Marine Order 71 (Masters and deck officers) 2023

The Order rests on a small set of core concepts that structure both legal requirements and administrative action.

• Certificate kinds and mapping to duties. Schedule 1 maps discrete certificate kinds (for example, Watchkeeper Deck <500 GT, Mate <500 GT, Master, Chief Mate <3000 GT) to the specific duties and functions the holder is authorised to undertake (s 6; Schedule 1). The statutory logic is categorical: if the Schedule lists a duty for the certificate kind, the person must hold that certificate to perform the duty (s 6(1)). Exceptions for yachts are carved out to Marine Order 74 (s 6(2)).
• Eligibility and revalidation criteria. Eligibility for a first issue is governed by s 7(1) and the detailed tables in Schedule 2. Revalidation (reissue) criteria for existing or previously held certificates are specified in s 7(2)-(3) and Schedule 4. Schedule 4 sets multiple alternative routes to revalidation (recent qualifying seagoing service; completion of an approved revalidation course; combinations of approved courses and duties AMSA accepts as equivalent; or approved short courses plus final assessment). Schedule 4 also requires certain ongoing proficiencies (medical fitness, GMDSS, security awareness, survival craft proficiency and advanced firefighting) (Schedule 4.1-4.5).
• Qualifying seagoing service. The Order defines qualifying seagoing service as service undertaken while performing specified roles (master, deck officer, trainee deck officer, deck cadet or rating) and recorded in writing, with calculation rules laid out and cross-references to Marine Order 70 Subdivision 3.1 (s 8). Specific counting rules apply: 8 or more hours in 24 hours counts as a whole day (s 8(2)); shorter periods count as the actual hours plus 25% (s 8(3)). Many Schedule 2 eligibility criteria are expressed in months of qualifying seagoing service, with additional granularity such as voyage duration (e.g. voyages of at least 24 hours), vessel size thresholds (≥24 m, ≥500 GT, ≥1500 GT) and role-specific time-in-role conditions (e.g. months in charge of a navigational watch).
• Specific training and proficiencies. The Order incorporates STCW Code requirements by reference and translates them into mandatory training elements: basic safety training (A‑VI/1), advanced firefighting (A‑VI/3), medical care/first aid (A‑VI/4), security awareness (A‑VI/6), survival craft and rescue boats proficiency (A‑VI/2), and GMDSS radio operator certificate (A‑IV/2). ECDIS proficiency is separately required for those working on ECDIS-equipped vessels (s 9(2)(a); Schedule 4.5).
• AMSA discretion and equivalence. Several eligibility and revalidation provisions include a discretion for AMSA to determine equivalence (for example, “other certificate that AMSA considers at least equivalent” appears repeatedly in Schedule 2 and Schedule 3). Schedule 3 also maps older certificates under Marine Order 3 to corresponding current seafarer certificates, formalising equivalence in specified cases (Schedule 3).
• Administrative cross-references and delegation. The Order repeatedly delegates procedural and evidentiary detail to Marine Order 70 (see s 7(1)(b), s 7(3)(a) and s 8(1)(b)), Marine Order 76 for the definition of certificate of medical fitness (s 4(1)(a)-(b)), Marine Order 505 for references to national-law certificates of competency (s 4 definitions), and Marine Order 74 for yachts. The instrument also points users toward AMSA’s website for delegations, application forms and external documents (s 4 notes).

Together these concepts form a compliance architecture: duties are defined by Schedule 1, eligibility by Schedule 2, service counting by s 8 and Marine Order 70, ongoing training requirements by s 9 and Schedule 4, and revalidation routes by Schedule 4. The STCW Code’s competency tables are the normative baseline for many of the technical standards referenced throughout.

The Order applies to two classes of persons, explicitly set out at s 5.

• Persons performing, or intending to perform, duties or functions as a master or deck officer on a regulated Australian vessel (s 5(a)). That captures both active practitioners and those seeking to undertake those roles in the future.
• Persons who hold a seafarer certificate as a master or deck officer (s 5(b)). That captures incumbents who must meet continuing training and revalidation conditions when they undertake duties tied to the certificate (see s 9).

The Order therefore affects several distinct operational groups:

• Candidate seafarers seeking first issue: the Order prescribes a suite of documentary, training and sea-service milestones that must be satisfied before AMSA (or the National Regulator where applicable for certain certificates of competency mentioned in the definitions) can issue the certificate (s 7(1), Schedule 2). The eligibility tables are granular. For example, applicants for Watchkeeper Deck <500 GT must be at least 18, complete 36 months qualifying service (or 18 months if part of an approved monitored course), including at least 12 months on vessels ≥24 m and 6 months under specific watchkeeping training conditions, and hold multiple proficiencies including GMDSS and survival-craft proficiency (Schedule 2, Watchkeeper Deck <500 GT).
• Existing certificate-holders seeking revalidation: holders of certificates in force, previously held certificates, or older Marine Order 3 certificates mapped by Schedule 3, are subject to revalidation criteria in Schedule 4. These criteria include options based on recent service (e.g. 12 months in the 5-year window or 3 months in the prior 6 months), approved revalidation courses, or approved short courses plus a final assessment (Schedule 4.1). Revalidation also requires holding a certificate of medical fitness and GMDSS (Schedule 4.2), and maintaining the STCW required standards for security awareness, survival craft proficiency and advanced firefighting (Schedule 4.3-4.5).
• Employers and vessel operators: while the Order addresses individuals, vessel operators have operational obligations because a person working without the required certificate commits an offence under ss 35 and 36 of the Navigation Act (s 6 note). Employers must ensure crew competence aligns with Schedule 1 duties, maintain records of qualifying seagoing service (s 8(1)(c)), and obtain documentary proof for AMSA inspections or applications.
• Training organisations and assessors: the Order references “approved programs of study” and “approved and monitored” courses or onboard training (Schedule 2). Training organisations will be affected by monitoring obligations, by providing courses that meet the STCW-specified standards (A‑II/1 and relevant A‑II/2 sections), and by having assessment regimes that produce the final assessment required in Schedule 2 entries.
• Holders of foreign certificates: the Order allows certain foreign certificates to be recognised where AMSA considers them at least equivalent, subject to the definition of foreign certificate in s 4 (which excludes certificates restricted to near-coastal voyages). The extent of equivalence is mediated by AMSA’s discretion, affecting foreign-trained seafarers who wish to work on Australian regulated vessels (Schedule 2, Schedule 3 and s 4 definition of foreign certificate).
• Regulatory decision-makers: AMSA and the National Regulator are central decision-makers: AMSA is the preparedness, recognition and enforcement hub (notes to s 4 reference AMSA’s delegation), and the National Regulator issues certain certificates of competency under the national law (s 4 definitions and references to Marine Order 505).

The Order also has targeted impacts where endorsement or near-coastal endorsements are required. Several Schedule 2 entries set specific requirements for endorsements (for example, Watchkeeper Deck <3000 GT near-coastal endorsement requires an additional six months’ service , Schedule 2 Watchkeeper Deck; similar endorsement pathways appear across Mate, Chief Mate and Master categories). These endorsement pathways affect career progression for seafarers moving from lower tonnage or restricted-service certificates to broader operating areas.

Finally, the Order allocates uncertainty and discretion primarily to AMSA through recurrent language that AMSA may consider certificates “at least equivalent,” and through procedural references to Marine Order 70 for how applications are made and evidenced. That places AMSA as the practical gatekeeper of equivalence judgments and revalidation decisions.

The Order is primarily regulatory and prescriptive; it imposes duties on individuals and specifies administrative rights and routes for issuance, revalidation and recognition.

Key duties (individual):

• Hold the appropriate seafarer certificate to undertake duties listed in Schedule 1. The requirement is statutory: if the duty or function is listed for a certificate kind, the person must hold that certificate to undertake it (s 6(1)). The Navigation Act offences for undertaking duties without the required certificate are noted (s 6 note).
• Meet first-issue eligibility requirements. For first issue, applicants must satisfy the English-language familiarity requirement, apply according to Marine Order 70 Subdivision 2.1, and meet the Schedule 2 eligibility requirements (s 7(1)(a)-(c)). Schedule 2 sets out minimum age, qualifying seagoing service, program of study completion, and specific proficiencies (for example, survival craft, GMDSS, medical fitness).
• Maintain ongoing training and proficiencies while undertaking duties tied to the certificate. Section 9 requires that a person who holds a seafarer certificate and undertakes a duty or function for which the certificate is required must: have ECDIS training if working on an ECDIS-equipped vessel (s 9(2)(a)); hold a current STCW-compliant survival craft and rescue boats proficiency certificate (s 9(2)(b)); and have maintained the required standard of competence in advanced firefighting specified in STCW Code Table A‑VI/3 (s 9(2)(c)).
• Record qualifying seagoing service in writing and ensure it complies with the counting rules in s 8: service must be recorded, and the day-counting rules for 8 hours (counts as a whole day) and less-than-8 hours (actual hours plus 25%) apply (s 8(1)-(3)). Many Schedule 2 eligibility criteria require service to be on vessels of certain size thresholds and voyage durations, so the recording must be sufficiently granular to evidence those specifics.
• For revalidation, meet one of the Schedule 4 pathways (recent qualifying seagoing service; revalidation course; approved-equivalent mixture; or short courses plus final assessment) and hold required proficiencies and certificates (Schedule 4.1-4.5).

Rights and administrative entitlements:

• Right to apply for a certificate or revalidation under prescribed processes. The Order requires application in accordance with Marine Order 70 Subdivision 2.1 and revalidation processes under Marine Order 70 Subdivision 5.1 (s 7(1)(b), s 7(3)(a)). Those provisions give applicants an administrative pathway and procedures (forms, evidence, timelines) governed by Marine Order 70.
• Right to recognition of certain past certificates. Schedule 3 maps specific previous Marine Order 3 certificates of competency or recognition to corresponding current seafarer certificates, providing a recognition pathway without necessarily satisfying all Schedule 2 first-issue requirements (s 7(2)(c); Schedule 3).
• Entitlement to revalidation through multiple routes. Schedule 4 offers alternative revalidation routes, including service-based and course-based routes, and allows AMSA to accept combinations it regards as equivalent (Schedule 4.1(c)).
• Right to maintain a certificate provided it has not been the subject of suspension, cancellation or revocation (s 7(3)(b) requires the certificate not be suspended, cancelled or revoked as a criterion for revalidation).

Administrative duties of the regulator and related bodies (implicit in the Order and the enabling Navigation Act provisions listed in s 3):

• AMSA (and the National Regulator where specified) must apply the eligibility, revalidation and equivalence criteria in practice, determine whether a foreign certificate is “at least equivalent,” and administer revalidation processes under Marine Order 70. Section 3 lists specific Navigation Act powers authorising regulations and Marine Orders to prescribe criteria, procedures, recognition, conditions, renewal, suspension and reporting, functions that in practice rest with AMSA and the National Regulator.
• Training providers have duties to provide approved programs and to monitor and report on monitored courses and onboard training where those elements are prerequisites for eligibility (Schedule 2 repeatedly requires "approved and monitored" courses).

Conditionality and administrative contingencies:

• The Order conditions many outcomes on AMSA’s evaluative judgements. Phrases such as “other certificate that AMSA considers at least equivalent” or “service that AMSA considers equivalent” confer a discretionary evaluative role on the regulator (appears repeatedly in Schedule 2 and Schedule 3). That has the practical consequence that applicants relying on equivalence must engage with AMSA’s assessment processes and evidentiary expectations.
• Certificates may be made subject to conditions and may be suspended, varied or revoked under the powers provided by the Navigation Act and implemented in Marine Orders (s 3(1)(f),(g),(h),(i)). Although the Order does not itself itemise suspension grounds or penalty rates, it incorporates the Navigation Act’s enforcement architecture.

In sum, the Order imposes duties on individuals to obtain and maintain the appropriate certificate, to hold specified proficiencies, and to maintain written records of qualifying seagoing service; it confers procedural rights to apply and to seek revalidation through enumerated routes; and it delegates substantial evaluative and implementation discretion to AMSA and the National Regulator.

The Order itself does not set out specific penalty amounts or a separate enforcement schedule; rather, it operates within the Navigation Act enforcement framework and references the Navigation Act’s offences for undertaking duties without the required certificate (s 6 note). The legal enforcement picture laid out or implied by the Order contains the following components.

Statutory offence backstop

• The Order explicitly notes that it is an offence under sections 35 and 36 of the Navigation Act if a person undertakes duties or performs functions for which the regulations require a particular certificate and the person does not hold the certificate (s 6 note). The Order therefore functions as a prescriptive instrument that creates the substantive prerequisites for the Navigation Act offences. The Order does not itself specify penalties; the Navigation Act contains the statutory offence provisions and penalties.

Certificate lifecycle enforcement tools (delegated/regulatory)

• The enabling provisions listed in s 3 indicate the set of regulatory tools that may be exercised under the Navigation Act and implemented by Marine Orders. Section 3(1)(d)(iii) allows for recognition of certificates issued under national law, State, Territory or foreign law; s 3(1)(d)(iv) allows conditions to be imposed on seafarer certificates. Subsections s 3(1)(e)-(i) list matters regulations may provide for certificates, including criteria for issue, variation, revocation, time limits for determinations, conditions, renewal, suspension, transfer and surrender. Those statutory delegations mean AMSA (and the National Regulator where applicable) can take regulatory action against certificates, suspension, cancellation, revocation or imposition of conditions, within the Navigation Act power set.
• Section 7(3)(b) uses certificate status as a criterion for reissue: a certificate that has been suspended, cancelled or revoked cannot be the subject of revalidation under the s 7(3) criterion. That provision thereby links enforcement history (suspension/cancellation) to eligibility for revalidation.

Administrative evidence and record-keeping as enforcement inputs

• The Order requires that qualifying seagoing service be recorded in writing (s 8(1)(c)) and computed in accordance with Marine Order 70 Subdivision 3.1. Those written records are the evidentiary basis for AMSA’s determinations and for inspectors to assess compliance. The detail required in Schedule 2 (destination vessel types, voyage durations and exact months of service) implies that records must be sufficiently granular to permit official verification.
• For revalidation, Schedule 4 requires documentary proofs such as a certificate of medical fitness and a GMDSS certificate (Schedule 4.2), and maintenance of STCW competencies (Schedules 4.3-4.5). Failure to produce those documents in an application process would likely prevent revalidation under the administrative regime.

Inspection, application processes and regulator discretion

• The Order assigns administrative processes to Marine Order 70 for application forms, supporting documents, and timing (s 7(1)(b), s 7(3)(a)). AMSA (or the National Regulator for certain certificate-of-competency matters) will implement those processes and can reject applications that do not meet the criteria or that present issues concerning equivalence.
• The Order leaves scope for discretionary equivalence assessments for foreign certificates and earlier marine orders’ certificates to be recognised by AMSA, meaning the regulator’s decisions on equivalence and recognition are primary enforcement levers in borderline or transitional cases (Schedule 2 and Schedule 3).

Enforcement gaps and delegation notes

• The Order does not itself specify inspector powers, penalty amounts, or procedural appeal processes. Those are located in the Navigation Act and other applicable instruments. The Order’s enforcement effect therefore depends on the Navigation Act’s powers and AMSA’s administrative practices (s 3, notes to s 4 which point to AMSA website for delegation and procedural details).
• The Order also relies on the STCW Convention standards as the competence baseline; compliance with those standards is enforced through the administrative certification and revalidation processes rather than by explicit criminal provisions in this Order.

In practical terms, the enforcement regime is administrative with statutory criminal backstops in the Navigation Act. The practical burdens on compliance enforcement are: verifying written service records; auditing training certificates and proficiencies (advanced firefighting, survival craft, GMDSS, ECDIS where relevant); assessing AMSA equivalence decisions for foreign or previous certificates; and enforcing against persons who undertake duties without the required certificate under Navigation Act offences.

The Order is explicitly designed to operate within a web of other Marine Orders, the Navigation Act 2012, the national law and the international STCW regime. The text contains numerous cross-references that allocate substantive, procedural and definitional responsibilities.

Primary legislative and international instruments

• Navigation Act 2012. The Order is made under the Navigation Act. Section 3 of the Order identifies the specific Navigation Act provisions that authorise it, including s 28 (regulations providing for seafarer certificates and giving effect to STCW), s 29 (prescribing classes of seafarer certificates and settings for competencies and conditions), subsections 314(1), 314(3)-(4), 314(5) (application/criteria processes) and s 342(1) (making Marine Orders) (s 3(1)). The Order therefore gives effect to the Navigation Act’s delegation to prescribe certificates and associated standards.
• STCW Convention and STCW Code. The Order repeatedly gives effect to and incorporates standards from the STCW Code and Convention. Purpose (s 2(b)) expressly cites giving effect to the STCW Convention. Many Schedule 2 and Schedule 4 requirements are framed as compliance with specific STCW Code sections and tables (for example, basic safety training A‑VI/1, advanced firefighting A‑VI/3, survival craft and rescue boats A‑VI/2, GMDSS A‑IV/2, and security awareness A‑VI/6). The STCW Code thus operates as the technical competency baseline.
• National law and Marine Orders. The Order cross-references multiple other Marine Orders and national instruments:
  • Marine Order 70 (Seafarer qualifications) 2014: used for application processes (Subdivision 2.1), qualifying seagoing service calculations (Subdivision 3.1), and revalidation processes (Subdivision 5.1). Section 4(2) and s 7(1)(b), s 7(3)(a), s 8(1)(b) make these links explicit.
  • Marine Order 76 (Health , medical fitness) 2017: supplies the definition of certificate of medical fitness used for first issue and revalidation (s 4(1)(a)-(b)).
  • Marine Order 74 (Masters and deck officers , yachts) 2015: governs yacht-specific requirements and is explicitly excluded from the scope of this Order with respect to yachts (s 6(2); s 4 definition of yacht references Marine Order 74).
  • Marine Order 505 (Certificates of competency , national law) 2022: referenced in definitions of Master <24 m NC, Master <45 m NC, Master <100 m NC certificates of competency (s 4 definitions).
  • Marine Order 3 (Seafarer qualifications) 2004: older certificates issued under Marine Order 3 are mapped to corresponding current seafarer certificates by Schedule 3 (s 7(2)(c); Schedule 3).
  • Marine Order 11 (Living and working conditions on vessels) 2024: referenced in Schedule 2 notes regarding night work for trainees under 18 (Schedule 2 Watchkeeper Deck and Watchkeeper Deck <500 GT notes).
• SOLAS and IMO documents. Section 4 notes that terms defined in Marine Order 1 and documents such as SOLAS, IMO Resolutions, and other IMO material are relevant; the Order points readers to AMSA’s website for obtaining those documents.

Operational interactions and practical effects

• The Order is not freestanding; compliance requires familiarity with the STCW Code, Marine Order 70 administrative procedures, Marine Order 76 medical fitness standards, and Marine Order 505 national-law certificates of competency. Applicants and operators must navigate all these instruments to meet evidentiary and substantive requirements.
• Equivalence and recognition regime: Schedule 3 creates a specific mapping from certain Marine Order 3 certificates to corresponding current seafarer certificates, smoothing transition for holders of older certificates. Outside those explicit mappings, AMSA’s discretion to accept “equivalent” foreign or other certificates means interaction with foreign regulatory regimes will be adjudicated by AMSA on an case-by-case basis (s 4 definition of foreign certificate; Schedule 2 country-equivalence language).
• Yachts: the Order defers to Marine Order 74 for yachts (s 6(2)), so operators and crews on yachts must consult a different Marine Order for the certificate requirements that would otherwise be covered here.
• Delegation, forms and procedures: the Order repeatedly points to Marine Order 70 and AMSA’s website for procedural details and for delegations of AMSA’s powers (s 4 notes). That means some implementation details (forms, timing, certification of training providers, approved courses) sit outside the text and are updated administratively, altering the practical compliance pathway without amending the Order itself.

Legal hierarchy and enforcement instruments

• Criminal enforcement against uncredentialled performance of duties is in the Navigation Act (s 6 note). The Order is an enabling instrument that specifies the competence baselines; the Navigation Act provides the penalty framework and the broader enforcement tools (s 3 references).
• Administrative enforcement such as refusal, suspension or revocation of certificates is grounded in the Navigation Act powers to regulate certificates (s 3(1)(f)-(i)). The Order’s references to certificate status in revalidation criteria (s 7(3)(b)) mean administrative enforcement directly affects eligibility for reissue.

In short, the Order is a node in a tightly interconnected regulatory network. Compliance entails simultaneous reference to the Order, multiple Marine Orders (70, 74, 76, 505, 3), the STCW Code/Convention and the Navigation Act. This structure centralises competence standards while dispersing procedural detail to Marine Order 70 and AMSA-administered materials.

The compilation note at the head of the instrument records the Order’s creation and subsequent amendment activity up to the compilation date. The following facts are stated in the Order’s notes and the compilation table.

• Original instrument and commencement. Marine Order 71 (Masters and deck officers) 2023 was registered as MO 2023/5 on 21 November 2023 and commenced on 1 July 2024 (compilation table).
• Subsequent amendment. Marine Orders Amendment (Marine Order 11 , consequential changes) Order 2024 (MO 2024/4) was registered on 15 November 2024 and commenced on 23 December 2024. The compilation date is 23 December 2024, and the compilation was prepared on 3 December 2024 including amendments up to MO 2024/4 (compilation header).
• Specific amendment affectation. The table of amendments in the notes identifies that Schedule 2 was amended by MO 2024/4 (Table of amendments) , the compilation explicitly lists Schedule 2 as “am. MO 2024/4”.
• Repeals of Legislation Act provisions. The amendment table includes entries labelled 1A and 1B which refer to the repeal of sections 48D and 48C of the Legislation Act 2003. The table entry format is terse: “1A … rep. Legislation Act 2003, s48D” and “1B … rep. Legislation Act 2003, s48C”. The compilation retains those notes as part of the amendment record.
• Compilation and editorial notes. The notes to s 4 indicate where readers can find the current delegations on the AMSA website and where to obtain IMO documents referenced in the Order (s 4 notes). The compilation includes an HTML-style Table of amendments showing the recorded changes and the reference to Schedule 2 amendment.

What the amendment history demonstrates mechanically:

• The Order was introduced in 2023, took effect mid-2024, and received at least one consequential amendment relating to Marine Order 11 in late 2024, with a specified amendment to Schedule 2. Users relying on Schedule 2 eligibility requirements should refer to the post-amendment text as compiled on 23 December 2024.
• The recorded repeals of provisions of the Legislation Act 2003 in the Table of amendments appear as technical entries in the compilation record; the instrument itself does not include explanatory narrative about the practical effect of those repeals. The compilation preserves the formal amendment trail for legal certainty.

Administrative implication

• Because the Order cross-references other Marine Orders and the STCW Code, any future amendments to Marine Order 70, Marine Order 76, Marine Order 74, or to AMSA’s delegated procedures could affect practical compliance without further amendment to this Order. The visible 2024 amendment to Schedule 2 demonstrates that competence standards and eligibility details can be updated consequentially to align with changes elsewhere (for example, Marine Order 11 amendments concerning living and working conditions on vessels are referenced in Schedule 2 notes regarding night work for trainees under 18).

Users should therefore track both Marine Order 71 itself and related Marine Orders and AMSA administrative material for a complete and current compliance picture. The compilation notes provide the immediate amendment trail through to late 2024.

The instrument as provided contains no references to judicial decisions, interpretations, challenges or litigation outcomes. The Order is an administrative Marine Order: its text records statutory authority, eligibility, revalidation, standards and cross-references, but it does not name any court decisions or prior litigation.

Consequently, from the text alone:

• There are no cases cited in the Order. The schedules, sections and notes do not reference judicial findings or litigation precedents.
• The Order does not itself set out any dispute resolution or appeal mechanisms specific to this instrument; procedural matters such as application processes, time limits and criteria are referenced to Marine Order 70 Subdivisions (s 7(1)(b), s 7(3)(a), s 8(1)(b)), and enforcement and offence provisions are in the Navigation Act (s 6 note). Any administrative review or merits appeal processes that might be available to applicants or certificate-holders will therefore be determined by the Navigation Act, Marine Order 70 administrative procedures, and the general administrative law framework applicable to AMSA decisions, none of which are detailed as litigation examples in this instrument.
• Schedule 3 provides mappings of older certificates to corresponding current seafarer certificates; these mappings are administrative decisions recorded in the Order and do not reference court review or judicial endorsement.

Because no litigation history is recorded in the instrument itself, practitioners wishing to understand how tribunal or court decision-making has interpreted the Operation of this Order will need to search case law databases and AMSA decision records external to the text. The Order’s heavy reliance on AMSA’s evaluative discretion (for equivalence determinations and recognition of foreign or older certificates) means administrative decisions are likely to be the primary source of contested outcomes rather than litigation directly involving the Order text. The instrument’s notes direct users to AMSA’s website for delegations, administrative forms and advice, which will be the practical place to find administrative determinations and possible internal review outcomes.

The Order’s detail contains numerous points where practical compliance or interpretation traps can arise. The following are concrete issues apparent from the text that practitioners, employers and seafarers should watch for.

Cross-references and administrative dependence

• Heavy reliance on other instruments. The Order frequently delegates procedural details and evidentiary rules to Marine Order 70 and references medical fitness to Marine Order 76, yachts to Marine Order 74, and certificates of competency to Marine Order 505. Practically, compliance requires reading multiple instruments; failure to consult Marine Order 70 (applications, evidence standards, subdivision rules) will cause application defects (s 7(1)(b), s 7(3)(a), s 8(1)(b)).
• AMSA discretion as a recurring pivot. The phrase “AMSA considers at least equivalent” appears across Schedule 2 and Schedule 3. If an applicant relies on equivalence, for example, a foreign certificate or another certificate type,AMSA’s subjective assessment is decisive. Preparing an equivalence application without AMSA-specific evidence risks delay or refusal.

Service-recording granularities

• Written record requirement and day-counting rules. Qualifying seagoing service must be recorded in writing (s 8(1)(c)). The 8‑hour rule (counts as whole day) and the shorter-hours calculation (actual hours plus 25%) are mechanical and potentially unintuitive (s 8(2)-(3)). Applicants relying on aggregated or approximate service logs risk failing to meet the strict month and voyage-duration thresholds in Schedule 2.
• Voyage duration and vessel-size granularity. Many eligibility criteria require service on vessels ≥24 m, ≥500 GT, ≥1500 GT, and voyages “of at least 24 hours duration.” Evidence must show those precise thresholds. Employers and seafarers must ensure voyage logs and vessel registries can demonstrate the relevant thresholds.

Complex endorsement pathways and conditional endorsements

• Endorsements for near-coastal or tonnage-specific capacities. Several pathways require additional endorsements (e.g. near-coastal endorsements to obtain broader service rights). Endorsement routes often require additional months of service while holding a lower certificate (Schedule 2 entries for Watchkeeper Deck, Mate, Chief Mate and Master). Career-planning must factor in these conditional time-in-role requirements.
• Restricted vs unrestricted certificates. The definitions distinguish foreign certificates that are “not a certificate restricted to service on vessels engaged on near-coastal voyages” (s 4). Foreign certificates limited to near-coastal service are excluded from the definition of foreign certificate for recognition, which may prevent the straightforward mapping of such foreign qualifications.

Revalidation timing pitfalls

• Tight revalidation windows. Schedule 4 provides discrete options,12 months in the 5 years before the application, or 3 months in the 6 months before the application, approved revalidation course within 5 years, or short courses plus a final assessment. Missing these windows may force a certificate-holder to undertake more onerous revalidation routes or new-issue pathways (Schedule 4.1).
• Proficiency and currency requirements for revalidation. Revalidation requires current medical fitness and a GMDSS certificate (Schedule 4.2), plus maintenance of STCW competencies in security awareness, survival craft proficiency and advanced firefighting (Schedule 4.3-4.5). A lapse in any of those proficiencies can block revalidation even if sea-service criteria are met.

Training and final assessment requirements

• Final assessment is a gate. Many Schedule 2 entries require passing a “final assessment” as a discrete requirement. The Order does not specify the assessment format; these procedural specifics flow from Marine Order 70 and the “approved program of study” regime. Candidates must ensure their training provider’s assessment protocols are approved and evidence of a pass will be accepted by AMSA.
• Monitored course requirements. Several accelerated pathways rely on “approved and monitored” courses with monitored onboard training, and reduced months of qualifying seagoing service if part of such programs. The monitoring and approval regime is critical: only monitored programs support the shorter service requirement and the Order requires the seafarer training organisation to monitor courses (s 4 definition of monitored).

ECDIS and equipment-specific training

• ECDIS training as a conditional requirement. Section 9(2)(a) requires ECDIS training for persons working on ECDIS-equipped vessels. That is task-specific: a certificate-holder who otherwise is compliant could still fail the condition if they are deployed on an ECDIS-equipped vessel without the ECDIS proficiency described in Schedule 4.5 (and s 9).

Medical and GMDSS preconditions

• Medical fitness and GMDSS as continuous requirements. The Order ties both medical fitness and a GMDSS radio operator certificate to first issue and to revalidation (s 7(1)(c)(d) / Schedule 4.2). A lapsed medical certificate or a lapsed GMDSS certificate can inhibit revalidation or the ability to undertake duties.

Yachts and scope exceptions

• Yacht carve-out. If the regulated Australian vessel is a yacht, Marine Order 74 applies and this Order does not displace that regime (s 6(2)). Practitioners and crews on yachts must therefore not assume the requirements in this Order apply.

Transition and legacy certificate mappings

• Schedule 3 mappings are specific. Only the listed Marine Order 3 certificates are explicitly mapped to current seafarer certificates. Holders of other legacy certificates must rely on AMSA equivalence processes rather than assuming automatic mapping.

In sum, the practical “gotchas” are mostly about documentary precision, timing of service and revalidation windows, AMSA discretion on equivalence, inter-instrument dependencies (Marine Order 70, 76, 74, 505), and equipment-specific proficiencies such as ECDIS. Each of these points is rooted in the text: s 4 definitions, s 7 eligibility pathways, s 8 service-recording rules, s 9 training-maintenance obligations, Schedule 2 eligibility breakdowns and Schedule 4 revalidation routes.

Compliance with Marine Order 71 requires a combination of forward planning, accurate record-keeping and alignment with AMSA-approved training and assessment processes. Below is a practical, source-grounded checklist and recommended steps for first-issue applicants, current certificate-holders seeking revalidation, employers and training providers.

Step 1: Determine the required certificate by duty and vessel

• Identify the duties the person will perform and the vessel’s characteristics (gross tonnage, operating area, whether it is a yacht and whether it is ECDIS-equipped). Use Schedule 1 to match the duty to the kind of certificate required (s 6; Schedule 1). For yachts, consult Marine Order 74 instead (s 6(2)).

Step 2: Check eligibility criteria for first issue

• For first issue, confirm the applicant meets the three s 7(1) core criteria: English-language familiarity (s 7(1)(a)), application in accordance with Marine Order 70 Subdivision 2.1 (s 7(1)(b)), and the Schedule 2 eligibility requirements for the chosen certificate kind (s 7(1)(c)).
• Read Schedule 2 entry for the specific certificate carefully for minimum age, qualifying seagoing service thresholds, voyage-duration and vessel-size requirements, required approved programs of study and the list of mandatory proficiencies (e.g. survival craft, GMDSS, medical fitness). For example, a Watchkeeper Deck <500 GT applicant must be at least 18, have 36 months qualifying service (or 18 months if part of an approved and monitored course) with specified months on ≥24 m vessels, an approved program of study, survival craft proficiency, GMDSS, certificate of medical fitness and a passed final assessment (Schedule 2, Watchkeeper Deck <500 GT).

Step 3: Plan and document qualifying seagoing service

• Ensure service is performed in roles that qualify (master, deck officer, trainee deck officer, deck cadet or rating), recorded in writing and calculated in accordance with Marine Order 70 Subdivision 3.1 (s 8(1)(a)-(b),(c)).
• Apply the day-counting rules when tallying service: 8 hours or more in a 24-hour period counts as a whole day (s 8(2)); less than 8 hours counts as the actual hours plus 25% (s 8(3)). Maintain voyage logs that show vessel size, voyage duration and role performed to meet the Schedule 2 specificity.

Step 4: Complete approved programs of study and final assessments

• Enrol in AMSA-approved programs of study that meet STCW Code section A‑II/1 and the relevant A‑II/2 components as required for the certificate (Schedule 2). Ensure the training provider is approved and that monitored onboard training is documented where applicable (for shortened seagoing service pathways).
• Prepare for and pass the final assessment that Schedule 2 requires. Confirm with the training provider and AMSA what constitutes an acceptable final assessment and the format for submitting evidence (Marine Order 70 Subdivision 2.1 will govern application paperwork and evidence).

Step 5: Obtain and maintain mandatory proficiencies

• Obtain a certificate of medical fitness in accordance with Marine Order 76 definitions (s 4(1)(a)-(b) and Schedule 4.2).
• Obtain and keep current a certificate of proficiency in survival craft and rescue boats other than fast rescue boats in compliance with STCW Code Table A‑VI/2‑1 (s 9(2)(b); Schedule 4.4).
• Obtain and maintain a GMDSS radio operator certificate compliant with STCW Code A‑IV/2 as required in Schedule 2 entries and Schedule 4.2.
• Maintain advanced firefighting competence as specified in STCW Code Table A‑VI/3 if the holder undertakes duties requiring it (s 9(2)(c); Schedule 4.4).

Step 6: ECDIS and equipment-specific training

• If the vessel is equipped with ECDIS and the person will undertake duties on that vessel, obtain the ECDIS training mentioned in Schedule 2 to Marine Order 70 and hold an ECDIS certificate of proficiency as required for revalidation and task performance (s 9(2)(a); Schedule 4.5).

Step 7: Apply via Marine Order 70 procedures

• Lodge the application in accordance with Marine Order 70 Subdivision 2.1 (s 7(1)(b)) and supply the written records of qualifying seagoing service and all training/proficiency certificates. For revalidation, follow Marine Order 70 Subdivision 5.1 procedures (s 7(3)(a)).
• For revalidation applicants, choose one of Schedule 4 pathways: qualifying service in the applicable windows (12 months in 5 years or 3 months in 6 months), completion of an approved revalidation course within 5 years, combination of duties and courses AMSA considers equivalent, or completion of approved short courses plus a final assessment (Schedule 4.1). Provide evidence of medical fitness and GMDSS (Schedule 4.2), and evidence of maintained security awareness, survival craft proficiency and advanced firefighting competence (Schedule 4.3-4.4).

Step 8: Prepare for AMSA equivalence assessments if relying on foreign or legacy certificates

• If relying on a foreign certificate, ensure it is not restricted to near‑coastal voyages if seeking recognition under the Order’s definition of foreign certificate (s 4 definition). If seeking recognition of a Marine Order 3 certificate, consult Schedule 3 to see if an automatic correspondence is provided; otherwise prepare equivalence evidence for AMSA’s consideration (s 7(2)(c), Schedule 3).
• Provide detailed documentary evidence of training content, sea service, vessel types and voyage durations to support equivalence assessments.

Step 9: Employer responsibilities and operational readiness

• Employers should verify certificate holdings match the duties in Schedule 1 before assigning personnel to roles and check revalidation windows and currency of proficiencies. Because undertaking duties without the required certificate is an offence under the Navigation Act (s 6 note), employers should incorporate certificate verification into crewing and compliance checks.

Step 10: Maintain continuous records and revalidation calendars

• Maintain the written records required for qualifying seagoing service (s 8(1)(c)) and a calendar for revalidation deadlines. Because Schedule 4 revalidation paths include temporal windows (5‑year windows, 6‑month windows), certificate-holders should proactively track service accumulation and course expiry to avoid lapses that could necessitate more onerous requalification.

Where to get procedural detail and assistance

• The Order points to Marine Order 70 for application mechanics and Marine Order 76 for medical fitness definitions (s 7(1)(b), s 7(3)(a), s 4). The notes direct users to the AMSA website for delegation details, application forms and sources for IMO documents (s 4 notes). Practitioners should obtain the AMSA-approved course lists, approved training organisations and monitoring requirements from AMSA’s current administrative material before applying.

Final operational notes

• Because AMSA has discretion on equivalence and recognition, engage with AMSA early when seeking equivalence for foreign or non-standard certificates. For trainees following an approved monitored course, ensure the training organisation understands the monitoring and reporting duties required to shorten qualifying seagoing service requirements (Schedule 2 monitored-course pathways).
• Keep medical fitness and GMDSS certificates current, as revalidation requires them (Schedule 4.2). If deployed on ECDIS-equipped vessels, secure and maintain ECDIS training and certificates (s 9(2)(a); Schedule 4.5).

Following the above steps, mapping duties against Schedule 1, meeting Schedule 2 eligibility for first issue or Schedule 4 for revalidation, recording qualifying service per s 8, maintaining STCW proficiencies per s 9 and Schedule 4, and applying under Marine Order 70 procedures, aligns operational practice with the Order’s requirements and the broader Navigation Act/STCW compliance architecture.
