Marine Order 74 (Masters and deck officers — yachts) 2015

The Order rests on a set of interlocking regulatory concepts: qualification by certificate, grade‑based permission to perform duties, endorsement where vessel attributes demand extra competence, qualifying seagoing service as the primary labour‑market input, STCW‑aligned training and assessment, and AMSA’s discretion to approve equivalence and revalidate certificates.

Qualification by certificate. Section 6 makes the certification/qualification relationship explicit: a person is taken to be qualified under section 35 of the Navigation Act to perform master or deck officer duties on a yacht only if they hold the seafarer certificate required by this Order and the certificate permits the duties in Schedule 1. The Order therefore links legal authorisation to particular certificates and Schedule 1 mappings.

Grades and permitted tasks. Schedule 1 lists four certificate grades for yachts (Watchkeeper Deck <3000 GT, Chief Mate <3000 GT, Master <500 GT, Master <3000 GT) and specifies inverted permissions across grades, for example that Master grades include watchkeeper duties and Able Seafarer,Deck functions as relevant. Some grades include conditional ability to perform master duties for smaller yachts when endorsed (Schedule 1, notes).

Endorsements tied to vessel fit. Section 8 requires additional endorsements in two circumstances: for master duties on a sailing vessel, the holder must have a sailing vessel endorsement of the appropriate kind (s 8(1)); and for duties on an ECDIS‑equipped yacht, the holder must also hold a certificate of proficiency as ECDIS trained (s 8(2)). Those endorsement rules impose a conditional overlay to the grade structure, making the certificate permissive only in combination with endorsements that respond to the vessel’s equipment or mode of propulsion.

Qualifying seagoing service as a measure. Schedule 3 sets who counts in qualifying service (masters, deck officers, trainees, ratings) and converts periods of watchkeeping into “whole days” using an 8‑hour threshold, with an extra 25% credit for shorter duty periods (Schedule 3 clauses 3.1-3.3). Schedule 2 operationalises these service thresholds for each grade: e.g. Watchkeeper Deck requires 36 months documented service, or 18 months if part of an approved and monitored course, with specific subrequirements about time on larger vessels and an understudy regime (Schedule 2).

STCW alignment and administrative cross‑references. The Order repeatedly requires approved programs and courses that comply with specific STCW Code sections and tables (for example A‑II/1, A‑VI/1, A‑VI/2, A‑IV/2). It references other Marine Orders for definitions and related requirements,Marine Order 70 for seafarer certification, Marine Order 76 for certificate of medical fitness, Marine Order 52 for definitions such as sailing vessel and trainee (s 2(2), s 4(1) and notes). Those cross‑references make compliance a multi‑instrument task and tether the Order to international standards.

Revalidation as maintenance of competence. Section 11 and Schedule 4 set revalidation rules: a certificate can be revalidated only if it is not suspended, cancelled or revoked and the applicant satisfies the revalidation conditions in Schedule 4. Revalidation can be met by recent sea service, completion of an approved revalidation course, or combinations of approved short courses and assessments. Schedule 4 also requires maintenance of specified STCW competencies and up‑to‑date medical fitness and GMDSS certification.

AMSA discretion and administrative processes. The Order gives AMSA a gatekeeping and evaluative role: approving programs, considering equivalence of other certificates or service, monitoring training courses, and revalidating certificates (see s 3(3), s 7(b), Schedule 2 and Schedule 4 references to AMSA’s consideration). The Order also invokes Navigation Act enabling provisions (s 3) that empower AMSA to set application forms, conditions, renewal mechanisms and criteria by regulation.

In short, the core concepts are certificate‑based permissioning, grade mapping, conditional endorsements for vessel attributes, quantified qualifying service, STCW‑aligned training and assessment and AMSA’s administrative discretion to approve and revalidate.

This Order binds a defined set of actors within the Australian regulated maritime sector.

Primary affected persons. The statutory application clause (s 5) identifies the covered population: (a) any person performing or intending to perform duties or functions as a master or deck officer on a regulated Australian vessel that is a yacht; and (b) holders of seafarer certificates listed in Schedule 1. That captures both incumbent seafarers and candidates seeking certification or endorsement for yacht operations.

Employers and yacht operators. Owners and operators of regulated Australian yachts that are used commercially for sport or pleasure will be affected because the Order prescribes the minimum certificates and endorsements their crew must hold if they are to lawfully occupy the master or deck officer roles. Employers must ensure crew have the correct grade certificates, medical fitness and endorsements (s 9, s 8, Schedules 1-4). For any yacht equipped with ECDIS, employers must ensure crew performing relevant duties have the ECDIS training endorsement (s 8(2), Schedule 4.6).

Training organisations and assessors. The Order requires approved programs of study and monitored courses for certain pathways (Schedule 2 and Schedule 4). A defined term, monitored, means monitoring by the seafarer training organisation providing the course (s 4). Training organisations therefore must obtain AMSA approval for curricula that comply with the STCW Code sections specified in Schedule 2 and Schedule 4, provide the monitoring function where required, and deliver final assessments required by the Order. The Order’s reliance on approved programs creates a regulatory market for these providers.

AMSA and administrators. Australian Maritime Safety Authority is the decision maker for approvals, equivalence assessments, issuing and revalidating certificates and applying the Navigation Act powers cited in s 3. The Order repeatedly invokes AMSA’s consideration and approval in relation to equivalence (s 7(b), Schedule 2 and Schedule 4). AMSA also controls the processes for application, forms and documentary evidence under the Navigation Act powers cited at s 3(1)(e) and s 3(1)(f).

Trainees and cadets. The Order includes trainees in the list of persons who can accrue qualifying seagoing service (Schedule 3 clause 3.1). For Watchkeeper Deck eligibility, trainees who are part of approved and monitored courses benefit from a reduced qualifying seagoing service requirement (36 months standard reduced to 18 months if part of an approved/monitored course), but must satisfy specific watchkeeping hour distributions and an approved understudy program with minimum hours (Schedule 2 watchkeeper provisions including sub‑subparagraphs on 100 hours lookout, 100 hours daylight, 100 hours darkness, 180 hours supervised watchkeeping).

Third parties affected by endorsements. Entities that certify equipment competence, such as ECDIS training course providers who can issue a certificate of proficiency as ECDIS trained, are affected because their certificates are preconditions for duties on ECDIS‑equipped yachts (s 8(2), Schedule 4.6).

Indirectly affected parties. Insurers, charterers, flag state authorities and classification societies may be second order affected parties because crew qualifications affect regulatory compliance, vessel insurability and charter conditions. While the Order does not address insurance or charter directly, the certificate and endorsement requirements influence commercial viability and risk allocation for yacht operations.

Geographic and vessel scope. The Order applies only to “regulated Australian vessel that is a yacht” as defined in s 4: less than 3000 GT, commercial use for sport or pleasure, no cargo and not more than 12 passengers. The definition explicitly includes training vessels used for sport or pleasure and, where trainees are charged fees, counts them as commercial use (s 4(2)). The operating area references in Schedule 1 (for example “in any operating area”) indicate that the Order’s grade permissions are not limited to local waters but are expressed by operating area classifications applied elsewhere in AMSA/MO frameworks.

Who pays and who gains. The immediate cash and time costs fall upon prospective certificate holders and their employers: training fees, time at sea to record qualifying service, medical examinations for certificate of medical fitness (Schedule 2, Schedule 4), and costs for specialist modules such as GMDSS, survival craft, advanced firefighting, medical care on board ship and ECDIS proficiency (Schedules 2 and 4). The benefits of compliance , legal authorisation to perform duties, market access, and meeting STCW obligations , accrue to certificate holders and employers who can lawfully operate regulated yachts.

The Order imposes duties on credential applicants, certificate holders and training providers and confers legal rights to perform duties if specified conditions are met. Those duties and rights are expressed primarily as preconditions to issue, permission mapping and endorsement obligations.

Duties of applicants and certificate holders

• Meet eligibility criteria. Section 9 requires applicants to be sufficiently proficient in English to understand directions and documents relating to the duties permitted by the certificate, and to satisfy the eligibility requirements listed in Schedule 2. Schedule 2 contains discrete obligations per grade, such as minimum age, documented seagoing service, completion of approved STCW programs and possession of particular certificates (for example GMDSS, survival craft, advanced fire fighting, medical certificates). These are preconditions to AMSA issuing a certificate (s 9, Schedule 2).
• Maintain medical and radio certifications. Schedule 2 and Schedule 4 require a current certificate of medical fitness and GMDSS General Radio Operators Certificate as conditions for issuance and revalidation (Schedule 2(e) items, Schedule 4.2). Maintaining the GMDSS certificate and medical fitness is an ongoing duty for revalidation.
• Hold endorsements where required. Section 8 requires sailing vessel endorsement for a person who holds a master/deck officer yachts certificate and performs master duties on a sailing vessel (s 8(1)). Section 8(2) requires an ECDIS proficiency endorsement where duties are performed on ECDIS‑equipped yachts. These are conditional duties in addition to holding the base grade certificate.
• Keep documentary evidence of sea service and complete final assessments. Schedule 2 prescribes documentary qualifying seagoing service thresholds and the need to pass a final assessment for each grade. Under the Watchkeeper grade, specific worksheet evidence for understudy programs is required (Schedule 2 subparagraphs on the 100/100/100/180 hours).
• Satisfy revalidation requirements. Section 11 and Schedule 4 impose duties to either maintain specified recent sea service, complete revalidation courses, maintain competencies in specified STCW standards, or pass approved short courses and final assessments in order to obtain revalidation.

Rights conferred by compliance

• Right to perform mapped duties. A person who holds the required seafarer certificate and endorsements has the statutory right, for the purposes of s 35 of the Navigation Act, to be treated as qualified to perform the duties or functions specified for that grade in Schedule 1 (s 6). In practice that is the legal permission to act as master or deck officer within the certificate’s scope.
• Entitlement to revalidation. If a holder satisfies the Schedule 4 test and their certificate is not suspended, cancelled or revoked, AMSA may revalidate the certificate (s 11). Revalidation preserves the right to perform the duties mapped to the certificate.
• Equivalence recognition. The Order gives AMSA the right to recognise other certificates or experience as equivalent to those listed, thereby granting rights to perform duties to holders of “another certificate AMSA considers at least equivalent” (Schedule 2 and s 7(b)). That is a discretionary right exercised by AMSA.

Administrative duties on AMSA and training providers

• Approval and monitoring. The Order places duties on AMSA to approve programs and courses that purport to meet STCW standards and on seafarer training organisations to monitor courses they provide where “monitored” is required (s 4 definition of monitored, Schedule 2, Schedule 4). AMSA must assess and determine equivalence of other certificates and service histories when applicants invoke equivalence clauses in Schedule 2.
• Documentation and forms. Section 3 cites Navigation Act powers that permit AMSA to prescribe application forms, information requirements and documents to accompany applications (s 3(1)(e),(f)). That creates an administrative duty on AMSA to specify and publish application requirements.

Limits and conditions

• Certificate scope can be conditional. Schedule 1 shows that some certificates permit duties only under endorsements or only on vessels of certain size and operating area. For example, the Watchkeeper and Chief Mate grades include a conditional ability to be endorsed to perform master duties on yachts <200 GT and <24 m long (Schedule 1, note).
• Certificates may be subject to suspension, cancellation or revocation. Section 11 makes revalidation contingent on the certificate not being suspended, cancelled or revoked. Those actions are governed by the Navigation Act and other Marine Orders that the Order cross‑references but does not itself elaborate.

In practical effect, the Order creates a compliance chain: applicants must acquire a combination of documented sea service, approved STCW‑compliant training modules and short courses, specialist proficiency certificates, medical fitness and final assessments; once issued and if not administratively impaired, that combination yields the legal right to perform specified duties on yachts, subject to endorsements driven by vessel attributes.

The Order itself does not set out criminal penalties or fine schedules. It operates within the regulatory powers and enforcement architecture of the Navigation Act 2012 and AMSA’s Marine Order regime. Section 3 identifies the enabling provisions in the Navigation Act that permit AMSA to make Marine Orders dealing with seafarer certificates, qualifications, issue and revalidation criteria and application processes (see s 3(1)(a)-(h), s 3(2) and s 3(3)). Enforcement of compliance with the certification requirements and any sanctions for non‑compliance therefore arises from the Navigation Act and related Marine Orders rather than from specific offence clauses within Marine Order 74.

Key enforcement mechanics implicit in the Order

• Certificatory gatekeeping. AMSA controls issue and revalidation of seafarer certificates for yachts (s 11). That gatekeeping is the principal regulatory mechanism for ensuring compliance: without the required certificate and endorsements, a person is not taken to be qualified under s 35 of the Navigation Act (s 6). The practical enforcement consequence is administrative denial of legal qualification to perform duties.
• Suspension, cancellation and revocation. Section 11 makes revalidation conditional on the relevant certificate not being suspended, cancelled or revoked. Those administrative sanctions are available under the Navigation Act and other Marine Orders; the Order therefore links its revalidation regime to existing AMSA sanctioning powers without specifying them (s 11).
• Evidence and documentary checks. The Order requires documented qualifying seagoing service (Schedule 2), specified certificates (Schedule 2 and Schedule 4), and final assessments. AMSA’s obligations and powers to prescribe application forms and documents (s 3(1)(e)) enable documentary verification and audit as an enforcement pathway.
• Endorsement compliance. Section 8 requires additional endorsements for sailing vessel master duties and ECDIS‑equipped yachts. The absence of required endorsements is an operational non‑compliance that AMSA can detect at inspection, audit or certificate application time and which will prevent lawful qualification under s 6.
• Revalidation checks. Schedule 4 specifies the conditions for revalidation, including recent sea service or approved course completion, maintenance of STCW competence in security awareness and specific firefighting and survival craft proficiencies for certain grades. Revalidation provides a recurring enforcement touchpoint.

What is not in the Order

• No express penalty schedule: the Order does not list fines or criminal penalties. Those provisions are to be found in the Navigation Act and other Marine Orders referenced by s 3. Users must consult the Navigation Act and Marine Order 70 and related instruments for the precise sanctioning regime.
• No surveillance or inspection protocols: the Order does not itself set inspection procedures or powers to board and inspect vessels; those are functions of the Navigation Act and other regulatory instruments referenced in s 3.

Enforcement risk and administrative discretion

• Discretionary determinations by AMSA create enforcement variability. Several eligibility and equivalence points depend on AMSA’s view , for example, whether other certificates are “at least equivalent” or whether combined courses and duties are “at least equivalent” for revalidation (Schedule 2, Schedule 4). That discretion is an enforcement lever but also a source of uncertainty for applicants and employers.
• Documentation quality and verification are focal points for enforcement. The Order’s reliance on documented qualifying seagoing service, monitored courses and final assessments means that enforcement depends heavily on the integrity and verifiability of submitted evidence.

In sum, Marine Order 74 relies principally on administrative certification, endorsement checks and revalidation controls enforced through AMSA’s powers under the Navigation Act. To determine the specific penalties for carrying out duties without necessary certification, or for failing to comply with safety obligations, one must consult the Navigation Act and other Marine Orders cross‑referenced in s 3 and in the Order’s notes.

The Order is explicitly designed to sit within a network of statutory instruments and international standards. It imports, cross‑refers to and prescribes compliance with other instruments and conventions.

Interaction with the Navigation Act 2012. Section 3 lists the Navigation Act provisions that empower AMSA to make this Order, notably the Act’s sections on regulations about seafarer certificates, classes of certificates, criteria for issue and renewal, and ancillary matters including application forms and information (s 3(1)(a)-(h)). Section 6 links the Order back to section 35 of the Navigation Act by providing that holding the required certificate is the qualification for performing duties for a regulated Australian vessel that is a yacht. The Order therefore operates as an instrument that gives statutory effect under the Navigation Act to STCW‑based competency requirements for yacht masters and deck officers.

Interaction with other Marine Orders. The Order must be read with Marine Order 70 (Seafarer certification) 2014 (s 2(2)). Several definitions and operational rules are drawn from other Marine Orders:

• Marine Order 70: definitions of terms and the broader seafarer certification regime are to be read together with this Order (s 4(3) and s 2(2)). The Order references Marine Order 70 for the status of certificates of recognition and for the general rules for calculation of qualifying seagoing service (see Schedule 3 note regarding Marine Order 70 Subdivision 3.1).
• Marine Order 76 (Health , medical fitness) 2017: the term certificate of medical fitness is defined by reference to Marine Order 76 (s 4(1) and the definition cross‑reference). The Order therefore defers to the medical fitness standards and certification process set out in Marine Order 76.
• Marine Order 52 (Yachts and training vessels) 2022: the terms sailing vessel and trainee are adopted from Marine Order 52 (s 4(1)). The Order also uses definitions from Marine Order 1 (Administration) 2013 for length, IMO, Navigation Act and STCW Code notes (s 4 notes).
• Marine Order 71 (Masters and deck officers) 2023: section 7(b) permits the use of seafarer certificates of grades mentioned in Schedule 1 of Marine Order 71 if those certificates permit the holder to perform the duties or functions. That creates a cross‑acceptance mechanism between Marine Orders covering different vessel classes.

Interaction with STCW Convention and STCW Code. The Order expressly adopts STCW standards as the competency framework (s 2(1)). Schedule 2 and Schedule 4 repeatedly require that approved programs and courses comply with specified STCW Code sections and tables (for example A‑II/1, A‑VI/1, A‑VI/2, A‑IV/2, A‑VI/3, A‑VI/4). The Order treats the STCW Code as the substantive technical standard for training, firefighting, survival craft, radio operations and medical care, delegating the content of these competency requirements to the international convention and code rather than restating technical content in the marine order.

Regulatory layering and administrative complexity. The cross‑references mean applicants and advisers must navigate a layered compliance architecture: Navigation Act statutory powers, multiple Marine Orders (70, 71, 76, 52, 1), and the STCW Code and tables. The Order’s notes explicitly instruct that STCW materials are available from the IMO and that Australian legislation implements STCW through the Navigation Act and associated Marine Orders (s 2 note). The net effect is that compliance outcomes are determined by combined operation of domestic and international instruments.

Implications for equivalence and recognition. The Order allows AMSA to accept “another certificate AMSA considers at least equivalent” to specified grades (Schedule 2 and Schedule 4). That equivalence mechanism intersects with international recognition frameworks under STCW and national administrative law, but the Order leaves the specifics of equivalence criteria to AMSA’s assessment. Similarly, the Order permits certificates of recognition (per Marine Order 70) to function as seafarer certificates under the Navigation Act (note to s 7), creating interaction between domestic recognition and AMSA’s certification decisions.

Procedural interactions. Section 3 cites the Navigation Act powers about application forms, criteria and renewal processes, so procedural aspects of issuing and renewing certificates are governed by the Navigation Act and by Marine Order 70’s administration of seafarer certification. Applicants must therefore comply with documentary and procedural requirements set out by AMSA under those instruments.

In short, Marine Order 74 is not a standalone code. It is an integrating instrument that implements STCW competency standards for yachts within Australia’s Navigation Act framework, and it operates materially through cross‑references to Marine Orders 70, 71, 76, 52 and the STCW Code.

The compilation includes amendments up to Marine Orders Amendment (Marine Order 71 , consequential changes) Order 2023. The Order was originally made in 2015 and has been amended several times. The compilation table in the instrument records the following key dates and amending instruments:

• Marine Order 74 (Masters and deck officers , yachts) 2015 (MO 2015/6) , registered 1 December 2015, FRLI F2015L01895, commencement 1 January 2016.
• Marine Order 75 (Seafarer certification amendment) 2016 (MO 2016/5) , registered 9 June 2016, FRLI F2016L01017, commencement 10 June 2016, recorded as amending provision 2.
• Marine Orders Amendment (Marine Order 76 , consequential changes) Order 2017 (MO 2017/9) , registered 18 December 2017, FRLI F2017L01635, commencement 1 January 2018, recorded as amending provision 4.
• Marine Orders Amendment (Marine Order 52 , consequential changes) Order 2022 (MO 2022/6) , registered 19 December 2022, FRLI F2022L01684, commencement 1 January 2023, recorded as amending provision 4 and producing consequential changes related to definitions such as sailing vessel and trainee.
• Marine Orders Amendment (Marine Order 71 , consequential changes) Order 2023 (MO 2023/6) , registered 21 November 2023, FRLI F2023L01534, commencement 1 July 2024, recorded as amending provision 7.

The compilation’s amendment table also shows that provision 1A was repealed by the Legislation Act 2003, s 48D, and entries in the amendments table indicate which numbered provisions were amended by which Marine Orders (see the table rows that list affected provisions 2, 4 and 7 and the amending MO numbers). The specific legislative amendments reflected in the Schedule language include updates to definitions and cross‑references, the introduction or modification of endorsement requirements tied to ECDIS and sailing vessels, and alignment with changes to other Marine Orders such as Marine Order 52 and Marine Order 71. The compilation date is 1 July 2024 and the compilation was prepared on 6 August 2024 including the amendments up to MO 2023/6.

Practical import of the amendment history

• The sequence of consequential amendment instruments signals iterative updates to align the Order with changes in other Marine Orders and with evolving STCW implementation practice. Notably, the MO 2022/6 amendment (consequential changes from Marine Order 52) updated definitions used in the Order, and MO 2023/6 introduced consequential changes aligning Schedule 1 references to Marine Order 71.
• Commencement dates vary by amendment. Practitioners must rely on the compiled version and the FRLI entries for commencement timing and transitional application, because the table records both registration and commencement dates for each amendment instrument.
• Because the Order is intertwined with other Marine Orders, many amendments are consequential to changes elsewhere; the amendment history therefore reflects not only substantive changes to Marine Order 74 but also the statutory housekeeping necessary to maintain cross‑instrument coherence.

For detailed chronological changes to particular clauses, consult the FRLI entries cited in the compilation table and the versions of the amending Marine Orders listed by FRLI number and commencement date.

The text of Marine Order 74 as compiled does not cite any court decisions, nor does it record litigation concerning the interpretation or application of the Order. The compilation contains only the legislative text, schedule content and an amendment table. There are no cases named in the instrument itself.

Implications for practitioners

• Absence of cases in the instrument means there is no judicial gloss provided within the Order compilation. Lawyers and compliance officers must therefore look to external case law involving the Navigation Act, AMSA decisions, or STCW implementation jurisprudence for precedent on disputes such as AMSA’s equivalence determinations, challenges to suspension/cancellation of certificates, or enforcement actions under the Navigation Act.
• Potential dispute areas. The Order contains several provisions likely to generate administrative or judicial review issues should disagreements arise: AMSA’s discretion to consider equivalence of other certificates and service (Schedule 2 and Schedule 4), the sufficiency and verification of documented qualifying seagoing service (Schedule 2 and Schedule 3), interpretation of endorsement requirements (s 8), and the application of revalidation criteria (s 11, Schedule 4). Any litigation arising from these points will be governed by the Navigation Act’s administrative law framework and the judicial review principles applicable to executive decision making.
• Administrative challenge routes. Where AMSA declines recognition of equivalence, denies issue or revalidation, or takes disciplinary action (suspension/cancellation/etc), affected persons would typically pursue administrative review processes available under the Navigation Act and, if necessary, judicial review in the Federal Court or the appropriate superior court. The Order itself does not set internal appeal mechanisms; those processes are located in the Navigation Act and AMSA procedural rules.

In short, the Order compilation offers no litigation history. Practitioners should treat AMSA’s discretionary equivalence and approval functions as likely loci for future disputes and should consult Navigation Act provisions and case law concerning certification and administrative review when advising clients.

The Order contains several detailed provisions and cross‑references that create practical traps for certificate applicants, employers and training providers. Practitioners and compliance officers should review the following specific points carefully.

Vessel definition and commercial use nuance. The definition of yacht is technical: less than 3000 GT, for commercial use for sport or pleasure, does not carry cargo, and does not carry more than 12 passengers (s 4). A training vessel is treated as used for sport or pleasure and, if trainees are charged fees, counts as commercial use (s 4(2)). Consequence: a vessel that might be commonly understood as private could fall within the Order’s commercial scope if trainees pay fees, triggering certification obligations.

Length measurements and endorsement thresholds. Schedule 1 note for paragraph (c) clarifies that the endorsement to permit master duties for a grade is linked to yachts that are less than 24 m in load line length, and the note directs to the definition of length in Marine Order 1 (Administration) 2013. Because the Order uses load line length for the endorsement threshold but refers to other length definitions elsewhere, practitioners must ensure they use the correct length metric when assessing eligibility or endorsements.

Service calculation quirks. Qualifying seagoing service is calculated using an “8 hour in 24 hour period equals a whole day” rule with a 25% uplift for periods of less than 8 hours (Schedule 3 clauses 3.2-3.3). That method will affect how documented service days are computed and can materially change whether an applicant meets time thresholds. For example, frequent short watch periods will be credited as actual hours plus 25% rather than full days unless they reach the 8‑hour threshold.

Understudy programme specifics. For Watchkeeper Deck eligibility, the order requires detailed understudy service when the service is performed as an understudy of an officer in charge: the seagoing service must include 100 hours performing lookout duties, 100 hours in daylight, 100 hours in darkness and 180 hours performing watchkeeping duties under supervision (Schedule 2, watchkeeper paragraph). Those hour allocations are precise and cumulative and may be overlooked by employers or training providers who do not track them to that granularity.

Monitored course condition. The reduced service pathway for Watchkeeper Deck (18 months versus 36 months) applies only when service is “part of an approved and monitored course” (Schedule 2). The term monitored is defined as monitoring by the seafarer training organisation providing the course (s 4). Employers and candidates must ensure the course is both AMSA approved and monitored, and that monitoring records are kept.

Endorsement dependence on vessel equipment. ECDIS endorsement is required where duties are to be performed on an ECDIS‑equipped yacht (s 8(2), Schedule 4.6). That means a certificate that otherwise permits duties is not sufficient if the vessel’s equipment demands the ECDIS proficiency. Operators who fit ECDIS must ensure crew have that endorsement or avoid assigning duties that require it.

Requirement overlap and duplication risk. Many grades require combinations of STCW modules, GMDSS, survival craft proficiency, firefighting and medical care certifications (Schedule 2). Some of these modules appear in both issuance and revalidation schedules (Schedules 2 and 4). Without careful mapping, applicants may duplicate training or miss a continuing‑competence requirement.

Equivalence is discretionary and vague. Several eligibility and revalidation clauses permit AMSA to accept “another certificate AMSA considers at least equivalent” or combinations of duties and courses AMSA considers “at least equivalent” (Schedule 2 and Schedule 4). Because the Order does not specify equivalence criteria, applicants face uncertainty about what other national or foreign certificates AMSA will accept and must expect case‑by‑case assessments.

Revalidation timing traps. Schedule 4 offers multiple revalidation pathways with different timeframes: 12 months in the prior 5 years; 3 months in the prior 6 months; or approved revalidation courses within 5 years. Applicants who fall short of a particular pathway must identify an alternative and may need to schedule approved courses or short modules in a timely manner.

Medical fitness and GMDSS as gating issues. Both issuance and revalidation require a certificate of medical fitness and GMDSS certification in many cases (Schedules 2 and 4). A lapsed medical or GMDSS certificate can invalidate an application even if other requirements are met.

Inter‑instrument dependencies. The Order instructs that some definitions and requirements are taken from other Marine Orders and the STCW Code (s 2(2), s 4(3) notes). Practitioners must not treat Marine Order 74 in isolation. For example, certificate of medical fitness is defined by reference to Marine Order 76, and “sailing vessel” and “trainee” derive from Marine Order 52. Failure to check those instruments can lead to mistaken conclusions about eligibility.

Administrative evidence and recordkeeping. The Order’s reliance on documented qualifying seagoing service, monitored course records and final assessments means that poor recordkeeping is a practical compliance risk. Employers should ensure sea service logs, watchkeeping rosters, monitored course records and final assessment certificates are retained and auditable.

In short, the gotchas are often practical and documental: measurement of vessel length, precise hour‑based service requirements, endorsement dependencies linked to vessel equipment, narrow revalidation windows, and discretionary equivalence assessments by AMSA. Each of those issues has direct operational consequences for certificate applicants and employers.

This section sets out a practical compliance roadmap for applicants, employers and training providers, grounded in the Order’s text. It assumes the reader will consult Marine Order 70 for procedural application requirements and the Navigation Act for enforcement implications.

1. Confirm vessel classification and applicability

• Determine whether the vessel is a “regulated Australian vessel that is a yacht” under s 4: confirm GT is less than 3000, verify the vessel is used commercially for sport or pleasure, that it does not carry cargo and it carries no more than 12 passengers. If the vessel is a training vessel, confirm whether trainees are charged fees because that affects commercial use treatment (s 4(2)).

2. Choose the correct certificate grade

• Map the duties or functions the person will perform to Schedule 1. Identify whether the person needs Watchkeeper Deck <3000 GT, Chief Mate <3000 GT, Master <500 GT or Master <3000 GT and whether additional endorsements are likely (Schedule 1). If the duties include master functions on a sailing vessel, plan to obtain the sailing vessel endorsement (s 8(1)). If the vessel is ECDIS‑equipped, plan for the ECDIS proficiency certificate (s 8(2), Schedule 4.6).

3. Satisfy eligibility criteria in Schedule 2

• Verify age requirements (for Watchkeeper minimum 18 years).
• Compile documented qualifying seagoing service according to Schedule 3. Use the Schedule 3 calculation rules: whole day if duties for at least 8 hours in 24 hours; otherwise, count actual hours plus 25% (Schedule 3 clauses 3.2-3.3). For Watchkeeper Deck track the additional subrequirements: at least 36 months documented service or 18 months if part of an approved and monitored course, with at least 8 months on vessels ≥20 m and the 100/100/100/180 hour understudy breakdown where applicable (Schedule 2).
• Enrol in and complete approved STCW‑compliant programs of study specified in Schedule 2: A‑II/1, A‑II/4 and specific modules listed for Master grades such as command navigation, shipmasters business and management, vessel operations and administration, advanced firefighting and medical care on board ship (Schedule 2(c), (d), (e)).
• Obtain required proficiency certificates at application time: survival craft and rescue boats other than fast rescue boats, GMDSS radio operator certificate, ECDIS proficiency where applicable, advanced firefighting and medical care certifications as needed (Schedule 2(e) items). Obtain a certificate of medical fitness as defined by Marine Order 76 (s 4(1) and Schedule 2).

4. Ensure monitoring and final assessments

• If relying on the reduced qualifying seagoing service pathway (18 months), ensure the course is AMSA approved and monitored by the training organisation providing it. Monitor and record required understudy and watchkeeping hours precisely (Schedule 2 watchkeeper requirements).
• Complete and pass the final assessment for the grade. For endorsements such as Master <200 GT, ensure the specific final assessment for the endorsement is passed (Schedule 2 watchkeeper and chief mate notes).

5. Prepare application documentation for AMSA

• Consult Marine Order 70 and AMSA guidance for the specific forms and document checklist (s 3(1)(e)). Include documented sea service logs prepared per Schedule 3, certificates of proficiency, course completion and monitoring records, medical fitness certificate and GMDSS certificate. If relying on equivalence, provide the foreign or other certificate and evidence supporting equivalence for AMSA’s assessment (Schedule 2, Schedule 4 equivalence clauses).

6. Plan for revalidation

• Track revalidation windows and choose the preferred revalidation pathway in Schedule 4: documented qualifying sea service (12 months in last 5 years or 3 months in last 6 months), or completion of an approved revalidation course within 5 years, or approved short courses plus a final assessment. Maintain required STCW competencies (security awareness and specified firefighting/survival craft competencies for certain grades) and ensure medical fitness and GMDSS certificates remain current (Schedule 4.1-4.6).
• For ECDIS duties, maintain the ECDIS proficiency certificate as required for revalidation (Schedule 4.6).

7. Employers’ compliance steps

• Ensure rosters and logbooks capture qualifying seagoing service with the granularity required by Schedule 3 and Schedule 2 (understudy hours, lookout, daylight/darkness hours, supervised watchkeeping hours).
• Ensure training providers used are AMSA‑approved for the STCW modules required and that any monitored course is actually monitored by the provider (s 4 definition of monitored).
• Before assigning duties, verify the person holds the necessary grade certificate and any required endorsements (s 6, s 8). Where equipment such as ECDIS is present, do not permit duties without the ECDIS proficiency endorsement (s 8(2)).

8. Training providers’ compliance tasks

• Seek AMSA approval for programs of study intended to meet STCW Code sections identified in the Order, and be prepared to monitor courses where a monitored pathway is required.
• Maintain rigorous records of attendance, supervised hours, assessments and final assessments to support applicants’ AMSA submissions.

9. Manage equivalence expectations

• If relying on “another certificate AMSA considers at least equivalent”, compile comparative evidence showing parity with STCW modules and experience. Expect AMSA to exercise discretion in equivalence assessments and allow time for AMSA decisions.

10. Keep abreast of related instruments

• Regularly check Marine Orders 70, 71, 76, 52 and Marine Order 1 definitions and any new Marine Orders or amendments because the Order is explicitly to be read with those orders (s 2(2), s 4 notes). Changes elsewhere may affect definitions, endorsement requirements and administrative procedures.

Recordkeeping checklist (minimum items)

• Detailed logbook entries for qualifying seagoing service calculated under Schedule 3.
• Certificates of completion for STCW modules and approved programs.
• Monitored course records and final assessment certificates.
• Certificate of medical fitness as defined in Marine Order 76.
• GMDSS General Radio Operators Certificate or GMDSS radio operator certificate as required for issuance and revalidation.
• ECDIS proficiency certificate where applicable.
• Documentary proof of vessel GT, length measurements per Marine Order 1 definitions and passenger/cargo status.

By following these steps and cross‑checking with Marine Order 70 application rules and the Navigation Act’s procedural requirements cited in s 3, applicants and employers can align their documentation and training plans with Marine Order 74’s issuance and revalidation criteria.
