Marine Order 44 (Safe containers) 2019

The Marine Order structures its regulatory approach around a handful of recurring legal and technical concepts. Understanding those is essential to reading the duties, enforcement and administrative discretion.

• Approval regimes. There are two parallel approval streams. For Container Convention containers the owner applies to AMSA or a recognised organisation for approval (s10); for offshore containers the owner applies to an approving competent authority authorised by AMSA (ss26-27). Approvals can be for a design type or an individual container (s27(3)).
• External technical standards by reference. The Order repeatedly requires compliance “in the manner mentioned in the Container Convention” or with the IMO Guidelines for offshore containers, and permits use of equivalent international standards (see s4 definitions; s27(2)). That means many technical specifics are not reproduced in the text but are incorporated by reference.
• Maintenance, examination and marking cycles. Owners must maintain containers “in the manner mentioned in the Container Convention” (s15) and ensure periodic examinations by AMSA or a recognised organisation unless a continuous examination programme (ACEP) is approved (s16). Examination markings and re‑examination timeframes are mandated (ss16(4),17,20,29(4)). For offshore containers inspections must occur at least yearly unless the approving competent authority specifies a shorter period (s29(3)).
• Continuous examination programmes (ACEP). Owners may apply for approval of a continuous examination programme under s18. AMSA or a recognised organisation may approve an ACEP where it meets Container Convention requirements (s18(2)). An ACEP changes the examination regime: containers under an approved ACEP are exempted from the periodic-scheme requirement (s16(2)) and must be marked with ‘ACEP (AUS)’ (s20). The Order also contains an owner-domicile caveat in the note to s18 , AMSA will not approve an ACEP for an owner without an Australian registered office or a registered local agent.
• Marking and plate obligations. Approved containers must carry a safety approval plate fixed in the manner required by the Container Convention (s11). The container’s maximum operating gross mass must be marked consistently with the plate (s12). Offshore containers need an approval plate fixed per the offshore Guidelines (s28). If the plate is inaccurate, the container is modified, or the container is removed from service and not maintained per the Convention, the owner must remove the safety approval plate (s13).
• Control measures at operational touchpoints. Loading and unloading are the operational focus: subdivisions 2.3 and 3.2 trigger at ports or the wider offshore transfer environment (s6(3)-(4)). They prohibit loading/unloading where plates/markings are absent, inspection dates have passed, gross mass is exceeded, or defects could endanger persons (ss21,30). The master has a specific duty regarding stacking loads using the 1.8g allowable stacking load indicated on the safety plate (s22).
• Sanctions and burden of proof. The instrument makes many contraventions strict liability offences (eg ss11(2),12(2),15(2),16(5),17(2),20(2),28(2),29(5),30(2)). The civil penalty regime mirrors criminal penalties for many provisions (eg ss11(3),12(3) etc). Penalties are repeatedly fixed at 50 penalty units.
• Administrative discretion and review. AMSA is given discretion to approve or withdraw approvals, authorise approving competent authorities, and issue remedial notices (ss14,19,26,23,31). Certain decisions are expressly taken to be reviewable under Marine Order 1 (s7), and delegation references and recognised organisation interaction are noted (s5(2) and Note 3 to s4).

These concepts show the Order’s mix of external technical standard incorporation, owner-focused duties, allocation of operational duties to masters/operatives at loading, and a relatively standard administrative enforcement architecture combining strict liability offences, civil penalties and AMSA oversight.

The Marine Order’s obligations and powers are distributed among a distinct set of stakeholders. The text identifies who bears responsibility and who makes decisions.

• Owners and persons with owners’ responsibilities. The statutory definition of owner includes (a) the person who owns a container or offshore container and (b) a lessee or bailee who by agreement may exercise the owner’s maintenance and examination responsibilities (definition of owner in s4). Most habitual duties , approvals, maintenance, examinations, marking, removal of plates, and ensuring re‑examinations , are placed squarely on the owner (see ss10-20 for containers, ss27-29 for offshore containers).
• Masters of vessels. The master has a distinct duty concerning stacking loads: they must ensure a container is not stacked on another container if doing so would exceed the allowable stacking load for 1.8g indicated on the safety approval plate (s22). The masters’ obligation is operational and aimed at load stability and vessel safety.
• Persons loading or unloading containers. Subdivisions 2.3 and 3.2 place obligations and prohibitions on “a person” who loads or unloads a container or offshore container at the relevant locations , ports, MODUs, fixed or floating installations, resources industry fixed structures (ss21,30; s6(3)-(4)). The prohibition language requires that persons refrain from loading/unloading when defects, invalid plates, expired examination marks or exceeded gross mass are present.
• Recognised organisations. The Order permits recognised organisations to act as the approving body for Container Convention approvals, to conduct periodic examinations, and to be the conduit for ACEP approvals (s10; s16; s18(1)-(2)). The text treats recognised organisations as equivalent to the Container Convention’s “authorised organisation” (s5(2)), tying them into AMSA’s delegation framework (note in s4).
• Approving competent authorities and inspection bodies. Organisations can apply to AMSA for authorisation as an approving competent authority to approve offshore containers (s26). AMSA will authorise entities that maintain technical standards, have approval procedures and ongoing audits, and for inspection meet the requirements for type B inspection bodies under ISO/IEC 17020:2012 (s26(2)-(4)). This affects third-party inspection firms and their operational standards.
• AMSA. AMSA has multiple administrative roles: it grants approvals, authorises approving competent authorities, may withdraw approvals, may issue written notices to cease activities or require precautions, and handles reviewable decision processes (ss3,10,14,19,23,26-27,31; s7 referencing Marine Order 1 review provisions).
• Ports, MODUs, installations and resources industry fixed structures. The Order’s operational prohibitions apply when containers are being loaded or unloaded at these locations (s6(3)-(4); ss21,30). Managers and operators at these sites therefore need procedures to ensure checks are performed and notices from AMSA are complied with.
• Lessees and bailee parties. If a lessee or bailee contractually assumes the owner’s responsibilities, they are treated as the owner for the purposes of maintenance and examination obligations (definition in s4). That shifts commercial risk and compliance obligations into leasing contracts.

Who pays and who decides: owners (or contracted lessees/bailees) pay for approvals, marks, inspections and ongoing maintenance. Masters and persons performing loading/unloading make on-the-spot operational decisions and can be criminally/civilly liable for contraventions during loading/unloading. AMSA and authorised/recognised organisations decide approvals, may issue corrective notices and can withdraw approvals.

The Marine Order establishes concrete statutory duties and a limited set of rights (mainly administrative review and approval). The dominant legal duties are owner-facing, and many are backed by strict liability and civil-penalty exposure.

Owner duties

• Apply for approval: The owner may apply to AMSA or a recognised organisation for approval of a container (s10(1)). If the container is modified, the owner must apply to AMSA or a recognised organisation for approval of the modification (s10(2)-(3)).
• Fix and maintain plates and markings: The owner must ensure a safety approval plate is fixed as required by the Container Convention (s11(1)); ensure maximum operating gross mass marking is consistent with the plate (s12(1)); and for offshore containers ensure an approval plate fixed per the offshore Guidelines (s28(1)).
• Remove incorrect plates: The owner must remove a safety approval plate if the container no longer complies due to modification or inaccurate information, if removed from service and not being maintained in accordance with the Container Convention, or if approval is withdrawn (s13(1)(a)-(d)).
• Maintenance and examinations: Maintain the container in the manner mentioned in the Container Convention (s15(1)). For periodic schemes, ensure periodic examination by AMSA or a recognised organisation (s16(1)), and ensure re‑examination after repair before the container is loaded (s16(3)) with re‑examination by AMSA/recognised organisation by the earlier of the next due Container Convention date or 30 months from the repair examination date (s16(4)). For continuous examination programmes, apply under Marine Order 1 and comply with ACEP rules, including examinations after refurbishment and on hire transitions and re‑examination timelines (s18(1)-(4)). For offshore containers the owner must ensure periodic inspection by an approving competent authority at least yearly or more frequently if the approving competent authority specified a shorter period (s29(2)-(3)).
• Marking of dates and ACEP: For periodic examination schemes, the owner must mark the examination or re‑examination date permanently and legibly (s17). For ACEP-approved containers owners must mark the container with ‘ACEP (AUS)’ permanently (s20(1)). For offshore containers owners must mark date of inspection and the mark of the person conducting inspection in the manner mentioned in the offshore Guidelines (s29(4)).

Operational duties

• Loading/unloading prohibitions: A person must not load or unload a container if it has a defect posing danger, lacks the safety approval plate, has past-due examination date, lacks ACEP marking, or exceeds the maximum operating gross mass as on the safety plate (s21(1)(a)-(e)). Equivalent prohibitions apply to offshore containers (s30(1)(a)-(d)).
• Master’s duty on stacking: The master must ensure that containers are not stacked contrary to the allowable stacking load for 1.8g indicated on the safety approval plate (s22(1)). For one-door-off operations, the allowable stacking load on the safety plate must be used (note under s22).
• Compliance with AMSA notices: When AMSA gives a written notice requiring cessation of an activity or specific precautions (s23(2); s31(2)), persons who receive the notice must ensure compliance to the extent the notice relates to matters over which they have control (s23(3); s31(3)).

Administrative rights and processes

• Approvals and conditions: AMSA or recognised organisations may grant approvals and may impose conditions where paragraph 6 of Regulation 2 of Chapter I of Annex I to the Container Convention applies (note to s18(2)). AMSA may withdraw approvals if non-compliance is found (s14(1); s19).
• Authorisation of approving competent authorities: Organisations may apply to AMSA to be authorised as approving competent authorities, and AMSA must be satisfied that they meet technical and audit requirements, including ISO/IEC 17020:2012 or an equivalent standard for inspection bodies (s26(1)-(4)).
• Internal review and reviewable decisions: Key administrative decisions (those under ss10(3),14(1),18(2), s19,26(2),27(2)) are taken to be reviewable decisions for ss17 and 18 of Marine Order 1 (Administration) 2013 (s7). That creates a statutory internal review route for affected parties.

Sanctions and legal character of contraventions

• Strict liability and civil penalties: Many offences are strict liability offences (eg ss11(2),12(2),15(2),16(5),17(2),20(2),28(2),29(5),30(2)). The typical monetary exposure where identified is 50 penalty units, and in many cases contraventions also attract civil penalties fixed at 50 penalty units (for example ss11(3),12(3),15(3),16(6),17(3),20(3),28(3),29(6),30(3)). The Order therefore couples criminal strict liability with a parallel civil enforcement route for many core duties.
• AMSA enforcement powers: AMSA may give written directions to cease activities or require precautions (ss23,31). The Order also cross‑refers to Navigation Act enforcement provisions that permit inspectors to give directions and prohibition notices for serious health or safety risks (note 2 to ss23 and 31 referencing ss264 and 267 of the Navigation Act and s114 for proper precautions).

Rights and caveats

• Owner latitude on conformity: Approvals may be given where containers comply with the Container Convention or, for offshore containers, meet equivalent international standards (s10(3); s27(2)(b)). That offers some flexibility for owners using recognised international approvals.
• Delegation and recognised organisations: The Order recognises the role of recognised organisations and approving competent authorities. Owners can use these entities for approvals and inspections, subject to AMSA’s authorisation and audit processes (s5(2); s26). However, AMSA retains final administrative discretion and the power to withdraw approvals (s14,19).

The Marine Order builds enforcement through a combination of strict liability offences, civil penalties, administrative powers vested in AMSA and references to the Navigation Act’s inspection and prohibition regime. The regime focuses on compliance at the point of loading/unloading and on maintaining documentary and physical certification.

Primary penalty structure

• Recurrent penalty quantum. For the offences specified in the Order, the monetary sanction is repeatedly set at 50 penalty units. This appears in provisions requiring safety approval plates (s11(1)), maximum gross mass markings (s12(1)), maintenance (s15(1)), periodic examination obligations (s16(1)), examination after repair and re‑examination timelines (ss16(3)-(4)), examination marking (s17), ACEP obligations (s18(3)-(4); s20), offshore container approval plate (s28), offshore inspection obligations (s29(2)) and loading/unloading prohibitions for containers and offshore containers (ss21(1);30(1)). The instrument systematically ties similar obligations to the same penalty quantum.
• Strict liability. Many offences are expressly declared to be strict liability offences (eg ss11(2),12(2),15(2),16(5),17(2),20(2),28(2),29(5),30(2)). The legal effect is that a prosecution need not prove mens rea beyond a reasonable doubt in relation to the fault element; defences will be limited to available statutory or common law exceptions for strict liability offences (the Order itself does not supply defences).
• Parallel civil penalties. A mirror civil penalty is repeatedly provided as an alternative enforcement pathway for contraventions (eg ss11(3),12(3),15(3),16(6),17(3),20(3),28(3),29(6),30(3)). The civil penalty is set at 50 penalty units for many of the same contraventions.

Administrative enforcement and discretion

• Withdrawal of approvals. AMSA or a recognised organisation may withdraw approval of a container that no longer complies with the Container Convention (s14(1)). AMSA may withdraw approval of an ACEP it earlier approved under s18 if the programme no longer meets the Container Convention requirements (s19). Written notice of withdrawal must be given within 14 days to the owner and, where a recognised organisation issued the notice, to AMSA (s14(2)).
• AMSA written notices to manage immediate risk. Where AMSA reasonably believes loading/unloading/stowage or carriage activities may damage the vessel, pose safety risks or damage the environment, AMSA may give written notices to individuals requiring cessation of doing an activity or requiring specified precautions (ss23(1)-(2); s31(1)-(2)). The recipient must comply to the extent the notice relates to matters the person controls (ss23(3);31(3)). The Order also notes Navigation Act inspector powers (ss264 and 267) and s114 concerning proper precautions as complementary enforcement tools (notes to ss23 and 31).
• Inspection and audit requirements for approving authorities. AMSA will authorise approving competent authorities only if they satisfy prescribed requirements including maintenance of technical standards, approval procedures and an ongoing audit process, and for inspection bodies compliance with ISO/IEC 17020:2012 (s26(2)-(4)). This creates an enforcement-by-qualification mechanism to ensure standards of inspection and approval.

Operational enforcement consequences

• Loading/unloading prohibitions backed by criminal/civil sanction. The prohibition on loading/unloading containers or offshore containers in specified unsafe circumstances is penalised (ss21(1)-(3);30(1)-(3)). This creates an immediate operational stop for parties performing transfers , those parties can be criminally or civilly liable for disregarding plate/marking or inspection requirements.
• Master’s statutory duty and liability. The master’s statutory duty to ensure stacking loads do not exceed allowable 1.8g stacking load is enforceable under ss22(1)-(3) with the same penalty quantum. That imposes direct personal legal responsibility on the master for stacking decisions.

Procedural enforcement rights

• Reviewability. Certain decisions under the Marine Order are taken to be reviewable decisions for ss17 and 18 of Marine Order 1 (Administration) 2013 (s7). The specified decisions include those under ss10(3),14(1),18(2), s19,26(2),27(2). This creates an administrative review path for owners and applicants against specified AMSA and recognised-organisation decisions.

Practical implications of the enforcement design

• Burden and risk of strict liability. The predominance of strict liability offences raises enforcement risk for owners and operational parties because regulatory contraventions can be proved without fault. Owners and operators cannot rely on conventional mens rea defences in many cases, increasing the role of procedural compliance and records.
• Dual civil/criminal enforcement. Parallel civil penalties and criminal strict liability provide AMSA and regulators flexibility in enforcement. That can streamline corrective enforcement (civil proceedings) or pursue criminal sanctions where warranted.
• AMSA’s role as gatekeeper. Withdrawal powers and approval authorisation mean AMSA controls market access for approvals and ACEP recognition. This amplifies the regulatory significance of authorisation and audit regimes for approving competent authorities and recognised organisations.
• Interaction with Navigation Act inspector powers. The notes cross-reference Navigation Act inspector powers (ss264 and 267) and the general obligation to take proper precautions (s114 of the Navigation Act). Those powers supplement the Marine Order’s direct enforcement tools with inspection, direction and prohibition notices by inspectors.

The Marine Order therefore combines prescriptive owner duties and operational prohibitions with a built-in compliance architecture that relies on AMSA’s administrative control and a strict liability enforcement posture backed by a consistent penalty quantum across core contraventions.

The Marine Order deliberately operates as part of the Navigation Act 2012 regulatory framework and references other Marine Orders and IMO instruments. The text itself specifies which external materials and statutory provisions it relies on.

Primary statutory framework

• Navigation Act 2012. The Marine Order is made under subsection 342(1) of the Navigation Act (introductory statement and s3(3)). The power base for the Marine Order’s content is drawn from multiple Navigation Act provisions as listed in s3(1): subsection 112(4) and 112(5) (carriage of cargo, loading, stowage and unloading), paragraph 340(1)(f) (giving effect to the Container Convention), subsection 341(1) (imposition of penalties for contraventions of regulations), and subsection 339(1) (prescription of matters necessary or convenient).
• Marine Order 1 (Administration) 2013 and 2011. The Marine Order references Marine Order 1 in multiple procedural contexts. Section 5(2) treats the Container Convention’s “authorised organisation” as a recognised organisation for this Marine Order. Section 18(1) directs owners applying for ACEP approval to do so “in accordance with Marine Order 1 (Administration) 2011”. Section 26(1) requires organisations to apply to AMSA for authorisation as an approving competent authority “in accordance with Marine Order 1 (Administration) 2013”. Section 7 makes certain decisions reviewable decisions for ss17 and 18 of Marine Order 1 (Administration) 2013. Those cross-references integrate the Marine Order into AMSA’s broader administrative processes and delegation architecture.
• Sea Installations Act 1987. The definition of resources industry fixed structure refers to the same meaning in the Sea Installations Act 1987 (s4 definition), linking the Marine Order’s operational scope to installations regulated under that Act.

International instruments and standards incorporated by reference

• Container Convention. The Marine Order explicitly gives effect to the Container Convention (s2(a)) and repeatedly requires compliance “in the manner mentioned in the Container Convention” (eg ss5(1),11(1),15(1),16(1),17(1) and others). That importation makes the Convention’s technical requirements and processes part of enforceable domestic law by reference.
• ACEP Guidelines and MSC/Circ.860 offshore Guidelines. Definitions in s4 include “ACEP Guidelines” and “Guidelines for the approval of offshore containers handled in open seas”, and the offshore approval provisions require compliance with those Guidelines (eg ss28(1),29(4)). The Order thus relies on IMO circulars and guidance for offshore container approval and inspection marking specifics.
• ISO/IEC 17020:2012. The Order requires that organisations intending to be approving competent authorities for inspection meet the requirements for type B inspection bodies in ISO/IEC 17020:2012, or an equivalent standard (s26(4)). That imports internationally recognised inspection body requirements into Australia’s authorisation test.

Interaction with other administrative instruments

• Recognised organisations and delegation. The Order treats recognised organisations as the domestic equivalent of the Container Convention’s authorised organisations (s5(2)) and notes that delegation of AMSA’s powers under this Marine Order is available via AMSA’s website (note in s4). This positions recognised organisations as delegated operational regulators for approval and examination tasks.
• Navigation Act inspection and prohibition provisions. Although the Marine Order creates its own offences and administrative notices, it explicitly notes that s114 of the Navigation Act criminalises failures to take proper precautions in cargo packing/stowage/loading/unloading, and that ss264 and 267 of the Navigation Act empower inspectors to give directions and prohibition notices (notes to ss23 and 31). That cross-reference clarifies overlapping enforcement powers and possible cumulative remedies.

Transitional and saving interactions

• Repeal and conversion of existing approvals. Marine Order 44 (Safe containers) 2002 is repealed (s1B), but approvals issued under the 2002 Order remain in force and are taken to be approvals under this Marine Order (s8). Similarly, approvals issued under the offshore Guidelines immediately before commencement are treated as approvals under this Order (s24). Applications pending at commencement are treated as applications under this Marine Order but AMSA may consider them under the 2002 criteria if it chooses (s9). Those transitional rules prevent regulatory gaps during the switch to the 2019 regime.

Practical implications of the interactions

• Technical detail outsourced to international instruments. Many operational specifics are not reproduced in the Marine Order but are applied by reference to the Container Convention and IMO Guidelines. That reduces duplication but requires owners and inspectors to consult external instruments to know precise technical requirements and marking dimensions, tests and tolerances.
• Administrative cohesion with Marine Order 1 and AMSA processes. Procedural aspects such as applications for ACEPs or authorisation as approving competent authorities are governed by Marine Order 1 processes. Practitioners must therefore cross‑check the relevant Marine Order 1 versions (2011 and 2013 references exist in the text).
• Enforcement overlap and cumulative remedies. The Marine Order’s offences sit alongside Navigation Act offences and inspector powers. That can produce multiple overlapping enforcement pathways (civil penalty, criminal prosecution, inspector prohibition notices, withdrawal of approvals), requiring careful strategic considerations by owners and operators when responding to compliance issues.

The instrument contains its own short amendment and transitional history, and it expressly replaces the earlier Marine Order 44 (Safe containers) 2002. The text sets out the immediate changes at commencement and transitional protections.

• Repeal and commencement. The Marine Order expressly repeals Marine Order 44 (Safe containers) 2002 (s1B) and states that it commences on 1 July 2019 (s1A). The instrument is made by AMSA’s CEO under subsection 342(1) of the Navigation Act 2012 (preamble).
• Savings of existing approvals. Approvals issued under the 2002 Marine Order that were in force immediately before commencement are taken to be approvals given by AMSA or a recognised organisation under the 2019 Marine Order (s8). For offshore containers, approvals issued under the Guidelines for approval of offshore containers handled in open seas in force immediately before commencement are taken to be approvals under the 2019 Marine Order (s24).
• Transitional treatment of pending applications. Applications for approval of containers made on or before 30 June 2019 but not decided before 1 July 2019 are taken to be applications under this Marine Order (s9(1)-(2)). AMSA retains discretion to consider such applications under the 2002 criteria as if that Marine Order had not been repealed (s9(3)). There is a parallel transitional provision for offshore container approval applications made on or before 30 June 2019 (s25(1)-(2)).
• New inclusions relative to the 2002 Order. While the 2002 Order text is not reproduced here, the 2019 Marine Order explicitly imports contemporary IMO materials (ACEP Guidelines and offshore Guidelines MSC/Circ.860) and clarifies authorisation criteria for approving competent authorities, including referencing ISO/IEC 17020:2012 as the inspection body standard (s26). The 2019 instrument therefore aligns domestic authorisation standards with current international inspection standards.
• Specified reviewable decisions. The 2019 Order specifies which decisions are to be treated as reviewable for the purpose of Marine Order 1 administrative review (s7). The nominated decisions include approvals, withdrawals and authorisations under particular subsections (s7 lists decisions under ss10(3),14(1),18(2), s19,26(2) and 27(2)).

What the instrument does not include about amendments

• No history of prior amendments is recorded in the text beyond the express repeal of the 2002 Marine Order. The Order’s notes point to AMSA’s website for delegation information and to the Federal Register of Legislation for registered instruments (final note).
• The text does not itself record subsequent amending instruments, so any later amendments or updates would need to be checked on the Federal Register of Legislation. The Marine Order does, however, permit the external documents it references (ACEP Guidelines; MSC/Circ.860) to be amended from time to time (see definitions in s4), meaning substantive technical content can evolve without formal amendment of the Marine Order itself.

Practitioners should therefore note that the 2019 Marine Order replaced the earlier instrument, preserved existing approvals, and built in a forward‑looking mechanism for incorporation of updated IMO guidance and external standards, while specifying the administrative review framework in relation to key decisions.

The legislative text provided does not contain or reference any judicial decisions, case law, or litigation history. It contains administrative review routes and enforcement provisions but does not record any court proceedings or reported cases.

What the Order does record about review and dispute processes

• Internal review pathway. Section 7 identifies certain decisions under this Marine Order as being reviewable decisions for ss17 and 18 of Marine Order 1 (Administration) 2013. That creates a formal administrative review process within AMSA’s Marine Orders framework for particular decisions (ss10(3),14(1),18(2), s19,26(2),27(2) are listed). The Marine Order explicitly integrates internal review rather than an external court remedy as the first recourse for decisions of the types listed.
• Withdrawal and notice procedures. Where approvals are withdrawn under s14, the Marine Order requires written notice to be given within 14 days to the owner and to AMSA if a recognised organisation gave the notice (s14(2)). That procedure creates a record for potential review challenges but the Marine Order itself does not specify tribunal or court escalation steps beyond the reference to Marine Order 1 review provisions.

Implications for litigation practitioners

• No reported cases recorded in the instrument. Because the Order itself does not list litigation, researchers must consult external databases and the Federal Court, state courts, and tribunal records to find judicial consideration of the Marine Order’s provisions. The instrument’s notes direct readers to AMSA’s website and the Federal Register of Legislation for authoritative instrument registration information.
• Administrative law challenges would likely centre on AMSA discretion, approval withdrawal, and authorisation decisions. The Marine Order’s specification of reviewable decisions under Marine Order 1 provides a statutory administrative pathway which would likely form a necessary precursor to any judicial review in many cases. The precise content of ss17 and 18 of Marine Order 1 (Administration) 2013 is not reproduced in this instrument and should be consulted for procedural requirements and time limits applicable to review actions.
• Strict liability offences and civil penalties. Enforcement action for strict liability offences under the Marine Order could give rise to criminal prosecutions or civil penalty proceedings. Challenges to enforcement action would involve standard procedural and evidentiary issues relevant to strict liability offences, but the instrument contains no guidance about prosecutorial discretion or case law.

In short, the Marine Order provides administrative review paths and sets out offence and civil penalty regimes, but it contains no litigation history. Practitioners seeking case law must consult courts and tribunal records outside the instrument.

This section pulls together specific, non‑obvious practical traps and operational risks embedded in the Marine Order text that owners, operators, masters, approving authorities and compliance teams should note. Each is grounded in the Order’s provisions.

1. Strict liability for many core obligations

• Many core duties are strict liability offences (for example ss11(2),12(2),15(2),16(5),17(2),20(2),28(2),29(5),30(2)). That limits available defences and increases exposure for owners and operators where procedural compliance fails. Practitioners should assume prosecutors need not prove fault for those contraventions.

2. Parallel civil penalties complement criminal exposure

• In many cases contraventions give rise to both criminal strict liability exposure and civil penalties set at 50 penalty units (eg ss11(3),12(3),15(3),16(6),17(3),20(3),28(3),29(6),30(3)). Regulators can choose the enforcement pathway; civil penalties allow sanction without criminal prosecution.

3. Heavy reliance on external standards and guidance by reference

• Technical specifics are often not in the instrument; they are in the Container Convention, ACEP Guidelines and MSC/Circ.860. Practitioners must consult those documents to know plate form, marking dimensions, specific test requirements and other technical details (s4 definitions; s5(1)). Non‑compliance through ignorance of the external materials is not an avoidance.

4. Owner definition includes lessees/bailees who contractually assume responsibility

• The statutory definition of owner includes a lessee or bailee who by agreement may exercise the owner’s maintenance and examination responsibility (s4). Contractual apportionment of risk can therefore shift statutory obligations; parties relying on contractual risk allocation must ensure contracts properly allocate duties and documentation to show who acts on maintenance and examination.

5. ACEP approval caveat for non‑Australian owners

• AMSA will not approve an ACEP for an owner not domiciled in Australia unless the owner has a registered office address in Australia or an ASIC registered local agent who agrees to accept service of notices and documents (note to s18(2)). International owners must establish an Australian presence or local agent before an ACEP will be approved.

6. Marking and plate consistency requirements

• Maximum operating gross mass marking must be consistent with the plate (s12(1)), and exceeding the maximum operating gross mass as marked on the safety approval plate is a prohibited loading ground (s21(1)(e)). Discrepancies between documentation and plate create immediate operational non‑compliance risk.

7. Removal obligation creates risk where modifications occur

• Owners must remove the safety approval plate if the container has been modified and no longer complies, or if the information on the plate is no longer correct, or if removed from service and not maintained in accordance with the Container Convention (s13(1)(a)-(c)). Failure to remove an invalid plate is an offence. In practice, companies that make field repairs or modifications must manage plates and approvals closely.

8. Re‑examination deadlines use month/year specification and an alternative 30‑month clock

• Examination and re‑examination dates in the Container Convention are specified by month and year only (notes to ss16 and 18). Where repaired, the re‑examination deadline is the earlier of the date that would have been due under the Convention or 30 months after the repair examination (s16(4); s18(4)). This dual-timer can catch operators who calculate dates incorrectly.

9. Loading/unloading restrictions limited to specific locations

• Subdivision 2.3 only applies to containers being loaded or unloaded at a port (s6(3)). Subdivision 3.2 applies to offshore container loading/unloading at ports, MODUs, fixed/floating offshore installations or resources industry fixed structures (s6(4)). Parties operating in intermodal or land‑based transfers should ensure they understand when these operational prohibitions apply.

10. Master has independent duty on stacking loads

• The master’s statutory duty about allowable stacking load for 1.8g is independent of owner duties (s22(1)). This creates potential dual liability situations where a master may be criminally/civilly liable even if the owner holds correct plates.

11. Approving competent authority authorisation standard requires ISO/IEC 17020:2012 equivalence

• Organisations seeking authorisation as approving competent authorities for inspection must meet type B inspection body requirements under ISO/IEC 17020:2012 or an equivalent (s26(4)). Not all inspection firms meet these standards; owners intending to use 3rd party inspectors should check the authorisation status and standards of their chosen body.

12. AMSA discretion and withdrawal power

• AMSA or a recognised organisation may withdraw approval if the container no longer complies with the Container Convention (s14(1)). AMSA may also withdraw ACEP approvals (s19). Withdrawal can disrupt commercial operations and create urgent re‑marking and inspection demands.

13. Administrative processes reference different versions of Marine Order 1

• The text refers to Marine Order 1 (Administration) 2011 for ACEP applications (s18(1)) and Marine Order 1 (Administration) 2013 for reviewability and authorisation applications (s7; s26(1)). Practitioners must check which Marine Order 1 provisions apply to their procedure and whether subsequent consolidation or amendment has altered process steps.

14. Offshore container inspection periodicity is the shorter of one year or original approving competent authority’s period

• Offshore containers must be inspected the shorter of 1 year or the period specified by the approving competent authority that originally approved the container (s29(3)). If an approving body has specified a shorter period, owners must follow the shorter timeframe.

These are operationally significant points that can produce compliance failures or unexpected enforcement consequences if not managed proactively through controls, contractor selection, and procedural discipline.

Compliance requires a programme that aligns approvals, marking, inspections, operational checks at transfer points, contractual allocation of responsibilities and record-keeping. Below is a practical compliance checklist tied to the Marine Order’s provisions.

1. Establish clear allocation of “owner” responsibilities

• Confirm whether your organisation is the statutory “owner” or whether legal title, lease or bailment arrangements transfer owner responsibilities. If a lessee or bailee assumes owner duties by contract, ensure the contract records that responsibility clearly because the Marine Order treats such a party as the owner for maintenance and examination duties (s4 definition).

2. Approvals and modifications

• For Container Convention containers, lodge applications for approval with AMSA or a recognised organisation (s10(1)). For offshore containers, apply to an AMSA‑authorised approving competent authority (s27(1)).
• If you modify a container’s structure after approval, apply for approval of the modification before placing the modified container back into service (s10(2)). Remove or update plates where the modification affects compliance (s13(1)(a)).

3. Maintain valid plates and markings

• Fix safety approval plates and offshore approval plates in accordance with the Container Convention and the offshore Guidelines (ss11(1);28(1)). Ensure the maximum operating gross mass marking is present and consistent with the plate (s12(1)).
• If a plate becomes inaccurate, remove it immediately (s13(1)(b)) and arrange for corrective approval/inspection.

4. Examination and inspection scheduling

• For periodic examination schemes, arrange periodic examinations by AMSA or a recognised organisation as required by the Container Convention (s16(1)). Maintain a master schedule for due months and years (note: dates specified by month and year only).
• For ACEP applicants, prepare an ACEP submission in accordance with Marine Order 1 (Administration) 2011 and the ACEP Guidelines; if approved, implement continuous monitoring and ensure post-refurbishment and hire-period inspections per s18(3).
• For offshore containers, schedule periodic inspections at least annually or per the shorter interval specified by the approving competent authority (s29(2)-(3)).

5. Marking and records

• Stamp, emboss, engrave or apply a permanent decal for examination/re‑examination dates for periodic scheme containers (s17(1)); for ACEP containers mark “ACEP (AUS)” permanently (s20(1)). For offshore containers mark inspection date and the inspector’s mark as required by the offshore Guidelines (s29(4)).
• Keep contemporaneous records of inspections, repairs, approvals and markings to demonstrate compliance in the event of enforcement or review.

6. Operational control at loading/unloading points

• Establish checklists and training for persons performing loading/unloading and for masters. On receipt of a container, verify: absence of defects that could endanger persons; presence and validity of safety/approval plates; that examination/inspection dates are not past due; that ACEP markings are present where relevant; and that the container does not exceed the maximum operating gross mass on the safety plate (s21(1)(a)-(e); s30(1)(a)-(c)).
• For masters, implement procedures and documentation to ensure stacking complies with the allowable stacking load for 1.8g indicated on the safety approval plate (s22(1)). For one‑door‑off operations use the allowable stacking load on the safety plate (note to s22).

7. Engage authorised and competent third parties

• Where using recognised organisations or approving competent authorities, confirm their authorisation status with AMSA (s5(2); s26). For inspection bodies, check they meet ISO/IEC 17020:2012 type B inspection body requirements or equivalent (s26(4)). Record their authorisation documentation and audit history.

8. Prepare for AMSA notices and inspector interactions

• Assign personnel and create standard operating procedures to respond to AMSA written notices requiring cessation of activities or precautions (ss23(2);31(2)). Ensure personnel know the scope of their control to comply with notices (ss23(3);31(3)).
• Maintain a clear escalation pathway for rapid response to withdrawal of approvals or prohibition notices, including contingency plans for alternative containers or re‑examination to minimise operational disruption (s14(1); s19).

9. Contracting and insurance

• Reflect statutory duties in supply, lease and hire contracts: make explicit who is responsible for approvals, exams, plates and removals, and require evidence of compliance. For hire arrangements, ensure examinations are done before loading when hire arrangements commence and after they end as required under s18(3)(b).
• Consider insurance coverage for regulatory fines and business interruption arising from withdrawn approvals or inspection failures, noting that strict liability exposure can produce enforcement cost even absent fault.

10. Review and continuous improvement

• Implement an audit programme for container management aligned to the Container Convention and the offshore Guidelines. If running an ACEP, ensure the programme meets the ACEP Guidelines and can be audited by AMSA or a recognised organisation (s18(2) note).
• Keep abreast of updates to IMO Guidelines and any AMSA guidance or changes to Marine Order 1 that affect application or review processes. The Marine Order permits the referenced international documents to be amended “from time to time” (s4 definitions), so technical compliance must track those updates.

11. Administrative review readiness

• If a decision under the listed subsections is taken against you, note that s7 makes it a reviewable decision under Marine Order 1 (Administration) 2013 ss17 and 18. Ensure timetables and records are in place to meet any procedural deadlines required by Marine Order 1.

By implementing these steps, an owner or operator will address the material obligations in the Marine Order: approvals, plates and markings, inspections, ACEP implementation, operational checks at transfer points, and responsiveness to AMSA. The critical compliance elements are documentary proof, timely inspections, plate integrity, and operator training for loading/unloading checks.
