Marine Order 502 (Vessel identifiers — national law) 2017

The Order uses a small set of concepts that determine owner obligations and regulator powers. These concepts are defined or referenced within the Order text itself and by cross-reference to the National Law and Marine Order 501.

• Application for unique identifier. An application must be made in accordance with Marine Order 501 (s 2). The Order notes that an application may be made at any time, including before or during the course of construction of a domestic commercial vessel (s 2 note 3). That preserves pre-construction and in-construction registration timing.

• Unique identifier. The Order repeatedly uses the defined term unique identifier and refers to the National Law definition (s 2 note referencing s 6 of the National Law). The identifier is an administratively allocated label that the National Regulator issues to domestic commercial vessels.

• Criterion for issue. The sole criterion that the Order supplies for issue under paragraph 77(1)(a) is that the National Regulator has not previously issued a unique identifier for the vessel (s 3). The Order expressly acknowledges that vessels may hold an “old unique identifier” issued by a State or Northern Territory agency before 1 July 2013, and that the National Regulator may nevertheless issue a new unique identifier (s 3 note).

• Display requirement. Once issued, the unique identifier must be displayed clearly and prominently on the vessel (s 4(1)). The Order sets timing rules: within 21 days of issue (s 4(2)), or, where the application was made before or during construction, before launch (s 4(3)). The Order leaves the expression “clearly and prominently” without numeric or technical specification, referring to a standards-like obligation rather than a prescriptive measurement.

• Removal and alteration restrictions. The Order restricts removal or alteration of the displayed identifier to two circumstances: written notification to the National Regulator that the vessel has ceased to be a domestic commercial vessel, or an exemption from the display requirement being in effect (s 5). Those are the exclusive permitted grounds set out by the instrument.

• Notification obligations. Owners must notify the National Regulator in writing within 14 days of transfer of ownership, sinking or scrapping, or the vessel ceasing to be a domestic commercial vessel (s 6(1)). The notification obligation attracts a penalty of 50 penalty units and is a strict liability offence (s 6(1) and (2)). The Order directs use of an approved form if one exists (s 6 note).

• Administrative linkage. The Order delegates administrative mechanics to Marine Order 501 and references the National Law Act for fee authority (s 2 notes referencing s 9 of the National Law Act and Marine Order 501 for definitions). The National Regulator is the entity receiving notifications, issuing identifiers and maintaining the register.

These concepts structure the interaction between vessel owners and the National Regulator. The Order sets temporal obligations, prescribes what may and may not be done with the identifier, and creates a narrow penalty-backed reporting regime.

The instrument affects owners of domestic commercial vessels, the National Regulator and indirectly persons who construct, buy, sell, scrap or otherwise change the status of such vessels. The Order repeatedly frames obligations in terms of the owner of a domestic commercial vessel, for example the application (s 2), display obligations (s 4), removal conditions (s 5) and notification duties (s 6(1)). The National Regulator is the decision-maker and recipient of notices under the Order, referenced throughout (s 2, s 3, s 5, s 6).

Owners. Vessel owners bear the compliance burden. They must apply for a unique identifier via the process in Marine Order 501 (s 2). Once issued, they must display the identifier clearly and prominently within 21 days, or before launch if the application was made during construction (s 4(2) and (3)). Owners are the parties who may remove or alter an identifier only when the specified conditions are met (s 5). They must notify the National Regulator within 14 days after specified events, with a 50 penalty unit fine attached and the offence characterised as strict liability (s 6).

Builders and constructors. The Order expressly contemplates applications during construction (s 2 note 3). Where applications are made while a vessel is under construction, the relevant compliance point for display is before launch (s 4(3)). That places the onus on owners or those acting for owners in the construction phase to plan for physical marking prior to launch.

Buyers and transferees. Transfer of ownership triggers a notification obligation for the owner who must inform the National Regulator within 14 days (s 6(1)(a)). The timing and strict liability character mean that transfer-related steps must include administrative notification.

Decommissioners and scrappers. Sinking or scrapping the vessel triggers the notification duty within 14 days (s 6(1)(b)). Owners involved in decommissioning must ensure notification for regulatory closure.

Regulator and administrative staff. The National Regulator decides issuance under the narrow criterion in s 3, maintains records, accepts notices and enforces the penalty provisions in s 6. The Order also cross-refers to approved forms and the AMSA website via Marine Order 501, which creates an administrative duty to publish and maintain forms and guidance.

Third parties. The Order does not directly impose obligations on charterers, hirers, or crew. However, because the identifier must be displayed “clearly and prominently” on the vessel (s 4(1)), third parties who rely on visible identification for safety, registration checks or commercial verification may be affected by compliance or non-compliance of owners.

Geographical and jurisdictional reach. The Order applies to domestic commercial vessels under the National Law. The Order also makes special note of vessels carrying an “old unique identifier” issued by State or Northern Territory agencies before 1 July 2013, confirming the National Regulator may issue identifiers in those cases too (s 3 note). The compilation notes show amendments with effect across the national framework (compilation table).

In short, owners bear the principal obligations and risks, constructors must plan for pre-launch display where relevant, and the National Regulator receives and enforces notices and issues identifiers under the terms of the Order.

This Order creates a concise set of duties for vessel owners and prescribes a regulator-centred issuing regime. It also identifies limited rights to alter or remove identifiers under specific circumstances.

Duties

• Application duty. An application for a unique identifier must be made in accordance with Marine Order 501 (s 2). The Order places the mechanical requirement on the applicant to follow Marine Order 501’s processes and an approved form if one exists (s 6 note). The Order also notes that a fee may be charged under section 9 of the National Law Act (s 2 note 1), which signals a financial obligation may accompany the application.

• Display duty. Once issued, the unique identifier must be displayed clearly and prominently on the vessel (s 4(1)). Timing is mandatory: display within 21 days of issue (s 4(2)), or before launch if the application was made pre-construction or during construction (s 4(3)). The duty is directed at owners and is immediate following issue.

• Notification duty. Owners must tell the National Regulator within 14 days in writing of any transfer of ownership, sinking or scrapping, or that the vessel ceases to be a domestic commercial vessel (s 6(1)(a)-(c)). The duty is backed by a penalty of 50 penalty units and is strict liability (s 6(1) and (2)).

• Use of approved forms. If an approved form exists for the notification, the approved form must be used (s 6 note, cross-referral to Marine Order 501).

Rights and limitations

• Right to apply at any time. The Order explicitly allows application for a unique identifier at any time, including during construction (s 2 note 3). That is a passive right enabling early administrative compliance.

• Right to removal or alteration in limited cases. Owners may only remove or alter an identifier if they have notified the National Regulator in writing that the vessel has ceased to be a domestic commercial vessel, or if an exemption from display is in effect (s 5). Those are the exclusive grounds set by the Order, and no other grounds for removal or alteration are provided.

• Regulator discretion bounded by criterion. The only criterion for issue specified in the Order is that the National Regulator has not previously issued a unique identifier for the vessel (s 3). That is a narrow, objective criterion. The Order also clarifies the National Regulator may issue an identifier to vessels holding an old unique identifier previously issued by a State or Northern Territory agency before 1 July 2013 (s 3 note). The Order therefore sets tight boundaries on discretion: prior issuance is the disqualifying factor.

• Procedural linkage to Marine Order 501. Rights to rely on process and the forms are mediated through Marine Order 501 (s 2). The Order does not itself prescribe the form or administrative steps, but it gives owners a right to use Marine Order 501’s processes.

Enforcement features

• Penalty. The notification duty includes a penalty of 50 penalty units (s 6(1)). The Order does not specify the monetary conversion of a penalty unit; that conversion sits outside the Order in the penalty unit regime.

• Strict liability. The offence for failing to notify is declared a strict liability offence (s 6(2)), meaning lack of intent is not a defence. The Order therefore places an evidential burden on compliance and requires timely administrative action.

In sum, the Order imposes concrete administrative duties on owners, gives limited rights to apply and to remove or alter identifiers in narrow circumstances, and frames regulator discretion narrowly around prior issuance. The Order relies on Marine Order 501 for procedural detail and for any approved forms.

The Order contains a single explicit penalty provision and sets an offence as strict liability. Enforcement responsibilities are implicit in the roles assigned to the National Regulator and in cross-references to administrative procedures.

Penalty provision

• The specific monetary sanction in the Order is the penalty of 50 penalty units for failure to notify the National Regulator within 14 days of transfer of ownership, sinking or scrapping, or of the vessel ceasing to be a domestic commercial vessel (s 6(1)). The Order does not convert penalty units to a dollar value; that conversion is governed by the penalty unit regime outside the Order. The Order ties the 50 penalty unit amount to a strict administrative duty.

Strict liability

• The Order designates an offence against subsection (1) as a strict liability offence (s 6(2)). That classification removes mens rea as an element to be proved for that offence. A prosecution need only prove the actus reus, namely that the owner did not tell the National Regulator within 14 days. The Order therefore increases the compliance risk for owners by lowering the prosecution threshold.

Enforcement actor

• The Order refers throughout to the National Regulator as the entity issuing identifiers and receiving notifications (s 2, s 3, s 5, s 6). While the Order does not detail enforcement powers such as inspection, notice, or administrative sanctions other than the penalty unit provision, the National Regulator is the recipient and appropriate enforcement agency in practice. The Order also references an approved form regime and the AMSA website for forms via Marine Order 501 (s 6 note), which creates an administrative pathway for enforcement and record-keeping.

Procedural enforcement considerations

• Use of approved forms. The Order requires that where an approved form exists, that form must be used (s 6 note). From an enforcement perspective, use of an approved form creates a standard record that a regulator can inspect and rely on in enforcement proceedings.

• Timing requirements and potential for prosecutions. The 14-day notification window (s 6(1)) and the 21-day display window (s 4(2)) are express deadlines. Failure to meet the 14-day window triggers the statutory penalty; failure to display within 21 days is a breach of the National Law’s s 79 requirement as fleshed out by the Order, though the Order does not itself specify a formal penalty for late display. Enforcement action for display failures would be pursued under the National Law provisions the Order supplements.

Limits on enforcement set by the Order

• Narrow scope. The Order is narrowly focused on identifiers and does not create a broad enforcement matrix. It creates a single monetary penalty for a specified failure to notify, and leaves other enforcement mechanisms and broader penalties to the National Law. The Order does not itself prescribe suspension, cancellation, or other administrative remedies for non-compliance beyond removal/alteration conditions and penalty units for failing to notify.

Conclusion on enforcement. The Order places sharp compliance deadlines on owners and makes at least one key notification offence strict liability with a 50 penalty unit sanction. The National Regulator is the enforcement counterpart but the Order leaves the larger enforcement architecture to the National Law and to procedural instruments such as Marine Order 501.

The Order operates as a Marine Order under the Marine Safety (Domestic Commercial Vessel) National Law framework and explicitly cross-refers to both the National Law and Marine Order 501 for definitions, procedural mechanics and fee authority. Its effect is to implement certain paragraphs and sections of the National Law by prescribing procedural and timing details.

Cross-references within the National Law

• Applications and issuing provisions. Section 2 ties the application process to paragraph 76(1)(c) of the National Law by stating that an application must be made in accordance with Marine Order 501 (s 2). Section 3 implements paragraph 77(1)(a) by setting the criterion for issue. Section 4 implements section 79 of the National Law concerning display. Section 6 implements paragraph 78(c) by specifying notification requirements. The Order thereby supplements and specifies how those National Law provisions operate in practice.

• Definitions and fee authority. The Order’s notes refer to the National Law for the definition of unique identifier (s 2 note referencing s 6 of the National Law) and to the National Law Act section 9 for fee authority (s 2 note 1). Those references show the Order does not stand alone; its operation depends on statutory definitions and fee-making powers in the suprahierarchical instruments.

Interaction with Marine Order 501

• Administrative mechanics. The Order delegates procedural details such as how to apply and the use of approved forms to Marine Order 501: s 2 requires applications to follow Marine Order 501 and the s 6 note instructs that an approved form must be used if one exists, available on the AMSA website in accordance with Marine Order 501. That means compliance requires consulting and following the administrative instrument of Marine Order 501 as well as this Order.

• Forms and website publication. The Order’s reliance on Marine Order 501 for the approved form and for where it is published means that the practical enforceability of the Order’s duties depends on the regulator maintaining the forms and guidance on the AMSA website as referred to (s 6 note).

Interaction with state/territory identifiers

• Old unique identifiers. The Order explicitly recognizes that prior to 1 July 2013 state and Northern Territory agencies issued “old” unique identifiers and clarifies the National Regulator may issue a new unique identifier to a vessel that already holds such an old identifier (s 3 note). That provision helps avoid legal friction between earlier state-issued identifiers and the national regulator’s register.

Penalty regime and other laws

• Penalty units. The Order imposes a 50 penalty unit sanction for certain notification breaches (s 6(1)). The monetary value of a penalty unit is determined by the relevant penalty unit legislation outside the Order. Therefore the Order interacts with the broader penalty unit framework in the applicable jurisdiction.

• National Law enforcement. While the Order sets out display and notification details, other enforcement tools and offences remain in the National Law. The Order does not itself create a standalone enforcement regime beyond the penalty unit provision and the strict liability designation. Enforcement of display obligations and other non-notification breaches will be pursued under the National Law.

Transitional and amendment interactions

• Compilation notes and amendments. The compilation notes show MO 2017/3 and MO 2023/4 as making and amending the Order, with MO 2023/4 making consequential changes to Marine Order 501 and amending s 2 and s 6 (compilation table). That demonstrates the Order’s ongoing interaction with amendment processes and consequential changes in the marine order series.

In short, Marine Order 502 supplements and operationalises particular paragraphs and sections of the National Law, requires consult of Marine Order 501 for administrative mechanics, and sits within the penalty unit and national enforcement framework. It recognises pre-existing state-issued identifiers and allows the National Regulator to re-issue identifiers to such vessels.

The compiled instrument records the initial making of Marine Order 502 and a subsequent consequential amendment. The compilation header indicates the document is compilation no. 1 with compilation date 1 September 2023 and that the compilation was prepared on 26 October 2023 taking into account amendments up to Marine Orders Amendment (Marine Order 501 , consequential changes) Order 2023 (MO 2023/4).

Recorded orders and dates

• Marine Order (MO 2017/3). Registered 26 June 2017, FRLI number F2017L00753, commenced 1 July 2017. This is the instrument that originally made Marine Order 502 (compilation table).

• Marine Orders Amendment (Marine Order 501,consequential changes) Order 2023 (MO 2023/4). Registered 8 August 2023, FRLI number F2023L01067, commenced 1 September 2023. This Order effected consequential amendments relevant to Marine Order 502 (compilation table).

Table of amendments recorded in the compilation

• The compilation contains a table of amendments showing specific provisions affected. It records that s 2 and s 6 were amended by MO 2023/4 (table rows indicating s.2 am. MO 2023/4 and s.6 am. MO 2023/4). The table also includes entries indicating prior repeal of s 1A and s 1B by the Legislation Act 2003, s 48D and s 48C respectively, but the immediate relevant amendments for this Order are the 2023 consequential amendments.

Compilation notes

• The Order includes notes that state that the Marine Order 502 is shown in the compilation as amended as indicated in the tables (compilation notes). The compilation indicates that the 2023 amendment was consequential to changes in Marine Order 501, which the Order cross-refers to for administrative mechanics and forms.

Practical effect of amendments

• Amendment to s 2. The amendment to s 2, recorded as MO 2023/4, indicates that the wording specifying that an application for a unique identifier must be made in accordance with Marine Order 501 (Administration , national law) 2023 was updated to reflect the 2023 iteration of Marine Order 501. That ties the application process explicitly to the 2023 administrative order.

• Amendment to s 6. The amendment to s 6 by MO 2023/4 updated the notification requirements provision and its notes to align with consequential changes in Marine Order 501. The compilation table lists s.6 as amended by MO 2023/4.

No other amendments recorded. The compilation table contains no other entries showing changes to the Order after the 2023 amendment. The compilation’s notes record the legislative instruments and their commencement dates, which provide the authoritative amendment trail as presented in this compilation.

Users of the Order should consult the FRLI entries and the Marine Orders Amendment (MO 2023/4) text for the exact amendment language and for any transitional or savings provisions that may have been included in the amending instrument. The compilation itself states that it takes into account amendments up to MO 2023/4.

The Order itself contains no report of litigation, and the compilation makes no reference to judicial decisions interpreting Marine Order 502. The text does not name any cases, nor does it include annotations about court challenges, appeals or tribunal decisions. The compilation's notes and amendment table record the instrument history but not any litigation.

No cases in the instrument. The Order does not cite, mention or summarise any judicial consideration. It therefore records no litigation history within its text or compilation notes.

Potential litigation contours implicit in the instrument. While the Order includes no cases, the provisions create several potential legal issues that could give rise to litigation or review in practice. These potential issues are identified from the text of the Order without reference to any external cases.

• Interpretation of “clearly and prominently”. Section 4(1) requires the unique identifier to be “displayed clearly and prominently on the vessel”. That phrase is imprecise and could be the subject of dispute in enforcement proceedings if a regulator alleges non-compliance and an owner disputes the adequacy of the display. The Order does not prescribe standards, sizes, locations or materials, which leaves room for contest about what constitutes “clearly and prominently”.

• Timing obligations. The 21-day display requirement (s 4(2)), the pre-launch display requirement for construction-phase applications (s 4(3)), and the 14-day notification windows (s 6(1)) establish strict deadlines. Litigation could turn on whether timing was met, and on whether time runs from the date of issue, transfer, sinking, scrapping, or other triggering event.

• Strict liability offence. Section 6(2) declares the notification offence strict liability. Strict liability offences are frequently litigated to test applicability of defences, statutory construction around the required elements, and the interplay with administrative fairness in enforcement. The Order establishes the statutory classification but contains no procedural enforcement detail.

• Form and publication. The Order requires use of an approved form where one is available and directs users to the AMSA website via Marine Order 501 (s 6 note). Disputes could arise about whether a valid form was available, whether the form was properly published, and whether a failure to use the approved form invalidates a notification.

Administrative review avenues. The Order does not itself specify administrative review or merits review mechanisms. Any prosecution or regulatory decision taken under the National Law or related orders would be contested under the review and appeals mechanisms provided by the National Law and the Administrative Decisions (Judicial Review) Act or other external frameworks. The Order does not name those avenues.

Because the instrument records no litigation, researchers or practitioners seeking precedent or interpretive guidance will need to search regulatory decisions and case law external to this compilation. The Order itself provides no litigation history or authoritative judicial interpretation.

The Order is short but contains specific procedural traps and room for non-compliance risk. The following practical pitfalls arise directly from the Order’s text.

Strict liability notification duty. The notification obligation in s 6(1) is a strict liability offence under s 6(2) and carries a 50 penalty unit sanction. That makes timely notification a high-risk area. Strict liability removes fault elements, which means inadvertent failure to notify within 14 days may still attract liability. Owners should not assume ignorance or administrative delay will be a defence.

Limited grounds to remove or alter identifiers. Section 5 restricts removal or alteration of a unique identifier to two situations: where the owner has notified the National Regulator in writing that the vessel has ceased to be a domestic commercial vessel, or where an exemption from the display requirement is in effect. There is no general right to temporarily remove an identifier for repainting, repair or aesthetic reasons unless an exemption applies or the owner has notified cessation of domestic commercial vessel status. Owners and yard operators must plan any work that could obscure the identifier to ensure either an exemption or written notification is in place.

Unspecified display standards. The Order requires display “clearly and prominently” (s 4(1)) but provides no objective metrics. That creates uncertainty about font sizes, location, legibility, label materials and placement. Owners who make subjective compliance choices risk regulator disagreement. The absence of prescriptive standards increases the administrative discretion and potential disputes over adequacy.

Timing nuances where construction is involved. If the application for an identifier was made before or during construction, the identifier must be displayed before launch, not merely within 21 days of issue (s 4(3)). Builders and owners who assume the 21-day rule applies in construction cases may inadvertently breach the pre-launch rule.

Dependency on Marine Order 501. The application must be made in accordance with Marine Order 501 (s 2), and approved forms are to be used if available (s 6 note). Those procedural steps are not duplicated in this Order. Owners who rely solely on the Marine Order 502 text without consulting Marine Order 501 risk failing to use the correct forms or following correct administrative steps.

Fee may be charged. Section 2 note 1 states a fee may be charged under section 9 of the National Law Act. The Order does not specify fee amounts or application of concessions, so applicants must check associated fee schedules. Failure to include the fee or to budget for it may delay an application.

Old unique identifiers. The Order notes the National Regulator may issue a unique identifier for a vessel that holds an old unique identifier issued by a State or Northern Territory agency before 1 July 2013 (s 3 note). Owners may assume an old identifier suffices, but the National Regulator’s authority to issue a new identifier may require them to accept a new number and to display it.

Approved form availability and website publication. The Order’s reliance on the AMSA website and Marine Order 501 for forms means that temporary website outages or delays in posting forms could create compliance problems. The Order requires use of an approved form where one is available (s 6 note); if a form is designated but inaccessible, owners should document attempts to access it.

Penalties outside the Order. While the Order specifies one penalty, failure to comply with related National Law obligations beyond the Order’s text (for example, display enforcement or other registration offences) may attract additional sanctions under the National Law. Owners should not assume the Order’s single penalty exhausts enforcement consequences.

Record-keeping and proof. The Order requires written notices to the National Regulator for certain actions (s 5, s 6(1)). Owners should retain copies of notices, evidence of dispatch and delivery, and any acknowledgment from the National Regulator. The Order does not set out required contents of notices, which can create dispute about adequacy.

In combination, these features create concentrated practical risks for owners who do not integrate administrative steps into their transactions, maintenance schedules and decommissioning plans.

Compliance with Marine Order 502 requires owners and their agents to follow the Order’s procedural timelines, use the appropriate Marine Order 501 processes and retain documentary proof. The following step-by-step approach maps directly to the Order’s provisions.

1. Determine whether the vessel is a domestic commercial vessel. The Order’s provisions apply to domestic commercial vessels. If there is any doubt about a vessel’s status under the National Law, owners should resolve that status before acting under the Order. The Order repeatedly addresses duties to the owner of a domestic commercial vessel (s 2, s 4, s 5, s 6).

2. Apply for a unique identifier using Marine Order 501 procedures. Make the application in accordance with Marine Order 501 (s 2). The Order expressly requires that the application follow Marine Order 501. Check the AMSA website for the current Marine Order 501 text and any approved forms referenced there (s 6 note). Budget for any applicable fee, as the Order notes a fee may be charged under section 9 of the National Law Act (s 2 note 1).

3. Check prior issuance. Before applying, confirm whether the National Regulator has previously issued a unique identifier for the vessel, because s 3 sets that as the criterion for issue. If the vessel has an old unique identifier issued by a State or Northern Territory before 1 July 2013, be aware that the National Regulator may still issue a new identifier (s 3 and s 3 note).

4. Arrange for display. Plan physical marking of the vessel. Once the identifier is issued, display it clearly and prominently on the vessel within 21 days of issue (s 4(1) and (2)). If the application was made before or during construction, ensure the unique identifier is displayed before launch (s 4(3)). Because the Order does not specify exact placement or size, choose a conspicuous location likely to be accepted as “clearly and prominently” and document the display with dated photographs.

5. Use approved forms and keep records. Where an approved form exists for notification, use it (s 6 note). Keep copies of any form submissions, acknowledgements from the National Regulator, proof of postage or electronic transmission receipts, and dated photographs of the displayed identifier. For written notifications required by s 5 and s 6(1), retain the correspondence and any evidence of receipt.

6. Do not remove or alter the identifier except as permitted. Do not remove or alter the identifier unless you have either (a) notified the National Regulator in writing that the vessel has ceased to be a domestic commercial vessel, or (b) an exemption from the display requirement is in effect for the vessel (s 5). If you plan paint, repair or re-hull work that would obscure the identifier, arrange either a written notice under s 5 or seek an exemption before commencing the work.

7. Notify within 14 days of triggering events. Tell the National Regulator in writing within 14 days of any transfer of ownership, sinking or scrapping, or the vessel ceasing to be a domestic commercial vessel (s 6(1)). Because the offence is strict liability (s 6(2)), do not assume late notification will be excused by inadvertence. If an approved form is available, use it (s 6 note).

8. Prepare for enforcement and penalties. Understand that failure to comply with the 14-day notification duty carries a penalty of 50 penalty units (s 6(1)). Build notification deadlines into transaction checklists, sale agreements and decommissioning schedules. Document attempts to notify and retain proof, because strict liability focuses on the act of omission rather than intent.

9. Coordinate with builders and buyers. If the vessel is under construction or being sold, ensure construction contracts, sale contracts and handover procedures include explicit steps for fulfilling display and notification obligations. For construction-phase applications, ensure display is planned prior to launch (s 4(3)).

10. Consult Marine Order 501 and AMSA guidance. Because Marine Order 502 delegates administrative and form requirements to Marine Order 501, consult the 2023 version of Marine Order 501 and the AMSA website for the current forms and guidance referenced by the Order (s 2, s 6 note). The Order requires compliance with Marine Order 501 processes, so following the Marine Order 502 text alone is insufficient.

11. Retain evidence of cessation or exemptions. If the vessel ceases to be a domestic commercial vessel and you notify the National Regulator under s 5, retain written proof of the notification and any regulatory acknowledgment. If an exemption is granted from the display requirement, keep the exemption instrument available onboard and in records.

12. Monitor for amendments. The compilation shows the Order was amended consequentially in 2023 (MO 2023/4). Owners and advisers should monitor FRLI entries and AMSA publications for future amendments that might affect timing, forms or penalties.

Following these steps will align administrative practice with the Order’s obligations. Because the Order ties to Marine Order 501 and the National Law for definitions, penalties and fees, a full compliance program should include checking those instruments alongside Marine Order 502 and documenting all communications with the National Regulator.
