113A Notice of acquisition

(1) Despite section 21 of the Land Acquisition and Compensation Act 1986, a notice of acquisition for the acquisition of land by a project authority under section 112—

(a) must be in the form approved by the Minister; and

(b) may contain an express declaration that—

S. 113A (1)(b)(i) inserted by No. 48/2024 s. 19.

(i) the land is to vest in the project authority; or

S. 113A (1)(b)(ii) inserted by No. 48/2024 s. 19.

(ii) if the interest in land is a right in the nature of an easement or purporting to be an easement, the interest in land is to be extinguished.

(2) The Minister must cause a form approved under subsection (1)(a) to be published—

(a) in the Government Gazette; and

(b) on the Department's Internet site.
