Marine Order 58 (Safe management of vessels) 2020

The Order organises a small set of recurring regulatory concepts: document of compliance, safety management certificate, issuing body, verification and endorsement, interim documents and certificates, major non‑conformity, and the role of AMSA as Administration for regulated Australian vessels. These concepts are defined or anchored to the ISM Code and Chapter IX in the Order (s 4). Where a term is not defined in the Order but is in the ISM Code or Chapter IX, the Order instructs that the ISM Code or Chapter IX meaning applies (s 5(1)). This means the Order imports international technical definitions rather than reproducing them.

Document of compliance. For foreign vessels this is the document issued under paragraph 13.2 of the ISM Code; for regulated Australian vessels it is the document issued in accordance with subsection 12(1) of the Order (s 4). The owner must hold a document of compliance or interim document of compliance (ss 8(1), 10). Documents of compliance are subject to endorsement after annual verifications and must be kept up to date through written notice to the issuing body where circumstances change (s 13). Durations are specified: a document of compliance expires no later than five years after issue (s 14(1)(b)) while an interim document of compliance expires no later than 12 months after issue (s 14(2)(b)).

Safety management certificate. For foreign vessels it is the certificate issued under paragraph 13.7 of the ISM Code; for regulated Australian vessels it is the safety management certificate issued in accordance with subsection 100(1) of the Navigation Act (s 4). The Order makes a safety management certificate a required safety certificate for regulated Australian vessels (s 18). A safety management certificate is conditional on a document of compliance being valid for the owner who has agreed to take over ISM Code duties, and on the shipboard application of the safety management system in accordance with the ISM Code and ISM Guidelines (s 20(1)).

Issuing bodies and AMSA. Issuing bodies are the entities that may issue documents and certificates, assess compliance against the ISM Code and ISM Guidelines, and endorse documents after verifications (s 12). Issuing bodies may refuse, vary, or revoke documents and those decisions are reviewable under Marine Order 1 (s 12(4), s 15(2)). AMSA is taken to be the Administration for regulated Australian vessels in references to the ISM Code and Chapter IX, giving AMSA the administrative role envisaged by the international instruments (s 5(2)). AMSA can require delivery of varied or revoked documents and impose penalties (s 16).

Verification and endorsements. The Order requires issuing bodies to endorse documents and certificates following annual or intermediate verifications and following any additional verifications as required by the ISM Guidelines (ss 13(1)(a), 21(1)(a)-(b)). Renewal verifications are pivotal for continuity and timing of new documents and certificates; the Order explicitly adopts the timing rules in the ISM Code for renewals performed within three months before expiry and those performed earlier (ss 14(3)-(4), 22(3)-(5)).

Interim instruments and extensions. The Order provides for issuance of interim documents and certificates where the ISM Code permits (ss 12(3), 20(3)). It sets precise durations for interims , 12 months for interim documents of compliance (s 14(2)(b)), and 6 months for interim safety management certificates (s 22(2)(b)) , and permits extensions in line with ISM Code paragraphs referenced for limited periods (s 23(i)-(j)).

Offence framing and remedies. Several obligations are framed as strict liability offences with an identified penalty amount or civil penalty (for example, keeping a copy of the document on board is penalised at 50 penalty units, s 9(1); similar framing appears in ss 16 and 17). The Order also points to Navigation Act provisions criminalising taking a vessel to sea without prescribed certificates (notes to ss 8 and 18) and to navigation law powers to detain vessels in specified circumstances (note to s 23 referring to s 315 of the Navigation Act).

Exemptions, definitions and cross‑references. Exemption mechanics are handled through Marine Order 1 application processes and require satisfaction of dual criteria: compliance would be unnecessary or unreasonable and the exemption would not contravene SOLAS or the ISM Code (s 7). Several defined terms are left to Marine Order 1 or the Navigation Act (s 4 notes), and the Order repeatedly refers readers to the ISM Code, ISM Guidelines and supporting Marine Orders for procedural detail.

Together these concepts convert the ISM Code’s system of company and shipboard safety management into an administrable Australian regime with fixed document lifecycle rules, documentary carriage obligations, verification and endorsement cycles, and explicit enforcement levers.

The Order identifies a discrete set of actors who bear duties, decision rights, or enforcement exposure. Owners. Owners of foreign vessels and owners of regulated Australian vessels to which Chapter IX applies must hold a document of compliance or interim document of compliance (ss 8(1), 10). The owner who agrees to take on all duties and responsibilities imposed by the ISM Code is the addressee for issuing bodies when assessing whether the owner’s safety management system meets ISM requirements (s 12(1)). Owners also carry obligations to notify issuing bodies in writing where certificate information is no longer accurate (ss 13(1)(b), 21(1)(c)). Owners may apply for exemptions under Marine Order 1 (s 7(1)) and may request variation or revocation of documents (s 15(1)(c), s 23(f)).

Masters and on‑board personnel. Masters have an operational obligation: they may take a foreign or regulated Australian vessel to sea only if a copy of the relevant document of compliance or interim document of compliance is carried on board (ss 9(1), 17(1)). Failure to carry the on‑board copy is an offence subject to a specified penalty and is strict liability (ss 9(1)-(3), 17(1)-(3)). More generally, the safety management system must be applied on the vessel in accordance with the ISM Code and ISM Guidelines for a safety management certificate to issue or remain valid (s 20(1)(b), s 21(1)(d)).

Issuing bodies. Issuing bodies decide whether to issue, endorse, vary, or revoke documents and certificates. They are charged with determining whether a company safety management system meets ISM Code and ISM Guidelines requirements (s 12(1)). Issuing bodies are required to perform endorsements after annual or intermediate verifications and after additional verifications where applicable (ss 13(1)(a), 21(1)(a)-(b)). A decision by an issuing body not to issue, endorse, vary or revoke a document is a reviewable decision under Marine Order 1 (ss 12(4), 15(2) and notes).

AMSA. For regulated Australian vessels, AMSA is the Administration as used in the ISM Code and Chapter IX (s 5(2)). AMSA may require delivery of varied or revoked documents, and the holder must comply under penalty (s 16). Various review and enforcement powers referenced by the Order are vested in AMSA under the Navigation Act, including the power to require delivery of revoked certificates and, per the note to s 23, the power to require delivery of revoked certificates and detain the vessel until compliance (note to s 23 and reference to s 315 of the Navigation Act).

Foreign Administrations. For foreign vessels, the Administration referenced in the ISM Code is taken as the government of the flag state (s 5(2)(b)). The Order therefore places an obligation on the owner and master of a foreign vessel to have the requisite ISM documents and to comply with Chapter IX, the ISM Code and ISM Guidelines (ss 8(3), 9).

Government vessels used for commercial purpose. The Order applies to Government vessels only where they are used for a commercial purpose (s 6(3)). This confines the Order’s application to government assets when they operate in commercial contexts.

Other entities. The Order cross‑references Marine Order 1 for administrative processes, including applications for exemptions, review of decisions and delegation arrangements (s 7 note; s 4 Note 4). Marine Order 31 is signalled for safety management system requirements for regulated Australian vessels to which Chapter IX does not apply (s 6(1) note). Owners, masters, issuing bodies and AMSA must therefore interface with those other instruments for procedural detail and for definitions left to other Marine Orders and the Navigation Act (s 4 notes).

Who pays and who decides. Costs will fall mainly on vessel owners and operators who must prepare, implement and maintain a safety management system that satisfies the ISM Code and ISM Guidelines and pay for verifications and endorsements by issuing bodies. Masters are exposed to compliance costs and potential penalties for not carrying a copy of the document on board (ss 9, 17). Issuing bodies decide on issuance, endorsement, variation and revocation subject to review (ss 12(1), 12(4), 15(2), notes).

Overall, the Order affects owners, masters and issuing bodies directly, AMSA as the national Administration for Australian vessels, foreign Administrations for foreign vessels, and, where applicable, government vessel operators engaged in commercial activity.

The Order creates specific documentary duties, notification duties, verification duties, and administrative rights of decision and review. Owner’s documentary duties. Owners of regulated Australian vessels must have a document of compliance or interim document of compliance (s 10). Owners of foreign vessels must hold a document of compliance or interim document of compliance (s 8(1)). Owners must also ensure the vessel holds a safety management certificate or interim safety management certificate where required (ss 8(2), 18). These are express statutory duties.

Carriage and on‑board duties. The master may take a foreign or regulated Australian vessel to sea only if a copy of a document of compliance or interim document of compliance for the owner is on board the vessel (ss 9(1), 17(1)). These are strict liability offences with specified penalties and civil liability exposure (s 9(1)-(3), s 17(1)-(3)). This turns the document into an operational pre‑condition for voyages and places a continuing record‑keeping duty on board.

Notification and accuracy duties. Holders of documents of compliance and safety management certificates must tell the issuing body in writing if the information on the document or certificate is no longer accurate because of changed circumstances (s 13(1)(b), s 21(1)(c)). This imposes an ongoing duty to update administrative records and invites issuing body scrutiny when particulars change.

Verification and endorsement duties. A document of compliance must be endorsed by the issuing body after annual verifications of the kinds in paragraph 13.4 of the ISM Code and paragraph 4.4 of the ISM Guidelines and within the time period mentioned in paragraph 13.4 of the ISM Code (s 13(1)(a)). A safety management certificate must be endorsed after an intermediate verification conducted between the second and third anniversaries of the certificate, or more often if the issuing body considers it necessary, and after any additional verification required under the ISM Guidelines (s 21(1)(a)-(b)). These rules convert the ISM Code verification cycles into compulsory administrative steps.

Issuing body rights and discretions. Issuing bodies may issue a document of compliance, interim document of compliance, safety management certificate and interim safety management certificate if they are satisfied the ISM Code and ISM Guidelines criteria are met (ss 12(1)-(3), 20(1)-(3)). They may vary or revoke documents and certificates where conditions are not complied with or where there is evidence of major non‑conformity or other grounds listed in ss 15(1), 23. Those decisions are reviewable under Marine Order 1 (s 12(4), s 15(2)). Issuing bodies also have the power to endorse documents and certificates following verifications (ss 13, 21).

AMSA rights. For regulated Australian vessels AMSA is the Administration in ISM Code terms and it may require delivery of varied or revoked documents by notice in writing (s 16(1)). The holder must comply under penalty (s 16(2)) and the Order emphasises AMSA’s role in administering and enforcing the regime. The Order also notes AMSA may require delivery of revoked certificates under the Navigation Act and may detain vessels until compliance with such a requirement (note to s 23 referencing s 315 of the Navigation Act).

Exemption and review rights. A person may apply to AMSA for exemptions from this Order or the ISM Code in accordance with the Marine Order 1 application process (s 7(1)). AMSA may grant an exemption only if satisfied that compliance would be unnecessary or unreasonable in the circumstances and that giving the exemption would not contravene SOLAS or the ISM Code (s 7(2)). Decisions by issuing bodies not to issue, endorse, vary or revoke documents are reviewable under section 17 of Marine Order 1 (ss 12(4), 15(2) and notes). The Order explicitly references the reviewable decision provisions of the Navigation Act for certain certificate decisions (note to s 20 referencing s 313; note to s 23 referencing sections 101 and 102).

Duration and renewal rights. Documents of compliance and certificates operate on fixed duration rules. A document of compliance expires on the day determined by the issuing body or 5 years after issue, with specific transitional rules for when new documents come into force depending on the timing of renewal verification in relation to expiry (ss 14(1), 14(3)-(4)). Safety management certificates have related but vessel‑linked expiration rules: a safety management certificate ceases to be in force on the day determined by the issuing body or the day the owner’s document of compliance ceases to be in force (s 22(1)(b)). Interim instruments have limited durations 12 and 6 months respectively (ss 14(2)(b), 22(2)(b)), with specified extension mechanisms set out in the ISM Code and adopted by the Order (s 23(i)-(j)).

Obligations linked to ISM Code compliance. Several duties are contingent on applying the safety management system on the vessel in accordance with the ISM Code and ISM Guidelines (ss 20(1)(b), 21(1)(d)). The Order therefore makes the operational application of the company’s safety management system a statutory condition for issuance and continuation of ship documents and certificates.

Penalties and strict liability. Certain failures, such as not carrying the document on board or failing to deliver varied or revoked documents to AMSA on notice, are framed as strict liability offences attracting specified penalties and civil penalties of 50 penalty units (ss 9(1)-(3), 16(2)-(4), 17(1)-(3)). The Order points to other Navigation Act offences for taking vessels to sea without required safety certificates (notes to ss 8 and 18).

Rights of appeal and review are preserved by cross‑reference to Marine Order 1 and Navigation Act review provisions (s 12(4), s 15(2), notes to ss 20 and 23). Practically, regulated parties have statutory avenues to seek exemptions, apply for documents, and seek review of issuing body decisions, but they also face a structure of mandatory verification cycles, notification duties and penalties for certain failures.

The Order provides a combination of strict liability offences, civil penalties and procedural enforcement mechanisms through issuing body actions and AMSA directions. The instrument specifies several obligations with explicit penalties and civil penalty exposure, and it cross‑references Navigation Act offences and enforcement powers.

Specified monetary penalties. The Order prescribes a penalty of 50 penalty units for failure to carry a copy of the document of compliance or interim document of compliance on board a foreign vessel (s 9(1)). Subsection 9(2) states that the offence is a strict liability offence and subsection 9(3) establishes civil penalty liability for contravention, with the civil penalty set at 50 penalty units. The same framework applies to regulated Australian vessels in relation to carriage of the document (s 17(1)-(3)). Section 16(2) imposes the same penalty and civil penalty regime where AMSA has required delivery of a varied or revoked document and the holder fails to comply with the written notice to deliver the document (s 16(1)-(3), and s 16(4) for civil penalty).

Strict liability framing. The Order makes contraventions of the on‑board carriage obligations and the AMSA delivery requirement strict liability offences (ss 9(2), 16(3), 17(2)). This reduces the prosecutorial burden of proving mens rea for those specific offences. The Order pairs those strict liability criminal offences with parallel civil penalty liability to provide an alternative enforcement pathway (ss 9(3), 16(4), 17(3)).

Issuing body enforcement powers. Issuing bodies have authority to vary or revoke documents of compliance, interim documents, safety management certificates and interim certificates where specified conditions are not met, where there is evidence of major non‑conformity, when holders request variation or revocation, or because of changes in circumstances such as ownership or vessel name or registration (ss 15(1), 23). Those powers provide an administrative enforcement tool that can remove the document or certificate that legitimates the vessel’s operation under the ISM Code. Decisions by issuing bodies to vary or revoke, or not to vary or revoke, are reviewable under Marine Order 1 (s 15(2)), which offers regulated parties procedural rights to challenge enforcement actions.

AMSA enforcement and detention. AMSA may require delivery of varied or revoked documents by written notice (s 16(1)). Failure to comply is penalised (s 16(2)-(4)). The Order’s note to s 23 points to section 315 of the Navigation Act which provides that AMSA may require a revoked certificate to be delivered and that the vessel may be detained until the requirement is complied with. This note links the Order’s revocation powers to the Navigation Act’s detention power, creating the potential for operational enforcement through detention until paperwork is surrendered.

Navigation Act offences. The Order notes that it is an offence under the Navigation Act to take a foreign vessel to sea without the required certificate of a specified kind (note to s 8 referring to ss 106 and 107) and that it is an offence under the Navigation Act to take a regulated Australian vessel to sea without a safety certificate of the specified kind (note to s 18 referring to ss 103 and 104). The exact penalties under those Navigation Act sections are not reproduced in the Order, but the cross‑references make clear that criminal liability under the Navigation Act is engaged where vessels go to sea without the required safety certificates.

Reviewability and administrative law. Several decisions are expressly made reviewable. Decisions by an issuing body not to issue a document of compliance or interim document are reviewable for section 17 of Marine Order 1 (s 12(4)). Decisions to vary or revoke (or not to do so) are reviewable under s 15(2). The Order’s notes reference section 313 of the Navigation Act which lists certificate decisions that are reviewable, and section 315 which concerns AMSA’s power to require delivery of revoked certificates and to detain vessels until that is complied with (notes to ss 20 and 23). These cross‑references preserve administrative review rights under existing Marine Orders and the Navigation Act and create an enforcement architecture that combines administrative removal of documents, criminal offences for specific failures, civil penalties and vessel detention.

Operational enforcement mechanics. Practically the enforcement path is often sequential. An issuing body can decline to endorse or may revoke a document or certificate where verifications do not support continuing validity (ss 13, 21, 15, 23). If a document or certificate is revoked and an issuing body or AMSA requires its surrender, the holder must deliver it or face penalties and possible detention of the vessel until it is delivered (s 16 and note to s 23). Parallel criminal and civil liability for on‑board carriage failures and non‑delivery of revoked documents creates dual levers for regulators.

In summary, enforcement under the Order combines administrative powers of issuing bodies and AMSA to issue, endorse, vary and revoke instruments, criminal offences and civil penalties for certain discrete failures, and the possibility of vessel detention under Navigation Act powers where certificates are revoked and not surrendered.

The Order is explicitly an implementing instrument for Chapter IX of SOLAS and the ISM Code, and it is thoroughly cross‑referenced to the Navigation Act and other Marine Orders for procedural details and administrative processes. The Order’s legal operation depends on these international and domestic instruments.

Navigation Act 2012. The Order is made under subsection 342(1) of the Navigation Act and relies on several provisions of the Act for its authority (s 3). It specifically notes the relevance of section 98 (regulations about safety certificates), section 314 (regulations about certificate matters), paragraph 340(1)(a) (giving effect to SOLAS), subsection 341(1) (imposition of penalties for contravention of regulations), subsection 339(1) (prescribing matters necessary or convenient for carrying out the Act), and subsection 342(1) (power to make Marine Orders) (s 3). The Order also cross‑references Navigation Act provisions that create civil and criminal offences for taking vessels to sea without specified safety certificates (notes to ss 8 and 18 referring to ss 106, 107, 103 and 104 of the Navigation Act). The notes to s 23 reference section 315 of the Navigation Act, underscoring that revoked certificates may be required to be surrendered and that vessels may be detained until surrender (note to s 23). The Order therefore operates as a Marine Order subordinate to and integrated with the Navigation Act enforcement and procedural framework.

International instruments. The Order gives effect to Chapter IX of SOLAS and mandates compliance with the ISM Code and ISM Guidelines (s 2). Definitions and many substantive compliance points are imported directly from Chapter IX and the ISM Code; where terms are not defined in the Order the ISM Code and Chapter IX meanings apply (s 5(1)). The Order treats the ISM Code and ISM Guidelines as instruments that may be updated from time to time and includes language to capture those amendments as in force from time to time (s 4 definitions). As a result, international amendments to the ISM Code or ISM Guidelines may alter obligations under the Order without separate domestic amendment, subject to the Order’s frame.

Marine Order 1 (Administration) 2013. The Order delegates procedural matters to Marine Order 1. It instructs applicants for exemptions to use the application processes in Marine Order 1 (s 7(1)) and states that decisions by issuing bodies are reviewable under the Marine Order 1 review provisions (s 12(4), s 15(2)). A note to s 4 directs readers to Marine Order 1 for delegation of AMSA’s powers (s 4 Note 4). Marine Order 1 therefore supplies administrative detail on how to apply for exemptions, how reviews are conducted, timeframes, the imposition of conditions, and notification requirements.

Marine Order 31 (SOLAS and non‑SOLAS certification) 2019. The Order signals that for safety management system requirements for regulated Australian vessels to which Chapter IX does not apply, Schedule 2 of Marine Order 31 should be consulted (s 6(1) note). This creates a practical interaction between different Marine Orders depending on whether Chapter IX applies to a particular vessel.

International Maritime Organization publications. The Order notes where to obtain copies of the ISM Code, ISM Guidelines and other IMO documents via AMSA’s website or IMO publications (s 4 Note 1). Those international documents are treated as authoritative for technical content.

Reviewable decision framework. Multiple decisions under the Order are made reviewable and the Order references the reviewable decision processes of the Navigation Act and Marine Order 1 (s 12(4), s 15(2), and notes to ss 20 and 23 referring to s 313 of the Navigation Act). This integrates the Order with Australia’s existing administrative law and review architecture.

Penalties and detention. The Order’s enforcement mechanisms are linked to Navigation Act provisions that criminalise sailing without prescribed certificates and that permit detention of vessels until AMSA’s requirement to surrender revoked certificates is satisfied (notes to ss 8, 18 and 23 referring to Navigation Act sections). Consequently the Order operates in conjunction with the Navigation Act enforcement toolbox.

Definitions and delegation. The Order leaves certain terms to be understood through Marine Order 1 and the Navigation Act (s 4 notes), and references Marine Order 1 for delegation of AMSA’s powers (s 4 Note 4). This means practical implementation depends on those instruments for delegation arrangements and the precise meaning of certain technical or administrative terms such as “issuing body”, “owner” and “foreign vessel”.

In short, the Order is not a standalone regulatory text; it is integrally linked to the Navigation Act for its legal authority and enforcement mechanisms, to Marine Order 1 and Marine Order 31 for administrative and procedural detail, and to the ISM Code and ISM Guidelines and Chapter IX of SOLAS for substantive technical standards. Changes to those international instruments or to the Navigation Act or Marine Orders will have direct consequences for obligations under this Order.

This Marine Order contains a short documented amendment history within the instrument itself. The Order commenced on 1 July 2020 and expressly repeals Marine Order 58 (Safe management of vessels) 2015 (ss 1A, 1B). No other domestic amendments or subsequent variations are recorded within the text provided.

The Order’s definitions anticipate that the ISM Code and ISM Guidelines may be amended over time and state that those instruments are adopted "as in force from time to time" (s 4 definitions for ISM Code and ISM Guidelines). That language means the substantive obligations in the Order are dynamic to the extent the international instruments change. The Order therefore imports a modality of automatic update through international instrument revision rather than requiring separate domestic amendment for changes to the ISM Code or ISM Guidelines.

Because the Order relies on numerous provisions of the Navigation Act and references other Marine Orders for administrative detail, changes to the Navigation Act and Marine Orders (in particular Marine Order 1 and Marine Order 31) will alter the operational effect of this Order. The Order itself records two such cross‑references: Marine Order 1 as the administrative companion instrument for exemption applications, review processes and delegation (s 7 note; s 4 Note 4) and Marine Order 31 for safety management system requirements for vessels outside the scope of Chapter IX (s 6(1) note). Any amendments to those instruments are therefore part of the practical amendment history of obligations created by this Order.

All legislative instruments are registered on the Federal Register of Legislation under the Legislation Act 2003, as the Order notes, and updates or subsequent instrument versions would be captured there (final note). The Order’s internal text does not list any subsequent amendments after its 1 July 2020 commencement, nor does it record transitional arrangements other than the statutory timing rules for renewals and renewals completed within specified periods relative to expiry (ss 14(3)-(4), 22(3)-(5)).

Practitioners should therefore treat this Order as the successor to the 2015 Marine Order 58 as of 1 July 2020, and should monitor the ISM Code and ISM Guidelines for international amendments that the Order imports by reference. They should also monitor the Federal Register of Legislation for any later amendments to this Marine Order or to Marine Order 1 and Marine Order 31 that affect how this Order operates in practice.

The text of the Order does not contain or report any litigation history. It does not name any cases or judicial decisions. Instead, it prescribes administrative decision‑making with multiple reviewable decision hooks that route disputes into the administrative review framework rather than specifying judicial outcomes.

What the Order does provide are multiple statutory reference points for administrative review processes. It makes decisions by issuing bodies not to issue, endorse, vary or revoke documents reviewable under Marine Order 1 (s 12(4), s 15(2)). The Order’s notes expressly refer to section 313 of the Navigation Act which lists certificate decisions that are reviewable and to section 315 which concerns AMSA’s power to require surrender of revoked certificates and to detain vessels until surrender (notes to ss 20 and 23). These cross‑references indicate the legislative architecture for contesting or reviewing enforcement and issuance decisions will be found in Marine Order 1 and the Navigation Act.

Because this Order establishes administrative decision points and leaves review mechanics to an existing administrative framework, any disputes will typically progress through administrative review channels provided under Marine Order 1 and, if necessary, judicial review avenues available under the Administrative Decisions (Judicial Review) Act 1977 or relevant provisions of the Administrative Appeals Tribunal Act where those statutes apply. Those review avenues and their precedents are not discussed within the Order itself.

Practitioners seeking litigation history will need to consult administrative decisions and court records outside the Marine Order text to determine whether any issuing body decisions, AMSA notices, or enforcement actions concerning this Order have been the subject of merits review, judicial review, or other litigation. The Order itself contains no case law, no dispute summaries, and no recorded judicial pronouncements.

The Order contains a number of practical traps and tight administrative linkages that can create exposure for owners, masters and operators if not actively managed. Below are points that commonly produce operational non‑compliance risks, with explicit section references.

Strict liability carriage offences. The master may take a vessel to sea only if a copy of the applicable document of compliance or interim document is on board (ss 9(1), 17(1)). Both these provisions are framed as strict liability offences with penalties and civil penalty exposure of 50 penalty units (ss 9(2)-(3), 17(2)-(3)). The strict liability construction reduces the scope for a duress or mistake defence and means a master can be convicted notwithstanding an absence of intention. Practically, failing to keep a copy on board is a relatively easy compliance failure with immediate operational consequences.

AMSA delivery notices and detention connection. AMSA may require delivery of varied or revoked documents by written notice and non‑compliance attracts the same fine and civil penalties (s 16). The note to s 23 links the revocation regime to Navigation Act s 315 which permits AMSA to require surrendered certificates and to detain vessels until the requirement is complied with (note to s 23). Owners should therefore treat a revocation as not just a loss of documentary status but as a trigger that can lead to detention until the document is delivered, with attendant operational and commercial costs.

Timing of renewal verifications. Renewal verification timing matters. If a renewal verification is completed within three months before the expiry date, the new document or certificate comes into force and ceases in accordance with ISM Code paragraph 13.10; if completed more than three months before expiry it follows paragraph 13.11 (ss 14(3)-(4), 22(3)-(4)). Renewal verifications completed after expiry have different consequences (s 22(5) referencing paragraph 13.12 of the ISM Code). Practically, operators who time renewals poorly risk gaps in coverage or unexpected start and stop dates for documents and certificates.

Interplay of owner document and vessel certificate. A safety management certificate for a vessel depends on the owner having an in‑force document of compliance (s 20(1)(a)) and a safety management certificate ceases to be in force if the owner’s document of compliance ceases to be in force (s 22(1)(b)). This creates a dependency: a problem at the company/document level can cascade to vessel certificates and thereby to the vessel’s ability to operate legally. Owners must manage their company safety management system and endorsements to avoid collateral vessel impacts.

Broad revocation grounds. Issuing bodies may vary or revoke documents for non‑compliance with the stated conditions, or where there is "evidence of a major non‑conformity" with requirements (s 15(1)(b), s 23(c)). The Order does not itself define "major non‑conformity"; that concept is set out in the ISM Code and ISM Guidelines which the Order imports (s 4). The lack of a domestic statutory definition means a regulator or issuing body’s interpretation, guided by the internationally sourced ISM Code and Guidelines, will be determinative in practice.

Interim durations and extensions. Interim documents and certificates have short prescribed durations , 12 months for interim documents of compliance and 6 months for interim safety management certificates (ss 14(2)(b), 22(2)(b)). Extensions are possible only to the extent provided in the ISM Code and are strictly limited in duration (s 23(i)-(j)). Operators relying on interims need to plan renewals early and cannot assume lengthy transitional coverage.

Exemptions are constrained. Exemptions from this Order or the ISM Code are available only through an AMSA application under Marine Order 1 and only if compliance would be unnecessary or unreasonable and the exemption would not contravene SOLAS or the ISM Code (s 7(1)-(2)). This is a narrow test and AMSA’s satisfaction is required, limiting the room for bespoke domestic relief.

Delegated powers and definitions elsewhere. Several important terms and procedural details are in Marine Order 1, the Navigation Act or other Marine Orders (s 4 notes). Practitioners must consult those instruments for critical definitions such as issuing body, owner, foreign vessel, and for the application, review and appeal mechanics. Failure to consult those cross‑references can produce procedural missteps.

Endorsements and additional verifications. Documents and certificates are conditioned on periodic endorsements after annual, intermediate and any additional verifications specified in the ISM Guidelines (ss 13(1)(a), 21(1)(a)-(b)). Issuing bodies can choose to require more frequent verifications if they consider it necessary (s 21(1)(a)). This discretion can lead to surprise additional verification costs for operators.

Operational application obligation. The issuing body must be satisfied that the safety management system for the vessel is being applied on the vessel in accordance with ISM Code and ISM Guidelines for issuance of a safety management certificate (s 20(1)(b)). Documentation alone is not sufficient; the system must be operationally embedded on the vessel. Owners and masters must therefore ensure that the company system is not only documented but practiced and demonstrable during verifications.

Review and timing risk. Many issuance and revocation decisions are reviewable under Marine Order 1 and the Navigation Act (s 12(4), s 15(2) and notes). While review rights exist, they do not prevent immediate regulatory actions such as revocation or detention. Owners who assume they can continue operating while an appeal is pending may be mistaken depending on the action taken by AMSA or the issuing body.

In short, the Order integrates documentary lifecycle rules with operational application requirements and enforcement levers. The principal operational risks are strict liability carriage offences, dependency of vessel certificates on company documents, timing of renewals, potential for additional verifications, and the narrow scope for exemptions. Each of these creates specific compliance attention points.

Compliance under this Order requires coordinated actions at the company, vessel and administrative interface levels. The pathway below translates the Order’s provisions into practical compliance steps, with explicit references to the provisions that impose the obligations.

1. Determine applicability and scope. Confirm whether the vessel is a regulated Australian vessel to which Chapter IX applies or a foreign vessel to which Chapter IX applies. The Order applies to regulated Australian vessels to which Chapter IX applies (s 6(1)) and Divisions 1 and 2 apply to foreign vessels (s 6(2)). Government vessels are covered only when used for a commercial purpose (s 6(3)). This threshold determines which parts of the Order apply.

2. Establish ownership responsibility. Identify the company or owner who has agreed to take over all duties and responsibilities imposed by the ISM Code. Issuing bodies require the owner to be the entity that has agreed to those duties when assessing applications for documents of compliance (s 12(1)).

3. Prepare and document the company safety management system. Ensure the safety management system meets the ISM Code and ISM Guidelines requirements for the kinds of vessel covered by the company document of compliance (s 12(1)). Documentation should be consistent with the ISM Code and guidelines and demonstrably operational for verifications.

4. Apply to an issuing body for a document of compliance or interim document of compliance. A person may apply to an issuing body for these documents (s 11). If an interim document is sought, the issuing body may issue one in accordance with paragraph 14.1 of the ISM Code and the ISM Guidelines (s 12(3)). Retain application records and ensure every application is made through the process expected by the issuing body and Marine Order 1.

5. Support issuing body verifications and endorsements. Be prepared for annual verifications for documents of compliance and intermediate verifications for safety management certificates. Documents are subject to endorsement after annual verifications (s 13(1)(a)) and safety management certificates must be endorsed after intermediate verifications between the second and third anniversaries, or more often if necessary (s 21(1)(a)). Prepare audit trails, crew training records, procedures and evidence that the system is being applied on board as required (s 20(1)(b), s 21(1)(d)).

6. Carry a copy of the document on board. Masters must ensure that a copy of the document of compliance or interim document of compliance for the owner is on board the vessel before taking it to sea (ss 9(1), 17(1)). Because these obligations are strict liability offences with specified penalties, implement on‑board checklist controls and document custody to ensure a current copy is always present.

7. Manage renewals and timing. Plan renewal verifications with reference to the Order’s timing rules. If a renewal verification is completed within three months before expiry the new document or certificate follows one set of ISM Code provisions, and if completed more than three months before expiry it follows another (ss 14(3)-(4), 22(3)-(4)). Avoid last‑minute renewals that risk expiry gaps or undesirable shift in start/expiry dates.

8. Notify issuing body of changed circumstances. If the information on any document or certificate becomes inaccurate because of changed circumstances, notify the issuing body in writing (ss 13(1)(b), 21(1)(c)). Have established procedures and contact points for prompt written notification to avoid grounds for variation or revocation.

9. Prepare for interim instruments and extensions. If operating under an interim document or certificate, track the shorter statutory durations , 12 months for interim documents of compliance and 6 months for interim safety management certificates (ss 14(2)(b), 22(2)(b)) , and the limited extension pathways under the ISM Code adopted by the Order (s 23(i)-(j)). Do not assume indeterminate transitional coverage.

10. Manage conformity and major non‑conformities. Implement corrective action processes to address non‑conformities identified during verifications because issuing bodies may vary or revoke documents where there is evidence of major non‑conformity (s 15(1)(b), s 23(c)). Maintain records of corrective actions and be able to demonstrate their completion to issuing bodies.

11. Use exemption avenues where appropriate. If compliance would be unnecessary or unreasonable in a particular case, consider applying to AMSA for an exemption under Marine Order 1, but note that AMSA may grant an exemption only where it is satisfied the exemption would not contravene SOLAS or the ISM Code (s 7(1)-(2)). Prepare a robust justification addressing both elements of AMSA’s test.

12. Keep administrative and legal interfaces current. Consult Marine Order 1 for application and review processes and Marine Order 31 for safety management requirements where Chapter IX does not apply (s 6(1) note; s 4 notes). Ensure you know the identity and procedural requirements of the issuing body under relevant delegations, and maintain records of endorsements, renewals and correspondence with issuing bodies and AMSA.

13. Prepare for AMSA notices and surrender requirements. If AMSA issues a written notice requiring delivery of a varied or revoked document, comply promptly to avoid penalties and the risk of detention (s 16; note to s 23 referencing s 315 of the Navigation Act). Implement an internal escalation to handle such notices within the required timeframes.

14. Preserve rights to review decisions. If an issuing body declines to issue, endorse, vary or revoke a document or certificate, understand the review rights under Marine Order 1 (s 12(4), s 15(2)) and the Navigation Act reviewable decision framework referenced in the Order. Prepare required documentation and records to support any review.

15. Train masters and crew on on‑board compliance. Given the strict liability offences for carriage failures, ensure that masters and responsible personnel understand the carriage and documentation obligations and maintain routine on‑board checks to assure compliance.

By following these steps and documenting each compliance action , system design, verification scheduling, evidence of operational application, written notices to issuing bodies and record of on‑board carriage , owners and masters will align their practical controls with the documentary and procedural requirements set out in the Order. Regular liaison with the issuing body and AMSA, and monitoring of ISM Code or ISM Guidelines updates, are necessary because the Order imports those international instruments by reference and those instruments can change in ways that alter domestic obligations (s 4 definitions).
