Marine Order 96 (Marine pollution prevention — sewage) 2018

Several interlocking concepts define how the Order operates in practice.

Annex IV of MARPOL. The Order gives domestic force to Annex IV of MARPOL, which is the international standard for preventing marine pollution by sewage from ships. MARPOL Annex IV establishes effluent standards, survey obligations, certificate requirements, and discharge rules. The Order routinely cross-references specific Regulations within Annex IV (for example, Regulation 4 on surveys, Regulation 8 on certificate duration and endorsements, Regulation 9 on systems, Regulation 10 on standard discharge connections, and Regulation 13 on special areas). The MARPOL text itself is incorporated by reference rather than reproduced.

The ISPP certificate. An International Sewage Pollution Prevention Certificate is the central administrative instrument of the regime. It is a pollution certificate issued under section 132 of the Navigation Act in the form prescribed by the Appendix to Annex IV. It certifies that the vessel has been surveyed in accordance with MARPOL Annex IV Regulation 4 and that its sewage systems comply with applicable requirements. The certificate is subject to ongoing conditions (s 13), expires and comes into force in accordance with Annex IV Regulation 8, and can be varied or revoked on defined criteria (ss 15 and 16).

Special areas. Certain waters designated under Annex IV attract stricter discharge standards. Passenger ships operating in special areas must meet enhanced effluent requirements under section 4.2 of the 2012 Guidelines (IMO Resolution MEPC.227(64)) rather than the general Annex IV standard. The Antarctic Area and Arctic waters are specifically addressed in Division 6 via the Pollution Prevention Act, which separately implements Antarctic Protocol obligations.

The 2012 Guidelines. These are the Guidelines on implementation of effluent standards and performance tests for sewage treatment plants adopted by IMO Resolution MEPC.227(64). They apply to systems installed after 31 December 2015 (and, under section 4.2, to passenger ships discharging in special areas). Earlier installations are governed by earlier IMO resolutions: MEPC.159(55) for systems installed between 1 January 2010 and 31 December 2015, and MEPC.2(VI) for systems installed before 1 January 2010.

DRmax: the maximum discharge rate formula. Section 20 quantifies the permissible rate of discharge of untreated sewage via the formula DRmax = 0.00926 × B × D × V, where B is vessel breadth in metres, D is draft in metres, and V is average speed in knots. This formula, derived from IMO Resolution MEPC.157(55), ties permitted discharge volume to vessel size and speed, reflecting the dilution effect of moving through water. The cap is DRmax m3 per hour over any 24-hour period, with a 20 per cent tolerance allowing up to 1.2 × DRmax in any single hour.

Issuing body. This term is defined in the Navigation Act. Approved systems and equipment must be approved by an issuing body, and ISPP certificates may be issued by an issuing body. AMSA itself is an issuing body; recognised organisations (classification societies) may also act in that capacity.

Polar Code and Arctic waters. Section 2(d) identifies the Polar Code as an additional source of obligations for the Antarctic and Arctic. The Pollution Prevention Act's Division 1A of Part IIIB implements those Polar Code obligations. The Order feeds into that regime by prescribing the discharge approval process for Arctic waters under section 21.

The Order applies broadly, covering four categories of vessel set out in section 5(1): regulated Australian vessels, foreign vessels, recreational vessels, and domestic commercial vessels. The carve-out in section 5(2) for vessels owned or operated by a foreign government and used for government non-commercial service aligns the instrument with standard public international law immunities. Importantly, section 5(4) removes that immunity for Commonwealth-owned vessels used for government non-commercial service: Annex IV is taken to apply to them.

The certificate and equipment obligations in Divisions 2 and 3 are narrower. Section 5(3) exempts foreign vessels and recreational vessels without Australian nationality from those requirements, reflecting the fact that those vessels will carry their own flag-state certificates and equipment compliance is verified by their home administration. Foreign vessels are instead captured by Division 4, which obliges them to comply with MARPOL Annex IV requirements and, for vessels from non-party states, to carry equivalent national documentation.

The practical effect is that the most intensive compliance burden falls on:

• Operators of regulated Australian vessels subject to Annex IV (primarily vessels of 400 gross tonnage and above, or vessels certified to carry more than 15 persons, as determined by Annex IV itself).
• Passenger ship operators, who face additional requirements under section 8 (special area treatment plants) and section 22 (prescribed passenger ship rules), with different dates for new and existing ships.
• Masters and owners of any covered vessel who bear the marine incident reporting obligations (s 19) and the seven-day alteration notification duty (s 17).

Shipyards and classification societies involved in surveying or certifying Australian vessels are also materially affected, as they act as issuing bodies and must conduct surveys in accordance with Annex IV Regulation 4 and apply the tiered technical standards in section 7.

Foreign operators transiting Australian waters carry a lighter but still real burden: they must comply with Annex IV requirements applicable to their vessel (s 18(1)) and, if flagged to a non-party state, must produce equivalent documentation (s 18(2)). Australian port state control officers enforcing this provision will examine those documents on arrival.

Operators of recreational vessels with Australian nationality are also within scope for the equipment requirements, which may surprise owners of smaller vessels. The Order's application to domestic commercial vessels, which are regulated under the Marine Safety (Domestic Commercial Vessel) National Law as well as the Navigation Act, is qualified by the note to section 5, which explains that state and territory laws giving effect to the same MARPOL provisions may displace the Order's application in certain areas.

Equipment duties (ss 7, 8 and 9). Vessels to which Annex IV applies must be equipped with one of three sewage systems: a sewage treatment plant approved by an issuing body and meeting the applicable effluent standard for its installation date; a sewage comminuting and disinfecting system approved by an issuing body; or a holding tank approved by an issuing body. The three-option structure gives operators commercial flexibility. Vessels discharging in special areas face a more restricted choice under section 8: either a treatment plant meeting the higher section 4.2 standard (for passenger ships from 31 December 2015 or 31 December 2017 depending on whether the ship is new or existing) or a holding tank. The comminuting-and-disinfecting option disappears in the special area context.

All covered vessels must also have a standard discharge connection as specified in MARPOL Annex IV Regulation 10 (s 9(1)). For passenger vessels, an alternative discharge connection approved by an issuing body (such as a quick-connection coupling) may substitute.

Certification duties (ss 10 to 17). Vessels subject to Annex IV must hold a valid ISPP certificate (s 10). The certificate is obtained by application to an issuing body; AMSA's general application procedures in Marine Order 1 apply (s 11). Issue requires a satisfactory Annex IV survey and compliance with applicable Annex IV requirements (s 12). Once issued, the certificate is subject to three ongoing conditions: maintaining vessel and equipment condition to comply with Annex IV, completing surveys as required, and obtaining issuing body approval for any structural or equipment changes beyond direct replacement (s 13). Certificate duration is governed by Annex IV Regulation 8 (s 14).

Operators have rights as well as duties. Section 6 provides for merits review of decisions made under sections 7, 8, 9, and 21. Internal review is available under Marine Order 1 (Administration) 2013, and from there an affected person may apply to the Administrative Appeals Tribunal. Decisions about ISPP certificates (issue, variation, revocation) are separately reviewable under subsection 313(1) of the Navigation Act, also via the AAT.

Notification duties (ss 17 and 19). Within seven days of making any alteration to a vessel, the operator must inform both AMSA and each issuing body that issued the vessel's ISPP certificate. This is a tight timeframe that requires administrative readiness from operators undertaking refits or equipment replacements. Marine incidents affecting Annex IV compliance (equipment failures, incidents affecting compliance, or anything substantially affecting the integrity of Annex IV equipment) must be reported to AMSA; the prescribed reporting periods are set in Marine Order 1.

Discharge rate obligations (s 20). The DRmax formula in section 20 is not merely aspirational. It feeds directly into the Pollution Prevention Act's discharge offence provisions (paragraphs 26BC(4)(b), 26BCC(6)(d), and 26D(6)(c)), where exceeding the prescribed rate is an element of the offence. Operators must be able to demonstrate adherence to that formula in the context of their vessel's dimensions and operational speed.

Approval to discharge in Arctic waters (s 21). A person may apply to AMSA for an approval to discharge sewage in Arctic waters in circumstances otherwise prohibited by paragraph 26BCC(8)(d) of the Pollution Prevention Act. The application must be supported by an ISPP certificate certifying the vessel has a compliant sewage treatment plant and any other document AMSA requests. AMSA must consider vessel type, treatment plant type, whether the vessel will operate in ice concentration exceeding 1/10 for more than 30 consecutive days, and any other relevant matter. Approval may be granted subject to conditions. This pathway is narrow: it is available only where the vessel has a compliant treatment plant, not a holding tank or comminuting system alone.

The Order itself does not impose penalties, as the Pollution Prevention Act expressly bars AMSA from doing so by order (s 34(1) of that Act). Penalty liability arises under the parent statutes.

Under the Pollution Prevention Act, the operative provisions that section 20 feeds are sections 26BC, 26BCC, and 26D. These provisions prohibit the discharge of sewage from ships in the Antarctic Area and (under the Polar Code obligations) from vessels in Arctic waters, except within the rate, distance, and treatment conditions prescribed. Breaches attract criminal and civil penalties under the Pollution Prevention Act. The specific quantum of those penalties is set by the Act, not by the Order.

Under the Navigation Act, the certificate regime is backed by the Act's enforcement architecture. Operating a vessel without a required ISPP certificate, or breaching a certificate condition, engages the penalty and enforcement provisions of the Navigation Act including those relating to detention of vessels. AMSA inspectors have port state control authority to board and inspect vessels. Foreign vessels must comply with Annex IV requirements; failure to carry required documentation exposes the vessel to detention under the Navigation Act's port state control powers.

The marine incident reporting obligation in section 19 is given teeth by sections 185 and 186 of the Navigation Act, which require owners and masters to report prescribed incidents. Failure to report is itself an offence under the Act.

Revocation of an ISPP certificate (s 16) is a significant enforcement consequence: the vessel cannot lawfully operate in compliance with the Navigation Act certificate requirements after revocation, effectively grounding it until a fresh certificate is obtained. The two revocation grounds are breach of a certificate condition (which is conduct-based) and the vessel ceasing to be registered in Australia (which is status-based). The status-based ground means that a change of flag automatically triggers certificate invalidity, removing any incentive to use reflagging as a way to escape AMSA's certification regime while remaining in Australian waters.

Decisions under sections 7, 8, 9 and 21 are reviewable (s 6), but this is a right held by the regulated party, not a limitation on AMSA's ability to take enforcement action pending review.

The Order sits at the intersection of at least four legislative instruments and two statutes.

Navigation Act 2012. The Order is primarily made under this Act. Sections 130 to 137 of the Navigation Act provide the certificate framework that Division 3 of the Order operationalises. Section 339 provides the general regulation-making power; sections 340 and 342 specifically enable MARPOL implementation by order. The Act's definitions of key terms (Australian nationality, issuing body, marine incident) shape the Order's scope.

Protection of the Sea (Prevention of Pollution from Ships) Act 1983 (the Pollution Prevention Act). Division 6 of the Order exists solely to prescribe matters for this Act. Sections 26BC, 26BCC, 26D, and 26DAA of the Pollution Prevention Act contain the substantive discharge prohibitions; the Order fills in the technical parameters (DRmax formula, approval criteria, prescribed passenger ship categories) that those prohibitions require. Without the Order, those prohibition provisions would be incomplete.

Marine Order 1 (Administration) 2013. The Order repeatedly cross-references Marine Order 1 for definitions (IMO, MARPOL, Navigation Act, Pollution Prevention Act), application procedures, reporting periods, internal review processes, and the AAT review pathway. Marine Order 1 is effectively the procedural backbone supporting this instrument.

MARPOL Annex IV. This is an international treaty obligation binding on Australia. The Order gives domestic legal force to Annex IV requirements. Terms defined in MARPOL and not separately defined in the Order are imported by section 4(2), meaning a reader must consult MARPOL itself to understand the full meaning of terms like "existing passenger ship," "new passenger ship," and "special area." The Order's alignment with MARPOL is its fundamental purpose.

The Antarctic Protocol and the Polar Code. Section 2(c) and (d) identify obligations under the Protocol on Environmental Protection to the Antarctic Treaty and the IMO Polar Code as additional sources of obligation. Division 6 partially implements both instruments through the Pollution Prevention Act's Part IIIB. These obligations sit alongside, and in the Antarctic and Arctic contexts effectively supersede, the general Annex IV rules.

State, Territory, and Marine Safety (Domestic Commercial Vessel) National Law. The note to section 5 flags that where a state, territory, or the domestic commercial vessel national law gives effect to the same MARPOL provisions for vessels in an area, this Order does not apply to those vessels in that area. This reflects the constitutional architecture of Australian maritime regulation, where state and territory waters and domestic vessel regulation coexist with Commonwealth powers. Operators of domestic commercial vessels may therefore need to check which regime applies to their particular operation.

Transport Safety Investigation Act 2003. Note 2 to section 17 refers to sections 18 and 19 of that Act as carrying additional reporting requirements, meaning a single equipment failure may trigger reporting obligations under both the Navigation Act (via Marine Order 1) and the Transport Safety Investigation Act.

The source text of the Order records no amendment history beyond its own commencement on 1 April 2018 and its repeal of Marine Order 96 (Marine pollution prevention , sewage) 2013 (s 1B). The Order is registered on the Federal Register of Legislation under the Legislation Act 2003 (final note), but no subsequent amending instruments are reproduced or noted in this compilation. On the basis of the source text alone, no amendments to this instrument after its commencement can be confirmed. The predecessor instrument (Marine Order 96 of 2013) was the prior iteration of the same regime; the 2018 version updated equipment standards (particularly the tiered installation-date approach in section 7 and the incorporation of the 2012 Guidelines), incorporated Polar Code obligations for Arctic waters, and updated the passenger ship special area regime to reflect the dates fixed in Annex IV Regulation 13.

The source text names no decided cases and contains no judicial or tribunal references beyond the administrative review pathways in section 6 and the AAT review available under subsection 313(1) of the Navigation Act. No litigation history can be grounded in this instrument on the basis of the source text. The AAT review pathway under Marine Order 1 and the Navigation Act has presumably been available since the regime commenced, but no specific proceedings are identified in the text.

Several features of the Order are likely to trap the unwary operator or adviser.

The tiered equipment standard by installation date is not optional retrospective upgrading. Section 7 imposes different technical standards depending on when the sewage treatment plant was installed, not when the vessel was built or when this Order commenced. An operator who fitted a plant before 1 January 2010 is governed by the 1976 MEPC.2(VI) standards; one who fitted a plant between 2010 and 2015 is governed by the 2006 MEPC.159(55) standards. The practical risk is that a vessel that was fully compliant when built may need to apply a different standard when it replaces equipment after 31 December 2015, because any new installation after that date must comply with the 2012 Guidelines (other than section 4.2). Equipment replacement that is merely a "direct replacement" may escape the upgrading obligation under section 13(c), but anything beyond that requires issuing body approval and potentially triggers the higher standard.

The special area passenger ship rule has a hard date that already passed. New passenger ships were required to meet the section 4.2 standard from 31 December 2015 and existing passenger ships from 31 December 2017. These deadlines passed before the Order commenced (1 April 2018). The Order takes effect with those deadlines already elapsed, meaning operators of passenger ships operating in special areas were in breach from those dates even under the predecessor 2013 Order. The 2018 instrument does not grandfather non-compliant vessels.

Foreign non-party state vessels carry documentary obligations. Section 18(2) applies to vessels registered in countries that have not ratified MARPOL Annex IV but whose vessel would otherwise be covered. Those vessels must carry and comply with whatever national documentation the flag state has issued dealing with sewage pollution prevention. This is a soft obligation in that it depends on the flag state having issued something; vessels from non-party states with no equivalent documentation may face inspection difficulties in Australian ports.

The DRmax formula requires real-time knowledge of operating parameters. The maximum discharge rate is not a fixed number: it varies with breadth, draft, and average speed over the discharge period. Operators discharging underway must be able to calculate and log the applicable DRmax for the voyage in question. Draft in particular changes as cargo is loaded or fuel is consumed. Failure to maintain accurate records of the inputs could make it impossible to demonstrate compliance with the rate limits in sections 26BC, 26BCC, and 26D of the Pollution Prevention Act.

The seven-day alteration notification window is tight. Section 17 requires notification to AMSA and each issuing body within seven days of any alteration to the vessel. This runs from the day the alteration is made, not from the day the operator becomes aware that the alteration requires notification. A vessel undergoing a refit in a remote port may find the window closes before paperwork can be organised. The penalty for non-compliance sits in the Navigation Act.

Certificate revocation on change of flag is automatic. Under section 16(b), an ISPP certificate is revocable as of right when the vessel ceases to be registered in Australia. The certificate does not simply become voidable; the criterion for revocation is met at the moment registration ends. Operators planning a reflagging must have replacement certification arrangements in place before the change takes effect or accept a period of non-compliance.

AMSA's Arctic discharge approval is discretionary and conditional. Section 21(3) lists the matters AMSA must consider but does not mandate approval in any case. Even a vessel with a fully compliant treatment plant and no ice concentration issues may be refused or approved subject to conditions (s 21(4)). Operators planning Arctic voyages should build in time to obtain approval before entering relevant waters, and must read any conditions carefully before discharging.

Review rights do not apply to certificate decisions under the general pathway. Section 6 makes decisions under sections 7, 8, 9, and 21 reviewable under Marine Order 1. Decisions about ISPP certificates (issue, variation, revocation under ss 12, 15, and 16) are not in that list because they are separately reviewable under subsection 313(1) of the Navigation Act. The note to section 11 makes this explicit. The practical consequence is that the review mechanism and timeframes differ depending on which kind of decision is being challenged. Advisers should identify which pathway applies before filing a review application.

Compliance with the Order requires action across equipment, certification, reporting, and record-keeping dimensions.

Step 1: Determine whether the Order applies. Check whether the vessel falls within section 5(1) (regulated Australian vessel, foreign vessel, recreational vessel, or domestic commercial vessel). Confirm the vessel is not within the government non-commercial service exemption (s 5(2)). If the vessel is a domestic commercial vessel or operates in state or territory waters, check whether a state, territory, or national law gives effect to the same MARPOL provisions and thereby displaces this Order in the relevant area.

Step 2: Determine whether Annex IV applies to the vessel. The Order applies its equipment, certification, and discharge obligations to vessels "to which Annex IV applies." Annex IV applies to ships of 400 GT and above and ships certified to carry more than 15 persons operating in international waters (the specific thresholds are in Annex IV itself). Verify whether the vessel meets those thresholds.

Step 3: Install and maintain compliant sewage equipment. For vessels to which Annex IV applies, select from the three equipment options in section 7 (treatment plant, comminuting-and-disinfecting system, or holding tank). If the vessel is a passenger ship operating in special areas, only a section 4.2-compliant treatment plant or a holding tank satisfies section 8. When replacing or upgrading equipment, identify the applicable standard based on installation date. For any installation after 31 December 2015, ensure compliance with the 2012 Guidelines (other than section 4.2, unless in a special area). Install a standard discharge connection meeting Annex IV Regulation 10.

Step 4: Obtain an ISPP certificate. Apply to AMSA or a recognised organisation (issuing body) for an ISPP certificate. Submit to a survey in accordance with Annex IV Regulation 4. Ensure the vessel and equipment comply with all applicable Annex IV requirements before the survey. Maintain the certificate conditions in section 13: keep the vessel in compliance, complete periodic surveys on time, and seek issuing body approval before making structural or equipment changes beyond direct replacement.

Step 5: Notify AMSA and issuing bodies of alterations within seven days. When any alteration is made to the vessel (other than a direct replacement), notify AMSA and each relevant issuing body within the seven-day window in section 17. Use the approved form available from AMSA's website.

Step 6: Report marine incidents. Establish an internal procedure for identifying and reporting the three categories of marine incident in section 19: equipment failure affecting Annex IV compliance, incidents affecting compliance, and anything substantially affecting vessel integrity or equipment completeness. Report to AMSA within the periods prescribed in Marine Order 1 (Administration) 2013 and, where applicable, under the Transport Safety Investigation Act.

Step 7: Manage discharge operations. For any discharge of untreated sewage, calculate DRmax using the formula in section 20 and the vessel's actual dimensions and speed. Maintain records of B, D, and V for each discharge operation. Do not exceed DRmax on average or 1.2 × DRmax in any single hour. For operations in Antarctic or Arctic waters, confirm whether a separate approval is required under section 21 or whether the vessel is subject to the special area passenger ship rules in section 22.

Step 8: For Arctic voyages, obtain AMSA approval in advance. If the vessel intends to discharge sewage in Arctic waters in circumstances covered by section 21, apply to AMSA with the required ISPP certificate documentation before entering the relevant area. Factor in AMSA's consideration criteria (vessel type, treatment plant type, ice concentration exposure) and allow sufficient lead time for the decision and any conditions to be imposed. Comply strictly with any conditions attached to the approval.

Step 9: Foreign vessels entering Australian ports. Ensure the vessel carries its Annex IV certificate or equivalent national documentation. Confirm that the vessel's sewage systems meet Annex IV requirements applicable to it. Be prepared for port state control inspection.

Step 10: Know the review pathway. If AMSA makes an adverse decision under sections 7, 8, 9, or 21, apply first for internal review under Marine Order 1, then to the AAT. For ISPP certificate decisions, use the subsection 313(1) Navigation Act pathway directly to the AAT. Seek legal advice promptly given the time limits applicable to administrative review applications.
