Marine Order 18 (Measures to enhance maritime safety) 2013

Several key concepts are defined or refined by the order. Continuous Synopsis Record (CSR) is defined in section 6 as a document issued by AMSA in accordance with SOLAS regulation 5(3) or, for a domestic-only regulated Australian vessel, a document issued to the same effect. The note explains the CSR is intended to provide an on-board history of the vessel, recording changes in ownership, flag, classification society, and other operational details. The concept is central to the order’s transparency objective, but it also imposes an ongoing administrative burden on owners to maintain and update the record within strict timelines. ESP Code is the International Code on the Enhanced Programme of Inspections during Surveys of Bulk Carriers and Oil Tankers 2011 adopted by IMO Resolution A.1049(27), as in force from time to time. This incorporates by reference a technical code that AMSA does not reproduce, meaning compliance requires access to and understanding of an external document that may be amended without further domestic legislative action. Home port and official number adopt definitions from the Shipping Registration Regulations 1981, tying the order to existing registration nomenclature. Date of construction (section 7) is defined by reference to keel laying or the commencement of identifiable construction and assembly of at least 50 tonnes or 1% of structural mass. This definition matters for determining which vessels must comply with CSR requirements from 1 July 2004 (section 15(1)(c) requires the CSR to include history from that date for vessels constructed before that date). The concept of the Administration in SOLAS and related documents is explicitly replaced with AMSA (section 8), meaning AMSA is the competent authority for exercising any discretion under the Code or resolutions. Strict liability is a central concept: several offences (sections 15(2), 17(2), 17(6), 18(2)) are designated strict liability, meaning no proof of fault is required for conviction, though the defence of honest and reasonable mistake of fact remains available at common law. This lowers the prosecution’s evidentiary burden and increases the risk of inadvertent non-compliance. Equivalents and exemptions are mechanisms by which AMSA may grant relief from requirements, but only if compliance would be “unnecessary or unreasonable” (exemption) or the proposed alternative is “at least as effective” (equivalent) and neither would contravene SOLAS. These concepts create limited flexibility but also introduce administrative discretion and application costs.

The order applies primarily to owners of regulated Australian vessels, as defined in the Navigation Act. These are vessels registered on the Australian General Shipping Register or the Australian International Shipping Register. The order also applies to foreign vessels in Australian ports, entering or leaving an Australian port, in internal waters, or in the territorial sea (except during innocent passage) - section 9(1)(b). For foreign vessels, the order likely enforces SOLAS obligations that already apply under international law, but it creates a domestic enforcement mechanism, including the power to inspect CSRs as part of port State control (note to section 15). Specific categories of vessels are caught by specific provisions. The ship identification number requirement (section 13) applies to passenger vessels of at least 100 gross tonnage and cargo vessels of at least 300 gross tonnage. The enhanced survey requirement (section 12) applies only to vessels that are bulk carriers or oil tankers within the meaning of SOLAS. The CSR requirement (Division 4) applies to all vessels covered by the order except cargo vessels under 500 gross tonnage and fishing vessels (section 9(2)). Fishing vessels are entirely excluded (section 9(2)(a)). The order does not apply to cargo vessels under 500 GT except for the ship identification number requirement (section 13), which has its own lower thresholds. Owners of vessels that are both regulated Australian and not on overseas voyages are also caught by enhanced surveys, ship ID numbers, and CSRs (section 9(2)(c)). This extension to domestic-only vessels is a notable expansion beyond what SOLAS strictly requires. The Registrar of Ships is the administrative actor responsible for issuing and updating CSRs and is a member of AMSA staff. Inspectors under the Navigation Act have powers to enforce the order, including inspecting CSRs on board. Persons applying for exemptions or equivalents must use the application process in Marine Order 1 (Administration) 2013, so the compliance burden falls on owners or their agents to prepare applications and pay any associated fees.

The order imposes several positive duties on vessel owners, with corresponding rights held by AMSA and the Registrar of Ships. The primary duty is in section 15: the owner must ensure that a CSR is kept on board the vessel, is available for inspection at all times, and for vessels constructed before 1 July 2004 includes the vessel’s history from that date. This duty is backed by criminal and civil penalties. The owner must apply for the CSR under section 16, providing information to the Registrar’s satisfaction and paying any application fee. If a CSR already exists, the previous version must be kept on board and a copy provided with the new application. The duty to update arises under section 17(1): if information in the CSR becomes inaccurate because of a changed circumstance, the owner must notify the Registrar in writing within 14 days of the change. This is a tight timeline given the administrative effort required to document changes involving classification societies, flag transfers, or ownership structures. After receiving a revised CSR, the owner must attach it to the superseded record within 14 days (section 17(5)). A further duty arises when a vessel ceases Australian registration and is registered under another flag: the owner must within 14 days tell the Registrar the new country of registration and, if known, the name and registered address of the entity that will operate the vessel (section 18(1)). All these duties carry strict liability offences. Owners have the right to apply for exemptions (section 10) and for approval to use equivalents (section 11). AMSA may grant these only if satisfied that compliance is unnecessary or unreasonable (exemption) or the equivalent is at least as effective (equivalents), and that SOLAS is not contravened. These rights are discretionary; there is no entitlement to relief even if conditions are met. Owners also have the right to have a CSR issued (section 16) and revised (section 17) once the Registrar is satisfied with accuracy and any fee is paid, but the Registrar may require additional information and there is no time limit specified for processing. The order confers on AMSA and inspectors the right to inspect CSRs at any time, and the note to section 15 confirms this applies to foreign vessels under port State control.

The order creates a dual enforcement regime: criminal offences and civil penalties, both set at 50 penalty units per contravention. For criminal offences, sections 15(1), 17(1), 17(5), and 18(1) impose a maximum fine of 50 penalty units. The same maximum applies to civil penalties under sections 15(3), 17(3), 17(7), and 18(3). At current Commonwealth rates (s 4AA Crimes Act 1914), a penalty unit is $313, making the maximum fine $15,650 per offence. Multiple offences could arise from a single pattern of non-compliance - for example, failing to notify a change of circumstance within 14 days (section 17(1)) and then failing to attach the revised CSR within 14 days of receiving it (section 17(5)) are separate offences. The criminal offences are designated strict liability (sections 15(2), 17(2), 17(6), 18(2)), meaning the prosecution does not need to prove fault. The defence of honest and reasonable mistake of fact remains available but places the evidentiary burden on the defendant. This design significantly raises the enforcement risk for shipowners, especially for small operators who may not have dedicated compliance personnel. Civil penalties are enforced through the Federal Court under Part 4 of the Regulatory Powers (Standard Provisions) Act 2014 (which is imported by the Navigation Act). Civil penalty proceedings do not require proof beyond reasonable doubt; the civil standard applies. The order does not provide for infringement notices (on-the-spot fines) but AMSA could presumably use other powers under the Navigation Act. Enforcement is likely to occur through routine port State control inspections and surveys. For foreign vessels, an inspector may report findings to the flag State or take more direct action under other provisions of the Navigation Act. The penalty levels are not high relative to the costs of compliance for a large shipping company, but they are non-trivial for smaller operators. The order relies on private incentives to comply; it does not impose any continuing penalty per day. The source does not contain a table of penalties or any specification of how penalty units are indexed.

The order sits within a hierarchy of legislation. It is made under subsection 342(1) of the Navigation Act 2012, which itself authorises AMSA to make orders about any matter for which provision must or may be made by regulations. The parent Act also provides, via section 339, for regulations to prescribe matters under SOLAS. The order therefore has the same legal force as a regulation, subject to disallowance by Parliament. It must be read consistently with the Navigation Act, and any inconsistency would see the Act prevail. The order incorporates by reference the ESP Code as in force from time to time, meaning amendments to that Code automatically become binding without further domestic instrument. This reduces legislative lag but creates uncertainty if owners are slow to track IMO amendments. The order also interacts with the Shipping Registration Act 1981 and the Shipping Registration Regulations 1981, from which it borrows definitions (home port, official number) and relies on the Registrar of Ships. Changes to those instruments could indirectly affect compliance obligations under this order. The order references Marine Order 1 (Administration) 2013 for procedural matters: application processes for exemptions and equivalents, approved forms, and decisions review. That order sets out the administrative framework for all marine orders. Review of AMSA decisions under this order (e.g., refusal of an exemption) would be governed by the Navigation Act’s internal review and AAT review mechanisms, which are not detailed here. For foreign vessels, the order operates alongside Australia’s port State control regime under the Navigation Act and the Maritime Labour Convention, but the source does not specify any hierarchy. The CSR, once updated, becomes the authoritative record; discrepancies between the CSR and other documents (e.g., registration certificates) could trigger enforcement under other provisions such as false statement offences. The strict liability provisions may interact with the Criminal Code Act 1995 (Cth) which applies fault elements unless displaced; the order expressly displaces those by designating the offences as strict liability. The note to section 16 indicates that fees are determined under section 47 of the Australian Maritime Safety Authority Act 1990, a separate fee-setting regime.

The source text provided is the original made version of Marine Order 18 (Measures to enhance maritime safety) 2013, registered on the Federal Register of Legislative Instruments as AMSA MO 2013/19. It shows no amendment history within the document itself; the order commences on 1 January 2014 and repeals the 2009 version. Based solely on the source, there are no incorporated amendments, corrigenda, or subsequent variations. However, users should be aware that the text as reproduced may not reflect subsequent amending instruments. The Federal Register of Legislation (legislation.gov.au) should be consulted for a current compilation. AMSA may have issued later Marine Orders that modify or replace this instrument, but they are not captured here. The ESP Code is incorporated as in force from time to time, so updates to that Code are not recorded in the order’s amendment history. The order’s enabling provisions (s 342(1) Navigation Act) have not been amended in a way that directly affects this order since 2013. The repeal of the 2009 order implies that any transitional matters would have been handled at commencement; no transitional provisions appear in the source.

The source text does not refer to any litigation, and there is no reported case law directly interpreting Marine Order 18 (2013) or its predecessor. This is unsurprising: the order is a technical instrument with relatively clear administrative requirements, and enforcement is likely to proceed by way of penalty notices or civil penalty proceedings rather than through criminal trials that would generate published judgments. The strict liability nature of the offences means that many disputes would be resolved at the administrative level or through the AAT on review of AMSA decisions (e.g., refusal of an exemption). The most likely litigation would involve challenges to penalty amounts or AMSA’s exercise of discretion in granting equivalents, but no such cases are recorded in the source. Users should search for any proceedings under the Navigation Act that cite this order. The absence of litigation may indicate that the order is generally complied with or that non-compliance is dealt with informally. It does not mean the order is free of legal risk.

Several provisions contain traps that could catch unwary owners or operators. First, the strict liability designation applies to most CSR obligations: an owner who fails to update a CSR within 14 days due to oversight alone is still liable for the full 50 penalty unit maximum. There is no grace period for weekends or public holidays. Second, the duty to notify a change of circumstance (section 17(1)) applies to “any changed circumstance” that makes information no longer accurate. This is a broad trigger that could include changes in classification society, changes in ownership structure, new mortgages, or changes in the person with overall control. The 14-day clock starts when the change “happens”, not when the owner learns of it, which is a potential problem if third parties (e.g., financial institutions) cause a change without immediate notification. Third, the owner identification number (section 14) specifies the person with “the overall general control and management of the vessel” as the registered owner for SOLAS purposes. This may differ from the legal registered owner on the shipping register. If the entity operating the vessel is different from the registered owner, the latter must ensure the CSR reflects the correct controlling entity. Failure to do so could lead to two different entities each believing the other has the compliance obligation. Fourth, vessels constructed before 1 July 2004 must ensure the CSR includes the history from that date. If the history has not been compiled, the owner must reconstruct it, which may involve contacting previous owners or flag States. Fifth, the application for an exemption or equivalent must be made in accordance with Marine Order 1, and AMSA’s satisfaction is subjective - the owner has no guarantee of relief even if criteria are met. Sixth, the fee for issuing a CSR or revised CSR is not stated in the order; it is determined under a separate Act and may change without notice. Seventh, fishing vessels are entirely excluded, but a vessel that sometimes fishes and sometimes carries cargo may still be subject to the order if it is not primarily a fishing vessel. The definition of “fishing vessel” in context will matter. Finally, the order does not specify what happens if a foreign vessel fails to have a CSR on board in Australian waters; inspectors likely have powers to detain the vessel under port State control provisions of the Navigation Act, which would impose substantial commercial costs beyond the penalty itself.

Compliance with Marine Order 18 requires a systematic approach by owners and operators. For the CSR, the first step is to apply to the Registrar of Ships for an initial CSR under section 16, using the approved form and providing all required information including the vessel’s history if constructed before 1 July 2004. The owner must verify the completeness and accuracy of the information before submission. Once issued, the CSR must be kept on board and presented for inspection on demand. The owner must establish an internal monitoring system to detect any change of circumstance that affects information in the CSR. Such changes include changes in ownership, operator, flag, port of registry, classification society, or the entity with overall general control (which is the owner identification number entity). When a change occurs, the owner must within 14 days notify the Registrar in writing, providing details of the change and any supporting evidence. The Registrar will then issue a revised CSR, which the owner must attach to the superseded version within 14 days of receipt. This attachment requirement, often overlooked, means the ship must carry both old and new records. For vessels ceasing Australian registration, the owner must notify the Registrar within 14 days of the new registration, giving the new flag and operator details. For enhanced surveys, owners of bulk carriers and oil tankers must engage surveyors (often via recognised organisations) to conduct surveys in accordance with the ESP Code as amended. This involves scheduling surveys within the defined intervals and rectifying any deficiencies found. The owner should maintain a survey calendar and check AMSA’s website for current ESP Code resolutions. For ship identification numbers, the marking must be permanently and legibly displayed in accordance with SOLAS regulation 3, which typically requires the IMO number to be marked on the hull, deck, and engine room. Owners of passenger vessels over 100 GT and cargo vessels over 300 GT must verify markings are compliant. For owner identification numbers, the owner must identify the person with overall general control (e.g., the ship manager or beneficial owner) and ensure that person is correctly recorded in the CSR. If the owner uses an equivalent (e.g., an alternative method of marking the IMO number), they must apply to AMSA for approval, demonstrating at least equivalent effectiveness and no contravention of SOLAS. It is prudent to document all steps and maintain a compliance file that includes the CSR, copies of notifications, and correspondence with the Registrar. For small operators, engaging a shipping agent or maritime compliance consultant may be cost-effective compared to the risk of penalties. Given the strict liability nature, a culture of proactive checking and training of crew and shore staff is essential.
