39 Insufficient security
(1) This section applies if the security given by an objector or objectors as required under subsection 25(4) is not sufficient to meet the expenses incurred by the Commonwealth as a result of the action taken by the Comptroller‑General of Customs under this Part because of the notice given by the objector or objectors. (2) The amount of the difference between those expenses and the amount of security given: (a) is a debt due by the objector, or by the objectors jointly and severally, to the Commonwealth; and (b) may be recovered by action in a relevant court.
