### 57 Refusal to deal with or approve applications > > (1)  The Minister must not accept any application – > > > > > > (a) for a lease for an area which is not the subject of a marine farming development plan; or > > > > > > > (b) which is not in accordance with [section 56](#GS56@EN) . > > > (2)  The Minister, by notice in writing – > > > > > > (a) must notify the applicant that the application is not accepted; and > > > > > > > (b) may advise the applicant to consult with the Secretary. > > > (3)  In consulting with the applicant, the Secretary must advise the applicant that – > > > > > > (a) a draft marine farming development plan is being prepared or is to be prepared; or > > > > > > > (b) he or she may apply for the Minister's approval to prepare a draft marine farming development plan under [section 16](#GS16@EN) .
