managed use zone (regulation 6). The zone is defined by the single listed rule: no littering and no wilful breaking of brittle materials except into receptacles provided, with an expiation fee of $315 for contraventions (reg 6(1)-(3)).
• Habitat protection zone (regulation 7). This zone incorporates the general managed use rule (reg 7(3)(a)) and adds prohibitions such as restrictions on anchoring large vessels, dredging and depositing dredged matter, trawl nets on or near the seabed, and removal/harm/disturbance of aquatic plants, sessile animals and certain materials. Expiation fees are set for several rules (e.g. $750 for dredging contraventions at reg 7(3)(c)-(e); $315 for removal/harm/disturbance at reg 7(3)(f)).
• Sanctuary zone (regulation 8). This zone incorporates habitat protection rules (reg 8(3)(a)) and then tightens restrictions further: no structures (wharves, jetties etc.), no aquaculture, prohibitions on certain discharges tied to the Environment Protection Act 1993 activities, dredging and deposit prohibitions, prohibition on establishing moorings except in narrow circumstances, bans on commercial tours, organised competitions, commercial/professional scientific research (subject to narrow exceptions), commercial filming, removal/harm/feeding/berleying of wildlife (with limited historical and incidental exceptions), water extraction, discharge of wastewater from vessels, motorised water sports (subject to traversing allowance), and controls on domestic animals (regulation 8(3)(b)-(p)). Some of these carry expiation fees (specifically listed in the table).
• Restricted access zone (regulation 9). This imposes strict limits on entry and activity inside the zone. It prohibits low level flights (helicopters under 500 metres, other aircraft under 300 metres) and generally prohibits entry or remaining or engaging in activity in the zone (reg 9(3)(a)-(c)), with an expiation fee of $750 for each rule.

Expiable offences and non‑expiable offences

• The Regulations draw a line between offences that are expiable (payable by way of an expiation fee set out in the tables) and those that are not expressly expiable but remain enforceable under section 17 of the Act. Each zone table states the expiation fee where applicable; absence of a fee entry means the offence is not an expiable offence under these Regulations (see reg 6(2), 7(2), 8(2), 9(2) and the tables).

Interaction with other statutory authorisations

• Regulation 4 defines how these zoning prohibitions interact with statutory authorisations under other Acts. It treats existing authorisations differently from authorisations that come into force after a prohibition has been applied, imposes limits on renewals that confer further rights, and preserves the section 19 permit route (reg 4(1)-(5)). There is an explicit carve out in relation to the Mining Act 1971 and the Petroleum and Geothermal Energy Act 2000, which are treated differently and brought into ministerial resolution processes (see the Note under regulation 4(5)).

Exemptions

• Regulation 5 creates explicit exemptions: persons acting in an emergency; Aboriginal persons acting in accordance with an ILUA or Aboriginal tradition; and persons exercising official powers or functions under any State or Commonwealth Act are not subject to the prohibitions and restrictions (reg 5(a)-(c)).

Operational details

• The Regulations require warnings to be given in a Minister‑approved manner and to contain a set list of particulars (regulation 10). This prescribes both substantive content and process for the initial enforcement step under section 17(2) of the Act.

Cross‑references and technical definitions

• The Interpretation (regulation 3) imports terms and links to other statutes, which means practical application will require reading the Regulations together with the Acts they reference (for example, Fisheries Management Act 2007; Harbors and Navigation Act 1993; Aquaculture Act 2001; Environment Protection Act 1993; National Parks and Wildlife Act 1972; Wilderness Protection Act 1992).

In short, the main concepts are: zone‑based rule templates, a mixture of expiable and non‑expiable offences, specified exceptions and cross‑Act interaction rules, and administrative details around warnings and authorised exceptions.

The Regulations allocate obligations and restrict behaviour across several groups with different expected costs and rights. The principal categories of affected persons or entities are:

• Individual members of the public who enter or use marine parks. Ordinary visitors are subject to baseline rules such as no littering in general managed use zones ($315 expiation , reg 6(3)), and a suite of stricter prohibitions if they enter sanctuary or habitat protection zones (for example, removal of plants or animals in sanctuary zones is prohibited , reg 8(3)(l) , and certain vehicle/watercraft behaviours are restricted in sanctuary zones, such as motorised water sports, subject to a $150 expiation fee , reg 8(3)(o)).
• Fishers and commercial fishing operators. The Regulations explicitly treat fishery authorities as subject to prohibitions applied to a zone (regulation 4(2)(a)(i)). Habitat protection rules allow limited removal or harm arising from lawful fishing activity carried on in accordance with the Fisheries Management Act 2007, and scientific observers performing ordinary functions are specifically recognised (reg 7(3)(f)). Operators holding fishery licences must therefore align their practices with the zone rules; where an activity is prohibited the permit pathway (s 19 of the Act) is available (reg 4(4)(a)).
• Aquaculture operators. Aquaculture is defined by reference to the Aquaculture Act 2001 (reg 3). Habitat protection zone rules exclude ordinary course aquaculture authorised and carried out in accordance with the Aquaculture Act 2001 from the removal/harm/disturbance prohibitions (reg 7(3)(f)(a)(i)). Conversely, sanctuary zones prohibit aquaculture (reg 8(3)(c)).
• Harbour and port operators and persons acting under their authority. The Regulations create specific exceptions for ports in relation to anchoring and dredging rules (reg 7(3)(b), (c), (d)), and permit port operator moorings in sanctuary zones (reg 8(3)(g)(i)). The Harbors and Navigation Act 1993 is used by reference for vessel length measurement and for statutory authorisation exceptions (reg 7(3)(b)(i)-(iii), reg 8(3)(g)(ii)).
• Operators of tourism and commercial activities. Sanctuary zones expressly prohibit conducting tours for fee or reward (reg 8(3)(h)) and commercial filming (reg 8(3)(k)), unless authorised by statutory authorisation under the National Parks and Wildlife Act 1972 or the Wilderness Protection Act 1992. Businesses that previously relied on zones for commercial activity will face regulatory restrictions unless they hold or obtain the relevant authorisation.
• Scientific researchers and commercial research entities. The Regulations prohibit scientific research for commercial or professional purposes in sanctuary zones unless conducted by an authorised scientific observer under the Fisheries Management Act 2007 or authorised by statutory authorisations under NPW Act or Wilderness Protection Act (reg 8(3)(j)). Academic or non‑commercial research may still be restricted depending on the activity and authorisations in place.
• Aviation operators. Restricted access zones impose minimum flight altitudes for helicopters (500 metres) and other aircraft (300 metres) and generally prohibit entry or activity (reg 9(3)(a)-(c)), exposing low‑flying pilots or operators engaging in aerial operations over these zones to expiation fees ($750) and enforcement.
• Indigenous persons acting under ILUAs or Aboriginal traditions. Regulation 5(b) exempts Aboriginal persons acting in accordance with an ILUA or Aboriginal tradition from the prohibitions and restrictions. That creates a distinct legal status for certain traditional uses, subject to the content of the ILUA or the nature of the Aboriginal tradition.
• Persons exercising official powers. Persons exercising official functions under State or Commonwealth law are exempted by regulation 5(c), which preserves governmental operational activities even when they would otherwise contravene zone rules.

Who pays: contraveners. The Regulations set expiation fees for many listed contraventions (examples: $315 littering; $750 dredging or low aerial flight; $150 motorised water sport; $75 domestic animal , regs 6-9 tables). Where an expiation fee applies, the person alleged to have committed the offence can discharge liability via payment of the stated amount; absence of an expiation fee means the matter remains an alleged offence under section 17 of the Act and is not resolved by the expiation scheme in these Regulations.

Who decides and authorises: the Minister has administrative control over the manner and form of warnings (regulation 10), and the Act’s permit process (section 19 of the Act) remains available to authorise otherwise prohibited activities (regulation 4(4)(a)). Decisions to grant or renew statutory authorisations in some deeply consequential sectors (notably mining and petroleum) invoke ministerial interdepartmental referral and the Governor where there is disagreement (note to regulation 4(5)).

In summary, the Regulations affect a broad range of users: recreational and commercial fishers, aquaculture operators, harbour operators, tourism and filming businesses, researchers, aviation operators, and Indigenous people exercising traditional rights. The economic and administrative burden will fall most heavily on those whose customary or commercial activities conflict with the zoning prohibitions and who lack statutory authorisations.

Duties created by the Regulations are zone‑specific and set out in tabular form for each zone. Rights are either statutory exemptions or routes to authorisation.

Key duties (by reference to regulations and tables)

• General managed use zone duties: do not deposit or leave litter, or wilfully break glass or similar materials except into provided receptacles (regulation 6(3)(a)(i)-(ii)); expiation fee $315.
• Habitat protection duties: comply with general managed use rules (reg 7(3)(a)); do not anchor vessels greater than 80 metres in length except in specified locations (reg 7(3)(b)); do not dredge or deposit dredged material (reg 7(3)(c)-(d)) subject to exceptions for Ministers, port operators or authorised agents; do not use trawl nets on or near the seabed (reg 7(3)(e)); do not remove, harm or disturb aquatic plants, algae, sessile animals, soils, rocks, fossils, archaeological remains, wood or dead vegetation (reg 7(3)(f)) except in narrowly defined situations (lawful aquaculture under Aquaculture Act 2001, lawful fishing under Fisheries Management Act 2007, scientific observer duties where unavoidable, or incidental unavoidable effects).
• Sanctuary duties: comply with habitat protection rules (reg 8(3)(a)); do not erect structures (reg 8(3)(b)); do not engage in aquaculture (reg 8(3)(c)); do not undertake certain environmental significance activities involving discharges (reg 8(3)(d)); do not dredge or deposit dredged material (reg 8(3)(e)-(f)); do not establish moorings except where a port operator or statutory authorisation under Harbors and Navigation Act applies (reg 8(3)(g)); do not carry on tourism for fee or reward in the zone (reg 8(3)(h)); do not hold organised competitions or trials without authorisation (reg 8(3)(i)); do not conduct commercial/professional scientific research without authorisation (reg 8(3)(j)); do not film or record images/sound for commercial purpose without authorisation (reg 8(3)(k)); do not remove or harm plants or animals, feed or interfere with wild animals, use berley, or engage in preparatory acts (reg 8(3)(l)), subject to specified limited exceptions (historic lawful fishing before 1 October 2014 and incidental unavoidable removals); do not remove water or extract salt or other substances (reg 8(3)(m)); do not discharge wastewater from a vessel into water or onto land in the zone (reg 8(3)(n)); do not engage in motorised water sports (reg 8(3)(o)) though traversing through the zone on a motorised vessel is allowed; and control domestic animals in specified ways or avoid bringing them into the zone (reg 8(3)(p)).
• Restricted access duties: do not fly helicopters under 500 metres or other aircraft under 300 metres above ground/sea level within the restricted access zone; and do not enter or remain or otherwise engage in activity in the zone (reg 9(3)(a)-(c)). Expiation fees are $750 for each listed breach.

Rights and permitted authorisations

• Exemptions (regulation 5): persons acting in an emergency; Aboriginal persons acting in accordance with an ILUA or Aboriginal tradition; and persons exercising official powers or functions under a State or Commonwealth Act are not bound by the prohibitions.
• Permit route (regulation 4(4)(a)): a person may seek a permit under section 19 of the Act to authorise an activity that would otherwise be prohibited. The Regulations explicitly preserve that route.
• Statutory authorisations under other Acts: where a statutory authorisation is in force when a prohibition or restriction is applied, the Regulations set out whether that authorisation’s rights are affected (reg 4(2)). For example, existing fishery authorities are subject to the prohibition or restriction when applied to a zone (reg 4(2)(a)(i)). Conversely, renewals in the same terms do not automatically confer further rights (reg 4(5)). For authorisations that commence after a prohibition is applied, the rule is that such later authorisations (other than under the Mining Act 1971 or Petroleum and Geothermal Energy Act 2000) are subject to the prohibition (reg 4(3)).
• Narrow statutory exceptions: several rules list specific statutory authorisations that will allow otherwise prohibited conduct. For example, sanctuary zone exemptions for tour operators and organisers are available where a statutory authorisation under the National Parks and Wildlife Act 1972 or Wilderness Protection Act 1992 applies (reg 8(3)(h), (i), (j), (k)).

Procedural rights

• Warning content and form: warnings given under section 17(2) of the Act must be in a manner and form approved by the Minister, and must set out the alleged offender’s particulars, particulars of the alleged offence (date, time, location, nature) and the authorised officer’s full name (regulation 10). That prescribes particular procedural content that an alleged offender will see before enforcement action escalates.

Implications of expiation schema

• Where an expiation fee is set in the tables, the alleged offender has an immediate, administratively simple route to resolve the alleged breach by payment (reg 6(2), 7(2), 8(2), 9(2)). Where no fee is set for a particular rule, the alleged offender does not have the expiation‑by‑fee route under these Regulations and the matter remains an alleged offence under section 17, likely pursued through standard criminal or regulatory enforcement mechanisms under the Act.

In short, duties vary materially by zone and activity. Rights are limited but include statutory exemptions, the Act’s permit route and tightly defined exceptions for particular actors and pre‑existing authorisations.

The Regulations establish an expiation framework for numerous contraventions and set out administrative requirements for warnings; they do not themselves create the underlying offence, but repeatedly refer to alleged contraventions of section 17 of the Marine Parks Act 2007 as the offence trigger (see regulations 6(2), 7(2), 8(2), 9(2)). Enforcement therefore proceeds under the Act, with the Regulations specifying where an expiation fee is available and the amount.

Expiation fees and their application

• The Regulations list expiation fees in the tables for many prohibited acts. Representative amounts include $315 for littering or wilfully breaking glass in a general managed use zone (reg 6(3)); $750 for dredging or depositing dredged matter in habitat protection and sanctuary zones (reg 7(3)(c), (d); reg 8(3)(e), (f)); $750 for prohibited aerial flights in restricted access zones (reg 9(3)(a)-(b)); $315 or $150 for other contraventions such as some sanctuary zone activities (reg 8(3)(h)-(o)); and $75 for domestic animal breaches in sanctuary zones (reg 8(3)(p)). Where a contravention is an “alleged offence against section 17 of the Act” and an expiation fee is set in the table, the alleged offender may discharge liability by paying the relevant expiation fee (regulations 6(2), 7(2), 8(2), 9(2)).
• Not all listed prohibitions carry expiation fees. The absence of a fee entry for a listed prohibition means the matter remains an alleged offence under section 17 but is not dealt with by the expiation scheme in the Regulations. That creates a two‑tier enforcement landscape: some contraventions can be resolved by payment; others require formal legal proceedings or other enforcement dispositions under the Act.

Warnings and authorised officers

• Regulation 10 prescribes the manner and content of warnings given under section 17(2) of the Act. Warnings must be in a manner and form approved by the Minister and contain the alleged offender’s name, address and contact details, particulars of the alleged offence (date, time, location, nature), and the name of the authorised officer giving the warning (regulation 10(a)-(b)). This gives authorised officers an administrative obligation to provide prescribed information and subject to Ministerial approval the form of warnings, which may affect procedural fairness and evidence of service.

Exemptions affecting enforcement scope

• Certain exemptions narrow the practical reach of enforcement. People acting in an emergency, Aboriginal persons acting under ILUAs or tradition, and those exercising official powers or functions under any Act are exempt from the prohibitions and restrictions (regulation 5). Temporary prohibitions or restrictions imposed under the Act have specific interaction rules with existing statutory authorisations (regulation 4(2)(b)).

Decision rights that affect enforcement outcomes

• The Minister’s approval role over warning form (regulation 10(a)) and the availability of permit authorisation under section 19 of the Act (preserved expressly by regulation 4(4)(a)) mean enforcement outcomes are mediated by administrative decisions. The note tied to regulation 4(5) flags that mining and petroleum authorisations are handled in an inter‑ministerial referral process resolved by the Governor where Ministers disagree , a separate avenue which could complicate enforcement in those sectors.

Evidence and uncertainty factors

• Some rules use imprecise phrasing that may challenge enforcement certainty: for example “on or near the seabed” (prohibition on use of a trawl net in the habitat protection zone, reg 7(3)(e)), or “involving a discharge into waters” in relation to activities of environmental significance (reg 8(3)(d) referencing Schedule 1 clauses of the Environment Protection Act 1993). Such phrases may require factual determinations in enforcement or prosecution contexts and could increase evidential burden for authorised officers or prosecutors.

Summary

• Enforcement has two principal levers: the expiation fee regime for specified contraventions and section 17 prosecutions for contraventions generally. The Regulations specify which contraventions attract expiation fees, the fee quantum, and the administrative content of warnings. Exemptions, statutory authorisations and Ministerial roles shape who is subject to enforcement and on what grounds.

The Regulations are heavily cross‑referenced to, and designed to operate alongside, several other South Australian and Commonwealth statutes. The Regulations themselves set out interaction principles and specific carve‑outs.

Primary cross‑references set out in the text

• Marine Parks Act 2007. The Regulations are subordinate to that Act and repeatedly refer to “section 17 of the Act” as the offence provision and to “section 19 of the Act” as the permit authorisation preserved by the Regulations (see regulations 4(4)(a) and 6(2), 7(2), 8(2), 9(2)).
• Fisheries Management Act 2007. The Regulations adopt defined terms and draw specific exceptions for lawful fishing activity carried out in accordance with that Act, and recognise scientific observers acting under s 87 of the Fisheries Management Act 2007 (e.g. reg 3 definition of fishing activity and fishery authority, reg 7(3)(f), reg 8(3)(j)). Regulation 4(2)(a)(i) states rights conferred by an existing fishery authority are subject to a prohibition or restriction when applied to a marine park zone.
• Aquaculture Act 2001. The term aquaculture is defined by reference to that Act and the habitat protection zone rules carve out ordinary course aquaculture authorised and carried out under that Act from the removal/harm restrictions (reg 3, reg 7(3)(f)(a)(i)). Sanctuary zones, however, expressly prohibit aquaculture (reg 8(3)(c)).
• Harbors and Navigation Act 1993 and Harbors and Navigation Regulations 2009. Vessel length for anchoring restrictions is to be determined in accordance with the Harbors and Navigation Act 1993; exceptions for anchoring include prescribed harbours or transhipment points under the Harbors and Navigation Regulations 2009 (reg 7(3)(b)(i)-(ii)). Moorings are also subject to statutory authorisation under that Act (reg 8(3)(g)).
• Environment Protection Act 1993. Sanctuary rules prohibit engaging in a “prescribed activity of environmental significance” specified in Schedule 1 clause 3(2) or 8(7) of the Environment Protection Act 1993 if the activity involves a discharge into waters in the zone (reg 8(3)(d)). This imports the EPA’s classification of environmentally significant activities into sanctuary zone prohibitions.
• National Parks and Wildlife Act 1972 and Wilderness Protection Act 1992. The Regulations permit some otherwise prohibited activity in sanctuary zones where authorised by statutory authorisation under those Acts (e.g. tours, competitions, scientific research, commercial filming , reg 8(3)(h)-(k)).
• Mining Act 1971 and Petroleum and Geothermal Energy Act 2000. Regulation 4 treats statutory authorisations under those Acts differently: the Note to regulation 4(5) requires referral to the Minister and, in the event of disagreement between Ministers about whether an authorisation should be granted or renewed or the conditions to which it should be subject, resolution by the Governor. Regulation 4(2)(a)(ii) also notes that if, after a prohibition is applied, an existing authorisation (other than under Mining Act 1971 or Petroleum and Geothermal Energy Act 2000) is varied or renewed to confer further rights, those further rights are subject to the prohibition.
• Subordinate Legislation Act 1978. Commencement timing is set by reference to that Act (regulation 2).

Principles of interaction set out in regulation 4

• Existing statutory authorisations in force when a prohibition or restriction is applied are not automatically nullified, but the Regulations specify how those rights are subject to the prohibition or restriction, with particular treatment for fishery authorities (reg 4(2)(a)(i)) and temporary prohibitions (reg 4(2)(b)). Renewals in the same terms do not, by themselves, constitute conferral of further rights (reg 4(5)). Authorisations that commence after a prohibition is applied are generally subject to the prohibition, except for authorisations under the Mining Act 1971 or the Petroleum and Geothermal Energy Act 2000 (reg 4(3) and note under reg 4(5)).

Consequential regulatory dependencies and layered authorisation

• The Regulations create layered compliance obligations that often require engagement with other statutory regimes. For instance, a tour operator wishing to operate in a sanctuary zone must consider the Management Act’s zone prohibition and whether an authorisation under the National Parks and Wildlife Act 1972 or the Wilderness Protection Act 1992 is available (reg 8(3)(h)). Similarly, port operators may rely on Harbors and Navigation statutory authorisations for activities otherwise restricted by the Regulations (reg 7(3)(b)(i), reg 8(3)(g)(ii)).

Operational effect on decision‑making

• The Regulations preserve the Act’s permit power (s 19) and create exception pathways that are dependent on other Acts. They also embed ministerial approval mechanisms for enforcement procedures (warnings) and require inter‑ministerial referral for certain resource sectors (mining and petroleum). Practitioners advising clients must therefore treat compliance as multi‑statute work, mapping proposed activity against the Marine Parks Act instrument, the Regulations’ zone tables, and any relevant external authorisation regimes.

The Regulations provide a concise legislative history section. The principal instrument details are:

• Principal Regulations: Marine Parks (Zoning) Regulations 2012, No. 243 (Government Gazette 29.11.2012 p 5278).
• Commencement note: regulation 2 states the Regulations come into operation four months after the day on which they are made; the legislative history entry records commencement as 29 March 2013 for regulation 2 (Gazette reference in the Legislative history note: “29.3.2013: r 2”).

No other amendments, later versions, or amendment dates are included in the text provided. The Regulations therefore appear, from the material supplied, to be the principal 2012 instrument with the commencement date noted. The Legislative history block at the end confirms the principal instrument and Gazette citation, but contains no further amendment entries in the supplied text.

What this means for practitioners

• When assessing whether later amending instruments exist, one must consult the consolidated statute or the South Australian legislation website referenced in the Notes (the Regulations themselves point users to the Index of South Australian Statutes or www.legislation.sa.gov.au). The absence of further entries in the printed legislative history here does not prove there have been no amendments after the principal regulations. To confirm current law, practitioners should check the consolidated, updated instrument on the official database.
• The commencement provision (regulation 2) relies on the Subordinate Legislation Act 1978 s 10AA for timing mechanics; any interpretation or amendment to that Act could affect commencement paradigms historically applied.

Record keeping and research steps

• For compliance opinions or transactional due diligence, confirm the current text via the official consolidated version online and review any subsequent amending regulations, administrative instruments (Ministerial approvals for warning forms under reg 10), and associated proclamations under the Marine Parks Act 2007 (such as zone maps or management plans), none of which are contained within the Regulations text itself.

The Regulations themselves do not include or cite any judicial decisions. The material supplied contains no references to litigation, court challenges, or tribunal decisions concerning these Regulations. As such, from the text provided:

• There is no litigation history recorded in the Regulations document.
• No cases, statutory appeals, or judicial interpretations are named within the Regulations.

Practical consequences for legal practitioners and researchers

• The absence of litigation references in the instrument does not mean there has been no judicial engagement with the Regulations or the underlying Act. It only means the text provided contains no litigation history. A practitioner preparing advice must search for case law interpreting section 17 of the Marine Parks Act 2007, the operation of expiation regimes in South Australia, any disputes arising under the interaction rules in regulation 4 (for example disputes between ministers over mining or petroleum authorisations as noted), and prosecutions or civil enforcement actions under the Act and Regulations.
• Key areas likely to produce litigation or administrative review (if disputes arise) include: (a) whether particular conduct falls within an imprecise phrase such as “on or near the seabed”, (b) the status of pre‑existing statutory authorisations when a marine park prohibition is applied to a zone, (c) the scope and application of exemptions for Aboriginal tradition or ILUAs, and (d) conflicts between the permit power (s 19 of the Act) and other statutory authorisations. Practitioners should search the South Australian court databases, administrative review records, and decisions of relevant tribunals for these topics.

Recommended research steps

• Consult consolidated legislation on the South Australian legislation website to ensure the current text is used.
• Use legal databases (AustLII, Jade, Westlaw AU, LexisNexis AU) to search for cases referring to the Marine Parks (Zoning) Regulations 2012, the Marine Parks Act 2007 section 17 prosecutions, and disputes involving interaction with Mining Act or Petroleum and Geothermal Energy Act authorisations.
• Search administrative decisions and ministerial records for the Minister’s approved forms or policies under regulation 10 and to see how warnings are implemented in practice.

Because the Regulations do not record litigation, any litigation history must be assembled from external case law and tribunal databases rather than from the Regulations themselves.

The Regulations include multiple specific traps for the unwary; these are practical points where compliance, enforcement, or legal analysis commonly encounters friction.

1. Expiation fee presence determines enforcement pathway

• Many prohibitions are paired with an expiation fee; others are not. The presence of an expiation fee (tables in regs 6-9) means a simple administrative resolution by payment. The absence of a fee means the contravention remains an alleged offence under s 17 and cannot be disposed of by the expiation scheme established here. Practitioners must check each rule’s table entry because not all rules have a listed fee (see, for example, the prohibition on erecting structures in sanctuary zones (reg 8(3)(b)), which has no fee listed).

2. Multiple overlapping statutes and cross‑authorisations

• Several rules rely on authorisations under other Acts (Fisheries Management Act 2007, Aquaculture Act 2001, Harbors and Navigation Act 1993, National Parks and Wildlife Act 1972, Wilderness Protection Act 1992, Environment Protection Act 1993). Compliance therefore requires cross‑checking those statutes for authorisations, conditions and licensing processes. Failure to do so can lead to mistaken assumptions that an activity is permitted or prohibited.

3. Different treatment of existing and later statutory authorisations

• Regulation 4 distinguishes between statutory authorisations that pre‑exist a prohibition, authorisations that come into force later, and renewals that confer further rights. Importantly, fishery authorities in existence at the time a prohibition is applied are stated to be subject to the prohibition (reg 4(2)(a)(i)). Renewals “in the same terms” do not by themselves confer further rights (reg 4(5)). Mining and petroleum authorisations are carved out for separate ministerial treatment (note under reg 4(5)). These rules can produce different legal outcomes for a client who holds a licence depending on timing and whether the licence is renewed or varied.

4. Narrow exceptions and administrative gateways

• The permit power under s 19 of the Act remains available (reg 4(4)(a)). For commercial operators (tour operators, film crews, research entities), the Regulations do not uniformly extinguish a route for authorised activity; instead, they require the appropriate statutory authorisation. Practitioners must advise clients that authorisation may be possible but will require engagement with the relevant statutory processes, potentially multiple agencies, and possibly ministerial decisions.

5. Ambiguous drafting raises evidential issues

• Terms such as “on or near the seabed” (reg 7(3)(e)), “involving a discharge into waters” (reg 8(3)(d)), “in the zone” (used extensively) and “ordinary course” in the exceptions for aquaculture or fishing (reg 7(3)(f)) will require factual assessment and careful evidential proof in enforcement contexts. This creates uncertainty for operators as to where the line is drawn and may increase compliance costs.

6. Historical carve‑outs that matter

• The sanctuary zone removal rule contains a dated historic carve‑out for “a lawful fishing activity (including berleying) carried on in the zone before 1 October 2014” (reg 8(3)(l)). That means some fishers with pre‑2014 lawful activities may retain limited rights; proving that legal continuity may require records and evidence not readily available.

7. Ministerial discretion over warnings

• Warnings must be in a manner and form approved by the Minister (reg 10). The Minister’s approved form could expand, clarify or contract the notice content in ways that materially affect the process and the rights of an alleged offender. Practitioners should request and review the actual Minister‑approved form in their jurisdictional practice area.

8. Exemptions for “official powers” and Aboriginal tradition

• The exemptions in regulation 5 may be broad in operation, particularly “person exercising official powers or functions under an Act.” There is potential for disputes about whether a particular actor is legitimately exercising such powers and about the scope of Aboriginal tradition or an ILUA. Advising clients in these contexts will require careful analysis of the ILUA terms, the scope of the official power asserted, and possibly consultation with Aboriginal custodians.

9. Port and Minister exceptions for dredging and anchoring

• The dredging and anchoring rules contain explicit exceptions for Ministers, port operators or those acting under their authority (reg 7(3)(b)-(d)). A port operator with statutory functions may proceed where ordinary operators cannot, concentrating practical rights in a narrow group.

10. Domestic animal rule interacts with local by‑laws

• Sanctuary zone provisions about bringing domestic animals into the zone allow certain council by‑law exceptions where local regulations permit animals in specific areas (reg 8(3)(p)(iii)). Compliance thus requires checking local council by‑laws as well as marine park zoning rules.

These “gotchas” translate into real transactional and compliance constraints: timing matters for existing licences, multi‑agency authorisations may be required, evidence burdens can be significant, and operators must maintain records demonstrating pre‑existing or authorised activity where that matters.

Compliance requires a practical cross‑statutory workflow that aligns activities with zone rules, authorisations, and administrative obligations. Below is an actionable compliance checklist informed by the Regulations.

1. Identify the zone(s) applicable

• Obtain official marine park maps and management plans (not contained in these Regulations) that identify whether the activity occurs in a general managed use zone, habitat protection zone, sanctuary zone, or restricted access zone. The Regulations prescribe different rules by zone type (regs 6-9). Without confirming zone boundaries, you cannot determine applicable duties or expiation fees.

2. Map the activity to the relevant rule table

• For the identified zone, map the specific activity to the table of prohibitions and expiation fees in the relevant regulation:
  • General managed use (reg 6)
  • Habitat protection (reg 7)
  • Sanctuary (reg 8)
  • Restricted access (reg 9)
• Determine whether the activity is expressly prohibited, permitted subject to exceptions, or not covered.

3. Check for statutory authorisations and permits

• Early check: determine whether any existing statutory authorisation applies (Fisheries Management Act 2007 licences, Aquaculture Act 2001 approvals, Harbors and Navigation Act 1993 authorisations, National Parks and Wildlife Act 1972 or Wilderness Protection Act 1992 authorisations, Environment Protection Act 1993 approvals, Mining Act 1971 or Petroleum and Geothermal Energy Act 2000 authorisations).
• If activity is prohibited, consider applying for a permit under section 19 of the Marine Parks Act 2007 (regulation 4(4)(a) preserves this route).
• For activities in sanctuary zones tied to NPW Act or Wilderness Protection Act authorisations (for example commercial tours or research), apply to those regimes where relevant (reg 8(3)(h)-(k)).

4. Evaluate timing and renewal risks

• For existing licences, determine whether they pre‑exist the prohibition and whether they have been or will be varied or renewed. Rights conferred by an existing authorisation are subject to the prohibition in defined ways (regulation 4(2)-(3), (5)). Renewals in the same terms do not automatically confer extra rights (reg 4(5)).

5. Implement operational controls and staff training

• Train staff to recognise zone boundaries and the specific prohibited acts in each zone.
• Implement procedures for waste handling, to avoid offences such as littering (reg 6(3)(a)); establish wastewater management systems to avoid discharging from vessels (reg 8(3)(n)); and restrict motorised water sport operations where sanctuary zone rules apply (reg 8(3)(o)).
• For commercial operators, incorporate checks into booking systems to ensure tours or competitions are not scheduled in sanctuary zones without required authorisations (reg 8(3)(h), (i)).

6. Maintain evidence of lawful historical activity where relevant

• If asserting the historic lawful fishing carve‑out in sanctuary zones (lawful fishing before 1 October 2014 , reg 8(3)(l)(a)), maintain documentary evidence demonstrating that status. Records could include licence histories, log books, or other documentation.

7. Prepare for enforcement interactions

• Ensure authorised officers have accurate contact information and that any warning processes comply with regulation 10: warnings must be given in a Minister‑approved manner and include specific particulars (regulation 10(b)). If you receive a warning, verify the form and content match the Minister‑approved form and include the required particulars (name, address, particulars of alleged offence, officer’s name).
• Have administrative processes for responding to expiation notices where appropriate and for contesting matters that should not have been subject to expiation if no fee was intended for a particular rule.

8. Seek statutory authorisations well in advance

• Apply for necessary statutory authorisations early because multiple agencies may be involved (aquaculture regulators, fisheries authorities, harbour authorities, NPW or Wilderness regulators, Environment Protection authority). Regulatory processes and inter‑agency referrals (notably for mining and petroleum authorisations) can take time.

9. Liaise with Indigenous custodians where Aboriginal tradition or ILUAs may apply

• If the activity involves Aboriginal tradition or an ILUA, coordinate with relevant Aboriginal parties to confirm whether an exemption in regulation 5(b) applies. Obtain documented agreements or confirmations where possible.

10. Legal audit and due diligence in transactions

• For transactions involving coastal businesses (tour operators, aquaculture, fishing licences, etc.), incorporate marine park zoning compliance checks into due diligence. Confirm whether the licences are affected by existing prohibitions, whether renewals or variations may trigger new restrictions, and whether permits under the Act or cross‑statute authorisations are in place.

11. Monitor Ministerial instruments and published forms

• Because regulation 10 requires warnings to be in a Minister‑approved manner, obtain the Minister’s approved warning form and any enforcement guidelines published by the administering agency. Also monitor any published Ministerial directions or management plans that may affect zoning implementation.

12. Manage aviation activities relative to restricted access zones

• Aviation operators should maintain flight planning systems to ensure compliance with minimum altitude requirements in restricted access zones: 500 metres for helicopters and 300 metres for other aircraft (reg 9(3)(a)-(b)). Where operations require lower altitudes, consider authorisation strategies.

By following these steps, an operator or adviser can map obligations to actions, avoid obvious contraventions subject to expiation, and pursue authorised pathways where necessary. The Regulations require multi‑agency compliance checks and record‑keeping to demonstrate lawful activity or authorisation.
