Marine Navigational Aids Act 1973

Marine navigational aid is defined broadly in section 2. It means a lighthouse, light ship, port light, buoy, beacon, signal, or other structure, mark, device or apparatus that is or is intended to be an aid to marine navigation, and includes a radio beacon or an electronic aid. This covers traditional physical fixed and floating aids as well as modern radio and electronic systems. The phrase “or is intended to be” means the coverage extends to things not yet functioning as aids if they are designed for that purpose. The definition is inclusive rather than exhaustive: “other structure, mark, device or apparatus” is open-ended, giving flexibility to cover future technological developments.

Chief executive officer is defined as the chief executive officer of the department. The “department” is the department of the Public Service principally assisting the Minister in the administration of this Act. In practice this is likely the Department of Transport (as indicated by the 1993 amendments). The CEO is the key State decision-maker under the Act for aids outside port authority boundaries.

Port authority means a port authority established under the Port Authorities Act 1999. These are statutory corporations that manage individual ports. The Act gives them concurrent powers with the CEO in relation to the approaches to the port under their control and management. The interface between CEO and port authority is governed by section 3(1A): the CEO cannot establish an aid within port boundaries without the port authority’s agreement. This division of authority creates a potential for jurisdictional disputes but is intended to ensure port authorities retain control over aids that directly affect port operations.

Fishing boat is defined in section 3A(3) as a vessel licensed, or required to be licensed, by or under the Fish Resources Management Act 1994 or the Pearling Act 1990. This captures commercial fishing and pearling vessels. The definition does not include recreational fishing boats unless they are required to be licensed under those Acts (they generally are not). The fee obligation therefore falls squarely on the commercial fishing and pearling sectors. The uncommenced provision in the Aquatic Resources Management Act 2016 would replace this definition with a reference to that Act, but that has not yet been proclaimed.

Good faith is the critical qualifier in the immunity provision of section 4. It is not defined in the Act. At common law, good faith generally means an absence of malice or dishonest intent. Negligence alone does not negate good faith; the defendant must have acted honestly, even if carelessly. This makes the immunity very difficult to overcome. The onus would be on a plaintiff to prove that the defendant did not act in good faith, which is a heavy evidentiary burden.

Delegation under section 6 is limited to the CEO. It must be in writing and signed. The delegate cannot sub-delegate. The section does not confer a power on a port authority to delegate; port authorities would rely on their own enabling legislation. The CEO may also perform functions through officers or agents without formal delegation, preserving administrative flexibility.

The Act directly affects several distinct groups. The department and its CEO are the primary State actors. The CEO has the power to establish, maintain and control aids outside port boundaries, and the duty to maintain aids under his or her control. The CEO can delegate these powers to departmental officers. The department collects fees from fishing boats under section 3A.

Port authorities are affected in relation to the approaches to their ports. They have the same powers as the CEO within their jurisdiction, but they also have a veto over the CEO establishing aids within port boundaries (s 3(1A)). They are also immune from civil liability under section 4 when acting in good faith. Port authorities are likely to bear the cost of maintaining aids in their areas, and they can enter into agreements with private parties to take over control of aids on terms that include reimbursement of expenses.

Owners, lessees and bailees of marine navigational aids are affected in two ways. If they transfer control of an aid to the department or a port authority under section 3(1)(aa), they shed the ongoing maintenance obligation and the risk of liability for defects, but they must pay for the costs incurred by the public authority in maintaining, altering or removing the aid. They also gain the protection of section 4(e): no civil action lies against them by reason of any act, matter or thing done or omitted in good faith in relation to, or by reason of any defect in, the aid after control is transferred. This protects them from claims arising from defects or failures after the transfer, as long as they acted in good faith before the transfer.

The fishing industry is directly affected by the fee regime in section 3A. Owners of fishing boats must pay prescribed fees for the provision of aids outside port boundaries. The fees are set by regulation; the Act gives no cap or formula. The regulations may exempt certain classes of fishing boats, but the Act does not guarantee any exemption. This is a targeted tax on commercial fishing and pearling operators for aids that also benefit other maritime users. There is no equivalent fee on recreational vessels, commercial shipping, or other vessel types, meaning the cost of navigational aids in coastal waters is borne disproportionately by the fishing industry.

Mariners and the public generally are affected by the availability and reliability of navigational aids, but they have no private right of action if an aid fails and causes damage, unless they can prove bad faith. The Act immunises the State and its officers from negligence claims arising from defective aids. This reduces the incentive for the State to invest in maintenance at a level that might otherwise be required to avoid tort liability. It is a form of sovereign immunity codified for this specific context.

Potential defendants in criminal proceedings are anyone who wilfully or negligently damages or interferes with an aid. This includes not only vandals but also operators of vessels who negligently collide with buoys or beacons. The penalty of $12,000 is substantial, and the court can also order full restitution for damage. The Act does not limit liability to intentional acts; negligence is sufficient.

The central duty is imposed by section 3(1)(d): the CEO and each port authority shall maintain every such aid under its control. This is a statutory duty of care imposed on public authorities. Failure to maintain could be a breach of statutory duty, but the section 4 immunity would likely bar any civil claim for damages caused by that failure, provided the failure occurred in good faith. The duty to maintain is not absolute; it is subject to the resources and priorities of the authority. However, it creates an obligation to take some positive steps to keep aids operational.

The power to establish, add, alter, or remove aids is discretionary. The CEO and port authorities may do so, not must. This means decisions about where and when to place aids are policy matters not readily reviewable in court. The only fetter on the CEO’s power to establish aids in port areas is the requirement of port authority agreement under section 3(1A). That gives the port authority a qualified right to veto.

The power to enter into agreements with private parties under section 3(1)(aa) is a right to acquire control of privately established aids. This transfers the burden of maintenance to the public authority but also subjects the private party to a contractual obligation to pay for those costs. The agreement must explicitly address expense payment (s 3(3)(b)). The private party does not have a right to force the public authority to take over an aid; it is at the authority’s discretion.

Fishermen have a right to use the aids, but that right is contingent on payment of the prescribed fees (s 3A). The Act does not say that failure to pay fees is an offence; the fee is payable to the department, and recovery may be as a debt or through some other mechanism. The regulations may prescribe consequences. The Act also does not say that only those who pay may use the aids; the fee is levied per boat, not per use. So a fishing boat owner who does not pay still benefits from the aids but may face administrative penalties.

The broadest right conferred by the Act is the right to immunity from civil action under section 4. This benefits the State, officers, port authorities, and private parties who have transferred control of aids. The immunity covers acts or omissions done in good faith. It is a significant shield against liability for negligence, nuisance, or breach of statutory duty. The Act does not require the defendant to be acting within the scope of employment or authority; it simply requires good faith for the purposes of the Act. This means even an officer acting beyond his or her standard duties might be protected if they subjectively believed they were furthering the Act’s purposes.

The public has a right to report damage? The Act does not create a right but section 7(2)(a) allows regulations to require reporting of incidents that result in damage to an aid. That would impose a duty on the person who caused the damage or perhaps on witnesses.

The primary offence is in section 5(1): a person who wilfully or negligently does anything which causes damage to or interferes with the operation or use of an aid so as to hinder its effective operation or use commits an offence. The maximum penalty is a fine of $12,000. Notably, the section does not require proof of intent to damage; negligence is sufficient. This means a vessel operator who accidentally collides with a buoy and damages it, but who failed to keep a proper lookout, could be convicted. The threshold is “hinders the effective operation or use” - temporary interference might suffice.

In addition to the fine, the court may order the convicted person to pay the amount of the damage or the cost of repairing, replacing or reinstating the aid (s 5(2)). This is a civil restitution order attached to the criminal proceeding. The court has discretion; it is not automatic. The amount is not capped beyond the actual damage or cost. For a large aid such as a major lighthouse, this could be a substantial sum.

Section 7(2)(e) allows regulations to create further offences with a maximum penalty of $12,000. The regulation-making power is broad and not limited to specific topics; the listed matters in section 7(2) are examples, not an exhaustive list. So a regulation could create an offence for failing to pay fees, failing to report an incident, attaching a vessel to an aid, or using a vessel in a way that might damage an aid. The regulation may also provide for the same restitution order power as in section 5(2) (s 7(2)(f)). This gives the executive significant flexibility to expand the criminal law without primary legislation.

Enforcement is not detailed in the Act. No specific inspectors are appointed by the Act; enforcement would be by police, departmental officers, or perhaps state marine officers under other legislation. The Act does not create powers of arrest, search, or seizure. The regulations could create those powers if consistent with the Act, but the Act itself does not authorise them. A person who obstructs enforcement might be guilty of an offence under another law (e.g., Criminal Code) but not under this Act unless the regulations so provide.

The penalty of $12,000 is set in the Act and is not inflation-indexed. As a 1973 Act with only minor penalty amendments in 2019 (changing from an earlier figure), the real value of the fine has eroded. The court also has the option of ordering payment of damage costs, which is not capped. That is the more meaningful financial deterrent.

There is no mens rea beyond negligence for the section 5 offence. The Act does not require that the defendant knew the object was a navigational aid; it is enough that he or she did the act that caused damage or interference. Ignorance of the object’s status is not a defence unless it goes to whether the act was voluntary or negligent.

The Act interacts primarily with Western Australian legislation dealing with ports and fisheries. The definition of port authority cross-references the Port Authorities Act 1999. That Act governs the establishment, powers and duties of port authorities. Section 3(1A) of this Act gives port authorities a veto over CEO establishment of aids within port boundaries, which means that the Port Authorities Act’s provisions on port management are the baseline. In effect, the Marine Navigational Aids Act delegates part of the coastal aid system to port authorities for their areas.

The definition of fishing boat in section 3A(3) incorporates the Fish Resources Management Act 1994 and the Pearling Act 1990. This means that if those Acts change their definitions or licensing requirements, the scope of the fee obligation changes automatically without amendment to this Act. If a vessel is no longer required to be licensed under those Acts, it ceases to be a fishing boat under this Act and the fee no longer applies. Conversely, if the licensing regime expands, more vessels become subject to the fee.

The uncommenced provision in the Aquatic Resources Management Act 2016, section 368, would amend the definition of fishing boat in section 3A(3) to refer to the Aquatic Resources Management Act 2016 instead of the Fish Resources Management Act 1994 and the Pearling Act 1990. This is a consolidation of fisheries legislation. When it commences, the fee obligation will follow the new Act’s definition of fishing boat. Until then, the old definition remains.

The Act is silent on interaction with Commonwealth navigation laws. The Commonwealth Navigation Act 1912 (now largely replaced by the Marine Safety (Domestic Commercial Vessel) National Law) and the Australian Maritime Safety Authority Act 1990 may impose standards for aids to navigation. The Western Australian Act does not exempt aids from Commonwealth standards. A port authority or CEO establishing an aid must ensure it complies with any applicable Commonwealth requirements. The immunity in section 4 would not protect against a Commonwealth prosecution, only against civil actions.

The Act does not interact with planning or environmental laws in the text. However, establishing a lighthouse or buoy may require approvals under the Environmental Protection Act 1986 (WA) or the Planning and Development Act 2005 (WA). The Act does not override those requirements.

Section 4 immunity may interact with the Crown Suits Act 1947 (WA) and the common law. The Crown can be sued for torts of its servants, but section 4 specifically bars any civil action against the State for matters within its scope. This overrides the general position that the Crown is liable for its servants’ negligent acts. It is an exception to the rule.

The Act was originally enacted in 1973 (No. 27 of 1973) and has been amended five times. The first amendment, the Marine Navigational Aids Act Amendment Act 1977 (No. 66 of 1977), altered section 3 but the specific changes are not detailed in the compilation table beyond the section reference. The Marine Navigational Aids Act Amendment Act 1978 (No. 83 of 1978) inserted section 3A, creating the fishing boat fee regime. That amendment took effect on 1 July 1985, nearly seven years after assent, indicating a delayed implementation to allow regulation-making.

The 1980 amendments (No. 31 of 1980) amended section 4 and section 5. The 1993 Acts Amendment (Department of Transport) Act (No. 47 of 1993) amended section 2, presumably to update the definition of department following the creation of the Department of Transport. The 1994 Fish Resources Management Act (No. 53 of 1994) amended section 3A(3) to replace the definition of fishing boat to refer to the new fisheries Act. That amendment commenced on 1 October 1995.

The most substantial recent amendments came via the Ports Legislation Amendment Act 2019 (No. 2 of 2019), which inserted the current section 6 (delegation) and section 7 (regulations), and amended sections 2, 3, 3A and 5. Section 2 was amended to update the definition of port authority to refer to the Port Authorities Act 1999. Section 3 was amended to add subsection (1A) (the consent requirement for CEO aids in port boundaries). Section 3A was amended to update language. Section 5 was amended to increase the penalty to $12,000 and to clarify the restitution power. Section 6 and 7 were entirely new, replacing the former regulation power which had been in an earlier version.

The compilation table shows a reprint as at 31 May 2002. The uncommenced provisions table notes that section 368 of the Aquatic Resources Management Act 2016 (No. 53 of 2016) will further amend section 3A(3) but has not yet been proclaimed. This uncommenced provision will replace the cross-reference to the Fish Resources Management Act 1994 and Pearling Act 1990 with a reference to the Aquatic Resources Management Act 2016. The delay in proclamation may be because the Aquatic Resources Management Act 2016 itself has not fully commenced.

The source text provides no litigation history. No cases are cited, mentioned or incorporated in the Act. The compilation table and notes contain no references to judicial decisions. This is consistent with a small, largely administrative Act that has not generated significant reported litigation in Western Australia. The broad immunity in section 4 would deter civil claims, as any plaintiff would first need to establish lack of good faith, a difficult threshold. The lack of reported cases suggests that either no claims have been brought, or claims have been settled or dismissed at an early stage, or that the immunity has been effective in preventing litigation. It is also possible that any litigation has occurred under other causes of action such as negligence or nuisance, but the immunity would quickly extinguish such claims. Without source citations, it would be improper to speculate on unreported cases.

The most significant trap is the breadth of the civil immunity in section 4. It covers not just the State and officers, but also “any officer of the department or a port authority or other person acting in good faith for the purposes of this Act”. The phrase “other person” could extend to contractors, volunteers or agents. The immunity applies to acts “done or omitted to be done in good faith, but whether negligently or otherwise”. This means that even gross negligence is immune if the actor was in good faith. A mariner who suffers loss because a buoy was not maintained, or because its light failed, has no claim unless they can prove bad faith - which is virtually impossible unless there is evidence of malice or dishonesty. This shifts the risk of navigational accidents onto the user of the aid.

The fee in section 3A applies to fishing boats, not to all vessel types. This is an asymmetric burden. A commercial fishing operator pays for aids that also benefit recreational boaters, commercial shipping, and other users. The Act does not require that the fees be set to reflect the cost of providing the aids; they are simply “at such rates as are prescribed”. The regulations could set fees that are revenue-raising rather than cost-recovery. There is no mechanism in the Act for fishing industry representation on the fee-setting process.

The definition of marine navigational aid is extremely broad. It includes “other structure, mark, device or apparatus that is or is intended to be an aid to marine navigation”. This could potentially cover things like a private mooring buoy that a boater intends to use for navigation reference, if it is intended as an aid. The Act does not require the aid to be officially designated; it is enough that it is intended as an aid. This means a person who casually sets out a temporary marker might unintentionally bring themselves within the ambit of the Act, though in practice the powers under section 3 are exercised only by the CEO or port authority.

The offence in section 5 applies to acts done “wilfully or negligently”. Negligence includes accidental damage resulting from a failure to take reasonable care. A vessel operator who misjudges the current and collides with a buoy could be criminally liable, even if there was no intent to damage. The penalty is a fine of $12,000, plus the cost of repairing the aid. Insurance may not cover a criminal fine. This is a strict result - negligence is enough.

The Act does not require that the marine navigational aid be established or maintained to any particular standard. There is no statutory duty to ensure an aid is fit for purpose. The duty to maintain is qualified by the immunity: even if an aid is defective, the authority is immune provided it acted in good faith. This creates a moral hazard: the incentive to invest in maintenance is weakened because liability for failure is removed.

The regulation-making power in section 7 is extremely broad. The Governor may make regulations “prescribing all matters that are required or permitted by this Act to be prescribed, or are necessary or convenient to be prescribed for giving effect to the purposes of this Act”. The listed matters in subsection (2) are not exhaustive. This could extend to creating new offences, imposing reporting duties, and requiring removal of attachments. The maximum penalty for a regulation-made offence is $12,000, the same as the primary offence. This gives the executive the ability to expand the scope of the Act significantly without further parliamentary approval. The Act contains no requirement for consultation before regulations are made.

Port authorities have a veto over CEO establishment of aids within port boundaries. If a port authority refuses agreement, the CEO cannot establish an aid. This could lead to a situation where aids needed for safety are not installed because of a dispute or differing priorities between the department and the port authority. There is no dispute resolution mechanism in the Act.

For fishing boat operators: ensure that the prescribed fees are paid to the department for each fishing boat on the dates set by regulation. Check whether exemptions apply for the specific class of boat. The Act does not specify how fees are to be paid or what happens if they are not paid; compliance means paying on time. Keep records of payment. If a fishing boat changes ownership, the new owner must ensure the fee obligation is met. The fee is per boat, not per trip.

For all vessel operators: avoid doing anything that might damage or interfere with a navigational aid. This includes not attaching ropes, lines, fenders or any other thing to a buoy or beacon (prohibition likely to be in regulations under s 7(2)(b)). Navigate with due care in the vicinity of aids. If collision occurs, report to the department or relevant port authority as required by the regulations. Do not attempt to remove or alter an aid. If you cause damage, you may face criminal prosecution and an order to pay repair costs, even if the damage was accidental but negligent.

For persons who have established or wish to establish a private navigational aid: if you intend to transfer control to the department or a port authority, enter into an agreement under section 3(1)(aa). The agreement must include terms for payment of ongoing expenses of maintenance, alteration or removal (s 3(3)(b)). Ensure the agreement is in writing and clearly defines which aid is transferred. After transfer, you gain immunity under section 4(e) for acts or omissions in good faith relating to the aid, but you must also satisfy any contractual obligations to pay expenses.

For the CEO and port authorities: exercise powers under section 3 in compliance with the Act. When establishing aids within a port authority’s boundaries, the CEO must obtain the port authority’s agreement. When entering into agreements under section 3(1)(aa), ensure the cost-reimbursement provision is included. Maintain all aids under control. To ensure the immunity in section 4 applies, act in good faith. This means making decisions honestly, without malice or improper purpose, and in the genuine belief that they are for the purposes of the Act. Document decision-making to demonstrate good faith. The CEO may delegate powers in writing; delegates must not sub-delegate. All officers and agents should be aware that they are protected only when acting in good faith.

For anyone potentially subject to a regulation: monitor the WA Government Gazette for regulations made under section 7. They may impose obligations to report damage, prohibitions on attaching things to aids, and requirements to detach vessels or things on direction. Non-compliance may result in a fine of up to $12,000 and an order to pay damage costs. The regulations may also specify exempt classes of fishing boats for fee purposes.

For legal practitioners advising clients: be aware that section 4 effectively precludes any civil claim for damage from defective aids unless you can plead and prove lack of good faith. That is an uphill battle. Consider alternative causes of action against parties not protected, such as manufacturers of aids, or claims under the Australian Consumer Law if the aid was supplied as part of a commercial transaction. Note that the Act does not bar claims against the wrongdoer for the intentional criminal damage under section 5; that is a criminal matter. For fee disputes, the Act does not prescribe a debt recovery mechanism, so the department may need to seek payment through debt recovery legislation.

For compliance officers: enforce section 5 offences where there is evidence of wilful or negligent damage. Gather evidence of damage, interference, and the hindering of effective operation. The penalty is $12,000 and restitution may be ordered. For regulation breaches, check the specific regulation for penalty details. No special search or seizure powers are given, so rely on general police powers or obtain a warrant if needed. Ensure that any enforcement action respects the immunity: if a defendant was acting in good faith for the purposes of the Act, they may have a defence to a civil claim but not to a criminal prosecution (section 4 only bars civil actions, not criminal proceedings).
