Marine Order 49 (High-speed craft) 2015

The Order’s operative concepts are the international Codes and three administrative tools: certificates, permits and AMSA’s discretionary relief mechanisms.

1. Codes incorporated by reference. The Order relies on three technical Codes:

   • 2000 HSC Code (2000 International Code of Safety for High‑Speed Craft), and the 1994 HSC Code (s 2(b)(i), s 4 definitions). Where terms used in the Order are defined in those Codes, the Order adopts the Code meanings (s 5(a)). Code provisions regulate construction, surveys, equipment, technical manuals, route operational manuals, operating limitations and place of refuge definitions (notes and cross‑references in ss 12-19, 23 and 31).
   • DSC Code (Code of Safety for Dynamically Supported Craft) for dynamically supported craft (s 4 definitions).
   • The Order takes the 2000/1994 HSC Code and the DSC Code as the baseline for the criteria for certificates (ss 14, 18), the conditions on certificates (ss 15, 19) and survey and endorsement procedures (ss 12-13, 16).

2. Certificates and their forms.

   • HSC Safety Certificate: a safety certificate relating to structure, systems, fittings, arrangements, material and equipment, in the forms set out in Annex I of the relevant HSC Code (s 4 definition; s 10(a)). The issue, conditions and revocation criteria of HSC Safety Certificates are tightly tied to the relevant Code’s provisions (ss 12-17).
   • DSC Construction and Equipment Certificate: analogous certificate for dynamically supported craft and in the form in Annex I of the DSC Code (s 4 definition; ss 10, 18-20).
   • Certificates are issued after initial or renewal surveys done in accordance with section 1.5 of the applicable Code (ss 14(a)(i), 18(a)) and must be endorsed by an issuing body (s 16).

3. Permit to operate high‑speed craft.

   • Separate to the construction/equipment certificates, a permit to operate is required for ordinary operation (s 21(1)), unless the movement is a limited transit voyage and a safety plan approved by AMSA is aboard (s 21(1)(b)). Permit issue criteria require demonstration of crew qualifications, documentation, area support (communications, SAR, weather), operational limits and a quality management system among other matters (s 23(b)(i)-(ix)). Permits may be subject to conditions and to variation or revocation by AMSA (ss 24-27).

4. AMSA discretion and delegations.

   • The Order is made under the Navigation Act powers and expressly anticipates AMSA’s role in administration and delegation to recognised organisations for survey and certification (s 3; s 5 note; notes to ss 4-5). AMSA is the decision‑maker on exemptions, equivalents, permit issue/variation/revocation and approval of safety plans for transit voyages (ss 7-8, 21-27, 29(3)).

5. Exemptions and equivalents.

   • Owners may apply for exemptions from requirements of the Order via Marine Order 1 processes; AMSA may grant an exemption only where compliance would be unnecessary or unreasonable, and provided SOLAS or the applicable Code would not be contravened (s 7). Equivalents may be approved only if at least as effective as compliance with the requirement (s 8).

6. Operational duties and reporting.

   • Masters and owners must operate vessels in accordance with code requirements and permit conditions (s 32), carry adequate information and guidance materials on board (s 33) and report prescribed marine incidents (s 31). The marine incident prescription captures failures and incidents that may affect compliance with the Codes or the integrity/effectiveness of surveyed equipment (s 31(a)-(c)).

7. Temporal and spatial application.

   • The Order applies to regulated Australian vessels constructed in particular date ranges and otherwise meeting the Codes’ applicability rules (s 6(1)(a)-(d)). Division 2 (certificates), Division 3 (permits) and Division 6 (other matters) apply only to regulated Australian vessels, whereas the rest of the Order (other than those Divisions) applies also to foreign vessels (s 6(2)). For foreign vessels, certificates and permits must be issued in accordance with the Code provisions or by the vessel’s flag Administration, and a safety plan accepted by that flag Administration substitutes in transit cases (ss 28-30).

Those concepts together create a two‑tier compliance model: technical compliance certified by survey and certificates (construction and equipment), and operational compliance governed by permits, operational manuals and AMSA’s conditions.

The Order names multiple actors and allocates obligations and decision‑making to them. Principal affected parties are:

• Owners of regulated Australian high‑speed craft and dynamically supported craft. Owners are obliged to apply for certificates (s 11), maintain arrangements required by the Codes (ss 14(a)(iii), 18(c)), ensure required documentation and manuals are on board (s 23(b)(viii)-(ix), s 33), establish and maintain a quality management system (s 23(b)(ix)), apply for permits (s 22), comply with permit conditions (s 24), notify alterations within specified timeframes (s 34), and they carry vicarious exposure to criminal or civil penalty liability for operational breaches (ss 21(1) penalty, 21(3) civil penalty, 32, 33). Owners also have administrative rights: they may apply for exemptions (s 7) or equivalents (s 8), and may request revocation of a certificate in writing (s 17(c)).

• Masters. The master shares direct operational obligations: ensure the vessel is operated according to the applicable Code and permit conditions (s 32), ensure core information/manuals and guidance material are on board before taking the vessel to sea (s 33), and ensure safety plans are on board for transit voyages if no permit exists (s 21(1)(b)(ii)). Masters also have reporting obligations for marine incidents under the Navigation Act, reflected in the Order’s prescribed incidents (s 31 and note).

• AMSA (Australian Maritime Safety Authority) and issuing bodies. AMSA is the issuing authority for certificates and permits under the Navigation Act powers invoked (s 3), and may grant, vary or revoke permits and certificates under the criteria set out in the Order (ss 13, 17, 20, 23-27). The Order also contemplates issuing bodies authorised under arrangements described in Marine Order 1 and notes that recognised organisations may provide survey and certification services for Australian‑registered vessels on AMSA’s behalf (s 5 note). AMSA determines exemptions and equivalents per Marine Order 1 procedures (ss 7-8).

• Seafarers and crewing entities. The permit application criteria require an adequate number of seafarers with appropriate seafarer certificates or qualifications (s 23(b)(iv)). For regulated Australian vessels, the Order points to Marine Order 21 for manning requirements (s 23 note). Therefore crewing firms and masters must ensure crew certification aligns with AMSA requirements and Marine Order 21.

• Foreign vessel Administrations and masters of foreign high‑speed craft. Foreign vessels visiting Australian waters must hold equivalent certificates issued under the Codes (s 28) and must carry a permit to operate issued by their flag Administration that includes the matters identified in s 23(b) (s 29(1)). If undertaking a qualifying transit voyage, the foreign flag Administration’s approved safety plan suffices, provided the master is familiar with the craft’s safe operations (s 29(2)-(3)).

• Maintenance and service providers. The Order requires maintenance to keep the vessel in compliance with the applicable Code (ss 15(a)(i), 19(c)), periodic surveys (ss 15(a)(iii), 19(b)), and servicing schedules on board (s 23(b)(viii)). This will implicate engineers, designers, shipyards and companies that perform maintenance, surveys and equipment replacement.

Who pays. The owner primarily pays: survey costs, third‑party recognised organisation fees if used, maintenance and replacement costs, costs of producing and keeping updated manuals (route operational manual, craft operating manual, training and maintenance manuals), crew wages and training to meet qualification requirements, and costs of preparing and maintaining a quality management system. Compliance with permit criteria (communications, weather forecasting access, maintenance facilities, search and rescue availability for the area of operation, s 23(b)(vi)-(vii)) can also create recurring operating costs.

Who decides. AMSA is the central decision maker for issuing, varying and revoking certificates and permits, approving safety plans for transit voyages, and granting equivalences and exemptions subject to the criteria in ss 7-8 and the procedural cross‑references to Marine Order 1 (ss 7-8, 22-27). Issuing bodies authorised by AMSA will endorse certificates (s 16). Owners can apply for administrative reliefs (exemptions, equivalents, variation requests) but AMSA has the evaluative discretion to accept or refuse within the statutory criteria.

Behaviour changes. Owners must shift behaviour from simple registration to a documented compliance model , maintain code compliance, produce and keep up‑to‑date manuals and quality systems, plan operations within defined operational limits, and submit to periodic surveys and potential AMSA conditions. Masters must incorporate safety plans and operational manuals into voyage planning, observe reporting obligations, and ensure crew qualifications meet AMSA/Marine Order 21 standards.

The Order specifies duties for owners and masters, rights to apply for administrative relief, and AMSA’s powers. Key duties and administrative rights follow directly from particular sections.

Duties of owners and masters

• Certificate holding and survey obligations: Regulated Australian vessels within the listed construction date brackets must hold the HSC Safety Certificate or the DSC Construction and Equipment Certificate as specified in s 10. The criteria for issue are that initial/renewal surveys required by the relevant Code have been completed and that the vessel meets the Code requirements (ss 12, 14, 18). Owners must maintain the vessel and equipment to keep the vessel in compliance with the applicable Code, and periodic surveys must be completed and endorsed on the certificate (ss 15(a)(i)-(iii), 19(a)-(c)).

• Permit to operate: A person may operate a high‑speed craft only if a permit to operate is in force for the vessel, except where the vessel is undertaking a specified transit voyage with an AMSA‑approved safety plan and the master has appropriate familiarity (s 21(1)). The permit is subject to conditions including operational limits, continuing compliance with the certificate and documentation matters and any AMSA conditions (s 24). For issue, AMSA must be satisfied as to crew qualifications, documentation, certificates in force, operational limits (including the 90% speed/time thresholds from a place of refuge for passengers and certain cargo vessels), area support and a quality management system (s 23(b)).

• Operational compliance and information aboard: Masters and owners must ensure the vessel is operated in accordance with the applicable Code and permit conditions (s 32). They must not take the vessel to sea if adequate information and guidance material concerning safe operation and maintenance is not on board (s 33). The Order references the Code sections that set out what technical manuals must contain (s 33 note; see s 1.12 of the HSC Codes and s 1.8 of the DSC Code).

• Reporting and alteration notification: Owners and masters must report prescribed marine incidents to AMSA (s 31 and notes referencing Navigation Act reporting duties) and must ensure AMSA and the issuing body are informed of alterations to a vessel within 7 days of the alteration being made (s 34).

Rights and administrative remedies

• Application rights: Owners can apply for safety certificates (s 11(1)), permits (s 22(1)), exemptions (s 7(1)) and equivalents (s 8(1)). The application processes default to Division 3 of Marine Order 1 for many procedural rules (s 11(2), s 22(2), s 8(1) note).

• Exemptions and equivalents: Owners may seek exemptions where compliance is unnecessary or unreasonable, and AMSA may grant them only if they would not contravene SOLAS or the relevant Code (s 7(2)). Equivalents must be at least as effective as the requirement they replace for AMSA to approve (s 8(2)).

• Review rights: Decisions under ss 23 (issue), 26 (variation) or 27 (revocation) are reviewable decisions under section 17 of Marine Order 1 according to s 9. The Order also references Navigation Act review processes in its notes (s 11 note referencing subsection 313(1) of the Navigation Act). Owners thus retain administrative avenues for review.

AMSA powers and constraints

• Issue, vary, revoke: AMSA may issue permits if satisfied on the criteria listed in s 23, may impose conditions on permits (s 24) and may vary or revoke permits where conditions are breached or likely to be breached (ss 26-27). For certificates, the criteria for variation and revocation are tied to survey completion and the Code provisions (ss 13, 17, 20).

• Delegation and recognised organisations: The Order contemplates AMSA arrangements with recognised organisations for survey and certification services for Australian‑registered vessels (s 5 note). Endorsements on HSC Safety Certificates must be made by an issuing body (s 16), and in practice the endorsing body will be the same that issued the certificate (s 16 note).

Criminal and civil liabilities

• Strict liability offences and civil penalties are specified for operating without a required permit except in the limited transit case (s 21(1)‑(3)), and for operation contrary to the Codes and permit conditions (s 32) and for failing to have the required information on board (s 33). The criminal penalty indicated in those sections is 50 penalty units; corresponding civil penalties are the same (50 penalty units).

• Revocation criteria for certificates and permits include breach or likely breach of conditions, cessation of Australian registration, owner requests in writing and incorrect information (ss 17, 20, 27).

Practical interface points

• Owners must align survey, certification and operational arrangements with the Code provisions (ss 12-19, 23) and with any AMSA conditions, while preserving the right to apply for exemptions or equivalents via Marine Order 1. Navigation Act enforcement provisions (sections 103, 104, 106, 107 referenced in notes) interact with the Order’s offences and may create additional enforcement pathways.

The Order establishes a mixture of criminal offences (strict liability for certain breaches), civil penalties and administrative enforcement through certificates and permits. Enforcement routes and the legal instruments that trigger them are clearly specified.

Criminal offences and strict liability

• Operating without a permit: s 21(1) makes it an offence to operate a high‑speed craft without a permit except where the transit voyage exception applies. The penalty for contravention is 50 penalty units. Subsection 21(2) states explicitly that an offence under s 21(1) is a strict liability offence. A separate civil penalty is also prescribed in s 21(3), set at 50 penalty units.

• Operating inconsistent with Codes and permit conditions: s 32(1) requires the master or owner to ensure operation in accordance with the applicable Code and any permit conditions; the penalty is 50 penalty units. Subsection 32(2) declares this a strict liability offence and 32(3) attaches a civil penalty of 50 penalty units for contravention.

• Information material on board: s 33(1) makes it an offence to take the vessel to sea without adequate information and guidance material on board; penalty 50 penalty units. Subsection 33(2) renders it a strict liability offence and s 33(3) sets a civil penalty of 50 penalty units.

Strict liability categorisation matters because it removes the need for AMSA/prosecutors to prove mens rea for those particular offences, making enforcement administratively easier. Owners and masters therefore bear higher operational compliance risk.

Administrative enforcement: certificates, permits and conditions

• Revocation and variation: Certificates and permits may be varied or revoked by AMSA under the criteria in the Order. For HSC Safety Certificates and DSC Certificates, revocation criteria include breaches of certificate conditions, loss of Australian registration, owner requests and incorrect information (ss 17 and 20). For permits, AMSA may revoke if the owner has breached or is likely to breach a permit condition (s 27). Variation criteria for certificates are tied to survey completion and compliance with Code sections on variation (s 13).

• Conditions: Certificates are issued subject to conditions that require continuing maintenance to Code standards, implementation of owner arrangements required by the Codes, completion and endorsement of periodic surveys, and AMSA approval for changes beyond direct replacement (ss 15(a)-(c), 19(a)-(e)). Permits are explicitly subject to conditions including those imposed by other countries where the craft will operate, operational limits and conditions imposed by AMSA (s 24).

• Endorsements and issuing bodies: Endorsements must be made by an issuing body (s 16); the Order notes the practice that the issuing body endorsing a certificate will be the same that issued it. AMSA’s arrangements with recognised organisations for survey and certification are noted (s 5 note), which is the practical channel through which much administrative compliance and enforcement is effected.

Reporting obligations and incident response

• Marine incidents that must be reported are prescribed in s 31 and include equipment failures that may affect compliance with the Codes, incidents that may affect compliance, and anything that substantially affects the integrity or the efficiency/completeness of surveyed equipment. The orders note that owners and masters must report marine incidents to AMSA under the Navigation Act (s 31 note 1), and refer to Marine Order 1 for the prescribed reporting periods and approved forms (s 31 note 2).

• Failure to report incidents is actionable under the Navigation Act reporting duties and may interact with revocation and enforcement actions under the Order.

Administrative timelines, durations and procedural safeguards

• Certificate and permit durations are set by reference to the Codes and the Order: HSC Safety Certificates commence and cease in accordance with section 1.8 of the relevant HSC Code; DSC Construction and Equipment Certificates in accordance with section 1.6 of the DSC Code (s 12). Permits expire at the earlier of either 5 years where a HSC Safety Certificate is in force or 1 year where a DSC certificate is in force, or a shorter AMSA‑determined period (s 25).

• Review mechanisms: s 9 makes a decision under ss 23, 26 or 27 a reviewable decision under section 17 of Marine Order 1 (Administration) 2013. The Order also notes that certain certificate decisions are reviewable under subsection 313(1) of the Navigation Act (s 11 note), tying the administrative remedies to established review processes.

Other enforcement connections

• The Order repeatedly references that it gives effect to SOLAS and the IMO Codes (s 2(b), s 4 notes), and the Notes in ss 10 and 28 stress that taking a vessel to sea without a certificate of a specified kind is an offence under sections 103, 104, 106 and 107 of the Navigation Act. Those Navigation Act provisions provide further enforcement tools beyond the Marine Order’s penalty clauses.

• AMSA’s power to make Marine Orders is exercised under s 3 and the enabling provisions in the Navigation Act; enforcement therefore sits within the broader Navigation Act regime.

Overall enforcement thus operates on three tracks: criminal/civil monetary penalties for operational breaches (strict liability on key operational rules); administrative sanctions via conditions, variation and revocation of certificates and permits; and reporting‑driven enforcement and oversight tied into Navigation Act procedures.

Marine Order 49 is explicitly designed to operate within a larger legal framework. The Order is made under the Navigation Act 2012 and cross‑references Marine Order 1 (Administration) 2013 and other Marine Orders, while importing and giving effect to international conventions and IMO Codes. Key interactions include the following.

Navigation Act 2012

• Enabling powers and penalties: s 3 of the Order lists the Navigation Act provisions that permit the making of the Order (ss 98, 314, 339(2), 340(1)(a), 341(1)). The Order relies on the Navigation Act for the legal authority to prescribe safety certificates (s 3(1)(a)) and for imposing penalties for contraventions (s 3(1)(e)). The Order also notes that offences for taking a vessel to sea without a specified certificate are covered by sections 103 and 104 of the Navigation Act (s 10 note) and similarly for foreign vessels (s 28 note referencing sections 106 and 107 of the Navigation Act).

• Review and enforcement processes: the Order refers to review procedures under the Navigation Act, including the reference to subsection 313(1) in s 11 note, and it uses Marine Order 1 review mechanisms for certain decisions (s 9).

Marine Order 1 (Administration) 2013

• Procedural rules: applications for certificates and permits, exemptions and equivalents are routed through the application and review processes established in Marine Order 1 (ss 7-8, 11(2), 22(2)). Section 34 expressly adopts the 7‑day notification period for reporting alterations as an element of the Navigation Act reporting regime and ties it to the Marine Order 1 framework (s 34).

• Exemptions, equivalents and use definitions: s 7 and s 8 refer to the application processes set out in Marine Order 1 for exemptions and equivalents and note that definitions of "equivalent" and "use" are in Marine Order 1 section 6.

Other Marine Orders

• Marine Order 21 (Safety of navigation and emergency procedures) 2013: s 23 note points to Marine Order 21 for the requirements for safe manning. Thus seafarer certification and minimum safe manning are governed by that separate Marine Order but are operationally linked to the permit issuance criteria in MO49.

International law: SOLAS and IMO Codes

• The Order repeatedly gives effect to the 2000 HSC Code, the 1994 HSC Code, and the DSC Code and thereby incorporates their technical compliance standards (s 2(b), s 4 definitions, ss 12-20, 23). It requires that certificates be in the forms set out in Annex I to the relevant Codes and that permits correspond to the forms in the Codes (s 4 definitions). The Order also restricts AMSA from granting exemptions that would contravene SOLAS or an applicable Code (s 7(2)).

• By adopting the Codes’ terms and survey/endorsement procedures, the Order links Australian domestic compliance to internationally recognised forms and processes, which has implications for foreign vessel interactions and mutual recognition of certificates and permits (ss 28-30).

Administrative law and delegation

• The Order contemplates delegation to issuing bodies and recognised organisations for surveying and certification services and records AMSA’s arrangements with those bodies (s 5 note). Those delegations operate under Marine Order 1 and the Navigation Act delegation framework.

Criminal/civil law intersection

• The Order’s offences are complementary to Navigation Act offences. The notes in ss 10 and 28 specifically point out Navigation Act sections (103, 104, 106, 107) that create offences for vessels taken to sea without required certificates. Thus, breaches may attract both Marine Order penalties and Navigation Act enforcement action.

Practical overlap and potential duplication

• The Order requires a permit containing matters set out in s 23(b). For foreign vessels, s 29 requires that permits be issued by the Administration of the flag state and include the same matters. This creates an expectation of compatibility between domestic permit criteria and foreign flag permit content, but operationally it could require documentary checks and reconciliation against AMSA expectations when foreign vessels operate in Australian waters (s 30).

• Marine Order 49 does not itself set out the full details of technical manuals, equivalent approvals, application timeframes, or internal review processes; those procedural matters are handled in Marine Order 1 and in the content of the Codes. Practitioners must therefore work across instruments to assemble the full compliance matrix.

This compilation of Marine Order 49 carries a compilation date and amendment trail recorded in the Order’s notes. The mechanical history in the Order is as follows:

• Original instrument: Marine Order 49 (High‑speed craft) 2015 (MO2015/2), registered 6 February 2015 and commenced 16 February 2015 (Notes table).

• Subsequent amendment: Marine Order 81 (Administration amendment) 2016 (MO2016/18), registered 12 December 2016 and commenced 13 December 2016. The compilation date recorded at the head of the instrument is 13 December 2016. The compilation states it takes into account amendments up to Marine Order 81 (Administration amendment) 2016 (compilation header).

• Aedendums and affected provisions: The notes reproduce an amendments table and an HTML table that indicate specific provisions affected. The table entries show that provisions labelled 1A and 1B were repealed (rep.) by the Legislation Act 2003 (sections 48C and 48D) , the table indicates "rep. Legislation Act 2003, s 48D" and "rep. Legislation Act 2003, s 48C" respectively , although the main body of MO49 as provided here does not include text for 1A and 1B. The amendments table explicitly notes that provision 31 was amended by MO2016/18 (row showing "31 am. MO2016/18").

• The compilation notes and the amendments table are the only explicit indications of amendment history contained within the provided text. The table indicates which items were added, amended or repealed using abbreviation keys (ad., am., rep., rs.). The table identifies that the only specifically flagged amendment in the supplied table is to provision 31, which corresponds to the "Marine incident" prescription in Division 5.

Limitations on what can be concluded from the compilation notes

• The Order’s notes identify the presence of amendments and the registration/commencement dates, and identify the particular Marine Orders that effected the changes. The compilation table does not provide the prior version text or the full amendment text; it only flags that s 31 was amended by MO2016/18. The precise content of that amendment is not reproduced beyond the fact of amendment.

• The other table entries (1A and 1B) are shown as repealed by provisions of the Legislation Act 2003; absent the prior context of those provisions in this compilation it is not possible to specify their former content from the provided text.

Practical effect for practitioners

• Section 31, which prescribes particular categories of marine incidents to be reported for the purpose of the Navigation Act definition, was amended by MO2016/18. Practitioners should verify the current operative text of s 31 in the consolidated instrument and check AMSA guidance and the Marine Orders Register for the precise amendment. The compilation date is 13 December 2016 and reflects changes up to that date; subsequent amendments (if any) are not contained in this document.

• The amendment history as recorded requires practitioners to consult the consolidated legal instrument on the Federal Register of Legislation or AMSA’s website for any later amendments beyond December 2016 and to confirm the current operative text before advising clients or taking compliance action.

The text of Marine Order 49 (High‑speed craft) 2015, as provided, contains no judicial decisions, case references or a litigation history. The instrument itself names no cases and contains only statutory and administrative provisions and cross‑references.

Administrative review and potential for litigation

• Administrative decisions under the Order are reviewable: s 9 makes decisions under ss 23 (issue of permit), 26 (variation of permit) and 27 (revocation of permit) reviewable decisions for section 17 of Marine Order 1 (Administration) 2013. Section 11 note indicates safety certificate decisions are reviewable under subsection 313(1) of the Navigation Act. These review pathways create customary administrative appeal avenues; they also establish the procedural route by which decisions of AMSA and issuing bodies may be challenged and, if necessary, taken up to tribunals or courts consistent with the Navigation Act and administrative law.

• Given the Order’s reliance on the Navigation Act and Marine Order 1 procedural provisions, litigation arising from interpretation of certification criteria, revocation or variation actions, enforcement of strict liability offences, or disputes over AMSA’s acceptance of equivalents or exemptions would proceed within the administrative law framework relevant to AMSA decisions and the criminal/civil enforcement provisions of the Navigation Act.

What this means in practice

• No specific litigation record is contained in the Order; practitioners should not infer any caselaw from the instrument itself. If a client requires precedent or litigation history, the appropriate next step is to search federal courts, tribunals, and administrative decisions referring to Marine Order 49, AMSA determinations or Navigation Act litigation arising from high‑speed craft enforcement actions.

• The Order’s provisions that create reviewable decisions and tie into Marine Order 1 and the Navigation Act indicate that litigation or tribunal review would be pursued through the administrative review channels applicable to AMSA decisions and that underlying enforcement actions for offences could generate judicial proceedings under the Navigation Act criminal and civil enforcement regime.

Marine Order 49 contains several operationally significant traps and points of potential uncertainty that practitioners and operators must watch. These are concrete issues that commonly cause non‑compliance or administrative friction.

Strict liability and civil penalties

• Several operational duties are strict liability offences (s 21(2), s 32(2), s 33(2)) with corresponding civil penalties (s 21(3), s 32(3), s 33(3)), each set at 50 penalty units. Practitioners must note that strict liability eliminates the need for a prosecution to establish intent, so procedural compliance and documentary evidence are crucial defences.

Transit voyage exception constraints

• The Order permits limited operations without a permit only where the craft is undertaking a transit voyage described in paragraph 1.9 of the HSC Codes and where a safety plan approved by AMSA is on board and the master is familiar with safe operation during the transit voyage (s 21(1)(b)). The content and approval standard for the safety plan are governed by Code provisions and AMSA practice; mischaracterising a voyage as a transit voyage or operating beyond the scope of the safety plan can expose operators to s 21 penalties.

Different regimes by construction date

• Which Code applies depends on vessel construction dates and whether a vessel meets the requirements of the 1994 HSC Code for older craft (s 6(1)(a)-(d)). Owners need to correctly classify the vessel’s construction date and application of the Code to ensure they apply the right survey and certificate criteria and do not inadvertently operate under the wrong standard.

90% speed/time limitation

• For permit issue AMSA must be satisfied that the craft will operate within certain distance/time thresholds at 90% of maximum speed from a place of refuge: for passenger vessels, not more than 4 hours at 90% maximum speed; for cargo vessels over 500 GT, not more than 8 hours at 90% maximum speed (s 23(b)(v)). This is a strict technical operational limit that affects route planning, choice of refuge and may influence commercial scheduling and fuel plans. Owners must demonstrate worst intended conditions and operational limitations when applying for a permit (s 23(b)(ii)).

Approval for alterations and notification window

• After any survey, any change to structure, equipment, systems, fittings, arrangement or material covered by survey (other than direct replacement of equipment or fittings) requires AMSA approval (s 15(c) and s 19(e)). Additionally, owners must inform AMSA and the issuing body of alterations within 7 days after the alteration is made (s 34). Practitioners must therefore ensure that prior approvals are sought where required and that the 7‑day reporting window is observed; retrospective approvals risk AMSA enforcement action.

Equivalents and exemptions: high threshold and SOLAS constraint

• Equivalents must be "at least as effective" as compliance with the requirement (s 8(2)). Exemptions can only be granted if compliance would be unnecessary or unreasonable and giving the exemption would not contravene SOLAS or an applicable Code (s 7(2)). AMSA’s evaluative standard and the expressed SOLAS constraint limit the scope for relief. Practical implication: owners should prepare strong technical justification and third‑party evidence when seeking equivalents/exemptions.

Foreign vessel permit reconciliation

• Foreign vessels must have a permit to operate issued by their flag Administration that includes the matters in s 23(b) (s 29(1)(a)-(b)). When foreign craft operate in Australian waters, AMSA may check that the foreign permit covers equivalent matters. In practice, differences between a foreign Administration’s permit content and what AMSA expects could lead to operational delays or additional AMSA conditions being applied.

Documentation and systems obligations

• The Order requires a suite of documents on board , route operational manual, craft operating manual, training manual, maintenance manual and servicing schedule , and a quality management system (s 23(b)(viii)-(ix)). Failure to maintain current documentation is an offence under s 33 and grounds for permit variation or revocation. The administrative burden of drafting, updating and retaining manuals should not be underestimated.

Ambiguity on "adequate number of seafarers"

• The Order requires "an adequate number of seafarers with appropriate seafarer certificates or qualifications" (s 23(b)(iv)) and refers to Marine Order 21 for safe manning requirements. Practitioners must reconcile the permit submission with Marine Order 21 requirements and ensure records of certificates and qualifications are available for inspection.

Endorsement practice and issuing bodies

• An endorsement on a HSC Safety Certificate must be made by an issuing body, and it is practice that the endorsing issuing body will be the same as the issuing body that issued the certificate (s 16). In practice, when ownership changes or certificates need variation, coordination with the issuing body is necessary to secure timely endorsements.

Reporting obligations scope

• The marine incidents prescribed in s 31 are drafted broadly and capture equipment failure that may affect Code compliance, any incident involving the vessel that may affect compliance, and anything that substantially affects vessel integrity or surveyed equipment. The breadth of these prescriptions can bring a wide range of events into the reporting regime; owners and masters should establish clear internal incident reporting protocols.

Permit duration asymmetry

• Permit durations differ depending on the certificate in force: where a HSC Safety Certificate is in force a permit expires at the earlier of 5 years, but where a DSC Construction and Equipment Certificate is in force a permit expires at the earlier of 1 year (s 25). For DSC craft, more frequent renewals and potential administrative overheads arise.

Compliance with Marine Order 49 requires a coordinated programme of technical surveys, documentation, crew certification, and administrative interaction with AMSA. A practical compliance checklist aligned to the Order’s provisions follows.

1. Determine which Code applies

   • Classify the vessel by construction date and characteristics per s 6(1)(a)-(d). If constructed after 30 June 2002, the 2000 HSC Code applies; if between 1 January 1996 and 30 June 2002, the 1994 HSC Code may apply; vessels constructed before 1 January 1996 may be captured by the 1994 HSC Code or the DSC Code (s 6(1)). Confirm whether the vessel is a "dynamically supported craft" as defined in the DSC Code (s 4).

2. Secure the correct certificates

   • Apply for the HSC Safety Certificate or DSC Construction and Equipment Certificate under the processes in Marine Order 1 (s 11). Ensure the vessel has completed the initial or renewal survey in accordance with section 1.5 of the applicable Code (ss 14(a)(i), 18(a)) and that all Code requirements are met (ss 14(a)(ii), 18(b)).

3. Prepare and maintain technical documentation and quality systems

   • Assemble the route operational manual, craft operating manual, training manual, maintenance manual and servicing schedule and ensure they are carried on board at all times for operations (s 23(b)(viii), s 33). Implement and maintain a quality management system for the craft (s 23(b)(ix)). Use the Code guidance for required manual content (see s 33 notes referencing s 1.12 of the HSC Codes and s 1.8 of the DSC Code).

4. Crew certification and manning

   • Ensure an adequate number of seafarers with appropriate seafarer certificates or qualifications are engaged on the craft to meet safe manning and AMSA expectations (s 23(b)(iv)). Cross‑check with Marine Order 21 for regulated Australian vessels for precise manning requirements (s 23 note).

5. Risk assessment and operational limits

   • Identify worst intended conditions and operational limitations and document them explicitly (s 23(b)(ii)). Plan operations to meet the permit operational limit thresholds (s 23(b)(v)) , for example passenger craft must be planned so they are not more than 4 hours at 90% maximum speed from a place of refuge.

6. Apply for a permit to operate

   • Owner applies to AMSA (s 22). Provide AMSA with details of any conditions imposed by countries of operation (s 23(b)(i)), documentation showing certifications in force (s 23(b)(iii)), proof of seafarer qualifications (s 23(b)(iv)), and evidence of area support (communications, weather forecast access, maintenance and SAR availability, s 23(b)(vi)-(vii)). Ensure the permit application demonstrates the presence of the manuals and quality system (s 23(b)(viii)-(ix)).

7. Maintain survey compliance and manage alterations

   • Complete periodic surveys in accordance with the applicable Code and ensure endorsements are placed on certificates (ss 15(a)(iii), 19(b), 16). For any changes to structure/equipment covered by survey beyond direct replacement, seek AMSA approval before or at least ensure timely notification and approval where required (ss 15(c), 19(e), 34 requires notifying AMSA and the issuing body within 7 days of an alteration).

8. Document AMSA interactions and permissions

   • Where seeking an equivalence or exemption, apply through Marine Order 1 processes with detailed technical justification demonstrating the equivalent is at least as effective or that compliance would be unnecessary/unreasonable and would not contravene SOLAS or the Codes (ss 7-8). Retain AMSA correspondence and approvals in the craft documentation.

9. Implement incident reporting procedures

   • Establish and test an incident reporting protocol that captures events within s 31’s scope. Be prepared to report equipment failure that may affect compliance, incidents that may affect compliance, and anything substantially affecting integrity or surveyed equipment. Use AMSA approved forms and observe reporting timeframes under Marine Order 1 and the Navigation Act (s 31 note 2).

10. Training, audits and maintenance scheduling

• Integrate training to ensure masters and crews are "familiar with information for the safe operation" of the craft during transit voyages and permitted operations (s 21(1)(b)(iii)). Schedule internal audits aligned to survey periodicity and quality management system requirements (s 23(b)(ix)). Keep maintenance and servicing schedules current and evidence of completed maintenance on board.

11. Plan for administrative review and change control

• Keep records of certificate and permit issue dates, endorsements and any AMSA conditions. If AMSA varies or revokes a permit or certificate, exercise review rights under Marine Order 1 and the Navigation Act review mechanisms (s 9, s 11 note).

12. Foreign operations

• For foreign‑flagged vessels, ensure the flag Administration issues a permit that includes the matters in s 23(b) and that the vessel holds a certificate issued in accordance with the applicable Code (ss 28-29). For transit voyages by foreign craft, ensure the flag Administration has approved the safety plan and that the master has the required familiarity (s 29(2)-(3)).

Operational checklist summary

• Identify applicable Code and ensure full conformance.
• Complete requisite surveys and secure HSC or DSC certificates with endorsements.
• Apply for and hold a permit to operate when required, providing full documentation on crew, manuals, communications, SAR, weather and quality systems.
• Keep manuals and guidance material on board; do not take vessel to sea without them.
• Maintain maintenance schedules and meet periodic survey/inspection timelines; seek AMSA approval for alterations beyond direct replacement and notify within 7 days.
• Implement incident reporting protocols for events specified in s 31.
• Use Marine Order 1 procedures for applications, equivalents and exemptions, and preserve records for administrative review.

Costs and risk allocation

• Budget for survey fees, recognised organisation fees where AMSA delegates are used, maintenance, drafting and updating of manuals, crew training and certification, and potentially higher administrative overhead if AMSA imposes conditions or requires additional documentation for foreign operations. Owners face the principal economic burden; AMSA decides whether to grant permits, equivalents or exemptions and may impose conditions that change operational costs.

Finally, practitioners should consult the consolidated text and AMSA guidance on forms and procedural matters and verify whether any amendments post‑December 2016 affect the current compliance posture.
