### 68 Cancellation of lease by Minister
> > (1) The Minister may cancel a lease if –
> >
> > > > (a) satisfied that a lease area or part of a lease area is not being sufficiently or effectively farmed; or
> > >
> > > > (b) [*\[Section 68 Subsection (1) amended by No. 9 of 2003, Sched. 1, Applied:16 Apr 2003\]*](/view/html/inforce/2003-04-16/act-2003-009#JS1@Ja38@GC2@EN) the lessee fails to obtain a marine farming licence or ceases to hold a marine farming licence in respect of a lease area or part of a lease area.

> > (2) Before cancelling a lease under [subsection (1)](#GS68@Gs1@EN) , the Minister must –

> > > > (a) inform the lessee of the intention to cancel the lease; and

> > > > (b) invite the lessee to make any written submission; and

> > > > (c) consider that submission.
