MARINE (AIR-CUSHIONED VEHICLES) REGULATIONS 1994

Approved. The term “approved” means approved by the Director. This appears in relation to alternative structural analyses (regulation 11(1)) and EPIRB equipment (regulation 16(1)(f)). The Director has the role of gatekeeper for any departure from the prescribed standards. Approval is a discretionary administrative act, not defined further in the regulations.

Designer and manufacturer. The regulations define “designer” as the person or organisation responsible for the accuracy of data, drawings and specifications submitted for approval. “Manufacturer” means the person or organisation responsible for the standards and procedures adopted during construction or alteration. This allocates legal responsibility for compliance upstream. The operator who runs the vehicle may not be the designer or manufacturer, but the offence is directed at the person who operates a non-conforming craft, so an operator must verify the credentials of those upstream parties.

Volume 1 and Uniform Shipping Laws Code. Volume 1 is a specific edition (December 1985, Revision 1) of Transport Canada’s standard for dynamically supported craft. The USLC is not edition-locked in the regulations; it is referenced as “Uniform Shipping Laws Code” without a year. This means updates to the USLC automatically become part of the regulatory requirements unless an amendment to the regulations freezes a version. The Schedule references specific sections of Volume 1 and USLC for each item. For example, “Engineering requirements for main and auxiliary machinery: Uniform Shipping Law Code, Section 9” and “Fans for lift or propulsion: Volume 1, Chapter 7, Sections 740 to 746”.

Construct includes alter. By definition, “construct” is extended to include “alter”. Therefore, any modification to a hovercraft that changes its design or structure triggers the design and construction requirements of Part 3. Pre-existing vehicles exempt under the savings provision may lose their exemption once altered, though the regulation does not explicitly say so. The definition creates a trap: a routine alteration (such as replacing a fan or modifying a fuel system) could theoretically require full compliance with Part 3 if the vehicle was not originally built to those standards.

Fees. Regulation 21 states that fees payable under a Marine order made under section 163 of the Marine Safety National Law are payable for corresponding matters under these regulations. This means the fee schedule is not in the regulations themselves, but is set by a national instrument. An operator must consult that separate instrument to know the cost of survey, approval, or certification.

Strict liability offence. Regulation 22(2) explicitly states that an offence against subregulation (1) is one of strict liability. No proof of intention, knowledge, or negligence is required. The only defences available are those generally applicable to strict liability offences (such as act of God or mistake of fact if the defendant proves an honest and reasonable belief). This places a heavy burden on operators to ensure technical compliance at all times.

Exemption powers. Two separate exemption provisions exist. Regulation 5 gives the Minister a general power to exempt any vehicle from a requirement if the alternative action is at least as effective, or if compliance would cause undue hardship and substantial compliance still protects safety. Regulation 23(2) gives a more limited exemption for vehicles that were in the approval pipeline before the regulations commenced, again on an undue hardship basis. Neither provision defines “undue hardship”, leaving it to Ministerial discretion.

The primary regulated persons are any individual or entity that operates an air-cushioned vehicle in the Northern Territory. This includes commercial operators (such as tourism ventures or transport services) and private owners who use a hovercraft on Territory waters. Because the offence targets operation, a person who merely owns or stores a non-conforming hovercraft but does not operate it is not caught by regulation 22, though they may be liable under other provisions if they allow another to operate it.

Designers and manufacturers are affected indirectly. They are not the direct addressees of the offence, but their work must produce a vehicle that will comply. The definition of “manufacturer” includes responsibility for standards and procedures during construction or alteration, and the designer must supply accurate data for approval. Any approval sought from the Director will be assessed against the incorporated standards. Therefore, engineering firms and shipyards that design or build hovercraft for the NT market must have access to Volume 1 and the USLC and must understand how those standards apply.

The Director (likely the Director of Marine Safety in the NT Department of Infrastructure, Planning and Logistics, or an equivalent body) is a central actor. The Director must maintain codes for inspection, can approve or reject alternative analyses, and must approve EPIRB equipment. The Director’s office is the point of contact for survey, inspection and enforcement.

The Minister (the Northern Territory Minister responsible for marine safety) holds the exemption powers under regulations 5 and 23. This introduces a political or at least high-level administrative layer into technical compliance decisions. The Minister may also determine the charge for copies of codes under regulation 20(b).

Finally, the Australian Maritime Safety Authority (AMSA) is referenced in regulation 16(2) as an alternative approver for EPIRBs. This means that operators can seek approval from a Commonwealth body rather than the Territory Director for that specific item, creating a dual approval path.

The regulations apply to all air-cushioned vehicles in the Territory, but there is no registration or licensing requirement stated within the regulations (that is left to Part 4 of the Act and the national law). The practical effect is that any hovercraft entering the Territory (including those from interstate or overseas) must comply, unless exempted. This could affect transient vessels or those used for events, imposing a one-time compliance burden.

Duty to ensure design, construction and operation conform. Regulation 22(1) creates the central duty: a person must not operate an air-cushioned vehicle unless its design, construction and operation conform to the regulations. This is an absolute, ongoing obligation. It covers the entire vehicle as a system: design must meet Volume 1 and USLC standards; construction must follow those approved designs; and operation must be consistent with the approved limitations. There is no grace period for new vehicles; compliance is required from first operation.

Duty to carry or fit prescribed equipment. Regulation 16 sets out specific equipment duties: life-saving equipment (USLC section 10), fire appliances (USLC section 11), radio equipment (USLC section 12), miscellaneous equipment (USLC section 13 and Volume 1 Chapter 13 for securing, anchoring, mooring), navigation lights (Volume 1 sections 1470-1477), and for class 1B, 1C, 2B, 2C, 3B or 3C vessels an approved 406 MHz EPIRB. This duty is independent of other design duties. An operator must verify the vessel’s class and ensure the EPIRB is approved by the Director or AMSA.

Right to seek exemption. Under regulation 5, an operator or owner may apply to the Minister for an exemption from any requirement. The Minister must be satisfied either that the alternative measure is at least as effective, or that compliance would cause undue hardship and substantial compliance will not impair safety. This right is discretionary; there is no automatic entitlement. The lack of published criteria for “undue hardship” creates uncertainty. The right to exemption under the transitional provision (regulation 23(2)) is narrower, applying only to vehicles that were in the approval pipeline pre-1994.

Right to inspect codes. Regulation 20 requires the Director to keep a copy of every code or standard referred to in the regulations available for inspection by the public at the Director’s office during normal office hours. This is a positive right of access, though it requires physical attendance at a government office. The Director may also make copies available for purchase at a charge determined by the Minister. The regulation does not guarantee online or free access; the cost could be a barrier for small operators.

Rights in relation to alternative analysis. Regulation 11(1) permits an alternative analysis to demonstrate equivalent structural strength values, provided it is approved by the Director. Similarly, regulation 5(1)(a) allows alternative measures that are at least as effective as the requirement. These open the door for performance-based compliance rather than strict adherence to prescribed calculations, but approval is at the Director’s discretion. There is no appeal mechanism specified in the regulations.

Right to rely on pre-existing vehicle exemption. Regulation 23(1) provides that Parts 3 and 4 do not apply to a vehicle that was operating in the Territory at the commencement of the regulations (1 November 1994) or was constructed in the Territory before that date, or to a vehicle whose drawings and specifications were submitted for approval under a corresponding law before that date. This is a grandfathering right, but it is subject to the Minister’s power under regulation 23(2) to impose requirements if hardship would otherwise occur. Operators who rely on this exemption must keep records to prove the vehicle’s pre-commencement status.

The only penalty provision in the regulations is regulation 22, as substituted in 2019. The maximum penalty is 20 penalty units. In the Northern Territory, a penalty unit is currently $157 (as of 2023), so the maximum fine would be $3,140. This is a modest sum, especially for a commercial hovercraft operation. The offence is one of strict liability, meaning the prosecution does not need to prove fault. The defendant bears the evidential burden on any defence. Possible defences include an honest and reasonable mistake of fact (if the operator reasonably believed the vehicle conformed) or act of God, but the strict liability element makes conviction easier for the regulator.

The regulations do not specify who enforces them. Enforcement would likely be undertaken by police officers or marine safety inspectors appointed under the Marine Act. The power to board, inspect and detain non-compliant vessels would flow from the Act, not from these regulations. The low penalty may not deter deliberate non-compliance, especially if the cost of achieving compliance outweighs $3,140. This creates a rational incentive for a marginal operator to take a fine rather than invest in a full design review or equipment upgrade.

There is no provision for daily penalties or continuing offences. Each operation of a non-conforming vehicle is a separate offence. But the penalty cap of 20 units per offence limits the deterrent for ongoing breaches.

The elimination of Part 2 (survey and certification) in 2013 removed the requirement for a certificate of survey to be issued before operation. That change shifted enforcement from a proactive certification gate to a reactive offence regime. Now, a hovercraft can be operated without a prior inspection, and enforcement occurs only if an inspector identifies non-compliance. This reduces the administrative burden on the regulator but increases the risk that non-conforming craft operate for extended periods undetected.

Regulation 23(2) provides a limited defence or exemption for pre-existing vehicles, but it is not a defence to the offence; it is an exemption that must be sought from the Minister. An operator who relies on the transitional exemption without a formal exemption notice risks prosecutorial action if the Minister disagrees.

There is no private right of action created by these regulations. Only the regulator can prosecute. Third parties (such as passengers or other water users) cannot sue directly for breach of the regulations, though they may rely on them in civil negligence proceedings as evidence of the standard of care.

The regulations sit within a broader legal framework for marine safety in the Northern Territory and nationally. They are made under the Marine Act 1981 (NT). Regulation 4 applies Part 4 of that Act to air-cushioned vehicles. Part 4 of the Act covers survey, certificates, licensing of operators, and general safety obligations. Therefore, an operator must comply with both the regulations and the Act’s Part 4 requirements (including any orders made under the Act).

The 2013 amendments (by the Marine Safety (Domestic Commercial Vessel) (National Uniform Legislation) Act 2013) repealed Part 2 of the regulations (which previously dealt with survey and certificates) and amended regulation 4. The effect was to remove duplication between the Territory regime and the national domestic commercial vessel safety framework. Fees under regulation 21 are now tied to Marine orders under the Marine Safety National Law, a Commonwealth Act. This means that the cost of regulatory services is set nationally, not locally. Operators may need to interact with both the NT Director and the national regulator (AMSA) depending on the type of vessel and its operations.

Regulation 16(1)(f) requires an EPIRB approved by the Director or by AMSA. This creates a direct link to the Commonwealth Australian Maritime Safety Authority Act 1990. The Australian Communications and Media Authority (ACMA) also regulates radio equipment, including EPIRBs, under the Radiocommunications Act 1992. An operator must ensure that the EPIRB is both type-approved by AMSA and licensed for use.

The regulations incorporate the Uniform Shipping Laws Code. The USLC is not a law but a set of standards developed by the National Marine Safety Committee (now the Australian Maritime Safety Authority). It has no direct legal force unless adopted by a regulation. Amendments to the USLC after 1994 automatically apply to new designs because the regulations do not specify a version. However, Volume 1 is frozen at Revision 1 (1985). This creates an asymmetry: Canadian hovercraft standards are locked, but Australian USLC standards are dynamic. An operator designing a new craft must use the current USLC for electrical, fuel, fire, life-saving and radio systems, but must use the 1985 Volume 1 for hull and structural matters.

The Northern Territory’s marine safety legislation may intersect with the Navigation Act 2012 (Cth) for international voyages, though that is unlikely for a typical Territory hovercraft. If the hovercraft is used for trade or commerce between the Territory and other states, the Commonwealth’s coastal trading legislation (Coastal Trading (Revitalising Australian Shipping) Act 2012) may apply.

The savings provision in regulation 23 interacts with similar grandfathering in the national scheme. A pre-1994 hovercraft that is exempt under the NT regulations may still be subject to the national law if it is a domestic commercial vessel. Operators cannot rely solely on the NT exemption; they must check national requirements.

The regulations do not explicitly cover environmental protection or noise, but hovercraft operations may also be subject to the Territory’s Environment Protection Act and local government by-laws regarding noise, wash, and access to protected areas.

The regulations commenced on 1 November 1994 as SL No. 39, 1994. The first amendment was the Marine (Air-Cushioned Vehicles) Regulations 2001 (SL No. 4, 2001), which amended regulations 16 and 22. The 2001 changes modified the EPIRB requirement and adjusted the penalty provision.

The Statute Law Revision Act 2003 (Act No. 12, 2003) made a formal amendment to regulation 20, likely to update references to the Director or other administrative details. No substantive policy change.

The Marine Amendment Regulations 2007 (SL No. 38, 2007) amended regulation 16 again, specifying the EPIRB requirement for certain vessel classes (1B, 1C, 2B, 2C, 3B, 3C) and requiring an approved 406 MHz EPIRB. This was a major operational change, aligning the Territory with international distress beacon standards.

The most significant structural change came with the Marine Safety (Domestic Commercial Vessel) (National Uniform Legislation) Act 2013 (Act No. 11, 2013), which commenced 1 July 2013. It repealed the whole of Part 2 (regulations 6 and 7), which had dealt with survey, certificates and exemptions from survey. It also amended regulations 4 and 12, and amended the Schedule to reflect the removal of Part 2. The result was to strip out the survey and certification regime from these regulations and leave it to the national law. The 2013 Act also amended regulation 21 to tie fees to Marine orders under the Marine Safety National Law.

The Penalties Amendment (Miscellaneous) Act 2013 (Act No. 23, 2013) increased the penalty for regulation 22 from whatever it was before to 20 penalty units (the amendment is noted as amending regulation 22, but the 2019 substitution later replaced it entirely).

The Transport Legislation Amendment Regulations 2019 (SL No. 11, 2019) substituted a new regulation 22, effective 1 August 2019. This is the current version. The 2019 amendment made the strict liability element explicit (subregulation (2)) and set the maximum penalty at 20 penalty units. The previous version may not have stated strict liability so clearly.

The endnotes also note that the Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) made general formal amendments to regulation 1 (citation), likely to update drafting style.

No further amendments have been made to the published version as at 1 August 2019. Practitioners should check for any subsequent amendments, especially given the passage of time.

The source text does not cite any court cases. This is not surprising for a niche regulatory instrument in a small jurisdiction. It is likely that there has been little or no reported litigation under the NT Marine (Air-Cushioned Vehicles) Regulations 1994. The offence is strict liability with a low maximum penalty, so defendants rarely have the incentive to fight a prosecution to appeal level. Most enforcement probably results in infringement notices or plea bargains.

Potential areas of litigation could include:

• Challenge to a Ministerial refusal of an exemption under regulation 5 or 23, on administrative law grounds (e.g., failure to consider relevant factors, unreasonableness).
• A defence of honest and reasonable mistake of fact in a strict liability prosecution, requiring evidence of what the operator believed and whether that belief was reasonable.
• Disputes about whether a vehicle qualifies under the transitional exemption in regulation 23(1) - e.g., was it “operating in the Territory” or “constructed in the Territory” before the commencement date?
• Disputes about the meaning of “construct” including “alter” - does a significant refit trigger the design standards?
• Questions of incorporation by reference of the USLC and Volume 1: whether those documents are sufficiently accessible to satisfy the rule of law, and whether an operator can be convicted for violating a standard that is not publicly available except for purchase. The High Court has held in other contexts that legislation cannot incorporate documents by reference if doing so would make the law inaccessible or uncertain (but this has been accepted for technical standards in many Australian jurisdictions).
• Interaction with the national law: if a vehicle complies with the Marine Safety (Domestic Commercial Vessel) National Law but not with these regulations, which prevails? The regulations are under a Territory Act, but the national law has been adopted by the Territory. There is potential for conflict.

No case law is recorded in the source, so the deep dive must note the absence and the theoretical pathways.

Strict liability without a due diligence defence. Regulation 22(2) makes the offence one of strict liability. This means that even if an operator exercised all reasonable care and had no reason to suspect non-compliance, they can still be convicted. The only likely defence is mistake of fact, which requires the defendant to prove an honest and reasonable belief about the facts that made the conduct innocent. For example, if an operator believed the EPIRB was approved based on a false representation from the seller, they might have a defence. But a mistake about the legal requirements (e.g., thinking a standard does not apply) is no defence.

Incorporation of external standards. The regulations do not reproduce Volume 1 or the USLC. An operator must obtain those documents (or inspect them at the Director’s office) to know the exact specifications. The USLC is not version-locked, so an operator must track its current version. If they rely on an outdated edition, they may be non-compliant. The cost and effort of obtaining and keeping up with these standards is a hidden compliance burden.

Pre-existing vehicle trap. Regulation 23 exempts vehicles that were operating or in the approval pipeline before the regulations commenced (1 November 1994). That exemption only applies to Parts 3 and 4. Any vehicle built after that date must comply fully. However, if an owner purchases a vintage hovercraft that was built before 1994 but never operated in the Territory before, it does not qualify for the exemption because it was not “operating in the Territory” at the commencement. Similarly, if a pre-1994 vehicle is imported from another state, it may not have been constructed in the Territory, so only the first limb applies if it was operating in the Territory before 1 November 1994. This is a narrow grandfathering.

Alterations trigger full compliance. The definition of “construct” includes “alter”. Therefore, any alteration to a vehicle that was originally exempt could bring it within the scope of Part 3. For example, replacing the lift fans or modifying the fuel system may be considered “construction” and require compliance with the design standards. The regulation does not provide a threshold for what constitutes an alteration that triggers the requirement. A routine repair that does not change the design might not be an alteration, but the line is unclear.

No appeal mechanism from Director’s decisions. The regulations do not provide any internal review or external appeal if the Director refuses to approve an alternative analysis under regulation 11(1) or an EPIRB under regulation 16(1)(f). The only recourse would be judicial review, which is costly and limited to procedural errors or irrationality. This gives the Director significant discretion that is effectively final.

Equipment approval dual path for EPIRB. Regulation 16(2) says an EPIRB may be approved by the Director or by AMSA. But if an operator chooses an AMSA-approved EPIRB, they must still verify that the Director does not require his own separate approval. The wording is permissive (“an approved EPIRB … approved by the Director or by AMSA”), so a device approved by AMSA should be sufficient. However, if the Director has not formally adopted AMSA’s list, an operator could face an argument that only a Director-approved device is acceptable. This ambiguity should be resolved by seeking clarity from the Director.

Fees not fixed. Regulation 21 says fees are payable under a Marine order made under the Marine Safety National Law. That order may change without notice. An operator must check the current fee schedule before seeking any approval or inspection.

No requirement for ongoing recertification. After the repeal of Part 2, there is no requirement for periodic surveys or renewal of certificates. Once a vehicle is compliant at the time of first operation, there is no mandatory regular inspection under these regulations (though the Act may impose one). This could lead to degradation of safety equipment or structural integrity over the life of the vehicle without oversight.

Compliance requires a systematic approach. First, determine whether the vehicle is covered by the transitional exemption (regulation 23). If the vehicle was operating in the Territory before 1 November 1994 or was constructed in the Territory before that date, or if its drawings were submitted for approval under a corresponding law before that date, then Parts 3 and 4 do not apply. Keep documentary evidence of the vehicle’s history: registration records, construction records, original drawings.

If the vehicle is not exempt, the following steps apply:

1. Obtain the standards. Acquire Volume 1 (Transport Canada, December 1985 Revision 1) and the current Uniform Shipping Laws Code. These can be inspected free of charge at the Director’s office (regulation 20). Purchase copies if needed. Also obtain any relevant Australian Standards referenced (e.g., for fibre reinforced plastics, appropriate Australian Standard per USLC subsection 5K).

2. Design. Ensure the design specification conforms to Volume 1 Chapter 2 (item 3), including a data sheet as in Volume 1 Division 6 Appendix 1. The design must be consistent with intended operating limitations. Buoyancy and hydrostatic stability must meet Volume 1 Chapter 3. Dynamic stability must be considered at design stage per Volume 1 Chapter 4. Structural strength must be calculated per Volume 1 Chapter 5, unless an alternative analysis is submitted for Director’s approval (regulation 11(1)). Material strength requirements are set for rigid structures, fibre-reinforced plastics (Australian Standard), and flexible structures (Volume 1 Chapter 6 sections 605-606).

3. Engineering systems. Main and auxiliary machinery must comply with USLC Section 9. Fans (lift or propulsion) per Volume 1 Chapter 7 sections 740-746. Propellers per sections 760-766. Transmission components per sections 780-787. Bilge systems per sections 950-959. Fuel systems per USLC Section 9. Electrical installation per USLC Section 9.

4. Structural fire protection. Comply with USLC Section 5 Subsection F (item 15). Additionally, if there is no evacuation from passenger area to open deck, install a machinery space fire detection and smothering system (regulation 14(2)).

5. Passenger and crew accommodation. Design per Volume 1 Chapter 11. Crew stations and control arrangements per Volume 1 Chapter 12.

6. Safety equipment. Carry life-saving equipment (USLC Section 10), fire appliances (USLC Section 11), radio equipment (USLC Section 12), miscellaneous equipment (USLC Section 13 and Volume 1 Chapter 13 for securing, anchoring, mooring), navigation lights (Volume 1 Chapter 14 sections 1470-1477). If the vessel is class 1B, 1C, 2B, 2C, 3B or 3C, carry an approved 406 MHz EPIRB (approved by Director or AMSA).

7. Construction. Build in accordance with Volume 1 Division 3, Chapter 1, Chapter 2 sections 3200, 3201, 3206 and Chapter 3 (item 23).

8. Testing and trials. Conduct functional tests per Volume 1 Division 4 Part A and Part B. Conduct operational trials per Division 4 Part C and Part D. The results must demonstrate compliance to the satisfaction of the Director (regulation 18).

9. Approval and documentation. Submit drawings and specifications for approval to the Director. The designer is responsible for accuracy. The manufacturer must adhere to approved standards and procedures. Keep records of all approvals, test reports, and supplier certifications.

10. Ongoing operation. Ensure the vehicle remains in a condition that conforms to the design and construction standards as operated. Any alteration may require re-compliance. Apply for an exemption under regulation 5 if an alternative measure is at least as effective, or if undue hardship exists, providing evidence of substantial compliance.

11. Fees. Ascertain current fees from Marine orders under the Marine Safety National Law and pay as required for any services sought from the Director.

12. If relying on pre-existing vehicle exemption. Maintain evidence of the vehicle’s status. Be cautious about alterations. If the Minister issues a notice under regulation 23(2) imposing certain requirements, comply with that notice.

Compliance is a one-time burden for vehicles built after 1994, but the strict liability offence means no margin for error on any day of operation. Periodic review of vehicle condition is prudent, especially for safety equipment like EPIRBs that have battery expiry dates.
