28 Hours of rest

(1) The owner of a regulated Australian vessel must ensure that a seafarer has at least the minimum hours of rest in accordance with Division 3 of Marine Order 28 (Operations standards and procedures) 2025.

(2) The owner of a regulated Australian vessel must ensure that records of seafarers’ daily hours of rest are maintained in accordance with Division 3 of Marine Order 28 (Operations standards and procedures) 2025.

(3) The master of the vessel must:

(a) give each seafarer a copy of the record relating to him or her; and

(b) ensure that the record is endorsed by the master or a person authorised by the master and the seafarer.

(4) An offence against subsection (1), (2) or (3) is a strict liability offence.

(5) A person is liable to a civil penalty if the person contravenes subsection (1), (2) or (3).
