Marine Order 52 (Yachts and training vessels) 2022

The Order organises responsibilities and technical standards around a handful of core concepts. Those concepts determine who must hold what certificate, the technical references to be applied, the role of issuing bodies, and the treatment of trainees.

1. Regulated Australian vessel and scope. The Order applies to regulated Australian vessels that are yachts or training vessels, and except for the large-yacht Certificate of Compliance and survey-specific rules, also applies to foreign yachts and training vessels in defined ways (s 5; Divisions 2, 3, 4). "Yacht" is a defined term: no cargo, not more than 12 passengers, and a commercial use related to sport or pleasure (s 4). "Training vessel" is also defined: not more than 12 passengers, may be sailing or motor, and operated to provide instruction of specific types (s 4). The definition of "trainee" expressly excludes passengers and seafarers for the purposes of this Order; which affects liability and regulatory classification (s 4).

2. Certificates and their categories. There are two principal certificate types created or specified by the Order:

   • Certificate of Compliance (large yacht) mandatory for Australian yachts of 24 m or greater in length (s 7). Its issuance criteria require the vessel, equipment and appliances to comply with Part A of the Red Ensign Group Yacht Code as modified for Australia (s 9(b)). Its duration and entry into force are tied to SOLAS Regulation 14 (s 12).
   • Certificate of Survey for a Yacht or Training Vessel required for Australian yachts or training vessels under 500 GT (s 15). The technical criteria for issue vary according to size and type, referencing the Red Ensign Group Yacht Code for yachts ≥24 m and otherwise using the criteria for a Cargo Vessel Certificate under Marine Order 31, with specific deviations and references to the USL and IS Codes for stability and subdivision (s 17).

3. Technical instruments and modifications. The Order explicitly prescribes compliance with Part A of the Red Ensign Group Yacht Code as modified for Australia, and identifies the Australian National Annex as the modifying instrument (s 2(b); s 4 definitions). It also imports standards and assessment approaches from SOLAS (Regulation 14, Chapter I, for timing and duration of certain certificates, s 12), the IS Code for intact stability references (s 4 definition of IS Code; s 18(b)), and the USL Code for watertight subdivision and intact stability in specified clauses (s 17(1)(b)(i)-(ii)).

4. Issuing bodies, application processes and review. Applications are made to issuing bodies, typically AMSA, and the process follows Division 3 of Marine Order 1 (Administration) 2013, except section 17 (internal review) does not apply because safety certificate decisions are reviewable under subsection 313(1) of the Navigation Act (ss 8(2), 16(2)). The Order notes practical expectations that the issuing body endorsing certificate updates is usually the same that issued the certificate (ss 11(2), 19(2)).

5. Equivalents. The Order allows an applicant to seek approval to use an equivalent to a stated requirement under the Marine Order 1 process, but AMSA must be satisfied the equivalent is at least as effective (s 6(1)-(2)).

6. Endorsements, surveys and survey records. Intermediate and annual surveys, and inspection of the outside of the bottom of a vessel, must be recorded as endorsements on the applicable certificate (ss 11(1), 19(1)). Certificates often last five years unless a shorter period is specified or other listed conditions occur (ss 12(2), 20(2)).

7. Training-specific obligations. Owners of training vessels must ensure trainees are carried solely for instruction, that training tasks include proper instruction, clear learning objectives and adequate supervision, and that trainees hold a valid Australian medical fitness certificate. Non-compliance exposes the owner to a criminal penalty of 50 penalty units, strict liability, and a civil penalty also of 50 penalty units (s 24).

8. Foreign vessel treatment. A foreign yacht ≥24 m must comply with Part A of the Red Ensign Group Yacht Code (s 23(1)). A smaller foreign yacht or training vessel must have at least one certificate or other documentary evidence attesting seaworthiness, area of operation, equipment and manning and demonstrating compliance with its flag administration (s 23(2)). Inspectors may have regard to the Red Ensign Group Yacht Code when inspecting foreign vessels certified as complying with it (s 23 note).

These core concepts link legal status (regulated Australian vessel, yacht, training vessel, trainee) to certificate obligations and to prescribed technical standards. The Order therefore converts international and domestic technical instruments into enforceable certificate criteria, sets administrative processes for application and endorsement, limits internal review pathways for certificate decisions, and creates specific owner duties concerning training activities.

This Order principally affects three groups: owners and masters of yachts and training vessels, issuing bodies (principally AMSA), and, to a more limited extent, foreign owners and masters of visiting yachts and training vessels.

1. Owners and operators of Australian regulated vessels. Owners of yachts and training vessels that are regulated Australian vessels are the primary duty-holders under the Order. They must ensure the vessel holds the prescribed certificate: a Certificate of Compliance (large yacht) if the vessel is a yacht 24 m or more (s 7); a Certificate of Survey for a Yacht or Training Vessel if the vessel is a yacht or training vessel under 500 GT (s 15). Owners must maintain the vessel, equipment and appliances to comply with the relevant standards while a certificate is in force (s 10; s 18(a)). Owners of training vessels must also ensure trainees are carried only for specified instructional purposes, that trainees receive proper instruction, have clear learning objectives, are adequately supervised by competent and qualified personnel familiar with the vessel’s business, and that trainees have a valid Australian medical fitness certificate (s 24(1)(a)-(c)). Non-compliance attracts a criminal penalty and civil penalty (s 24(1), (3)).

2. Masters and crew. Masters have operational responsibilities arising from the Navigation Act offences referenced in the Order. The Order notes the Navigation Act makes it an offence to take a vessel to sea without a required certificate (notes to ss 7 and 15), and for foreign vessels the owner and master may commit offences for taking the vessel to sea without appropriate documents or for taking an unseaworthy vessel to sea (s 23 note 2). For training tasks, supervision must be provided by competent and qualified personnel familiar with the business of the vessel (s 24(1)(b)(iii)), placing onus on operators to allocate crew to supervision duties.

3. Issuing bodies and AMSA. The Order frames AMSA as the issuing body for these certificates in practice and as the agency with discretion to approve equivalents and impose certificate conditions (s 6(2); ss 8, 16 referring to AMSA application processes). The Order also references the practical expectation that endorsements and survey endorsements will be made by the original issuing body (ss 11(2), 19(2)). AMSA decides applications under the process in Marine Order 1 Division 3 and may be required to be satisfied on technical matters such as damage stability calculations (s 17(2)).

4. Trainees. The Order defines trainees (s 4) and explicitly states they are not seafarers or passengers, and that they are not passengers despite contributing to the cost of a voyage. This affects the regulatory classification of persons aboard a training vessel and the legal duties owed to them. The order requires trainees to hold an Australian certificate of medical fitness before boarding a training vessel (s 24(1)(c)).

5. Foreign owners, masters and vessels. The Order regulates foreign vessels to a limited extent. A foreign yacht 24 m or more must comply with Part A of the Red Ensign Group Yacht Code (s 23(1)). A foreign yacht under 24 m or a foreign training vessel must carry at least one certificate or other documentary evidence attesting seaworthiness and operational details (s 23(2)). The Order notes inspectors may have regard to the Red Ensign Group Yacht Code when inspecting foreign vessels certified as complying with it (s 23 note 2). The Navigation Act offences that penalise taking an uncertified or unseaworthy foreign vessel to sea remain engaged (s 23 note 2).

6. Surveyors and technical staff. Surveyors who conduct initial, intermediate and annual surveys are affected because their inspections must be endorsed on the relevant certificate (ss 11(1), 19(1)). For vessels requiring damage stability calculations, issuing bodies must check those calculations in context of design characteristics and possible damaged compartments (s 17(2)). The Order’s technical cross-references require surveyors to apply the Red Ensign Group Yacht Code, USL Code and IS Code provisions where applicable (ss 9, 17, 18).

7. Legal and compliance advisors, insurers and financiers. While not named in the instrument, these professional actors will be affected because compliance with the Order determines certificates that can affect seaworthiness findings, liability exposure, insurance cover and the legal ability to operate commercially. For example, missing required endorsements or failing to maintain equipment per conditions may lead to certificate revocation under specified criteria (ss 14, 22), which in turn can trigger insurance consequences or charter restrictions.

Who pays and who decides. Owners and operators bear the direct compliance costs: arranging surveys, maintaining equipment to the prescribed standards, procuring medical certificates for trainees, and applying for certificates and endorsements with AMSA or other issuing bodies (ss 8, 16; s 24(1)(c); ss 11, 19). AMSA or an authorised issuing body decides on applications, approves equivalents where demonstrated to be at least as effective, and can revoke certificates on stated grounds (s 6; ss 13, 21; ss 14, 22).

In short, the Order mostly imposes duties on owners and operators of defined yachts and training vessels, tasks AMSA and issuing bodies with certification and equivalence decisions, and imposes penalties and endorsement requirements tying survey practice into the certificate lifecycle.

This section lists the principal legal duties imposed by the Order, and the procedural rights and decision pathways available to regulated parties as specified in the text.

Key duties

1. Certification duties.

   • Owners of regulated Australian yachts 24 m or more must ensure the vessel holds a Certificate of Compliance (large yacht) (s 7).
   • Owners of regulated Australian yachts or training vessels under 500 GT must ensure the vessel holds a Certificate of Survey for a Yacht or Training Vessel (s 15).
   • A foreign yacht ≥24 m must comply with Part A of the Red Ensign Group Yacht Code (s 23(1)). Foreign yachts <24 m and foreign training vessels must carry at least one certificate or other documentary evidence attesting seaworthiness, area of operation, equipment and manning, and compliance with their flag administration (s 23(2)).

2. Technical and maintenance duties.

   • A Certificate of Compliance (large yacht) is subject to the condition that the vessel, its equipment and appliances are maintained to comply with the Red Ensign Group Yacht Code as modified for Australia (s 10).
   • A Certificate of Survey for a Yacht or Training Vessel is similarly subject to maintenance to comply with the requirements for issue (s 18(a)).

3. Survey and endorsement duties.

   • Each intermediate and annual survey and inspection of the outside of the bottom must be endorsed on the relevant certificate by the issuing body (ss 11(1), 19(1)).
   • Any change to structure, equipment or arrangements that were part of a required survey, other than direct replacement of equipment or fittings, must be approved by an issuing body after the required survey is completed (s 18(c)).

4. Technical compliance duties specific to vessel type.

   • Yachts ≥24 m must comply with Part A of the Red Ensign Group Yacht Code as modified for Australia to obtain the Certificate of Compliance (s 9(b)).
   • Other yachts and training vessels follow Cargo Vessel Survey criteria in Marine Order 31, with specified exceptions and with stability treatment under the USL Code and IS Code where relevant (s 17(1)(b)-(d), s 18(b), s 17(2)).

5. Training vessel owner duties.

   • For training vessels, owners must ensure trainees are carried only for specified training purposes and must ensure proper instruction, clear learning objectives and adequate supervision by competent, qualified personnel (s 24(1)(a)-(b)).
   • Owners must ensure trainees have a valid Australian medical fitness certificate (s 24(1)(c)).

6. Documentation duties for foreign vessels.

   • Foreign small yachts and training vessels must carry documentary proof meeting the specified content requirements (s 23(2)).

Key rights and procedural provisions

1. Application and issuing process.

   • Applicants apply for certificates to issuing bodies under the application process in Division 3 of Marine Order 1 (Administration) 2013, except that internal review under section 17 of that Order does not apply to safety certificates because decisions are reviewable under subsection 313(1) of the Navigation Act (ss 8(2), 16(2)). The Order therefore channels administrative decision-making through AMSA's application processes while preserving statutory review rights under the Navigation Act.

2. Right to seek equivalents.

   • A person may apply, following Division 3 of Marine Order 1, for approval to use an equivalent to a requirement. AMSA may approve only if satisfied the equivalent is at least as effective as the original requirement (s 6(1)-(2)).

3. Variation and revocation criteria.

   • Variation of certificates follows the Navigation Act criteria; for the Certificate of Compliance (large yacht), the variation criteria require compliance with Marine Orders and, where duration is varied, compliance with SOLAS Regulation 14 requirements for duration and extensions as if it were a SOLAS certificate other than a Passenger Vessel Safety Certificate (s 13(a)-(b)). For Certificates of Survey for yachts and training vessels, variations to duration must comply with section 22 of Marine Order 31 as if the vessel had a Cargo Vessel Certificate (s 21(b)).
   • Grounds for revocation are specified. For the Certificate of Compliance (large yacht), revocation can occur where the vessel does not comply with the Red Ensign Group Yacht Code as modified for Australia, where a certificate condition is or is suspected to be breached, where a required endorsement has not been made, where the vessel ceases to be registered in Australia, where the owner requests revocation, or where the certificate contains incorrect information (s 14(a)-(f)). Parallel grounds apply for Certificates of Survey (s 22).

4. Endorsements and surveillance continuity.

   • The Order contemplates that the same issuing body will, as a practice, endorse the certificate over time, helping provide continuity of record-keeping, though this is phrased as practice rather than a mandatory rule (ss 11(2), 19(2)).

5. SOLAS and other international code integration.

   • Certain aspects of certificate commencement and duration are determined by SOLAS Regulation 14 and other international codes referenced in the Order, which alters the domestic administrative application of those certificates (s 12(1)-(2); s 17 references).

6. Penalty framework for training vessels.

   • The owner of a training vessel that breaches the owner duties in s 24 is subject to a criminal penalty of 50 penalty units, a strict liability offence, and also a civil penalty of 50 penalty units (s 24(1)-(3)).

Who decides and evidence burden. AMSA and issuing bodies decide on certificate applications and equivalents under the Marine Order 1 application process. The issuing body must be satisfied on technical matters such as damage stability calculations as required (s 17(2)). Where an equivalent is proposed, AMSA bears the administrative right to approve only when satisfied equivalence is "at least as effective" (s 6(2)), creating an evidentiary burden on an applicant to demonstrate equivalence.

In summary, the Order imposes duties on owners and operators to secure and maintain certificates and to supervise and medically certify trainees; it specifies the technical pathways to satisfy issuing bodies, preserves statutory review avenues under the Navigation Act, and allows AMSA discretion to accept approved equivalents under a strict "at least as effective" test.

Marine Order 52 itself prescribes one explicit criminal and one civil penalty, and otherwise ties enforcement to the Navigation Act framework which contains offences relating to the carriage and operation of uncertified or unseaworthy vessels. The Order also sets procedural triggers for endorsements, revocation and inspection which feed into enforcement outcomes.

1. Express penalties in the Marine Order.

   • Section 24 establishes both a criminal penalty and a civil penalty tied to obligations specific to training vessels:

     • A breach of s 24(1) (training vessel owner duties to ensure trainees are carried only for specified purposes; that trainees are provided proper instruction, clear learning objectives and adequate supervision; and that trainees have a valid Australian medical certificate) is a criminal offence with a penalty of 50 penalty units (s 24(1) final line).
     • Subsection 24(2) specifies that an offence against subsection (1) is a strict liability offence.
     • Subsection 24(3) establishes a civil penalty for contravening subsection (1), also 50 penalty units.

   • The Order does not convert penalty units into monetary amounts; penalty units must be interpreted under the relevant Commonwealth penalty unit value regime.

2. Offences referenced via the Navigation Act.

   • The Order repeatedly notes that taking a vessel to sea without a required safety certificate is an offence under sections 103 and 104 of the Navigation Act (notes to ss 7 and 15). It also references that for foreign vessels, the owner and master may commit offences for taking a foreign vessel to sea without appropriate documents and for taking an unseaworthy vessel to sea, citing sections 106, 107, 109 and 110 of the Navigation Act (s 23 note 2). Those Navigation Act provisions are not reproduced in the Order but are explicitly referenced as operative enforcement mechanisms.

3. Certificate revocation as enforcement outcome.

   • The Order specifies objective grounds for revocation of certificates. For Certificates of Compliance (large yacht), revocation criteria include failure to comply with the Red Ensign Group Yacht Code as modified for Australia, breach or suspected breach of certificate conditions, missing required endorsements, loss of Australian registration, owner request, and incorrect certificate information (s 14(a)-(f)). For Certificates of Survey for a Yacht or Training Vessel, similar grounds for revocation are provided (s 22(a)-(e)). Revocation is therefore an administrative enforcement tool permitted under the Navigation Act framework that issuing bodies may exercise on stated criteria.

4. Inspection and endorsement enforcement linkages.

   • The Order mandates endorsements on certificates after intermediate and annual surveys and after inspection of the outside bottom (ss 11(1), 19(1)). Absence of required endorsements is itself cited as a ground for revocation (s 14(c), s 22(b)). This creates a mechanical compliance pathway: failure to produce or record the necessary survey endorsements can lead to certificate revocation and to the Navigation Act offences for taking an uncertified vessel to sea.

5. Enforcement discretion and AMSA role.

   • AMSA is an issuing body with discretion to approve equivalents, endorse certificates, and enforce the Order through revocation and through referencing Navigation Act offences (s 6; ss 11, 19; ss 14, 22). The Order channels administrative decision-making through AMSA and issuing bodies, but preserves statutory enforcement tools in the Navigation Act which carry criminal penalties beyond those specified in s 24.

6. Strict liability and evidentiary consequences.

   • The strict liability treatment of the training vessel owner offence (s 24(2)) reduces the prosecution's burden to prove mens rea, meaning that an owner may be convicted without proof of intentional or reckless conduct. This increases the enforcement potency of s 24 but does not change the maximum sanction which is specified at 50 penalty units.

7. Practical enforcement signals.

   • The Order’s repeated linkage of certificate conditions to international codes and to SOLAS Regulation 14 for commencement and duration (s 12) suggests that inspectors will look for both documentary compliance and technical adherence to referenced codes. The Order’s notes indicate inspectors may have regard to the Red Ensign Group Yacht Code when inspecting foreign vessels certified as complying with it (s 23 note 2), providing a line-of-sight enforcement expectation for both domestic and visiting vessels.

In practice, enforcement is therefore a mix of:

• statutory offences under the Navigation Act for taking vessels to sea without certification or taking unseaworthy vessels to sea;
• administrative enforcement by AMSA or issuing bodies via revocation or refusal to renew, or by imposing conditions and endorsements; and
• a standalone criminal/civil penalty pair specific to training vessel owner obligations with 50 penalty units and strict liability (s 24).

Regulated parties should therefore expect that enforcement can be documentary (endorsements, certificates), technical (surveys, stability calculations), and behavioural (training supervision and medical certification for trainees), with the potential for both administrative and criminal/civil sanctions depending on the contravention.

Marine Order 52 expressly integrates and cross-references the Navigation Act 2012, other Marine Orders, international instruments and Australian technical annexes. Understanding those interactions is essential for determining applicable standards, review rights, and certificate lifecycles.

1. Navigation Act 2012

   • The Order is made under subsection 342(1) of the Navigation Act and relies on multiple navigation-act powers described in s 3. It converts the regulatory capacity under sections 98, 314, 339, 341 and 342 into specific certificate requirements and criteria (s 3(1)(a)-(f)). The Order therefore functions as a Marine Order made under the Act, and procedural paths for review are determined by the Act: safety certificate decisions are reviewable under subsection 313(1) of the Navigation Act, which is why internal review under section 17 of Marine Order 1 does not apply to safety certificate applications (ss 8(2), 16(2)).

   • The Order also references Navigation Act offences: taking a vessel to sea without a required safety certificate is an offence under sections 103 and 104 of the Navigation Act (notes to ss 7 and 15). For foreign vessels, the Order references sections 106, 107, 109 and 110 regarding required documents and seaworthiness (s 23 note 2).

2. Marine Order 1 (Administration) 2013

   • The application and approval processes for certificates are governed by Division 3 of Marine Order 1 (Administration) 2013, except that section 17 (internal review) is excluded for safety certificates because they are reviewable under the Navigation Act (ss 8(2), 16(2)). Section 6 of this Order references that equivalents applications follow Division 3 of Marine Order 1 and the definition of equivalent and use are located in Marine Order 1 (s 6(1) and note).

3. Marine Order 31 (SOLAS and non-SOLAS certification) 2019

   • The Order cross-references Marine Order 31 for several matters:
     • Yacht ≥24 m is also required to hold certificates mentioned in Marine Order 31, and may be required to have other certificates under other Marine Orders as set out in Table 1 to the Australian National Annex (s 7 note 3).
     • For other yachts or training vessels, the criteria for issue of a Certificate of Survey are to comply with the criteria for issue of a Certificate of Survey for a Cargo Vessel under Marine Order 31, except for stated differences (s 17(1)(b)).
     • Variation of duration for a Certificate of Survey is to comply with section 22 of Marine Order 31 as if the vessel had a Certificate of Survey for a Cargo Vessel (s 21(b)).

4. International instruments: SOLAS, Red Ensign Group Yacht Code, IS Code, USL Code

   • The Order requires compliance with Part A of the Red Ensign Group Yacht Code as modified for Australia for yachts ≥24 m and, for foreign yachts ≥24 m, requires compliance with Part A (s 2(b); s 9(b); s 23(1)). The Australian National Annex is defined and is the modifying instrument (s 4).
   • Regulation 14 of Chapter I of SOLAS is specifically invoked to determine when a Certificate of Compliance (large yacht) comes into force and as to the duration (s 12(1)-(2)), and to frame duration variation requirements (s 13(b)).
   • The IS Code is referenced for intact stability requirements in certain contexts (s 4 definition of IS Code; s 18(b)).
   • The USL Code is referenced for watertight subdivision of Class 2 vessels where the vessel does not comply with certain SOLAS regulations, and for intact stability criteria for sailing vessel types in certain clauses of section 8C (s 17(1)(b)(i)-(ii); s 17(1)(b)(ii)(A)-(B)).

5. Interaction with certificate systems and survey regimes

   • The Order creates a layered certification system where yachts may be subject to multiple certificates: the Certificate of Compliance (large yacht), Certificate of Survey for a Yacht or Training Vessel, and certificates required by Marine Order 31 (s 7 note 3; s 15 notes). Those overlapping certification requirements mean compliance must be coordinated across instruments and issuing bodies.

6. Administrative review and appeal

   • Decisions about safety certificates are reviewable under subsection 313(1) of the Navigation Act rather than by internal review under Marine Order 1 section 17, which channels review to the statutory regime in the Navigation Act (ss 8(2), 16(2)). The Order therefore deliberately integrates certificate decisions with Navigation Act review rights rather than duplicating internal administrative review processes.

7. Delegation and administrative practice

   • The Order notes that delegation of AMSA’s powers under the Order is addressed on the AMSA website (s 4 note 3). This signals that operational implementation , who within AMSA, or authorised external issuing bodies such as Recognised Organisations, may make determinations , is a matter of AMSA administrative practice and delegation arrangements.

8. Evidence and inspection interplay

   • Inspectors under the Navigation Act are directed, via the Order’s references and notes, to consider the Red Ensign Group Yacht Code when inspecting foreign vessels that claim compliance with it (s 23 note 2). The Order therefore provides guidance to inspectors about documentary and technical materials to be considered under the broader Navigation Act inspection regime.

Overall, the Order does not operate in isolation. It converts international technical standards into domestic conditions of certification, integrates the certificate lifecycle with SOLAS processes for certain certificates, prescribes where Marine Order 1 and Marine Order 31 procedures apply, and embeds certificate decisions within the Navigation Act’s review and enforcement framework.

The instrument itself provides a short amendment history in its preliminary provisions. This section records and explicates what the Order changes institutionally and procedurally.

1. Repeal and replacement.

   • Marine Order 52 (Yachts and training vessels) 2022 expressly repeals Marine Order 52 (Yachts and training vessels) 2016 (s 1B). The new Order commences on 1 January 2023 (s 1A). The cover header records the making of the Order by the CEO of AMSA, Michael Kinley, on 15 December 2022.

2. Shift in technical anchoring and references.

   • The 2022 Order confirms explicit prescription of Part A of the Red Ensign Group Yacht Code as modified for Australia for yachts ≥24 m (s 2(b); s 9(b)). The Order also references the Australian National Annex as the relevant modifying document (s 4). While the 2016 Order text is not contained in this instrument, the 2022 Order’s textual emphasis on the Red Ensign Group Yacht Code, specific references to SOLAS Regulation 14 for certificate commencement and duration, and explicit integration of the IS Code and USL Code criteria indicate a continued anchoring to international instruments with clarified cross-references.

3. Application and process changes.

   • The Order clarifies application processes by directing applicants to Division 3 of Marine Order 1 (except section 17) for Certificate of Compliance (large yacht) and for Certificate of Survey for a Yacht or Training Vessel (ss 8(2), 16(2)). It therefore continues the approach of integrating administrative application processes under Marine Order 1 but removes the internal review pathway in that instrument for safety certificates because these are reviewable under subsection 313(1) of the Navigation Act (ss 8(2), 16(2)). This procedural clarification may represent a change in how applicants pursue administrative review, by consolidating review rights under the Navigation Act rather than Marine Order 1 internal review.

4. Technical clarifications on stability and survey.

   • The Order sets out explicit approaches to intact stability assessment and damage stability arrangements for certain yachts and training vessels, including requiring issuing bodies to check damage stability calculations that account for design characteristics and possible damaged compartments (s 17(2)). It also identifies specific intact stability clauses from the USL Code for monohulls and multihulls for sailing vessels under certain circumstances (s 17(1)(b)(ii)(A)-(B)). The explicitness of these requirements reflects a technical tightening or clarification of surveyor responsibilities.

5. Training vessels obligations and penalties.

   • Section 24 sets out owner duties specific to training vessels and attaches a 50 penalty unit criminal penalty and civil penalty, and declares the criminal offence strict liability (s 24(1)-(3)). Whether this is a substantive change from the 2016 instrument cannot be stated from the current text alone, but the inclusion of a clearly stated strict liability offence and identical civil penalty represents a formal articulation of training-specific enforcement consequences in the 2022 Order.

6. Equivalents and AMSA discretion.

   • Section 6 reiterates the process for seeking equivalents and reiterates AMSA’s requirement to be satisfied that an equivalent would be at least as effective as the requirement. This confirms that AMSA retains discretion to approve alternative compliance solutions, but only subject to a substantive "at least as effective" test.

7. Interplay with Marine Order 31 and other Marine Orders.

   • The Order clarifies that yachts ≥24 m that need a Certificate of Compliance may also be required to hold certificates under Marine Order 31 and other Marine Orders as set out in the Australian National Annex (s 7 note 3). The incorporation of Table 1 reference to the Australian National Annex suggests that certificate requirements and cross-instrument obligations are consolidated in the Annex.

8. No express prior amendment entries within the text.

   • The Order does not list a schedule of previous amendments; rather it repeals the 2016 Order and replaces it with the 2022 instrument. The instrument therefore represents a consolidated rewrite effective 1 January 2023.

In sum, the explicit amendment history contained in the Order is limited to the repeal of the 2016 Order and the commencement date. Procedural and technical clarifications in the instrument, alignment with Division 3 of Marine Order 1 for applications with the internal review caveat, explicit references to SOLAS Regulation 14, IS Code and USL Code clauses, and clear training vessel penalties, represent the substantive mechanics of what has been changed or reasserted for the 2022 regime.

The Marine Order text contains no references to judicial decisions or litigation arising under this instrument. The document itself names neither judgments nor administrative appeals that have tested its provisions. Where the Order discusses reviewability, it directs that decisions about safety certificates are reviewable under subsection 313(1) of the Navigation Act rather than by internal review under Marine Order 1 section 17 (ss 8(2), 16(2)). Thus, the Navigation Act’s review procedure is the statutory avenue for challenge to issuing body decisions in respect of safety certificates as contemplated by the Order.

Given the Order’s reliance on the Navigation Act review mechanism, any litigation or administrative review that challenges AMSA decisions under this Order would proceed under the procedural framework and grounds set out in the Navigation Act and in relevant administrative law principles. However the text does not provide examples of such proceedings or judicial interpretations.

Where the Order references offences in the Navigation Act (for example, sections 103, 104, 106, 107, 109 and 110) it does so to indicate existing offences that will be triggered by non-compliance with certificate requirements (notes to ss 7 and 15; s 23 note 2). The Order therefore anticipates administrative and criminal enforcement actions under the Navigation Act but does not recount any prior litigation or case law.

In practice, if a regulated party wished to challenge a certificate refusal, variation, or revocation under this Order, the appropriate review path identified in the instrument is the Navigation Act’s reviewability provision at subsection 313(1). Any outcomes, judicial consideration of the Order’s interaction with SOLAS, the Red Ensign Group Yacht Code, Marine Orders 1 and 31, or AMSA’s exercise of discretion on equivalents would be matters for courts or tribunals considering administrative law and maritime safety statutory interpretation. None of those decisions or precedents are recorded in the instrument itself.

Therefore the litigation history section is empty in the sense that the instrument does not record or cite litigation. Practitioners should therefore consult Navigation Act jurisprudence and any subsequent judicial or tribunal decisions post-commencement for case law that applies these provisions.

This section highlights points where regulated parties commonly stumble, where the Order creates non-obvious obligations, and where procedural traps may arise. Each "gotcha" is grounded in the Order’s text.

1. Classification matters, and commercial use can determine regulatory treatment (s 4).

   • The definition of "yacht" includes the element "has a commercial use that is related to the provision of a sport or pleasure activity" (s 4). A vessel might be commercially used in ways that are borderline between private pleasure craft and charter operations offering sport or pleasure activities. Misclassification can trigger additional certificate obligations. Operators should not assume non-regulated status based on superficial descriptions; instead, classify the vessel against the Order’s definition.

2. A trainee is neither a seafarer nor a passenger (s 4).

   • The Order explicitly states a trainee is not a seafarer or a passenger and that a trainee is not a passenger despite any contribution to voyage cost (s 4). This reclassification affects crew training, duty of care, insurance and manning requirements. Operators who treat trainees as passengers or seafarers for administrative convenience may overlook training-specific obligations and the medical certificate requirement in s 24(1)(c).

3. Training vessel size thresholds interact with large-yacht requirements (ss 4, 7).

   • A training vessel that is 24 m or larger may be treated as a yacht ≥24 m for Certificate of Compliance purposes because the definition of "yacht" can include training vessels in certain commercial roles (s 7 note 2 referencing definition of yacht in s 4). That can unexpectedly elevate certificate and SOLAS-related requirements.

4. Multiple certificates may be required concurrently (ss 7, 15; s 7 note 3; s 15 note 2).

   • The Order notes that a yacht ≥24 m will also be required to hold certificates mentioned in Marine Order 31 and possibly other Marine Orders (s 7 note 3). Similarly, a vessel with a Certificate of Survey for a Yacht or Training Vessel may also be required to have other certificates (s 15 note 2). Failure to consider the full matrix of certificates referenced in Marine Order 31 and the Australian National Annex can leave operators inadvertently non-compliant.

5. Endorsements are mandatory and absence is actionable (ss 11(1), 19(1); ss 14(c), 22(b)).

   • The Order requires that intermediate and annual surveys and inspection of the outside of the bottom be endorsed on the certificate (ss 11(1), 19(1)). Failure to have required endorsements is itself a ground for revocation (s 14(c); s 22(b)). Operators must proactively ensure these endorsements are completed and recorded by the issuing body.

6. Duration and SOLAS timing links might be non-intuitive (s 12(1)-(2), s 13(b)).

   • For Certificates of Compliance (large yacht), the certificate comes into force and its duration are governed by Regulation 14 of Chapter I of SOLAS (s 12). Variations to duration must comply with SOLAS requirements for duration and extension as if the certificate were a SOLAS certificate (s 13(b)). Practitioners must therefore be familiar with SOLAS timing rules to manage renewals and extensions.

7. Equivalents require AMSA satisfaction of "at least as effective" (s 6(2)).

   • While equivalents are permitted, AMSA may approve them only if satisfied the alternative is at least as effective as the original requirement (s 6(2)). Applicants should expect to provide substantive technical evidence demonstrating equivalence; a superficial substitution is unlikely to succeed.

8. Stability and subdivision are technical and specific (s 17(1)(b), (2); s 18(b)).

   • For vessels not subject to the Red Ensign Group Yacht Code, the Order relies on USL Code and Marine Order 31 Cargo Vessel Survey criteria with specific exceptions. The issuing body must check damage stability calculations that account for vessel design, compartment arrangements and contents that may be damaged (s 17(2)). Surveyors and owners must ensure calculations and documentation are precise and specifically address the Order’s requirements.

9. Training vessel obligations carry strict liability (s 24(2)).

   • The criminal offence for contravening s 24(1) is strict liability (s 24(2)). Owners cannot rely on lack of intent or mistake of fact to avoid criminal liability. This raises the stakes for compliance systems, supervision adequacy and record-keeping in relation to training tasks.

10. Medical certificates for trainees must be Australian and current (s 24(1)(c)).

    • The Order requires a trainee to have a valid certificate of medical fitness from a person registered as a medical practitioner in a State or Territory of Australia (s 24(1)(c)). Foreign medical certificates may not satisfy this requirement. Operators who carry international trainees must ensure Australian-recognised medical certification is obtained.

11. Foreign vessel documentary requirements are minimum and subject to inspection assessment (s 23(2) and notes).

    • Foreign yachts <24 m and foreign training vessels must have at least one certificate or documentary evidence attesting seaworthiness, area of operation, equipment and manning, and compliance with flag administration requirements (s 23(2)). Inspectors may nevertheless refer to the Red Ensign Group Yacht Code when examining foreign vessels claiming compliance (s 23 note 2). Documentary compliance does not preclude an inspection-based finding of non-compliance.

12. Revocation may be owner-requested or triggered by incorrect information (ss 14(e), 22(d)-(e), 14(f), 22(e)).

    • Certificates can be revoked at the request of an owner or where the certificate contains incorrect information (s 14(e)-(f); s 22(d)-(e)). Operators should ensure certificate data is accurate and manage revocation requests carefully.

13. Interplay with other Marine Orders and SOLAS may create overlapping or conflicting obligations.

    • The Order expects operators to consult Table 1 of the Australian National Annex and Marine Order 31 for other certificate requirements and duration rules (s 7 note 3; s 15 note 2). Overlooking these cross-references can result in non-compliance despite adherence to the yacht/training vessel-specific provisions.

These "gotchas" point to the need for precise vessel classification, carefully managed surveys and endorsements, technical evidence for stability and equivalents, Australian medical certification for trainees, and a compliance system that anticipates administrative revocation mechanics and strict liability exposure for training vessel obligations.

This section provides a practical, source-grounded checklist and compliance pathway for owners, masters, issuing bodies and advisors. Each step references the relevant provisions of Marine Order 52 and associated procedural instruments named in the Order.

1. Determine vessel classification and applicable thresholds.

   • Confirm whether the vessel is a regulated Australian vessel and whether it is a "yacht" or a "training vessel" under the Order’s definitions in section 4.
   • Measure length to determine whether the 24 m threshold applies for a Certificate of Compliance (large yacht) (s 7) and determine GT for the <500 GT Certificate of Survey requirement (s 15).

2. Identify required certificates.

   • If the vessel is a yacht ≥24 m, prepare to apply for a Certificate of Compliance (large yacht) (s 7). Note the vessel may also require certificates listed in Marine Order 31 and Table 1 of the Australian National Annex (s 7 note 3).
   • If the vessel is a yacht or training vessel <500 GT, prepare to apply for a Certificate of Survey for a Yacht or Training Vessel (s 15).
   • For foreign visiting vessels, ensure required documentary evidence is carried: foreign yachts ≥24 m must comply with Part A of the Red Ensign Group Yacht Code (s 23(1)); foreign yachts <24 m and foreign training vessels must carry at least one certificate or documentary evidence attesting seaworthiness, area of operation and equipment/manning and demonstrating flag compliance (s 23(2)).

3. Gather technical documentation and apply to AMSA or issuing body.

   • For either certificate type, applications are made to the issuing body under Division 3 of Marine Order 1 (Administration) 2013, except section 17 is excluded for safety certificates because Navigation Act review applies (ss 8(2), 16(2)). Follow the application process in Marine Order 1 Division 3.
   • For yachts ≥24 m, ensure all vessel equipment and appliances comply with Part A of the Red Ensign Group Yacht Code as modified for Australia and provide evidence of compliance with the Australian National Annex (s 9(b); s 4 definitions; note to s 4 referencing AMSA website).
   • For other yachts and training vessels, prepare documentation demonstrating compliance with the Cargo Vessel Certificate criteria in Marine Order 31, and where applicable prepare damage stability calculations and intact stability documentation per USL Code and IS Code references (s 17(1)(b)-(d); s 17(2); s 18(b)).

4. Prepare damage stability and intact stability evidence.

   • If the vessel is one where the Red Ensign Group Yacht Code does not apply and classification rests on Marine Order 31 Cargo Vessel criteria, provide damage stability calculations taking into account design characteristics, compartment configurations and contents that may be damaged, as the issuing body must check these calculations (s 17(2)).
   • For sailing vessels <24 m, ensure auxiliary propulsion capability of at least 6 knots in still water and calm air, if required (s 17(1)(d)).

5. Apply for and secure endorsements for intermediate/annual surveys and hull-bottom inspections.

   • Plan for and schedule intermediate and annual surveys and inspections of the outside bottom. Each such survey/inspection must be endorsed on the applicable certificate by the issuing body (ss 11(1), 19(1)). Absence of required endorsements is a ground for revocation (s 14(c), s 22(b)).

6. Maintain equipment and record-keeping.

   • Maintain the vessel, equipment and appliances to comply with the conditions of the certificate while the certificate is in force (s 10; s 18(a)). After any required survey, obtain issuing-body approval before making changes to structure, equipment or arrangements that were covered by that survey, other than direct replacement of equipment or fittings (s 18(c)).

7. Plan for certificate durations and renewals in line with SOLAS or Marine Order 31 requirements.

   • Certificates of Compliance (large yacht) come into force in accordance with Regulation 14 of Chapter I of SOLAS and remain in force for five years unless a shorter period is specified or SOLAS-based cessation happens (s 12(1)-(2)). When seeking variations to duration, ensure compliance with SOLAS Regulation 14 requirements for extension and expiry as if the certificate were a SOLAS certificate (s 13(b)). For Certificates of Survey for yacht/training vessels, manage renewals per s 20 and ensure compliance with section 22 of Marine Order 31 when varying durations as if the vessel had a Cargo Vessel Certificate (s 21(b)).

8. For training vessels, meet the specific supervisory, instructional and medical requirements.

   • Ensure trainees are carried only for the specified training purposes and that each training task is conducted with proper instruction, clear learning objectives and adequate supervision by competent, qualified personnel familiar with the vessel’s business (s 24(1)(a)-(b)(i)-(iii)).
   • Obtain and retain a valid certificate of medical fitness for each trainee from a medical practitioner registered in an Australian State or Territory (s 24(1)(c)). Because the criminal offence is strict liability (s 24(2)), keep contemporaneous records showing compliance with supervision and medical certificate requirements.

9. Consider equivalents only where technically and economically justified, and prepare robust evidence.

   • If seeking to use an equivalent to a prescribed requirement, apply under Division 3 of Marine Order 1 and give AMSA the technical evidence required to demonstrate that the alternative is at least as effective as the original requirement (s 6(1)-(2)). Be prepared to quantify performance equivalence, not merely provide descriptive statements.

10. Be aware of foreign vessel documentary minimums and ensure documentation is complete.

    • For foreign yachts <24 m and training vessels, ensure at least one certificate or other documentation attests to seaworthiness, area of operation, equipment and manning and demonstrates compliance with the vessel’s flag administration (s 23(2)). Keep this documentation aboard for inspection and be prepared to have inspectors refer to the Red Ensign Group Yacht Code when assessing compliance (s 23 note 2).

11. Implement internal compliance processes and training records.

    • Because of potential strict liability exposure for training vessel owner duties and the administrative consequences of missing endorsements, maintain: training plans that evidence clear learning objectives; records of instruction and supervision; inspection and survey records; certificates of medical fitness for trainees; and copies of certificates and endorsements. These records substantiate compliance and may be decisive in review or enforcement contexts (s 24; ss 11, 19; ss 14, 22).

12. Understand review and appeal options.

    • If AMSA or an issuing body refuses to issue, varies, or revokes a certificate, pursue reviewability under subsection 313(1) of the Navigation Act as the Order excludes internal review under Marine Order 1 section 17 for safety certificates (ss 8(2), 16(2)). Engage legal advice early in contested cases, and ensure procedural fairness and evidence obligations in applications are satisfied.

13. Liaise with surveyors and AMSA early on complex technical matters.

    • For novel designs, equivalence proposals, or complicated stability arrangements, consult with the issuing body and surveyors early. The Order allows AMSA to impose requirements such as carrying specified damage control equipment when approving arrangements (s 17 note for paragraph (c)). Early engagement reduces the risk of later revocation or refusal.

By following these steps, owners and operators can align operational practices with the specific prescriptive requirements and procedural mechanisms set out in Marine Order 52. Compliance requires attention to classification, technical documentation, survey scheduling and endorsement, training supervision and medical verification, and understanding how the Order’s requirements intersect with SOLAS and other Marine Orders.
