Despite section 5(2), new schedule 2 applies in relation to the transitional period with the modifications provided under this section. New schedule 2, sections 3 and 4 apply to the operator as if the reference in sections 3(1) and 4(1) of that schedule to the operator must prepare a plan were a reference to the operator may prepare a plan. However, until the operator prepares a plan under a new provision mentioned in column 1 of the following table and a copy of the plan is given to the chief executive under the new provision— the provision of the repealed regulation mentioned opposite the new provision in column 2 of the table continues to apply to the Authority as if the repealed regulation had not been repealed; and new schedule 2, section 2 does not apply to the Authority.
