### 16 Approval to prepare draft plan > > (1) The Secretary and a person, other than a person referred to in [section 15](#GS15@EN) [(1)](#GS15@Gs1@EN) , may apply to the Minister for approval to prepare a draft plan. > > > (2) An application, by a person other than the Secretary, is to – > > > > > > (a) be in an approved form; and > > > > > > > (b) contain any details the Minister requires; and > > > > > > > (c) be accompanied by the prescribed fee; and > > > > > > > (d) be lodged with the Minister. > > > (3) The Minister may – > > > > > > (a) grant the application subject to any requirement not inconsistent with any other provision of this Act; or > > > > > > > (b) refuse to grant the approval.
