sec.103 Using a minor research aid
A person carrying out limited impact research (extractive) may use only the following research aids (each a minor research aid )— the fishing apparatus and methods authorised under the Fisheries Act 1994 for recreational fishers; a baited station, invertebrate trap, leaf litter trap or light trap; a plankton net that is not fixed or attached in place; a device for sampling water; a device for sampling sediment; a tag for an animal or plant; a data logger, camera and sound recording equipment, or a video recording device; hand-held monitoring equipment; a marker buoy; fixed transect tape; a fixed quadrat. A minor research aid may be fixed in position only by a concrete nail, an inverted-u-shaped metal rod, a line or rope, a stake less than 12mm in diameter, a bolt or a dive weight. A person carrying out limited impact research (extractive) may use a total of no more than 20 minor research aids for each research project being carried out. A person carrying out limited impact research (extractive) by limited research sampling in the marine park must ensure that a minor research aid used by the person for the research— does not emit sounds or frequencies that disturb cetaceans or dugongs; and is not motorised or pneumatically or hydraulically operated, unless the minor research aid is a water sampling device; and is removed from the marine park within 30 days after the research ends (the notification period ). However, subsection (4) (c) does not apply if, before the end of the notification period, the person gives the chief executive notice that the minor research aid has not been removed. If the person gives the chief executive a notice under subsection (5) , the chief executive may, by notice to the person, impose conditions on the use of the minor research aid. In this section— baited station means a device or equipment that uses bait to attract, capture or detect an animal. invertebrate trap means a device or equipment used to attract, capture or detect an invertebrate animal. leaf litter trap means a device or equipment used to catch or capture plant matter. light trap means a device or equipment that includes the use of a light to attract, capture or detect an animal or plant.
