Marine Order 94 (Marine pollution prevention — packaged harmful substances) 2014

The Order defines two core terms by reference to Annex III. A "harmful substance" has the same meaning as in regulation 1 of Annex III, which in turn relies on the criteria set out in the Appendix to Annex III. In essence, these are substances identified as marine pollutants under the IMDG Code or otherwise meeting specified criteria for toxicity, bioaccumulation or persistence. "Packaged form" also takes its meaning from regulation 1 of Annex III, covering cargo transport units, portable tanks, freight containers, tank vehicles and other packaging. The Order does not set out these criteria in the text; it incorporates them externally. That means operators must consult either the text of MARPOL Annex III or, more practically, the current IMDG Code.

The key external document is Annex III itself, particularly regulations 2 (packing), 3 (marking and labelling), 4 (documentation) and 5 (stowage). Regulation 4 is especially important: it requires that transport information accompany a consignment and that the ship carry a special list, manifest or stowage plan showing the location of harmful substances. The Order designates AMSA as the organisation to which this documentation must be given before departure (section 8(2) and (3)). The Order also introduces the concept of a prescribed incident notification: for the purposes of subsections 26B(3) and (5) of the Pollution Prevention Act, the notification must begin with the code letters POLREP together with the ship's name, IMO number and radio call sign, and must be sent by telephone, fax, radio or email (section 10). The prescribed form for the marine pollutants report (Schedule 1) follows the IMO standard reporting format from Resolution A.851(20) as amended. Items cover the ship's identity, date, time and position of the event, radio communications, probable discharge details (technical name, UN number, hazard class, package types, quantity), condition of the ship, weather, contact details for the owner and representative, ship dimensions, and action taken or planned.

Another concept is the washing overboard of harmful substances. Section 9 permits this only if the master has considered the physical, chemical and biological properties of the substance and reasonably considers that washing overboard is the most appropriate manner of disposal, and has authorised it. This is not a right to discharge; it is a narrow exception that must be justified on a case-by-case basis. The master bears the evidentiary burden. The term "most appropriate" implies a comparative judgment against other disposal methods (for example, retention on board and discharge at a port reception facility). The requirement to consider "physical, chemical and biological properties" suggests that a master with limited scientific training must nonetheless make a defensible technical assessment.

Marine Order 94 directly affects the owner and master of any vessel to which Annex III applies that falls within one of the classes listed in section 7(1). The primary duty bearer is the owner: section 8(1) states that if a vessel has on board harmful substances in packaged form, the owner must comply with regulations 2 to 5 of Annex III. The term "owner" is defined in the Navigation Act 2012 and includes not only the registered owner but also any person who has the use or benefit of the vessel, such as a charterer, manager or operator. This broad definition means that a time charterer or a ship management company could bear compliance obligations even if it does not own the vessel. The master is not made separately liable for Annex III compliance under the Order, but the master is responsible for the matters in sections 9 (washing overboard), 10 (manner of notification) and 12 (time for giving a report). The master's decisions are subject to the owner's overall duty, and both may be liable under the parent Acts for any non-compliance that results in a pollution incident.

The Order also affects parties who interact with the vessel before departure. The obligation in section 8(3) to give a copy of the special list, manifest or stowage plan to AMSA at the office at or nearest to the port of loading imposes a positive duty that must be fulfilled by someone acting on behalf of the owner. That may be an agent, a freight forwarder or the ship's master. Failure to provide the documentation before departure could delay clearance or attract enforcement action. The marine pollutants report in Schedule 1 requires the contact details of the ship's owner and representative (charterer, manager, operator or agent). These parties may be contacted by AMSA or by rescue coordination centres in the event of an incident. They therefore need to be available and responsive within the 24-hour window for providing a report after a request.

Foreign vessels are squarely within scope. Section 7(1)(d) brings in any foreign vessel to which Annex III applies, subject to the limitations in subsection 33(2) of the Pollution Prevention Act and section 12 of the Navigation Act. That means a foreign-flagged ship carrying packaged harmful substances while in Australian ports or waters must comply with the same Annex III requirements and the same reporting obligations. The Order also applies to Commonwealth government vessels used on government non-commercial service (section 7(2)), thereby binding naval and other public vessels. Recreational vessels with Australian nationality are included; owners of yachts or small craft that carry packaged harmful substances (such as certain paints, chemicals or batteries in dangerous goods packaging) must ensure compliance, though in practice most such vessels will not carry significant quantities of marine pollutants.

The central duty imposed by the Order is on the owner to comply with regulations 2 to 5 of Annex III (section 8(1)). This duty is absolute in the sense that it does not require fault; the owner must ensure that packing, marking, labelling, stowage and documentation are correct. The owner also has the duty to arrange for the special list, manifest or stowage plan to be given to AMSA before departure (section 8(3)). This is an administrative obligation with a clear deadline, and non-compliance could be readily proven if the document is not supplied.

The master has a conditional right to wash harmful substances overboard, but only after satisfying three cumulative conditions: consideration of the substance's properties, a reasonable belief that washing overboard is the most appropriate manner of disposal, and explicit authorisation (section 9). This is not a right in the ordinary sense because the master must first meet a high evidentiary standard. The master also has the duty to ensure that any notification of a prescribed incident under section 26B of the Pollution Prevention Act is made in the prescribed form and manner (sections 10 and 11). The notification must start with POLREP and the ship's identification, and must be sent by one of four listed channels (telephone, fax, radio or email). The prescribed form in Schedule 1 is mandatory; a report that omits relevant items may not be compliant. If AMSA or another prescribed officer requests a written report, it must be given within 24 hours of the request (section 12). That time limit is tight, especially if the ship is at sea or in a remote area.

AMSA itself has certain institutional duties under the Order. It is designated as the organisation under regulation 4 of Annex III (section 8(2)), which means it must receive and presumably process the documentation provided before departure. It does not have a duty to approve or reject the documentation; its role is to receive it. The note to section 10 provides contact details for the Rescue Coordination Centre Australia for incident notifications, but those are practical conveniences rather than legal duties on AMSA to respond. The Order does not confer any new rights on private parties. For example, a consignee whose goods are lost overboard does not gain a private right of action under this Order; enforcement is left to the public authorities.

Marine Order 94 does not itself impose penalties. Section 34(1) of the Protection of the Sea (Prevention of Pollution from Ships) Act 1983, under which the Order is made in part, expressly provides that AMSA may make orders only for matters other than the imposition of penalties. The Order therefore relies on the penalty provisions of its parent Acts for enforcement. The note to section 4 of the Order states that Chapter 8 of the Navigation Act 2012 includes enforcement powers for inspectors, including inspection, directions and detention. Under the Navigation Act, an inspector may board a vessel, require production of documents, issue directions to prevent or reduce risk of pollution, and detain the vessel if satisfied that an offence has occurred or is likely to occur. The specific penalties for non-compliance with the requirements of Annex III and the prescribed matters are found in the Navigation Act and the Pollution Prevention Act, not in the Order itself.

For example, section 339 of the Navigation Act creates offences for contravening a Marine Order. Penalties may include fines and, in serious cases, imprisonment. The Pollution Prevention Act, in Part IIIA, makes it an offence to discharge a harmful substance in packaged form except as authorised. The washing overboard provision in section 9 of the Order may operate as a defence if the master's conditions are fully satisfied. If they are not, the act of washing overboard could constitute an offence under section 26AB of the Pollution Prevention Act, which is the provision to which section 9 refers. Similarly, failure to notify an incident in the prescribed manner, or failure to provide a report within 24 hours of request, could attract penalties under section 26B of that Act.

The practical bite of enforcement is that an inspector need not prove a pollution incident to take action: simply having incorrect documentation or failing to provide the special list before departure is enough to justify a detention order. The cost of delay to a commercial vessel can be very high, so the incentive for owners and masters to comply is strong even if the formal penalty for an administrative breach is modest. The Order itself does not contain any civil penalty provisions, but the parent Acts may include provisions for infringement notices (on-the-spot fines) for less serious breaches. The absence of litigation history in the source means that court interpretations of this particular Order are not publicly known, but parents Act prosecutions for MARPOL-related offences are common in Australian federal courts and often result in substantial fines.

Marine Order 94 is part of a multi-layered regulatory framework. It is made under both the Navigation Act 2012 and the Protection of the Sea (Prevention of Pollution from Ships) Act 1983. It gives domestic effect to MARPOL Annex III, which is an international convention binding on Australia as a flag and coastal state. The Order also incorporates the IMDG Code by reference through Annex III regulation 4. That means changes to the IMDG Code (typically every two years) automatically affect compliance obligations under the Order without any amendment to the Order itself. The Order notes that the current version of the IMDG Code is available from the IMO website and that IMO resolutions adopting or amending the Code are listed on AMSA's website. Operators cannot rely solely on the Order's text; they must track external documents.

The Order interacts with other Marine Orders, particularly Marine Order 1 (Administration) 2013, which defines key terms such as IMO, MARPOL, Navigation Act and Pollution Prevention Act. The terms "vessel" and "ship" are used in different provisions depending on whether the provision is made under the Navigation Act or the Pollution Prevention Act; note 3 to section 6 explains this technical overlap. The Order also interacts with the Maritime Safety (Domestic Commercial Vessel) National Law and state and territory laws. Section 7(1) notes that the Order does not apply to certain vessels because of laws of a state or the Northern Territory or the National Law. This carve-out reflects the constitutional division of powers: some domestic vessels are regulated by state regimes rather than Commonwealth law, even where MARPOL applies.

Enforcement powers under Chapter 8 of the Navigation Act are a critical interaction point. Those powers are broad and include the ability to board, inspect, require documents, issue directions and detain vessels. A direction issued under that chapter might, for example, require the master to not discharge any packaged harmful substance overboard, or to proceed to a specified port for inspection. The Order thus works together with the enforcement machinery of the Navigation Act to create a system where the substantive obligations are set by convention and incorporated code, the administrative duties are prescribed by the Order, and the enforcement teeth are provided by the parent Act.

There is also potential interaction with other environmental legislation, such as the Environment Protection and Biodiversity Conservation Act 1999 and state pollution laws, though the Order does not mention these. Compliance with the Order does not necessarily satisfy all obligations under those Acts. For example, a discharge of a harmful substance that is also a listed threatened species or that occurs in a marine park could attract separate liability.

The source text provides limited information on amendment history. Marine Order 94 (Marine pollution prevention , packaged harmful substances) 2014 repealed and replaced the earlier 2009 version of the same Order (section 3). The Order was made on 19 February 2014 and commenced the day after it was registered on the Federal Register of Legislative Instruments. No subsequent amendments are noted in the source. However, as a legislative instrument that gives effect to an international convention and codes that are regularly updated, the Order is likely to have been amended or reissued in the years since 2014. For example, Annex III may have been amended by the IMO, and the references in the Order to the IMDG Code and to IMO Resolution A.851(20) as amended may now point to later versions.

Practitioners should verify the current version on the Australian Federal Register of Legislation (www.legislation.gov.au) and check AMSA's website for any amending Marine Orders or compilations. The Legislative Instruments Act 2003 (now part of the Legislation Act 2003) requires all legislative instruments to be registered and consolidations published. It is possible that Marine Order 94 has been rewritten in a different format as part of AMSA's ongoing Marine Order consolidation program. The source text is the original order as made in 2014 and does not reflect any later changes. The user should treat the analysis as applying to that version and cross-check against the current instrument.

The source text contains no references to litigation. No cases are cited, and there is no schedule of prosecutions or judicial decisions interpreting Marine Order 94. This is not unusual for a narrow legislative instrument that primarily incorporates international rules and prescribes administrative details. Litigation typically arises under the parent Acts (Navigation Act 2012 or the Protection of the Sea (Prevention of Pollution from Ships) Act 1983) rather than under the Order itself. For example, prosecutions for discharging harmful substances without authorisation, or for failing to maintain proper records, would be brought under those Acts, and the court would consider the Order as part of the regulatory context.

The absence of reported litigation does not mean the Order is unenforced. AMSA has a compliance and enforcement branch that actively monitors vessels for MARPOL compliance, and infringement notices or prosecutions are routine. However, they rarely result in published judgments that interpret the Order's specific provisions. The washing overboard condition in section 9, in particular, is a potential source of dispute: what constitutes "most appropriate manner of disposal" and what evidence suffices to show the master "reasonably considered" the substance's properties would be fact-intensive questions. No Australian appellate court has yet provided definitive guidance. The user should be aware that the lack of case law means the Order has mostly operated as a straightforward administrative obligation without contested interpretations.

Several provisions in the Order create traps for the unwary. First, the duty in section 8(1) is on the owner, but "owner" under the Navigation Act includes the bareboat charterer, a person who has the use or benefit of the vessel, and possibly a managing operator. A company that merely time-charters a vessel for a single voyage could be treated as an owner for that period and thus bear full compliance responsibility. Many commercial operators may not appreciate the breadth of this definition.

Second, the washing overboard provision (section 9) is often misread as a permission. It is not. It is a conditional exemption from a prohibition elsewhere in the Pollution Prevention Act. The master must not only consider the substance's physical, chemical and biological properties but also "reasonably consider" that washing overboard is the most appropriate disposal method. The word "reasonably" imports an objective test: it is not enough that the master subjectively believed it; the belief must be one that a reasonable master in the same circumstances would hold. This is a high bar. A master who washes overboard without documenting the consideration or without exploring alternative disposal methods may face prosecution even if no visible pollution occurred. The master also must have "authorised" the washing overboard, which implies a formal decision that should be recorded.

Third, the requirement to give the special list, manifest or stowage plan to AMSA "before departure" (section 8(3)) is easily overlooked, especially for vessels making short port stays. If the document is not provided in time, the vessel could be detained. The Order does not specify how far before departure; the only safe course is to submit it well before the vessel is due to sail.

Fourth, the prescribed form for a marine pollutants report (Schedule 1) is detailed and includes items such as "names of manufacturers of goods if known" and "offical registration marks and identification number of the cargo transport unit". If the ship does not have this information readily available, the 24-hour reporting requirement in section 12 could be impossible to meet. The master must anticipate this and have a system for collecting such data from shippers before the voyage.

Fifth, the Order applies to recreational vessels with Australian nationality (section 7(1)(c)). Many small boat owners may be unaware that carrying a small quantity of a packaged harmful substance (for example, a can of marine paint or a fire extinguisher that contains a harmful chemical) could bring them within the scope of this Order and the parent Acts. The incident notification obligations also apply to them, even if they are far from shore.

Sixth, the incorporation by reference to Annex III and the IMDG Code means that the substantive requirements can change without any amendment to the Order. An operator who relies solely on the Order text as at 2014 may unknowingly be non-compliant if the IMDG Code has been updated. The Order's note suggests checking AMSA's website, but many operators do not regularly monitor international changes.

Compliance with Marine Order 94 requires a systematic approach that goes beyond simply reading the Order's 12 sections. The first step is to identify whether the vessel carries any substance that qualifies as a harmful substance in packaged form. The criteria for identification are in the Appendix to Annex III, and the easiest practical reference is the IMDG Code's classification of marine pollutants. If the vessel carries such substances, the owner must ensure that they are packed, marked, labelled and stowed in accordance with regulations 2, 3 and 5 of Annex III and the IMDG Code. That means using approved packaging, affixing marine pollutant marks where required, and complying with segregation requirements.

The owner must also prepare a special list, manifest or stowage plan that shows the location of all harmful substances on board (regulation 4 of Annex III). A copy of that document must be given to AMSA at the AMSA office at or nearest to the port of loading before the vessel departs. This is a hard deadline. It is prudent to submit the document electronically with acknowledgement of receipt. The master should keep a signed copy on board.

For any situation where the master considers washing overboard of a harmful substance, a formal decision process must be followed. The master should document the physical, chemical and biological properties of the substance (which can be obtained from the material safety data sheet or the IMDG Code entry), list the alternative disposal methods considered (for example, retention for shore reception, incineration if permitted, or transfer to another vessel), and explain why washing overboard is the most appropriate. The authorisation should be recorded in the ship's log. Without this paper trail, a defence of compliance under section 9 is unlikely to succeed.

The vessel should have a pre-prepared POLREP template that matches the form in Schedule 1. All crew who might be involved in incident notification should know the AMSA contact numbers (as provided in the note to section 10) and the requirement to begin the notification with POLREP and the ship's IMO number and call sign. If an incident occurs, the master must notify as soon as possible by telephone, fax, radio or email. If a written report is subsequently requested, it must be provided within 24 hours. The master should ensure that all required fields in Schedule 1 can be completed promptly; that means having ready access to cargo documents, the ship's particulars, and contact details for the owner and representative.

Finally, the owner and master should regularly check AMSA's website for updates to the IMDG Code and for any amending Marine Orders. Subscription to AMSA's maritime notices or to IMO circulars is advisable. Non-compliance can result in detention, delay, fines and prosecution. Given the narrow margins in commercial shipping, the cost of a single detention far outweighs the cost of a proper compliance system. For recreational vessel owners, a simpler approach is to avoid carrying any substance that may be a marine pollutant, or to consult a marine surveyor to confirm whether the substance is captured.
