Marine Navigation Levy Collection Regulations 2018

The instrument’s core operational concepts are: exempt ship, prevented from putting to sea, refund, remission, the Collector’s duty, and the arithmetic for calculating refund/remission amounts. Each is defined or operationalised in the text and interacts with the Act.

• Exempt ship: Section 6 lists specific classes of vessels that are to be treated as exempt for the Act’s definition of "exempt ship". The list is prescriptive and covers foreign state ships (unless engaged in trade or carrying goods under freight or charter) (s 6(1)(a)), Australian Defence Force vessels (s 6(1)(b)), Commonwealth vessels including requisitioned or chartered ships (s 6(1)(c)), property of a State (s 6(1)(d)), ships used for State/Territory purposes (other than trade) (s 6(1)(e)), specified fishing and attendant vessels (s 6(1)(f)-(g)), vessels carrying only ballast and not engaged in cargo/passenger operations except tugs (s 6(1)(h)), recreational vessels per the Navigation Act 2012 (s 6(1)(i)), ships under 24 metres in tonnage length (s 6(1)(j)), ships used only for charitable purposes (s 6(1)(k)), cable-laying/repair ships (s 6(1)(l)), hospital ships (except where used in trade) (s 6(1)(m)), and small sailing ships under 500 Levy Act tons (s 6(1)(n)). Section 6(2) supplies two interpretive definitions relevant to exemptions: "property of any kind belonging to a State" adopts the meaning in s 114 of the Constitution, and "tonnage length" is measured for the purposes of the International Convention on Load Lines as in force for Australia on 1 October 2018.
• Prevented from putting to sea: Section 10 provides an operational definition. A ship is prevented on a day if at any time that day it is moored in harbour and not engaged in the ordinary employment of a merchant ship for hire or reward including loading/unloading; or is wrecked/stranded; or is laid up for repairs; or is prevented due to an industrial dispute. The provision thus ties the "prevention" concept to discrete, verifiable states rather than to more general impairment of sailing capability.
• Refund and remission: Sections 7 and 8 create a requirement that a Collector must refund or remit levy under specific temporal and factual conditions, and specify formulae to calculate amounts. Section 7 targets refunds where levy has been paid and the ship is prevented from putting to sea for more than 30 consecutive days with at least one of those days within the three‑month period starting on the day the levy became payable. Section 8 contains two remission rules: one (s 8(1)) for ships most recently paid for under s 7(1) of the Act where the ship was prevented on the day the levy becomes payable and prevented for more than 30 consecutive days up to and including the day before levy becomes payable; the other (s 8(2)-(3)) where the levy payable under s 7(1) becomes payable before the end of three months beginning on the day levy paid under s 7(2) or (3) became payable. Each remission uses a defined formula with variables A, N and Q (s 8(3)).
• Collector’s duty: Sections 7(1) and 8(1)-(2) use mandatory language "A Collector must refund" and "A Collector must remit", thereby imposing an administrative obligation. The instrument prescribes only the circumstances and arithmetic; it does not set out the procedural steps a Collector must follow to determine eligibility.

Other technical concepts: "Act" is defined in the instrument as the Marine Navigation Levy Collection Act 1989 (s 5). The instrument cross‑references external instruments for definitions (Navigation Act 2012, Fisheries Management Act 1991, Charities Act 2013, International Convention on Load Lines), meaning the instrument’s operation depends on those texts as in force or as specifically referenced (s 5 note; s 6(2)).

The instrument affects several distinct groups through its exemption and collection rules.

• Ship owners and operators subject to the levy regime under the Act: The regulations alter the circumstances in which a levy charge, once paid, may be reduced or refunded, and they define exemptions that remove levy liability for specified vessels (s 6; s 7; s 8). Although the instrument does not itself name the payer, the levy is payable under the Act’s sections referenced in these regulations; therefore the primary economic effect is on persons liable under the Act for payment of levy. The Act retains the substantive liability rules, while the regulations adjust collection outcomes.
• Collectors appointed under the Act: The instrument imposes duties on Collectors by requiring refunds and remissions under prescribed factual and temporal conditions (s 7(1) and s 8(1)-(2)). Collectors will need to determine eligibility under the instrument, apply the prescribed arithmetic, and accept payment by electronic funds transfer where appropriate (s 9).
• State and Territory agencies and vessels: The instrument explicitly exempts ships that are Commonwealth property, State property, or used for state or territory purposes (s 6(1)(c)-(e), s 6(3)). The instrument also interprets "property of any kind belonging to a State" by reference to s 114 of the Constitution (s 6(2)). This affects how state agencies budget for navigation services and interact with federal collection procedures.
• Defence and foreign states: The Australian Defence Force’s vessels are exempt (s 6(1)(b)). Vessels owned or operated by a foreign country are exempt except where the ship is being used in trade or carrying goods under freight or charter (s 6(1)(a)). These exemptions affect the obligation of foreign and defence shipping to account for levy exposure when operating in Australian ports.
• Fishing and related operations: Vessels used only in fishing or searching for or taking sedentary organisms under the Fisheries Management Act 1991 are exempt, together with attendant vessels (s 6(1)(f)-(g)), affecting commercial fishers whose operations are constrained to such activities.
• Charities, hospital ships, and recreational users: Vessels used only for charitable purposes per Part 3 of the Charities Act 2013 are exempt (s 6(1)(k)), and hospital ships are exempt unless used in trade (s 6(1)(m)). Recreational vessels are exempt as defined in the Navigation Act 2012 (s 6(1)(i)). These provisions specifically impact non‑commercial users and charities who might otherwise face levy obligations.
• Small vessels and minor commercial users: The instrument excludes small ships from levy liability by reference to physical metrics: ships less than 24 metres in tonnage length (s 6(1)(j)) and sailing ships with tonnage under 500 Levy Act tons (s 6(1)(n)). The tonnage length measurement is defined by reference to the International Convention on Load Lines as in force for Australia on 1 October 2018 (s 6(2)).

Practical immediate effects: affected parties must determine whether a vessel sits within one of the listed exempt categories (s 6). For those not exempt, operators must monitor the vessel’s status in relation to the definition of "prevented from putting to sea" (s 10) because long periods of prevention trigger refund or remission rules (ss 7-8). Collectors must administer these adjustments and accept electronic funds transfers (s 9). The instrument therefore reallocates administrative responsibilities between payers and Collectors and modifies the timing and quantum of net levies payable once the Act triggers liability.

The instrument imposes mandatory duties on Collectors and grants procedural rights to persons liable for levy in the form of refunds and remissions when specified conditions are met.

Collector duties

• Refund obligation: Section 7(1) uses mandatory language: "A Collector must refund an amount of levy, worked out under subsection (2), if" three conditions are satisfied: (a) levy has been paid under the specified subsections of the Act, (b) the ship is prevented from putting to sea on more than 30 consecutive days, and (c) any of those days falls within the three‑month period that begins on the day the levy became payable. The Collector therefore has a positive duty to calculate the refund using the formula in s 7(2) and to pay it.
• Remission obligation: Section 8(1) and (2) require the Collector to remit levy payable in certain circumstances. Section 8(1) mandates remission where levy has most recently been paid under s 7(1) of the Act and the ship was prevented on the day the levy becomes payable and for more than 30 consecutive days up to and including the day before the levy becomes payable. Section 8(2) mandates remittance where levy payable under s 7(1) becomes payable before the end of the three months beginning on the day levy paid under s 7(2) or (3) became payable. Section 8(3) prescribes the arithmetic for computing the remitted amount.
• Payment acceptance: Section 9 authorises payment of levy by electronic funds transfer to a Collector, and explicitly states this may be used for the purposes of paragraph 8(4)(c) of the Act. This is a collection duty to accept EFT.

Rights and entitlements of payers

• Right to refund: Where the conditions in s 7(1) are met, the person who paid the levy (the payer under the Act) is entitled to have an amount refunded by the Collector computed under s 7(2). The instrument secures a substantive right to reimbursement in prescribed circumstances.
• Right to remission: Under s 8(1)-(2), the payer is entitled to have levy remitted by the Collector where the ship’s prevented status meets the stated conditions and the arithmetic in s 8(3) yields the remitted amount.
• Right to pay by EFT: The instrument expressly allows payment by electronic funds transfer (s 9), which is a procedural right facilitating payment.

Operational requirements on payers and Collectors

• Proof and verification: The instrument does not set out documentary requirements or procedural steps for a payer to claim a refund or for a Collector to verify claims. The Collector's obligation is stated in mandatory terms, but the instrument is silent on application forms, timeframes for decision, or evidentiary thresholds. This silence means that, in practice, the Collector will need to rely on powers and procedures in the Act or administrative practice to determine eligibility and process refunds/remissions.
• Calculation complexity: The refund and remission amounts are determined by formulae that require calculating the number of days N in relevant windows, and the number of days in specified three‑month periods or quarters (P and Q respectively) (s 7(2) definitions; s 8(3) definitions). This creates a duty for payers to maintain records that permit accurate calculation and for Collectors to apply the formulae correctly.

Limits and absences

• No penalty provisions: The instrument contains no penalty clauses or enforcement sanctions for failure to pay levy; penalties, if any, are matters for the Act and the Levy Act (s 3). The instrument is primarily administrative in focus.
• Delegation or discretion: The mandatory language constrains a Collector’s discretion to refuse refunds/remissions where the statutory conditions are met. The instrument, however, leaves unspecified the finer administrative discretions (evidence sufficiency, timing of payment, offsetting against other debts), which are matters for the Collector and the Act’s overall framework.

The instrument itself does not create new penalties or criminal offences. Its enforcement focus is administrative: it prescribes when Collectors must refund or remit levy and the method of payment (s 7, s 8, s 9). Specific features relevant to enforcement and penalties are as follows.

Absence of penal provisions in the instrument

• The text contains no expressed penalty clauses, civil fines or criminal sanctions. It imposes duties (for example, "A Collector must refund") but provides no express enforcement mechanism within the instrument for failure by a Collector to perform those duties. Enforcement of Collector obligations, or penalties for non‑payment of levy by liable parties, must therefore be looked to in the Act and the Levy Act, not in these regulations (s 3).
• Because the instrument is made under the Act (s 3), any enforcement or sanctions for non‑compliance with levy obligations would derive from the enabling legislation. The instrument’s role is to set collection and adjustment rules, not to redefine enforcement mechanics.

Administrative enforcement levers

• Collector duty to refund/remit: The only direct compulsion in the instrument is the mandatory obligation on Collectors to perform refunds and remissions when statutory criteria are met (s 7(1), s 8(1)-(2)). In practice, enforcement of these duties will be administrative and subject to the Act’s internal review, complaint or appeal mechanisms if any exist at the Act level.
• Payment acceptance and receipt controls: Section 9 authorises electronic funds transfer as a method of payment. That provision may have operational enforcement effects: acceptance of EFT allows the Collector to record receipt, allocate payments, and apply reconciliations. It also removes a possible procedural barrier to payment, reducing disputes about payment method.

Potential enforcement friction points implied by the instrument

• Lack of procedural detail: The regulations do not set deadlines or procedural requirements for applications for refunds or remissions, nor do they specify the magnitude of evidence required. This may create administrative friction where Collectors and payers disagree about whether the factual conditions are met. Any resulting enforcement, dispute resolution or litigation would rely on the Act’s framework and general administrative law principles rather than on procedures in the instrument.
• Qualification by definitions and external instruments: The instrument imports definitions from other statutes and conventions (Navigation Act 2012, Fisheries Management Act 1991, Charities Act 2013, International Convention on Load Lines, s 5 note; s 6(2)). Disputes may therefore require interpretation of those external instruments, which may prolong enforcement processes.

Interaction with other enforcement regimes

• Constitutional reference: The instrument adopts the meaning of "property of any kind belonging to a State" from s 114 of the Constitution for the purpose of a specific exemption (s 6(2)). If contention arises about whether a vessel is State property, parties may invoke constitutional concepts. Enforcement of exemption status could therefore involve constitutional interpretation.
• Relying on the Act: Because the instrument is an exercise of the Act’s legislative power (s 3), enforcement of levy payment or of Collector non‑performance is governed by the Act and any enforcement provisions it contains. The instrument does not change penalties that may be included in the Act.

In summary, the instrument imposes administrative duties with mandatory language on Collectors and creates procedural choices for payers (for example allowing EFT) but does not itself create new penalties or enforcement mechanisms. Enforcement questions and remedies for non‑performance by either Collectors or payers fall back to the Act or to general administrative law, as the instrument provides the substantive rules for refunds and remissions but not the sanctioning framework.

The instrument is tightly interwoven with other federal legislation and an international convention by explicit reference. Its operation depends on external definitions and the Act under which it is made.

Primary enabling statute

• Marine Navigation Levy Collection Act 1989: The instrument is made under the Act (s 3). The Act contains the substantive levy provisions (for example the sections referenced in ss 7 and 8 of the instrument). The regulations do not supplant the Act; they implement collection, exemption and adjustment mechanics referenced by the Act. Where the instrument refers to levy being paid under particular subsections of the Act (for example ss 7(1), 7(2), 7(3) of the Act), the substantive liability and the persons required to pay levy are governed by the Act itself (s 5 note).

Cross‑references to other domestic statutes

• Navigation Act 2012: The instrument exempts "recreational vessel within the meaning of the Navigation Act 2012" (s 6(1)(i)). That means a vessel’s exemption status depends on the Navigation Act 2012’s definition of recreational vessel as in force, and disputes over whether a vessel is recreational will require reference to that Act.
• Fisheries Management Act 1991: The exemption for ships only being used in fishing or searching for, or taking, sedentary organisms is tethered to the Fisheries Management Act 1991 (s 6(1)(f)). The instrument therefore imports that statute’s substantive definitions of the permitted activities, and fisheries law can determine levy exposure.
• Charities Act 2013: Exemption for a ship used only for a charitable purpose invokes Part 3 of the Charities Act 2013 (s 6(1)(k)). Whether a ship is "only being used for a charitable purpose" will involve the Charities Act’s criteria for charitable status and activity.
• Constitution: Section 6(2) directs that "property of any kind belonging to a State" has the same meaning as in s 114 of the Constitution. That places some exemptions within constitutional property concepts and affects how state property is identified for levy purposes (s 6(2) and s 6(3) which extends the reference to include the Australian Capital Territory and the Northern Territory for paragraph (d)).

International instrument

• International Convention on Load Lines (London, 1966): The meaning of "tonnage length" for the instrument is the length for purposes of that Convention as amended and in force for Australia on 1 October 2018 (s 6(2)). The instrument thereby locks the relevant measurement standard to the state of the Convention at that date. If the Convention is subsequently amended, the instrument does not automatically adopt later amendments unless it is itself amended.

Interaction consequences and interpretation dynamics

• Reliance on external definitions: Because exemptions and measurement rules are defined by reference to other laws and instruments, legal determinations on levy exposure may require interpretation of multiple instruments. Disputes are likely to involve multi‑instrument reasoning rather than pure interpretation of these regulations.
• Temporal anchoring of international standard: By specifying the International Convention on Load Lines as amended and in force for Australia on 1 October 2018, the instrument fixes the measurement method to that point in time, which may create interpretive certainty or, conversely, mismatches if international practice changes thereafter.
• Administrative interplay: The Collector is required to administer the refunds and remissions, but the assessment of whether a ship is exempt, whether it is prevented from putting to sea, and the counting of relevant days, will require evidence that may be governed by other statutes’ records (for example port authorities’ logs under navigation law, fisheries records, or charity registration records).

Overall, the instrument functions as a focused administrative overlay to the Act, borrowing definitions and standards from other laws and an international convention to define eligibility and measurement. It does not operate in isolation; determination of rights and obligations will commonly require reference to the Act, those statutes and the Convention.

The instrument records its original commencement and a repeal of the prior regulations; it contains no amendment schedule beyond those matters.

• Commencement: The instrument commenced in full on 1 October 2018. The formal commencement table at s 2 records that "The whole of this instrument" commenced on that date. The table also contains a note that the table relates only to provisions as originally made and will not be updated for later amendments (s 2(1) note).
• Repeal of former regulations: Schedule 1 repeals the Marine Navigation Levy Collection Regulations 1990 in full. Item 1 of Schedule 1 reads "The whole of the instrument" to repeal the 1990 regulations. That is the only express amendment action recorded in the instrument.
• Static text on external instruments: Section 6(2) fixes the measurement standard for "tonnage length" to the International Convention on Load Lines as amended and in force for Australia on 1 October 2018, which is a temporal anchoring rather than an ongoing reference to any future amendments of the Convention. The instrument’s choice to anchor to that date means that subsequent amendments to the Convention do not automatically change the tonnage length definition unless the regulations are amended.
• Notes about the instrument’s table: Section 2(2) contains a standard drafting note that information in the commencement table’s column 3 is not part of the instrument and can be edited in published versions; this indicates the printed instrument may contain non‑statutory editorial notes, but it does not represent substantive amendment.

No other amendments, transitional provisions, or saving clauses are included in the instrument text provided. The instrument therefore appears to be an original replacement of the 1990 regulations rather than an incremental amendment of them. Any later amendments to the instrument after the original making are not recorded in the provided text and cannot be inferred from it.

The instrument does not contain or cite any litigation history. It makes no reference to judicial decisions, nor does it identify past disputes as a basis for particular drafting choices. The text names no cases and includes no schedule of judicial interpretations. Therefore, based solely on the instrument as provided:

• There is no litigation history recorded within the instrument.
• Any litigation that might concern these provisions would necessarily arise after this instrument’s commencement or relate to interpretations of the Act or the external instruments it references. The instrument itself provides the substantive rules on exemptions, refunds, remissions and the definition of prevented status, but it is silent on dispute resolution mechanisms beyond obliging Collectors to act; judicial disputes about how those duties are carried out would engage the Act and general administrative law.

Because the instrument cross‑references external statutes and an international Convention, litigated questions are likely to require interpretation of multiple instruments. For example, a judicial challenge over whether a vessel qualifies as a "recreational vessel" for exemption would require interpretation of the Navigation Act 2012 as well as these regulations. Similarly, disputes over measurement of "tonnage length" would involve the International Convention on Load Lines as it stood on 1 October 2018. However, none of those litigation threads are recorded in the instrument itself.

If a practitioner needs an authoritative account of case law interpreting these regulations, the instrument as provided gives no cases; research in case law databases and administrative decision records beyond this text would be required.

The instrument contains several technical features and drafting choices that can produce operational pitfalls for payers, Collectors and advisers. These "gotchas" arise from timing rules, definitional cross‑references, lacunae in procedural detail, and the arithmetic mechanics.

Timing windows and the "more than 30 consecutive days" threshold

• Refunds and remissions depend on a 30‑day consecutive threshold. For a refund under s 7(1) the ship must be prevented from putting to sea on more than 30 consecutive days and at least one of those days must fall in the three‑month period beginning on the day the levy became payable (s 7(1)(b)-(c)). The "more than 30 consecutive days" threshold is exacting: a period of exactly 30 consecutive days does not qualify. Precise daily counting matters because the formulae use N as the number of qualifying days in the three‑month window (s 7(2) definitions). Parties must be careful in calculating consecutive day counts and in establishing the start and end dates of the prevention period.
• Remission under s 8(1) has an asymmetrical window: remission is required if the ship is prevented on the day the levy becomes payable and prevented on more than 30 consecutive days up to and including the day before the levy becomes payable. That structure means that a ship that was laid up in the 30 days preceding the levy and was prevented on the levy day itself may qualify for remission. This timing may be confusing in practice and creates a need for clear record keeping around which days fall into which window.

Dependence on external definitions and temporal anchoring

• External statute definitions: The instrument links exemptions to definitions in other acts (Navigation Act 2012, Fisheries Management Act 1991, Charities Act 2013) (s 5 note; s 6(1)(f), (g), (i), (k)). In contested cases, parties must refer to those statutes and their factual matrices. That may complicate audits or administrative decision making because Collectors must be competent to assess matters outside the levy statute framework, such as whether an organization is a charity under the Charities Act.
• Fixed international standard date: The "tonnage length" is defined by reference to the International Convention on Load Lines as amended and in force for Australia on 1 October 2018 (s 6(2)). Tonnage measurements that changed in later amendments will not be reflected until these regulations are amended, which could produce anomalies for ships measured under later standards.

Definitions that limit flexibility in close cases

• "Prevented from putting to sea" is confined to four categories (s 10). If a ship is immobilised for a reason not captured by (a)-(d), including certain technical or regulatory embargoes or weather-related protracted port closure not framed as a wreck, stranded state, repair layup, or industrial dispute, there may be disputes about whether the vessel is "prevented" on the instrument’s terms. The instrument’s list appears inclusive; absent one of the listed states, a Collector may deny refund/remission despite significant interruption.
• The mooring category (s 10(a)) refers to being moored in a harbour "and not engaged in the ordinary employment of a merchant ship for hire or reward, including the loading and unloading of passengers or cargo". The inclusion of "including" suggests the listed activities are examples rather than exhaustive. Determining what constitutes "ordinary employment" versus incidental or exceptional activities may create interpretive disputes.

Procedural silence creates administrative risk

• No procedural rules: The instrument mandates refunds and remissions but contains no procedural prescriptions for applying for, deciding, or disputing refunds/remissions. Practitioners must therefore rely on the Act and administrative practice for timelines, evidence thresholds, and remedies. That can create uncertainty and delay in cashflow-sensitive contexts.
• Collector verification: Because the instrument does not prescribe required evidence, Collectors may develop varying administrative practices. This could produce inconsistent outcomes across ports or Collectors and increase transaction costs for operators who must negotiate differing documentary requirements.

Arithmetical complexity and recordkeeping burdens

• Required calculations use variables tied to calendar windows: refunds use variables A (amount paid), N (number of qualifying days in the relevant three‑month period), and P (number of days in that three‑month period) (s 7(2)). Remissions use A, N and Q (where Q is the number of days in the quarter beginning on the day the levy becomes payable) (s 8(3)). Correct application requires careful date accounting and agreement on which days count. Mistakes in counting N, P or Q may produce material differences in refunded or remitted sums.
• Quarter and three‑month period definitions: The instrument refers to a "3 month period" and "quarter" without defining them in the instrument itself. The note at s 5 states that "quarter" is defined in the Act. Parties must therefore consult the Act to confirm the calendar boundaries used to compute P and Q.

Incentives and scheduling effects

• The instrument’s architecture creates an identifiable incentive for owners to align long repair or lay‑up periods so that they overlap with levy payability windows. While the instrument provides relief in those circumstances, it does not regulate timing of maintenance. Parties may therefore schedule downtime strategically, taking advantage of remissions, and Collectors will need to guard against contrived arrangements. The instrument itself contains no anti‑avoidance provision; any question about contrivance will likely raise broader questions under the Act or general administrative law.

Recording and evidentiary implications

• Proof required: Given the lack of procedural detail, operators should preserve port logs, repair invoices, industrial dispute notices, and other contemporaneous records to establish that a ship was in one of the s 10 states on the relevant days and that the consecutive period exceeds 30 days. Absent such records, Collectors may defer refunds pending further proof.

These elements are embedded in the instrument’s text and must be navigated in application. Practitioners should note the narrowness of the prevention definition, the exacting nature of the day counts, the importation of definitions from other laws, and the administrative gaps that collectively create risk of delayed or disputed refunds and remissions.

This section translates the instrument’s requirements into practical compliance steps for ship operators, managers, and Collectors. It is a source‑grounded checklist and operational guidance tied to specific provisions.

1. Determine whether the vessel is exempt (s 6)

• Review s 6(1)(a)-(n) to see if the vessel falls within any listed category. Key categories include defence, Commonwealth or State property, foreign state vessels (subject to trade exclusion), vessels used solely for fishing under the Fisheries Management Act 1991, recreational vessels under the Navigation Act 2012, charitable vessels under the Charities Act 2013, vessels under 24 metres tonnage length, and sailing ships under 500 Levy Act tons.
• For exemptions depending on external statutes, obtain documentary proof: charity registration or reliance on Part 3 of the Charities Act 2013 for charitable purpose exemption (s 6(1)(k)); statutory fishing authorisations or activities records for exemptions tied to the Fisheries Management Act (s 6(1)(f)); or classification as a recreational vessel under the Navigation Act 2012 (s 6(1)(i)).
• If vessel tonnage or tonnage length is at issue, measure tonnage length as per the International Convention on Load Lines as amended and in force for Australia on 1 October 2018 (s 6(2)). Secure the measurement certificate used for classification.

2. Monitor and document "prevented from putting to sea" events (s 10)

• Understand the four triggers in s 10: (a) moored in harbour and not engaged in ordinary employment of a merchant ship for hire or reward (including loading/unloading of passengers or cargo), (b) wrecked or stranded, (c) laid up for repairs, and (d) prevented due to an industrial dispute.
• Keep contemporaneous evidence for each day a ship is in one of these states. Evidence may include port mooring logs, manifest and cargo movement records, repair invoices and shipyard work orders, photographs, correspondence showing industrial dispute impacts, and official notices of wreck or stranding.
• Mark and retain daily logs so that you can prove consecutive-day counts. The regulations require "more than 30 consecutive days" for refund/remission qualification (s 7(1)(b), s 8(1)). A break in consecutive days can negate eligibility.

3. Track levy payability windows and compute N, P, Q precisely (ss 7-8)

• Identify the day the levy became payable for the ship under the Act. The instrument’s refund and remission mechanics depend on this anchor date (s 7(1)(c); s 8(2)(b)).
• For refunds (s 7): calculate N as the number of suppressed days that fall into the three‑month period beginning on the day levy became payable, and P as the number of days in that three‑month period (s 7(2) definitions). Apply the formula in s 7(2) to compute the refund amount A × N ÷ P (formula image referenced in s 7(2)).
• For remissions (s 8): where applicable, calculate N as the number of days from the start of the day the levy becomes payable under s 7(1) to the end of the three‑month period mentioned in s 8(2)(b), and Q as the number of days in the quarter beginning on the day the levy becomes payable. Apply the formula in s 8(3) to compute the remitted amount (A × N ÷ Q).
• Consult the Act to ensure alignment on what constitutes a "quarter" or any other calendaring defined by the Act (s 5 note indicates that "quarter" is defined in the Act).

4. Engage the Collector and manage payments (s 7-9)

• Where a refund or remission is believed to be due, contact the Collector identified under the Act. The instrument mandates the Collector must refund or remit when conditions are satisfied (s 7(1); s 8(1)-(2)), but the instrument does not prescribe application processes. Anticipate that the Collector will require notice and supporting evidence.
• Make payments of levy by electronic funds transfer where preferred. Section 9 expressly permits payment of levy by EFT to a Collector. Keep bank remittance records and payment confirmations to establish the date the levy became payable and the date of payment.
• Where the Collector credits or offsets payment against other obligations, seek written confirmation and an itemised account of calculations. The instrument requires calculation using the specified formulae but does not stipulate offsets or setoff rules.

5. Preserve and organise records for possible disputes

• Maintain a clear audit trail: payment receipts, levy notices, daily ship logs, port authority records, repair and shipyard invoices, industrial dispute documentation, and copies of any communications with the Collector.
• Retain documents beyond the immediate three‑month windows because disputes about whether the conditions were met will require historical proof of consecutive days and the ship’s status on levy payment dates.

6. Anticipate administrative variability and prepare to escalate

• Because the instrument does not set documentary standards or timing for Collector decisions, expect variation in administrative practice. Prepare standardised packages of proof for submission to the Collector to reduce delay.
• If a Collector declines to refund or remit where the ship owner believes the statutory conditions are met, escalation paths will depend on the Act. Seek the Act’s review, objection or appeal procedures and be prepared to rely on general administrative law remedies.

7. Special compliance notes for particular vessel classes

• Charitable operations: confirm that the vessel’s use falls solely within Part 3 of the Charities Act 2013 to rely on s 6(1)(k). If charitable use is partial or intermittent, be cautious: the exemption is for "only being used" for charitable purposes.
• Foreign state and defence vessels: verify whether the vessel is in trade or carrying goods under freight or charter, because foreign state vessels are exempt only when not engaged in trade (s 6(1)(a)), and hospital ships are exempt except when used in trade (s 6(1)(m)).
• Small vessels: ensure correct measurement under the International Convention on Load Lines as in force on 1 October 2018 for tonnage length exemptions (s 6(2)). Where measurement is borderline, secure a formal determination or measurement certificate.

8. Account for incentive effects and record governance

• Be aware that the refund/remission architecture may encourage scheduling of repairs or lay‑ups to create eligibility. If electing to schedule maintenance, document commercial reasons for the timing to defend against any claim of contrivance.
• Implement an internal compliance protocol to log prevention events, to compute N/P/Q for each levy period, and to coordinate submissions to the Collector.

In sum, compliance requires disciplined recordkeeping tied to the instrument’s defined concepts (s 6, s 7, s 8, s 10), careful date accounting to apply the formulae correctly, direct engagement with the Collector for refunds and remissions, and cross‑reference to the Act and the external statutes referenced for threshold questions. The instrument imposes precise net‑charge mechanics but leaves procedural administration to the Collector and to the Act’s broader framework.
