Marine Order 47 (Offshore industry units) 2019

The Order builds on a small set of foundational concepts that determine applicability, the scope of obligations and the administrative framework. These concepts are defined in section 4 and refined by section 5 and the Schedules. They operate as the rules of construction for the rest of the instrument.

Offshore industry unit is a central definitional hook. Section 4 defines that term by reference to the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Schedule 3, subclauses 4(1) and 4(5A)) and excludes entities listed in subclause 4(6) of that Schedule. The definition captures vessels used in operational activities described in that other Act, and explicitly excludes non-vessels such as structures. That delimitation matters because the Order applies only to vessels and not to fixed platforms that are “facilities” under the petroleum Act (see section 6 note and s 14 of the Navigation Act referenced).

Certificates and their taxonomy are a second organising concept. Section 8(1) requires regulated Australian vessels to hold: for MODUs a MODU safety certificate; for vessels that SOLAS requires to have a certificate, the corresponding certificate in Schedule 1 (labelled SOLAS certificates); and for vessels not required by SOLAS (or cargo vessels under 500 GT) the Schedule 2 certificates (labelled non-SOLAS). Schedule 1 reproduces the criteria and conditions for the five SOLAS certificates (Passenger Ship Safety Certificate, Cargo Ship Safety Construction, Equipment, Radio, and Cargo Ship Safety Certificate). Schedule 2 does the same for Certificate(s) of Survey for passenger or cargo vessels under the non-SOLAS stream.

Survey and endorsement processes are expressed as compliance mechanisms. The Order ties certificate issuance and renewal to surveys carried out in accordance with the MODU Code, SOLAS Regulations 7-10 of Chapter I and the Survey Guidelines under the HSSC (see sections 10(c), 15, Schedule 1 and Schedule 2). Endorsements following annual, intermediate or bottom inspections are required (see sections 11(h), 22(b), 23, 17 and 12). The Order also permits application for equivalents and approval of in-water inspections to replace dry-dock inspections, but only with AMSA approval and subject to equivalence criteria (sections 7, 31).

Equivalence and delegation are third key concepts. Section 7 allows owners to apply to AMSA for approval to use equivalents for survey or inspection arrangements; AMSA’s approval requires satisfaction that the use will not contravene the MODU Code or SOLAS and that it is at least as effective as the replaced requirement (section 7(2)). The Order accepts recognised organisations and issuing bodies as operational actors; owners may hold arrangements with classification societies and recognised organisations, and such arrangements are material to issuing bodies when assessing certificate criteria (see sections 10(b), 15(b), 21(c) and various notes).

Safety management concepts are embedded via cross-reference to the ISM Code and ISM Guidelines in both Schedules and the text. For example, Schedule 2 requires the vessel’s owner who will take over duties as the “Company” under the ISM Code to provide a written declaration that a safety management system is in place as if Chapter IX of SOLAS applied (Schedule 2.2). Safe transfer of personnel is repeatedly required to be demonstrable in the vessel’s safety management plan (see sections 11(e), 16(b), 22(c) and the related notes).

Operational controls for particular risks are specified. The MODU-specific clause requires carriage of the MODU Code on board and compliance with Chapter 14 of the 2009 MODU Code whether that Code applies to the vessel or not (section 11(b)-(c)). There are explicit stowage rules for gas cylinders tied to separation from breathing cylinders and distance from accommodation, bridge and radio room (sections 11(d), 16(c), 22(d)). Reporting of defects adopts the SOLAS definition of defect (section 30(2)), and requires prompt reporting to AMSA and coastal state authorities, in particular for MODUs (section 30(1)(b)-(c)).

Notification concepts define timing and responsibilities. Planned tow notifications must be lodged at least seven days before the tow commences, and owners and masters share duties to implement arrangements for safe towage including stability assessments, equipment, manning and crew familiarisation (section 28). Alterations and major repairs must be notified to AMSA and issuing bodies within seven days of making or completion respectively (section 29).

Finally, the Order embeds enforcement and administrative discretion. AMSA may impose conditions, endorse certificates, revoke approvals and require owners to revert to dry-dock surveys if an approved in-water inspection fails to meet conditions (sections 7(4), 12, 14A, 31(3)-(4)). The Navigation Act provisions that empower the Order, and which it incorporates by reference, include enforcement tools such as prohibition notices and directions by inspectors (section 3 references to ss 98, 125, 314, 339; note references to inspectors in section 28).

Those main concepts together create a framework where international codes are operationalised through AMSA decision-making, issuing-body surveys and owner obligations.

The Order’s reach is limited by its definitions but wide in impact across several actor categories. Primary affected parties are owners and masters of offshore industry units, issuing bodies and recognised organisations, classification societies, AMSA, foreign flag Administrations and, indirectly, crew and contractors engaged in survey, towage and offshore transfers.

Owners and masters. Owners and masters of regulated Australian vessels that qualify as offshore industry units must ensure the vessel holds the correct category of safety certificate, arrange initial and renewal surveys, implement and demonstrate safe transfer arrangements, maintain required documentation on board and meet survey and endorsement schedules (see sections 8-13, 11(e), 11(f), 21-24). Owners also bear specific notification obligations: for planned tows they must notify AMSA at least seven days before commencement and provide information requested by AMSA (section 28(1)-(2)); they must notify AMSA and issuing bodies within seven days of alterations or of completion of major renewal or repair (section 29); and they must report defects at the earliest opportunity (section 30(1)). For a vessel being towed, the owner must ensure safe towage arrangements are implemented (section 28(3)).

Issuing bodies and recognised organisations. The Order presumes a system in which issuing bodies and recognised organisations perform initial and renewal surveys and may issue or endorse certificates (sections 9(2), 10(c), 12, 17, 23). The Order also assumes recognised organisations will issue certain safety-related certificates such as diving safety certificates where fixed diving systems were fitted after 23 November 1995 (sections 15(c), 21(d)). Classification society relationships are material; holding a valid certificate of classification is a criterion for several certificates (sections 10(b), 15(b), 21(c)).

AMSA. The Australian Maritime Safety Authority is the Administration for Australian regulated vessels (section 5(2)(a)), the decision-maker for equivalency approvals (section 7), for approval of in-water inspections (section 31), and for endorsing and revoking safety certificates under the Navigation Act criteria set out in this Order (see sections 14A, 19, 20, 26). AMSA also receives the notifications and reports the Order prescribes (sections 28-30).

Foreign flag Administrations and foreign vessels. Foreign vessels in Australian waters are required to carry the certificates mandated by Regulation 12 of SOLAS, and to comply with SOLAS to the extent required by their flag Administration (section 27(1)). If not required under Regulation 12, foreign vessels must carry at least one document attesting to seaworthiness, with details of areas of operation, equipment and manning, and comply with their flag Administration’s requirements (section 27(2)).

Surveyors, classification societies and marine service providers. The Order increases demand for periodic surveys, issuing-body inspections, towing assessments, towing survey reports and associated technical documentation (sections 28(2) note 1, 31(2)). Owners will engage surveyors and recognised organisations to prepare equivalence applications and to perform in-water inspections when approved (sections 7 note 2, 31(1)-(3)).

Third parties and contractors. Entities that supply equipment for safe personnel transfer, towing equipment suppliers, and maintenance contractors are affected because the Order requires safe transfer arrangements, adequate towing equipment and approvals for major repairs and renewals (sections 11(e), 28(2)(a)(ii), 29(2)). Insurers and P&I clubs may become involved in planning and notification for tows (section 28(1) note 2).

Crew and seafarers. Crew must be familiarised with responsibilities for planned tows, trained in accordance with IMO Resolution A.1079(28) where applicable and participate in fire and abandonment drills in accordance with chapter 14 of the 2009 MODU Code (section 28(2)(a)(iv); section 11(b) and note 1). The Order therefore imposes requirements that affect crew training and contingency planning.

Regulatory interplay and administrative reviewers. Decisions about safety certificates are reviewable by the Administrative Appeals Tribunal under subsection 313(1) of the Navigation Act, and the Order notes that internal review under Marine Order 1 s 17 does not apply to safety-certificate decisions (section 9(2) and notes). Inspectors under the Navigation Act retain powers to issue prohibition notices or directions in relation to planned tows and compliance failures (section 28(2) note 2 referencing ss 264, 267 of the Navigation Act).

In summary, the Order places the operational and compliance burden squarely on vessel owners and masters, leverages issuing bodies and classification societies to carry out technical verification, centralises approval discretion with AMSA and obliges foreign vessels to carry their flag-state certificates or equivalent documentary proof while in scope.

The Order sets out specific duties owners and masters must follow, and it also creates rights and administrative paths for applicants and recognised organisations. Duties are concrete and time-bound; rights are mainly procedural and contingent on AMSA acceptance.

Primary duties

• Hold and maintain required safety certificates. Section 8(1) requires regulated Australian vessels to have the appropriate certificate: MODU safety certificate for MODUs, SOLAS certificates for vessels required by SOLAS, and non-SOLAS certificates for the remainder. The Order specifies criteria for issue and conditions that become ongoing obligations while the certificate remains in force (sections 10-11; Schedule 1; Schedule 2).

• Maintain surveys and endorsements. Certificates must be supported by initial, renewal, annual, intermediate and other surveys as applicable, and the Order mandates endorsements following completion of annual, intermediate or bottom inspections (sections 11(g)-(h), 17, 23). For MODUs, survey conduct must follow the applicable MODU Code (section 10(c)).

• Keep documentation and codes on board. MODU certificates require the MODU Code and related material to be on board and available to seafarers, and owners must be able to demonstrate arrangements for safe personnel transfer (sections 11(b)-(f)). SOLAS and non-SOLAS certificate conditions similarly require compliance and access to documentation (sections 16, 22).

• Notify AMSA of planned tows at least seven days before commencement and implement specified safe towage arrangements, including stability assessments, adequate equipment, appropriate manning and crew familiarisation (section 28(1)-(2)). The owner of a vessel being towed must ensure safe towage arrangements are implemented (section 28(3)). Owners must also provide information AMSA requests (section 28(2)(b)).

• Notify AMSA and issuing bodies of alterations or major repair work within seven days of the alteration or completion (section 29(1)-(2)).

• Report defects promptly. Section 30(1) requires that defects be reported at the earliest opportunity to AMSA, and immediately to coastal state authorities for MODUs or when in another SOLAS contracting government’s port.

• Implement and maintain an ISM-compliant safety management system where required. Schedule 2.2 requires a declaration by the owner acting as the “Company” under the ISM Code that the vessel has a safety management system in place and applied as if Chapter IX of SOLAS applied.

• Comply with gas cylinder stowage rules. Sections 11(d), 16(c) and 22(d) require separation of certain cylinders and minimum distances from accommodation and critical spaces.

Administrative rights and processes

• Apply for certificates and for AMSA approval of equivalents and in‑water inspections. Section 9(1) confirms the types of certificates for which an application may be made. Section 7 allows the owner to apply to AMSA to use an equivalent and section 31 allows application for approval of in‑water inspections in place of dry-docking.

• Use issuing bodies and recognised organisations to undertake surveys and inspections. Sections 10(b), 15(b) and 21(c) accept valid certificates of classification and recognised-organisation-issued diving safety certificates as inputs to the issue of safety certificates.

• Seek variation, endorsement and revocation processes. Sections 14 and 19 specify criteria for variation consistent with MODU Code or SOLAS Regulation 14, and sections 14A, 20 and 26 set out criteria for revocation including where conditions are breached, requested by the owner, or contain incorrect information.

• Administrative review via the Administrative Appeals Tribunal. Section 9(2) notes that decisions about safety certificates are reviewable by the AAT under subsection 313(1) of the Navigation Act; internal review under Marine Order 1 s 17 is not applicable to safety-certificate decisions (section 9(2) and notes).

Delegated and conditional authorities

• Issuing bodies may endorse certificates after surveys and may impose other conditions under paragraph 100(2)(b) of the Navigation Act as reflected in the notes (sections 12, 17 and notes to those sections).

• AMSA may grant or revoke approval for equivalents and in‑water surveys and impose conditions on approvals; failure to meet conditions triggers a requirement to revert to dry-docking (sections 7(4), 31(3)-(4)).

Practical limits on rights

• AMSA’s discretion to approve equivalents is bounded by the requirement that the use would not contravene the MODU Code or SOLAS and must be at least as effective as the replaced requirement (section 7(2)(a)-(c)). Equivalence approvals can be revoked if AMSA is no longer satisfied of equivalence (section 7 note 4).

• Duration and endorsement rules may restrict operational flexibility. Certificate durations are specified in section 13 for MODUs, section 18 for SOLAS certificates, and section 24 for non-SOLAS certificates, with provisions that allow some extensions subject to conditions and AMSA satisfaction (see section 25(2) table). Variations that extend expiry dates are constrained to vessel types listed and to satisfaction by AMSA that survey frequency remains at least as effective (section 25(1)(b)).

In sum, the Order imposes concrete, enforceable duties on owners and masters, while creating administrative rights to seek approvals or to use issuing bodies. Those rights are contingent because the Order grants AMSA discretion to assess equivalence, impose conditions and revoke approvals or certificates where criteria are not satisfied.

The Order itself primarily sets substantive requirements and administrative processes and frequently references enforcement powers and criminal offences provided in the Navigation Act. It does not list discrete fines in text but integrates with statutory enforcement mechanisms and inspector powers. Practical enforcement therefore occurs through certificate refusal, revocation, endorsements, prohibition notices and statutory offences referenced in the Act.

Statutory offence connections

• Offences for operating without required safety certificates. The Order notes that taking a vessel to sea without a safety certificate of the specified kind is an offence under sections 103 and 104 of the Navigation Act (sections 8 note; and section 27 note referencing sections 106 and 107 for foreign vessels). The Order’s certificate requirements in section 8 therefore directly link to criminal liability under those Navigation Act provisions.

• Reporting offences. Section 30 cross-references the Navigation Act reporting obligations under sections 185 and 186 for marine incidents, and the Order prescribes defect reporting (section 30(1)) reflecting those statutory duties. Failure to report defects and incidents can therefore attract penalties under the Navigation Act.

Inspector powers and administrative enforcement

• Prohibition notices and directions. The Order notes that an inspector may issue a prohibition notice if a planned tow would involve a serious risk to the health or safety of a person, under section 267 of the Navigation Act, and may issue directions if a person is not complying with requirements, under section 264 of the Act (section 28(2) note 2). These enforcement mechanisms allow immediate operational intervention where safety risks are identified.

• Endorsements and refusal to endorse. Issuing bodies are authorised to endorse certificates following surveys and may withhold endorsements if required surveys or conditions have not been met (sections 12, 17, 23). The effect is practical: a vessel cannot lawfully sail without the endorsements that evidence valid surveys.

Administrative revocation and suspension

• Revocation criteria. Sections 14A, 20 and 26 set out criteria for revocation of MODU, SOLAS and non-SOLAS certificates respectively. Revocation can occur where a condition has been, or is likely to be, breached, where the owner requests revocation, or where certificates contain incorrect information. Revocation obviously removes the legal authority to operate.

• AMSA approval revocation for equivalence and inspection approvals. Section 7 note 4 and section 31(4) allow AMSA to revoke approvals where AMSA is no longer satisfied of equivalence or where conditions of an in-water inspection approval are not met. Revocation may obligate the owner to revert to dry-dock inspections or to remedy defects prior to further operation.

Civil and administrative remedies

• Administrative review. Decisions to issue, vary or revoke safety certificates are reviewable by the Administrative Appeals Tribunal under subsection 313(1) of the Navigation Act, as noted in section 9(2). That provides an administrative remedy and potential stay of enforcement action pending review in certain circumstances.

• Contractual and commercial consequences. While not a statutory penalty, revocation, failure to obtain endorsements or failure to hold certificates likely triggers contractual breaches (charterparty, insurance) and commercial costs through detention, towing restrictions and lost work. The Order emphasises endorsement following surveys and AMSA approvals that, if withheld, have commercial impact (sections 11(h), 22(b), 31(4)).

Enforcement discretion and criteria-based triggers

• Condition-based enforcement. The Order sets out specific conditions that, if not met, justify revocation or intervention. For example, a MODU safety certificate is conditional on carrying the MODU Code on board and compliance with Chapter 14 of the 2009 MODU Code whether or not that Code applies to the vessel (section 11(b)-(c)). Non-compliance with such conditions is explicitly a ground for revocation (section 14A(1)(a)). This makes enforcement both rules-based and fact-specific.

Transparency and procedural protections

• Endorsement practice and issuing-body consistency. The Order notes that it is common practice for the issuing body endorsing a certificate to be the same that originally issued it (sections 12, 17, 23 notes). That practice suggests administrative continuity but may also be important where owners seek transfers between issuing bodies.

• AMSA conditions on approvals. Approvals are subject to conditions imposed by AMSA, and failure to meet such conditions triggers enforcement. The Order places the onus of compliance on owners and provides AMSA with discretionary but criteria-tethered enforcement tools (sections 7(4), 31(4)).

In sum, enforcement is delivered through the Navigation Act’s offence and inspector powers supplemented by certificate-based administrative controls such as endorsement and revocation. Owners face immediate operational consequences from withheld endorsements and revocation as well as potential criminal liability under the Navigation Act for taking vessels to sea without required certificates.

Marine Order 47 is a regulatory instrument made under the Navigation Act 2012 and deliberately integrates multiple international instruments, other Marine Orders and the Offshore Petroleum and Greenhouse Gas Storage Act 2006. Its operational effect therefore depends on a web of statutory and international standards.

Navigation Act 2012. Section 3 of the Order identifies the Navigation Act provisions under which it is made, specifically sections 98 (safety certificates), 125 (musters and tests), 314 (matters relating to certificates), 339 (matters such as design, machinery, safety, survey and certification) and subsection 342(1) (AMSA’s power to make Marine Orders). The Order thus implements the Navigation Act’s regulatory delegation by prescribing the mechanics and criteria for certificates, surveys and reporting. Several enforcement references in the Order point back to the Navigation Act, for example inspector powers under ss 264 and 267 (section 28 note 2), the offence provisions for operating without certificates (sections 8 and 27 notes) and reporting obligations under ss 185 and 186 (section 30 note 2).

SOLAS, MODU Code and Survey Guidelines. The Order imports and operationalises international instruments by reference. It treats SOLAS regulations (Chapter I Regulations 7-14 and others) and the Survey Guidelines under the HSSC as binding functional benchmarks for survey, endorsement and certificate duration (sections 5(1)(a)-(c), 15-19, Schedule 1). It prescribes that MODU surveys and criteria follow the applicable MODU Code version (sections 4 definitions, 5(1)(b), 10(c), 11). Section 5(c) states that a reference to the Survey Guidelines is to be treated as if those Guidelines were in force internationally on a mandatory basis, giving them interpretive weight within the Australian regime.

Other Marine Orders. The Order cross-references other Marine Orders that prescribe technical requirements and operational obligations. For example, Schedules require compliance with Marine Orders 12 (construction and stability), 15 (fire protection), 21 (safety and emergency arrangements), 25 (lifesaving equipment), 27 (navigation and radio equipment), 30 (collision prevention) and 58 (safe management of vessels) as applicable (Schedule 1 and Schedule 2). The Order also notes that Marine Order 18 deals with oil tanker inspection programmes (section 2 note). The practical effect is that compliance with Marine Order 47 typically requires simultaneous compliance with multiple other Marine Orders, producing cumulative regulatory duties.

Marine Order 1 (Administration). Section 7 relies on Marine Order 1 for the process and definitions concerning equivalents and Marine Order 1’s Division 3 is applied to certificate applications (section 9(2)). Marine Order 1 also provides for the form and fee requirements for applications (section 31(2) note). The Order excludes Marine Order 1 s 17 internal review for safety-certificate decisions, signalling that AAT review under the Navigation Act is the route for external review (section 9(2) and notes).

Offshore Petroleum and Greenhouse Gas Storage Act 2006. The definition of offshore industry unit in section 4 is expressly tied to Schedule 3 of the petroleum Act, linking whether a thing is a “vessel” under that Act’s schedule to Marine Order 47’s application (section 4 and section 6 note). The Order clarifies it does not apply when a vessel is a “facility” under clause 4 of Schedule 3 to the petroleum Act (section 6 note and reference to s 640 of the petroleum Act). The effect is an inter-act that differentiates between vessels and petroleum facilities and prevents duplication of regimes.

ISM Code and ISM Guidelines. Schedule 2.2 incorporates ISM Code obligations by requiring a declaration that a safety management system complying with Part A of the ISM Code is in place for cargo vessels treated as if Chapter IX of SOLAS applied. The Order also references the ISM Guidelines as guidance for implementation (section 4 definitions, Schedule 2.2). That interaction creates overlap between the International Safety Management framework and domestic certification.

Code of Safety for Diving Systems, 1995. Where fixed diving systems were fitted after 23 November 1995, the Order requires a diving safety certificate issued by a recognised organisation in accordance with that Code as a precondition for some certificates (sections 15(c), 21(d)). This ties a specific safety niche to a recognised-organisation certification.

Administrative law and review provisions. The Order explicitly channels contestation of safety-certificate decisions to the Administrative Appeals Tribunal under subsection 313(1) of the Navigation Act (section 9(2) note). It disapplies Marine Order 1 s 17 internal review to safety-certificate decisions (section 9(2)). This arrangement affects procedural rights and the forum for judicial or administrative oversight.

Operational regulations elsewhere. The Order makes repeated cross-references to survey guidelines and other IMO circulars for practical guidance on towing and in-water surveys (section 28 note 3 referencing IMO Circular MSC.1/Circ.884; section 31 note referencing MSC.1/Circ.1348). Those non-legislative instruments are used for operational detail without being incorporated as law, although the Order treats some as if mandatory in force for interpretive purposes (section 5(c)).

In practice, compliance requires simultaneous calibration against international conventions, other Marine Orders and the Navigation Act. Owners must manage cross-cutting obligations that may be triggered by a single activity: a planned tow engages the SOLAS rules about towing stability, Marine Order 47’s seven-day notification, possible towing assessments under section 28(5), and inspector powers under the Navigation Act. Equivalence requests and in-water inspection approvals are handled through Marine Order 1 procedures and can result in AMSA imposing conditions that operate across the other Marine Orders.

The compilation accompanying the Order records amendments up to the end of 2023 and provides a formal record of how the instrument has evolved since its initial registration. The compilation date is 1 January 2024 and the compilation was prepared on 29 February 2024, taking account of Marine Orders Amendment (Marine Order 12 , consequential changes) Order 2023 and Marine Orders Amendment (Marine Order 27 , consequential changes) Order 2023 (header information and compilation note).

Registered instruments and key amendment steps in the compilation table are:

• Marine Order (MO 2019/4), registered 11 October 2019, commenced 1 November 2019, FRLI F2019L01324. This is the original Marine Order 47 (Offshore industry units) 2019 (Note: Table of Orders).

• Marine Order 47 Amendment Order 2020 (MO 2020/3), registered 16 June 2020, commenced 1 July 2020, FRLI F2020L00729. The compilation table indicates multiple provisions were amended or substituted in MO 2020/3 (see Table of amendments).

• Marine Orders Amendment (Marine Order 12 , consequential changes) Order 2023 (MO 2023/8), registered 23 November 2023, commenced 1 January 2024, FRLI F2023L01538. The compilation indicates Schedule 1 and Schedule 2 were amended by MO 2023/8 (Table of amendments).

• Marine Orders Amendment (Marine Order 27 , consequential changes) Order 2023 (MO 2023/10), registered 12 December 2023, commenced 1 January 2024, FRLI F2023L01657. The compilation indicates Schedule 1 and Schedule 2 were also amended by MO 2023/10 (Table of amendments).

The Table of amendments in the compilation shows specific provision-level changes. For example:

• Section 11 was repealed and substituted in MO 2020/3 (Table row showing s.11 rs. MO 2020/3).

• Section 16 was repealed and substituted in MO 2020/3 (Table row showing s.16 rs. MO 2020/3).

• Sections 22 and 23 were repealed and substituted in MO 2020/3 (Table rows s.22 rs. MO 2020/3; s.22 appears in the table).

• Section 14A was added in MO 2020/3 (Table row s.14A ad. MO 2020/3), introducing explicit revocation criteria for MODU safety certificates.

• Section 28 was amended in MO 2020/3 (Table row s.28 am. MO 2020/3), which likely adjusted planned tow notification or obligations.

• Both Schedule 1 and Schedule 2 were amended in MO 2020/3 and further amended in MO 2023/8 and MO 2023/10 (Table rows for Schedule 1 and Schedule 2 show amendments).

The compilation’s Table of amendments uses abbreviations: ad. (added), am. (amended), rep. (repealed), rs. (repealed and substituted). The historical table indicates that the instrument has been the subject of several consequential changes over its life, especially to align with updates to other Marine Orders (notably Marine Orders 12 and 27) and to reflect updated survey practices or international code versions.

Practical points arising from the amendment history:

• Section-level substitutions and additions, such as the addition of s 14A, indicate the Order’s evolution to clarify administrative remedies such as revocation criteria for MODU certificates (s 14A). Where sections were repealed and substituted in MO 2020/3 (e.g. ss 11, 16, 22), those changes suggest substantive rework of certificate conditions and cross-references.

• The 2023 amendments are described as “consequential changes” tied to updates in Marine Orders 12 and 27. This pattern indicates coordinated updates across Marine Orders to maintain technical coherence, particularly around construction, navigation and radio equipment requirements that feed into certificate criteria in Schedules (Schedule references to Marine Orders 12 and 27).

• The compilation shows that Schedules are a frequent locus of amendment, reflecting the need to keep SOLAS-related certification criteria aligned with evolving Marine Orders and international standards.

The instrument’s amendment history is recorded in the compilation and is available for inspection through the FRLI numbers noted. The compilation itself provides the consolidated text as in force on 1 January 2024 and documents the legislative genealogy by catalogue number and commencement date.

The text of Marine Order 47 does not list or reference any judicial decisions applying or interpreting the instrument. The compilation and the Order itself do not name cases. The only direct references to dispute-resolution and review mechanisms are to administrative review avenues and inspector powers within the Navigation Act framework.

Administrative review pathway

• Administrative Appeals Tribunal. Section 9(2) expressly notes that decisions about safety certificates are reviewable by the Administrative Appeals Tribunal under subsection 313(1) of the Navigation Act. Marine Order 1 s 17 internal review does not apply to safety-certificate decisions, so the AAT is the external mechanism for review of AMSA decisions to issue, vary or revoke safety certificates. This establishes the default administrative avenue for challenges to AMSA or issuing-body actions regarding certificates.

Inspector action and potential litigation triggers

• Inspector-issued prohibition notices and directions (referenced via section 28 note 2 citing ss 264 and 267 of the Navigation Act) create immediate operational constraints that can be the subject of administrative review, compliance, or possibly judicial review where procedural fairness or jurisdictional error is asserted. The Order itself does not describe litigation routes but imports the Navigation Act’s enforcement tools that may lead to contested proceedings.

No statutory appeal to courts in the Order text

• The Order does not create or identify a statutory right of appeal to a court for disputes over certificate decisions. The legislative design channels challenge to administrative review via the AAT and leaves criminal enforcement issues and inspector actions to the Navigation Act’s statutory processes. Judicial review in the Federal Court or other courts on public law grounds (for example, jurisdictional error or denial of procedural fairness) remains a potential avenue under broader administrative law principles but is not specified in the Order.

Practical litigation-relevant observations grounded in the text

• Decisions referable to equivalent approvals, in-water inspection approvals and revocation criteria are discretionary but criteria-based (sections 7(2), 31(3)-(4), 14A). The presence of explicit criteria may shape the standards of review at the AAT and in judicial review applications, with scope for examining whether AMSA properly applied the equivalence tests or imposed conditions within power.

• The Order’s reliance on external international instruments and other Marine Orders may give rise to interpretive disputes about what compliance with those instruments entails in a domestic administrative decision. For instance, disputes could arise about whether a proposed “equivalent” is “at least as effective” as the prescribed requirement (section 7(2)(c)). The Order does not set a specific metric for such comparisons, leaving AMSA evaluation and the AAT review process as the decision locus.

• Endorsement practices noted as “it is practice” that the endorsing issuing body is the same as the original issuing body (sections 12, 17, 23 notes) may affect procedural expectations in disputes about change of issuing body; such practices are not legally binding but may be used as an indicator of customary administrative conduct.

Absence of named cases and implied reliance on administrative remedies

• Because the source does not cite any case law, practitioners must approach contestation via the administrative-review and enforcement mechanisms embedded in the Navigation Act and in the broader administrative law framework. The Order’s built-in reviewability by the AAT is the procedural channel for certificate decisions, while criminal or regulatory enforcement under the Navigation Act would follow statutory processes that can be litigated when challenged in a court setting.

In short, the Order creates administrative decision points ripe for AAT review and potential judicial review on public law grounds, but it does not itself disclose any litigation history or precedent.

Attention to several specific textual features of the Order will help identify common traps that cause compliance failures or unexpected operational constraints.

1. Application excludes “facilities” but includes vessels connected to oil and gas activity. The definition of offshore industry unit in section 4 ties application to Schedule 3 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 and explicitly excludes things that are not vessels such as structures. Failure to apply the vessel/facility boundary can produce regulatory misclassification. See section 6 note and section 4.

2. MODU Chapter 14 mandatory carriage and compliance irrespective of applicability. Section 11(c) requires compliance with Chapter 14 of the 2009 MODU Code “whether or not that Code applies to the vessel.” Owners of MODUs that might otherwise be subject to an earlier MODU Code must nonetheless observe Chapter 14 of the 2009 Code. Practically, this can create obligations that owners did not anticipate based on a MODU’s construction date. See sections 5(1)(b) and 11(b)-(c).

3. Documentation must be available without request. Section 11(f) requires that the determination under section 51 of the Navigation Act and any safe manning document determined under Marine Order 21 be available on the vessel “without the need for any seafarer to request access.” This is stronger than merely having the documents on board; they must be accessible. See section 11(f).

4. Seven-day notification for planned tows is non-negotiable. Section 28(1) requires notification to AMSA at least seven days before the tow commences. The Order notes that notification might be made by an agent or insurer (section 28(1) note 2), but failure to meet the seven-day threshold is a compliance risk and may expose owners to prohibition notices by inspectors (section 28(2) note 2).

5. Owner and master shared obligations for tows. Section 28(2) places operational duties on the owner or master of the towing vessel, and section 28(3) requires the owner of the vessel being towed to ensure safe towage arrangements are implemented. Blaming the other party is not an automatic defence.

6. Equivalents and in-water inspection approvals require application and evidence. Sections 7 and 31 allow equivalents and in-water inspections but require an application in accordance with Marine Order 1 and supporting statements. AMSA must be satisfied that the alternative is at least as effective as the original requirement (section 7(2), 31(3)). Owners who assume equivalence without approval risk subsequent revocation and the obligation to return to dry-dock. See section 7 note 4 and section 31(4).

7. Certificate durations and anniversary-date mechanics can shift required survey windows. Section 24 and section 25 contain detailed rules for when certificates commence and how extensions and anniversary date adjustments operate. Completing a survey early can lead to limited flexibility for anniversary date adjustments, and extensions apply only in prescribed circumstances and subject to AMSA conditions (section 25(3) and section 25(2) table). Misreading these rules can leave a vessel temporarily without a valid certificate.

8. Gas cylinder stowage specifics are prescriptive and recurrent. Sections 11(d), 16(c) and 22(d) require that gas cylinders be stowed separate from diving breathing medium cylinders and at least three metres from accommodation, the navigating bridge and the radio room. This is a specific layout requirement that owners must implement physically.

9. Foreign vessels’ compliance depends on flag-state rules. Section 27 requires foreign vessels to have SOLAS certificates as required by Regulation 12 of Chapter I of SOLAS or at least one seaworthiness attestation. Owners and masters of foreign vessels cannot rely on Australian equivalence if their flag Administration requires different arrangements; they must hold flag-state documentation and comply with their Administration’s requirements.

10. Survey work often requires coordination with issuing bodies and class. The Order presumes accepted practice by issuing bodies and classification societies in surveys and endorsements. Owners who lack robust relationships with their issuing body or whose vessels are away from survey ports at expiry risk the short extensions allowed by section 25(2) only under restrictive conditions.

11. Defect reporting cross-triggers incident reporting obligations. Section 30 requires early reporting of defects to AMSA and immediate reporting to coastal-state authorities for MODUs. Defect reporting can therefore engage the Navigation Act’s marine incident reporting provisions (sections 185 and 186 referenced). Owners may inadvertently trigger broader investigations by not appreciating the overlap.

12. ISM Code incorporation for some non-SOLAS cargo vessels. Schedule 2.2 requires a written declaration that an ISM-compliant safety management system is in place. Owners not used to ISM obligations must align procedures and documentation accordingly.

13. Revocation grounds are broad. Sections 14A, 20 and 26 allow certificate revocation where a condition has been, or is likely to be, breached, as well as where the owner requests revocation or the certificate contains incorrect information. The “likely to be breached” standard introduces a preventive revocation risk if AMSA has reasonable grounds to foresee non-compliance.

14. Delays in issuing bodies endorsing or re-issuing certificates can leave a vessel in legal limbo. Section 25(2) allows extensions where renewal surveys have been completed but the new certificate cannot be placed on board before expiry, but only for limited periods and subject to endorsement by the issuing body. Operational delays in administration can therefore translate to operational risk.

Being alert to these textual specifics and structuring compliance processes around AMSA approval windows, issuing-body schedules and the physical measures required by the Order will reduce the risk of unintended non-compliance.

A practical compliance checklist derived directly from the Order’s requirements and cross-references will assist owners and masters. The following is a structured set of steps aligned to the Order’s provisions.

1. Determine applicability and certificate type

• Confirm the vessel is an offshore industry unit as defined in section 4, by reference to Schedule 3 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006. Verify that the vessel is a “vessel” and not a “facility” under that Act (section 6 note).
• Identify whether the vessel is a MODU, a vessel required by SOLAS Regulation 12, or a non-SOLAS cargo/passenger vessel, so the correct certificate stream in section 8 and Schedule 1 or 2 applies.

2. Maintain classification society and recognised-organisation arrangements

• If the vessel has a classification society arrangement, maintain a valid certificate of classification because it is a criterion for certificate issuance (sections 10(b), 15(b), 21(c)).
• Engage a recognised organisation to issue specialized certificates where required (e.g. diving safety certificates for fixed diving systems fitted after 23 November 1995) (sections 15(c), 21(d)).

3. Prepare for initial and renewal surveys to international standards

• Schedule and complete surveys in accordance with the applicable MODU Code for MODUs, SOLAS Chapter I Regulations 7-10 and the Survey Guidelines under the HSSC for SOLAS and non-SOLAS vessels (sections 10(c), 15 and section 5(c)).
• Ensure annual, intermediate and dry-dock surveys are planned consistent with the certificate’s required cycle. If relying on in-water inspection to replace a dry-dock, apply to AMSA per Marine Order 1 with supporting statements and evidence (section 31(1)-(3), note in 31(2)).

4. Ensure certificate conditions are satisfied and documented on board

• For MODUs, carry the applicable MODU Code and Chapter 14 of the 2009 MODU Code on board and ensure they are accessible to seafarers at all times (section 11(b)-(c)).
• Keep the determination under section 51 of the Navigation Act and any safe manning document determined under Marine Order 21 available on board without the need for seafarers to request access (section 11(f)).
• Maintain documentation of safety management systems, especially for cargo vessels that must provide an ISM declaration per Schedule 2.2.

5. Implement operational safety arrangements and crew training

• Put in place safe transfer arrangements for personnel, demonstrate those arrangements as required, and incorporate them in the vessel’s safety management plan (sections 11(e), 16(b), 22(c); notes referring to IMCA guidance and Marine Order 58).
• Provide crew familiarisation, training and certification in line with IMO Resolution A.1079(28) where seafarers are carried (section 28(2)(a)(iv)) and run fire and abandonment drills as required by the MODU Code chapter references (section 28(2)(a)(iv)(B)).

6. Comply with gas cylinder stowage and related equipment requirements

• Ensure any gas cylinder’s stowage is separate from breathing medium cylinders and at least three metres from accommodation, the navigating bridge and the radio room (sections 11(d), 16(c), 22(d)).

7. Meet notification and reporting obligations

• Notify AMSA of any planned tow at least seven days before tow commencement. Ensure either the owner, master or an authorised agent lodges the notice and respond to any AMSA information requests (section 28(1)-(2) and notes).
• Notify AMSA and issuing bodies of alterations affecting safety certificates within seven days of the alteration and notify of any major renewals or repairs within seven days of completion (section 29(1)-(2)).
• Report defects at the earliest opportunity to AMSA and immediately to coastal state authorities for MODUs or when in another SOLAS Contracting Government’s port (section 30(1)). Use AMSA’s approved reporting forms where required (section 30 note 1).

8. Manage surveys, endorsements and certificate renewals

• Ensure issuing bodies complete and endorse certificates after annual/intermediate/outside bottom inspections as required (sections 12, 17, 23). If renewal surveys are completed but the new certificate cannot be placed on board before expiry, arrange for endorsement and apply for short extensions as permitted in section 25(2) where eligible.
• Adjust anniversary dates in compliance with section 25(3) if surveys are completed early, but plan to avoid inadvertent shortening of subsequent survey windows.

9. Apply for equivalents or in-water inspections only with robust evidence

• When seeking AMSA approval for equivalents or alternative survey regimes, prepare an application in accordance with Marine Order 1 with a supporting statement explaining how the alternative is at least as effective and does not contravene SOLAS or the MODU Code as relevant (section 7(1)-(2); section 31(2) note 2).
• Expect AMSA to impose conditions and to revoke approval if equivalence is no longer demonstrated (section 7(4)).

10. Prepare for AMSA oversight and potential inspection

• Ensure records and documentation are available for AMSA or issuing-body review; non-compliance with conditions can trigger revocation under sections 14A, 20 and 26.
• Be ready to respond to AMSA requests for information about planned tows or to participate in towing assessments if AMSA elects to conduct them (sections 28(2)(b), 28(5)).

11. Maintain an audit trail and contingency plans for revocation risk

• Keep contemporaneous records of surveys, endorsements, correspondence with issuing bodies, equivalence approvals and AMSA approvals to support appeals to the AAT if a certificate decision is contested (section 9(2) note).
• Plan operational contingencies for the period an enforcement action might render the vessel unable to operate legally, including positioning for survey ports and contractual notice provisions.

12. Engage competent third parties and insurers early

• Use classification societies, recognised organisations and experienced issuing bodies to plan surveys, certificates and equivalence applications. Include P&I insurers and agents in planned-tow notifications where appropriate, given the Order’s note that such parties may notify AMSA (section 28(1) note 2).

Following these steps aligns operational practice with the Order’s textual obligations and conditions. The key practical principle is to treat AMSA approvals and issuing-body endorsements as gatekeepers to lawful operation and to plan surveys, notifications and documentation well ahead of expiry or operational events such as planned tows and major repairs.
