Marine Order 507 (Load line certificates — national law) 2018

Load line certificate: The load line certificate is the central regulatory object. It is defined as a certificate issued under s 5 of this Order (or under the 2013 version) and is required, for vessels to which the Order applies, to satisfy obligations under Marine Order 503 (s 17; note to s 3). A load line certificate documents that a vessel’s freeboard and related markings comply with the Load Lines Convention or Section 7 of the USL Code (s 5(c)).

Scope and eligibility: The Order applies only to domestic commercial vessels with at least 24 m load line length as defined by the Load Lines Convention, excluding fishing vessels and certain Class 1D/1E and Class 2D/2E vessels operated to carry passengers only (s 3). The Order therefore targets a subset of the domestic fleet defined by size and operational class.

Survey regime: Issue and renewal are survey‑driven. A vessel must complete an initial or renewal survey in accordance with Chapter 6 of Part 2 of the National Law - Marine Surveyors Accreditation Guidance Manual 2014 to obtain a certificate (s 5(b)). Renewal also requires a renewal survey within specified six‑month windows and evidence that the vessel had a load line certificate within the preceding two years (s 6(1)(b),(d)). The Order ties periodic survey frequency either to the vessel’s certificate of survey under Marine Order 503 or to what that frequency would be if a certificate of survey were required (s 7(d)-(f)).

Conditions and further restrictions: The load line certificate is issued subject to obligatory conditions in s 7(1): required documents on board or made available on request (conditions of assignment of load lines in approved form; stability and loading information per NSCV C6 or USL Code Section 7); maintenance of the fittings and appliances specified in Article 14(c) of the Load Lines Convention (s 7(1)(b)); correct and permanent display of deck line and load line marks (s 7(1)(c)); periodic surveys (s 7(1)(d)-(f)); and notification and approval obligations for changes to structure, arrangements, material or scantlings (s 7(1)(g)-(h)). The regulator can add further conditions and may direct loading limits by notice (s 7(2)-(3)).

Operational marking rules: The Order requires display of the load line mark and associated marks in accordance with the certificate, and creates offences for operating without the certificate, without the marks displayed, or with marks submerged by water (ss 15-16). The Order gives statutory defences based on hypothetical flotation tests for submersion offences: associated marks must be judged against the vessel floating without a list in the still water for which that associated mark is appropriate, while the load line mark uses still salt water with a specific gravity of 1.025 (s 15(4)-(5); s 16(5)-(6)).

Enforcement and liability: The Order supplies both criminal penalties (expressly stated penalty units) and civil penalties for contraventions. Many offences are strict liability (ss 13(2), 14(2), 15(2), 16(2)). For breaches of condition (owners and masters) the penalty is 50 penalty units and civil penalty liability of 50 penalty units (ss 13-14). For operating without a certificate or with submerged/not‑displayed marks, penalties are criminal 50 penalty units and civil 500 penalty units (ss 15-16).

Regulator discretion and administrative mechanics: The National Regulator must issue certificates where the statutory criteria are satisfied (s 5) and may act on its own initiative to vary, suspend or revoke certificates if certain criteria are met (ss 10-12). Certain decisions are reviewable under Marine Order 501 (note to s 5; s 6(2)). Instruments incorporated by reference (the Manual, NSCV, USL Code, Load Lines Convention) are treated as instruments existing from time to time (s 17(2)), so compliance depends on the versions current at the time.

Transitional rule: Section 18 treats pending applications made on or before 30 June 2018 as taken to be applications under this Order, but allows the National Regulator to consider them under the pre‑2018 Marine Order 507 criteria if the regulator chooses (s 18).

Owners and masters of vessels meeting the Order’s scope: The primary regulated entities are owners and masters of domestic commercial vessels of at least 24 m load line length, subject to the exclusions in s 3. Owners are the applicant and the principal legal actor for certification processes (s 4, s 9). Masters are subject to immediate operational duties while underway and share criminal and civil liability with owners for many breaches (ss 13-16). Both parties bear compliance costs: fees, surveys, documentation, marking, maintenance and potential operational restrictions.

Vessels excluded: Fishing vessels and small passenger‑only vessels in specified classes are excluded (s 3(b)(i)-(iii)). That exclusion directs compliance costs away from those categories and concentrates them on larger non‑fishing commercial vessels.

Surveyors and maritime service providers: The Order requires initial, renewal and periodic surveys to follow the National Law - Marine Surveyors Accreditation Guidance Manual 2014 (s 5(b); s 6(1)(d); s 7(d)). Accredited marine surveyors and those that perform surveys, provide stability/loading calculations, or certify fittings and marks are therefore affected because their certification and survey work is the statutory gateway for certificate issue and renewal.

Commercial operators and cargo interests: The regulator can, by written notice, direct a vessel’s loading so that a specified extent of hull remains unsubmerged (s 7(3)(a)). This authority can constrain cargo loading, passenger numbers or ballast operations, and therefore affects ship operators’ revenue calculations, charterers and cargo interests that depend on loading capacity and scheduling.

Administrators and the regulator: The National Regulator has decision‑making and enforcement duties under ss 5-12 and 11(2)(a)-(c) authorises suspension to recover unpaid fees, to ensure repairs, and where safety or environmental protection requires it. The regulator’s duties include issuing certificates where statutory criteria are met and conducting renewals and reviews where appropriate (s 5; s 6(2); note to s 5).

Third parties and enforcement observers: Marine safety inspectors may request documentation required to be kept on board (s 7(1)(a)). Port authorities and insurers will be affected indirectly because operating without a certificate, incorrect markings, or submerged marks may attract penalties that influence port access, underwriting and liability exposure.

Legal practitioners, compliance officers and auditors: Those advising owners and masters must handle a bundle of interlocking requirements: forms and fees under Marine Order 501 (s 4; note 1 to s 4), survey timing and content under the Guidance Manual (s 5(b), s 6(1)(d)), content and retention of stability/loading information under NSCV C6 or Section 7 of the USL Code (s 7(1)(a)(ii)), and the narrow defences available for mark submersion and display offences (ss 15(4)-(5); 16(4)-(6)). Decisions to refuse to renew are reviewable under Marine Order 501 (s 6(2)).

Regulated fees and suspension/revocation triggers: Owners that fail to pay prescribed fees face a statutory pathway to suspension or revocation: s 11(2)(a) authorises suspension to ensure unpaid fees are recovered and s 12(1) requires revocation on application "if any fees relating to the certificate have been paid." The drafting of ss 11(1) and 12(1) is notable and may affect owners’ strategies around fee payments and applications (see Gotchas below).

Instrument maintainers and standards bodies: Because the Order incorporates the Guidance Manual, NSCV and USL Code as instruments that exist "from time to time" (s 17(2)), bodies that maintain or amend those instruments effectively change the compliance landscape for regulated owners and masters without amendment to the Order itself.

Key duties: The Order creates a set of affirmative duties for owners and masters, and a set of obligations for the National Regulator:

• Application and formality duties: Applications for load line certificates and for variation/suspension/revocation must be in the approved form and accompanied by prescribed fees (s 4; s 9). The Order directs applicants to Marine Order 501 for the approved form and contains an offence for giving false or misleading information in an application (note to s 4 referencing Criminal Code s 136.1).

• Survey and certification duties: Owners must ensure the vessel completes the initial or renewal surveys required by the National Law - Marine Surveyors Accreditation Guidance Manual 2014 to qualify for issue or renewal (s 5(b); s 6(1)(d)). For renewal, the vessel must have had a load line certificate within the two years before application and must not have had specified changes (s 6(1)(b)-(c)).

• Onboard documentation and maintenance: The master must ensure documents specified in s 7(1)(a) are kept on board or made available (conditions of assignment of load lines in approved form; stability and loading information per NSCV C6 or USL Code s 7). The fittings and appliances listed in Article 14(c) of the Load Lines Convention must be maintained in effective condition (s 7(1)(b)). Deck line and load line marks must be correctly and permanently displayed (s 7(1)(c)).

• Notification and approval for changes: The National Regulator must be told of any change to structure, arrangements, material or scantlings, and the vessel may operate after the change only if the change is approved (s 7(1)(g)-(h)). This creates a pre‑operation approval step where structural changes occur.

• Operational obligations tied to marks and certificates: Masters and owners must not operate the vessel without a load line certificate where the Order applies, must not operate without the load line and associated marks displayed, and must not operate so that those marks are submerged, subject to limited defences (ss 15-16).

• Compliance with regulator conditions and notices: The National Regulator may impose further conditions on certificates and may direct loading limits in writing; owners and masters must comply with those directions (s 7(2)-(3)).

Regulator duties and rights:

• Issue duty: The National Regulator must issue a certificate where the statutory criteria in s 5 are met (s 5).

• Renewal discretion and review: The regulator may renew a load line certificate where criteria in s 6 are met; a refusal to renew is a reviewable decision under Marine Order 501 (s 6(2)).

• Variation, suspension, revocation: The regulator may vary certificates on application or on its own initiative on specified grounds (s 10); must or may suspend on application or own initiative in specified circumstances (s 11); and must revoke on application in certain fee‑related circumstances and must revoke on its own initiative where necessary for safety or where a certificate was issued in error (s 12).

Rights and defences:

• Review rights: Applicants refused certificate issue or renewal, or otherwise subject to a reviewable decision, have review rights under Marine Order 501 (note to s 5; s 6(2)).

• Statutory defences to submersion/display offences: The Order provides narrowly framed defences for submersion offences that require proof of hypothetical flotation conditions (ss 15(4)-(5); s 16(5)-(6)), and for display offences there is a defence for owners who prove they caused a copy of the mark to be displayed and had no means of knowing it was no longer displayed (s 16(4)).

Liability architecture:

• Many offences are strict liability (ss 13(2), 14(2), 15(2), 16(2)), lowering the prosecutorial burden to prove mens rea and elevating the evidentiary importance of compliance records and preventive acts.

• Penalties are stated as penalty units. For breaches of condition the criminal penalty is 50 penalty units and civil penalty liability also 50 penalty units (ss 13-14). For operation without certificate, without marks, or with submerged marks the criminal penalty is 50 penalty units and civil penalty liability is 500 penalty units (ss 15-16).

Interaction with other orders and instruments:

• The duties incorporate the Guidance Manual, NSCV and USL Code for technical standards, the approved forms and administrative review in Marine Order 501, and certificate of survey periodicity rules in Marine Order 503 (s 17; s 7(e)-(f); note to s 3). Those links make compliance a multi‑instrument exercise.

Who enforces and who pays:

• The National Regulator has the enforcement authority and discretion to vary, suspend or revoke certificates and to require rectification (ss 10-12). Owners pay application and prescribed fees and bear down‑time, survey and maintenance costs; masters must implement day‑to‑day compliance and bear immediate exposure to breaches while operating the vessel (ss 4, 5, 6, 7, 11-12, 13-16).

Penalties set out by the Order are dual: criminal offences with specified penalty units and separate civil penalty provisions. The Order treats many offences as strict liability, and provides specific statutory defences for some operational physical elements.

Criminal penalties and strict liability:

• Breach of a certificate condition by master or owner (s 13(1), s 14(1)): criminal penalty 50 penalty units for each offence; each offence is an offence of strict liability (ss 13(2), 14(2)). The text also records civil penalty liability for contravening s 13(1) and s 14(1) of 50 penalty units (ss 13(3), 14(3)).

• Operation in certain circumstances without a certificate or with marks not displayed or submerged (ss 15(1), 16(1)): criminal penalty 50 penalty units. These offences are strict liability (ss 15(2), 16(2)).

Civil penalties:

• Contraventions of ss 15(1) and 16(1) attract civil penalty liability of 500 penalty units (ss 15(3), 16(3)). Contraventions of ss 13(1) and 14(1) attract civil liability of 50 penalty units (ss 13(3), 14(3)).

Defences and evidentiary specifics:

• Submersion of associated marks: For offences where the physical element is that an associated mark is submerged, the defendant has a defence if they prove that, had the vessel been floating without a list in still water of the kind for which the associated mark is appropriate, the associated mark would not have been submerged (ss 15(4), 16(5)).

• Submersion of the load line mark: For offences where the load line mark is submerged, the defendant has a defence if they prove that had the vessel been floating without a list in still salt water with a specific gravity of 1.025, the load line mark would not have been submerged (ss 15(5), 16(6)). These are technical, hypothetical tests that import the Load Lines Convention’s standard salinity and list assumptions.

• Display offences (owner): If the physical element is that the mark was not displayed, the owner can defend by proving they had caused a copy of the mark to be displayed and had no means of knowing that it was no longer displayed (s 16(4)). For masters, the equivalent defences for display are not expressly set out in s 15(4)-(5); s 15(4)-(5) apply to submersion defences.

Discretionary enforcement actions by the regulator:

• Suspension: The National Regulator must suspend a load line certificate on application if any fees relating to the certificate have been paid (s 11(1)). On the regulator’s own initiative the regulator must suspend where the suspension is "necessary" for any of: ensuring unpaid fees are recovered; ensuring necessary repairs are made to the vessel; or where the regulator considers suspension necessary in the interests of marine safety or protecting the environment (s 11(2)(a)-(c)). The Order notes that suspension does not extend the certificate duration (s 11 note).

• Revocation: The National Regulator must revoke on application if any fees relating to the certificate have been paid (s 12(1)), and must revoke on its own initiative where necessary for safety or environmental protection, or where the certificate was issued in error (s 12(2)(a)-(b)).

• Variation: The regulator may vary a certificate on application or on its own initiative where owner or vessel details change, information becomes inaccurate, or the vessel is altered/damaged/sold (s 10(1)-(2)). The regulator may impose further conditions on a certificate (s 7(2)) and must include further conditions on the certificate when imposed (s 7(4)).

Review rights and administrative process:

• Decisions in relation to applications are reviewable under the review process mentioned in Marine Order 501 (note under s 5). Renewal refusal is explicitly reviewable under ss 16 and 17 of Marine Order 501 (s 6(2)). The Order repeatedly ties administrative processes to Marine Order 501’s forms, fees and review routes (s 4; note 1 to s 4; s 9).

Practical enforcement consequences:

• Strict liability offences lower the prosecution burden on state actors and elevate the evidentiary importance of accurate records, routine maintenance logs, surveys and documentary proof of compliance.

• The civil penalty (500 penalty units) attaching to operating without the certificate or with submerged marks is materially larger than the civil penalty for mere breach of condition (50 penalty units), reflecting the Order’s higher sanctioning of operational non‑compliance where vessel seaworthiness and marking are implicated.

• The regulator’s ability to suspend certificates to ensure unpaid fees are recovered (s 11(2)(a)) connects administrative revenue collection to operational permissions, allowing the regulator to leverage operational suspension to secure fee compliance.

• The statutory defences require technical proof often involving survey evidence, stability calculations and evidence of environmental salinity and list at the time of the alleged offence, suggesting that in enforcement actions expertise and contemporaneous records will be central to litigation and administrative review.

The Order does not operate in isolation; it is expressly interlinked with other Marine Orders and technical instruments and sits under the Marine Safety (Domestic Commercial Vessel) National Law. Interactions in the text include administrative cross‑references, technical incorporations and conditional dependencies.

Marine Order 501 (Administration):

• Application forms, prescribed fees and review processes are routed through Marine Order 501. Section 4 requires applications be "in accordance with Marine Order 501" and the note to s 4 refers to subparagraph 9(a)(i) of Marine Order 501 for the approved form. The Order also states that decisions are reviewable in accordance with the review process mentioned in Marine Order 501 (note to s 5). Section 6(2) states a decision to refuse renewal is a reviewable decision for sections 16 and 17 of Marine Order 501. Thus procedural rights, forms and fee structures are administered under Marine Order 501.

Marine Order 503 (Certificates of survey):

• The Order cross‑references Marine Order 503 for periodic survey frequencies and for the requirement to obtain and maintain a load line certificate in order to comply with Marine Order 503 (note to s 3 and ss 7(e)-(f)). Periodic survey timing for load lines is aligned with the periodic survey for the vessel’s certificate of survey under Marine Order 503; where no certificate of survey exists, periodic load line survey frequency defaults to the frequency that would apply for a certificate of survey under Marine Order 503 (s 7(d)-(f)). Schedule 1 of Marine Order 503 is referenced in s 6(1)(c) (renewal: vessel must not have had a change mentioned in Schedule 1), meaning changes listed in that schedule affect renewal eligibility.

National Law - Marine Surveyors Accreditation Guidance Manual 2014:

• Initial, renewal and periodic surveys must be completed in accordance with the Manual (s 5(b); s 6(1)(d); definitions s 17). The Manual is incorporated by reference and treated as existing from time to time (s 17(2)(a)), so changes to the Manual will change the regulated survey processes without amendment of this Order.

NSCV and USL Code:

• Stability and loading information to be kept on board must be in accordance with NSCV Section C6 or Section 7 of the USL Code (s 7(1)(a)(ii)). The Order also allows compliance with the Load Lines Convention or Section 7 of the USL Code as alternative compliance standards for issuance under s 5(c). NSCV and USL Code are incorporated as instruments that may change over time (s 17(2)(b)-(c)).

Load Lines Convention:

• The Order purports to "give effect to the Load Lines Convention" (s 2), requires maintenance of items described in Article 14(c) of the Convention (s 7(1)(b)) and uses the Convention’s technical standards as the compliance benchmark for issuing certificates (s 5(c)). Defences for submersion are framed around the Convention’s still water and salinity assumptions (ss 15(4)-(5), 16(5)-(6)).

Criminal Code and national law:

• The note to s 4 warns that giving false or misleading information in an application is an offence under s 136.1 of the Criminal Code. The Order also references sections of the national law elsewhere, including burden of proof matters, and uses defined terms from the national law (s 17(1) note 2).

Effect of incorporations and "from time to time" language:

• Section 17(2) treats the Manual, NSCV, USL Code and Load Lines Convention as instruments existing from time to time. That cross‑instrument incorporation means technical compliance depends on the current versions of those instruments, as published by AMSA, creating an administrative link whereby standards bodies and AMSA updates change procedural and technical obligations.

Administrative convergence and practical consequence:

• Because periodic surveys for the load line certificate are synchronised with the vessel’s certificate of survey periodicity under Marine Order 503 (s 7(e)-(f)), owners who already hold certificates of survey may manage load line survey schedules to minimise duplicate down‑time; conversely, vessels without a certificate of survey face an imposed periodicity that mirrors what would have applied under Marine Order 503 (s 7(f)).

• Reviews and appeals of administrative decisions are channelled through Marine Order 501 procedural mechanisms, meaning that legal challenges or internal reviews will follow those rules rather than being handled under a separate review process in this Order (note to s 5; s 6(2)).

Transitional interaction:

• Section 18 connects the 2018 Order with the prior 2013 Marine Order 507, allowing the National Regulator to consider pre‑1 July 2018 applications under the prior order criteria where appropriate, thereby smoothing transition between the two instruments.

Compilation and amendment metadata in the instrument identify two primary entries:

• Marine Order (MO 2018/7), registered 13 June 2018, FRLI F2018L00764, commenced 1 July 2018. This is the originating instrument for Marine Order 507 (Load line certificates , national law) 2018 (compilation no. 1, compilation date 1 September 2023).

• Marine Orders Amendment (Marine Order 501 , consequential changes) Order 2023 (MO 2023/4), registered 8 August 2023, FRLI F2023L01067, commenced 1 September 2023. This order effected consequential changes to reflect amendments in Marine Order 501 and amended this Order at least by way of modification to s 17.

Specific amendments recorded in the instrument:

• The amendment table indicates that s 17 was amended by MO 2023/4 (table of amendments). The printed compilation notes also show that changes to s 1A and s 1B were repealed (by references to the Legislation Act 2003), although those specific provision tags do not appear in the published operative text here beyond the amendment table.

Transitional provision reflecting the repeal/replace cycle:

• Section 18 addresses applications made on or before 30 June 2018 that were not decided before 1 July 2018; those applications are taken to be applications under the 2018 Order (s 18(2)), but the National Regulator may consider such applications according to the criteria in the 2013 Order if it chooses (s 18(3)). This transitional arrangement accommodated the changeover from Marine Order 507 (2013) to the 2018 Order.

Practical reading of amendment history:

• The Order incorporates external instruments, some of which may be updated without formal amendment to this Order (s 17(2)). The 2023 consequential amendment to s 17 reflects administrative housekeeping triggered by changes to Marine Order 501. The compilation date of 1 September 2023 and preparation date of 26 October 2023 indicate the legal text here takes into account amendments up to MO 2023/4.

What the amendment history implies for practitioners:

• The Order’s reliance on Marine Order 501 for administrative form and review processes means that changes to MO 501 will have flow‑on effect. The 2023 consequential amendment confirms that the series of Marine Orders are updated iteratively and that legal advisers and compliance officers must monitor the Marine Order series and AMSA’s published manuals for the operative rules and forms.

The text of this Marine Order does not include any case law, decisions, or judicial interpretations. The instrument, as provided, contains no litigation history, no citations to judicial authority and no recorded judicial decisions about the interpretation or enforcement of this Order. The Order does, however, reference review rights under Marine Order 501 (note to s 5; s 6(2)), which provides an administrative review process rather than a judicial history.

What this means for legal risk assessment:

• There are no reported judicial decisions in the provided instrument to guide interpretation of its unusual phrases (for example, the language in ss 11(1) and 12(1) concerning fees). Where novel or ambiguous statutory text exists, absence of prior case law means that administrative practice, AMSA guidance and any subsequent litigation will shape practical interpretation.

• Enforcement provisions that create strict liability are likely to produce technical disputes about facts and records; absent litigated interpretations in this text, regulators and operators should expect that contestation about the scope of defences (ss 15(4)-(5); s 16(4)-(6)) and about regulator discretion (ss 10-12) could be resolved in administrative review or later litigation. Practitioners should track AMSA guidance and review determinations under Marine Order 501 which may develop into a body of administrative precedents before matters reach courts.

• The Order’s cross‑references to the Guidance Manual, NSCV and USL Code mean that disputes over compliance may also hinge on technical interpretations of those incorporated instruments. Litigation history in respect of those instruments is not included here and should be sourced from subsequent administrative or judicial records outside the text.

This section highlights textual features and operational mechanics that practitioners should read carefully because they materially affect compliance, exposure and enforcement. All citations below are to the Order as provided.

1. Fee‑related suspension and revocation language is potentially counter‑intuitive:

• Section 11(1) states: "The National Regulator must suspend a load line certificate on application if any fees relating to the certificate have been paid." Section 12(1) similarly states that the regulator "must revoke a load line certificate on application if any fees relating to the certificate have been paid." The application of "have been paid" in both provisions appears to mandate suspension or revocation on owner application where fees have been paid. This contrasts with s 11(2)(a), which authorises suspension on the regulator’s own initiative "for ensuring any unpaid fees are recovered." The textual juxtaposition may be a drafting oddity; practitioners should not assume the ordinary policy meaning without checking AMSA guidance or seeking clarification, because as written these provisions could be read to trigger suspension/revocation whenever fees have been paid rather than unpaid. The text is the text; any operational or declaratory interpretation is likely to be found in AMSA practice or future review decisions.

2. Strict liability increases evidentiary importance of records:

• Sections 13-16 contain multiple strict liability offences (ss 13(2), 14(2), 15(2), 16(2)). In strict liability offences, mens rea need not be proven, so procedural and documentary compliance becomes the primary defence. That puts a premium on contemporaneous maintenance records, survey reports, loading logs, photos and evidence of communications with the National Regulator.

3. Limited and technical defences for submerged marks:

• The defences in ss 15(4)-(5) and ss 16(5)-(6) require proving hypothetical flotation states (still water of specified kinds; salt water with s.g. 1.025) and absence of list. Those defences are technical and will generally require expert evidence, surveyor calculations and evidence about water salinity and list at the time of the alleged contravention. Practitioners should preserve evidence that might support those tests, including stability calculations and contemporaneous observations.

4. Owner defence for display is narrow and requires proactive steps:

• Section 16(4) gives an owner a defence for a display offence only if the owner "proves that the owner had caused a copy of the mark to be displayed and had no means of knowing that it was no longer displayed." The defence requires proactive steps (causing a copy to be displayed) and an evidentiary showing about the owner’s lack of means to know it was no longer displayed. If a third party removes or defaces a mark and the owner could reasonably have known, the defence may fail.

5. Incorporation of instruments "from time to time" shifts technical obligations without legislative amendment:

• Section 17(2) treats the Manual, NSCV, USL Code and Load Lines Convention as instruments that exist from time to time. Updates to those standards alter the technical and survey requirements for load line certificates. Operators must monitor AMSA publications and the versions that apply to their surveys; relying on an older version without verifying its currency risks non‑compliance.

6. Synchronisation of periodic surveys with certificate of survey:

• Sections 7(d)-(f) require periodic load line surveys either at the same frequency as the periodic survey for a vessel’s certificate of survey under Marine Order 503 or at the frequency that would be required for a certificate of survey if none exists. Owners should map survey cycles carefully to avoid unintended lapses or duplicated surveys that create downtime and cost.

7. Operational loading directions can reduce cargo capacity:

• Section 7(3)(a) allows the National Regulator by written notice to direct that the vessel be loaded so it leaves at least a specified extent of its hull unsubmerged. Such notices will directly affect permissible cargo, passenger numbers and revenue per voyage. Owners should have plans for compliance with such loading directions and understand the appeal/review route if they disagree.

8. Reviewability is through Marine Order 501:

• The Order repeatedly ties review rights to Marine Order 501 (note to s 5; s 6(2)). Practitioners must consult MO 501 for administrative review timelines, grounds and processes. Procedural missteps under MO 501 could foreclose remedies.

9. Transitional provision preserves regulator discretion:

• Section 18 allows the regulator to decide pending pre‑1 July 2018 applications under the older 2013 criteria even though the application is taken to be under the 2018 Order (s 18(2)-(3)). Where applications straddle that transition, the regulator’s approach may vary, so applicants should seek clarity from AMSA on which criteria will be applied.

10. Penalty units but no monetary conversion in the text:

• The Order specifies penalties in penalty units and does not otherwise state monetary equivalents. Practitioners must convert to dollar amounts using the relevant statute or schedule for penalty unit value; the Order itself does not provide that conversion.

This section provides a practical compliance checklist and evidence preservation guide strictly grounded in the Order’s text (ss cited).

Administrative and application steps:

• Use approved forms and pay prescribed fees: Make all applications for issue, variation, suspension or revocation of a load line certificate in the approved form and include the prescribed fee (s 4; s 9; note 1 to s 4 referring to Marine Order 501). Check Marine Order 501 for the current approved form and fee schedule.

• Ensure survey timing and content: For initial issue, complete an initial survey in accordance with Chapter 6 of Part 2 of the National Law - Marine Surveyors Accreditation Guidance Manual 2014 (s 5(b)). For renewal, ensure the renewal survey is completed within the six‑month window before the certificate ceases to be in force, or within six months before application if you do not have a certificate in force (s 6(1)(d)(i)-(ii)). Arrange survey appointments sufficiently early to avoid gaps.

Document and records retention:

• Keep required documentation on board or make it available: Ensure the master keeps the conditions of assignment of load lines in the approved form and stability and loading information in accordance with NSCV Section C6 or Section 7 of the USL Code on board, or has those documents available on request to a marine safety inspector or the National Regulator (s 7(1)(a)(i)-(ii)). If structural constraints make physical retention on board impractical, ensure rapid electronic or other access so documents can be produced on request.

• Maintain maintenance and fitting records: Keep up‑to‑date maintenance records showing that fittings and appliances referred to in Article 14(c) of the Load Lines Convention are maintained in effective condition (s 7(1)(b)). This log is relevant both for safety and to defend strict liability contraventions.

• Preserve survey reports and stability calculations: Retain initial, renewal and periodic survey reports, and stability/loading calculations that support the vessel’s assigned load lines, as these underpin both issue/renewal and statutory defences for submersion claims (s 5(b); s 7(1)(a)(ii); ss 15(4)-(5), 16(5)-(6)).

Operational compliance:

• Display and monitor marks: Ensure deck line and load line marks are correctly and permanently displayed in accordance with the certificate (s 7(1)(c)). Keep photographic records and, where copies of marks are displayed per s 16(4), document the steps taken to display copies and any limitations on the owner’s ability to monitor their status.

• Monitor load line mark immersion: Operate vessels so the load line and associated marks are not submerged. To support the narrow statutory defences, record water salinity, list and loading at voyage start and during suspect events; measurements or surveyor calculations that demonstrate compliance with the salinity/list assumptions (s 15(5), s 16(6)) are critical evidence.

• Notify the Regulator of changes: Notify the National Regulator of any change to structure, arrangements, material or scantlings, and obtain approval before operating the vessel after such a change (s 7(1)(g)-(h)). Maintain copies of all notices to and approvals from the regulator.

Survey coordination and scheduling:

• Align periodic surveys with certificate of survey frequency where possible: If you have a certificate of survey, schedule load line periodic surveys to occur with that certificate’s periodic survey (s 7(e)). If you do not have a certificate of survey, identify and comply with the periodic survey frequency that would apply under Marine Order 503 (s 7(f)).

• Plan renewal windows: For renewal, ensure the vessel had a load line certificate within the prior two years where required (s 6(1)(b)), and schedule renewal surveys within the six‑month windows specified to avoid application refusal or unplanned downtime (s 6(1)(d)(i)-(ii)).

Fee management and regulator interactions:

• Pay fees and manage fee disputes proactively: Given the Order’s fee‑related suspension/revocation clauses (ss 11(1) and 12(1) reference fees being paid), maintain clear records of fees paid and consider confirming with the National Regulator the operational effect of fee payments and outstanding amounts. Because s 11(2)(a) allows the regulator to suspend to ensure unpaid fees are recovered, owners should avoid arrears which could trigger an own‑initiative suspension.

• Use review rights: If an application for issue or renewal is refused, or if a decision to vary/suspend/revoke is made, lodge review applications or administrative appeals under the process set out in Marine Order 501 (note to s 5; s 6(2)). Track timeframes for review outlined in MO 501.

Preparation for enforcement risk:

• Create and maintain an evidence bundle: For each voyage and for events where marks might be at risk of submersion, keep contemporaneous voyage logs, loading plans, ballast records, stability calculations, water salinity measurements, photos and communications with the master, owner and regulator. These items support strict liability defences and administrative reviews.

• Prepare for technical defences: If an incident occurs involving alleged submersion, be prepared to produce surveyor calculations and other technical material that can demonstrate the hypothetical flotation tests required by ss 15(4)-(5) and 16(5)-(6).

Operational practices to reduce inspection friction:

• Train masters and crews on document production: Masters are obliged to have documents on board or make them available to inspectors (s 7(1)(a)). Make the routine of document production part of pre‑departure checks and inspections to avoid breaches under ss 13-16.

• Implement maintenance schedules: Regular maintenance of Article 14(c) fittings and appliances is a stand‑alone certificate condition (s 7(1)(b)). A preventative maintenance programme reduces the risk of suspension for "ensuring necessary repairs are made to the vessel" under s 11(2)(b).

Monitoring instrument versions and guidance:

• Monitor AMSA publications and the Guidance Manual: Because the Guidance Manual, NSCV, USL Code and the Load Lines Convention are applied "from time to time" (s 17(2)), subscribe to AMSA updates to ensure the survey standards and technical requirements used by surveyors reflect the version that will be applied to your certificate applications.

Checklists and sample documentary items to retain:

• Approved application and fee receipts (MO 501 references) (s 4; s 9).
• Initial/renewal/periodic survey reports as per the Guidance Manual (s 5(b); s 6(1)(d); s 7(d)).
• Certificate of survey documents where applicable, and cross‑referenced periodic survey schedules (s 7(e)).
• Stability and loading information per NSCV C6 or USL Code s 7 (s 7(1)(a)(ii)).
• Conditions of assignment of load lines in the approved form (s 7(1)(a)(i)).
• Maintenance logs for Article 14(c) fittings (s 7(1)(b)).
• Photographs, logs and ballast records showing mark display and immersion status (s 7(1)(c); ss 15-16).
• Notifications to and approvals from the National Regulator for structural changes (s 7(1)(g)-(h)).
• Records of any written notices from the regulator directing loading limits (s 7(3)).

In short, compliance under this Order is chiefly a matter of procedural and technical discipline: timely surveys under the Guidance Manual, correct and durable markings, documentary evidence of stability and loading data, proactive maintenance of specified fittings, fee management, prompt notification of structural changes and a clearly documented chain of communications with the National Regulator. Where ambiguity exists in the Order’s text (for example the fee‑related provisions in ss 11-12), obtain contemporaneous confirmation from AMSA or preserve a clear record of the regulator’s instructions and rationale to support review or challenge.
