Marine Order 64 (Vessel traffic services) 2022

The Order organises the VTS regime around several recurring legal and operational concepts. These are authorisation (instrument of authority), accreditation (certificate of accreditation), standards and guidance (IALA standards and the IMO-adopted Guidelines), audits, conditions, AMSA discretion, and obligations on masters and operators.

Authorisation: An instrument of authority is the legal authorisation granted by AMSA allowing a person to provide a vessel traffic service in a defined VTS area (s 6). Applications must detail the VTS area and operational objectives, and show alignment with AMSA’s Guidelines and the normative provisions of specified IALA standards (s 5(3), s 6(c)). Instruments include the name of the VTS provider, a VTS area description, operational objectives and conditions (s 8), and run for up to five years (s 9).

Accreditation: A certificate of accreditation permits an organisation to deliver VTS training courses recognised by AMSA (s 15). Applicants must be registered training organisations under one of the enumerated Australian registries (s 4 definitions, and s 14(3)(a)), and must demonstrate compliance with the normative provisions of IALA Standard S1050 (s 15).

Guidance and normative standards: The Order repeatedly anchors operational requirements to external documents. It makes AMSA the competent authority for Guidelines adopted by IMO Resolution A.1158(32) (s 4(2)). It requires VTS providers to operate in accordance with the Guidelines “as if the Guidelines were mandatory” (s 7(1)(a)). It also requires compliance with the normative provisions of IALA Standards S1010, S1040, S1050 and S1070 (ss 6(c), 7(1)(c), 15(b), 16(1)(a)). The Order distinguishes “normative provisions” as those necessary for a member state to achieve compliance with the standard (notes to ss 6 and 15).

Audits and fees: AMSA may conduct audits of applicants, providers and training organisations to assess capability and compliance (ss 13, 21). Audits may review all relevant aspects of operations and AMSA may charge a fee for audits under s 47 of the AMSA Act (notes to ss 13 and 21). During audits, providers and training organisations must comply with reasonable requests from AMSA (ss 7(1)(d) and 16(1)(d)).

Conditions, amendment and review: AMSA may impose conditions when issuing instruments or certificates, may add or change conditions, and may amend on its own initiative or on application by the holder (ss 7(2), 10, 19). Amendments initiated by AMSA are reviewable decisions under s 17 of Marine Order 1 (s 10(7), s 19(7)), and suspension and cancellation decisions are reviewable (ss 11(3), 20(3)). The Order repeatedly cross-references Marine Order 1 for application procedure and review processes (multiple sections).

Obligations on masters: The Order specifies the information a master must provide when requested by a VTS provider (s 22(1)) and creates a specific offence and civil penalty for failing to obey a VTS instruction, naming the penalty quantum and strict liability status (s 22(2)-(4)). It also highlights that Part 6 of the Navigation Act applies the VTS regime to all vessels including foreign and recreational vessels (note under s 22, reference to s 212 of the Navigation Act).

Transitional continuity: Applications made under the 2013 Order before 1 July 2022 but not decided by that date are treated as applications under this Order (s 23). Instruments and certificates in effect on 30 June 2022 continue in effect under the new Order (s 24).

These concepts jointly allocate responsibility for setting performance expectations to IALA standards and the Guidelines, while giving AMSA the administrative powers to authorise, audit, condition and, where necessary, amend, suspend or cancel authorisations and accreditations.

The Order creates obligations, permissions and administrative pathways that affect several distinct groups, each with clearly defined legal roles under the text.

AMSA: The authority that administers the regime. AMSA is given explicit powers to issue, amend, suspend and cancel instruments of authority and certificates of accreditation (ss 6, 10, 11, 15, 19, 20). AMSA is designated the competent authority for the Guidelines (s 4(2)). AMSA also conducts audits, invites comments on proposed amendments, and may charge audit fees under s 47 of the AMSA Act (notes to ss 13 and 21). Where AMSA initiates an amendment or makes a suspension/cancellation, the decision is reviewable under Marine Order 1 (s 10(7), s 11(3), s 19(7), s 20(3)).

Applicants for VTS authorisation: Persons or entities that seek to be a VTS provider must apply to AMSA in the approved form and supply a VTS area description, operational objectives, and statements about how they will meet responsibilities in paragraph 5.3 of the Guidelines and the normative provisions of the IALA standards named (s 5(1)-(3), s 6). Applicants may be audited to verify these capabilities (s 6 note, s 13).

VTS providers: Entities holding an instrument of authority. They must operate within the authorised VTS area, in accordance with the Guidelines and the normative provisions of IALA Standards S1010, S1040, S1050 and S1070, and comply with audit requests (s 7(1)). VTS providers may apply for approval to conduct recurrent training (s 12). They are also subject to terms, time limits of up to five years for their instrument, and obligations to apply for renewal at least 90 days before expiry to ensure continuity (s 9(1)(b), s 9(3)).

VTS training organisations: RTOs that apply for and hold certificates of accreditation to provide VTS training courses (ss 14-18). They must be registered training organisations under one of the Australian registration authorities identified in the definitions (s 4), must present how their courses align with IALA S1050 (s 14(3)(b)-(c)), must renew their RTO registration annually and show that renewal to AMSA (s 16(1)(b)-(c)), and are subject to audit (s 21).

Masters of vessels: The Order places statutory reporting obligations on masters under paragraph 213(2)(e) of the Navigation Act, specified in s 22(1). Masters must provide requested reports or information about identity, position, course, speed, cargo attributes, route before and after entering the VTS area, times of entry and exit, ports of call, and conditions relevant to safety and pollution (s 22(1)(a)-(h)). Failure to obey a VTS instruction is an offence punishable by 50 penalty units, is a strict liability offence, and also attracts a separate civil penalty of 50 penalty units (s 22(2)-(4)). The Order notes s 215 of the Navigation Act makes it an offence not to comply with requests under s 22(1).

Other maritime operators and stakeholders: The Order requires AMSA to seek comments before amendments, directed to persons AMSA considers may have an interest (s 10(4), s 19(4)). That creates an administrative route by which ports, pilot organisations, harbour authorities, and commercial shipping interests might be consulted. The note under s 22 refers to s 212 of the Navigation Act applying Part 6 to all vessels, including foreign and recreational vessels, indicating broad coverage.

Registered training authorities and regulatory registries: The scheme refers to particular registries for RTOs (Australian Skills Quality Authority, Victorian Registration and Qualifications Authority, Western Australia Training Accreditation Council) in the definition of registered training organisation (s 4), so those registries indirectly shape who may apply for accreditation.

Fee-payers and auditors: The Order contemplates fees may be charged for audits under s 47 of the AMSA Act (notes to ss 13 and 21), therefore applicants and holders of authorisations and accreditations who are audited may pay fees.

In short, the Order affects AMSA as regulator and auditor, entities that provide VTS or VTS training, applicants seeking those roles, masters of vessels transiting VTS areas who must report and obey instructions, and other stakeholders who may be consulted in amendments. Each group faces discrete compliance tasks, costs and administrative interactions set out in the cited provisions.

The Order sets out duties and corresponding AMSA powers that translate international standards and an IMO-line into domestic administrative requirements. These are the main duties imposed, and the rights that flow from the text.

Duties of applicants and holders (VTS providers)

• Application content: Applicants must provide a description of the proposed VTS area, describe operational objectives and explain how responsibilities in paragraph 5.3 of the Guidelines will be met, and state how they will meet the normative provisions of the IALA Standards specified (s 5(3)(a)-(c)). Form requirements are governed by Marine Order 1 (s 5(2)).
• Operational conduct: A VTS provider must operate in accordance with the Guidelines “as if the Guidelines were mandatory” (s 7(1)(a)); operate within the VTS area in the instrument (s 7(1)(b)); and establish and operate the VTS in accordance with the normative provisions of the IALA standards cited (s 7(1)(c)).
• Audit cooperation: If subject to audit, the provider must comply with reasonable requests during the audit (s 7(1)(d)).
• Renewal and continuity: Instruments run for up to five years and expire earlier if cancelled; to continue providing services after expiry, a VTS provider must apply for a new instrument at least 90 days before expiry (s 9(1)-(3)).
• Recurrent training: A VTS provider may apply to AMSA to conduct recurrent training per IALA model course V-103/5; AMSA may approve if it considers the provider capable (s 12).

Duties of VTS training organisations

• RTO status: Applicants must be registered training organisations registered by specific registries (s 4 definition, s 14(3)(a)).
• Course scope: The applicant must state which VTS courses it proposes to provide and how it meets the normative provisions of IALA S1050 (s 14(3)(b)-(c)).
• Compliance with IALA S1050: Accredited VTS training organisations must operate in accordance with the normative provisions of IALA S1050 (s 16(1)(a)).
• Annual RTO renewal and evidence: They must renew RTO registration annually and show AMSA evidence each year (s 16(1)(b)-(c)).
• Audit cooperation: If audited, they must comply with reasonable audit requests (s 16(1)(d)).

Duties of masters

• Reporting obligation: If requested by a VTS provider, the master must give reports or information about identity, position, course, speed, attributes, cargo, communications, routes and timings, ports of call, and conditions relevant to safety or pollution (s 22(1)(a)-(h)). Section 215 of the Navigation Act is noted as making non-compliance an offence.
• Obedience to instructions: A master commits a criminal offence (50 penalty units) if they receive an instruction from a VTS provider for the movement of the vessel and do not obey it (s 22(2)). The offence is strict liability (s 22(3)). Separately, contravening subsection (2) attracts a civil penalty of 50 penalty units (s 22(4)).

AMSA powers and procedural protections

• Issuance: AMSA may issue instruments and certificates if satisfied of need and capability (ss 6, 15).
• Conditions and amendments: AMSA may impose further conditions on instruments and certificates (ss 7(2), 16(2)), and may amend instruments or certificates on its own initiative or on application by the holder (ss 10, 19). For AMSA-initiated amendments, AMSA must give written notice seeking comments within a period of less than 90 days to persons AMSA considers may have an interest, and must consider comments received (ss 10(4)-(5), 19(4)-(5)).
• Suspension and cancellation: AMSA may suspend or cancel instruments and certificates if it considers a condition has not been complied with, or the holder returns the instrument or certificate for cancellation (ss 11(1)-(2), 20(1)-(2)).
• Audits and fees: AMSA may conduct audits to assess compliance or capability, and may charge fees for audits under s 47 of the AMSA Act (ss 13, 21; notes).
• Review rights: Decisions such as AMSA-initiated amendments and suspensions/cancellations are reviewable decisions under section 17 of Marine Order 1, and Marine Order 1 governs the application process and review procedures (notes to ss 6, 12, 15, 10(7), 19(7), 11(3), 20(3)).

Rights and administrative processes

• Right to comment: Before amendments initiated by AMSA, AMSA must seek comments from persons it considers may have an interest (ss 10(4), 19(4)).
• Review: Affected persons have the right to seek review of specified AMSA decisions under Marine Order 1 (s 10(7) etc).
• Time-limited authorisations: The five-year term gives holders a predictable renewal cycle and a duty to apply in advance to avoid service disruption (s 9).

The Order therefore allocates operational duties to providers and training organisations, statutory reporting and obedience duties to masters, and investigative and corrective powers to AMSA, while creating procedural stepping stones for affected parties to comment and seek review of administrative decisions.

The Order sets clear enforcement points anchored in the Navigation Act and establishes both criminal and civil remedies for non-compliance, while giving AMSA administrative enforcement powers including audits, suspension and cancellation.

Specific criminal and civil penalties

• Failure to obey a VTS instruction: Section 22(2) makes it a criminal offence for the master of a vessel who receives an instruction from a VTS provider for the movement of the vessel and does not obey the instruction. The penalty is 50 penalty units. The Order then clarifies that this offence is a strict liability offence (s 22(3)). Separately, subsection 22(4) provides that a contravention of subsection (2) is also a civil penalty offence, with a civil penalty set at 50 penalty units. Therefore failure to obey an instruction exposes a master to both criminal sanction and a civil penalty, each of the same quantum.
• Failure to provide requested information: The Order states in the note to s 22(1) that section 215 of the Navigation Act makes it an offence not to comply with a request under subsection (1) to give a report or information to a VTS provider. The Order itself specifies the categories of information a master may be required to provide (s 22(1)(a)-(h)).

Administrative enforcement by AMSA

• Audit powers: AMSA may conduct audits to assess whether applicants or holders satisfy the capability requirements and are complying with conditions (ss 13(1), 21(1)). Audits may review all aspects of operations relevant to provision of VTS or delivery of courses (ss 13(2), 21(2)). During audits, holders must comply with reasonable AMSA requests (ss 7(1)(d), 16(1)(d)).
• Suspension and cancellation: AMSA may suspend or cancel an instrument of authority or a certificate of accreditation if it considers that a condition has not been complied with (ss 11(1), 20(1)). AMSA may also cancel if the holder voluntarily returns the instrument or certificate for cancellation (ss 11(2), 20(2)).
• Amendment: AMSA may amend instruments or certificates on its own initiative to change or add conditions, update details, or include other necessary matters (ss 10(1), 19(1)). Note examples include amendment following identification of a major non-conformance in an audit.
• Fees: AMSA may charge a fee for the conduct of an audit under section 47 of the AMSA Act, as noted in ss 13 and 21.

Procedural checks and review

• Notice and consultation: For AMSA-initiated amendments, AMSA must give written notice of the proposed amendment and seek comments within a stated period of less than 90 days from anyone AMSA considers may have an interest, and must consider comments received (ss 10(4)-(5), 19(4)-(5)).
• Reviewable decisions: Decisions to amend an instrument of authority or certificate of accreditation on AMSA’s own initiative, and decisions to suspend or cancel the same, are reviewable under section 17 of Marine Order 1 (s 10(7), s 11(3), s 19(7), s 20(3)). The Order repeatedly cross-references Marine Order 1 for broader application and review rules.

Enforcement scope and reach

• Coverage of vessels: The note under s 22 reminds that Part 6 of the Navigation Act applies to all vessels including regulated Australian vessels, foreign vessels, domestic commercial vessels and recreational vessels, per s 212 of the Navigation Act. That means the enforcement provisions for masters are applicable across a wide set of vessels.
• Dual pathways: The text creates both criminal liability (strict liability offences) and civil penalty liability for the same substantive breach (failure to obey a VTS instruction), which provides parallel enforcement mechanisms that the regulator or prosecuting authority may choose between or pursue in tandem.

Practical enforcement implications

• Quantum of penalty: The fixed penalty in the Order is 50 penalty units, which should be cross-checked against the applicable penalty unit value when assessing monetary exposure.
• Audit-leading-to-amendment pipeline: The Order explicitly contemplates audits identifying major non-conformances and triggering AMSA-initiated amendments or other administration (notes to ss 10 and 19). This creates an enforcement pathway where operational shortcomings discovered in audits can be addressed administratively through modified conditions, suspension or cancellation.
• Strict liability: The strict liability character of the offence for non-compliance with an instruction narrows available defences, which shifts evidential risks onto the accused master.

In sum, the Order combines administrative oversight, audit-enabled enforcement and statutory sanctions for masters, containing procedural rights to comment and review while granting AMSA a broad toolbox to correct or remove non-compliant authorisations and accreditations.

Marine Order 64 is not standalone; it operates as an instrument under the Navigation Act 2012 and expressly ties domestic obligations to international instruments, national marine orders and other statutory regimes. The Order cross-references and relies on multiple legal instruments and bodies.

Navigation Act 2012

• Source power and statutory context: The Order is made under subsection 342(1) of the Navigation Act, and s 3 of the Order lists relevant Navigation Act provisions authorising its making, including s 213 for regulations about vessel traffic services, paragraph 340(1)(a) for giving effect to SOLAS, and s 341(1) for imposing penalties (s 3(1)(a)-(c)). Subsection 339(1) is also identified as enabling prescription of matters necessary or convenient for giving effect to the Act (s 3(2)). Marine Order 1 is applied for procedural matters as noted across the Order.
• Part 6 application to all vessels: The note under s 22 states that Part 6 of the Navigation Act applies to all vessels, including regulated Australian vessels, foreign vessels, domestic commercial vessels and recreational vessels (referring to s 212 of the Navigation Act). This situates the Order’s obligations within the broader Navigation Act coverage.

IMO / SOLAS / IALA

• SOLAS implementation: The Order’s stated purpose is to give effect to Regulation 12 of Chapter V of SOLAS (s 2). The Order operationalises SOLAS obligations by mandating compliance with the IMO-adopted Guidelines and IALA standards.
• Guidelines: The Guidelines for Vessel Traffic Services adopted by IMO Resolution A.1158(32) are explicitly referenced and AMSA is designated the competent authority for the Guidelines (s 4(2)). The Order requires VTS providers to operate in accordance with the Guidelines as if mandatory (s 7(1)(a)), and AMSA must consider certain responsibilities noted in paragraph 5.3 of the Guidelines when issuing instruments (s 6(b), s 5(3)(c)).
• IALA Standards: The Order requires adherence to the normative provisions of IALA Standards S1010, S1040, S1050 and S1070 in authorising providers and accrediting training organisations (ss 6(c), 7(1)(c), 15(b), 16(1)(a)). The Order notes that "normative provisions" are those required to be adopted by a member state to achieve compliance with the standard.

Marine Order 1 (Administration) 2013

• Application and review procedures: Marine Order 1 provides general application rules, approved forms, and review rights under its sections 17 and 18. The Order repeatedly requires applications to be in accordance with Marine Order 1 (s 5(2), s 12(2), s 14(2), s 15 note 3), and notes that decisions made in accordance with the application process are reviewable under Marine Order 1 (notes to ss 6, 12, 15, and explicit references to ss 17-18 in ss 10(7) and 19(7)). Therefore procedural fairness, forms and review avenues are frame-worked by Marine Order 1.

AMSA Act

• Fees for audits: The notes to ss 13 and 21 reference s 47 of the AMSA Act as permitting AMSA to charge fees for audits the Order authorises. That imports the financial management and fee-setting regime of the AMSA Act.

Other regulatory registries

• Registered training organisations: The Order defines "registered training organisation" by reference to registration with the Australian Skills Quality Authority, the Victorian Registration and Qualifications Authority, or the Training Accreditation Council, Western Australia (s 4). This links the Order to national and state RTO regulatory frameworks for eligibility to be accredited as a VTS training organisation.

Criminal and civil penalty regimes

• Navigation Act offences: The Order relies on offences and enforcement in the Navigation Act, including that failure to respond to a request to provide information is an offence under s 215 of the Navigation Act (note to s 22(1)). The Order itself creates an offence for failure to obey VTS instructions and a civil penalty for the same conduct (s 22).

International documents and access

• Availability and amendments: The Order notes how to obtain copies of IMO Resolutions and IALA documents via AMSA’s website (s 4 notes). It also links operation to international documents as amended from time to time, which means compliance obligations can change with international standard updates.

Transitional continuity

• Repeal of older Marine Order: The 2013 Order is repealed (s 1B), however transitional provisions treat pending applications under the 2013 Order as applications under this Order (s 23) and existing instruments and certificates in force on 30 June 2022 continue under the new Order (s 24). That preserves legal continuity and avoids gaps in authorisations.

In short, the Order functions as a domestication vehicle for SOLAS Regulation V requirements, ties domestic regulatory design to IMO Guidelines and IALA normative standards, uses Marine Order 1 for procedure and review, leverages AMSA Act authority for fees, and interacts with RTO regulatory frameworks. Compliance therefore requires actors to track both domestic marine orders and international standards incorporated by reference.

The text of the Marine Order itself documents a minimal domestic amendment history within the instrument. Key dates and changes present in the Order are as follows.

Enactment and commencement

• The Order is signed by Michael Kinley, Chief Executive Officer of AMSA, and dated 26 May 2022 at the front of the instrument. The Order commences on 1 July 2022 (s 1A). That is the operative commencement date at which its provisions apply.

Repeal and replacement

• The Order expressly repeals Marine Order 64 (Vessel traffic services) 2013 (s 1B). This indicates a replacement of the 2013 instrument with the 2022 instrument, with transitional and savings provisions provided to preserve continuity for pending applications and existing instruments and certificates (ss 23-24).

Transitional provisions

• Applications made under the 2013 Order before 1 July 2022 that were not decided before that date are taken to be applications to which this new Order applies (s 23(1)-(2)). This transitional rule migrates live applications from the earlier framework into the new one.
• Instruments of authority and certificates of accreditation in effect on 30 June 2022 are preserved and continue in effect under the new Marine Order (s 24(1)-(2)). This is a standard saving provision that avoids immediate disruption to existing VTS providers and training organisations.

Notes on iterative standards

• The Order incorporates international documents “as amended from time to time” for the IALA Standards S1010, S1040, S1050, S1070 and the IMO Guidelines (s 4 definitions). That means the substantive operational content may change over time as those external documents are updated, without needing an immediate amendment to the Marine Order itself. AMSA is designated as the competent authority for the Guidelines (s 4(2)), which indicates AMSA’s ongoing role in interpreting and applying evolving guidance.

Internal amendment mechanisms

• The Order contains procedures that allow AMSA to amend instruments of authority and certificates of accreditation on its own initiative or on application by the holder (ss 10, 19). It also requires AMSA to give written notice and seek comments for proposed amendments and to consider comments received (ss 10(4)-(5), 19(4)-(5)). These mechanisms create a governance path for iterative changes to individual authorisations and accreditations without amending the Marine Order itself.

No further legislative amendment record within the text

• The instrument does not record any earlier amendments to itself, nor does it list a history of prior modifications beyond the repeal of the 2013 Order. Therefore, the concrete amendment history contained in the instrument is the replacement of the 2013 Order by the 2022 Order, its signing date and commencement date, and the transitional and savings arrangements.

Practical note on evolving obligations

• Because the Order refers to external documents that may be amended, regulated entities should not treat the Order as static; compliance duties may effectively change as IALA standards and IMO Guidelines evolve. The Order’s internal amendment and review processes, and AMSA’s competent-authority role, create administrative mechanisms to adapt to such evolution without parliamentary amendment to the Marine Order itself.

In summary, the domestic amendment history in the instrument is limited to the 2022 replacement of the 2013 Order, with enacted transitional provisions; operationally, the Order delegates adaptability to the external standards and to AMSA-administered amendment procedures for individual instruments and certificates.

The Marine Order text does not record any litigation or case law. The instrument contains no references to judicial decisions, appeals, or precedent that has interpreted its provisions. It does, however, create reviewable administrative decision pathways that could give rise to litigation.

Reviewable decisions and potential for judicial review

• The Order identifies certain AMSA decisions as reviewable under section 17 of Marine Order 1, and repeatedly cross-references Marine Order 1 sections 17 and 18 as providing for the review of decisions made in accordance with the application process (notes to ss 6, 12, 15; ss 10(7), 19(7), 11(3), 20(3)). That creates an administrative review route for affected applicants or holders to challenge decisions such as AMSA-initiated amendments, suspensions and cancellations.
• Because Marine Order 1 sets out the review procedure, and the Navigation Act provides the statutory framework, any appeal from an administrative reviewable decision could progress to judicial review in the courts on conventional administrative law grounds. The Order itself does not specify the scope of review or the tribunal or court in which reviews or appeals lie; practitioners must consult Marine Order 1 and the Navigation Act for procedural and jurisdictional detail.

Potential litigation subjects

• Decisions likely to generate disputes, and therefore potential litigation, include AMSA’s refusals to issue an instrument of authority or certificate of accreditation, AMSA-initiated amendments to conditions, or suspensions and cancellations based on alleged non-compliance discovered in audits (ss 6, 10, 11, 15, 19, 20).
• Enforcement against masters under s 22 for failing to obey VTS instructions could lead to criminal prosecutions or civil penalty proceedings, where defendants may challenge evidential bases, strict liability character, or factual elements of the alleged non-compliance.

No cases named in the instrument

• The instrument does not name any cases or judicial interpretations. The text’s references to review procedures are administrative in nature.

Practical implication for practitioners

• Although the instrument does not yet reflect litigation history, the presence of reviewable decisions, audit-driven corrective processes, and overlapping civil and criminal enforcement pathways (for example s 22) mean that regulated entities should anticipate administrative contests and potential court involvement. Advisers should plan for timely use of Marine Order 1 review processes where AMSA exercises its discretionary powers, and for criminal or civil litigation strategies in the event of enforcement under s 22 or under the Navigation Act.

In the absence of any reported litigation within the instrument, current advice must be derived from the statutory text, the connected Marine Order 1 review framework, and general principles of administrative and maritime law rather than from domestic precedent specific to this Order.

The Order contains several provisions and drafting choices that create discrete practical risks, compliance traps and administrative consequences. These are the concrete "gotchas" that practitioners and operators should watch.

"Operate in accordance with the Guidelines as if mandatory" (s 7(1)(a))

• The Order explicitly requires VTS providers to operate in accordance with the IMO-adopted Guidelines as if they were mandatory. Although the Guidelines are technically guidance, the Order gives them mandatory effect for holders. This means that informal reliance on the Guidelines as mere best practice will not insulate providers from enforcement; non-conformance can be a basis for amendment, suspension or cancellation (ss 7, 10, 11).

Normative IALA provisions are required (ss 6(c), 7(1)(c), 15(b), 16(1)(a))

• The Order repeatedly distinguishes "normative provisions" in the IALA standards as those that must be adopted to achieve compliance. Applicants and holders must therefore identify and demonstrate compliance with those normative provisions. Failure to do so is a trigger for AMSA's refusal to issue, or for later enforcement action.

Dual liability for disobeying instructions (s 22(2)-(4))

• A master who fails to obey a VTS instruction faces both a strict liability criminal offence and a separate civil penalty, each at 50 penalty units. The strict liability designation narrows defences and shifts evidential burdens. The risk is compounded where prosecutorial or regulatory actors may elect either or both enforcement tracks.

Strict timelines for continuity (s 9(3))

• A VTS provider must apply for renewal at least 90 days before the instrument expires to ensure continuity. Missing this window could risk service interruption or a gap in authority, with operational and legal consequences.

AMSA's broad unilateral amendment powers (ss 10(1), 19(1))

• AMSA may amend instruments or certificates on its own initiative to change or add conditions, or to include necessary details. While AMSA must give notice and seek comments where it proposes an amendment (ss 10(4)-(5), 19(4)-(5)), the timeframe for seeking comments is "less than 90 days", which could be short for complex stakeholder arrangements. Additionally, an amendment following an audit's identification of a major non-conformance may materially change operational obligations.

Audit fees (notes to ss 13 and 21)

• AMSA may charge a fee for audits under s 47 of the AMSA Act. Audited organisations should budget for potential fees. The Order does not set the fee quantum, which is governed by the AMSA Act and AMSA policy.

RTO renewal obligation for VTS training organisations (s 16(1)(b)-(c))

• Accredited VTS training organisations must renew their RTO registration annually and show evidence to AMSA each year. Loss of RTO registration could jeopardise the certificate of accreditation, and the requirement to provide annual evidence imposes an administrative burden and the risk of non-compliance if renewals are missed.

External standards changeability

• The Order incorporates IALA Standards and the IMO Guidelines as amended from time to time. That means substantive obligations may change without amendment to the Marine Order itself. Operators must monitor developments in the international instruments; failure to do so is a compliance risk.

Application form and Marine Order 1 requirements (multiple sections)

• Applications must follow Marine Order 1 and approved forms. Failure to use approved forms or follow Marine Order 1 procedures may render an application invalid or delay processing.

Coverage of all vessels (note under s 22)

• Part 6 applies to all vessels including foreign and recreational vessels. Operators who previously thought VTS obligations were limited to commercial vessels should reassess exposure.

Limited judicial history and administrative discretion

• The instrument contains no litigation history. That leaves uncertainty on how courts will interpret overlapping civil and criminal liabilities, the scope of "reasonable requests" in audits, or the precise boundary of "normative provisions". Parties must be prepared to test those questions in administrative review or litigation.

Recordkeeping and evidence capture

• Given strict liability offences and audit powers, regulated entities and masters should ensure robust recordkeeping of instructions received, reports made to VTS providers, training records, and RTO renewals, because documentary evidence is likely to be decisive in enforcement or review.

In sum, the gotchas are concentrated around the mandatory effect of guidance and international standards, the twin civil/criminal exposure for masters, AMSA's unilateral amendment and audit powers, the administrative burdens on RTOs and providers, and the need to monitor evolving international normative texts.

This section translates the Order’s prescribed duties into a practical compliance roadmap for applicants, VTS providers, VTS training organisations, masters and advisers.

For applicants seeking an instrument of authority (s 5)

• Use the approved form required by Marine Order 1, available on AMSA’s website, and follow Marine Order 1 application rules (s 5(2); note to s 5). Ensure the application includes: a clear description of the proposed VTS area (s 5(3)(a)); detailed operational objectives showing how the VTS will enhance safety, efficiency and environmental protection (s 5(3)(b)); an explicit statement of how responsibilities in paragraph 5.3 of the Guidelines will be met (s 5(3)(c)); and all documents required in the approved form (s 5(3)(d)). Prepare to be audited by AMSA to evidence capability (see s 6 note and s 13).
• Map proposed operations to the normative provisions of IALA Standards S1010, S1040, S1050 and S1070, and prepare a compliance table cross-referencing each normative clause to policy, procedures, equipment and staffing. Include internal procedures to implement the Guidelines as if mandatory (s 7(1)(a)).

For holding and operating as a VTS provider (ss 6-12)

• Establish operations strictly in accordance with the Guidelines and the normative provisions of the listed IALA standards (s 7(1)(a)-(c)). Maintain written procedures that demonstrate compliance with each normative provision and with paragraph 5.3 responsibilities.
• Be audit-ready: designate a compliance officer, maintain up-to-date operational manuals, incident logs, training records and equipment certification, and respond promptly to AMSA audit requests (s 7(1)(d), s 13). Budget for potential audit fees under s 47 of the AMSA Act (note to s 13).
• Manage authorisation lifecycle: note instruments commence on the day issued and expire at the earlier of 5 years or cancellation (s 9(1)). Apply for renewal at least 90 days before expiry to ensure continuity (s 9(3)).
• If intending to conduct recurrent training in-house, apply to AMSA under s 12 using Marine Order 1 procedures, and be prepared to demonstrate capability to conduct the IALA model course V-103/5.

For VTS training organisations seeking accreditation (ss 14-20)

• Ensure RTO registration is current with one of the prescribed registries and include proof in the application (s 14(3)(a)). State proposed courses and map course content to normative provisions of IALA S1050 (s 14(3)(b)-(c), s 15(b)).
• After accreditation, maintain annual RTO registration and supply evidence to AMSA each year (s 16(1)(b)-(c)). Implement quality assurance processes aligned with both national RTO standards and the IALA normative provisions.
• Prepare for audits of course delivery and records, and respond to reasonable AMSA requests during audits (s 16(1)(d), s 21).

For masters and vessel operators (s 22)

• Train masters and bridge teams on the specific information categories AMSA permits VTS providers to request (s 22(1)(a)-(h)), and on the obligation to provide requested reports promptly. Implement on-board checklists to ensure accurate and timely responses.
• Establish procedures for receiving, recording and executing VTS instructions. Because failure to obey a VTS instruction is both a strict liability offence and attracts a civil penalty (s 22(2)-(4)), every instruction should be logged, and compliance steps documented. If an instruction is unsafe, document reasons and immediate actions taken, and notify AMSA/VTS without delay, preserving contemporaneous evidence.

Governance, documentation and monitoring

• Maintain an up-to-date compliance manual mapping every regulatory requirement in the Order to internal policy, responsible officers and documentary evidence.
• Monitor amendments to the IMO Guidelines and the IALA standards, because the Order incorporates these documents "as amended from time to time" (s 4 definitions). Assign responsibility to a compliance or standards officer to track updates and implement changes.
• Keep a forward calendar for instrument/certificate expiry, audit schedules, RTO renewal dates and AMSA consultation periods for proposed amendments, to ensure timely responses and continuity of authority (s 9(3), s 16(1)(b)-(c), ss 10(4), 19(4)).

Engagement and dispute preparedness

• On AMSA consultation about proposed amendments, respond within the stated period (less than 90 days) and provide evidence-based submissions demonstrating consistency with safety, efficiency and environmental protection (ss 10(4)-(6), 19(4)-(6)).
• If AMSA initiates an amendment or suspends/cancels an instrument or certificate, consider immediate use of the review procedures in Marine Order 1 (refs throughout the Order), and preserve audit and operational materials to support review or litigation.

Practical risk management

• Budget for potential audit fees and compliance costs, including staff training, equipment updates, and documentation systems.
• Implement robust records management to capture VTS interactions and training records, because strict liability offences and audits rely on documentary evidence.
• For training organisations, ensure alignment between national RTO compliance obligations and the additional requirements of IALA normative provisions, and maintain annual evidence trails for AMSA review.

Following these steps will not guarantee immunity from enforcement, but they align operational practice with the specific requirements and procedural expectations set out in Marine Order 64 (Vessel traffic services) 2022, and position applicants and holders to respond effectively to AMSA audits and administrative processes.
