Marine Order 16 (Load lines) 2025

The Order centres on a small set of interlocking legal concepts that operationalise the Load Lines Convention in Australian domestic law: Administration, issuing body, regulated Australian vessel, International Load Line Certificate, International Load Line Exemption Certificate, loading stress information, stability information, appropriate load line and equivalence/exemption.

Administration. The term Administration, as used in the applied convention provisions, maps to AMSA for regulated Australian vessels and to the flag-state Administration for foreign vessels (s 5(1)). That allocation determines who approves surveys, stability/loading stress information and endorsements. The Order reinforces a dual-responsibility model: AMSA regulates Australian-flagged vessels, whereas foreign-flagged vessels remain the remit of their own Administrations, subject to certain port-state controls within Australian law (s 6).

Issuing body. Certificates and endorsements are to be issued or endorsed by an issuing body. The Order requires that endorsements on Load Line Certificates or Exemption Certificates be made by an issuing body and notes customary practice that the endorsing issuing body is commonly the original issuer (ss 16, 19). For regulated Australian vessels, issuing bodies approve loading stress and stability information (ss 22(2)(a), 23(2)(a)).

International Load Line Certificate and International Load Line Exemption Certificate. These safety certificates must be in the form set out in Annex III to the Load Lines Convention (s 4 definitions; ss 9, 10). The Exemption Certificate is expressly available for vessels exempted under Article 6 of the Convention, including vessels with novel features or for single international voyages, subject to criteria in ss 17-18 and satisfaction that adequate safety standards apply.

Survey and record of conditions of assignment. Issue and variation of certificates are contingent on surveys in accordance with Article 14 and Annex I (s 12; s 14). Freeboards must be assigned in accordance with Annex I and a record of conditions of assignment must be carried on board (s 14). Annual surveys are mandated and must be endorsed on the International Load Line Certificate (s 15(e)).

Load lines, marking and freeboard. The Order requires marking of deck line, load lines, subdivision load lines where SOLAS applies and draft marks in particular positions, consistent with SOLAS and the Convention (s 15(b)-(d); s 28(1)). The appropriate load line for determining overload is the line that applies to the season and zone the vessel is located in, or other specified rules (s 25).

Loading stress and stability information. The master or owner must have specified loading stress information and stability information on board and approved by the issuing body for regulated Australian vessels, or by the flag Administration for foreign vessels. Failure to have these documents on board is a strict liability offence and attracts criminal and civil penalties of 50 penalty units (ss 22-23).

Exemptions and equivalents. AMSA retains discretion to grant exemptions for regulated Australian vessels where compliance would be unnecessary or unreasonable and where the exemption would not contravene the Convention (s 7). AMSA may approve equivalents if they are at least as effective as the requirement and consistent with the Convention (s 8). Application processes and administrative detail are handled via Marine Order 1 (Administration) 2013 (notes to ss 7-8, s 10(2)).

Strict liability and civil penalties. Several offences are specifically declared strict liability (ss 22(3), 23(3), 28(2)), and parallel civil penalties are provided (ss 22(4), 23(4), 28(3)). The statutory penalty quantum for those infractions is set to 50 penalty units (ss 22(1), 23(1), 28(1), 28(3)).

Interaction with SOLAS and IMO guidance. The Order embeds SOLAS requirements for passenger vessels and references specific SOLAS regulations for subdivision load lines and draft marks (ss 15(c)-(d); notes to s 23). It instructs that IMO unified interpretations and particular IMO circulars be taken into account in complying with the Convention (s 5(3) and note).

Procedural cross-references. The Order does not reinvent administrative procedures. It cross-references Marine Order 1 for applications, exemptions, equivalents and related administrative practice, and it uses the Navigation Act as the enabling statute for penalties and certificates (ss 3, 7-8, 10(2)). That means procedural timelines, application forms and internal review mechanisms are partly governed by Marine Order 1 and the Navigation Act, with certain decisions reviewable under subsection 313(1) of the Navigation Act (note to s 10(2)).

Owners and masters of regulated Australian vessels are the primary duty-holders under the Order. The Order repeatedly places obligations on those parties to hold valid certificates, ensure surveys are completed, keep approved loading stress and stability information on board, and mark the vessel correctly (ss 9, 14-15, 22-23, 28). Masters are singled out for operational duties, for example the prohibitions on taking a vessel to sea without approved loading stress or stability information and for ensuring logbook entries are made (ss 22(1), 23(1), 26).

Issuing bodies and AMSA as Administration. AMSA, as the Administration for regulated Australian vessels, has decision-making authority under the Order to issue certificates, grant exemptions, approve equivalents and approve documents such as loading stress and stability information (s 5(1); ss 7-8, 10(2), 22(2)(a), 23(2)(a)). Issuing bodies are the administrative vehicle for certification and endorsement; the Order mandates that endorsements on certificates be made by an issuing body (ss 16, 19). The Order also requires that AMSA and issuing bodies be notified of alterations before they are made (s 27).

Foreign flag Administrations and foreign vessel operators. The Order affects foreign vessels to the extent set out in s 6 and Division 3. Most provisions of the Order apply to foreign vessels except Divisions 2 (certificates for regulated Australian vessels) and 6 (other matters specified as applying to regulated Australian vessels). Foreign vessels to which the Load Lines Convention applies must carry the requisite certificates, mark load lines and maintain records and fittings in effective condition (ss 20-21). For foreign vessels, approvals for loading stress and stability information are to be given by the Administration of the country in which the vessel is registered (ss 22(2)(b), 23(2)(b)).

Passengers and cargo interests. Indirectly affected groups include shippers, charterers and passengers. The Order prescribes marking and subdivision load lines that influence permissible loading limits and therefore cargo and passenger carriage. The definition of overloaded and the requirement to adhere to appropriate load lines (ss 24-25) determine limits on cargo stowage and passenger distribution for passenger vessels, particularly where SOLAS subdivision load lines apply (s 25(3)).

Surveyors and classification societies. External surveyors and classification societies that act as issuing bodies, or on behalf of Administrations, are implicated because they perform surveys, endorse certificates and approve loading/stability documentation. The Order ties their approvals to statutory consequences and requires endorsement actions be performed by an issuing body (ss 14, 15(e), 16, 19, 22(2), 23(2)).

Compliance-adjacent stakeholders. Other affected parties include insurers, port authorities and maritime service providers who rely on certificate status, logbook entries and marking compliance to make operational decisions. Enforcement actions under the Navigation Act provisions referenced in the Order (see s 3 and notes to ss 9 and 20) can impact vessel detentions, fines and legal exposure.

Those who decide and who pay. Decision-makers are AMSA and issuing bodies for regulated Australian vessels and the flag-state Administration and issuing bodies for foreign vessels (s 5(1); ss 16, 19, 22(2), 23(2)). Costs fall primarily on owners and operators who must fund initial and annual surveys, maintain fittings and markings, prepare and keep approved loading stress and stability documentation, seek exemptions or equivalents where needed, and submit to endorsement and administrative processes (ss 14-15, 22-23, 7-8). Masters carry operational responsibility for not taking vessels to sea in breach of the Order (ss 22(1), 23(1)).

Obligation to hold appropriate certificates. Owners of regulated Australian vessels that fall within the Convention’s scope must hold an International Load Line Certificate; where Article 6 exemptions apply, an International Load Line Exemption Certificate must be carried instead (ss 9-11). The Order specifies the form of these certificates as the Annex III forms from the Load Lines Convention (s 4 definitions). Owners have a corresponding right to apply for certificates (s 10(1)-(2)).

Survey and record-keeping duties. Owners must ensure vessels complete initial, renewal and annual surveys in accordance with Article 14 and Annex I of the Convention and maintain on board a record of conditions of assignment of load lines (ss 14-15). Annual surveys must be endorsed on the International Load Line Certificate (s 15(e)). For vessels with novel features or single-voyage exemptions, AMSA must be satisfied that statutory surveys or other evidence of adequate safety exist before an exemption certificate is issued (s 17).

Marking and maintenance duties. Masters and owners must ensure deck line, load line and, where SOLAS applies, subdivision load lines and draft marks are correctly and permanently marked in the positions specified in certificate documents (ss 15(b)-(d); 28(1)). They must maintain relevant fittings and appliances for openings, freeing ports, guard rails and crew access in effective condition (s 21(1)(c); s 15(a)).

Operational duties: loading stress, stability information and avoiding overload. Masters and owners must not take a vessel to sea without loading stress information and approved stability information on board (ss 22(1), 23(1)). The Order defines overloaded and sets how to determine the appropriate load line (ss 24-25). The master has a specific duty not to take a vessel to sea if these documents are absent (ss 22(1), 23(1)).

Notification and logbook duties. Owners and masters must notify AMSA and issuing bodies of alterations before they are made (s 27). The master of a regulated Australian vessel must make prescribed entries in the official logbook according to the approved form, Parts II and III (s 26).

Rights to exemptions and equivalents, and administrative processes. Owners may apply to AMSA for exemptions and for approval to use equivalents, following the Marine Order 1 application process (ss 7-8). AMSA may grant exemptions where compliance would be unnecessary or unreasonable and where the exemption does not contravene the Convention (s 7(3)). AMSA may approve equivalents only if they are at least as effective and consistent with the Convention (s 8(3)). Owners have the procedural right to apply under the processes in Marine Order 1 (notes to ss 7-8, s 10(2)), and decisions about safety certificates are reviewable under subsection 313(1) of the Navigation Act (note to s 10(2)).

Variation and revocation criteria. Certificates may be varied where certain survey criteria are met and where variations relate to specific Article 19 matters (s 12). Certificates may be revoked for enumerated reasons such as structural alteration requiring increased freeboard, lowered structural strength making the vessel unsafe, breach of certificate conditions or cessation of Australian registration (s 13).

Approval allocation. The Order gives issuing bodies specific approval functions, for example approval of loading stress and stability information for regulated Australian vessels (ss 22(2)(a), 23(2)(a)); for foreign vessels equivalent approvals rest with the flag Administration (ss 22(2)(b), 23(2)(b)). That allocation prescribes who must be satisfied before the duty on masters to carry documentation is released.

Penalty and civil liability regime. The Order defines strict liability offences and parallel civil penalty liability for certain failures, with a specified quantum of 50 penalty units per contravention (ss 22-23, 28). It also references other Navigation Act offences for taking vessels to sea without certificates and for unseaworthy vessels (notes to ss 9, 24 and ss 20-21).

Delegation and incorporation. The Order notes that AMSA may delegate powers under the Order and may adopt or incorporate instruments in force from time to time (s 3(4); note to s 4; note to s 5 on IMO circulars). That structure creates administrative rights for AMSA in how the Order is implemented.

The Order establishes a mix of criminal penalties, strict liability infractions and civil penalties targeted at specific operational failures. The most prominent monetary sanction is 50 penalty units, applied in several contexts.

Specified strict liability offences with 50 penalty units. The master or owner of a vessel must not take the vessel to sea if loading stress information required by Regulation 10(1) of Annex I to the Load Lines Convention is not on board. That prohibition is a strict liability offence with penalty 50 penalty units (s 22(1)-(3)). Similarly, the master must not take a vessel to sea if the stability information mentioned in Regulation 10(3) of Annex I is not on board; that is also a strict liability offence with penalty 50 penalty units (s 23(1)-(3)). The marking requirements for regulated Australian vessels contain the same structure: the master and owner must not take the vessel to sea if required markings are not in place; breach is an offence with penalty 50 penalty units and is strict liability (s 28(1)-(2)).

Civil penalties mirror criminal penalties. The same contraventions that attract criminal penalties also attract civil penalties of 50 penalty units: absence of loading stress information and stability information each attract a civil penalty of 50 penalty units (ss 22(4), 23(4)). The marking requirement contravention also attracts a civil penalty of 50 penalty units (s 28(3)). The Order therefore allows enforcement by either criminal prosecution or civil penalty proceedings for those defaults, consistent with the Navigation Act’s broader enforcement framework referenced in s 3(1)(f).

Offences for carrying to sea without required certificates and unseaworthy vessels. The Order notes that it is an offence under sections 103 and 104 of the Navigation Act if a vessel is taken to sea without a specified certificate in force (notes to ss 9 and 20). It also notes that taking an unseaworthy vessel to sea is an offence under sections 109 or 110 of the Navigation Act (note to s 24). The Order therefore sits within the Navigation Act enforcement architecture and cross-references those statutory offences for additional criminal exposure.

Revocation and variation as enforcement levers. The Order lists criteria for variation and for revocation of certificates. A certificate may be revoked on a list of grounds that includes structural alteration requiring increased freeboard, materially lowered structural strength making the vessel unsafe, breaches of certificate or exemption conditions, cessation of Australian registration, written request by the owner, or incorrect information in the certificate (s 13). Variations require surveys, and endorsements must be made by issuing bodies (s 12; s 16). Those administrative mechanisms allow AMSA and issuing bodies to use certificate status as means to enforce compliance.

Administrative process and review. Applications for certificates, exemptions and equivalents are handled in accordance with Marine Order 1 (Administration) 2013 (notes to ss 7-8, s 10(2)). The Order expressly excludes section 17 of Marine Order 1 (internal review) for safety certificates and points to review rights under subsection 313(1) of the Navigation Act for decisions about safety certificates (note to s 10(2)). That means decisions about certificates are reviewable under the Navigation Act, while other application decisions follow Marine Order 1 procedures.

Allocation of enforcement responsibilities by vessel type. For regulated Australian vessels, AMSA and issuing bodies carry the approval and enforcement burden (s 5(1); ss 22(2)(a), 23(2)(a), 16, 19). For foreign vessels, enforcement in relation to approvals rests with the flag Administration, but Australian enforcement can still be applied through the Navigation Act’s port-state controls where the Order applies to foreign vessels (s 6; Division 3). The Order thereby combines flag-state certification duties with port-state enforcement consequences.

Strict liability label and evidential implications. The imposition of strict liability for the absence of loading stress, stability information or markings means that prosecution does not require proof of fault beyond the physical absence of the document or marking (ss 22(3), 23(3), 28(2)). That lowers the evidential threshold for enforcement action in those areas.

Consistency with international forms and schedules. Certificates must be in the form set out in Annex III to the Load Lines Convention and survey criteria reference Annex I and Article 14 (s 4 definitions; s 14). Use of prescribed international forms reduces dispute about certificate content in enforcement, but it also embeds international instruments by reference.

The Order is explicitly made under, and functions as an instrument subordinate to, the Navigation Act 2012. Section 3 of the Order lists specific enabling provisions in that Act, including sections relating to safety certificates (s 98), logbooks (s 309), overloaded vessels (s 113), certificates (s 314), giving effect to the Load Lines Convention (par 340(1)(d)) and imposition of penalties and civil penalties (subsection 341(1)) (s 3(1)). The Order therefore integrates with the Navigation Act’s existing offence and enforcement architecture.

Cross-reference to Marine Order 1 (Administration) 2013. Application processes for certificates, exemptions and equivalents are delegated to the application process set out in Division 3 of Marine Order 1 (notes to ss 7-8 and s 10(2)). The Order also excludes section 17 of Marine Order 1 (internal review) for safety certificates and refers decision review to subsection 313(1) of the Navigation Act (note to s 10(2)). That means procedural timelines, application forms, information requests, and the imposition of conditions are managed under Marine Order 1, creating administrative continuity across Marine Orders.

Interaction with SOLAS and Load Lines Convention. The Order gives domestic effect to the Load Lines Convention and, where applicable, to SOLAS provisions. It applies SOLAS subdivision and draft mark requirements for passenger vessels and references the SOLAS regulations (ss 15(c)-(d); note to s 23). It requires the International Load Line Certificate to be in the Annex III form and uses Annex I and Article 14 for surveys and freeboard assignment (s 4 definitions; ss 14-15). For vessels where SOLAS applies, other SOLAS requirements (for example, detailed stability or inclining tests) are noted to be relevant (note to s 22 and note to s 23). Thus the Order functions as the domestic mechanism for enforcing and coordinating compliance with these international instruments.

Port-state and flag-state interplay. Section 5(1) clarifies that, for foreign vessels, the Administration referenced in the applied convention provisions is the flag Administration. The Order therefore continues the international division between flag-state certification and port-state enforcement. Division 3 requires foreign vessels to have certificates and maintain markings and records consistent with their flag Administration or the Convention when it applies (ss 20-21). This creates a port-state verification obligation for Australian authorities and may trigger enforcement under the Navigation Act if foreign vessels lack proper documentation or are unseaworthy while in Australian waters.

Incorporation of IMO guidance and external documents. The Order instructs that unified interpretations published by the IMO be taken into account (s 5(3)) and lists specific IMO circulars relevant to compliance (note to s 5). It also notes the relevance of IMO Resolution A.1186(33) on survey guidelines (note to s 14) and that forms and protocols (Protocol of 1988) contain the record of conditions of assignment (note to s 14). Section 3(4) authorises Marine Orders to apply, adopt or incorporate any matter contained in an instrument or document in force from time to time; that mechanism allows obligations to change in practice as international instruments are amended.

Delegation and administrative law overlay. The Order notes that AMSA may delegate powers under the Marine Order (note to s 4). Because the Order relies on Marine Order 1 for application processes and the Navigation Act for reviewable decisions, administrative law principles, internal review requirements and external review pathways under the Navigation Act will govern many operational decisions under the Order.

Interaction with criminal and civil penalty regimes. The Order creates strict liability offences and civil penalties for operational failures, and it references other Navigation Act offences for taking vessels to sea without required certificates or for taking unseaworthy vessels to sea (notes to ss 9, 20, 24). Therefore enforcement can proceed under multiple statutory instruments and via different legal vehicles, including criminal prosecution, civil penalty proceedings and certificate revocation.

This Marine Order begins life as a single consolidated instrument, noting a direct mechanical change in the statutory corpus. The Order repeals Marine Order 16 (Load lines) 2014 and commences on 1 September 2025 (ss 1A, 1B). The text does not record earlier amendments beyond the repeal. The Order expressly relies on the Navigation Act as the enabling statutory layer and incorporates, adopts or applies provisions of the Load Lines Convention, Protocol of 1988 and SOLAS by reference (s 3(4); s 4 definitions; notes throughout).

The Order also creates a structure for future change by reference. Section 3(4) permits a Marine Order to apply, adopt or incorporate any matter contained in an instrument or document in force or existing from time to time. The Order’s reliance on IMO circulars, IMO resolutions and annexes to the Load Lines Convention signals that future amendments at the international level may effectively alter the practical obligations on Australian vessels and issuing bodies without an amendment to the Marine Order itself, to the extent those instruments are applied by reference (s 5(3) and related notes; note to s 14). The Order leaves open AMSA’s ability to exercise delegation and administrative change, noting delegation details on the AMSA website (note to s 4).

Procedural amendments and administrative changes will be implemented pursuant to Marine Order 1 for application processes and for the administrative detail of exemptions and equivalents (notes to ss 7-8 and s 10(2)). The Order excludes internal review for safety certificate decisions under Marine Order 1 and directs those reviews to subsection 313(1) of the Navigation Act (note to s 10(2)), which constrains amendment pathways for administrative review processes.

Because the Order incorporates international forms (Annex III certificates, Annex I freeboard assignment, SOLAS regulations), changes to those international instruments or to the unified interpretations published by the IMO are flagged as relevant (s 5(3); notes). The Order’s text therefore signals that its effective content can change through international amendments or through AMSA administrative practice, without explicit amendment to the Marine Order in every instance.

The text contains multiple notes directing users to the AMSA website and to the Australian Treaties Library on AustLII for current texts of international instruments and for delegation arrangements (note to s 4; note to s 5). Those notes indicate how implementational changes will be disseminated rather than showing a formal domestic amendment history within the instrument itself.

The text of Marine Order 16 (Load lines) 2025 does not include any case law or litigation history. It references statutory offences in the Navigation Act that may give rise to prosecutions (notes to ss 9, 20 and s 24 referencing sections 103, 104, 106, 107, 109 and 110 of the Navigation Act). It also references review under subsection 313(1) of the Navigation Act for decisions about safety certificates (note to s 10(2)). Beyond those cross-references, the Order itself does not name any cases, nor does it provide judicial interpretations of its provisions.

Practitioners should note that the Order adopts international instruments and IMO circulars, and these documents may themselves be the subject of legal contest in administrative or judicial review proceedings when AMSA makes discretionary decisions (e.g. exemptions, equivalents, endorsements, revocation). The Order points to Marine Order 1 for application processes and to the Navigation Act for review rights, which means any litigation challenging an AMSA or issuing body decision about a certificate, exemption or equivalent will be conducted under the administrative law framework in those instruments. The Order specifically excludes internal review under section 17 of Marine Order 1 for safety certificates and directs review under the Navigation Act (note to s 10(2)), which shapes the procedural path for litigation.

Because the Order makes several offences strict liability and creates civil penalty liability, contested enforcement actions could give rise to both criminal and civil litigation, as well as administrative review of enforcement decisions. The Order does not, however, include any reported judicial interpretations, and it contains no case names or litigation summaries.

Given the Order’s reliance on international instruments and on issuing body practice, disputes may surface about the proper interpretation of Annex I freeboard rules, conditions of assignment, survey adequacy under Article 14, and the scope of exemptions and equivalents. Those disputes would be adjudicated against the domestic instrument (this Order), the Navigation Act, Marine Order 1 procedures and any relevant international instruments adopted by reference. The Order itself does not identify any precedents or a litigation record.

The Order creates a number of operational and legal traps that are concrete and source-grounded.

Incorporation by reference can change obligations without parliamentary amendment. Section 3(4) permits Marine Orders to apply, adopt or incorporate instruments in force from time to time. The Order also directs operators to take into account IMO unified interpretations and certain IMO circulars (s 5(3) and note). In practice, that means obligations can shift when the relevant international instruments or IMO guidance are updated, which may produce compliance costs if owners or issuing bodies do not monitor these external sources.

Strict liability offences for missing documents or markings. The Order makes the absence of loading stress information, stability information and specified markings strict liability offences (ss 22(3), 23(3), 28(2)). Strict liability reduces the operator’s ability to rely on excuse or lack of fault; the mere absence of the document or marking is sufficient to ground criminal exposure and parallel civil penalties (ss 22(1)-(4), 23(1)-(4), 28(1)-(3)).

Duplication of criminal and civil exposure. For the same contraventions the Order provides both criminal penalties and civil penalties of the same quantum (50 penalty units) (ss 22-23, 28). That duplication means regulatory agencies have multiple enforcement tools and owners face overlapping exposure for a single lapse.

Delegated approvals and practical reliance on issuing bodies. Many approvals and endorsements must be made by issuing bodies (ss 16, 19; ss 22(2)(a), 23(2)(a)). Where issuing bodies are industry-affiliated or delegate functions to classification societies, owners should note that AMSA’s practice and delegation arrangements (referred to in the note to s 4) determine which bodies are competent to endorse. Failure to secure the correct issuing-body endorsement will cause certificate invalidity risk and potential enforcement.

Administrative discretion in exemptions and equivalents. AMSA may grant exemptions and approve equivalents subject to specified criteria (ss 7-8). The statutory criteria are relatively general: exemptions where compliance would be unnecessary or unreasonable and where the exemption would not contravene the Convention (s 7(3)); equivalents only if at least as effective and consistent with the Convention (s 8(3)). The breadth of these criteria creates uncertainty on what will be accepted in practice and places an evidence-gathering burden on applicants.

Reference to SOLAS and passenger vessel particulars. The Order requires SOLAS-specific markings and tests where SOLAS applies, including subdivision load lines and draft marks in certain positions (ss 15(c)-(d); s 28(1)). Operators of passenger vessels must reconcile the Order’s Load Lines obligations with SOLAS Chapter II-1 requirements. The Order depends on cross-application of SOLAS regulations, which can complicate compliance if a vessel’s SOLAS status is contested.

Overload definition uses specific gravity 1.025. The test for overload measures flotation “without a list in still salt water of a specific gravity of 1.025” (s 24(2)-(3)). Practically, that requires either knowledge of sea water density or conservatism in loading practices. In voyages where water density could differ materially, masters must be aware of this benchmark.

Markings must be in the position specified in the Load Line Certificate. The Order requires that the vessel be marked “in the position specified in its Load Line Certificate” with deck line and load line (s 28(1)(a)). That means a mismatch between the certificate position and physical marks risks an offence. Owners proposing structural alterations must secure approval because unnotified or unapproved alterations that require increased freeboard can be grounds for revocation (ss 13, 27).

Logbook entry specificity. The Order requires masters to make entries in the official logbook mentioned in Parts II and III of the approved form (s 26). Owners and masters cannot rely on ad hoc record-keeping; they must adhere to the approved logbook format prescribed elsewhere.

Foreign-flagged vessel complexities. For foreign vessels, approvals and documentation depend on the flag Administration, but Australian authorities still require proof of compliance while in Australian waters (ss 20-21; ss 22(2)(b), 23(2)(b)). That creates potential port-state enforcement, and owners of foreign vessels must ensure flag-state documents are accessible and up to date when visiting Australian ports.

Certificate revocation grounds are fact-specific. The revocation criteria include lowered structural strength making the vessel unsafe or breaches of certificate/exemption conditions (s 13). Those grounds could be triggered by post-survey events or by factual disputes about structural strength, potentially leading to certificate revocation and associated operational disruption.

Administrative review channel limitations. The Order excludes an internal review pathway under Marine Order 1 for safety certificates and directs review under subsection 313(1) of the Navigation Act (note to s 10(2)). Practitioners should map their review and appeal strategies to the Navigation Act regime rather than relying on Marine Order 1 internal review mechanisms for certificate decisions.

Map responsibilities and set administrative controls. Owners and operators should map which vessels fall within the Order (s 6), determine whether they are regulated Australian vessels or foreign vessels, and identify relevant Administrations and issuing bodies (s 5(1)). Primary duties, survey, marking, documentation, logbook entries and notification of alterations, are distributed across owners and masters (ss 14-15, 22-23, 26-28). Assign clear internal roles: owners to secure surveys, issuing-body approvals, certificates and equivalents/exemptions where relevant; masters to verify documents are on board and to make logbook entries and to refuse to take the vessel to sea if required documentation or markings are absent (ss 22(1), 23(1), 26).

Certificates and surveys. For vessels to which the Load Lines Convention applies or would apply, ensure International Load Line Certificates or International Load Line Exemption Certificates are in force in the Annex III form and are properly endorsed by an issuing body (ss 9-11; s 16; s 19). Arrange timely initial and renewal surveys under Article 14 and Annex I and ensure freeboards are assigned and recorded in the record of conditions of assignment carried on board (s 14). Track annual survey cycles and ensure endorsements of annual surveys on the certificate as required (s 15(e)).

Maintain and document loading stress and stability information. Obtain and keep on board approved loading stress information and stability information in accordance with Regulation 10 of Annex I to the Load Lines Convention (ss 22(1)-(2); s 23(1)-(2)). For regulated Australian vessels, secure issuing-body approval; for foreign vessels, secure flag Administration approval. Treat these approvals as strict requirements because absence is a strict liability offence and attracts a civil penalty (ss 22(3)-(4), 23(3)-(4)).

Marking and physical maintenance. Ensure deck line, load line, subdivision load line where SOLAS applies and draft marks are correctly and permanently indicated in the positions specified in the vessel’s Load Line Certificate and meet SOLAS regulation requirements where applicable (ss 15(b)-(d); s 28(1)). Maintain the fittings and appliances for protection of openings, freeing ports, guard rails and crew access in effective condition (s 21(1)(c); s 15(a)). Where physical modifications are contemplated, notify AMSA and issuing bodies before changes are made (s 27) and obtain requisite surveys and approvals to avoid revocation grounds (s 13).

Prevent overload by operational practice. Use assigned load lines and records to determine appropriate loading limits for season and zone (s 25). For cargo planning, apply the specific gravity 1.025 benchmark and ensure the vessel would not float with the appropriate load line submerged or, for passenger vessels, with the appropriate subdivision load line submerged (s 24). When planning voyages that change the appropriate load line (s 24(2)(b)), account for consumable fuel and material where relevant to avoid the second-load-line scenario becoming a compliance breach.

Use exemptions and equivalents where justified. If a vessel embodies novel features, has lower bow height or is otherwise unable to comply practically, prepare an AMSA application for exemption or an approval application for an equivalent under the Marine Order 1 process (ss 7-8; notes). Document the evidence that compliance would be unnecessary or unreasonable, or that an equivalent is at least as effective and consistent with the Convention (ss 7(3), 8(3)). Be aware that AMSA will impose conditions and that exemptions must not contravene the Convention (s 7(3)).

Administrative record-keeping and logbooks. Use the approved form of the official logbook and make the entries required by Parts II and III for regulated Australian vessels (s 26). Keep copies of certificates, records of conditions of assignment and any exemptions or equivalents on board, as the notes indicate owners should attach exemption copies to the record of conditions of assignment (note to s 7).

Monitor international instruments and AMSA practice. Because the Order incorporates international instruments by reference and directs attention to IMO unified interpretations and circulars, maintain a process to monitor relevant IMO circulars, resolutions and updates to the Load Lines Convention and SOLAS (s 5(3); notes). Check AMSA’s Marine Orders page for delegation and implementation guidance and for changes in the list of issuing bodies or endorsed practices (note to s 4).

Prepare for enforcement exposures. Recognise that several offences are strict liability and can be enforced criminally or by civil penalty (ss 22-23, 28). Establish pre-departure checklists to verify the presence and validity of loading stress and stability information, correct marks and certificates. Keep digital and paper copies readily accessible for port-state or flag-state inspection.

Plan for certification contingencies. Where an issuing body is used for endorsements or approvals, confirm that the issuing body has authority to endorse and that endorser identity is aligned with the original issuing body where practice suggests this will be relevant (s 16 note). For foreign vessels visiting Australia, ensure flag-state documentation is current and that any required approvals are accessible to demonstrate compliance in port (ss 20-21; ss 22(2)(b), 23(2)(b)).

Map review and appeal pathways. For certificate-related decisions, be ready to use the Navigation Act review process under subsection 313(1) rather than internal review under Marine Order 1 section 17, which is excluded for safety certificates (note to s 10(2)). Keep application records and correspondence under Marine Order 1 processes to support any administrative or judicial review.

In summary, compliance requires three parallel workstreams: technical (surveys, marks, stability/loading documentation), administrative (applications, endorsements, logbook entries, notifications) and monitoring (international instrument changes and AMSA/issuing body practice). Each duty is tied to statutory penalties and administrative levers specified in the Order (ss 11-19; ss 22-28).
