Marine Order 34 (Solid bulk cargoes) 2016

The Order organises its regulatory regime around several recurring legal and operational concepts drawn from international instruments and implemented by AMSA’s domestic rules. These concepts include: compliance hierarchy; competence and administration; approvals and equivalents; duties of named actors; notice regimes; plans and contingency powers; strict liability and civil penalties; and material-specific addenda.

Compliance hierarchy and incorporation by reference: Section 11(1) lists what must be complied with when loading, stowing, carrying and unloading solid bulk cargo: Parts A and B of Chapter VI of SOLAS, regulation 7-3 of Chapter VII of SOLAS for dangerous solid bulk goods, the IMSBC Code, the BLU Code and this Order (including Schedule 1). The Order therefore operates integratively: its operative obligations require actors to follow the international instruments as they are “in force from time to time” (see the definitions of IMSBC Code and BLU Code at s 4). Section 5(1) confirms that terms defined in SOLAS or in a code mentioned in the Order have the meaning given by those instruments. Section 5(4) takes a further step for amendments: a person is taken to comply with the IMSBC Code if the person complies with the Code as amended for dates of voluntary application of amendments, and an explanatory note states Australia adopts the voluntary application date.

Competent authority, Administration, AMSA functions: s 5 sets AMSA as competent authority and, for regulated Australian vessels, the Administration (s 5(2)-(3)). AMSA therefore has primary domestic responsibility for approvals, assessments, exemptions and enforcement under the Order. The Order repeatedly refers to procedures and application processes that are to be carried out under Marine Order 1 (Administration) 2013 (for exemptions, equivalents and approvals, see s 7, s 8, s 9 and s 10).

Approvals, equivalents and exemptions: the instrument creates administrative gates. Shippers may require AMSA approval for transport arrangements mentioned in the IMSBC Code (s 9(1)-(2)). Owners or masters of Australian regulated cargo vessels may apply to an issuing body to have a vessel approved as specially fitted or constructed under IMSBC section 7.3.2 (s 10). Equivalents (alternative means of compliance) are possible by application to AMSA, but AMSA must be satisfied the equivalent is at least as effective as compliance (s 8). Exemptions from paragraph 11(1)(c) may be granted where compliance would be unreasonable or impracticable and the exemption would not contravene SOLAS or the IMSBC Code; exemptions are conditional, must be kept on board for the voyage and contravention of certain exemption conditions is a strict liability offence (s 7).

Named actors and role allocation: the Order distributes duties among named actors:

• Shippers must provide information to AMSA and the master, arrange sampling and testing as required by the IMSBC Code, give notices at prescribed times (s 16, s 18, s 19).
• Masters must ensure documents demonstrating compliance are carried and produced to inspectors on request, must agree loading/unloading plans with the terminal representative, ensure operations are conducted in accordance with the plan, suspend operations where plan limits are exceeded and notify inspectors, and ensure the Medical First-Aid Guide is on board where applicable (s 11(2), s 12-13, s 15).
• Terminal operators and terminal representatives may allow operations only in accordance with SOLAS/IMSBC/BLU/this Order and must keep and produce loading/unloading plans and ensure operations comply with the plan (s 11(3), s 12(3)-(4), s 13(2), s 13(6)).
• Inspectors (empowered by AMSA) may request documents, detain vessels (via Navigation Act authority referenced in a note), give notices requiring cessation or precautions when risk is detected, and receive notices of intention and fumigation (s 11(2), s 16, s 17, s 20).

Notice, plan and information regimes: The Order prescribes concrete timeframes and content. For Group A/B cargo, the shipper must give AMSA at least 48 hours' notice prior to starting loading at an Australian port (s 16(1)). The shipper must provide the master with the information in IMSBC section 4.2 before loading starts (s 18(1)). Loading and unloading plans must comply with the BLU Code, be agreed between master and terminal representative, be lodged with the terminal representative, be kept on board for the voyage and retained by the terminal representative for at least six months (s 12). Fumigation intentions must be notified to AMSA within 72 hours before arriving in port (s 17).

Material-specific regulation and Schedule 1: The Order supplements the IMSBC Code with Schedule 1 additional requirements for listed materials. For example, ammonium nitrate fertiliser UN 2067 is “subject to approval after inspection of condition and cleanliness of intended cargo space”; UN 2071 requires a trough test result certified by a competent chemist; low specific activity (LSA) materials are subject to exclusive-use cargo space and contamination limits; seedcake with certain oil/moisture thresholds requires chemist certification; scrap metal requires a shipper declaration that it does not include certain shavings or cuttings susceptible to self-heating.

Enforcement and sanctions: the Order makes many contraventions strict liability offences and/or subject to civil penalties, often set at 50 penalty units (for example, failing to carry documents s 11(2), failing to agree or comply with loading plans s 12-13, failing to obtain AMSA approvals for Group A procedures s 14(1), shipping Group A with moisture above the IMSBC transportable moisture limit s 14(2), failing to give notices s 16-18, failing to keep plans s 12(4), and contravening exemption conditions s 7(4) and s 7(6)). Inspectors can issue written notices requiring cessation of unsafe activity or requiring precautions (s 20). The Order also cross-refers to the Navigation Act for detention powers and for reporting marine incidents (note to s 11(3) and s 21).

Taken together, these concepts create a regulatory structure that layers international technical standards onto a domestic administrative enforcement regime, with specific actors given documentary, procedural and operational obligations, and with AMSA exercising approval and assessment discretion under statutory criteria.

The Order allocates obligations across a relatively small set of identifiable actors in maritime solid bulk cargo operations, and therefore affects each actor differently.

Shippers: Shippers bear a substantial portion of the compliance burden. They must provide prescribed cargo information to AMSA for unlisted cargo under s 19(1)(a) and ensure AMSA assesses that cargo per IMSBC section 1.3 (s 19(1)(b)). For Group A/B cargo, shippers must give AMSA a signed notice at least 48 hours before starting loading at an Australian port, containing vessel identity, port/berth and IMSBC section 4.2 cargo information (s 16(1)). The shipper must give the master the IMSBC section 4.2 information before loading begins (s 18(1)) and must arrange sampling and testing if IMSBC section 4.3 requires it (s 18(4)). For Group A cargo that may liquefy, AMSA approval of the shipper’s sampling/testing/moisture-control procedure is required (s 14(1)). The shipper must also provide copies of approvals to the master (s 14(1)(b)). Schedule 1 imposes additional shipper obligations for specific commodities (for example: inspection approval condition for ammonium nitrate fertiliser UN 2067; trough test certification for UN 2071). Shippers also face strict liability and civil-penalty exposure for many notice and information failures (s 16(8)-(10), s 18(6)-(7), s 19(3)-(4)).

Masters and owners: Masters are responsible for operational and documentary compliance onboard. Section 11(2) requires the master to ensure documents necessary to demonstrate compliance with s 11(1) are carried on the vessel and made available to an inspector on request. Masters must agree and implement BLU Code-compliant loading and unloading plans with a terminal representative and must keep a copy aboard throughout the voyage (s 12(1)-(3)). Under s 13, the master must ensure operations are conducted in accordance with the plan, may suspend loading/unloading if plan limits are exceeded and must ensure corrective action before resuming (s 13(3)-(6)); the master must notify the inspector when suspension occurs where the port State is Australia (s 13(7)(a)). For Group A cargo, the master must not take a vessel to sea carrying cargo with moisture content higher than the transportable moisture limit (s 14(2)). Masters also must keep the Medical First-Aid Guide (IMDG supplement) onboard where relevant (s 15). Many of these duties are strict liability offences and attract civil penalties (see s 11(2), s 12(1)-(2), s 13(1), s 14(2), s 15(2)-(4)).

Terminal operators and terminal representatives: Terminal operators and their on-site representatives are gatekeepers of shore-side operations. Section 11(3) restricts them to allow loading, trimming, carriage or unloading only in accordance with SOLAS/IMSBC/BLU/this Order (s 11(1)(a)-(e)) and makes non-compliance an offence. Section 12 requires terminal representatives to keep loading/unloading plans and any amendments for at least six months and to make them available to an inspector at the AMSA office nearest the port (s 12(3)-(4)). Section 13 requires terminal representatives to ensure operations within their area of responsibility comply with the plan and take corrective action when loading/unloading is suspended (s 13(2), s 13(4), s 13(6)). Failure to comply with these duties is a strict liability offence and may attract 50 penalty units (see s 11(3), s 12(4), s 13(2), s 13(6)).

AMSA and issuing bodies: AMSA is the competent authority for Australia and the Administration for regulated Australian vessels (s 5(2)-(3)). AMSA has discretion to approve or refuse applications for Certificates of Approval for transport arrangements referred to in the IMSBC Code (s 9). AMSA must be satisfied an arrangement is safe to approve it in writing (s 9(2)). AMSA may approve equivalents, but only if satisfied the equivalent is at least as effective as the requirement to which it is an alternative and does not contravene SOLAS/IMSBC (s 8). AMSA is also the recipient of statutory notices from shippers (s 16) and masters (s 17), and is the body that assesses cargo not listed in Appendix 1 of the IMSBC Code (s 19(1)(b)). Issuing bodies may approve that a regulated Australian cargo vessel is specially fitted or constructed under IMSBC section 7.3.2 (s 10). The Order also points to fees that may be prescribed under the Australian Maritime Safety Authority Act 1990 for processing applications under s 9 and s 10 (notes to s 9(1) and s 10(1)).

Inspectors: Inspectors act as the on-the-spot enforcement arm, entitled to request documents carried under s 11(2), to receive notices under s 16 availability and s 17 fumigation notices, and under s 20 to serve written notices requiring cessation of activity or imposition of precautions if loading/unloading may damage the vessel, persons or the environment. The Order refers to AMSA’s detention power under s 248 of the Navigation Act in a note to s 11(3).

Who ultimately “pays”: The compliance costs fall primarily on shippers (testing, notices, paperwork, AMSA applications) and terminal operators (procedural compliance, plan keeping, on‑site corrective action), while masters and shipowners bear operational risk, documentary burdens and potential civil/penalty exposure, including the operational cost of suspending or delaying operations. AMSA (and issuing bodies) bears administrative costs in assessing applications and conducting inspections; the Order reflects that some of those costs may be recovered by fees determined under AMSA’s enabling statute (notes to s 9(1) and s 10(1)). Enforcement outcomes such as detention or suspension create downstream costs for cargo owners, charterers and insurers.

Foreign vessels and international interplay: The Order applies to foreign vessels (s 6(b)). For foreign vessels, the Administration is the flag State’s administration (s 5(3)(b)) and the competent authority is under the flag State law (s 5(2)(b)). However, AMSA retains port State enforcement capability (including detention note at s 11(3) referencing Navigation Act), and foreign vessel masters and operators calling at Australian ports must comply with the notice, plan, documentary and operational duties described in the Order when in Australian ports.

Concentrated versus diffuse impacts: The Order’s approval and exemption processes concentrate discretion in AMSA and issuing bodies, which benefits applicants who secure approvals or exemptions. Costs and routine compliance burdens (sampling, notice timeframes, plan-keeping) are distributed across all shippers, vessel operators and terminal operators who engage in solid bulk trade in Australia.

This section lists the key operational duties and statutory rights allocated by the Order and ties each to the source provisions.

Duties to comply with international instruments and Order (s 11(1)): Every party involved in loading, trimming, carrying and unloading solid bulk cargo must comply with Parts A and B of Chapter VI of SOLAS, regulation 7-3 of Chapter VII of SOLAS if the cargo is dangerous goods in solid form in bulk, the IMSBC Code, the BLU Code and this Order including Schedule 1. This is the primary substantive duty that frames downstream documentary, procedural and operational obligations.

Documentary duties , masters (s 11(2)): The master must ensure that documents necessary to demonstrate compliance with s 11(1) are carried on the vessel and produced to an inspector on request. This is a strict liability offence and attracts a 50 penalty unit penalty. The duty is framed as an on-board record-keeping and evidence obligation.

Terminal operator/terminal representative duties (s 11(3), s 12(4), s 13(2), s 13(6)): Terminal actors may allow loading/unloading only if operations will comply with the SOLAS/IMSBC/BLU/Order suite, must keep loading/unloading plans and amendments for six months and make them available to the inspector, must ensure operations within their area of responsibility are conducted in accordance with the plan, and must ensure corrective action is taken where the master suspends operations because a plan limit is exceeded (s 11(3), s 12(4), s 13(2), s 13(4), s 13(6)). These duties are enforced via strict liability offences and 50 penalty unit civil penalties.

Loading and unloading plan duties , master and terminal representative (s 12(1)-(4), s 13(1)-(6)): The master and terminal representative must agree a BLU Code-compliant plan for loading and unloading (s 12(1)-(2)). The plan must be lodged with the terminal representative and a copy kept on board throughout the voyage (s 12(3)). Operations must be carried out in accordance with the plan, and both master and terminal representative have specific obligations to suspend and take corrective action where plan limits are exceeded (s 13(3)-(6)). Failure to comply is a strict liability offence and a civil penalty may apply.

Notice duties , shippers (s 16): For Group A, Group B or Group A and B cargo, a shipper must give AMSA an inspector a signed notice at least 48 hours before starting to load at an Australian port containing specified information (vessel name and IMO number, port and berth, cargo information per IMSBC s 4.2) (s 16(1)). The inspector may allow a later notice (s 16(2)). Shippers may give consolidated lists for a week or fortnight (s 16(3)-(4)) but must update the list under s 16(5). The shipper must give a copy of the notice to the master (s 16(7)). The master may accept loading of Group A/B only if he or she has received the copy of the notice (s 16(8)). Failures to comply are strict liability offences and attract civil penalties (s 16(9)-(10)).

Fumigation notice (s 17): If the master intends to arrange for fumigation of cargo holds when in port, the master must give AMSA specified vessel/agent/fumigator details and berthing/departure times within 72 hours before arriving (s 17). A form is available on AMSA’s website as noted.

Information to master , shippers (s 18): The shipper must give the information in IMSBC s 4.2 to the master or owner before the start of loading (s 18(1)). The master/owner may allow loading only if the information has been received (s 18(2)). Dangerous goods in solid form in bulk require the list or manifest in IMSBC s 4.8.1 (s 18(3)). Where IMSBC s 4.3 requires sampling/testing, the shipper must arrange it and provide any required certificate to the master (s 18(4)). The shipper must also give a statement confirming, to the best of the shipper’s knowledge, that the cargo’s chemical characteristics are those present when loaded (s 18(5)). Many of these are strict liability offences (s 18(6)-(7)).

Unlisted cargo assessment and AMSA assessment rights/duties (s 19): For cargo not listed in IMSBC Appendix 1, the shipper must give information in accordance with IMSBC s 4 to AMSA and ensure AMSA has assessed the cargo in accordance with IMSBC s 1.3 (s 19(1)). The master may load such cargo only if the shipper has given the master both the information and AMSA’s assessment (s 19(2)). If AMSA assesses the cargo as Group A/B or A and B, the master must give a notice of intention to load per s 16 (s 19(5)). Failures attract strict liability and civil-penalty exposure (s 19(3)-(4)).

Group A cargo moisture control obligations and approvals (s 14): Group A cargoes that may liquefy carry additional duties. The master or owner may allow Group A cargo to be loaded only if AMSA has given the shipper an approval under s 9(2) for the sampling, testing and moisture-control procedure and the shipper has given a copy of the approval to the master (s 14(1)). The master must not take a vessel to sea with Group A cargo having moisture content above the transportable moisture limit as defined in the IMSBC Code (s 14(2)). AMSA approvals are to be judged against safety and may have regard to IMO Circular MSC.1/Circ.1454 guidelines, per the note to s 14.

Right to apply for equivalents and exemptions (s 7-8): Individuals and entities may apply under the Marine Order 1 application process for exemptions from paragraph 11(1)(c) (s 7(1)) or for approval to use an equivalent (s 8(1)). Exemptions are granted only where AMSA is satisfied compliance would be unreasonable or impracticable and that the exemption would not contravene SOLAS or the IMSBC Code; exemptions are conditional and must be kept on board for the voyage (s 7(2)-(6)). AMSA may approve equivalents only if satisfied the alternative is at least as effective and does not contravene SOLAS/IMSBC (s 8(2)).

Inspector powers and right to serve precautionary notices (s 20): If an inspector reasonably believes an activity or failure during loading, stowage, carriage or unloading may damage the vessel, risk persons’ safety or damage the environment, the inspector may give a written notice requiring cessation or specific precautions (s 20(1)-(2)). Persons served must ensure compliance to the extent the notice relates to matters under their control (s 20(3)). This provision operationalises AMSA’s on-scene authority to manage acute risks.

Reporting of marine incidents (s 21): The Order prescribes that loss or likely loss overboard of dangerous goods in solid form in bulk is a prescribed marine incident for the Navigation Act definition of marine incident (s 21). The note reminds dutyholders of reporting duties under sections 185-186 of the Navigation Act and of required forms and periods under Marine Order 1.

Enforcement consequences: The Order makes many contraventions strict-liability offences and separately exposes contraveners to civil penalties, commonly stated as 50 penalty units (for many specified contraventions, e.g. ss 7(4), 7(6), 11(2)-(3), 12(1)-(4), 13(1)-(2), 14(2), 15(2)-(4), 16(8)-(10), 18(6)-(7), 19(3)-(4)). The Order also notes AMSA may detain a vessel where there is reasonable suspicion of contravention (note to s 11(3), citing Navigation Act s 248).

Rights to fees and charging: The Order notes that fees may be determined under the Australian Maritime Safety Authority Act 1990 for processing certain applications (s 9(1) note; s 10(1) note). This creates a potential cost-recouping right for AMSA to charge for processing approvals.

Collectively these duties and rights create a procedural and substantive compliance regime: shippers and terminal operators/representatives must provide information and adhere to plans, masters must ensure operational compliance and have the limited right under the Order to suspend loading/unloading to protect the vessel and persons, AMSA has investigatory, approval and enforcement functions including the power to issue or refuse approvals, exemptions and equivalents and to receive statutory notices, and inspectors have immediate corrective powers. The rights to apply for exemptions and equivalents give commercial actors limited pathways to alternate compliance where AMSA is satisfied the alternative is at least as effective.

The Order devises a layered enforcement regime built on strict liability offences, civil penalties, inspector powers, detention power reference and administrative approvals. Enforcement language is consistent: many contraventions are designated strict liability offences and attract civil penalties set at 50 penalty units where specified.

Strict liability and civil penalties: The Order repeatedly designates breaches as strict liability offences (for example, ss 7(7), 11(4), 12(5), 13(8), 14(4), 15(3), 16(9), 18(6), 19(3)). For a number of these contraventions, the instrument separately identifies civil penalty liability with a civil penalty of 50 penalty units (for example, ss 7(8), 11(5), 12(6), 13(9), 14(5), 15(4), 16(10), 18(7), 19(4)). The repeated use of strict liability means regulatory enforcement is predicated on absence of the need to prove fault; the actor’s liability will be engaged by proof of the prohibited act and the statutory elements, subject to any available statutory defences or mitigations not set out in the Order.

Range and examples of contraventions attracting penalties: The Order sets the 50 penalty unit figure as the civil-penalty measure for a broad range of contraventions, including failures to carry required documents (s 11(2)), permitting loading/unloading otherwise than in accordance with the SOLAS/IMSBC/BLU/Order suite (s 11(3)), failure to agree or comply with BLU Code-compliant loading/unloading plans (ss 12-13), sailing with Group A cargo over the transportable moisture limit (s 14(2)), not keeping the Medical First-Aid Guide (s 15(2)), failure to give required notices of intention to load (s 16(8)), and failure to provide required information to the master (s 18(1), s 18(3)). Exemption applicants who do not comply with conditions on their exemption are also subject to a 50 penalty unit sanction and strict liability for some breaches (s 7(4)-(7)).

Inspector powers and immediate enforcement: Section 20 empowers an inspector to give a written notice requiring cessation of activity or requiring specified precautions where the inspector reasonably believes that an activity or failure during loading/unloading, stowage or carriage may damage the vessel, pose a safety risk to persons, or damage the environment. The recipient must ensure compliance with the notice to the extent it relates to matters under their control (s 20(2)-(3)). This provision establishes an on-scene enforcement instrument for immediate risk mitigation.

Detention and Navigation Act interaction: The Order notes (in a note to s 11(3)) that AMSA may detain a vessel if it reasonably suspects the vessel has been, is, or will be involved in a contravention of the Order, including outside Australia, and that detention for foreign vessels applies only in specified places, citing s 248 of the Navigation Act. The Order itself does not restate the detention regime but flags its availability and cross-references the Navigation Act.

Administrative review and application processes: While the Order grants AMSA and issuing bodies discretion to grant approvals, equivalents and exemptions (ss 7-10), it also requires that those processes be carried out in accordance with Marine Order 1 (Administration) 2013 application processes, and notes Marine Order 1 deals with making applications, seeking further information, time allowed for consideration, conditions on approvals, notification and review of decisions. Those procedural references indicate a statutory pathway for applicants to seek administrative review or to have decision-making processes follow prescribed procedural steps.

Operational enforcement consequences: The combination of documentary requirements (masters must carry documents and make them available on demand, s 11(2)), the mandatory nature of loading/unloading plans and agreements (s 12-13), the sampling/testing/AMSA approval gate for Group A (s 14) and the inspector’s immediate powers (s 20) creates multiple enforcement touchpoints where non‑compliance can lead to civil penalty liability, immediate operational disruption (suspension, corrective action), or potential detention under the Navigation Act.

Penalty-unit quantum and statutory context: The Order consistently refers to penalty units rather than dollar amounts. The value of a penalty unit is not set in the Order; the Order’s penalties are therefore to be read against the statutory definition of a penalty unit in the relevant Commonwealth instruments, which is outside the text provided. The notes also indicate that fees may be payable to AMSA under the Australian Maritime Safety Authority Act 1990 for processing applications (notes to ss 9(1) and 10(1)), meaning actors seeking approvals can expect administrative charges in addition to exposure to civil penalties and operational disruption.

Reporting obligations and prescribed marine incidents (s 21): The Order prescribes loss or likely loss overboard of dangerous goods in solid form in bulk as a prescribed marine incident for the Navigation Act definition (s 21). The note reminds owners and masters of reporting obligations under Navigation Act ss 185 and 186 and that Marine Order 1 prescribes forms and periods. Failure to report may therefore attract Navigation Act enforcement consequences in addition to any Order-based penalties.

Incentives and enforcement profile: The enforcement architecture emphasises documentary compliance, procedural pre-clearance (AMSA approvals and assessments), and immediate corrective powers for inspectors. The statutory use of strict liability and civil penalties accelerates enforcement outcomes and places a compliance-onus on regulated actors to maintain documentary and operational evidence of compliance. Inspectors have a low-threshold tool in s 20 for operational risk control, and the linkage to the Navigation Act detention power creates a high-cost enforcement lever for more serious or suspected contraventions.

The Order is explicitly constructed to give effect to international instruments and to interact with the Navigation Act and other Marine Orders and statutes. The Order cross‑references and depends on these instruments for definitions, duties, administrative processes, fees, enforcement powers and reporting obligations.

SOLAS, IMSBC Code, BLU Code and IMDG Code supplement: Section 2 states the Order gives effect to Parts A and B of Chapter VI of SOLAS, the IMSBC Code, Part A-1 of Chapter VII of SOLAS for dangerous goods in solid form in bulk and the BLU Code. Section 11(1) requires that loading, trimming, carriage and unloading be carried out in accordance with SOLAS, the IMSBC Code, the BLU Code and the Order itself. Section 15(2) specifically requires the master of a regulated Australian vessel carrying cargo mentioned in IMSBC Appendix 1, cargo assessed under s 19, or dangerous solids in bulk to keep on board the current supplement to the IMDG Code that includes the Medical First-Aid Guide. The Order therefore operates as a domestic implementation mechanism for the technical requirements and definitions contained in those international instruments.

Navigation Act interaction: The Navigation Act is the enabling statute under which Marine Orders are made. Section 3 of the Order identifies specific Navigation Act provisions authorising the Order (ss 112(4)-(6), 119(1), 340(1)(a), 341(1), 339(1), 342(1) of the Navigation Act). The Order also cross-references Navigation Act enforcement powers: the note to s 11(3) cites section 248 of the Navigation Act as the source of AMSA’s detention power, and s 21 prescribes a class of marine incidents for the Navigation Act definition of marine incident (which triggers reporting duties under Navigation Act ss 185-186 as noted). Marine Order 1 is cited repeatedly for administrative procedures and for forms/times relating to reporting.

Marine Order 1 (Administration) 2013: Several operational processes mandated in this Order are to be carried out “in accordance with the application process set out in Marine Order 1 (Administration) 2013” (see ss 7(1), 8(1), 9(1), 10(3)). Marine Order 1 is therefore the procedural companion instrument governing how applications for exemptions/equivalents and approvals are to be lodged, processed, notified and reviewed. The Order’s notes explicitly point readers to Marine Order 1 for matters including making applications, seeking further information, timing, imposing conditions, notification of decisions and review of decisions.

Australian Maritime Safety Authority Act 1990: The Order notes (in s 9(1) and s 10(1) notes) that fees may be determined for processing certain applications under that Act, indicating AMSA’s enabling statute authorises cost recovery through fees for processing approvals and likely other administrative functions.

IMSBC/IMO circulars and voluntary application dates: Section 5(4) provides that a person is taken to comply with the IMSBC Code if the person complies with the Code as amended for dates of voluntary application of amendments. The explanatory note states Australia, as a SOLAS Contracting Government, gives effect to the date for voluntary application. This creates a specific interaction with IMO amendment timetables: parties operating in Australian jurisdiction must be attentive to amendment dates that Australia elects to implement earlier than the mandatory effective date.

IMDG Code and WHO/ILO materials: Section 15(2) requires the Medical First-Aid Guide for use in accidents involving dangerous goods be kept on board. The Order’s note clarifies the Guide is published jointly by the IMO, WHO and ILO and is also known as the Chemicals supplement to the international medical guide for ships.

Domestic detention, reporting and enforcement frameworks: The Order does not itself recreate AMSA’s detention, report or enforcement frameworks but references the Navigation Act and Marine Order 1 for their operation. Detention authority (Navigation Act s 248), marine incident reporting obligations (Navigation Act ss 185-186) and forms (Marine Order 1) are all interaction points that operationalise enforcement and reporting beyond the text of this Order. The Order’s reference to these instruments means actors must manage obligations arising under multiple overlapping legal instruments in practice.

Flag State and port State interaction: The Order defines “competent authority” and “Administration” to mean AMSA for Australia and the relevant national authority for foreign countries (s 5(2)-(3)). For regulated Australian vessels, AMSA is the Administration; for foreign vessels, the vessel’s flag State administration is the Administration. The Order applies to both regulated Australian and foreign vessels (s 6), which positions AMSA’s domestic rules within the international framework: foreign-flagged vessels must comply when in Australian ports, and AMSA retains port State enforcement powers including detention (note to s 11(3)). This interaction creates parallel obligations for flag States (administration) and AMSA as port State.

Interaction with technical IMSBC and BLU obligations: The Order delegates technical compliance (for example, sampling/testing, classification, transportable moisture limit measurement for Group A cargo) to the procedures and definitions in the IMSBC Code and relevant IMO circulars. AMSA’s approvals under s 9 may take into account IMO guidance (note to s 14 referencing MSC.1/Circ.1454). Thus technical obligations are anchored in international documents and the Order provides the domestic compliance and enforcement interface.

Administrative charging and fee recovery: The notes to ss 9(1) and 10(1) identify fees may be determined under the Australian Maritime Safety Authority Act 1990 for processing applications. This creates an interaction between the Order’s administrative approvals and AMSA’s statutory fee-setting power.

Together, these cross-references and interactions show the Order is not a free-standing code but an implementation instrument that ties into a network of international rules (SOLAS, IMSBC, BLU, IMDG materials) and domestic statutory frameworks (Navigation Act, AMSA Act, Marine Order 1). Operators must therefore coordinate compliance across multiple instruments and administrative processes.

The compilation includes a short amendment and commencement history embedded in the document’s front matter and notes. The Order appears as a 2016 Marine Order with a subsequent Administrative Amendment in 2017. The compilation particulars in the front matter state:

• Marine Order 34 (Solid bulk cargoes) 2016 (MO 2016/17) was registered on 7 December 2016 (FRLI F2016L01886) and commenced on 1 January 2017.
• Marine Orders (Navigation Act) Administrative Amendment Order 2017 (MO 2017/5) was registered on 10 October 2017 (FRLI F2017L01336) and commenced on 11 October 2017.

The compilation date is listed as 11 October 2017 and the document was prepared on 13 October 2017, “taking into account amendments up to Marine Orders (Navigation Act) Administrative Amendment Order 2017.”

The internal Table of Amendments included in the compilation contains entries indicating that provisions 1A and 1B were repealed by the Legislation Act 2003 (s 48D and s 48C respectively). Those two repeals are noted in the table without further contextual detail in the compilation. The Table of Amendments also notes that item 21 was amended by 2017/5, which corresponds to s 21 (the marine incidents provision) being amended by MO 2017/5.

The notes to Schedule 1 and the Order's front matter also confirm that the consolidation reproduces the BLU Code and supplementary material and that material such as IMO resolutions and documents should be obtained from AMSA’s Marine Orders webpage. The notes repeatedly reference Marine Order 1 (Administration) 2013 as the procedural companion instrument for application processes (for equivalents, exemptions, approvals), implicating Marine Order 1 as a stable procedural anchor for any subsequent amendments that affect application processes.

No other amendment history is included in the text provided. The compilation’s “Notes to Marine Order 34 (Solid bulk cargoes) 2016” include a Table of Orders and a Table of Amendments that record the 2016 instrument and the 2017 Administrative Amendment Order, and identify the specific technical amendment to s 21 in 2017. The compilation also includes an HTML table excerpt showing the amendment entries and their short-form descriptors.

Given the limited amendment entries in this compilation, practitioners should treat the instrument as originally commenced 1 January 2017 and amended administratively on 11 October 2017 as recorded, with specific attention to the amendment that affected s 21. The front matter also indicates the compilation will be updated to reflect future amendments, and the Order’s frequent notes point readers to AMSA’s Marine Orders web pages for up-to-date versions of IMO instruments referenced by the Order.

For legal practice, this history means:

• the primary operational start date for obligations was 1 January 2017 for MO 2016/17;
• an administrative amendment in October 2017 changed at least the marine-incident prescription in s 21;
• prior or subsequent amendments (if any) beyond 11 October 2017 are not reflected in the provided compilation and must be verified against AMSA’s consolidated Marine Orders or Commonwealth legislation registers for up-to-date compliance obligations.

The compilation’s inclusion of repeal entries referencing the Legislation Act 2003 indicates minor structural or housekeeping changes, but the text provided does not supply the pre-amendment wording of the repealed provisions or the practical effect beyond the narrow entries noted.

The text provided does not cite any judicial decisions, authority opinions, tribunal determinations or administrative appeal outcomes concerning Marine Order 34. There are no reported cases, no statutory interpretation disputes included, and no direct references in the Order to litigation outcomes or precedential administrative rulings. The compilation is an administrative enactment with cross-references to international instruments and domestic procedural instruments, but the instrument itself does not record litigation.

Implications of this absence for practitioners:

• The absence of litigation in the source means there is no statutory interpretive guidance embedded in the Order text; practitioners will need to rely on the plain wording of the Order, the international texts it incorporates (SOLAS, IMSBC, BLU), and any AMSA administrative guidance or determinations referenced in Marine Order 1 or on AMSA’s website.
• Where the Order references discretionary processes (for example, AMSA’s approval power in s 9 and the granting of exemptions under s 7 on a satisfaction test), the lack of recorded administrative decision outcomes in the document means the margin of agency discretion and its exercise will be principally shaped by AMSA’s internal application of Marine Order 1 procedures, any guidance AMSA publishes, and any future judicial or tribunal scrutiny not captured here.
• The Order’s designation of many contraventions as strict liability suggests that challenges to enforcement actions may focus on procedural fairness, jurisdictional errors, or whether specified elements of contraventions (for example, whether required information was indeed given, or whether a plan complied with the BLU Code) are present. In the absence of precedents in the text, administrative appeals or judicial review would likely rely on general administrative law principles and statutory construction of the Order’s terms.
• The Order repeatedly points users to Marine Order 1 for application, review and decision procedures. If disputes arise from AMSA decisions under s 7, s 8, s 9 or s 10 (exemptions, equivalents, certificates of approval, issuing-body approvals), the review and appeals mechanisms described in Marine Order 1 (which the Order does not itself reproduce) will be the immediate route for contesting administrative decisions. Practitioners should therefore consult Marine Order 1 and AMSA’s published processes for more detail on internal review and merits review pathways.

In short, the compiled instrument contains no litigation history. That absence increases the importance of monitoring AMSA administrative decisions, published guidance, and future judicial or tribunal decisions that will interpret and apply the Order in disputes over approvals, exemptions, inspection actions and enforcement penalties.

The Order contains several operational and legal features that may not be obvious on first reading and that carry practical compliance risks. These “gotchas” arise from cross-references, strict liability framing, timing windows, and the need to align with technical international standards.

Strict liability architecture: Numerous contraventions are strict liability offences (for example, s 7(7) , exemption condition non‑compliance; s 11(4) , failure to carry documents; s 12(5) , failure to agree a BLU Code-compliant plan; s 13(8) , failure to ensure operations comply with the plan; s 14(4) , Group A moisture limit contravention; s 18(6) , failing to give information to the master). Strict liability removes the need for prosecutors to prove mens rea and therefore increases compliance risk for shippers, terminal operators and masters. The practical implication is that documentary, procedural and record-keeping discipline is essential: absence of records is unlikely to insulate an actor from liability.

Civil penalties set to penalty units: The Order commonly specifies civil penalties as “50 penalty units” rather than dollar amounts. Because the dollar value of a penalty unit is not in the text, parties must check the current statutory value of a penalty unit to quantify exposure. The use of penalty units means liability will change with statutory adjustments to the penalty unit.

AMSA approvals, fee recovery and administrative delay risk: AMSA may require an approval under s 9 for transport arrangements and may charge fees under the AMSA Act (s 9(1) note). For Group A cargo, AMSA approval of the shipper’s sampling/testing/moisture-control procedure is required (s 14(1)(a)). These approval gates create potential delay risk. The Order allows an inspector to permit later notice for s 16(1) (s 16(2)), but otherwise the 48-hour and 72-hour notice obligations (s 16 and s 17) are firm; failure to meet them can attract penalties. Delays in AMSA processing or in arranging required sampling/testing/certification could therefore disrupt operations.

Voluntary application dates for IMSBC amendments: Section 5(4) and the associated note state a person is taken to comply with the IMSBC Code if they comply with the Code as amended for dates of voluntary application, and Australia gives effect to the date for voluntary application. Practically, this means that entities operating in Australia must monitor not only mandatory amendment dates but also IMO voluntary application dates, and must adopt amendments at AMSA-adopted voluntary application times , this creates timing complexity and an obligation to track international circulars and AMSA guidance.

Record-keeping for plans and approvals: The master must keep a copy of the loading/unloading plan on board for the voyage (s 12(3)) and the terminal representative must keep the plan and any amendments for at least six months and make them available to the inspector at the AMSA office at or nearest to the port of loading or unloading on request (s 12(4)). Exemptions, when granted, must have a copy kept on board for the duration of each voyage to which the exemption applies (s 7(6)). Failure to keep these records is a strict liability offence (s 7(6), s 12(5)). In practice, this means vessel masters, ship operators and terminal representatives must have robust document control procedures to ensure compliance upon inspection.

Group A carriage strict moisture prohibition vs vessel-level approval exception: For Group A cargo that may liquefy, two separate approval pathways exist. The shipper must have an AMSA approval for the sampling/testing/moisture-control procedure (s 14(1)), unless there is on board a copy of an approval mentioned in s 10(4), i.e., an issuing-body approval that the vessel is specially fitted or constructed per IMSBC section 7.3.2 (s 14(3)). Practically, the presence of a vessel-level issuing-body approval can relieve the shipper-level approval requirement for a particular voyage, but obtaining vessel-level issuing-body approvals has its own application and documentary requirements (s 10(1)-(4), referencing IMSBC s 7.3.2.4). Shippers and owners must coordinate approvals to avoid a regulatory gap.

Master’s power and obligation to suspend vs business interruption costs: Section 13(3) gives the master the power to suspend loading/unloading if a plan limit is exceeded or likely to be exceeded, and s 13(4)-(6) requires corrective action prior to resuming. The master must notify the inspector in Australia (s 13(7)(a)). This creates an operational authority for safety but also can cause immediate commercial interruption, demurrage, or cascading contractual consequences, which the Order contemplates as a safety instrument but does not mitigate commercially.

Unlisted cargo process and AMSA assessment timing: Cargo not listed in IMSBC Appendix 1 requires shipper-provided information to AMSA and an AMSA assessment under IMSBC s 1.3 before loading (s 19(1)). The master may only load such cargo if the shipper has provided the master with both the information and AMSA’s assessment (s 19(2)). The practical risk is that AMSA assessment timelines could delay loading unless handled in sufficient lead time.

Inspector notices and scope of “control”: An inspector may require precautions or cessation and the person served must ensure compliance “to the extent that it relates to any matter over which the person has control” (s 20(3)). Ambiguity can arise where multiple parties share responsibility , for example, terminal operators, stevedores and the vessel may each contest the scope of “control.” Operational plans and contractual arrangements should therefore clarify control boundaries in advance.

Schedule 1 specific commodity requirements: Schedule 1 imposes extra, sometimes technical requirements for listed materials (e.g., ammonium nitrate fertiliser, LSA materials, seedcake, scrap metal). These requirements can trigger additional inspections, chemist certifications or exclusive use of cargo spaces, each of which involves time and cost. For example, UN 2067 shipment is subject to approval after inspection of condition and cleanliness of the intended cargo space, implying a pre-loading inspection regime.

Interaction with Marine Order 1 for application and review processes: The Order repeatedly directs applicants and regulated entities to Marine Order 1 for application processes, timeframes and review procedures (ss 7-10). A practical “gotcha” is assuming that the Order’s substantive obligations are self-contained; in reality, the procedures, review windows and forms are governed by Marine Order 1 and AMSA practice.

Penalties and dollar value variability: Because penalties are stated in penalty units and fee rules are in the AMSA Act, affected parties must check the current statutory penalty unit amount and AMSA’s published fees to quantify risk and transactional costs. Failure to do so can produce inaccurate commercial risk assessments.

In sum, compliance risk under this Order is concentrated in documentary discipline, advance administrative approvals and timely notice processes, and in ensuring technical sampling/testing and plan-compliance obligations aligned to the international technical instruments the Order incorporates.

Below is a practical compliance checklist linked to the Order’s specific provisions, organised by actor and task. Each bullet points to the operative section(s) that impose the duty.

Shippers , pre-loading and information duties:

• For any cargo identified as Group A, Group B or Group A and B, provide AMSA with a signed notice at least 48 hours before starting to load at an Australian port, including vessel name and IMO number, port and berth of loading, and the cargo information prescribed by IMSBC s 4.2 (s 16(1)). If circumstances require later notice, seek the inspector’s permission (s 16(2)).
• Give the master a copy of the AMSA notice when giving the notice to AMSA (s 16(7)); do not allow loading without the master having received the notice (s 16(8)).
• Before the start of loading, provide the information required by IMSBC s 4.2 to the master or owner in writing (s 18(1)); for dangerous goods in solid form in bulk, also provide the list or manifest required by IMSBC s 4.8.1 (s 18(3)).
• If IMSBC s 4.3 requires sampling and testing, arrange for the sampling and testing and provide certificates to the master as required (s 18(4)). For Group A cargo, obtain AMSA approval for the sampling/testing/moisture-control procedure under s 9(2) and give a copy of that approval to the master (s 14(1)(a)-(b)). Unless the vessel has the issuing-body approval under s 10(4), in which case s 14(3) provides an exception.
• For cargo not listed in IMSBC Appendix 1, provide information in accordance with IMSBC s 4 to AMSA and ensure AMSA conducts an assessment under IMSBC s 1.3 before loading (s 19(1)). Provide the master with both the information and AMSA’s assessment before loading (s 19(2)). If AMSA assesses the cargo as Group A/B, the master must give a notice of intention to load per s 16 (s 19(5)).
• For fumigation planned in port, if arranging fumigation, ensure the master provides AMSA with the specified fumigation notice details within 72 hours before arriving in the port (s 17). Use AMSA’s form as available on the AMSA website (note to s 17).

Masters and owners , operational and documentary duties:

• Carry and be prepared to produce on request documents that demonstrate compliance with the suite in s 11(1) (SOLAS, IMSBC, BLU, this Order including Schedule 1) (s 11(2)). Maintain an on-board document control system to retain plans, approvals, certificates and test results.
• Agree, before loading, a BLU Code-compliant loading plan with the terminal representative and ensure the plan is lodged with the terminal representative and a copy kept on board throughout the voyage (s 12(1)-(3)). Keep copies of AMSA approvals, issuing-body approvals, exemption instruments and certificates related to the cargo aboard as required by s 7(6) and s 14(3).
• Ensure loading/unloading operations under the master’s area of responsibility are conducted in accordance with the plan; where a plan limit is exceeded or likely to be exceeded, suspend operations and notify the inspector (s 13(1), s 13(3)). Ensure corrective actions are taken before resuming and coordinate with the terminal representative (s 13(4)-(6)).
• Do not take the vessel to sea with Group A cargo on board that has a moisture content higher than the IMSBC transportable moisture limit (s 14(2)). Maintain test certificates and AMSA/issuing-body approvals on board and ensure shore-side sampling/testing data is referenced prior to departure.
• For regulated Australian vessels carrying IMSBC-listed cargo, cargo assessed under s 19, or dangerous solid bulk goods, keep on board at all times the current supplement to the IMDG Code that includes the Medical First-Aid Guide (s 15(1)-(2)). Ensure crew know where this is located and how to use it in an emergency.
• If fumigation is to be carried out while in port, ensure the master gives the fumigation notice to AMSA within the 72‑hour window before arrival into port and keeps copies of contact details for the fumigator and agent (s 17).

Terminal operators and terminal representatives , shore-side compliance:

• Do not allow loading, trimming, carriage or unloading unless such operations will be in accordance with SOLAS, IMSBC Code, BLU Code and this Order including Schedule 1 (s 11(3)). Maintain compliance checklists tied to the IMSBC and BLU Code requirements to review shipper documents and master confirmations prior to allowing operations.
• Keep loading/unloading plans and any amendments for at least six months and make them available to the inspector at the AMSA office at or nearest to the port on request (s 12(4)). Implement a secure records retention policy and a retrieval protocol for inspection requests.
• Ensure that operations within the terminal representative’s area of responsibility are conducted in accordance with the agreed plan and that corrective action is taken where plan limits are exceeded (s 13(2), s 13(4)-(6)).
• Coordinate with shippers and masters on timing for AMSA approvals and ensure that documentation is checked and copied for port-side records before allowing cargo operations to proceed.

Shipper/master/owner coordination on Group A cargo:

• Create a documented chain of custody and testing regime to ensure moisture measurements are traceable to recognized laboratory standards and consistent with IMSBC sampling/testing methods. For Group A cargo, secure AMSA approval of the shipper’s procedure under s 9(2) or ensure the vessel has a valid issuing-body approval under s 10(4) if relying on vessel-level approval (s 14(1)-(3)).
• Maintain copies of approvals and certificates on board and as part of the cargo manifest provided to the master and to AMSA where required (s 9, s 14, s 18).

Applications, equivalents and exemptions:

• If seeking an exemption from paragraph 11(1)(c) or approval to use an equivalent, apply under the Marine Order 1 processes referenced in ss 7(1) and 8(1). Prepare to demonstrate that compliance with the relevant requirement would be unreasonable or impracticable for exemptions (s 7(2)(a)) and that use of an equivalent would be at least as effective for equivalents (s 8(2)(a)). Expect conditions and ensure any conditions on exemptions/approvals can be complied with and that copies of approvals are carried where required (s 7(3)-(6), s 8).
• For vessel-level approvals under s 10, prepare the required information mentioned in IMSBC s 7.3.2.4 and lodge applications in accordance with the Marine Order 1 application processes; fees may be payable under the AMSA Act (note to s 10(1)).

Records and retention:

• Maintain, aboard and on shore, a records register for each voyage containing: AMSA notices, AMSA approvals, issuing-body approvals, sampling/testing certificates, the BLU-compliant loading/unloading plan and any amendments, fumigation notices, shipper statements under s 18(5), and Schedule 1 compliance documents. Ensure the terminal representative keeps a local copy of each plan for at least six months (s 12(4)).

Inspector interactions and immediate compliance:

• Train masters, ship’s officers and terminal staff on s 20 inspector notices and prepare an operational protocol to comply promptly with any inspection directive. Appoint responsible persons at the vessel and terminal capable of effecting corrective action where needed. Establish communication protocols with AMSA offices nearest ports to ensure timely notification if suspension is necessary (s 13(3)-(7), s 20).

Marine incident reporting:

• If loss or likely loss overboard of dangerous goods in solid form in bulk occurs, recognise that this is a prescribed marine incident for Navigation Act purposes (s 21) and report to AMSA as required under the Navigation Act ss 185-186 and Marine Order 1 forms and timeframes, ensure crew and shore agents know reporting procedures.

Monitor AMSA guidance and international amendments:

• Because the Order requires compliance with IMSBC/BLU and permits voluntary application of amendments on AMSA’s chosen date (s 5(4) and note), keep an active monitoring protocol for AMSA announcements, IMO circulars, IMSBC amendments and amendments to Marine Order 1. Incorporate a compliance calendar for voluntary and mandatory amendment dates and update operational procedures accordingly.

Insurance and contractual steps:

• Consider amending charterparty clauses and stevedoring/terminal contracts to allocate costs and liabilities arising from delays due to AMSA approvals, suspensions under s 13, detentions under the Navigation Act, and mandatory sampling/testing/certifications. Ensure commercial contracts require shippers and terminals to produce the documents the Order requires and to indemnify owners where appropriate.

Practical checklist summary (must-dos before loading a solid bulk cargo in Australia):

1. Identify cargo group per IMSBC Appendix 1 (or submit unlisted cargo info to AMSA per s 19).
2. For Group A/B, provide AMSA with the 48-hour notice required by s 16 and give the master a copy.
3. Ensure sampling and testing are done per IMSBC and that certificates are onboard the vessel (s 18(4)).
4. Agree and record a BLU-compliant loading/unloading plan between master and terminal rep; lodge with terminal rep and keep a copy aboard (s 12).
5. For Group A, ensure AMSA approval of shipper procedures under s 9(2) or hold a valid issuing‑body vessel approval under s 10(4) and ensure TML is not exceeded (s 14).
6. Retain and make available on demand the documents demonstrating compliance (s 11(2)), and ensure terminal rep retains plan copies for at least six months (s 12(4)).
7. If fumigation is planned, provide the 72‑hour notice to AMSA with the prescribed detail (s 17).
8. Ensure the Medical First-Aid Guide is aboard if IMSBC-listed cargo or dangerous solids are carried (s 15).
9. Be prepared to suspend operations and notify inspectors if plan limits are exceeded (s 13(3)-(7)).
10. Keep a chain-of-custody and document control system to prove compliance on inspection; non-compliance often attracts strict liability and a 50 penalty unit civil penalty (see many sections above).

Following these steps and codifying responsibilities contractually between shippers, owners, masters and terminal operators will reduce the practical risk of enforcement action under the Order.
