Marine Order 55 (Vessels carrying industrial personnel) 2024

The Order centres on several discrete statutory concepts that structure compliance, certification and enforcement. Key terms are defined or adopted by reference: IP Code, IP Ship Safety Certificate, industrial personnel, responsible person, Administration (AMSA for regulated Australian vessels; flag State government for foreign vessels) and others (s4; s5(1)). The Order relies heavily on the IP Code and SOLAS provisions; terms not defined in the Order take their meaning from SOLAS, the HSC Code or the IP Code (s5(3)).

Industrial personnel is the lay concept at the core: the Order adopts the SOLAS definition by reference, which covers persons transported or accommodated on board for the purpose of offshore industrial activities performed on board other ships or offshore facilities (s4 note). The instrument emphasises that the number of industrial personnel must be counted on an aggregate basis with special personnel and passengers, and the number of passengers must not exceed 12 when used as a parameter in Chapter XV or the IP Code (s7 Note 2). Regulation 5 of Chapter XV (summarised in the Order) sets the threshold for requiring an IP Ship Safety Certificate: generally cargo vessels or high-speed cargo craft over 500 GT, engaged on international voyages, that carry more than 12 industrial personnel (s7 Note 1).

IP Ship Safety Certificate is a bespoke safety certificate under the Navigation Act framework, defined by reference to the IP Code Appendix and a record of equipment attached (s4). The certificate is issued after survey in accordance with the IP Code and certain SOLAS/HSC Code survey provisions (s9(c)). The Order sets specific conditions to which the certificate is subject, including functional requirements for personnel transfer arrangements, a requirement for an analysis of failures that could impair transfer arrangement availability, evaluation of vessel manoeuvrability relative to position-keeping needs, and obligations for detailed survey timings and endorsements (s10).

A “responsible person” for the purposes of maintenance and inspection of transfer appliances is someone with practical and theoretical knowledge and relevant experience to detect and evaluate defects affecting intended performance; the Order gives examples such as chief officers and chief engineer officers (s4). This embeds a competency standard into the maintenance obligations in s17, which requires supervision, records, marking, lighting, job safety analysis and communications associated with personnel transfer operations.

Compliance is enforced via three related legal mechanisms:

• criminal strict liability offences for specified contraventions of ss17 and 18 (ss17(2), 18(2)); these offences attract a penalty of 50 penalty units as stated in the relevant subsections (ss17(1) penalty; 18(1) penalty).
• civil penalties (civil liability to pay) for contraventions of the same duties: owners or masters as specified (ss17(3), 18(3)), with the civil penalty specified at 50 penalty units.
• administrative action under the Navigation Act framework for failure to hold required certificates, including offences under sections 106 and 107 of the Navigation Act if a vessel is taken to sea without a required certificate (s15 Note).

The Order also preserves issuing‑body discretion outside the criteria set here: an issuing body can impose other certificate conditions under paragraph 100(2)(b) of the Navigation Act (not reproduced in the Order but referenced in the notes to s10). Variation and revocation criteria follow the Navigation Act model but are specified here against IP Code survey outcomes and specified grounds such as incorrect certificate information, owner request, breach or likely breach of a condition, or cessation of Australian registration (ss13-14).

Finally, the Order differentiates between regulated Australian vessels and foreign vessels for parts of its operation (s6). Division 2 (the domestic IP Ship Safety Certificate regime) and Division 4 (certain operational provisions) do not apply to foreign vessels; foreign vessels are regulated through Divisions 3 and the overarching requirement in s15 that they hold a certificate issued in accordance with the IP Code.

The Order directly affects three groups: owners of regulated Australian vessels (and their masters), masters of regulated Australian vessels, and foreign vessels in Australian waters to which Chapter XV of SOLAS applies.

Regulated Australian vessels: where Regulation 5 of Chapter XV requires an IP Ship Safety Certificate (notably cargo vessels or high-speed cargo craft >500 GT engaged on international voyages and carrying more than 12 industrial personnel per s7 Note 1), the vessel’s owner must apply for and hold an IP Ship Safety Certificate under the Navigation Act scheme as implemented by this Order (ss7-9). Owners are also placed under maintenance and operational duties: s17 requires owners or masters to ensure personnel transfer appliances are maintained, inspected, supervised and marked; s17 explicitly places penalties (criminal strict liability and civil) on contraventions and associates the civil liability with the master or owner (ss17(1)-(3)). Section 10 imposes conditions on the certificate that create design, analysis and survey obligations that owners must meet to obtain and retain the certificate.

Masters: masters of regulated Australian vessels hold specific statutory duties in relation to the safety of industrial personnel during voyage (s18). The master must ensure each industrial person is at least 16 years old, has acceptable documentary evidence of physical and medical fitness, can communicate adequately in English or the working language, holds specified safety training certificates (BOSIET, GWO or equivalents approved by AMSA), and receives onboard safety familiarisation and transfer-specific familiarisation prior to transfer (s18(1)(a)-(e)). Contraventions by the master attract strict liability, civil penalty exposure and, indirectly, operational enforcement consequences (s18(2)-(3)).

Third parties: issuing bodies and AMSA as Administration play decision-making roles. For regulated Australian vessels AMSA is the Administration and issuing body for certificate applications in many cases via the administrative rules set out in Marine Order 1 (s5(1)(a); s8(2)). The Order directs applications for an IP Ship Safety Certificate to AMSA and applies Division 3 of Marine Order 1 (Administration) 2013 (other than section 17) to those applications (s8(2)). The text also contemplates that other issuing bodies may act under the Navigation Act where authorised. Issuing bodies decide on issuance, endorsement, variation and revocation of certificates pursuant to the criteria set out in the Order (ss9-14). The issuing body may also impose additional conditions on a safety certificate as allowed under paragraph 100(2)(b) of the Navigation Act, which the Order references (s10 Note).

Foreign vessels: the Order requires foreign vessels to have a certificate issued in accordance with the IP Code and to comply with Chapter XV and the IP Code while in scope (ss15-16). However, Divisions 2 and 4 do not apply to foreign vessels (s6(b)). There is a transitional carve-out in s16(2) for some foreign vessels constructed before 1 July 2024 which were permitted by their Administration (their flag State) to carry more than 12 industrial personnel in accordance with an earlier interim IMO resolution; such vessels need only comply with certain IP Code regulations at their first intermediate or renewal survey after 1 July 2024 (s16(2)).

Ancillary services and markets: surveyors, classification societies, certifiers, training providers (BOSIET, GWO, AMSA‑approved courses), equipment manufacturers, and companies providing personnel transfer systems will be affected by the requirement for survey, endorsement, certification of transfer arrangements and the specified training. The Order’s conditions (s10) that require analyses of failures of transfer arrangements, manoeuvrability evaluations, equipment marking, record‑keeping and annual/periodical surveys (s10(1)(a)-(f); s10(2)) create recurring compliance spending for vessel operators and ongoing work for certifiers and trainers.

Employees and industrial personnel: persons carried as industrial personnel are affected positively in the sense that the Order mandates minimum training and familiarisation, medical/fitness documentation, age minimum and language capability (s18). The Order also places responsibilities on masters and owners to ensure safe transfer operations and adequate lighting, communications and unobstructed passage associated with transfers (s17 and s18).

Who ultimately pays: costs will be borne by owners and operators of regulated Australian vessels (capital and operating costs for modifications, transfer systems, surveys, training, and records) and, in practice, also by clients contracting crew transfer services if market contracts pass on costs. Issuing bodies and certifier fees (where charged) are also passed through to owners.

The Order prescribes specific duties for owners, masters and issuing bodies, and procedural rights in relation to certificate applications and administrative review.

Duties on owners and masters:

• Certificate duty: regulated Australian vessels must hold an IP Ship Safety Certificate where SOLAS Chapter XV requires it (s7). Owners must apply for the certificate to AMSA following the application rules in Marine Order 1 (s8(2)).
• Design, survey and certificate conditions: the vessel must meet the criteria in s9 for issuance, which includes holding relevant SOLAS or HSC certificates (s9(a)), meeting functional and Part IV/V IP Code requirements (s9(b)), and being surveyed according to section I/3 of the IP Code and certain SOLAS/HSC survey regulations (s9(c)). The certificate is subject to conditions included in s10(1)(a)-(i) such as personnel transfer appliance design and testing, failure-analysis, manoeuvrability evaluation, procedures for accurate counts and identity of industrial personnel, completion and endorsement of surveys, carriage of dangerous goods per SOLAS Chapter VII and approval for changes after survey (s10).
• Operational duties: s17(1) requires owners or masters to ensure personnel transfer appliances are kept clean, maintained, inspected and supervised by a responsible officer, operated by trained personnel, rigging and operations follow safety procedures, communications exist between the responsible officer and the navigation bridge, appliances are permanently marked, a record of use and maintenance is kept, checks are made before commencing transfer operations, safe unobstructed passage is provided, emergency lighting is provided, deck transfer areas are designated and free from obstructions, and a job safety analysis is carried out in planning and before transfer (s17(1)(a)-(k)).
• Voyage safety duties: s18(1) requires the master to ensure each industrial person is at least 16 years old and has acceptable documentary medical/fitness evidence, can communicate adequately in English or the working language, holds specified training certificates (BOSIET, GWO or AMSA‑approved equivalents), receives onboard familiarisation that includes vessel layout, life‑saving appliance locations, alarms and escape routes and receives transfer-specific familiarisation prior to transfer (s18(1)(a)-(e)).

Enforcement duties and rights:

• Strict liability offences: contraventions of the duties in ss17(1) and 18(1) are strict liability offences (ss17(2), 18(2)). The instrument specifies a penalty of 50 penalty units for breaches of s17(1) and for the requirements in s18(1) (see penalty notes in those sections).
• Civil penalties: owners and masters are liable to a civil penalty of 50 penalty units for contraventions (ss17(3), 18(3)).
• Administrative rights in certificate processes: applications to AMSA for the certificate are governed by Division 3 of Marine Order 1 (Administration) 2013 (other than s17), which prescribes general rules for applications (s8(2)). The Order notes that decisions about safety certificates are reviewable by the Administrative Appeals Tribunal under subsection 313(1) of the Navigation Act (s8 Note 2), so applicants have administrative review rights under federal administrative law rather than the internal-review provision of Marine Order 1.

Issuing body powers and duties:

• Issuing bodies (which may include AMSA acting as Administration) must survey vessels in accordance with IP Code section I/3 and the SOLAS/HSC survey requirements referenced in s9(c). They must endorse surveys on certificates (s10(1)(f); s12).
• Criteria for variation and revocation: issuing bodies vary certificates only where survey requirements of the IP Code are satisfied and, for certain matters, variation must be consistent with Regulation 14 of Chapter I of SOLAS or section 1.8 of the HSC Code (s13). Certificates may be revoked where they contain incorrect information, the owner requests revocation in writing, a condition has been or is likely to be breached, or the vessel ceases Australian registration (s14).
• Discretion to impose further conditions: the Order acknowledges that issuing bodies may impose other conditions on a safety certificate under paragraph 100(2)(b) of the Navigation Act (s10 Note).

Rights of industrial personnel:

• The Order does not create a private cause of action but imposes duties in favour of the safety of industrial personnel via the master’s and owner’s obligations for training, medical fitness, and familiarisation (s18). The statutory structure makes non-compliance a strict liability offence and a civil penalty exposure, giving regulators enforcement powers rather than direct individual remedies.

Administrative and procedural rights:

• Applicants for certificates may apply to an issuing body under s99 of the Navigation Act as implemented by the Order (s8(1)); the Order applies Marine Order 1 administrative rules (s8(2)) and preserves tribunal review rights (s8 Note 2). The Order also prescribes the form and content (Appendix form) for IP Ship Safety Certificates and the need to attach a record of equipment (s4).

The Order establishes a combination of strict liability criminal offences and civil penalty regimes for operational failures, and it interfaces with existing Navigation Act offences for failing to hold required certificates.

Penalties specified in the Order:

• For contraventions of s17(1) (personnel transfer appliances and arrangements obligations), the Order prescribes a penalty of 50 penalty units and states the offence is strict liability (ss17(1) penalty, 17(2)). It also specifies that the master or owner is liable to a civil penalty of 50 penalty units for contravention (s17(3)).
• For contraventions of s18(1) (requirements for the safety of industrial personnel during voyage), the Order prescribes a penalty of 50 penalty units, treats the offence as strict liability (s18(2)), and makes the master liable to a civil penalty of 50 penalty units for contravention (s18(3)).

The Order does not set the monetary value of a penalty unit; that is determined under the scales contained in federal penalty unit provisions and relevant to the time of any offence. The Order also notes that a vessel taken to sea without a required certificate may engage offences under sections 106 and 107 of the Navigation Act (s15 Note).

Enforcement actors and mechanisms:

• Criminal enforcement: strict liability offences are enforceable by prosecution, though strict liability reduces the prosecution burden by negating the need to prove mens rea for the particular contraventions specified. The Order does not itself prescribe prosecutorial discretion, which in practice rests with Commonwealth prosecutors and regulators.
• Civil penalties: the Order states the civil penalty amounts (50 penalty units) and specifies who is liable (owner and/or master depending on the provision). Civil penalty proceedings are administered under the civil penalty provisions of the Navigation Act and related federal procedures. The Order itself references the Navigation Act for the broader enforcement framework (s3 and the notes referencing Navigation Act sections).
• Administrative enforcement: issuance, endorsement, variation and revocation of the IP Ship Safety Certificate are administrative actions vested in issuing bodies under the Navigation Act. Grounds for revocation are listed in s14, and variation criteria are in s13. These administrative tools allow an issuing body to remove or limit a vessel’s certificate if survey standards or certificate conditions are not met.

Administrative review and rights of challenge:

• Decisions about safety certificates are reviewable by the Administrative Appeals Tribunal under subsection 313(1) of the Navigation Act, which the Order explicitly notes in s8 Note 2. Marine Order 1 internal review section 17 does not apply to decisions about safety certificates because of the statutory tribunal review path.
• Owners/applicants therefore have a tribunal-based review route against adverse administrative decisions (refusal, variation or revocation).

Interaction with SOLAS/flag State enforcement:

• For foreign vessels, the Order requires possession of a certificate issued in accordance with the IP Code (s15) and compliance with Chapter XV and the IP Code (s16). Enforcement of foreign vessels is therefore also a function of flag State certification and port State control mechanisms, and domestic enforcement may be exercised where foreign vessels enter Australian jurisdiction; the Order notes the possible criminal offences under the Navigation Act for a vessel taken to sea without a required certificate (s15 Note).

Practical enforcement considerations and implementation risk:

• The Order creates multiple enforcement touchpoints: pre-survey design and certification, in-service inspections (annual, periodical and intermediate surveys in accordance with IP Code section I/3), port State controls and prosecutions for operational breaches such as inadequate transfer arrangements or insufficient training/familiarisation (s10(1)(f); s17; s18). This multiplicity requires coordination between AMSA (as Administration and issuing body for Australian vessels), port State control authorities, classification societies and operators.
• Issuing bodies may impose additional conditions under the Navigation Act (paragraph 100(2)(b)), which can expand enforceable obligations beyond those expressly listed in the Order. That creates the risk of variable standards by issuing body and an enforcement burden to monitor compliance against potentially differing conditions.

The Order is explicitly designed to sit within the Navigation Act regulatory framework and to give force to international maritime instruments, meaning multiple legal instruments interplay in practical compliance.

Foundation statutes and instruments:

• Navigation Act 2012: the Order is made under subsection 342(1) of the Navigation Act (s3) and relies on the Navigation Act provisions that authorise regulations to provide for safety certificates, matters related to certificates, design and construction of vessels, giving effect to SOLAS and imposition of penalties (s3(1)(a)-(e)). The procedure for applying for certificates is tied to the Navigation Act application process and to Marine Order 1 administration provisions (s8(2)).
• SOLAS and IP Code: the Order gives effect to the IP Code in accordance with Chapter XV of SOLAS (s2). It imports many SOLAS and IP Code obligations by reference: survey requirements (s9(c) references IP Code section I/3 and SOLAS Ch I regs 8-10 or HSC Code sections), certificate validity harmonisation (s11 Note 1 referencing SOLAS reg 14 of Chapter I), and other functional requirements from the IP Code (s9(b), s10). Terms not defined in the Order obtain meanings from SOLAS, the HSC Code or the IP Code (s5(3)).
• Marine Orders: the Order cross-references other Marine Orders. Marine Order 1 (Administration) 2013 supplies administrative rules for certificate applications (s8(2)); Marine Order 31 (SOLAS and non-SOLAS certification) 2019 is called up for related safety certificate types required under SOLAS chapters I and VIII (s9(a)); Marine Order 49 (High-speed craft) 2015 is referenced for HSC Code requirements (s4 and s9(a)(ii)). Marine Order 58 (Safe management of vessels) 2020 is referenced in s17 Note 3 as the instrument setting out operational obligations under the International Safety Management Code for vessels to which Chapter IX of SOLAS applies.

Overlap and coordination with domestic occupational health and safety frameworks:

• The Order mandates minimum training, medical fitness and transfer safety measures for persons carried as industrial personnel, but it does not displace applicable workplace health and safety laws. The Order’s notes point to industry guidance such as IMCA and Seacare Authority’s Code of Practice for health and safety in shipboard work (s17 Note 1), indicating that compliance will likely require aligning vessel safety management systems with both the Order and any applicable national workplace health and safety obligations.

Interaction with flag State and port State regimes:

• For foreign vessels, the Order requires possession of a certificate issued in accordance with the IP Code (s15) and compliance with Chapter XV and the IP Code while in scope (s16(1)). However, the Order provides a limited transitional arrangement for some legacy foreign vessels constructed before 1 July 2024 (s16(2)). Where foreign vessels come into Australian jurisdiction, port State control measures may be used to verify compliance. The Order itself does not elaborate on port State enforcement mechanisms, but the referenced Navigation Act offences for sailing without required certificates apply (s15 Note).

Administrative review and dispute resolution:

• Decisions about safety certificates are reviewable by the Administrative Appeals Tribunal as provided under subsection 313(1) of the Navigation Act (s8 Note 2). The Order applies Marine Order 1 Division 3 administrative application rules (other than s17) for AMSA procedures (s8(2)). This gives applicants a statutory route to challenge administrative decisions about certificate refusals, cancellations, variations or endorsements.

Certification harmonisation and survey alignment:

• The Order instructs that IP Ship Safety Certificates must be harmonised with SOLAS certificates (s11 Note 1), meaning survey and validity dates are to be aligned in accordance with SOLAS reg 14 of Chapter I or HSC Code section 1.8. The Order requires that the vessel already carry other relevant SOLAS/HSC certificates before an IP Certificate can be issued (s9(a)), embedding certificate layering and coordination across different international instruments.

Rights to impose additional conditions:

• The Order acknowledges issuing body powers under the Navigation Act to impose other conditions on certificates (s10 Note). That creates an interaction whereby the baseline obligations set by the Order can be augmented administratively, meaning compliance may require tracking additional issuing body conditions beyond the Order’s text.

The instrument text supplied is the Marine Order 55 (Vessels carrying industrial personnel) 2024, made by the Chief Executive Officer of the Australian Maritime Safety Authority (AMSA) on 3 June 2024 and commencing 1 July 2024 (cover sheet and s1A). The Order explicitly cites its statutory basis in the Navigation Act 2012 and the specific provisions of that Act enabling AMSA to make the Marine Order (s3(1)). The Order also references the adoption of the IP Code by IMO Resolution MSC.527(106) as the international instrument it is given effect to (s4 note).

Within the text, the Order cross-references and integrates other existing Marine Orders and international instruments rather than amending them directly:

• Marine Order 1 (Administration) 2013 is applied by reference for administrative procedures on certificate applications (s8(2)). The Order carves out s17 of Marine Order 1 (internal review) on the basis that Administrative Appeals Tribunal review applies to safety certificates (s8 Note 2).
• Marine Order 31 (SOLAS and non-SOLAS certification) 2019 is cited for other safety certificate types necessary under SOLAS referenced by s9(a).
• Marine Order 49 (High‑speed craft) 2015 is used for bringing HSC Code certification into the criteria for an IP Ship Safety Certificate where applicable (s4; s9(a)(ii)).
• Marine Order 58 (Safe management of vessels) 2020 is referenced for the operational obligations under the ISM Code relevant to safe transfer arrangements (s17 Note 3).

The instrument appears to be a new Marine Order, identified as Marine Order 55 (Vessels carrying industrial personnel) 2024. The text does not identify superseded instruments or express amendments to existing Marine Orders, nor does it provide a table of statutory amendments. It instead fills a regulatory gap by statutorily implementing IP Code requirements through AMSA’s Marine Order mechanism.

Transitional arrangement and amendment implications:

• For foreign vessels constructed before 1 July 2024 and permitted by their Administration under IMO Resolution MSC.418(97) to carry more than 12 industrial personnel, the Order allows that certain IP Code regulations (III/1, III/2 except para 2.1.7, IV/7 and IV/8) need only be complied with at the first intermediate or renewal survey after 1 July 2024 (s16(2)). This is a temporal transitional concession that effectively staggers the compliance timeline for affected foreign vessels.

How future amendments would operate:

• The Order expressly gives effect to the IP Code "as in force from time to time" (s4 definition of IP Code). That means future amendments to the IP Code adopted at the IMO could be given effect domestically through the Order’s reference, subject to AMSA’s further action, and within the constraints of the Navigation Act. However, the Order leaves administrative discretion and procedural rules to Marine Order 1 and issuing bodies, so practical changes will often be implemented through AMSA administrative instruments or updated Marine Orders cross-referenced by this Order.

Availability and supporting materials:

• The Order includes notes on where to obtain the text of the IP Code and SOLAS and notes on AMSA delegation arrangements (s4 Note 3 and Note 4), indicating that implementation will rely on external documents and AMSA guidance. The Order also references industry guidance (s17 Note 1) which may be updated independently of the Marine Order.

In short, this Order constitutes a new, standalone Marine Order enacted in mid‑2024 that integrates and cross-references existing Marine Orders and international instruments. The Order’s design allows it to track changes in the IP Code in future, but the instrument itself establishes the domestic legal mechanics now in place for certification, survey and operational obligations relating to carrying industrial personnel.

The Marine Order 55 text supplied contains no judicial decisions, case law citations or recorded litigation concerning the Order itself. The instrument is a regulatory enactment that creates administrative decisions (issuance, variation and revocation of IP Ship Safety Certificates) and criminal/civil contraventions; any litigation arising from it will therefore predominantly be of two types: administrative review of issuing body decisions and civil or criminal enforcement proceedings.

Administrative review route:

• The Order notes that decisions about safety certificates are reviewable by the Administrative Appeals Tribunal under subsection 313(1) of the Navigation Act (s8 Note 2). That is the statutory pathway for challenging AMSA or issuing body decisions to refuse, vary or revoke safety certificates. Tribunal review is ordinarily available for reviewable federal administrative decisions and will focus on the lawfulness of the administrative decision, the facts as found by the decision‑maker, and the statutory scheme enacted by the Navigation Act and this Marine Order.

Potential grounds for administrative proceedings:

• Applicants or certificate holders dissatisfied with an issuing body’s decision could seek AAT review on grounds such as failure to follow the criteria set out in ss9-14 (survey requirements, conditions, variation criteria), procedural unfairness in application processing (Marine Order 1 administrative rules apply to AMSA decisions per s8(2)), or incorrect exercise of discretion in imposing conditions under paragraph 100(2)(b) of the Navigation Act (noted in s10).
• There is a carve-out in the Order of the internal review provision in Marine Order 1 (s17) specifically because safety certificate decisions are subject to tribunal review (s8 Note 2). The existence of a tribunal pathway shapes litigation strategy: parties would typically seek merits review in the AAT and judicial review in the Federal Court on questions of law.

Enforcement litigation:

• Prosecutions for strict liability offences under ss17 and 18 could produce litigation on issues such as whether the elements of the strict liability offence were proved, and whether any available defences in federal law apply. For civil penalty actions, litigation would address whether contraventions occurred and the appropriate penalty amount and liable party (owner, master).
• Administrative revocation or variation (ss13-14) could raise legal challenges if the issuing body is alleged to have misapplied the IP Code or SOLAS survey criteria, or failed to follow required survey procedures (s9(c); s10(1)(f); s12).

No reported cases in the instrument:

• Because the text supplied is the enacted Marine Order, it does not contain or reference any court or tribunal decisions applying it. Any litigation history will develop after enforcement activity and administrative decisions occur and is not present in the Order.

Practical implications for litigation risk:

• The Order’s mixture of administrative decisions (certificate issuance, endorsement, variation, revocation) with criminal strict liability offences and civil penalties creates two litigation exposure vectors: challenges to agency decisions and defence or contest in enforcement actions. Interested parties should note the availability of AAT review for administrative decisions and the statutory strict liability and civil penalty regimes for operational contraventions (ss8 Note 2; 17(2)-(3); 18(2)-(3)).

For present purposes, because the instrument itself contains no reported litigation, practitioners must rely on general administrative law principles and Navigation Act dispute resolution provisions when advising about potential legal remedies and defences.

This section flags specific provisions, interactions and practical traps in the Order that may catch operators, masters or certifiers if overlooked. Each "gotcha" is grounded in the Order’s text and associated notes.

1. Aggregation of numbers counts passengers and special personnel: Regulation 5 of Chapter XV and the Order’s note make clear that where the number of industrial personnel is used as a parameter, it means the aggregate number of industrial personnel, special personnel and passengers, and the number of passengers must not exceed 12 (s7 Note 2). Operators who treat passenger counts and industrial personnel separately may miscalculate whether the >12 threshold is reached and whether an IP Ship Safety Certificate is required.

2. Division 2 and 4 do not apply to foreign vessels: s6(b) excludes foreign vessels from Divisions 2 and 4, meaning the domestic certificate issuance regime and some operational provisions do not apply to foreign vessels. Instead, foreign vessels are dealt with under Div3 (ss15-16). Operators of foreign vessels must ensure their flag State certificate conforms to the IP Code, but they are not subject to the same domestic application procedures as regulated Australian vessels (ss6(b), 15).

3. Transitional relief for some foreign vessels only: s16(2) provides limited deferral of compliance with certain IP Code regulations for foreign vessels constructed before 1 July 2024 that were permitted to carry more than 12 industrial personnel under an earlier IMO interim recommendation. This relief applies only to particular IP Code regulations (III/1, III/2 except para 2.1.7, IV/7 and IV/8) and only until the first intermediate or renewal survey after 1 July 2024. Relying on a broader or longer transition than this would be an error.

4. Strict liability offences: contraventions of the operational duties in ss17(1) and 18(1) are strict liability offences (ss17(2), 18(2)). This reduces the prosecution’s need to prove fault and increases the importance of compliance systems and contemporaneous records (s17(1)(f) record keeping requirement). Operators and masters cannot rely on proving lack of mens rea to avoid liability for these particular contraventions.

5. Civil penalties assigned differently: s17(3) makes the master or owner liable to a civil penalty for contraventions of s17(1), while s18(3) makes the master liable to the civil penalty for contraventions of s18(1). Parties need to pay attention to which role is civilly liable for each duty. Contracts allocating responsibilities between owners and masters should be carefully structured to address this allocation.

6. Issuing body may impose additional conditions: while the Order sets out specific certificate conditions (s10), it also notes that issuing bodies may impose other conditions under the Navigation Act (paragraph 100(2)(b) referenced in s10 Note). This can lead to variability in the regulatory burden between certificates depending on issuing body practice; operators must review certificate text and not rely solely on the Marine Order.

7. Harmonisation and endorsement requirements: the Order requires annual/periodical/intermediate surveys in accordance with IP Code I/3 and endorsements on the certificate (s10(1)(f); s12). The IP Certificate’s validity must be harmonised with SOLAS certificates (s11 Note 1). Failure to harmonise survey cycles may create administrative non‑compliance issues.

8. Post‑survey changes require approval: s10(1)(i) requires approval by an issuing body for any change to structure, equipment, systems, fittings, arrangement or material covered by survey, other than direct replacement. Operators who retrofit or modify transfer equipment without prior approval risk breaching certificate conditions.

9. Training certificates must be in force: s18(1)(c) requires that the person have BOSIET, GWO BST, an AMSA‑approved equivalent, or AMSA‑approved safety training. Notes reference that certificates must be in force and not expired per Marine Order 1 s7 (s18 Note for (c)). Practitioners should not rely on expired training certificates.

10. Marking and recordkeeping obligations: s17(1)(e) requires permanent marking to identify each appliance for survey and record‑keeping, and s17(1)(f) requires a record of use and maintenance to be kept on board. Failure to maintain identification and a contemporaneous maintenance log is both an operational safety risk and an evidentiary disadvantage if defending strict liability or civil penalty proceedings.

11. Job Safety Analysis must consider environmental and equipment limits: s17(1)(k) mandates a job safety analysis before personnel transfer operations that accounts for environmental conditions and equipment limitations. A superficial checklist will not meet this standard; it must materially consider wave, wind and other operational constraints.

12. Language competence test is subjective but mandatory: s18(1)(b) requires industrial persons to "demonstrate adequate knowledge of English or the working language on board". The Order does not prescribe an objective test; this subjectivity can generate disputes about compliance while imposing a clear duty on masters to assess competence.

13. Narrow scope for foreign vessels under Div 3: because Divisions 2 and 4 do not apply to foreign vessels, certain procedural protections and domestic administrative pathways available to Australian vessels may not be available to foreign owners or masters, and reliance on flag State certification becomes critical (s6(b); s15-16).

14. Delegation and AMSA practice: the Order notes AMSA delegation arrangements are available on AMSA’s website (s4 Note 4). In practice, the way AMSA delegates or authorises issuing bodies and the internal AMSA approach to certificates will materially affect compliance timelines and documentary expectations, creating administrative risk if not anticipated.

Operators should map these practical "gotchas" to their vessel operations, certificate timelines, maintenance schedules and contractual arrangements with crews, clients and certifiers to avoid regulatory and operational interruption.

This section sets out a practical compliance checklist and process map based on the Order’s substantive prescriptions. Each step cites the specific provision that creates the obligation and outlines documentary or process actions to satisfy it.

1. Determine whether Chapter XV of SOLAS applies and whether your vessel meets the certificate threshold

• Check whether the vessel is a regulated Australian vessel subject to Chapter XV of SOLAS and whether Regulation 5 of Chapter XV requires an IP Ship Safety Certificate, typically where the vessel is a cargo vessel or high-speed cargo craft over 500 GT engaged on international voyages and carrying more than 12 industrial personnel (s6(a); s7 Note 1; s7 Note 2 on aggregation). If foreign, confirm the flag State certificate and whether Divisions 2 and 4 apply (s6(b); ss15-16).

2. Prepare for certificate application to AMSA and follow Marine Order 1 rules

• Lodge an application for an IP Ship Safety Certificate with AMSA as the issuing body under s8(1). Ensure you follow Division 3 of Marine Order 1 (Administration) 2013 other than s17, which governs application procedures (s8(2)). Assemble required supporting documents, including other SOLAS/HSC certificates required under s9(a).

3. Ensure prerequisite SOLAS/HSC certificates and survey programs are in place

• Confirm the vessel holds any SOLAS Chapter I/Chapter VIII or HSC Code certificates required by s9(a)(i)-(ii) before applying. Arrange surveys in accordance with IP Code section I/3 and applicable SOLAS/HSC survey regulations (s9(c); s10(1)(f)). Align survey dates with SOLAS-regulated certificates to satisfy harmonisation (s11 Note 1).

4. Meet IP Code functional and Part IV/V requirements

• Verify that the vessel, equipment and arrangements meet the functional requirements listed in Part II of the IP Code (subdivision and stability, machinery, electrical installations, fire safety, life-saving appliances and dangerous goods) and Part IV/V requirements as applicable (s9(b)). For carriage of dangerous goods ensure compliance with SOLAS Chapter VII (s10(1)(g)).

5. Personnel transfer arrangements: design, testing, analysis and marking

• Ensure personnel transfer appliances and arrangements are designed, constructed, tested, installed and suitable for the vessel arrangement to meet II/2.2.2 of the IP Code and any issuing body standards (s10(1)(a)-(b)). Prepare a failure analysis covering single failure, fire or flooding scenarios and provide solutions to ensure availability and safety (s10(2)(a)-(b); s10(1)(c)). Permanently mark each appliance for identification and retain a record of use and maintenance on board (s17(1)(e)-(f)).

6. Implement operational procedures and competent supervision

• Appoint a responsible officer with the defined practical and theoretical knowledge to supervise rigging, inspections and use of transfer arrangements (s4 definition; s17(1)(b)). Ensure mechanical equipment is operated by properly trained personnel and that safety procedures and communications between the supervising officer and the navigation bridge exist (s17(1)(b)-(d)).

7. Conduct job safety analyses and pre‑transfer checks

• Before any transfer at sea, carry out a job safety analysis that considers environmental conditions, operational and equipment limitations (s17(1)(k)). Prior to commencing transfer ensure the transfer arrangement functions correctly and that deck transfer areas are designated and free from obstructions (s17(1)(g); s17(1)(j)).

8. Provide lighting, communication and safe passage

• Ensure lighting to illuminate the transfer arrangements and the water below is available from the emergency source of power (s17(1)(i)). Provide means to ensure safe, unobstructed passage between transfer arrangements and accommodation/transport locations (s17(1)(h)) and a means of communication between the supervising officer and the navigation bridge (s17(1)(d)).

9. Maintain records and perform scheduled surveys and endorsements

• Keep on board a record of use and maintenance for transfer appliances (s17(1)(f)). Complete annual, periodical and intermediate surveys per IP Code section I/3 and ensure issuing body endorsements are placed on the IP Ship Safety Certificate (s10(1)(f); s12). Remember that after survey, any change other than direct replacement to the surveyed items requires issuing body approval (s10(1)(i)).

10. Ensure industrial personnel meet age, medical and training requirements

• The master must ensure each industrial person is at least 16 years old and possesses documentary evidence of physical and medical fitness acceptable to AMSA (s18(1)(a); s18 Note for (a)). Confirm that personnel can demonstrate adequate English or working language competence (s18(1)(b)). Require and verify BOSIET (OPITO), GWO BST, AMSA‑approved equivalent or AMSA‑approved safety training certificates and ensure they are current (s18(1)(c); s18 Note for (c)).

11. Provide onboard familiarisation and transfer-specific briefings

• Before leaving port or immediately after boarding provide safety familiarisation covering vessel layout, life-saving appliance locations, muster/embarkation stations, emergency escape routes and first aid stations, safety information and alarms, and actions on alarm or emergency (s18(1)(d)(i)-(iv)). Before transfer provide familiarisation in vessel procedures and any additional safety measures for transfer to another vessel or offshore facility (s18(1)(e)).

12. Monitor issuing body conditions and be ready for variable requirements

• Read the IP Ship Safety Certificate text carefully because issuing bodies may impose other conditions under paragraph 100(2)(b) of the Navigation Act as referenced in the Order (s10 Note). Compliance must meet both the Order’s minimum conditions and any additional issuing body's requirements.

13. Contracting and allocation of responsibilities

• Given the split civil penalty liabilities (s17(3) allows owner and master civil liability, s18(3) makes the master civilly liable), contracts between owners, managers and masters should allocate responsibility for training, medical checks, record keeping, transfer equipment maintenance and compliance costs, and should require indemnities or insurance to cover civil penalty exposure.

14. Prepare for administrative review rights

• If AMSA or an issuing body refuses, varies or revokes a certificate, understand that Administrative Appeals Tribunal review is available under the Navigation Act (s8 Note 2). Keep clear documentation of surveys, maintenance logs, training certificates and pre-transfer analyses to support appeal or defence.

15. Keep up with international and industry guidance

• Maintain copies of the IP Code, SOLAS amendments and relevant IMO resolutions, and follow industry guidance referenced in the Order (s4 Note 3; s17 Note 1). Keep an eye on delegation and AMSA guidance pages for procedural updates (s4 Note 4).

Practical checklist summary for boarding officers and masters:

• Verify each person’s age, medical documentation and training certificate (s18(1)(a)-(c)).
• Conduct and record safety familiarisation on boarding (s18(1)(d)).
• Ensure pre-transfer familiarisation and job safety analysis are completed and recorded (s17(1)(k); s18(1)(e)).
• Inspect and mark transfer appliances, check operation before starting transfer, maintain clear passage and lighting and confirm communication lines to the bridge (s17(1)(e)-(i); s17(1)(g); s17(1)(h)).
• Keep maintenance and use records onboard for inspection and evidentiary purposes (s17(1)(f)).

Compliance entails administrative preparation (certificate applications and surveys), technical work (design, marking, failure analysis and approvals), personnel training and documentation, and operational discipline (job safety analysis, checks and records). Each step maps to specific provisions in the Order and should be integrated into a vessel’s Safety Management System per Marine Order 58 and ISM Code expectations (s17 Note 3).
