Marine Order 30 (Prevention of collisions) 2016

The Order organises around four core legal concepts: incorporation of the International Regulations, specification of required equipment standards, administrative approvals and exemptions, and dynamic adoption of IMO routeing instruments.

Incorporation of the International Regulations: Section 9(1) makes compliance with the International Regulations mandatory in the operation of a vessel. The Order defines “International Regulations” to mean the Rules and Annexes of the 1972 Convention as in force from time to time (s 4). The Order therefore imports the text of those international Rules into domestic operation without restating the Rules verbatim. The note to s 9(1) explicitly links this obligation to offences under the Navigation Act for contravening regulations made for s 176, signalling criminal enforcement will depend on the Navigation Act’s offence provisions (note to s 9(1)).

Equipment-performance standards and routeing documents: Section 9(2) requires lights and signals to be provided and used. Section 9(3) adds a conditional technical requirement: navigation lights, controllers and associated equipment installed after 30 November 2009 on three categories of vessels must meet performance standards at least equal to those in the Annex to IMO Resolution MSC.253(83). The three categories listed are a regulated Australian vessel, a domestic commercial vessel, and a recreational vessel that has Australian nationality (s 9(3)(a)-(c)). Sections 9(4)-(5) take the traffic separation schemes and inshore traffic zones designated in the latest edition of the IMO publication Ships’ Routeing to be the corresponding features for the International Regulations. The Order notes what the latest edition was as at commencement (2015), but the statutory text takes the latest edition “as in force from time to time” (s 9(4)-(5)).

Administrative approvals and exemptions: Section 8 allows applications to issuing bodies for two specific approvals mentioned in the International Regulations, namely paragraph 14 of Annex I and paragraph 3 of Annex III. The issuing body may give approvals only if satisfied about construction, performance and installation being in accordance with the International Regulations (s 8(2)-(3)). An issuing body may revoke such an approval if it is no longer satisfied (s 8(4)). Section 6 establishes a narrow exemption power: a person may apply to AMSA, in accordance with Marine Order 1 Division 3 procedures, for an exemption from a requirement of section 9 for the matters mentioned in paragraphs (c) or (h), or subparagraph (d)(i) of Rule 38 of the International Regulations. AMSA may grant an exemption only if it is satisfied that giving the exemption would not contravene the International Regulations (s 6(1)-(2)). The Order links the administrative flow to Marine Order 1 for procedural detail about applications, timeframes, conditions and review (note to s 6).

Dynamic incorporation and external documents: The Order repeatedly references external IMO instruments and explicitly treats those instruments as incorporated “as in force from time to time” (s 4 definition and ss 9(3)-(5)). The Order includes notes directing readers to the AMSA website for copies and delegation information (s 4 notes 3 and 4). For AMSA determinations under Rule 1(e), the Order directs AMSA to take into account a relevant IMO circular (MSC/Circ.1144) as guidance on applying Rule 1(e) and on the narrowness of exemptions (note to s 9(6)). This structure delegates interpretive and technical detail to external IMO materials and to AMSA’s application of them.

Backstop powers and linkage to Navigation Act: Section 3 cites the Navigation Act provisions that empower making this Marine Order, including the power to give effect to the Prevention of Collisions Convention and to prescribe matters necessary to carry out the Act. The Order therefore sits within the Navigation Act regulatory architecture and relies on that Act for offence and enforcement provisions, as indicated by the note to s 9(1).

In short, the main concepts are mandatory adoption of the International Regulations for applicable vessels, conditional technical obligations for certain lights and controllers, a narrow exemptions process and specific approvals administered by issuing bodies, and dynamic dependence on IMO standards and routeing publications.

The Order applies, by its own terms, to “each of the vessels mentioned in section 175 of the Navigation Act in the areas mentioned in section 175 for the vessel” (s 5(1)). The instrument therefore targets the population of vessels and areas that section 175 of the Navigation Act identifies, without restating their content in the text of this Order. Practically, owners and masters of those vessels are the immediate addressees of the principal obligations, because s 9(1) and the accompanying note make it clear that operating a vessel in contravention of the International Regulations connects to the Navigation Act offence regime for owner or master responsibility (s 9(1) and note).

Domestic categories specifically called out for equipment standards are regulated Australian vessels, domestic commercial vessels and recreational vessels having Australian nationality (s 9(3)). For those classes of vessels, navigation lights and associated equipment installed after 30 November 2009 must meet performance standards at least equal to the Annex to IMO Resolution MSC.253(83) (s 9(3)). That creates a distinct compliance obligation for owners of such Australian vessels who have installed new equipment since that date.

Foreign vessels are treated differently in two specific respects. Section 5(2) provides that sections 6 (exemptions) and 8 (approvals) do not apply to a foreign vessel. That means foreign-flag vessels are not eligible to apply to AMSA for the exemptions described in s 6 nor to an issuing body for the specific approvals in s 8 under this Order. The operative obligations in s 9(1)-(2) are framed as applying to vessels within the Order’s scope under s 5(1), and the text does not restate an explicit exemption from s 9 for foreign vessels, but ss 5(1) and 5(2) create a clear administrative boundary for the procedural privileges in ss 6 and 8.

Who decides and who pays: AMSA is the decision-maker for exemption applications under s 6 and for determinations under Rule 1(e) under s 9(6). Issuing bodies are decision-makers for approvals under s 8. Owners and masters bear the costs of compliance with the International Regulations and of providing and using required lights and signals (s 9(1)-(2); note to s 9(1)). Where approvals are required, owners or operators will need to secure issuing body approval and possibly demonstrate technical compliance to the issuing body’s satisfaction (s 8(2)-(3)). Where owners seek an exemption, they must apply to AMSA and meet both the application procedures set out in MO1 Division 3 and AMSA’s substantive test that an exemption would not contravene the International Regulations (s 6(1)-(2) and note).

Administrative review: The Order identifies certain decisions as reviewable under Marine Order 1 s 17: a decision not to give, or to revoke, an approval under s 8, and a determination made under s 9(6) (s 7). The Order’s note also states that a decision not to give an exemption under s 6 is a reviewable decision because it is mentioned in section 15 of the Order (note to s 7). That creates a defined administrative-review path for affected parties seeking to challenge particular AMSA or issuing body decisions.

Information and delegation links: The Order’s notes point readers to the AMSA website for obtaining copies of IMO documents mentioned and for information on delegation of AMSA’s powers (s 4 notes 3 and 4). These notes indicate that responsibilities for administering exemptions and determinations may be subject to AMSA delegations, which matters to those seeking to identify the exact decision-maker in practice.

In summary, the Order affects owners and masters of vessels within the scope described in Navigation Act s 175, with particular equipment standards applying to Australian regulated, domestic commercial and recreational vessels that have Australian nationality. AMSA and issuing bodies are the deciding authorities for exemptions, determinations and approvals. Foreign vessels are excluded from ss 6 and 8, and review mechanisms are channelled through Marine Order 1.

Key duties

• Observe the International Regulations: Operators must observe the measures required by the International Regulations in the navigation, management and working of a vessel (s 9(1)). The Order explicitly ties this duty to the International Regulations “as in force from time to time” (s 4 definition), so the duty tracks amendments to the international instrument.

• Provide and use required lights and signals: Owners or operators must provide and use the lights and signals required by the International Regulations (s 9(2)). That duty is separate from the equipment-performance obligation in s 9(3).

• Equipment performance standards for newer installations: Navigation lights, navigation light controllers and associated equipment installed after 30 November 2009 on (a) regulated Australian vessels, (b) domestic commercial vessels, and (c) recreational vessels with Australian nationality must conform to performance standards at least equal to those in the Annex to IMO Resolution MSC.253(83), as in force from time to time (s 9(3)). This imposes a contemporaneous technical benchmark for post-2009 installations for those vessel classes.

• Compliance with adopted routeing schemes: Traffic separation schemes and inshore traffic zones designated in the latest edition of the IMO publication Ships’ Routeing are taken to be the applicable traffic separation schemes and inshore traffic zones for the International Regulations (s 9(4)-(5)). Practically, masters and owners must comply with those routeing instruments insofar as they are part of the International Regulations’ operational framework.

• Apply for and secure approvals where required: Where the International Regulations call for an approval that is reflected in paragraph 14 of Annex I or paragraph 3 of Annex III, an applicant must apply to an issuing body and satisfy the issuing body that construction, performance and installation are in accordance with the International Regulations (s 8(1)-(3)).

Key rights and administrative entitlements

• Right to apply for exemptions (limited): A person may apply to AMSA for an exemption from a requirement of section 9 for the matters specifically listed in Rule 38 of the International Regulations (the Order identifies the relevant subparts as paragraphs (c) or (h) or subparagraph (d)(i)) (s 6(1)). This is a constrained right, because AMSA may grant the exemption only if satisfied it would not contravene the International Regulations (s 6(2)). The application process must follow Division 3 of Marine Order 1 (s 6(1)).

• Right to apply for approvals: Persons may apply to an issuing body for approvals referred to in paragraph 14 of Annex I and paragraph 3 of Annex III (s 8(1)). If the issuing body agrees the required technical criteria are satisfied, it may issue the approval (s 8(2)-(3)).

• Right to administrative review: The Order identifies certain decisions as reviewable for the purposes of Marine Order 1 s 17: a decision not to give, or to revoke, an approval under s 8; and a determination made under s 9(6) (s 7). The Order notes a decision not to give an exemption under s 6 is also a reviewable decision under Marine Order 1 because it is referenced in section 15 of this Order (note to s 7). The procedural details for reviewable decisions are governed by Marine Order 1, which addresses making an application, seeking further information, time allowed for consideration, imposing conditions, notification and review processes.

• Right to seek AMSA determinations: AMSA has express statutory authority under s 9(6) to make determinations for a vessel under Rule 1(e) of the International Regulations, including about the closest possible compliance with the International Regulations. A determination is an authoritative administrative instrument that affects a vessel’s compliance obligations.

Operational mechanics and ongoing obligations

• Approvals are revocable: An issuing body may revoke an approval given under s 8(2) or (3) only if it is no longer satisfied that the construction, performance or installation meets the International Regulations (s 8(4)). That creates an ongoing compliance exposure for holders of approvals.

• Dynamic standards mean ongoing monitoring: Because the Order adopts standards and publications “as in force from time to time” (s 4 definition and ss 9(3)-(5)), obligated parties must monitor changes in IMO standards and routeing publications to ensure continued compliance.

• Delegation and information access: The Order’s notes direct parties to the AMSA website for obtaining copies of IMO documents and for delegation information (s 4 notes 3 and 4). This affects how parties exercise their rights to apply and to obtain administrative decisions.

In sum, duties fall primarily on owners and masters to observe the International Regulations and to provide and use lights and signals, with specific technical standards for certain classes of equipment on certain Australian vessels. Rights include narrow exemption and approval application rights, revocation risk for approvals, and administrative review channels governed by Marine Order 1.

The Marine Order itself does not set out direct monetary penalties or criminal sanctions in its text, but links compliance and non-compliance to the Navigation Act enforcement framework and to AMSA administrative powers.

Statutory enforcement linkage: The note to s 9(1) states that it is an offence for the owner or master of a vessel to operate a vessel, or cause or permit another person to operate a vessel, in contravention of regulations made for section 176 of the Navigation Act, and it directs the reader to sections 177 and 178 of the Navigation Act. The Order therefore places primary enforcement within the Navigation Act’s penal and remedial architecture rather than creating novel penalties in the Marine Order itself. Practitioners should take the Order’s operative content together with the Navigation Act’s offence provisions to understand the legal consequences of breach.

Administrative controls and remedial mechanics

• Revocation of approvals: An issuing body may revoke an approval issued under s 8(2)-(3) if it is no longer satisfied that the relevant construction, performance or installation complies with the International Regulations (s 8(4)). Revocation is an administrative remedy that can impose immediate practical consequences on owners who rely on an approval.

• AMSA determinations and their consequences: AMSA may make determinations under Rule 1(e) for a vessel, including about “closest possible compliance” for a vessel (s 9(6)). A determination will set a binding administrative position that affects enforcement risk for the vessel’s operator if AMSA’s determination sets compliance expectations.

• Exemption constraints: Exemptions are only available in constrained circumstances and only when AMSA is satisfied that granting the exemption will not contravene the International Regulations (s 6(2)). Denial of an exemption leaves the applicant fully subject to the regulatory obligations, and a denial is a reviewable decision under Marine Order 1 (s 7 and accompanying notes).

Review and challenge routes

• Administrative review: Certain decisions are expressly reviewable under Marine Order 1 s 17, as listed in s 7: decisions not to give, or to revoke, an approval under s 8, and determinations under s 9(6). The notes also state that a decision not to give an exemption under s 6 is reviewable because it is mentioned in section 15 of the Order. Reviewable decisions permit an internal administrative appeal process as set out in Marine Order 1. Practitioners must consult Marine Order 1 to determine timeframes and procedural steps for seeking review.

• Criminal or regulatory prosecution: Operational contraventions of the International Regulations, as expressed in domestic regulations pursuant to s 176 of the Navigation Act, are actionable under the Navigation Act’s offence provisions. The Order itself does not restate those penalties; instead it signals that prosecution or other regulatory sanctions will be pursued under the Navigation Act framework.

Information, delegation and publication practicalities

• Access to instruments: The Order’s notes point parties to the AMSA website for obtaining copies of any IMO resolution or document mentioned and for delegation of AMSA’s powers (s 4 notes 3-4). Enforcement actions and administrative decisions may in practice be taken by delegates authorised by AMSA, so practitioners should verify the identity of decision-makers in any enforcement or administrative context.

• Dynamic incorporation raises enforcement complexity: Because standards and routeing instruments are incorporated “as in force from time to time” (s 4 and ss 9(3)-(5)), enforcement officers and prosecutors will apply the version of the international instrument current at the time of alleged non-compliance. This creates a moving target for proving the content of the standard at a particular time, and means operators need to show contemporaneous compliance with the version in force.

In short, the Order creates substantive duties but relies on the Navigation Act and AMSA’s administrative powers for enforcement and penalties. Revocation of approvals and denial of exemptions are the immediate administrative levers, while criminal or regulatory penalties for contraventions are to be pursued under the Navigation Act’s offence provisions as noted in the Order.

The Order is an instrument operating within the statutory architecture of the Navigation Act 2012 and integrated with Marine Order 1 (Administration) 2013 and international instruments. Its interaction with other laws and instruments is primarily by reference rather than by restatement.

Relationship to the Navigation Act: Section 3 identifies the specific Navigation Act provisions that authorise this Order, including subsection 176(1) (regulations may provide for requirements for the prevention of collisions, and for provision and use of lights and signals), subsection 176(2) and paragraph 340(1)(b) (regulations may give effect to the Prevention of Collisions Convention), subsection 339(1) (power to prescribe matters required or permitted to be prescribed), and subsection 342(1) (AMSA’s power to make Marine Orders about matters that can be provided for by regulation). The Order therefore functions as a statutory instrument made consistent with those Navigation Act powers, and enforcement of the Order’s substantive obligations is connectable to the Navigation Act’s regulatory and offence framework as noted in s 9(1) note. Readers must consult the Navigation Act itself to identify the specific offence provisions, penalties and enforcement procedures that will apply to breaches of the duties expressed in this Marine Order.

Connection with Marine Order 1 (Administration) 2013: The Order builds procedural content into Marine Order 1. Section 6(1) requires that exemption applications be made in accordance with the application process set out in Division 3 of Marine Order 1. Section 7 identifies particular decisions as reviewable for the purposes of section 17 of Marine Order 1, and the note after s 6 summarises the Marine Order 1 topics relevant to exemptions and equivalents: making an application, seeking further information, the time allowed for consideration, imposing conditions, notification of a decision and review of decisions. The procedural mechanics , who may apply, how AMSA processes applications, time limits and review rights , are therefore governed by Marine Order 1 rather than by this instrument. Practitioners should not assume the Marine Order’s procedural details are in this text; they are in Marine Order 1.

Incorporation and interaction with international instruments: The Order gives domestic effect to the Prevention of Collisions Convention and the International Regulations, which by definition are international instruments. The Order incorporates external IMO materials dynamically: the definition of International Regulations is “as in force from time to time” (s 4), the performance standards in the Annex to IMO Resolution MSC.253(83) are incorporated “as in force from time to time” for the equipment obligation (s 9(3)), and the latest edition of the IMO publication Ships’ Routeing is taken to be the traffic separation schemes and inshore traffic zones for the International Regulations (ss 9(4)-(5)). The Order therefore interacts with international law through direct incorporation by reference, and as those international documents change, the domestic obligations on relevant vessels change in parallel.

Effect on foreign vessels and extraterritorial interaction: Section 5(2) expressly states that sections 6 and 8 do not apply to a foreign vessel. That limits the reach of the Order’s administrative processes to domestic or otherwise qualifying vessels for exemption and approval applications. The Order does not explicitly state how enforcement against foreign vessels is to proceed, but the implied mechanism is that foreign vessels operating in Australian jurisdiction will still be expected to comply with relevant rules under international law. The text’s administrative privileges for exemptions and approvals are not extended to foreign vessels.

Delegation and administrative law interactions: The Order’s note on delegation (s 4 note 4) directs interested parties to the AMSA website for details on delegated powers under this Order. This suggests that AMSA may, consistent with the Navigation Act, delegate decision-making under the Order to authorised officers or bodies, which interacts with general administrative law principles on delegation, decision-making and review. The Order itself identifies particular decisions as reviewable under the Marine Order 1 scheme (s 7), thereby interacting with internal administrative review mechanisms set out elsewhere.

Interplay with subordinate instruments: Marine Order 30 removes Marine Order 30 (Prevention of collisions) 2009 (s 1B). The new Order therefore supersedes any earlier subordinate instrument on the same subject, and any regulatory references to the repealed Marine Order should be read as replaced by the 2016 Order from 1 August 2016.

In summary, the Order operates as a subordinate instrument made under the Navigation Act, delegates procedural and review mechanics to Marine Order 1, incorporates international standards dynamically, limits certain administrative privileges for foreign vessels, and depends on AMSA’s delegation arrangements for practical administration. Wherever the Order references enforcement or offences, the Navigation Act’s provisions govern the substantive penalties and processes.

The Order itself contains a limited amendment and commencement history within its text.

• Commencement: The Order commences on 1 August 2016 (s 1A).

• Repeal of prior instrument: The Order expressly repeals Marine Order 30 (Prevention of collisions) 2009 (s 1B). That repeal means the 2016 Order replaced the 2009 Marine Order on commencement.

• Dynamic incorporation of IMO instruments: The Order repeatedly frames incorporated international instruments as “as in force from time to time” (definition of International Regulations at s 4; performance standards referenced in s 9(3) are adopted “as in force from time to time”; Ships’ Routeing references in ss 9(4)-(5) point to the latest edition). This drafting choice makes the statutory content responsive to updates at the international level without requiring formal amendment of the Marine Order each time an IMO instrument is updated. Practically, changes at the IMO level will change the operative standards domestically, and the Order’s drafting obviates the need for frequent formal amendments to the Marine Order to reflect those updates.

• References to external documents and guidance: The Order includes notes identifying what the latest edition of Ships’ Routeing was at the date of commencement (as at 1 August 2016, the 2015 edition) and indicates that AMSA will take account of MSC/Circ.1144 in exercising its Rule 1(e) determination power (note to s 9(6)). These are not formal amendments but show how AMSA expects to apply guidance in making determinations and that AMSA recognises particular IMO instruments as influential for pragmatic application.

• Delegation and procedural detail externalised: The Order places procedural and administrative details in Marine Order 1 (for applications, review processes and Div 3 processes noted at s 6(1) and s 7). To the extent those procedural rules are amended in Marine Order 1, the operational practice under this Order will be affected without amendment of Marine Order 30 itself. Similarly, AMSA’s published delegation arrangements on its website will affect who exercises powers under this Order in practice.

• No in-text amendments beyond repeal/commencement: The Order text does not record any subsequent amendments, schedules or variations beyond the replacement of the 2009 Order and the commencement date. Any later amendments to Marine Order 30 would be published as separate legislative instruments and registered on the Federal Register of Legislation, as the Order’s closing note indicates (note at end referring to the Federal Register of Legislation and Legislation Act 2003).

For legal practitioners, the amendment-historical implications are: (1) the operative substantive duties have been updated and replaced the 2009 Marine Order as of 1 August 2016, and (2) the dynamic incorporation of international instruments and reliance on Marine Order 1 for procedural mechanics mean that substantive and procedural operational requirements may change via updates to external international instruments or to Marine Order 1, rather than through amendment of Marine Order 30 itself. To trace any subsequent changes, consult the Federal Register of Legislation entry for Marine Order 30 and AMSA’s website for delegation and guidance documents, as the Order itself instructs (s 4 note 3; endnote referring to the Federal Register of Legislation).

The text of Marine Order 30 (Prevention of collisions) 2016 does not record any judicial decisions, appeals, or litigation history. It contains no citations to case law and names no judicial proceedings; it is a standalone regulatory instrument that references the International Regulations and the Navigation Act, and embeds administrative review mechanisms through Marine Order 1. Because the instrument itself does not include litigation references, this section must confine itself to the procedural and review mechanisms that the Order establishes which may, in practice, generate litigation or administrative appeals.

Administrative review as the immediate avenue: The Order identifies certain decisions as reviewable under Marine Order 1 s 17 (s 7). Specifically, the following are reviewable decisions for section 17 of Marine Order 1: (a) a decision not to give, or a decision to revoke, an approval under section 8; and (b) a determination made under subsection 9(6) (s 7). The Order’s accompanying note also states that a decision not to give an exemption under section 6 is a reviewable decision for section 17 of Marine Order 1 because it is mentioned in section 15 of the Order. Marine Order 1 sets out the procedure for administrative review, and those review channels will ordinarily be the first avenue for challenge or dispute about AMSA or issuing body decisions under the Order.

Potential for judicial review: While the Order does not mention judicial review explicitly, the fact that certain decisions are defined as reviewable decisions under an administrative review scheme indicates that affected persons have an internal avenue of appeal. In practice, administrative decisions that have been through internal review processes may be subject to judicial review in the courts under general administrative law principles, where parties allege jurisdictional error or failure to comply with statutory procedural requirements. The Order itself does not create or limit judicial review rights; those rights derive from broader administrative law and the Judicial Review Act or common law doctrines, none of which are stated in this instrument.

No reported judicial interpretations in the instrument: Because the Order text contains no litigation history, it does not supply judicial interpretation that might affect how its provisions are read. For example, the instrument includes AMSA’s power to make determinations under Rule 1(e) (s 9(6)) and indicates AMSA will take into account MSC/Circ.1144 as guidance when exercising that power. In the absence of reported decisions cited in the instrument, there is no authoritative judicial gloss in this text on how AMSA’s determinations or issuing body approvals should be interpreted or reviewed.

Practical litigation considerations implicit in the Order

• Reviewable decisions are limited in scope: The Order lists a small set of reviewable decisions (s 7). That confines the categories of administrative decisions under the Order that are amenable to the Marine Order 1 internal review process. Questions about the scope of AMSA’s power to grant exemptions, to make determinations, or about the revocation of approvals, could give rise to administrative appeals and, potentially, to judicial review, but the instrument itself provides neither precedent nor a litigation record.

• Enforcement under the Navigation Act creates separate legal pathways: Because the Order ties the substantive duty to the Navigation Act offence provisions (note to s 9(1) referencing ss 177 and 178 of the Navigation Act), prosecutions or enforcement actions taken under the Navigation Act will generate their own litigation history in the courts or tribunals applying the Navigation Act provisions. The Order itself does not supply that history.

• Delegation and agency practice may be litigated: The Order’s note on delegation (s 4 note 4) suggests delegated decision-making may occur, and challenges to the lawfulness of delegation or to the exercise of delegated powers could arise in litigation if a party alleges a procedural or jurisdictional defect. The Order provides no judicial guidance on these matters.

Because no cases or disputes are reported in the Order text, practitioners must look outside this instrument , to reported decisions under the Navigation Act, to challenges to AMSA determinations or issuing body decisions, or to administrative appeals under Marine Order 1 , to assemble any litigation history relevant to applying or enforcing Marine Order 30.

The Order is compact but contains several practical traps and sources of potential uncertainty for owners, masters and advisers. These are matters that the text itself makes significant, and they should be surfaced before relying on the Order in operational or compliance planning.

1. Dynamic incorporation of international instruments changes compliance obligations without legislative amendment (s 4 definition; ss 9(3)-(5)). The Order takes IMO instruments and standards “as in force from time to time.” That means an owner who brought a vessel into compliance with the standard in force at time A may find the applicable standard changed at time B without any express amendment to the Marine Order. Practitioners must monitor IMO instruments and AMSA’s guidance. The Order’s notes point to the AMSA website for copies of the relevant documents (s 4 note 3), but the dynamic incorporation itself is the mechanism that can produce surprise regulatory drift.

2. Narrow exemption scope and the Rule 38 caveat (s 6(1)-(2)). The Order allows exemptions only for matters specifically mentioned in paragraphs (c) or (h), or subparagraph (d)(i) of Rule 38 of the International Regulations. The Order does not give parties carte blanche to seek exemptions on any ground. AMSA may give an exemption only if satisfied that giving the exemption would not contravene the International Regulations (s 6(2)). The Order also references MSC/Circ.1144 in guiding exercise of Rule 1(e) determinations (s 9(6) note), which emphasises that exemptions should be exceptional. Applicants should not assume exemptions are readily available.

3. Foreign vessels cannot access ss 6 and 8 procedural relief (s 5(2)). If a foreign-flag vessel needs an exemption or an approval covered by ss 6 and 8, that administrative route is not available under this Order. That can complicate operational planning for foreign operators in Australian waters. The Order does not spell out an alternative pathway for foreign vessels in this instrument.

4. Approvals are conditional and revocable (s 8(2)-(4)). Issuing bodies may grant approvals only where satisfied about construction, performance and installation, and they may revoke them if satisfaction is lost. Approval holders therefore face ongoing compliance risk and administrative oversight. The Order does not specify the procedural protections that apply on revocation beyond noting that a decision to revoke is a reviewable decision under Marine Order 1 (s 7).

5. Limited categories for the equipment-performance obligation and a temporal cutoff (s 9(3)). The performance-standard obligation in s 9(3) applies only to navigation lights, controllers and associated equipment installed after 30 November 2009, and only on the three enumerated vessel categories (regulated Australian vessel, domestic commercial vessel, recreational vessel with Australian nationality). Equipments installed before that date are not captured by s 9(3), which creates a grandfathering effect that may surprise purchasers of second-hand vessels or those assessing retrofit obligations.

6. Routeing adoption depends on latest edition of Ships’ Routeing (ss 9(4)-(5)). The Order takes the traffic separation schemes and inshore traffic zones in the latest edition of the IMO’s Ships’ Routeing as the applicable instruments. That both simplifies adoption of new routeing scheme edits and creates uncertainty if an operator is relying on a version published at a particular time. The Order did note what the latest edition was at commencement (2015), but the operative text imports the latest edition going forward.

7. Substantive enforcement is via the Navigation Act (note to s 9(1)). The Marine Order itself does not state penalties but explicitly links contraventions to the Navigation Act offence regime (note to s 9(1) referencing sections 177 and 178 of the Navigation Act). Practitioners must consult the Navigation Act to identify the enforcement consequences, time limits and procedural safeguards applicable to alleged breaches. Relying on the Marine Order alone will not identify exposure to penalties.

8. Reliance on Marine Order 1 for procedural detail (s 6(1); s 7). The Order externalises application and review procedures to Marine Order 1. That means operational steps, timeframes and rights of review are not in this Order and must be explicitly consulted in Marine Order 1. Missing that linkage could lead to procedural missteps.

9. Delegation and administrative practicalities (s 4 note 4). AMSA may delegate powers under this Order and the identity and authority of decision-makers may change over time. The Order’s note directs readers to AMSA’s website for delegation information; failure to check delegation arrangements could delay applications or result in submissions to the wrong decision-maker.

10. Ambiguity where the Order references specific International Regulations paragraphs without reproducing their text (s 6(1), s 8(1), s 9(6)). The Order references specific paragraphs of Annexes and Rules but does not reproduce them. Practitioners must consult the International Regulations to understand precisely which matters are subject to exemption or approval. Relying on the Order’s cross-references without consulting the underlying International Regulations can lead to misinterpretation of the scope of the Order’s rights and obligations.

These "gotchas" are mechanical and procedural, arising from the Order’s design choices: dynamic incorporation of external materials, delegation of procedural rules to Marine Order 1, narrow administrative relief for exemptions and approvals, and reliance on the Navigation Act for enforcement.

Compliance under this Marine Order requires both substantive adherence to the International Regulations and attention to the Marine Order 1 procedural mechanics. The steps below are practical, grounded in the Order’s text, and specify where to look in the Order for the relevant requirement.

1. Determine whether the Order applies to your vessel and area: The Order applies to the vessels mentioned in section 175 of the Navigation Act in the areas mentioned in section 175 for the vessel (s 5(1)). Before acting, identify whether the vessel and operating area fall within that scope by consulting section 175 of the Navigation Act. The Order excludes foreign vessels from ss 6 and 8 (s 5(2)), so identify flag status to determine eligibility for exemptions and approvals.

2. Ensure operational observance of the International Regulations: Section 9(1) requires that the measures in the International Regulations for navigation, management and working of a vessel for the prevention of collisions must be observed in operation. Review the current text of the International Regulations (as in force from time to time) and align navigational and operational procedures with those Rules. Because the Order imports the International Regulations dynamically (s 4), ensure your operational manuals are updated against the current international text, not merely the text in force at a prior date.

3. Provide and use required lights and signals: Under s 9(2), provide and use the lights and signals mandated by the International Regulations. Audit vessel lighting and signalling policies, check operational checklists and train watchkeeping personnel in required usage.

4. For equipment installed after 30 November 2009, verify performance standard compliance: If you own or operate a regulated Australian vessel, a domestic commercial vessel, or a recreational vessel with Australian nationality, and you installed navigation lights, navigation light controllers or associated equipment after 30 November 2009, ensure that those installations conform to performance standards at least equal to the Annex to IMO Resolution MSC.253(83) (s 9(3)). Obtain the relevant resolution and Annex current at the time of installation and match installation certificates, manufacturer documentation and test results against the Annex standards. Keep documentary proof that equipment meets the Annex or equivalent standards “as in force from time to time” for audit and enforcement scrutiny.

5. Check traffic separation schemes and inshore traffic zones: The Order makes the traffic separation schemes and inshore traffic zones in the latest edition of Ships’ Routeing applicable to the International Regulations (ss 9(4)-(5)). Ensure voyage planning and passage planning consult the latest edition of Ships’ Routeing and incorporate any applicable traffic separation schemes or inshore traffic zone requirements into passage plans and navigational risk assessments.

6. Use the approvals and exemptions pathways where necessary and eligible:

   • Approvals from issuing bodies: If you require an approval mentioned in paragraph 14 of Annex I or paragraph 3 of Annex III of the International Regulations, apply to an issuing body per s 8(1). Anticipate that the issuing body will require proof that construction, performance and installation conform to the International Regulations (s 8(2)-(3)). Prepare technical documentation, test certificates and installation records, and plan for potential post-approval surveillance because approvals can be revoked if the issuing body ceases to be satisfied (s 8(4)). Note the procedural review rights: a decision not to give or to revoke an approval under s 8 is a reviewable decision under Marine Order 1 s 17 (s 7).

   • Exemptions from AMSA: If seeking an exemption, confirm the exemption sought concerns only the specific matters allowed by the Order (paragraphs (c) or (h) or subparagraph (d)(i) of Rule 38 of the International Regulations) (s 6(1)). Follow the application process set out in Division 3 of Marine Order 1 (s 6(1)). Be prepared to show that granting the exemption would not contravene the International Regulations, since AMSA may grant an exemption only if satisfied this is so (s 6(2)). Know that a decision not to grant an exemption is reviewable under Marine Order 1, as noted in the Order (s 7 note).

7. Use AMSA determinations under Rule 1(e) where closest-possible compliance is an issue: AMSA may make a determination for a vessel under Rule 1(e) of the International Regulations about the closest possible compliance with the International Regulations (s 9(6)). If you consider compliance requires an AMSA determination , for example, where strict literal compliance is impossible , apply to AMSA and note that AMSA will take into account MSC/Circ.1144 guidance on the narrowness of exemptions and the need to consider problems posed to other vessels (note to s 9(6)). A determination under s 9(6) is a reviewable decision under s 7.

8. Maintain records and documentary proof: Because the Order connects obligations to international standards and external approvals, maintain contemporaneous records of the versions of the International Regulations and IMO instruments relied on when equipment was installed or when a passage plan was prepared, installation certificates, manufacturer’s statements of compliance with IMO performance standards, issuing body approval certificates, AMSA correspondence regarding applications, and any determinations or exemption notices. The dynamic nature of incorporated standards (s 4 and ss 9(3)-(5)) makes contemporaneous documentary proof important when demonstrating compliance with the standard that was in force at a particular time.

9. Consult and comply with Marine Order 1 procedural requirements: Procedural aspects , making application for exemptions, seeking further information, time allowed for consideration, conditions on approvals or exemptions, notification and review of decisions , are governed by Marine Order 1 as referenced by this Order (s 6(1) and note; s 7). Practitioners must not rely on the summary in Marine Order 30 alone; they should consult Marine Order 1 for application forms, deadlines and review processes.

10. Monitor AMSA delegation and publication sources: The Order’s notes direct parties to the AMSA website for copies of IMO documents and for delegation information (s 4 notes 3-4). Confirm the identity of the issuing body or AMSA delegate handling an application, and use AMSA’s published guidance to ensure applications and technical submissions are directed appropriately.

11. Understand enforcement exposure under the Navigation Act: Because the Order indicates that contravening regulations made for s 176 of the Navigation Act can be an offence for owner or master (note to s 9(1)), consult the Navigation Act to understand the penalties and enforcement processes that may be applied in case of non-compliance. Treat the Marine Order as specifying substantive duties to be enforced under the Navigation Act framework.

12. Seek early technical and legal advice where uncertain: Where technical compliance is borderline, or a procedure (exemption, approval or determination) is required, seek early engagement with the issuing body or AMSA, and prepare a technical submission that maps the vessel’s condition or equipment to the specific International Regulations and IMO standards referenced in the Order.

Following these steps, and cross-referencing the applicable sections of Marine Order 30 and the procedural contents of Marine Order 1, will position an operator or owner to demonstrate compliance and to engage the administrative processes the Order provides when relief or approvals are necessary.
