Marine Order 63 (Vessel reporting systems) 2019

The Order rests on a small set of legal and operational concepts defined in the instrument and imported from international instruments and the Navigation Act.

MASTREP and REEFREP areas: The two geographic regimes are central. MASTREP is defined as the area for which JRCC Australia is responsible, described in the IMO GISIS Radiocommunications and Search and Rescue module, and visually set out in Schedule 1, see clause 4 (definition of MASTREP area) and Schedule 1. The REEFREP area is the area for the mandatory ship reporting system mentioned in IMO Resolution MSC.52(66) and shown in Schedule 2, see clause 4 (definition of REEFREP area) and Schedule 2. Clause 9 expressly prescribes both areas for the Navigation Act definition of prescribed area.

Master obligation: The operative duty language in both main reporting provisions is framed as an obligation on the master of the vessel, not the owner or operator. Clause 7(1) requires the master in the MASTREP area to ensure reports are transmitted in accordance with Schedule 3. Clause 8(1) requires the master in or entering the REEFREP area to ensure reports are made to REEFVTS in accordance with Schedule 4. The text therefore places primary operational responsibility on the vessel master.

Strict liability and civil penalty: Both reporting provisions make non-compliance a strict liability offence (clauses 7(2) and 8(2)) and expose the person in breach to civil penalty liability of 50 penalty units (clauses 7(3) and 8(3)). The instrument distinguishes criminal-style strict liability offences from civil penalty liability under the Navigation Act framework and provides both as potential enforcement tools.

Report content and methods: The Schedules set the required report content and methods. Schedule 3 requires position reports via AIS (cl 2(1)), listing identity, type, position, course, speed and navigational status (cl 1). If AIS malfunctions or is switched off for safety or security the Schedule prescribes manual reporting by VHF or other means requested by JRCC Australia, hourly or as required, and specifies additional content (Schedule 3 cl 2(3)). Schedule 4 contains a more elaborate set of report types for REEFREP: Entry Report (at least one hour before entry or departure, Schedule 4 cl 1), Route Deviation Report (within 15 minutes, cl 2), Position Reports (AIS by default, cl 3), Defect Reports (mandatory for specified events, cl 4), and Final Reports on exit or arrival (cl 5). Schedule 4 cl 6 lists permitted transmission methods (AIS, recognised mobile satellite service, VHF channels by latitude table, telephone, fax, email) and requires English.

Interplay with SOLAS and IMO guidance: The Order does not stand alone. It cross-references SOLAS requirements, for example requiring AIS operation in accordance with Regulation 19.2.4.7 of Chapter V of SOLAS (Schedule 3 cl 2(2) and Schedule 4 cl 3(2)). The Order notes that the MASTREP area description and REEFREP area description may be amended over time via IMO GISIS and refers readers to AMSA and other guidance documents such as the MASTREP and Australian Mandatory Reporting Guide and the REEFVTS User Guide (Schedule notes).

Geographic reference standard: Clause 5 establishes that geographic positions are referenced to WGS84. That affects the format and datum of all latitude/longitude reporting.

Towing and “length of tow”: The Order defines length of tow and includes towing in the REEFREP coverage conditionally when either the towing or the towed vessel is otherwise reportable or the length of tow is 150 metres or longer (clause 4 definition and clause 6(2)(f)).

Prescribed area linkage: Clause 9 ties the two reporting areas into the statutory notion of prescribed area under subsection 221(3) of the Navigation Act 2012, which is relevant to other Navigation Act provisions that depend on “prescribed area”.

These main concepts set the substantive and jurisdictional perimeter for obligations, determine who is the immediate addressee of duties, and connect the Order to international obligations and existing AMSA authorisations such as REEFVTS under Marine Order 64 (referenced in clause 4 definition of REEFVTS).

The Order applies to different groups in different ways, and those distinctions matter for compliance cost, risk allocation, and operational changes.

Masters of vessels: The immediate legal duty is on the master. Clauses 7(1) and 8(1) state that the master must ensure reports are transmitted or made in accordance with the relevant Schedule. The master therefore bears primary operational responsibility for timing, content and transmission of reports specified in Schedules 3 and 4.

Foreign vessels: Clause 6(1)(b) extends MASTREP coverage to foreign vessels from their arrival at their first port in Australia until departure from their final port. That means commercial foreign-flagged ships entering Australian ports are within the MASTREP reporting regime for the entirety of their time between first arrival and final departure in Australia, which places reporting obligations on masters of foreign vessels while in Australian territorial waters and the MASTREP area.

Regulated Australian vessels: Clause 6(1)(a) includes regulated Australian vessels in the MASTREP area. The definition of regulated Australian vessel is in the Navigation Act and is not reproduced in this Order, but the inclusion makes domestic vessels subject to MASTREP when they meet the Navigation Act definitions. The Order also contains a note encouraging domestic commercial vessels fitted with GMDSS and AIS to participate.

Vessels meeting REEFREP thresholds: Clause 6(2) identifies vessel types and thresholds that trigger REEFREP coverage: vessels 50 metres or longer, oil tankers, chemical tankers, any vessel carrying at least 200 cubic metres of oil (cargo or fuel), INF Code vessels, and certain towing operations. Owners and operators of these vessel types must ensure masters comply with REEFREP reporting.

Towing operations: Where the length of tow is 150 metres or longer, or one of the vessels in the towing pair meets other REEFREP thresholds, the towing operation is within scope. The Order defines length of tow and requires reporting when those criteria are satisfied (clause 4 definition; clause 6(2)(f)). Owners or masters involved in towage must therefore treat tow length and vessel types as triggers.

REEFVTS and JRCC Australia: These agencies or services are the recipients and operational managers of reporting. Schedule 4 requires reports to REEFVTS and provides REEFVTS with discretion to request alternative communication methods and to set standard route plans (clause 1 note and cl 6). Clause 4 defines JRCC Australia as AMSA’s Joint Rescue Coordination Centre responsible for search and rescue across the Australian search and rescue region; MASTREP reports are coordinated via JRCC Australia.

Ship owners and operators: Although the immediate statutory obligation falls on the master, the Order separately exposes “a person” to civil penalty liability for contravening the master’s reporting duties (clauses 7(3) and 8(3)). The term “a person” is broad and may capture owners, charterers, operators or others depending on circumstances and enforcement practice. Owners and operators therefore face indirect liabilities and compliance duties, including equipment provision and crew training.

Equipment suppliers and maintenance providers: The operational rules require vessels to have functioning AIS, and reference recognised mobile satellite services. Suppliers and maintenance providers will face demand for installation, testing, and maintenance to ensure AIS and satellite systems meet SOLAS and IMO standards referenced in Schedule 3 and 4.

Third party service providers: REEFVTS is authorised under Marine Order 64 and listed in clause 4; REEFVTS’s User Guide and the AMSA MASTREP guide are referenced. Those documents and services will be operational actors receiving reports, holding route plans, and issuing requests. Users will interact with those administrative systems and queue times, and compliance may require registering with REEFVTS or using its specified channels.

Regulatory and enforcement agencies: AMSA is the making authority and will have roles in guidance, monitoring and enforcement. Clause 3 links the power for the Marine Order to provisions in the Navigation Act that allow regulation of foreign and regulated Australian vessels, implementation of SOLAS and imposing penalties. The Order itself does not lay out enforcement procedure beyond penalties, but enforcement responsibility will sit with agencies given powers under the Navigation Act and related statutes.

Stakeholders not directly regulated but affected operationally: Ports, pilots and coastal managers can expect increased transmission of vessel movement data into JRCC and REEFVTS systems, which may influence traffic management and response planning. Owners of smaller domestic vessels not mandated for MASTREP are nonetheless encouraged to participate when fitted with GMDSS and AIS.

In short, masters are the immediate duty-bearers, owners and operators bear secondary exposure via civil penalties, and a defined set of vessel types and operations are brought into the reporting systems. The Order creates interaction points between vessel crews and AMSA-run or authorised services (JRCC Australia and REEFVTS) and links domestic statutory duty to international SOLAS/SAR obligations.

The Order specifies a compact set of duties, procedural requirements, permitted methods, and rights to operate AIS in safety or security situations. These are concrete and prescriptive.

Master’s duties: The principal duty is on the master to ensure required reports are transmitted or made. For MASTREP, clause 7(1) requires the master to ensure reports are transmitted in accordance with Schedule 3. For REEFREP, clause 8(1) requires the master to ensure reports are made to REEFVTS in accordance with Schedule 4.

Report content and timing: Schedule 3 requires the AIS-generated position report to contain identity, type, position, course, speed and navigational status (Schedule 3 cl 1). Schedule 4 requires specific content for the Entry Report (vessel identifiers, UTC date/time, current position, ETA into REEFREP area, last and next ports and route, speed, draught fore and aft, anticipated exit position, satellite equipment details where fitted, cargo details including hazardous classification, and vessel particulars including length and gross tonnage), see Schedule 4 cl 1(2). Route Deviation Reports must be made within 15 minutes of deviation, see Schedule 4 cl 2. Position Reports must be given while transiting REEFREP, using AIS unless AIS is unavailable, see Schedule 4 cl 3. Defect Reports are required for damage, failure or breakdown that affect safety or cause deviation, and must include detailed descriptions and recognised IMO reporting formats where relevant, see Schedule 4 cl 4. Final Reports must be given on exit from the REEFREP area and on arrival at a port, see Schedule 4 cl 5.

Permitted transmission methods: Schedule 4 cl 6 provides permitted methods: AIS, recognised mobile satellite service, VHF Radiotelephone (on specified channels according to latitude), telephone number +61 1300 721 293, fax number +61 7 4721 0633, and email reefvts@vtm.qld.gov.au. Schedule 3 requires AIS as the standard for position reporting and prescribes manual alternatives if AIS malfunctions or is switched off for safety or security reasons, see Schedule 3 cl 2(1)-(3).

AIS operation obligations and permitted switching off: The Order requires AIS to be operated in accordance with SOLAS Reg 19.2.4.7, which, as the Order notes, takes into account IMO guidelines on onboard operational use (see Schedule 3 cl 2(2) and notes). However, the Order recognises circumstances where AIS may malfunction or the master may switch it off for safety or security reasons; in those circumstances Schedule 3 cl 2(3) and Schedule 4 cl 3(4) require manual reporting hourly or as required by JRCC Australia or REEFVTS, and specify mandatory content for those manual reports.

Language and datum: Schedule 4 cl 6(3) requires reports be in English using the IMO Standard Marine Communications Phrases. Clause 5 requires geographic positions to be referenced to WGS84. These are mandatory formatting and language duties which create precise communication standards.

Rights implicit in the Order: The Order gives operational agencies (JRCC Australia and REEFVTS) express discretion to request alternate means of communication if AIS malfunctions or the master switches off AIS for safety/security reasons (Schedule 3 cl 2(3)(a)(ii); Schedule 4 cl 3(4)(a)(ii)). REEFVTS may also prescribe standard route plans and accept deviations with reporting; the Order notes that standard route plans are set out in the REEFVTS User Guide and that REEFVTS is operational 24 hours a day (Schedule 4 cl 1 note; cl 6(1) notes). Masters therefore have the right to follow directions from JRCC Australia or REEFVTS concerning alternative reporting.

Reporting records and logbook entries: Schedule 4 cl 6(4) requires entries in the vessel’s radio log book for radio equipment failure, and in the vessel’s official logbook for other equipment failure, when failure prevents reporting. That duty creates a contemporaneous record requirement for equipment failures affecting reporting.

Criminal and civil risk: Non-compliance is a strict liability offence (clauses 7(2) and 8(2)) and attracts a penalty of 50 penalty units (clauses 7(1) and 8(1)), and the same contravention exposes “a person” to a civil penalty of 50 penalty units (clauses 7(3) and 8(3)). The Order therefore creates both criminal-style strict liability exposure and a civil penalty regime for reporting breaches.

Duty to use specific channels by latitude: Schedule 4 cl 6(1)(c) contains a table mapping latitude bands to VHF channels for manual VHF reporting. Masters using VHF must use the specified channel for their current latitude band. The Order expects masters to know or determine their latitude band and select the right VHF channel.

Interaction with other statutory duties: The Defect Report requirement in Schedule 4 cl 4(1)(c) links back to reporting duties under the Navigation Act and the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 by requiring Defect Reports when a vessel is required under those Acts to report safety-related information or incidents involving dangerous goods, harmful substances or marine pollutants.

Scope limits and encouragement: The Order limits mandatory MASTREP coverage to regulated Australian vessels and foreign vessels as specified, but includes a note encouraging domestic commercial vessels fitted with GMDSS and AIS to participate even when not mandatory (clause 6(1) note). That is a non-binding encouragement, not a statutory duty.

In sum, the Order imposes precise operational duties on masters and creates both criminal and civil enforcement exposure, while granting reporting authorities discrete operational discretion to request alternative communications and to rely on complementary statutory reporting duties under other Acts.

The Marine Order creates specific sanctioning mechanics centred on strict liability offences and separate civil penalty exposure. Enforcement mechanisms are not elaborated in procedural detail in the instrument, but the statutory placement indicates how liability is structured.

Penalty quantum: Clauses 7(1) and 8(1) each specify a penalty of 50 penalty units for contravention of the master’s reporting duty. The instrument does not define the monetary value of a penalty unit; that value is set in other Commonwealth legislation. The Order therefore fixes the penalty in units, which is common parliamentary drafting practice.

Strict liability criminal offence: Clauses 7(2) and 8(2) declare that an offence against the provisions requiring reporting is a strict liability offence. That means for criminal prosecution the prosecution need not prove fault elements such as intention or negligence; proof of the physical elements of the offence is sufficient, subject to any statutory defences. The Order does not specify defences, so criminal prosecution would follow usual principles applicable to strict liability offences in Australian law and the Navigation Act enforcement regime.

Civil penalty liability: Clauses 7(3) and 8(3) provide that “a person is liable to a civil penalty if the person contravenes subsection (1)”. The civil penalty amount is 50 penalty units. The Order does not specify the enforcement agency or process for civil penalty proceedings; that is handled under the Navigation Act or general civil penalty enforcement mechanisms. The instrument therefore creates parallel enforcement avenues: criminal prosecution for strict liability offences and civil penalty proceedings for the same or similar conduct.

Enforcement posture and actors: The Order itself does not describe investigative powers, notice mechanisms, or administrative processes. Clause 3 ties the power to make the Order to sections of the Navigation Act that authorise penalties and give effect to SOLAS. Enforcement action will therefore be taken under the Navigation Act framework and any enforcement powers in AMSA’s enabling statutes. The Order names JRCC Australia and REEFVTS as operational recipients and coordinators of reports. Those bodies will be the front-line receivers of compliance information and will likely generate referrals to enforcement authorities where breaches are detected, but the Order does not specify administrative sanctions such as directions, warnings or infringement notices.

Strict liability and master’s role: Because the duty is personally placed on the master, strict liability status increases the exposure of masters to criminal sanction. The Order also exposes “a person” to civil penalties, which could include owners or operators depending on how regulators choose to proceed. Masters should be aware that strict liability reduces the prosecution’s evidentiary burden regarding state of mind; consequently proving compliance or relying on statutory exceptions or exigent circumstances will be practically important.

Operational enforcement triggers: The Order provides practical ways enforcement could be triggered. Examples include: failing to transmit AIS position reports while in the MASTREP area absent an AIS malfunction entry in the radio or official logbook with required information; failure to submit an Entry Report to REEFVTS at least one hour prior to entry or departure within the REEFREP area; failure to notify REEFVTS within 15 minutes of a route deviation; failure to submit a Defect Report where damage or breakdown has occurred; or failure to submit a Final Report on exit or arrival. Each of those contraventions is expressly captured in the Schedules and would be the basis for enforcement.

Record-keeping as evidentiary protection: The Order requires logbook entries when equipment failure prevents reporting (Schedule 4 cl 6(4)). Those entries function as contemporaneous records that could be used to establish a defence or explain a failure to report. Proper logbook practice therefore reduces enforcement risk.

Discretionary operational measures: The Order authorises JRCC Australia and REEFVTS to request alternative communications and to set route plans. Those operational decisions may affect enforcement outcomes by changing what constitutes compliance in a given incident, for example by validating a master’s use of a requested communication method.

Limitations in the Order: The Order does not provide detailed enforcement procedure, infringement notice schedules, or administrative penalty processes. It leaves enforcement mechanics to the Navigation Act framework and standard prosecutorial and civil penalty processes. Practitioners therefore must look to the Navigation Act and AMSA enforcement policies for procedural detail.

In short, the Order makes reporting failures criminal offences of strict liability and separately civilly actionable at a fixed penalty unit level. Enforcement will be operationalised through AMSA and related agencies, with JRCC Australia and REEFVTS as the operational nodes that receive reports and will likely generate compliance referrals.

The Marine Order is explicitly constructed as an instrument implementing international conventions and as a subordinate instrument under the Navigation Act. Its provisions create intersections with SOLAS, the SAR Convention, MARPOL, the Navigation Act itself, and the Protection of the Sea (Prevention of Pollution from Ships) Act 1983. The text identifies several specific interactions.

Navigation Act 2012: Clause 3 cites sections of the Navigation Act that authorise the Marine Order: section 221 (allowing regulations to provide for reporting requirements for foreign vessels in prescribed areas and for regulated Australian vessels), paragraph 340(1)(a) (allowing regulations to give effect to SOLAS), subsection 341(1) (authorising imposition of penalties), subsection 339(1) (prescription of necessary matters), and subsection 342(1) (AMSA’s power to make Marine Orders about anything prescribed by the regulations). Clause 9 expressly prescribes the MASTREP and REEFREP areas for the Navigation Act definition of prescribed area (subsection 221(3)). The Order therefore functions as an instrument under the Navigation Act’s regulatory architecture and will be read alongside that Act, including its enforcement, definitions and penalty regime.

SOLAS and IMO instruments: Clause 2(1) states the Order gives effect to Chapter 5 of the SAR Convention Annex and Regulation 11 of Chapter V of SOLAS. Schedules require AIS operation in accordance with SOLAS Regulation 19.2.4.7 and refer to IMO guidance, for example the Revised guidelines for the onboard operational use of shipborne automatic identification systems (IMO Resolution A.1106(29)), see Schedule 3 cl 2(2) and Schedule 4 cl 3(2). The Order therefore imports SOLAS technical and operational standards, and compliance will require alignment with SOLAS-regulated equipment and practices.

MARPOL and other IMO codes: The Order uses definitions drawn from MARPOL and SOLAS for tankers and INF Code vessels (Schedule 4 and clause 4 definitions reference MARPOL and SOLAS). Clause 4 notes that Marine Order 1 and the Navigation Act contain additional definitions, and cross-references MARPOL annexes for oil tanker, chemical tanker definitions. Defect Reports required under Schedule 4 cl 4(1)(c) reference incidents reportable under the Navigation Act and the Protection of the Sea (Prevention of Pollution from Ships) Act 1983, linking reporting duties across safety and pollution regimes.

Marine Order 64 and state VTS regimes: Clause 4 defines REEFVTS as the service authorised under Marine Order 64 (Vessel traffic services) 2013 and known as the Great Barrier Reef and Torres Strait Vessel Traffic Service. Schedule 4 requires reports to REEFVTS and refers to the REEFVTS User Guide on Maritime Safety Queensland’s website for standard route plans. This creates an administrative interaction between federal Marine Orders and state-administered services and guidance.

Logbook and radio log requirements: Schedule 4 cl 6(4) requires entries in the vessel’s radio logbook and official logbook for equipment failure preventing reporting. Those logbook obligations will interact with other statutory logbook requirements contained in Marine Order 1 and in the Navigation Act or other maritime safety instruments.

Criminal/civil penalty frameworks: The Order’s strict liability offences and civil penalty provisions will be enforced within the Navigation Act’s civil penalty and criminal enforcement architecture. Practitioners must consult the Navigation Act and any associated regulations or AMSA enforcement policy to understand procedural aspects such as notices, evidentiary practice and appeals.

International reporting systems and databases: The Order references GISIS (the IMO Global Integrated Shipping Information System) for the MASTREP area description and allows the MASTREP area to be updated in GISIS, implying that changes to international area descriptions will flow through to the operational scope of the Marine Order (clause 4 definition of MASTREP area and notes). Similarly, references to IMO resolutions for REEFREP mean that future IMO amendments affect domestic obligations.

Protection of the Sea (Prevention of Pollution from Ships) Act 1983: Schedule 4 cl 4(1)(c) links Defect Report obligations to reporting obligations under that Act, so incidents involving dangerous goods or pollutants that are reportable under the pollution Act will also trigger REEFREP Defect Reports.

In practical terms, compliance requires coordination across instruments. Masters and operators must align vessel equipment and reporting behaviour with SOLAS AIS rules, MARPOL definitions for pollutant carriage, logbook duties under other Marine Orders, and with REEFVTS technical and procedural requirements. Regulatory and operational bodies such as AMSA, JRCC Australia, REEFVTS and Maritime Safety Queensland will each play roles in the combined legal and administrative framework. The Order does not supplant these instruments; it operates within and alongside them, importing standards and cross-referencing duties.

The instrument itself contains limited amendment history but provides two explicit temporal facts and a mechanism for future variation through referenced international instruments and GISIS.

Commencement and repeal: Clauses 1A and 1B state that the Marine Order commences on 1 January 2020 and that Marine Order 63 (Vessel reporting systems) 2015 is repealed. Those are the only explicit historical steps recorded in the text. The practical effect is that, as of 1 January 2020, the 2019 Order replaced the 2015 instrument.

Dynamic references to international instruments and GISIS: The Order repeatedly references IMO conventions and instruments “as amended from time to time”. Clause 2(1) gives effect to Chapter 5 of the SAR Convention and to SOLAS Regulation 11 “as in force from time to time”. Clause 4 defines the MASTREP area by reference to the IMO GISIS Radiocommunications and Search and Rescue module “as amended from time to time” and the REEFREP area by reference to IMO Resolution MSC.52(66), “as amended from time to time”. Those references mean the domestic instrument is designed to track international amendments without the Order itself being formally amended each time, insofar as the definitions and obligations depend on the international texts. The visual representations in Schedules 1 and 2 will change if GISIS or IMO resolutions change the described areas, although the Order itself does not set out a mechanism for updating the Schedules beyond those references.

References to other Australian Marine Orders and guidance: The Order references Marine Order 1 (Administration) 2013 for definitions and Marine Order 64 for REEFVTS authorisation. Any amendments to those Marine Orders will affect how the 2019 Order operates, since the Order imports definitions and administrative links. The Order also references external guidance documents such as the MASTREP and Australian Mandatory Reporting Guide and the REEFVTS User Guide, which are administrative materials that can be updated more readily than subordinate legislation.

No other amendments recorded in the text: The Order does not list prior modifications other than the repeal of the 2015 instrument and the commencement date. It does not include a schedule of amendments or transitional provisions beyond the repeal clause.

Practical consequence: To track changes relevant to obligations under the Order, practitioners must track three sources: (1) any future formal amendments to Marine Order 63 itself that may be made under the Navigation Act, (2) amendments to referenced Marine Orders (for definitions and REEFVTS authorisation), and (3) changes in international instruments or in GISIS or IMO Resolutions that the Order expressly imports. The Order’s “as amended from time to time” wording means certain international changes will alter operative obligations without an amending instrument being published domestically.

Finally, the Order’s notes and references point to AMSA and Maritime Safety Queensland web resources for guidance and maps, so administrative updates to those resources will be the first indications of operational changes for masters and operators. The Order’s explicit repeal of the 2015 Marine Order provides a clear cut-over date, but beyond that the Order relies on external instruments and guidance that may change over time.

The Marine Order text does not mention any cases, judicial authorisations, or litigated interpretations. It contains no citations to judicial decisions and records no litigation history. Consequently, there is no litigation history contained in the instrument itself to summarise.

What that absence means for practitioners is the following.

No reported judicial constructions to rely on: Because the Order contains no cases or litigation references, there is no judicially developed body of interpretive authority directly tied to its provisions contained within the Order. Practitioners therefore must rely on statutory drafting principles, the Navigation Act regime, and interpretive materials such as AMSA guidance or administrative decision-making practice for interpreting ambiguous clauses.

Likely future litigated issues (based on the Order’s content): While the instrument contains no case law, its structure suggests the types of disputes that could arise and thus be litigated. These include: the scope and meaning of “ensure” duties placed on masters in clauses 7 and 8; the proper interpretation of strict liability in the context of master duties and available defences; the circumstances in which AIS may legitimately be switched off for safety or security reasons and the sufficiency of manual reporting in such cases; the allocation of civil penalty liability to “a person” where masters, owners and operators have overlapping responsibilities; and the legal effect of internationally referenced and dynamically amended instruments such as GISIS area descriptions and IMO resolutions as imported by the Order.

Evidentiary and procedural questions: The Order’s reliance on strict liability offences and civil penalties could give rise to litigation over evidentiary burdens, admissibility of logs and AIS records, and the sufficiency of logbook entries required by Schedule 4 cl 6(4). Challenges may also engage procedural aspects of civil penalty enforcement under the Navigation Act.

Administrative review and merits appeal: The Order itself does not provide a statutory review mechanism for enforcement decisions made under it. Any judicial review or statutory appeal would proceed under the Navigation Act, the Administrative Decisions (Judicial Review) Act 1977 where applicable, or other relevant statutory schemes. As the Order does not supply details, practitioners must consult the Navigation Act and AMSA enforcement policy for procedural routes.

In summary, the instrument contains no litigation history. Practitioners should note the absence and be prepared for first-instance litigation to address interpretive and enforcement questions that the Order's text makes likely but does not itself resolve.

The Order is concise but contains specific operational requirements and legal traps. The following are concrete practical pitfalls that arise directly from the text.

1. Strict liability for masters, civil penalties for “a person” (clauses 7 and 8)

• The master’s reporting obligation is framed in mandatory terms, and breaches are strict liability offences (clauses 7(1)-(2) and 8(1)-(2)). Strict liability reduces the prosecution’s burden on mental elements. Separately, clause 7(3) and clause 8(3) expose “a person” to civil penalties for contravention, which may include owners or operators. Practitioners should note that criminal and civil exposures coexist.

2. AIS is mandatory for position reports but may be switched off in limited circumstances (Schedule 3 cl 2(1)-(3), Schedule 4 cl 3(1)-(4))

• The default reporting mechanism is AIS. If AIS malfunctions or the master switches it off for safety or security reasons, manual reporting obligations kick in, with specific content and hourly reporting or as required by JRCC Australia or REEFVTS. A common pitfall is assuming that switching off AIS absolves a master from reporting; it does not. The Order requires compensating manual reporting and logbook entries where relevant.

3. Timing requirements are strict and prescriptive (Schedule 4 cl 1 and cl 2)

• REEFREP Entry Reports must be made at least one hour before entry to the REEFREP area or departure from a port in it (Schedule 4 cl 1(1)). Route Deviation Reports must be made within 15 minutes of deviation (Schedule 4 cl 2(1)). These timeframes are tight and may be operationally challenging for vessels with rapidly changing conditions. Failure to meet them is a contravention.

4. VHF channel selection depends on latitude bands (Schedule 4 cl 6(1)(c))

• The Order specifies VHF channels by latitude ranges in a table. Masters using VHF must match the current latitude to the correct channel. Errors in channel selection will impede compliance and could be treated as failure to use an authorised communication method.

5. Required content can be detailed and includes cargo and satellite equipment details (Schedule 4 cl 1(2))

• The Entry Report requires cargo information including whether cargo is classified as hazardous, draught fore and aft in metres and decimals, expected exit position, and satellite equipment details where fitted. Missing or inaccurate cargo or equipment data in the Entry Report can create compliance exposure.

6. Defect reporting links to pollution and safety reporting duties (Schedule 4 cl 4)

• The Defect Report requirement is triggered when a vessel suffers damage, failure or breakdown affecting safety, or is required under the Navigation Act or the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 to report incidents. Operators must be aware of the overlapping statutory reporting duties and the specific formats required by IMO for incident reporting.

7. Geographic positions must be reported in WGS84 (clause 5)

• The Order requires positions to be referenced to the World Geodetic System 1984. Using a different datum without conversion could lead to inaccurate reported positions and a possible compliance issue.

8. Dynamic international references may extend obligations without domestic amendment (clause 2 and clause 4)

• The Order imports instruments “as amended from time to time” and defines areas by reference to GISIS and IMO Resolutions as amended. Changes at the international level could alter the MASTREP and REEFREP areas or technical standards without an amending Marine Order. Operators need processes to monitor IMO and GISIS updates.

9. Logbook entry requirements as evidence (Schedule 4 cl 6(4))

• If equipment failure prevents reporting, entries must be made in the radio log book for radio equipment failure and in the official logbook for other equipment failure. Failure to make these entries removes an important contemporaneous record and weakens any explanatory defence to an enforcement action.

10. The Order does not contain enforcement procedure detail

• While penalties are specified, the Order does not set out how enforcement action is initiated, whether infringement notices will be used, or the processes for contesting civil penalties. Parties must consult the Navigation Act and AMSA guidance for procedure.

11. REEFVTS operational requirements and route plan nomination (Schedule 4 cl 1(3) and notes)

• Entry Reports require nomination of a standard route plan and identification of any planned deviations. Standard route plans are set out in the REEFVTS User Guide. Failure to use or nominate the correct standard route plan can be treated as a deviation.

12. Multiple channels for reporting, but Position Reports are AIS-only by default (Schedule 4 cl 6 and cl 3)

• While Schedule 4 cl 6 provides multiple methods for reports generally, Schedule 4 cl 3(2) makes Position Reports to REEFVTS by AIS the default. Practically, this means masters relying on other methods for position reporting may be non-compliant unless AIS is unavailable and manual reporting is properly made.

These are concrete operational hazards implied by or explicitly stated in the Order. Practitioners should update checklists and procedures to address each gotcha, ensure masters are trained in the precise timeframes and content obligations, maintain equipment and logbooks to create evidentiary records, and monitor IMO and AMSA guidance for changes that may alter obligations.

This section translates the Order’s text into a practical checklist and recommended operational steps that flow directly from the instrument. The steps focus on avoiding the specific contraventions and evidentiary pitfalls that the Order prescribes.

1. Know if the Order applies to your vessel

• For MASTREP: Confirm whether the vessel is a regulated Australian vessel or a foreign vessel in Australia’s territory. If so, MASTREP position reporting per Schedule 3 applies while the vessel is in the MASTREP area (clause 6(1)). Consult Schedule 1 and the GISIS description for MASTREP area boundaries, remembering they are described in WGS84 (clause 5; Schedule 1).
• For REEFREP: If the vessel is 50 m or longer, an oil or chemical tanker, carries at least 200 m3 of oil, is an INF vessel, or is engaged in towing where the length of tow is 150 m or longer or either vessel is otherwise reportable, then REEFREP reporting applies when in or entering the REEFREP area (clause 6(2)). Check Schedule 2 maps and REEFVTS User Guide for precise area limits.

2. Equip the vessel to meet SOLAS and AMSA standards

• Ensure AIS equipment is SOLAS compliant and maintained, and operated in accordance with SOLAS Regulation 19.2.4.7 and relevant IMO guidance (Schedule 3 cl 2(2) and Schedule 4 cl 3(2)). Have recognised mobile satellite service equipment where practical, and confirm satellite phone numbers and equipment details for Entry Reports (Schedule 4 cl 1(2)(i)-(j)).
• Ensure navigation and positioning systems use WGS84 datum for reported latitude/longitude (clause 5).

3. Prepare report templates and checklists reflecting Schedule content

• For MASTREP position reports ensure your AIS transmits identity, type, position, course, speed and navigational status (Schedule 3 cl 1).
• For REEFREP, prepare Entry Report templates covering every item in Schedule 4 cl 1(2): identifiers, UTC time, current position, ETA into REEFREP area, last and next ports, nominated route and planned deviations, speed, draught fore and aft, anticipated exit position, satellite equipment details, satellite phone number, cargo details including hazardous classification, and vessel type/length/gross tonnage.
• Prepare Route Deviation Report templates with required fields including time and next port and draught details (Schedule 4 cl 2).
• Prepare Defect Report templates that allow detailed description of damage, failure or breakdown and that can use recognised IMO reporting formats for safety messages and incidents (Schedule 4 cl 4).

4. Implement operational timing processes

• For REEFREP Entry Reports, set an automated or procedural reminder to transmit at least one hour before planned entry into the REEFREP area or at least one hour before departure from a port in the REEFREP area (Schedule 4 cl 1(1)). Keep watch on position fixes so the 1 hour window is not missed.
• For Route Deviation Reports, implement watchstanding processes requiring immediate notification to the bridge officer and REEFVTS within 15 minutes of any deviation from the nominated route (Schedule 4 cl 2(1)). If deviation is anticipated, the note suggests making the Route Deviation Report before the deviation.

5. Ensure correct transmission channels and language

• Use AIS for required position reports by default. If using VHF Radiotelephone, make sure the channel matches your latitude band per Schedule 4 cl 6(1)(c). Maintain a simple reference chart on the bridge mapping latitude bands to VHF channels.
• Designate personnel fluent enough in English and trained in IMO Standard Marine Communications Phrases to make reports (Schedule 4 cl 6(3)). Keep scripted phrases and templates for common reports to reduce errors.

6. Maintain and test alternative communications

• Maintain recognised mobile satellite service equipment and test Inmarsat-C and other services, noting the instrument’s operational note that Inmarsat-C may use SAC 861 through POR LES and is free of charge (Schedule 4 cl 6 note).
• Keep REEFVTS telephone, fax and email contacts accessible and tested: +61 1300 721 293, +61 7 4721 0633, reefvts@vtm.qld.gov.au.

7. Logbook discipline and equipment failure records

• If equipment failure prevents reporting, make the required entries: radio logbook for radio equipment failures, official logbook for other equipment failures (Schedule 4 cl 6(4)). Record date/time, nature of failure, steps taken to restore communications, and any manual reports made to JRCC Australia or REEFVTS.
• Retain AIS transmission logs, satellite service records, and copies of emails or faxes sent to REEFVTS or JRCC Australia to demonstrate compliance or the timing of reports.

8. Plan and document routes and deviations

• For REEFREP Entry Reports nominate a standard route plan from the REEFVTS User Guide and document any planned deviations in the Entry Report (Schedule 4 cl 1(3)). Ensure standard route plans are current by referring to the Maritime Safety Queensland REEFVTS User Guide and update voyage planning routines to incorporate chosen standard routes.

9. Towing operations and length-of-tow checks

• Accurately measure and document length of tow (defined in clause 4) for any towage operation. If the length of tow is 150 m or longer, ensure REEFREP reporting is made as required. Maintain towing records and pre-departure checks to ensure compliance where tow length is marginal.

10. Cargo reporting and hazardous cargo classification

• Prepare and verify cargo declarations for Entry Reports, ensuring cargo names and hazard classification (if any) are accurate and consistent with IMDG Code or other applicable classification. For oil carriage, check whether the vessel carries at least 200 m3 of oil (clause 6(2)(d)).

11. Train masters and bridge teams in reporting obligations

• Conduct specific training modules for masters on: timing and content of Entry, Deviation, Position, Defect and Final Reports; how to make manual reports when AIS is unavailable; use of VHF channels by latitude; logbook entry requirements; and the implications of strict liability and civil penalties. Keep printed checklists on the bridge for quick reference.

12. Monitor international and AMSA updates

• Because the Order imports GISIS area descriptions and IMO resolutions as amended, assign responsibility to a shoreside compliance person to monitor IMO GISIS, AMSA Marine Orders webpage, the MASTREP guide and REEFVTS User Guide for changes that alter area boundaries or reporting content (clause 4 notes and Schedule notes).

13. Integrate reporting into safety management systems

• Incorporate these reporting procedures into the vessel’s Safety Management System and company SMS procedures, including drills for AIS failures and defect reporting. Make sure that the SMS evidences the company’s role in training equipment maintenance and logbook practice, which supports the master if enforcement questions arise.

14. Retain documentary evidence and a compliance folder

• Keep a compliance folder with: copies of the Order, SOLAS Regulation 19.2.4.7 excerpts and AIS operation guidance, MASTREP and REEFVTS user guides, printed route plans, contact numbers, templates and recent AIS logs. This folder will be crucial if enforcement inquiries arise.

15. Seek clarification when in doubt

• If operational uncertainty or conflicting guidance arises, contact REEFVTS or JRCC Australia for direction as the Order allows those bodies to request alternative communications and provide operational guidance (Schedule 3 cl 2(3)(a)(ii); Schedule 4 cl 3(4)(a)(ii)). Keep records of any operational directions provided by those bodies.

Following this checklist aligns vessel practice to the specific duties, timing, content and recording requirements in the Order. Because non-compliance draws both strict liability criminal exposure and civil penalties, documenting efforts to comply and to remediate communication failures is essential.
