Marine Order 41 (Carriage of dangerous goods) 2017

The Order builds on a small set of core concepts and definitions which organise duties, permissions and enforcement.

• IMDG Code and INF Code. The IMDG Code is defined as the International Maritime Dangerous Goods Code adopted by IMO Resolution MSC.122(75) and "in force on a mandatory basis for Chapter VII of SOLAS" (s 4(1)). The INF Code is defined and incorporated for INF cargoes (s 4(1)). The Order requires compliance with Parts A and D of Chapter VII of SOLAS and with the IMDG Code and, for INF cargo, the INF Code (s 13). The Order further clarifies that certain voluntary IMO amendments that Contracting Governments may apply early are treated as compliance if applied (s 4(4)).
• Document of compliance to carry dangerous goods. For regulated Australian vessels, the instrument prescribes a domestic "document of compliance to carry dangerous goods" issued by an issuing body where the vessel and equipment meet the SOLAS requirements that apply (ss 4(1)(b), 11). For foreign vessels the document is that required by regulation 19.4 of Chapter II-2 of SOLAS (s 4(1)(b)).
• Consolidator and shipper. A consolidator is a person who packs or supervises packing of at least one consignment into a cargo transport unit (s 4(1)). The shipper (also called consignor in the IMDG Code) carries primary responsibility to give written notices and documentation prior to shipment (s 16). Consolidators have separate notice, packing declaration and record retention duties (s 17).
• Handling and cargo transport units. Handling is defined to include loading, unloading, stacking, stowing, restowing and incidental operations (s 4(1)). The Order repeatedly distinguishes dangerous goods carried in packaged form and those in bulk, and uses cargo transport unit concepts from IMDG/SOLAS when specifying stowage, segregation and placarding requirements (multiple provisions; see notes to s 13 and s 14).
• Approvals and issuing bodies. AMSA is empowered to grant approvals to arrangements called for in the IMDG Code (s 7). "Issuing bodies" under the Navigation Act and Marine Order 1 are responsible for issuing documents of compliance for Australian vessels, and may revoke them where criteria are no longer met or other conditions apply (ss 11-12).
• Strict liability offences and civil penalties. Multiple contraventions are stated to be strict liability offences (e.g. s 9(3); s 14(3); s 15(3); s 17(3); s 18(5)) and many are paired with civil penalties of 50 penalty units (e.g. ss 9(4), 14(4), 15(4), 17(4), 18(6)). The instrument cross-references the Navigation Act for additional offences and inspector powers in its notes (see notes to ss 13, 14, 27).

Cross-cutting rules that practitioners must track:

• Temporal requirements: notice timing (shipper must give notice to master at least 48 hours before loading, and special list/manifest to AMSA at least 24 hours before loading) (s 16(5)(a); s 18(1)).
• Record retention: copies of notices and manifests must generally be retained for at least 3 months; evidence of training must be kept for at least 5 years (ss 16(5)(b), 17(2), 18(4), 19(3), 21(3)).
• Classes with special treatment: Class 1 explosives and Class 7 radioactive materials carry specific additional requirements (ss 25-26). Type B and Type C radioactive material packagings require AMSA approval (s 23(2)).
• Integration with other domestic statutes and instruments: the Order applies subject to other regulatory schemes such as the Explosives Act 1961 and the Protection of the Sea (Prevention of Pollution from Ships) Act 1983, and interfaces with Marine Order 1 and the Australian Maritime Safety Authority Act 1990 for fees and processes (notes to ss 5 and 13; s 7 note 1).

Those concepts are the structural primitives you use to determine who must do what and what evidence agencies may seek in audit or enforcement.

The instrument distributes obligations and potential exposure across a chain of actors involved in the maritime carriage of dangerous goods. The principal affected parties are:

• Masters and vessel owners. The master or owner must not permit loading of certain dangerous goods without a document of compliance where one is required, and must ensure loading, stowage, carriage and unloading comply with SOLAS/IMDG/INF (ss 9(1)-(2), 13). The master must provide special lists or manifests to AMSA and must make emergency response instructions available to seafarers (ss 15(2), 18(1), 18(3)).
• Shippers (consignors). Shippers must give written notice to the master and to AMSA prior to shipment, complete the Multimodal Dangerous Goods Form or equivalent transport document, provide exemptions or approvals if any, and retain copies for three months (s 16). Shippers must ensure packaging, marking, labelling and placarding meet IMDG requirements and that packagings and portable tanks meet Part 6 of the IMDG Code (ss 14(1), 23(1), 24(1)). For Class 1 explosives, shippers must notify AMSA before packing into closed cargo transport units and allow inspection (s 25).
• Consolidators. Consolidators who pack cargo transport units must give the master and, if requested, AMSA the notice and a completed packing declaration (Container/vehicle Packing Certificate), and retain copies for 3 months. Consolidators must ensure packing is supervised by a person trained to IMDG Chapter 1.3 standards (ss 16(3), 17(1)-(2), 14(2)).
• Employers of shore-based personnel (non-seafarers) who handle packing, loading or carriage. Employers must provide training and refresher training in accordance with Chapter 1.3 of the IMDG Code, provide function-specific training tied to responsibilities, and retain training evidence for five years (s 21).
• Issuing bodies and AMSA. Issuing bodies issue and may revoke documents of compliance for regulated Australian vessels where SOLAS criteria are met and where ongoing compliance exists (ss 10-12). AMSA is the competent authority for IMDG shipments from Australia, may grant exemptions and approvals (ss 4(3)(b), 6-7), may audit training systems (s 22), and inspectorates may serve notices and require precautions (s 27).
• Persons organising transhipments and agents. Those organising transhipment must provide both the documentation covering the previous leg and the endorsed document for the intended voyage, and retain copies for three months (s 19).
• Owners or agents in incident situations. If an incident involves loss or likely loss overboard of packaged dangerous goods, masters must report particulars without delay to the nearest coastal State and owners or agents must complete reports if the master abandons or information is incomplete (s 20).

Secondary affected parties include training providers (who supply the courses recognised by AMSA), manufacturers or suppliers of packagings and portable tanks (whose products must meet Part 6 IMDG and in some cases AMSA approval, ss 23-24), and port authorities or port service providers that rely on accurate manifests and stowage information.

The Order also identifies AMSA and issuing bodies as decision-makers with reviewable decision pathways: decisions under sections 11 or 12 (issue or revocation of a document of compliance) are reviewable decisions under section 17 of Marine Order 1 (s 8).

The Order allocates discrete duties and procedural rights along the supply chain. Below are the principal, materially operative duties and rights with statutory citations.

Duties of masters and owners

• Prevent loading where no document of compliance is required by SOLAS regulation 19.4 (s 9(1)). Penalty 50 penalty units; strict liability; civil penalty also specified (ss 9(1)-(4)).
• Ensure loading, stowage, carriage and unloading comply with Parts A and D of Chapter VII of SOLAS, the IMDG Code and the INF Code for INF cargo (s 13).
• Ensure emergency response instructions are on board and available to seafarers (s 15(1)-(2)).
• Provide special list or manifest for dangerous goods to AMSA at or nearest the port of loading at least 24 hours before loading (s 18(1)-(2)); notify AMSA in writing of changes (s 18(3)).

Duties of shippers and consolidators

• Shippers must give written notice to the master and to AMSA (if requested) before goods are shipped, including a completed Multimodal Dangerous Goods Form or IMDG Chapter 5.4 transport document, copies of any exemptions or approvals, and a waste movement document for hazardous waste exports (s 16(1), (2), (4)(a)-(d); s 16(5)(a)-(b)).
• Shippers must ensure packing, marking, labelling and placarding comply with IMDG and that packings are constructed, marked, tested and approved in accordance with Part 6 IMDG (ss 14(1), 23(1)).
• Consolidators must provide the notice and a packing declaration to the master and AMSA on request, and retain copies for three months (s 17(1)-(2)).
• Shippers must notify AMSA before packing Class 1 explosives into closed cargo transport units and must make the unit available for inspection; they must not carry Class 1 on a tanker without AMSA approval (s 25).

Duties of employers and training obligations

• Employers of shore-based personnel handling dangerous goods must provide training in accordance with IMDG Chapter 1.3, including function-specific training as appropriate, and must keep evidence of training for at least five years (s 21(1)-(3)).

AMSA and issuing body powers and duties

• AMSA may grant exemptions up to five years where compliance would be unreasonable and in accordance with IMDG section 7.9.1, and may impose conditions including the requirement to keep the exemption on board (s 6).
• AMSA may approve testing, classification, packaging or carriage arrangements under the IMDG Code if satisfied they comply with SOLAS and the IMDG Code; AMSA must inspect and approve equipment, procedures and methods for Class 7 stowage and securing (s 7).
• Issuing bodies may issue a document of compliance to carry dangerous goods for up to five years where the vessel and equipment comply with the applicable SOLAS requirements (s 11) and may revoke it on enumerated grounds (s 12).
• AMSA may audit training systems under Chapter 1.3 of the IMDG Code and inspectors may issue written notices to cease activities or require precautions where reasonable grounds exist to believe an activity may damage the vessel, pose safety risks or damage the environment (ss 22, 27).

Rights and procedural protections

• Applicants may apply for exemptions or approvals through the Marine Order 1 administration process (s 6(1); s 7(1) note references Marine Order 1).
• Decisions to issue or revoke documents of compliance are reviewable decisions under section 17 of Marine Order 1, providing a defined administrative review pathway (s 8).
• Owners may request revocation of a document of compliance, and revocation can occur when the vessel ceases to be registered in Australia or if the criteria for issue are no longer met (s 12).

Cross-cutting compliance duties

• Record-keeping obligations: notices and manifest copies must be kept for at least three months (ss 16(5)(b), 17(2), 18(4), 19(3)), and training evidence for five years (s 21(3)).
• Strict liability. Many offences are declared strict liability, limiting available defences (e.g. ss 9(3), 14(3), 15(3), 17(3), 18(5), 19(4), 20(3), 21(4), 23(3), 24(2), 25(5), 26(3)).
• Monetary exposure. The Order repeatedly sets the pecuniary level at 50 penalty units for specified offences and civil penalty provisions (e.g. ss 9(1)-(2), 14(1)-(2), 15(1)-(2), 16-20, 21, 23-26).

These duties are operationalised by reference to external technical instruments (IMDG, INF, SOLAS) for technical specifications (packaging, stowage, segregation, placarding, documentation), while administrative duties (notice, record-keeping, training, approvals, audits) are wholly contained in the Order.

The Order uses a combined criminal and civil enforcement architecture, with inspector powers and administrative mechanisms. Core features:

Penalty scale and strict liability

• The instrument repeatedly prescribes a penalty of 50 penalty units for specific contraventions. Examples include permitting loading in contravention of document of compliance requirements (s 9(1)-(2)), failure by shippers or consolidators to meet packing or notice obligations (ss 14(1)-(2), 17(1)), failure to provide special lists or manifests (s 18(1), (3)), failures in transhipment documentation (s 19(1)-(2)), failures to report incidents at sea (s 20(1)-(2)), failures in training evidence retention (s 21(3)), and failures to ensure packagings or tanks meet Part 6 IMDG requirements (ss 23-24). Where the instrument specifies, the criminal offence is strict liability and a parallel civil penalty of 50 penalty units is often available (see for example ss 9(3)-(4), 14(3)-(4), 15(3)-(4)).

• The repeated use of strict liability offences in key operational duties indicates that prosecutors do not need to prove fault (mens rea) for those contraventions; the statutory text explicitly calls out strict liability for many offences (multiple provisions cited above).

Inspector powers and administrative enforcement

• Section 27 establishes an operational enforcement mechanism. Where an inspector believes on reasonable grounds that an activity during loading, unloading, stowage or carriage may damage the vessel, pose a risk to safety, or damage the environment, the inspector may issue a written notice requiring cessation of the activity or requiring specified precautions (s 27(1)-(2)). Persons given a notice must comply to the extent it relates to matters over which they have control (s 27(3)). The instrument cross-references Navigation Act powers and prohibition notices in its notes (s 27 notes referencing ss 264 and 267 of the Navigation Act).
• AMSA may carry out audits of training systems in accordance with IMDG Chapter 1.3 (s 22). These audits may expose employers to enforcement action if training and record-keeping obligations are not met.
• Issuing bodies may revoke documents of compliance where the criteria are no longer met, where the vessel is involved in a breach of the Order, where the vessel ceases to be registered in Australia, or at the owner’s request (s 12). Revocation affects legal ability to load goods subject to a document of compliance requirement (s 9).

Administrative remedies and review

• Decisions under sections 11 (issue) and 12 (revocation) are reviewable decisions for section 17 of Marine Order 1, so affected parties have an administrative review mechanism available (s 8). The Order’s notes point users to Marine Order 1 for application processes and to the Australian Maritime Safety Authority Act 1990 for fees which may apply when applying for approvals (s 7 note 1).

Interaction with criminal provisions elsewhere

• The Order’s notes refer to the Navigation Act for additional criminal offences relating to dangerous goods, false descriptions and failure to give notice, indicating that enforcement may run in parallel under the Navigation Act for certain breaches (notes to ss 13 and 14, and s 16 note referencing s 119 of the Navigation Act).

Practical enforcement implications

• The combination of strict liability offences and inspector powers means operational actors carry high compliance burdens and time-sensitive obligations, with criminal penalties at a fixed scale and civil penalty alternatives explicitly available. AMSA’s ability to audit, approve, exempt and revoke documents of compliance creates administrative levers that can be exercised without court processes where statutory criteria are met (ss 6-12, 22, 27).

For practitioners and compliance officers the immediate tasks are to map operational processes to the Order’s timing and documentation requirements, and to ensure record systems can produce evidence for inspections and audits, because the instrument’s enforcement design privileges rapid, administratively executable actions by AMSA and issuing bodies.

The Order is explicitly designed to give domestic effect to international obligations and to sit alongside other Australian statutes and subordinate instruments. Its text and notes identify several statutory and regulatory touchpoints.

International instruments and implementation

• SOLAS, IMDG Code and INF Code. The Order directly implements Part A and D of Chapter VII of SOLAS and the IMDG Code, and the INF Code for INF cargo, as its core technical standards (s 2; s 13). The IMDG Code is incorporated as the IMDG Code in force and mandatory for Chapter VII of SOLAS and the Order treats certain voluntary IMO amendments as acceptable for compliance where IMO invites early application (s 4(1), (4)). Practitioners must therefore track the current SOLAS/IMO amendment timetable and AMSA guidance on which voluntary amendments Australia has adopted in practice.
• International documentation norms. The Multimodal Dangerous Goods Form and the IMDG Chapter 5.4 transport document are prescribed as the format/content for notices and manifests (s 16(4)(a); s 17(1)). The Order refers to IMO Circular FAL.2/Circ.51/Rev.1 as an example for manifest formats (s 18 note).

Domestic maritime and related laws

• Navigation Act 2012. The Order is made under subsection 342(1) of the Navigation Act 2012 and expressly relies on powers in sections 112, 339, 341 and 340 (s 3). The Order also cross-refers to offences in the Navigation Act, including s 114 (failure to take proper precautions) and ss 116-119 concerning false descriptions and failure to give notices (notes to ss 13, 14, 16). Inspectors’ powers under the Navigation Act (ss 264 and 267) are noted as relevant to the inspector powers in s 27.
• Marine Order 1 (Administration) 2013. Procedural matters such as the application process for exemptions and delegation of AMSA’s powers are referenced to Marine Order 1 (s 6(1); s 4 note 4). Decisions under ss 11 and 12 are reviewable under s 17 of Marine Order 1 (s 8).
• Australian Maritime Safety Authority Act 1990. The Order notes that fees may be determined under the AMSA Act for processing applications under s 7 (s 7 note 1), linking the approval/administrative cost regime to AMSA’s enabling legislation.
• Protection of the Sea (Prevention of Pollution from Ships) Act 1983 and Marine Order 94. The Order highlights that additional pollution control requirements under MARPOL and related domestic instruments may apply to harmful substances (s 13 notes). Where dangerous goods overlap with harmful substances, MARPOL-derived obligations and Marine Order 94 will also apply.
• Explosives Act 1961. The Order excludes goods the handling of which is regulated under the Explosives Act from its scope (s 5(2)(b)), so explosive regulation may be captured elsewhere and create parallel regulatory touchpoints for Class 1 goods.
• Hazardous Waste (Regulation of Exports and Imports) Act 1989. For exports of hazardous waste substances, the Order requires inclusion of the waste movement document from the Department of the Environment and Energy in shipper notices (s 16(4)(d)), and cross-references the Hazardous Waste Act for those shipments.

Administrative instruments and standards

• Australian Standards and ISO. For certain "national material standards" and "recognized pressure-vessel code" references in the IMDG Code, the Order specifies AS 1210,2010 and ISO 16528-1:2007 as the relevant Australian/ISO standards at the time of the Order for yield, ultimate strength and other criteria (s 4(3)(d)-(e)). That creates a domestic baseline for acceptance of pressure-vessel materials for dangerous goods carriage.
• IMO guidance. The Order cites MSC.1/Circ.1216 and the Annex of IMO Resolution A.851(20) as examples of guidance for port area activities and ship reporting systems (notes to s 13 and s 20).

Consequences and practical interactions

• Parallel obligations. Operators must ensure compliance with both the technical IMDG/SOLAS prescriptions and separate domestic provisions under the Navigation Act and other statutes, creating potential for parallel enforcement processes (e.g. criminal offences under the Navigation Act referenced in notes, plus strict liability offences in the Order).
• Administrative coordination. AMSA is established as the competent authority for shipments from Australia under the IMDG Code and will be the decision-maker for approvals, exemptions and audits required by the Order (s 4(3)(b); ss 6-7, 22).
• Temporal complexity. The Order’s treatment of certain voluntary IMDG amendments as acceptable for compliance adds an element of timing complexity: operators must know whether AMSA accepts early application of a given IMDG amendment and whether Australia has made that amendment mandatory domestically (s 4(4)).

For lawyers and compliance professionals the immediate implication is an obligation to map international technical requirements and domestic administrative instruments into operational compliance frameworks and to ensure that manuals, training, record-retention and documentation systems reflect both sets of requirements.

The Marine Order itself contains limited historical material but does record two discrete historical facts:

• Repeal and replacement. The instrument expressly repeals Marine Order 41 (Carriage of dangerous goods) 2009 (s 1B). The 2017 Marine Order therefore replaces the 2009 Order as the operative subordinate instrument with effect from its commencement date.
• Commencement date. The Order commenced on 1 January 2018 (s 1A).

Beyond those two statements, the instrument does not list subsequent amendments or a legislative history within its text. Users seeking post-2017 amendments or consolidated versions should consult the Federal Register of Legislation and the Australian Legal Information Institute for any legislative amendments or replacement instruments. The instrument includes a note directing users to the Federal Register of Legislation under the Legislation Act 2003 for registration of legislative instruments and compilations (final note).

Two features in the text create an ongoing dynamic that acts as de facto amendment points to the operational rule set:

• International amendment channels. Because the Order implements the IMDG Code and SOLAS provisions, subsequent changes to the IMDG Code and SOLAS made by IMO (and the Australian decision to adopt particular amendments) will affect practical compliance. The Order explicitly treats IMDG amendments that IMO invites Contracting Governments to apply on a voluntary basis as acceptable bases for compliance (s 4(4)). That means in practice that technical changes at the international level may be incorporated into Australian compliance obligations without separate domestic amendment of the Order.
• Standards references. The Order fixes at the time of making certain national material standards and ISO codes (AS 1210,2010; ISO 16528-1:2007) as the references in Chapter 6.7 of the IMDG Code for national material standards or recognized pressure-vessel codes (s 4(3)(d)-(e)). If AMSA or the IMDG Code updates the reference points later, that may require administrative action or clarifying guidance from AMSA to affect enforcement practice.

Practitioners should therefore treat amendment history as both the formal record of instrument replacement (2009 to 2017) and an open-ended process driven by international instrument change and AMSA administrative adoption decisions. For authoritative amendment records consult the Federal Register of Legislation and AMSA guidance pages referenced in the Order (s 4 notes).

The text of the Order does not mention any judicial decisions or litigation history. There are no cases named in the instrument, and it does not contain any judicial interpretive history.

What the Order does specify about adjudicative and review pathways is administrative rather than judicial:

• Decisions to issue or revoke documents of compliance (ss 11-12) are reviewable decisions under section 17 of Marine Order 1 (s 8). That creates an administrative review route for affected parties. Marine Order 1 sets out the process for requests, internal review and related administrative procedural matters.
• The Order repeatedly imposes strict liability offences and civil penalties. Enforcement activities may therefore result in prosecutions or civil penalty proceedings under relevant statutes (the Navigation Act framework and the Order itself). Any litigation under those provisions would be brought under the Navigation Act or the Order’s criminal/civil penalty provisions in the relevant courts or tribunals, subject to usual jurisdictional rules.

Because the instrument does not contain any reported litigation, practitioners must rely on wider case law under the Navigation Act and subordinate instruments when litigating enforcement or review matters. Any legal strategy must therefore map the administrative review outlined in Marine Order 1 with prosecutorial options under the Navigation Act and the Order’s strict liability offences. If judicial review of AMSA administrative action is contemplated, standard administrative law remedies and grounds (procedural fairness, jurisdictional error, unreasonableness) would be the route, but the Order itself provides no examples or precedents.

In short, the Order creates administrative decision points and review rights, but contains no litigation history in the text. Practitioners should search case law databases and AMSA decision records to identify any emerging case law on the Order’s operation.

Operational compliance under Marine Order 41 involves numerous timing, documentation, approval and evidence pitfalls that can create exposure even where technical compliance with the IMDG Code is attempted. Key "gotchas" identifiable within the instrument are:

Strict liability framing and parallel civil penalties

• A large number of specified offences are strict liability (e.g. ss 9(3), 14(3), 15(3), 17(3), 18(5), 19(4), 20(3), 21(4), 23(3), 24(2), 25(5), 26(3)). In strict liability contexts the defence of absence of fault is limited; defendants must rely on statutory defences, reasonable mistake of fact where available, or other available defences. The instrument pairs criminal penalties with civil penalties of the same monetary order for many contraventions (e.g. ss 9(4), 14(4), 17(4), 18(6), 19(5), 20(4), 21(5), 23(4), 24(3)), providing prosecutorial alternatives.
• Practical consequence: a procedural lapse in notice or record-keeping can attract the same pecuniary exposure as more substantive technical breaches. Compliance systems must therefore capture documentary steps precisely.

Timing and notice windows

• Shippers must give notice to the master at least 48 hours before loading (s 16(5)(a)). Masters must provide special lists or manifests to AMSA at least 24 hours before loading (s 18(1)); a limited alternative allows provision in the 24-hour period if key information was submitted 24 hours prior (s 18(2)). Failure to meet these timing windows is an offence carrying penalties.
• Practical consequence: last-minute bookings or late changes create legal exposure. Supply chain actors should build procedures that ensure notices are triggered and logged sufficiently in advance.

Record retention mismatches

• Standard retention for shipping notices, manifests and transhipment documents is three months (ss 16(5)(b), 17(2), 18(4), 19(3)), but evidence of training must be retained for five years (s 21(3)). Different retention periods demand different document management practices.
• Practical consequence: failing to maintain training evidence for five years is a distinct offence from failing to keep a manifest for three months. Corporations frequently apply a single retention schedule which risks under-retention.

Voluntary IMDG amendments and compliance uncertainty

• Section 4(4) treats certain voluntary IMDG amendments permitted by IMO for early application as acceptable for compliance. That means AMSA may accept compliance on the basis of a voluntary amendment adopted internationally. However, whether a given amendment is treated this way in Australia requires checking AMSA notices and guidance.
• Practical consequence: operators cannot assume that the IMDG edition they are using is the one AMSA expects; they must check AMSA guidance about which voluntary amendments it treats as acceptable.

Class-specific traps

• Class 1 explosives require shippers to notify AMSA before packing into a closed cargo transport unit and to make the unit available for inspection; Division 1.4S may have mitigated inspection needs if AMSA so determines, but shippers must still ensure structural serviceability and compliance with IMDG paragraph 7.3.3.15 (s 25). Class 7 radioactive materials require AMSA approval of equipment/procedures for stowage and securing and specific AMSA approvals for Type B and C packaging (ss 23(2), 26(1)-(2)).
• Practical consequence: shipping high-hazard classes requires prior engagement with AMSA and cannot be treated as a routine booking.

Document of compliance and foreign vessels

• The Order requires a document of compliance for goods listed in SOLAS regulation 19.4; masters/owners must not permit loading of those dangerous goods if no such document is in force (s 9). Issuing bodies may issue documents of compliance for up to five years (s 11). For foreign vessels, the SOLAS regulation applies directly (s 4(1)(b)).
• Practical consequence: charterers, agents and masters must ensure that issuing bodies have issued valid compliance documents; a missing or expired document exposes masters and owners to 50 penalty units.

Interaction with other regulatory regimes

• The Order excludes goods whose handling is regulated under the Explosives Act 1961 from its scope (s 5(2)(b)). However, both regimes may apply to different aspects of a supply chain (e.g. storage, inland transport, maritime carriage), so operators need to manage cross-regime obligations.
• Practical consequence: relying on a single compliance check against Marine Order 41 may miss obligations under other statutes such as the Explosives Act, MARPOL-derived rules, or the Hazardous Waste Act.

Inspector discretion and operational stoppages

• Inspectors may, on reasonable grounds, order cessation of activities or impose specified precautions (s 27). These notices bind persons to the extent matters are within their control (s 27(3)).
• Practical consequence: inspectors can halt operations at short notice and require remedial steps; companies must have contingency plans and escalation routes to resolve inspector concerns rapidly.

Administrative fees and approvals

• AMSA may charge fees for approvals under the Australian Maritime Safety Authority Act 1990 (s 7 note 1). While the Order does not set the fees, applicants should expect administrative costs for approvals and applications.
• Practical consequence: cost budgeting for approvals and possible repeated applications in complex cases is necessary.

Taken together these "gotchas" create compliance risk concentrated in documentation, timing, record-keeping and prior approvals rather than only in technical packaging or stowage. Organisations should treat the Order as a mixture of technical obligations derived from international codes and process-based obligations that can create enforcement exposure even in the absence of a manifest safety failure.

A practical compliance roadmap framed to align with the statutory obligations and administrative processes in Marine Order 41 is as follows. Each step cites the controlling provision from the Order.

1. Map applicability and scope

• Confirm the Order applies to the specific carriage activity: regulated Australian vessel or foreign vessel (s 5(1)). Exclude goods that are part of vessel equipment/stores or whose handling is regulated under the Explosives Act 1961 (s 5(2)(a)-(b)).

2. Verify whether a document of compliance is required and maintain validity

• Determine whether the dangerous goods fall under regulation 19.4 of Chapter II-2 of SOLAS and therefore require a document of compliance for the vessel (s 9(1)). Ensure the issuing body has issued a valid document of compliance for a regulated Australian vessel and that it is within its validity period (s 11). Keep a note of the five-year maximum issue period and calendar reminders for renewals (s 11(2)).

3. Pre-shipment notifications and documentation

• Shippers must give written notice to the master and to AMSA (if requested) before goods are shipped. The notice must include a completed Multimodal Dangerous Goods Form or an IMDG Chapter 5.4 transport document, any AMSA exemption or approval, and for hazardous waste exports the waste movement document (s 16(1), (2), (4)(a)-(d)). Ensure notices to the master are given at least 48 hours before loading and retain a copy for at least three months (s 16(5)(a)-(b)).
• If using a consolidator, provide the notice to the consolidator as well (s 16(3)).

4. Consolidator duties and packing declaration

• Consolidators must forward the shipper’s notice and provide a packing declaration (Container/vehicle Packing Certificate) to the master and AMSA if requested, and retain copies for three months (s 17(1)-(2)). Ensure the person supervising packing has IMDG Chapter 1.3 training (s 14(2)).

5. Packing, marking and packaging approvals

• Ensure all packagings are constructed, marked, tested and approved per Part 6 of the IMDG Code. For Type B and Type C radioactive materials, obtain AMSA approval for the packagings (s 23(1)-(2)). For portable tanks, MEGCs, road tank vehicles or bulk containers, ensure construction and approvals per Part 6 IMDG (s 24(1)).

6. Training and evidence retention

• Employers must provide IMDG Chapter 1.3 training and refresher training for shore-based personnel handling dangerous goods, and function-specific training per responsibilities (s 21(1)-(2)). Keep evidence of training for at least five years (s 21(3)). Maintain a retrievable training record system capable of producing certificates and attendance records on audit (s 21(3)).

7. Manifests, special lists and AMSA notifications

• Masters must provide a special list or manifest to AMSA at or nearest the port of loading at least 24 hours before dangerous goods are loaded (s 18(1)). If using the alternative described at s 18(2), ensure the preliminary information (vessel name, IMO number, port of loading, proposed date, classes, stowage location) is submitted at least 24 hours prior. Maintain copies for at least three months (s 18(4)). Notify AMSA in writing of any changes to the list or manifest (s 18(3)).

8. Transhipment and voyage continuity

• For transhipment from an Australian port, provide to the master copies of the IMDG transport document covering the previous leg and an endorsed document for the intended voyage; retain copies for at least three months and provide to AMSA on request (s 19(1)-(3)). Ensure endorsement language clearly states that goods are being transhipped.

9. Emergency response and incident reporting

• Ensure emergency response instructions consistent with IMDG paragraph 5.4.3.2 are on board and available to seafarers (s 15(1)-(2)). Prepare procedures for immediate reporting of incidents involving loss or likely loss overboard of packaged dangerous goods and ensure masters and owners/agents understand reporting obligations to the nearest coastal State without delay (s 20(1)-(2)).

10. Special classes: Class 1 and Class 7

• For Class 1 explosives, notify AMSA in writing before packing into a closed cargo transport unit and make units available for inspection, and ensure any carriage on a tanker has AMSA approval (s 25(1)-(3)). For Class 7 radioactive materials, obtain AMSA approval for equipment, procedures and methods relating to stowage and securing and stow/secure in accordance with that approval (s 26(1)-(2)). For Type B and Type C packagings, obtain AMSA approval as required (s 23(2)).

11. Approvals and exemptions

• Apply for AMSA approvals for any testing, classification, packaging or carriage arrangements where the IMDG Code requires an approval or where AMSA approval is specified (s 7(1)(a)-(b)). Apply for exemptions where strict compliance would be unreasonable, following the Marine Order 1 application process, noting that AMSA may grant exemptions for up to five years subject to conditions and that copies of exemptions must be carried on board (ss 6(1)-(4)).

12. Responding to inspectors and audits

• Prepare for AMSA audits of training systems (s 22) and for inspectors exercising cessation or precaution notices under s 27. Ensure that operational control matrices identify who must comply with inspector notices and keep accessible evidence to show compliance with AMSA directions (s 27(2)-(3)). Maintain a contact protocol to escalate issues to AMSA promptly.

13. Record-keeping and evidence systems

• Implement document management that preserves shipping notices, manifests and transhipment documents for at least three months and training records for at least five years (ss 16(5)(b), 17(2), 18(4), 19(3), 21(3)). Ensure documentary evidence of AMSA approvals, exemptions, and issuing body certificates is maintained on board where required (s 6(4)(a); s 12).

14. Legal and administrative review readiness

• If an issuing body declines to issue or revokes a document of compliance, be prepared to seek review under section 17 of Marine Order 1, as decisions under ss 11-12 are reviewable decisions (s 8). Maintain administrative records and decision correspondence to support any internal review.

15. Monitor AMSA guidance and international amendments

• Because the Order ties compliance to SOLAS, IMDG and INF technical requirements and allows for early voluntary IMDG amendments to be treated as compliance (s 4(4)), organisations should subscribe to AMSA notices about IMDG adoption and to IMO circulars. Track AMSA lists of accepted training providers and any administrative guidance about documentary formats (s 21 note; s 4 note 3).

Practical implementation checklist highlights

• Operational checklists to ensure the master receives completed Multimodal Dangerous Goods Forms 48 hours prior to loading.
• Automated notifications to AMSA (or confirmation that AMSA does not require separate notice) and to the consolidator as required.
• Document-control templates for the Multimodal Dangerous Goods Form, Container/vehicle Packing Certificate and Dangerous Goods Manifest.
• Training programmes for shore staff certified to IMDG Chapter 1.3 and retraining schedules recorded for five-year retention.
• A registry for AMSA approvals, exemptions and documents of compliance with expiry alerts.

Following the procedural steps above aligns operational practice to the Order’s prescriptive duties and reduces exposure to strict liability and civil penalties. Legal advisers should document compliance policies, administrative controls and escalation routes so that audit trails can be produced quickly in response to AMSA inspections or enforcement actions.
