Marine Order 72 (Engineer officers) 2014

The Order organises engineer officer regulation around a few core concepts: grades of certificate, permitted duties for each grade, eligibility requirements, qualifying seagoing service, revalidation, propulsion power, and the relationship to STCW standards.

• Grades of certificate and permitted duties. Schedule 1 lists discrete grades (Electro-technical officer; Engineer Watchkeeper; Engineer Class 2; Engineer Class 1) and the duties or functions each grade permits. The permitted duties map to STCW Code Tables (for example, electro-technical officer duties reference STCW Code Table A‑III/6; engineer watchkeeper duties reference Table A‑III/1). Endorsements are possible: for example, Engineer Watchkeeper certificates may be endorsed to permit second engineer duties on vessels <3000 kW or chief engineer duties in near-coastal waters if further criteria are met (Schedule 1; Schedule 2, Engineer Watchkeeper endorsement requirements).

• Propulsion power and kind. Propulsion power for vessels is defined as total maximum continuous rated output in kilowatts appearing on the vessel’s certificate of registry (s 4). Section 8 requires every seafarer certificate to state the kind of propulsion power to which it applies, except electro-technical officer grades.

• Eligibility and qualifications. Schedule 2 sets out detailed eligibility requirements by grade. These combine age thresholds (generally minimum 18 years), formal qualifications (trade certificates, degrees, or recognised foreign certificates), specified training programmes (engineer cadet, trainee engineer, engineering experience programmes), prescribed short courses (firefighting, medical first aid, basic safety training, security awareness) and documented qualifying seagoing service in specified capacities and on vessels above stated power or generation thresholds (notably ≥750 kW for much of the engine-service calculations).

• Qualifying seagoing service: calculation and limits. Schedule 3 prescribes what counts as qualifying seagoing service (clauses 3.1-3.6). Service must be performed as an engineer, trainee, or equivalent or electro-technical officer on vessels with specified capacities. Service calculation rules treat 8 or more hours in a 24‑hour period as a whole day; service of shorter duration is credited as actual time plus 25% of that time (clause 3.2). Clause 3.4 imposes maxima for creditable service on offshore units that are not self-propelled, certain dredges and on auxiliary machinery separate from main propulsion, with specific caps depending on certificate grade.

• Revalidation. Schedule 4 offers alternative revalidation paths: documented qualifying sea service (12 months in 5 years, or 3 months in the 6 months before application); attendance at an approved revalidation course within 5 years; combinations of duties and approved courses that AMSA deems equivalent; or approved short courses plus final assessment (clause 4.1). Revalidation also requires a certificate of medical fitness and maintenance of particular STCW proficiencies (Schedule 4 clauses 4.2-4.3).

• Administrative discretion and equivalence. The Order repeatedly uses discretionary language for AMSA to "consider" foreign certificates equivalent, to accept combinations of service as equivalent to stated thresholds, and to revalidate where it is "satisfied" that requirements are met (see Schedule 2 notes and s 11; Schedule 2 and 4 provisions use "AMSA considers...equivalent" and similar formulations).

• Relationship to other instruments. The Order is to be read with Marine Order 70 (s 2(2)), refers to Marine Order 76 for medical fitness definitions (s 4(1)), and references the national law and Marine Order 505 for NC certificates (s 4 definitions). It explicitly implements STCW Code competencies by cross-reference in many eligibility items (Schedules 1 and 2).

These concepts form an administrative framework: international competency standards are transposed into domestic certificate grades, documentary requirements, seagoing-service calculations and revalidation procedures that AMSA administers.

The Order explicitly applies to two categories of persons (s 5): (a) a person performing or intending to perform duties or functions as an engineer officer on a regulated Australian vessel; and (b) a person who holds a seafarer certificate as an engineer officer. That is the primary coverage: active officers, trainee engineers, cadets, and existing certificate-holders seeking issuance, endorsement or revalidation.

Secondary affected parties, identified by the Order’s mechanics and cross-references, include:

• Employers, owners and masters of regulated Australian vessels. The Order constrains who may be engaged to carry out engine-room duties on regulated vessels because s 7 mandates that a person must hold the appropriate grade of certificate in Schedule 1 to perform the permitted duties. Owners and masters therefore must verify certificates, endorsements and propulsion-kind applicability (s 8 requires certificates to indicate propulsion kind where relevant).

• Training organisations and assessors. The Order requires completion of approved training courses and final assessments (Schedule 2, multiple entries). Training providers must deliver courses that comply with the STCW Code sections cited (for example, A‑III/1, A‑III/2, A‑III/3, A‑VI/1, A‑VI/2, A‑VI/3, A‑VI/4 and A‑VI/6) and maintain documentation such as Training Record Books.

• Seafarer training administrators and certifying authorities (AMSA and the National Regulator). AMSA is the issuing and revalidating authority (ss 9, 11) and is given discretion to determine equivalence of certain foreign or older certificates (Schedule 2). The National Regulator issues particular NC certificates referenced in definitions (s 4).

• Competent foreign certificate holders. The Order recognises foreign certificates issued under the STCW Convention but reserves to AMSA the power to consider them equivalent to specified domestic categories (s 4 definition of foreign certificate and Schedule 2 notes). Holders of foreign certificates who wish to work on Australian regulated vessels fall within scope if AMSA accepts equivalence.

• Medical services and certifying practitioners. Revalidation and issue require a certificate of medical fitness as defined by Marine Order 76; medical examiners and systems for obtaining and certifying fitness are therefore implicated (s 4 and Schedule 4 clause 4.2).

• Crews on specialised vessels and offshore facilities. The Order’s crediting rules and caps for seagoing service on non-self-propelled offshore industry mobile units, certain dredges and floating production facilities (Schedule 3 clause 3.4) mean that personnel training on these platforms will be affected by limits on how much service counts toward eligibility for particular grades.

Who pays and who decides: AMSA administers issuance, equivalence determinations and revalidation decisions (s 11 and numerous Schedule provisions giving AMSA discretion). Costs fall on candidates (training, assessment, record-keeping, medicals), employers (ensuring compliance, possibly paying for training and course attendance), and training providers (course design to STCW standards). Regulatory decision-makers are AMSA and, for certain national-law NC certificates, the National Regulator (s 4 definitions and notes).

Key duties and rights under the Order flow from certificate grade, endorsements, eligibility criteria and employer verification obligations embedded in the Navigation Act interplay.

Duties and permitted functions by grade. Schedule 1 is the operative mapping of certificate grade to permitted duties. For example:

• Electro-technical officer may perform electro-technical duties on any vessel powered by main propulsion machinery of any propulsion power in any operating area, and may perform able seafarer , engine rating duties (Schedule 1).

• Engineer Watchkeeper grades permit engineer watchkeeper duties on seagoing vessels powered by the relevant propulsion kind, and, if endorsed, second engineer duties on vessels <3000 kW and chief engineer duties on vessels <3000 kW in near‑coastal waters, plus electrical and control duties and engine rating duties (Schedule 1).

• Engineer Class 2 and Class 1 certificates progressively permit second engineer and chief engineer duties up to any propulsion power (Class 1) and include electrical, electronic and control duties and engine rating duties (Schedule 1).

These mapped duties set the scope of lawful activity: s 6 says a person is qualified for the purposes of s 35 of the Navigation Act if they hold the seafarer certificate required by this Order and the certificate permits the duties listed in Schedule 1. Section 7 binds employers and crew allocation: to perform duties listed in Schedule 1 a person must hold the correct grade per s 7.

Rights implicit in the Order:

• Right to hold a certificate if eligibility requirements are met. The Order sets objective criteria (age, training, seagoing service, medical fitness, final assessment) that, when satisfied, give rise to entitlement to issuance or revalidation by AMSA in accordance with s 9 and s 11 and Schedule 2 and 4.

• Right to equivalence and endorsement subject to AMSA discretion. The Order provides for acceptance of foreign certificates and combinations of service as equivalent (“AMSA considers...equivalent” language in Schedule 2), and for endorsements (engineer watchkeeper endorsements to second engineer or chief engineer roles) where specific additional service and courses are completed (Schedule 2).

• Right to revalidation through alternative pathways. Schedule 4 offers several revalidation paths , recent seagoing service, approved courses within five years, or a combination AMSA considers equivalent , and requires maintenance of STCW proficiencies.

Administrative duties on AMSA and applicants. AMSA must be satisfied that eligibility and revalidation criteria are met (s 9, s 11). Applicants have the duty to produce documentary evidence: Training Record Books, certificates of medical fitness, certificates of proficiency in survival craft and rescue boats, short-course certificates, final assessments and course completion evidence (Schedules 2 and 4). Employers have the duty to ensure persons onboard hold appropriate certificates per s 7 and should verify propulsion-power applicability (s 8).

Operational duties for candidates and crews include:

• Completing required STCW-based short courses (basic safety, advanced fire fighting, medical first aid, survival craft proficiency, and security awareness) as specified in Schedule 2 and Schedule 4.

• Recording qualifying seagoing service according to the calculation rules in Schedule 3 (for example, whole-day credit for 8+ hours, actual time plus 25% for less than 8 hours).

• Maintaining medical fitness certificates per Marine Order 76 (s 4 cross-reference and Schedule 4 clause 4.2).

Rights and constraints are statutory and administrative, exercisable through application to AMSA. The Order provides procedural structure but leaves substantive equivalence determinations and revalidation satisfaction to AMSA’s assessment.

Marine Order 72 itself does not create new criminal penalties; rather it operates within the Navigation Act enforcement framework. Section 3 notes that the Navigation Act contains offences relevant to seafarer certificates including falsely representing that a person holds a certificate (s 34 of the Navigation Act), performing duties or functions without the appropriate seafarer certificate (s 35), and breaching a condition of a seafarer certificate (s 37). The Order links into that framework by prescribing which certificates are required for particular duties (s 7) and what counts as qualification (s 6), thereby creating the factual basis for enforcement under those Navigation Act provisions.

Administrative enforcement and control. AMSA is the issuing and revalidating authority for seafarer certificates and has power to suspend, cancel or refuse revalidation under the Navigation Act and Marine Orders framework (the Order itself refers to AMSA revalidation power in s 11 and requires that the certificate not be suspended, cancelled or revoked for revalidation to proceed). Although specific suspension or revocation procedures are not detailed in this Order, the Navigation Act and Marine Order 70 provide the broader administrative enforcement regime referenced by s 2(2) and s 3(1)(a)-(i). The Order requires applicants to meet eligibility and revalidation criteria; failure to do so can lead to refusal to issue or revalidate a certificate.

Criminal exposure for individuals and legal persons. Because s 6 links possession of the appropriate certificate to the qualification to perform duties for the purposes of s 35 of the Navigation Act, a person who performs engineer officer duties without the required certificate risks prosecution under s 35. The note in s 3 draws attention to other offences under the Navigation Act such as false representation of holding a certificate (s 34) and breach of certificate conditions (s 37). Penalties and enforcement mechanisms (fines, potential court proceedings) are set out in the Navigation Act; this Order supplies the statutory standards against which such offences are judged.

Record-keeping and evidentiary consequences. The Order's multiple documentary requirements , Training Record Books, certificates of proficiency, medical fitness certificates, course completions and final assessments (Schedules 2 and 4) , function as evidence thresholds. Absent those records, AMSA may decline issuance or revalidation, and an individual undertaking duties may be exposed to enforcement action. Employers who allow uncertified persons to perform duties may be liable under the Navigation Act enforcement provisions.

Discretion and review risk. The Order repeatedly leaves determinations to AMSA’s satisfaction and ability to consider equivalence. That administrative discretion may lead to contested decisions (see Litigation history below for absence of cases in the text), and any enforcement action based on AMSA’s refusal or later suspension of certificates could give rise to administrative law review or statutory appeals under the Navigation Act. The Order itself does not specify appeal pathways, but the Navigation Act and general administrative law principles apply to AMSA's decision-making. The Order’s cross-references to other Marine Orders also mean enforcement may be multi-layered across instruments.

Marine Order 72 is not standalone: it is expressly made under the Navigation Act 2012 (s 3) and designed to be read with other Marine Orders and the STCW Convention. The Order’s operation relies on and cross-references a network of instruments and legal authorities.

• Navigation Act 2012. Section 3 lists the Navigation Act provisions giving power to make this Order, notably s 28 (regulations may provide for seafarer certificates and give effect to STCW), s 29 (different classes of seafarer certificates, proficiencies and standards, evidence of attainment, recognition of foreign certificates, conditions), s 314 (procedural matters for issuing certificates) and s 342(1) (power to make Marine Orders). The Navigation Act also contains offences relevant to seafarer certification (see s 3 note referencing ss 34, 35, 37). The Order therefore operationalises Navigation Act policy choices by setting concrete criteria and administrative procedures for engineer officers.

• Marine Order 70 (Seafarer certification) 2014. The Order is to be read with Marine Order 70 (s 2(2)). Section 8 of Marine Order 70 is referenced for the meaning of “kind” for propulsion (s 8 note). Marine Order 70 supplies broader rules for seafarer certification, including general rules for calculation of qualifying seagoing service referred to in s 10 note. Thus, interpretation and administration of Marine Order 72 will necessarily refer to Marine Order 70 for procedural and definitional matters.

• Marine Order 76 (Health , medical fitness) 2017. The definition of certificate of medical fitness in s 4 of the Order depends on Marine Order 76. Revalidation and issue require a certificate of medical fitness (Schedule 2 and Schedule 4), so medical standards and procedures in Marine Order 76 dictate the content and acceptability of medical evidence.

• Marine Order 505 (Certificates of competency , national law) 2022 and the national law. The Order’s definitions treat certain national-law NC certificates (e.g. Engineer Class 3 NC, Marine Engine Driver Grade 1 NC) as being issued by the National Regulator under the national law (s 4). The compilation notes amendments arising from Marine Order 505 consequential changes (Notes and amendment tables). This is significant for transitional issues and for the recognition of NC certificates issued under the national law.

• STCW Convention and STCW Code. The Order repeatedly implements STCW competencies and standards by direct cross-reference to STCW Code Tables (for example, the competencies for chief engineer in Table A‑III/2 or electro-technical officer in A‑III/6) and STCW sections A‑III/1, A‑III/2, A‑III/3 and A‑VI technical requirements, including basic safety training and specialised courses (Schedules 1, 2 and 4). The Order therefore converts international obligations into administrative eligibility criteria and course content requirements.

• AMSA Act and administrative law. The Order notes that AMSA may delegate powers under the Order (s 4 note 4 refers to the AMSA website for delegation of AMSA powers). General administrative law principles and the AMSA Act’s delegation framework will govern how AMSA delegates, and the legal accountability of delegates making equivalence or revalidation decisions.

• State and Territory law legacy certificates. The Order contains transitional recognition for certificates issued under former State systems (s 13). It acknowledges that certain State-issued certificates before 1 July 2013 (when the national law commenced) continue to be recognised and in some cases treated as qualifying (Schedule 2 notes). This creates interaction with historical State administrative decisions and the national law.

• Criminal and civil liability regimes. While the Order itself is not the locus of criminal penalties, it specifies the standards that feed into Navigation Act offences (s 3 note). Employment and workplace safety regimes (Work Health and Safety Acts) are not mentioned in the Order but in practice will interact with certification standards, since unqualified engine-room activity can trigger employer liability under other legal regimes.

In short, Marine Order 72 is a detailed implementation instrument that anchors international STCW obligations and the Navigation Act’s certification framework into domestic testing, training and revalidation rules, while delegating operational discretion to AMSA and deferring medical and national-law certificate content to related Marine Orders and the national law.

The compilation at the end of the Order records the amendment history up to 1 January 2023. The Order was originally made as Marine Order 72 (Engineer officers) 2014 (MO 2014/4) with commencement 1 April 2014. Subsequent instruments amended and updated the Order. The compilation lists four instruments and summarises how parts of the Order were affected.

Key amendment instruments and dates:

• Marine Order 72 (Engineer officers) 2014 (MO 2014/4), registered 24 February 2014, commenced 1 April 2014.

• Marine Orders Amendment (Marine Order 76 , consequential changes) Order 2017 (MO 2017/9), registered 18 December 2017, commenced 1 January 2018. Schedule and definitional changes to s 4 were effected (see amendment table: s 4 am. MO2017/9).

• Marine Order 72 (Engineer officers) Amendment Order 2018 (MO 2018/5), registered 20 March 2018, commenced 1 April 2018. Multiple provisions were amended or replaced (the amendment table shows s 2 amended MO2018/5; s 4 amended MO2018/5; s 8, s 10, s 11, s 12 amended or rs MO2018/5; Schedules 1, 3, 4 amended; Schedule 2 replaced rs MO2018/5).

• Marine Orders Amendment (Marine Order 505 , consequential changes) Order 2022 (MO 2022/2), registered 30 March 2022, commenced 1 January 2023. This instrument made consequential changes linked to Marine Order 505 and changes to national-law certificates; s 4 was amended by MO2022/2 and the compilation date is 1 January 2023 reflecting these changes.

The amendment table in the compilation itemises how individual provisions were affected (for example, Schedule 1 am. MO2018/5; Schedule 2 rs. MO2018/5; Schedule 3 am. MO2018/5; Schedule 4 am. MO2018/5). The compilation also notes a repeal of section 1A as a technical amendment related to the Legislation Act 2003 (see amendment table: 1A rep. Legislation Act 2003, s 48D).

Practically, the amendments reflect two themes: alignment and consequential updating. The 2017 and 2018 amendments updated the Order to reflect changes in related marine orders (notably Marine Order 76 on medical fitness) and to refine eligibility and revalidation provisions. The 2022 amendment implemented consequential changes arising from Marine Order 505 which deals with certificates of competency under the national law; those changes affect definitions and recognition of NC certificates mentioned in the Order. The compilation’s notes explicitly link those instruments as the legal history up to the stated compilation date.

For legal research, the amendment history in the compilation is the authoritative record of what changed and when. Any historical compliance or transitional question must look to the version of the Order in force at the relevant date, noting that s 12 and s 13 provide for expiry and transitional treatment of previously issued State certificates and other legacy arrangements.

The compilation of Marine Order 72 provided contains no litigation history and does not reference any court or tribunal decisions. It names no cases and includes no summaries of legal challenges, judicial interpretations or appeals relating to the Order. The only enforcement references are to statutory offences in the Navigation Act (s 3 note referencing ss 34, 35, 37), but the compilation does not report prosecutions, decisions or precedent.

Absence of litigation in the source document is not dispositive of whether litigation exists in the broader legal record. However, the Order itself provides numerous points at which disputes might arise in practice: AMSA discretionary assessments of equivalence for foreign or combined service; AMSA decisions on revalidation satisfaction; interpretation of qualifying seagoing service calculation rules (for example, aggregation of shorter shifts using the 25% rule in Schedule 3 clause 3.2); and the creditability caps for non-self-propelled offshore units and dredges (Schedule 3 clause 3.4). These are the factual and legal questions that, in other contexts, generate administrative law challenges or appeals when an applicant contends AMSA’s assessment is incorrect or unreasonable.

For practitioners advising clients, the immediate implications of the compilation’s silence on litigation are:

• There is no case law provided in this primary source to guide interpretation of ambiguous provisions; interpretation must therefore rely on the text, related Marine Orders (notably Marine Order 70), STCW Code authorities, and broader administrative law principles.

• Any contested AMSA decision would engage the administrative law regime: merits review and judicial review pathways are governed by the Navigation Act, applicable administrative review regimes and the general law. Those procedures and remedies are not described in the Order and must be researched separately.

• In the absence of reported authorities in the compilation, factual precision in applications is critical: applicants should document qualifying seagoing service in Training Record Books, maintain specified STCW proficiencies, hold medical fitness certificates under Marine Order 76, and obtain final assessments to reduce the likelihood of discretionary rejections that might lead to review proceedings.

If legal teams anticipate disputes over equivalence or service crediting, they should plan for administrative review strategies and anticipate AMSA’s evidentiary expectations as set out in Schedules 2-4. But the compilation provides no litigation examples, outcomes, or precedent to cite.

Several practical pitfalls and traps for practitioners and operators emerge directly from the Order’s detailed requirements and its allocation of discretion.

• Propulsion-kind specificity. Section 8 requires seafarer certificates (other than electro-technical officer grades) to include the kind of propulsion power to which the certificate applies. A certificate without the correct propulsion-kind endorsement may not legally permit a holder to serve on a vessel using the other kind of propulsion. For vessels switching propulsion type or for candidates whose service was on a different propulsion kind, operators must confirm that the certificate’s propulsion-kind matches the vessel. The definition of propulsion power relies on the figure appearing on the vessel’s certificate of registry (s 4), so discrepancies between records and vessel documentation can be consequential.

• Thresholds for electrical generation and propulsion. Many eligibility and service-credit requirements hinge on numerical thresholds: qualifying service is often required on vessels with total installed electrical generation capacity or propulsion power ≥750 kW (Schedules 2 and 3), and some duties require service on vessels ≥3000 kW for certain endorsements (Schedule 2, Engineer Class 1 requirements). Practitioners must verify the vessel’s electrical generation capacity and propulsion power as recorded on registry documents, because shortfalls or misclassification of a vessel’s power could make substantial portions of service non-creditable.

• Calculation quirks for qualifying seagoing service. Schedule 3 clause 3.2 rules the calculation of credited time: 8 or more hours with machinery in use or immediately available and the person on duty or on call counts as a whole day; less than 8 hours is the actual time plus 25%. It also caps credited service at a maximum of a whole day under clause 3.3. These arithmetic rules can materially change whether thresholds (weeks or months specified in Schedule 2) are satisfied. Accurate log entries and consistent use of Training Record Books are essential; imprecise record-keeping can lead to denial of issuance or revalidation.

• Limits on service credit on special platforms. Clause 3.4 sets maximum creditable service for eligibility when service is on offshore industry mobile units that are not self-propelled, dredges not capable of self propulsion while dredging, or auxiliary machinery run independently of main propulsion. The caps vary by certificate grade (20 weeks for Engineer Watchkeeper; 6 months for Engineer Class 2; 12 months for Engineer Class 1). Practitioners and candidates who spend substantial training time on such platforms risk discovering that only part of their service counts.

• Workshop skills equivalence categories. Schedule 2 distinguishes between "workshop skills equivalent" qualifications (specified Certificates III, IV, trade certificates) and "qualifications that are not workshop skills equivalent" (degrees, Chartered Engineer, approved engineering qualifications). The content and duration of required training courses vary depending on which category a candidate falls into. Misclassifying a candidate’s qualification can lead to placement in the wrong training pathway or subject them to unnecessary workshop training.

• Training Record Book and documented service. Many eligibility paths require qualifying seagoing service to be documented in an approved Training Record Book (multiple entries in Schedule 2). Gaps or informal documentation will weaken an applicant’s case. The Order requires particular patterns of service (for example, minimum weeks on vessels using the propulsion kind to which the certificate relates), so incomplete or non-approved record books create exposure.

• AMSA discretion on equivalence. The Order allows AMSA to consider foreign certificates or combinations of service as "at least equivalent" (Schedule 2 uses AMSA considers to be at least equivalent language). This creates uncertainty: applicants with foreign certificates or mixed service histories cannot predict outcomes with certainty and must rely on AMSA’s adjudication. Practitioners should plan to present comprehensive documentation to reduce the risk of an adverse equivalence ruling.

• Revalidation timing windows. Schedule 4 gives several alternative revalidation options but ties them to specific time intervals (12 months in 5 years, 3 months in 6 months, approved courses completed within five years). Candidates who let certificates lapse without meeting these windows face revalidation hurdles. Employers should track crew revalidation timelines to avoid staffing disruptions.

• Medical fitness linkage. Revalidation and issue require a certificate of medical fitness as defined by Marine Order 76 (s 4 and Schedule 4 clause 4.2). Illness or failure to obtain timely medical fitness certification can block revalidation.

• Endorsements have layered requirements. For example, endorsement as Second Engineer (<3000 kW) and Chief Engineer NC (<3000 kW) have separate, layered service and study requirements (Schedule 2 for Engineer Watchkeeper endorsements). Candidates and employers must track sequential service requirements (e.g., 12 months as Second Engineer endorsement before Chief Engineer NC endorsement eligibility requires an additional 24 months, some of which must be after holding the Second Engineer endorsement) and ensure compliance with STCW programme standards referred to.

• Transitional and legacy certificates. Section 12 allows AMSA to determine expiry dates for certificates of competency that were in force on 31 March 2018; s 13 treats certain pre-1 July 2013 State-issued certificates as taken to be seafarer certificates. Practitioners should check the relevant certificate history and AMSA determinations to avoid relying on expired or grandfathered credentials that may have specific expiry conditions.

These are practical, text-based traps that regularly affect certification outcomes. They are not hypothetical warnings; each is directly grounded in the respective provisions of Schedules 1-4 and the main text (see ss 6-11 and Schedules).

Compliance under Marine Order 72 requires meeting the textually specified eligibility, training, service documentation and revalidation requirements and ensuring employer verification of appropriate certificates. Below is an operational checklist and procedural guidance, mapped to specific provisions of the Order and Schedules.

1. Identify the appropriate grade and permitted duties. Consult Schedule 1 to determine the grade required for the duties to be performed. Employers should match vessel operations and duties to a listed grade (e.g., Engineer Watchkeeper, Engineer Class 2, Engineer Class 1, Electro-technical officer). Remember endorsements exist (Schedule 1) and that s 7 makes holding the correct grade a legal precondition to perform the listed duties.

2. Verify propulsion-kind applicability. For certificates (other than electro-technical officer) confirm the certificate specifies the propulsion kind (s 8). Cross-check the vessel’s certificate of registry to confirm propulsion power and kind align with the certificate’s scope (s 4 definition of propulsion power).

3. Age and base qualification checks. Ensure candidate is at least 18 years old where required (Schedule 2). Check baseline qualifications: trade certificates or degrees, Chartered Engineer status, or approved engineering qualifications as stipulated in s 4 and Schedule 2. Distinguish between “workshop skills equivalent” and other qualifications as definitions in s 4 show different training course content and duration obligations.

4. Training course requirements. Enrol candidates in approved training courses that comply with the STCW Code sections specified (Schedule 2 references A‑III/1, A‑III/2, A‑III/3 and Schedule 2 and Schedule 4 reference A‑VI safety course sections). Required short courses include advanced fire fighting (A‑VI/3), medical first aid (A‑VI/4 ¶1-3), basic safety training (A‑VI/1), survival craft and rescue boats proficiency (A‑VI/2 ¶1-4), and security awareness training (A‑VI/6 ¶4). Ensure course providers are recognised and course records are retained.

5. Document qualifying seagoing service accurately. Use an approved Training Record Book where required (Schedule 2). Apply Schedule 3 calculation rules: credit a whole day for 8+ hours on duty or on call while machinery is available; for less than 8 hours, credit actual time plus 25% (Schedule 3 clauses 3.2-3.3). Ensure required proportions of service are performed on vessels using the propulsion kind relevant to the intended certificate (Schedule 2 contains multiple minimums like 16 or 9 months on propulsion of the relevant kind depending on grade). Be aware of credit limits for service on non-self-propelled offshore units, dredges and auxiliary machinery (Schedule 3 clause 3.4).

6. Maintain required proficiencies and medical fitness. Holders and revalidation applicants must maintain STCW proficiencies in survival craft, advanced fire fighting and security awareness (Schedule 4 clause 4.3). Keep current a certificate of medical fitness as defined in Marine Order 76 (Schedule 2 and Schedule 4 require it).

7. Final assessments and record retention. Schedule 2 requires passing final assessments for initial issue and Schedule 4 may require a final assessment for some revalidation paths. Retain assessments, course completion certificates, and Training Record Book entries as evidence to present to AMSA.

8. Revalidation planning. To revalidate a certificate, choose among Schedule 4 alternatives: documented qualifying seagoing service of 12 months in 5 years or 3 months in the last 6 months (Schedule 4 clause 4.1(a)); approved revalidation course within five years (clause 4.1(b)); or combinations AMSA considers equivalent (clause 4.1(c)). Short-course plus final assessment within five years is also an option (clause 4.1(d)). Ensure you meet medical and STCW maintenance requirements (clauses 4.2-4.3).

9. Foreign and legacy certificates. If relying on foreign certificates or State-issued legacy certificates, collect full documentary evidence of the foreign authority’s standards and course content for AMSA to consider equivalence (Schedule 2 uses “AMSA considers to be at least equivalent”). For State-issued certificates pre-1 July 2013, consult s 13 and AMSA guidance on transitional treatment, and confirm whether AMSA issued a re-issuance or expiry determination under s 12.

10. Employer verification and rostering. Employers must verify the grade and endorsements of each engineer officer before assigning duties (s 7). Where a vessel’s propulsion power or operating area requires a particular endorsement (e.g., chief engineer on vessels ≥3000 kW), ensure the rostered engineer’s certificate authorises that duty.

11. Administrative submissions to AMSA. When applying for issuance, endorsement or revalidation, include: Training Record Book entries, course completion certificates (STCW short courses), final assessment evidence, certificate of medical fitness (per Marine Order 76), evidence of workshop skills or degree qualifications as applicable, and vessel registry documents showing propulsion power where needed. AMSA’s power to revalidate is conditioned on the certificate not being suspended, cancelled or revoked (s 11), so resolve any outstanding administrative issues before application.

12. Anticipate AMSA discretion. When relying on equivalence routes, provide comprehensive supporting documentation, because the Order repeatedly vests AMSA with the decision whether a foreign certificate, combined service or alternative training is "at least equivalent" (Schedule 2 and Schedule 4). Prepare written submissions aligning foreign course syllabi to the STCW Code clauses referenced.

13. Keep timelines under review. Track key dates: course completion within five years for revalidation courses, the 12-month/3-month service windows, and expiry or transition determinations under ss 12-13. Failure to meet timing windows will likely require remedial training or course attendance.

14. Cross-check related Marine Orders. For medical fitness (Marine Order 76), seafarer certification procedures and application mechanics (Marine Order 70), and national-law NC certificate interactions (Marine Order 505), read those instruments alongside Marine Order 72. Application forms, application procedures and variation conditions are addressed in the Navigation Act and Marine Order 70 (s 3 cites s 314 of the Navigation Act and s 2(2) names Marine Order 70 as the companion instrument).

Following the steps above and adhering to the documentary and training standards in the Schedules will reduce administrative risk. Employers and candidates should maintain contemporaneous, accurate records aligned to the calculation rules in Schedule 3 and the course content requirements cross‑referenced to the STCW Code.
